7TH CPC PAY FIXATION METHODOLOGY

DETAILED REPORT WITH 2 ILLUSTRATIONS

Examples of two pay fixation methodology

1. where a Railway Servant has been placed in a higher grade pay or scale between 1st day of January, 2016 and the date of notification of RS(RP) Rules, 2016 on account of promotion or upgradation and elect to switch over to revised pay structure from the date of such promotion/upgradation.

2. fixation of pay in case an employee elect to continue to draw pay in existing pay structure until he vacates his post or ceases to draw pay in the existing pay structure with respect to promotion upgradation.

Pay as on 1.1.2016 in existing pay structure Rs. 17300 + GP Rs. 4200 = Rs. 21500
Pay as on 1.7.2016 after annual increment Rs. 17950 + GP Rs. 4200 = Rs. 22150

Relevant Cell in Level-6 : Rs. 58600
Fixation on promotion in Level-7 w.e.f. 15.11.2016. As per Rule 13 of RS(RP) Rules, 2016, one increment shall be given in the Level from which the employee is promoted and he shall be placed at a cell equal to the figure so arrived at in the Level of the post to which promoted and if no such cell is available in the Level to which promoted , he shall be placed at the next higher Cell in that Level. In the instant case, next Cell to Rs. 58600 in Level-6 is Rs. 60400. The same figure is available in Cell 11 of Level-7.

Therefore, pay will be fixed at Rs. 60400 in Level-7

Note: It may be noted that though the employee can continue in 6th CPC pay structure till he vacates the posts, promotional benefit can only be granted in the 7th CPC scale.

Board's attention is invited towards this federation's letter of even number dated 2nd April, 2018 (copy enclosed), vide which it was pointed out that, on implementation of new formula, recommended by the VII CPC, rates of Night Duty Allowance get reduced rather than any improvement therein.

A calculation table was also appended in our letter referred to above, explaining the actual reduction in Night Duty Allowance on implementation of current formula, recommended by the VII CPC, which we are again quoting hereunder for ready reference:-

Rates of Night Duty Allowance, as per 6th CPC formula (mean value of Pay Band + GP) + DA)/215, changed by the 7th CPC, i.e. (Basic Pay + DA)/200, will decline by 20% to 40% from the existing, i.e.

Also rates of the NDA were not declared by the Railway Board on 01.07.2016 and 01.01.2017 as per 6th CPC.

It is, therefore, reiterated that, the issue may be looked into afresh in the light of the foregoing, and improvement in the formula, recommended by the VII CPC, may be done, so that, rates of Night Duty Allowance get improved rather than any reduction therein.

This may kindly be treated as "Most Urgent" as there is serious discontentment brewing among the staff, particularly Running and Traffic Staff and other Safety Categories Staff who have to invariably perform night duty.

Sub:  Grant of Tough Location Allowance to Central Govt. Employees of Darjeeling.

This is to bring to your kind notice that Hill Compensatory Allowance (HCA) was being paid till June 2017 to the employees of Darjeeling. Unfortunately HCA has been withdrawan from the month of July 2017 onwards after implementation of 7th CPC Allowance Committee report. However, the neighbouring state, Sikkim is still getting the Special Compensatory Allowance (SCA). It is worth mentioning that Darjeeling and Sikkim share same type of terrain, alongwith climatic conditions. It is further to mention here that the employees of some hill areas viz; Shimla in Himachal Pradesh, comparatively similar to Darjeeling Hills, are enjoying Tough Location Allowance (TLA). But the employees of Darjeeling are deprived of both the Tough Location Allowance (TLA) and Special Compensatory Allowance (SCA).

Darjeeling being the world famous tourist spot and the "Queen of Hills" is one of the expensive place to live in as all the basic commodities are to come from Siliguri, which is a 'Y' category city with 16% HRA. This has led the employees of Darjeeling being economically handicapped with the removal of Hill Compensatory Allowance.

In view of the above, I request you to review the orders withdrawing the Allowance already enjoyed by the employees of Darjeeling, and Consider grant of any kind of Special Duty Allowance/Tough Location Allowance/High Altitude Allowance as a special case, considering the geographical, climatical and economical hardship faced by the employees.

Attention is invited to Board letter under reference prescribing criteria for Physical Efficiency Test (PET) for recruitment of staff for all categories in Level - 1 of 7th CPC Pay Matrix (earlier Grade Pay 1800/-) on Indian Railways.

