Grant of annual increment due on 1st July retiring on 30th June of the year
New Delhi, dated 21.05.2020

The General Manager
All Indian Railways and Production Units
(As per standard mailing list)

Sub: Grant of annual increment due on 1st July to the employees retiring on 30th June of the year

A number of representations are being received in this office seeking grant of one notional increment as due on 1st July in favour of employee retiring on 30th June before drawing the same, exclusively for the purpose of pensionary benefits.

Also check: 7th Pay Commission Annual Increment

2. As the Railways are aware, the annual increment is granted to railway employees on completion of laid down qualifying service for the purpose. Based on the recommendations of the Sixth Central Pay Commission, as accepted by the Government of India, Railway Services (Revised Pay) Rules, 2008 were notified on the lines of Central Civil Services (Revised Pay) Rules, 2008. As per Rule 10 of above Rules, it was stipulated that there will be a uniform date of annual increment, viz. 1st July of every year and the employees completing 6 months and above in the revised pay structure as on 1 of July will be eligible to be granted the increment. There has been no change in the above rule / extant policy so as to enable grant of increment (notional or actual) on 30th June, where it was due on the following 1st July.

3. In the various representations being received in this office, certain Judgments in the case of Shri Ayyamperumal, an employee of Department of Revenue are being cited. As the details of above court matter and policy decision of concerned nodal departments were not available in this office, the matter was referred to concerned departments of Government of India seeking their advice / guidelines.

4. DOP&T vide their O.M dated 11.11.2019 have stated that the Judgment passed in the case of Shri P. Ayyamperumal is in personam. Further, the judgment pronounced by Hon’ble High Court of Madras in P. Ayyamperumal case, as endorsed by Hon’ble Supreme Court, is based on the decision in the case of M. Balasubramaniam, which was related to Fundamental Rules of State Govt. However Central Government employees are governed by Central Government Rules. Further, Hon’ble High Court of Andhra Pradesh at Hyderabad in C. Subbarao case has inter-alia observed that “A person who retires on the last working day would not be entitled for any increment falling due on the next day and payable next day thereafter, because he would not answer the tests in these Rules.” A copy of DOP&T O.M dated 11.11.2019 is enclosed herewith.

5. The Railways are therefore advised to take further necessary action to dispose off the pending representations on the issue based on above position and advice of DOP&T. The pending court cases may also be defended accordingly. Further, in case any clarification / inputs are required relating to railway Fundamental Rules and Railway Pension Rules, Finance (Estt.) dte. may also please be consulted being the nodal directorate on these aspects. This issues with the approval of DG/HR, Railway Board.

  • Coaches being modified as Isolation coaches to be available for contingency; 5000 coaches being planned initially
  • More than 6500 hospital beds of Railways to be made available as prescribed medical specifications
  • Railways to supplement the efforts of Government in tackling COVID-19
MAR 2020
In In order to prevent the spread of COVID 19, Indian Railways is making an all out effort to supplement the health care efforts of Government of India. The spectrum of steps include modification of passenger coaches as isolation coaches, equipping the existing Railway Hospitals to meet the COVID needs, earmarking of hospital beds to meet the contingencies, recruitment of additional doctors & paramedics etc.

All these facilities will be made available as mandated by the Government of India to those in need. The preparations are being done across all the zones under the supervision GMs and Medical professionals of Indian Railways.

Indian Railways is planning to initially modify 5000 passenger coaches to meet the requirement of any possible exigency of keeping some corona patients in isolation as and when required by Government. These coaches would be equipped with basic facilities needed for isolation as per medical guidelines. In case need be, more coaches can be modified. Coaches are also going to be equipped with mosquito nets, charging points for mobiles & laptop, space for paramedics etc. These coaches would be prepared zone wise.

Railways has 125 hospitals in India and of that more than 70 are being planned to be kept ready to be for any contingency as and when required. Efforts are being made to designate dedicated COVID wards or floors in these hospitals. Approximately 6500 hospital beds are being made ready to meet the possible needs of patients.

Indian Railways has already given a go ahead to Zonal heads to explore the possibility of hiring doctors and paramedics from the market and also to re-employ retired railway doctors as a temporary measure to meet the increased requirement of medical supervision and assist the authorities in charge of COVID 19 control management in the region.

It may be noted that these efforts of Indian Railways have been mounted not only to supplement the efforts of the Government of India but also to contribute to the national efforts to fight the Corana Virus.

Sub: Clarification regarding irregular fixation of pay of Running Staff promoted on or after 01/01/2006.