2. The matter has further been reviewed, keeping in view the requirement of the job and it has been decided by Ministry of Railways (Railway Board) to amend the existing criteria for recruitment from open market in all categories in Level-1 , as per norms prescribed below:

Male Candidates
(i) Should be able to lift and carry 35 kg of weight for a distance of 100 metres in 2 minutes in one chance without putting the weight the weight down;
(ii) Should be able to run for a distance of 1000 metres in 4 minute and 15 seconds 5 minutes and 40 second
Female Candidates
(i) Should be able to lift and carry 35 kg of weight for a distance of 100 metres in 2 minutes in one chance without putting the weight the weight down;
(ii) Should be able to run for a distance of 1000 metres in 5 minutes and 40 second
3. The above norms will be applicable in all future recruitment from open market in Level-1. Notification, 1f any, issued may please be amended,Suitably by issuing a corrigendum.

General

1.1. Level of Ranks.

Introduction, Aim and Preview

INTRODUCTION

1. The 7 th Central Pay Commission (CPC) has been implemented for the Defence Forces vide Govt MoD Gazette Notification S.R.O. 12 (E) dt 03 May 2017 and S.R.O. 9 (E) dt 03 May 2017. This Info Brochure has endeavoured to combine the entitlements of each indl alongwith relevant authorities so that benefits of 7th CPC are exploited to the maximum.

2. The 7th CPC makes a major departure from its predecessors, in so far as the pay structure is concerned. The recommendations of 7 th CPC involves dispensing with the existing Pay Bands and Grade Pay and instituted Pay Levels which correspond to the erstwhile Grade Pay. The 7th CPC has proposed a Pay Matrix for the purpose of pay fixation of the employees. The major features of the 7th CPC, as related to Army, are as under:-

(a) The recommendations to take effect from 01.01.2016.

(b) The minimum revised pay approved is Rs 21700/- {in place of Rs 8460/- (6460/- + 2000) and the maximum is Rs 250000/- (in place of Rs 90000/-)}.

(c) A Fitment Factor of 2.57 is applied for transition from 6 th CPC to 7th CPC.

(d) Annual increment will be calculated by transiting one stage vertically down in the same Level.

(e) MACP shall continue to be granted without any changes.

(f) Separate Pay Matrix for Defence Personnel and Military Nursing Services Officers.

(g) All Allces have been rationalized.

(h) Most of the Allces have been raised corresponding to the rise in Dearness Allowance (DA).

(i) House Rent Allowance (HRA) shall be revised to 24%, 16% and 8% of Basic Pay in X, Y and Z Cities respectively. Rate of HRA will be revised to 27%, 18% and 9% when DA crosses 50% and further to 30%, 20% and 10% when DA crosses 100%.

(j) Non Practicing Allowance (NPA) and Military Service Pay (MSP) not to be included for calculating HRA, Composite Transfer Grant (CTG) and Annual Increment.

(k) All non-interest bearing advances to be abolished. (m) Ceiling for Gratuity to be enhanced to Rs 20 lakhs wef 01.01.2016 and thereafter increase of 25% to be allowed whenever DA rises by 50%.

3. The aim of this Information Brochure is to info all ranks about their entitlements in respect of Pay, Allces, Pension and Conditions of Service post implementation of 7 th CPC.

The Union Cabinet chaired by the Prime Minister Narendra Modi has approved the revision in the salaries, gratuity, allowances, pension etc. of the Judges of the Supreme Court and the High Courts and retired Judges of Supreme Court and High Courts. It follows the implementation of recommendations of the 7th Central Pay Commission in respect of Civil Servants.

The approval will pave the way for necessary amendments in the two laws viz. Supreme Court Judges (Salaries and Conditions of Service) Act, 1958 and High Court Judges (Salaries and Conditions of Service) Act, 1954, which govern the salaries of Chief Justice of India (CJI), Judges of Supreme Court of India, Chief Justices and all Judges of High Courts.

The increase in the salary and allowances etc. will benefit 31 Judges of Supreme Court of India (including the CJI) and 1079 Judges(including the Chief Justices) of High Courts. Besides, approximately 2500 retired Judges will also be benefited on account of revision of pension/gratuity etc.

Arrears on account of revised salaries, gratuity, pension and family pension w.e.f 01.01.2016 will be paid as one time lump sum payment.

Background:

Salaries, gratuity, pension, allowances etc. in respect of Judges of Supreme Court are governed by the Supreme Court Judges (Salaries and Conditions of Service) Act, 1958. Salaries etc. of Judges of High Courts are governed by High Court Judges (Salaries and Conditions of Service) Act, 1954. An amendment in the Acts is required whenever there is any proposal for revision of salaries/pension gratuity, allowances etc. in respect of Judges of Supreme Court and High Courts. Therefore, Government proposes to move a Bill in the Parliament in the ensuing Session for amendment in the relevant Acts for giving effect to the revision of salaries and allowances.

Subject: Grant of Extra Work Allowance (abolition of existing Flight Charge Certificate Allowance) - decision of the Government on the recommendation of the Seventh Central Pay Commission.

Sir,
I am directed to refer to MoD letter No.1 (54)/2008/D(Pay/Services) dated 04.11.2008 and Department of Expenditure OM No.12-3/2016-E.III(A) dated 20.07.2017 and to say that consequent upon the decision taken by the Government on the recommendations of the Seventh Central Pay Commission vide Ministry of Finance Resolution No.11-1/2016-1C, Flight Charge Certificate Allowance has been abolished as a separate allowance and the President is pleased to decide that the eligible personnel shall now to be covered under a New Extra Work Allowance which shall be governed as under:
(a) Extra Work Allowance will be paid at a uniform rate of 2% (two percent) of the basic pay per month.

(b) An employee shall receive this allowance for a maximum period of one year, and there should be minimum gap of one year before the same employee is deployed for similar duty again.

(c) This allowance should not be combined, i.e., if same employee is performing two or more such duties and is ellqible for 2 percent allowance for each add-on, then the total Extra Work Allowance payable will remain capped at 2 percent of basic pay.

(d) The other terms and conditions would continue to be applicable along with their admissibility (unless otherwise stated) as mentioned in MoD letter dated 04.11.2008 and otherwise.
3. These orders shall take effect from 1st July, 20174.

4. This issues with the concurrence of the Ministry of Defence (Finance) vide their Diary No.446/AG/PD dated 05.10.2017.

Message Regarding 7 CPC

1. "GoI, MoD has extended sanction of Operation Rhino for a further period of 3 months with effect from 15/06/2017 to 14/09/2017 or till the termination of Op Rhino whichever is earlier". Units may publish Part II orders accordingly.

2. "Govt orders have been received vide SRO No 17(E) dated 06/07/2017 notified in Gazette of India No 14 dated 07/07/2017 and acted upon in Aug 2017. As per the orders, index of rationalization (IOR) of level 12A & 13 of the Defence Pay Matrix has been enhanced from 2.57 to 2.67 for the entry level Pay but the multiplication factor is retained as 2.57. In some cases pay fixed on 01/01/2016 as per revised Pay matrix would be less than that fixed earlier as per SRO 12(E) dated 03/05/2017, leading to recovery in August 2017 pay account. A few examples are cited at Annexure "A".

OFFICE MEMORANDUM

Sub: Implementation of Government's decision on the recommendations of the Seventh Central Pay Commission - Fixation of Pension of Medical Officers retired during 1.1.2016 to 30.6.2017

In accordance with Rule 33 of Central Civil Services (Pension) Rules, 1972 the emoluments reckoned for calculation of pension include Non-practicing Allowance (NPA) granted to medical officers in lieu of private practice.

2. In the case of medical officers who have retired from 1.1.2016 to 30.6.2017, the pension is based on emoluments which included NPA @ 25% of the pre-revised pay. Orders have been issued by Ministry of Finance (Department of Expenditure) vide OM No.12-2/2016-EIII.A dated 7th July, 2017 for grant of NPA to serving medical officers @ 20% of basic pay w.e.f. 1.7.2017. Accordingly, the medical officers retired/retiring on or after 1.7.2017 are entitled to pension based on emoluments which include NPA at the rate of 20% of the revised basic pay.

3. The matter regarding revision of pension of the medical officers who retired during 1.1.2016 to 30.6.2017 based on revised rate of NPA has been examined by the Government. It has been decided that the pension/family pension in respect of medical officers who retired/died during 1.1.2016 to 30.6.2017 shall be further revised w.e.f. 1.7.2017 by adding NPA @ 20% to the basic pay on the date of retirement.

4. The fixation of pension/family pension of retired medical officers in the above manner will be further subject to the condition that emoluments (i.e. Basic Pay + NPA) to be reckoned for pension do not exceed Rs.2,37,500/- (Rupees two lakh thirty seven thousand and five hundred only).

5. This issues with the approval of Ministry of Finance, Department of Expenditure vide their I.D. No. 1(18)/E-V/2017 dated 23rd October, 2017.

Subject:- Implementation of the recommendations of Seventh Central Pay Commission relating to Headquarters Special Pay/Special Allowance admissible to officers of the Organized Group 'A' services on their posting in their respective Headquarters - reg.

This Department's OM No.2/22(A)/2008-Estt(Pay-ll) dated 3rd September, 2008 provided for rates of Headquarters Special pay/ Special Allowance admissible to officers of the Organized Group 'A' services on their posting in their respective headquarters.

2. As provided in para 7 of Ministry of Finance (Department of Expenditure)'s Resolution No.1-2/2016-IC dated 25th July, 2016, the matter regarding allowances (except Dearness Allowance) based on the recommendations of the 7th Central Pay Commission (CPC) was referred to a Committee under the Chairmanship of Finance Secretary and until a final decision thereon, all allowances have been paid at the existing rates in the existing pay structure.