Ref:
i) NFIR’s letter No. IV/RSAC/ Conf./Part IX dated 23/07/2018.
ii) Rajkot/ Jodhpur Division’s letter dated 12.01.2018/29.06.2018 respectively.
iii) Board’s letter No. PCVI/2017/ CPGRAMS/1 dated 17.08.2018 addressed to GM/WR regarding irregular pay fixation of running staff in Rajkot Division (Copy annexed).

This office is in receipt of NFIR’s letter dated 23/07/2018 (copy enclosed). wherein it has stated that there has been discrepancy in fixation of pay of Running Staff promoted on or after 01/01/2006 in Rajkot/ Jodhpur Division under Western Railway /North Western Railway respectively. In support of this, they have relied upon Rajkot/ Jodhpur Division’s letter dated 12.01.2018/29.06.2018 respectively (copy enclosed).

2. Prima facie observation of the concerned Division’s letter indicates there exists some confusion in the methodology of pay fixation of Running Staff promoted on or after 01/01/2006. As.the Railways are aware, the pay fixation of existing staff, already in service on the date of effect of RS(RP) Rules, 2008 viz. 01/01/2006, in the revised pay structure is governed by Rule 7 of above rules notified vide Gazette Notification No. GSR 643 (E) dated 04/09/2008 (RBE No.103/2008). For the above purpose, fitment tables were issued vide Board’s letter No. PCVI/2008/I/RSRP /1 dated 11/09/2008 (R.BE No. 108/2008) which are applicable to non running Staff. Since existing running Staff (already in service as on 01/01/2006) was in receipt of Dearness Allowance on Pay Element, separate fixation table were issued for fixation of their pay in revised pay structure in terms of Rule 7 of RS(RP) Rules. 2008 vide Board’s letter No. PCVI/2008/I/RSRP/1 dated 12/09/2008 (RBE No. 109/2008). As prescribed in Rule 7 of RS(RP) Rules, 2008, if fixation of pay as per Rule 7( 1)(A)(i) is short of minimum of applicable revised pay band (viz .Minimum of PB- 1 to PB-4 as applicable to the employee) or pay scale (applicable to HAG & higher grades), such minimum would be allowed , as laid down Rule 7(1)(ii). The provisions of Rule 7(1)(A)(ii) have already been taken care of while issuing fitment tables vide Board’s letter dated 11/09/2008 & 12/09/2008. The fitment tables are also applicable in the cases where an existing employee (already in service as on 01/01/2006 opts to have his pay fixation from a date later than 01/01 /2006, in terms of Rule 5 ,6 & 11 of RS(RP) Rules, 2008 as clarified vide Clarification No.3 of Board’s letter No. PCVI/2008/I/ RSRP/ dated 25/09/2008 (RBE No. 132/2008).

3. There is no prescribed minimum, other than minimum of the applicable pay band in the case of those promoted on or after 01/01/2006, where an employee is fixed in any of the applicable pay bands. The minimum pay in pay band as prescribed in First Schedule Part A, Section II of RS(RP) Rules, 2008 and corresponding stipulation in first schedules annexed with Board’s letter dated 11/09/2008 (RBE No. 108/2008) is applicable only for direct recruits appointed on or after 01/01/2006 belonging to Running as well as non running categories. The position has been clarified in detail in Board’s letter No. PCVI/2010/I/ RSRP/1 dated 17/02/2010 (RBE No. 28/2010). As such once the pay of any existing employee (already in service as on 01/01/2006) is fixed in revised pay structure in the applicable pay band as per the provisions of Rule 7 or 11 and he is subsequently promoted to a post in same or other pay band, his fixation has tp be made as per Rule 13 Even at this stage, the minimum of applicable pay band (PB-1 to PB-4) or scale (HAG or above) as applicable is to be ensured.

4. In view of this. it is requested that the Rajkot / Jodhpur Division’s letter dated 12-01-2018/ 29-06-2018 respectively be examined in light of relevant instructions and the necessary corrective action taken and thereafter, the position be advised to this office. Further if any specific point of doubt arises, the same may be referred to this office for clarification along with the views of PFA of the Railways.

2. References were received in this office seeking clarification whether the rule allowing option for drawl of pension/ family pension, instead of NPS corpus, is also applicable retrospectively for the cases where corpus of NPS has already been paid to the deceased employee’s legal heirs before issue of board’s letter No. 2008/AC-II/21/19 dated 29.05.2009. If the date of application of additional benefit is retrospective, whether it is from the date the employee deceased or from the date of issue of Board’s letter dated 29.05.2009. Also, whether the arrears of pension/family pension is to be paid (upon surrender of NPS Corpus) or not, and the amount is likely to be huge which would impact the Railway Finances. Clarification was, also, sought whether the interest on the corpus is to be charged from the date of payment of corpus amount till the date of is surrender and if so, at what rate.

3. The above issue has been examined in consultation with Department of Pension and Pensioners’ Welfare (DOP&PW), the nodal Department of pensioner matters. The General Managers / Principal Financial Advisors,
ll Zonal Railways / Production Units.

Sub : Reckoning of Charge Allowance for the purpose of revision of Pension of Pre-2016 retirees in terms of 7th CPC recommendations - reg.

Consequent upon the recommendations of 7th CPC, instructions were issued vide Board’s letters No.2016/F(E)III/1(1)/7 dated 10.08.2016 and 22.05.2017, regarding revision of pension / family pension of pre-2016 pensioners / family pensioners. A number of references have been received in this office for reckoning of Charge Allowance for the purpose of notional fixation of pay and accordingly revision of pension w.e.f. 01.01.2016.

2. The true nature of charge allowance was earlier considered by the Board and it was decided that the charge allowance, which is actually in the nature of pay restricted under FR-35. should be reckoned as 'Pay' as defined in Rule 1303(FR-9)(21) (a)(i) R-II/6th Edition and as such, it would count as pay for the purposes of pension. gratuity etc. as well as for leave encashment. Accordingly, instructions were issued vide letter No. F(E)III/94/PN1/26 dated 23.06.1995.

3. The issue has again been examined in Board keeping in view the earlier decision on charge allowance cited in para 2 above and it has been decided as follows:-
  • Since. Board had already decided to treat the charge allowance as pay restricted under FR-35 and to reckon it as emoluments for pensionary benefits vide letter dated 23.06.1995, the charge allowance may be taken into account for notional fixation of pay for the purpose of revision of pension / family pension of pre-2016 retirees w.e.f. 01.01.2016 in terms of first formulation as conveyed by Board’s letter No. 2016/F(E)III /1(1)/7 dated 22.05.2017.
  • Pay fixed in terms of Board’s letter No. PC-VII/2017/ 1/7/5/8 dated 08.08.2019 w.e f. 01.07.2017 may also be treated as emoluments in terms of Rule 49 of the Railway Services (Pension) Rules, 1993 for the purpose of fixation of pension.
  • Since, Charge Allowance may have been paid w.e.f. 01.01.2016 to 30.06.2017 at old rates which was admissible before 2016, the same may be reckoned for calculation of retirement benefits of employees who retired between the periods from 01.01.2016 to 30.06.2017.

Sub: Accident Free service award to the employee retired after 01.01.2016.

Ref: Board’s letter of even no. dated 28.11.2018

Vide Board’s letter referred above, it was clarified that the Accident Free Service Award to the staff retired after 01.01.2016 shall be paid as per the salary structure of 7th CPC and no arrears shall be admissible to whom the award is already disbursed.

Various Railways have brought out that some of the staff that had retired between 01.01.2016 & 28.11.2018 have been paid Accident Free Service Award as per 6th CPC pay structure while some of them have still not been paid the award due to various reasons and would therefore, be eligible for award as per 7th CPC pay structure. This would lead to different treatment meted out to two sets of staff retired during the same period.

In this respect, Board has examined the matter and it has been decided that the Accident Free Service Award will be paid as per 7th CPC pay structure w.e.f. 01.07.2017, the date on which revised rate of allowances as per the 7th CPC came into effect. Therefore, the staff who have retired between 01.07.2017 & 28.11.2018 and have been paid as per 6th CPC pay structure will be eligible for payment of arrears of the Accident Free Service Award as per 7th CPC pay structure.

Dear Sir,

Subject: Payment of Leave Salary to the Running Staff after implementation of 7th CPC recommendations-reg.

Ref: (i) NFIR’s PNM Items No. 47/2018 & 57/2016.
(ii) Railway Board’s letter No. E(P&A)II/2017/RS-22 dated 28/12/2018 (RBE No.2204/2018).

Federation invites kind attention of the Railway Board to the references cited above relating to payment of Leave Salary to the Running Staff pursuant to the implementation of the recommendations of 7th Central Pay Commission. Federation once again reiterates that though the Railway Board have issued orders vide RBE No. 204/2018 dated 28/12/2018 but, however, there is no clarity in the said orders regarding date of effect i.e. from 01/01/2016, consequently in the provision in IPAS, date of effect has been taken as 01/07/2017 and the Running Staff have been put to recurring financial loss for 18 months (from 01/01/2016 to 30/06/2017) leave salary. Though the Federation has been making efforts to persuade the Railway Board to set right the technical snag but however action to correct/up-date IPAS has no been taken yet with the result Federation continues to receive grievances from the Running Staff from Zonal Railways.

Also check: 7th CPC: Payment of leave salary to the running staff after the implementation of 7th CPC recommendations

NFIR, therefore, once again urges upon the Railway Board to kindly intervene and issue suitable instructions to all concerned to rectify/up-date the IPAS giving effect to the instructions vide RBE No. 204/2018 dated 28/12/2018 from 01/01/2016 repeat from 01/01/2016 and not from 01/07/2017.
Action taken in the matter may kindly be apprised to the Federation.

Chance to eligible Multiple Disability (MD) ‘Divyangjan’ Level-1 candidates to correct disability option for Railway jobs

Ministry of Railways

Another chance to eligible Multiple Disability (MD) ‘Divyangjan’ Level-1 candidates to rectify disability option for Railway jobs

Eligible MD Divyangjan candidates who have filled in their Disability option incorrectly while applying can now represent to the RRC of the Zonal Railway they had opted for with proof. Option to be available from 23rd December 2019 on RRC websites

Divyangjan Railway jobs

It may be recalled that Railway Recruitment Boards (RRBs) had advertised through their centralized CEN 02/18 notification for around 63000 vacant Level-1 posts in early February,2018. Consequent to the notification of the revised Divyangjan Act (RPWD Act, 2016) and orders of the Hon’ble Delhi High Court in a case filed by an organization for one of the Divyangjan categories, a corrigendum was issued on Feb 28, 2018. An extended one month window was provided to enable the Divyangjan categories included in the revised Act, including candidates with identified Multiple Disabilities (MD) to apply for the examination. Around 1.17 crore candidates including around 1.54 lakh Divyangjan appeared at the Computer based written tests. The number of vacancies reserved for Divyangjan  is over 2400, with around equal number reserved for the four Disability categories of Locomotor Disability (LD), Visually Impaired (VI), Hearing Impaired (HI), and Multiple Disability (MD). MD refers to candidates having more than one Disability among the other three Categories of LD, VI and HI.

The vacant posts notified for any Zonal Railway are being filled in as per merit position among those who have opted for that zonal Railway and have secured the minimum qualifying threshold marks and qualified in the Physical Efficiency Tests (PET) conducted by the Railway Recruitment Cells (RRC) of the respective Zonal Railways. Divyangjan candidates have not only been fully exempted from PET, but have been accorded 2 marks relaxation in minimum qualifying cut-offs as well. Their final selection, subject to Document Verification and Medical Examination, is therefore based on their merit position in the Computer Based Tests for their Disability category and Zonal Railway they had opted for.

While over 1025 Divyangjan candidates have already been finally selected and several more candidates’ cases are under verification/medical examination, it has been observed that the MD category has remained mostly unfilled in all Zonal Railways. It is a fact that this Category has been included as per the revised Act fairly recently and the CEN 02/2018 is among the earliest recruitment notifications to incorporate this Disability Category.

In this context, several Divyangjan candidates & groups have represented that due to unfamiliarity with the revised Categorisation and application protocol, they have filled in only Single Disability (either LD or VI or HI) option in the application form, instead of two or more of the Disabilities that they are affected with. Due to this inadvertent exercise of option, such candidates have therefore been considered only against the respective single Disability Category of LD or VI or HI as per option, and not as MD to which they actually belong.

The above representation has been considered in the Ministry of Railways, and it has been decided to allow a window period for such candidates to represent for considering them against MD Category vacancies. Accordingly, those eligible Divyangjan MD candidates who actually have more than one benchmark Disability among the three single Disability categories of LD, VI and HI but have inadvertently opted for only a single Disability Category in their application forms for the Level-1 CEN 02/2018 recruitment notification will now get another chance to be considered against unfilled MD Category vacancies of the Railway zone they had originally opted for. Such eligible Divyangjan MD candidates, who have a score of 38 or more in the written Computer Based Test (28 or more for Divyangjan of SC/ST/non-creamy layer OBC) will be able to represent to the RRC of the Zonal Railway they had opted for with proof of their belonging to MD Category. The notification and format for representation is scheduled to be available in the relevant RRC/RRB websites from 23rd December 2019 for around a fortnight. From amongst the eligible applications so received and scrutinised, shortlisting for further processing for filling up the unfilled MD vacancies will be done as per merit position. Indicative notice has already been published in newspapers for advance information of the eligible MD Category Divyangjan in this regard.

Indian Railways continues to remain committed to the cause of empowerment of Divyangjan and in following all applicable laws and provisions in this regard in letter and spirit. The dispensation being adopted above is an illustrative example in this regard.