3. The decision of the Government on various allowances based on the recommendations of the 7th CPC and in the light of the recommendations of the Committee under the Chairmanship of the Finance Secretary has since been issued as per the Resolution No.11-1/2016-IC dated 6th July, 2017 of Department of Expenditure.

4. As mentioned at SI.No. 76 of the Appendix-II of the said Resolution dated 6th July, 2017, the recommendation of the 7th CPC for abolition of Headquarters Allowance has been accepted by the Government and this decision is effective from 1st July, 2017. Accordingly, the President is pleased to abolish the Headquarters Special Pay/ Special Allowance in respect of officers of the Organized Group 'A' services on their posting in their respective Headquarters.

5. Accordingly, the entitlement and payment of Headquarters Allowance is discontinued from the salary of the month of July, 2017. A copy of Department of Expenditure's OM No.29/1/2017-E.II (B) dated 11th July, 2017 on Payment on account of discontinued allowances is enclosed for reference.
6. In so far as persons serving in the Indian Audit & Accounts Department are concerned, these orders issue after consultation with the Comptroller & Auditor General of India.

Subject: Implementation of recommendation of the Seventh Central Pay Commission on Dress Allowance - regarding.

The undersigned is directed to state that in pursuance of the decisions taken by the Government on the recommendations of Seventh Central Pay Commission, and in supersession of the existing orders relating to admissibility of Uniform Allowance/ Washing allowance/ Stitching Charges /Shoe allowance, etc to common categories of Group 'C' and erstwhile Group 'D' employees of various Ministries/Departments, including attached/ subordinate offices, who are supplied uniform and are required to wear them regularly, they shall be paid Dress Allowance at the rate of Rs. 5000/- per year.

2. The Uniform Allowance/Washing Allowance/Stitching Charges/Shoe Allowance, etc. have been subsumed in Dress Allowance.

3. The categories of Staff who were earlier being provided uniforms if any, shall henceforth not be provided with uniform.

4. Allowance related to maintenance and washing of uniform is subsumed under Dress Allowance, and will not be payable separately.

5. The amount of Dress Allowance shall be credited to the salary of employees directly once a year in the month of July.

6. The rate of Dress Allowance shall be, as mentioned in para-1 above, Rs.5oo0/- per year. The rate of Dress Allowance shall go up by 25% every time the Dearness Allowance rises by 50%.

7. This allowance covers only the basic uniform of the employees. Any special clothing will continue to be provided by the concerned Ministry as per existing norms.

8. This order shall take effect from 1st July, 2017.

Consequent upon the publication of Gazette Notification by Ministry Of Finance, Deptt. Of Expenditure dated 06/07/2017 regarding different allowances namely TA/DA, LTC etc , it is seen that entitlement of Govt. servant for different kind of journey and also entitlement for their mode of transport, stay and lump sum amount etc directly linked with Pay Levels of the Pay Matrix.

Hence, it is enjoined upon all concerned that, claim of the Govt. servant, who commence journey on or after 1st July 2017, may invariably to be indicated with Pay Levels of the Pay Matrix positively, to process the same as per entitlement at this end.

Sub: Brief of the Standing Committee of National Council (JCM) held today with the Additional Secretary, Department of Expenditure

A meeting of the Standing Committee of National Council(JCM) with the Additional Secretary, Department of Expenditure, has taken place today to discuss about the issues arising after the implementation of the 7th CPC recommendations.

At the beginning of the meeting: the Official Side briefed about the decision taken by the Government on the Allowances. The Staff Side thereafter raised the following issues:-

1. The Central Government Employees are dissatisfied by the decision taken by the Government not to revised the HRA percentage recommended by 7th CPC. The demand of the Staff Side is reiterated for retaining the existing percentage of 30%, 20% and 10%.

2. The low paid employees who were getting Transport Allowance @ Rs.3600 + DA a on 1.1.2016 is subject to huge financial loss since their Transport Allowance has been reduced to Rs.1300+DA. This injustice should be rectified. Official Side agreed for a review.

3. Even though the demand of the Staff Side is that, Allowances should also be revised from the date of revision of pay i.e.1.1.2016, at least Government should have given the same from the date of notification of 7th CPC as was done during the previous pay commissions. The Official Side is requested to consider this demand. The Staff Side also drawn attention of the Official Side towards the Awards given by the Board of Arbitration in favour of the employees in the past in the regard.

4. As regards Minimum Pay Fitment Formula, the Staff Side has already the justification for increasing Minimum Pay and Fitment Factor. However, Official Side has not yet responded till date on this demand. Since Minimum Pay is not derived on the basis of Dr.Akryod Formula / 15th ILC norms and Supreme Court judgement, the issue requires the review by the Government. Morever, even in the existing Pay Matrix there is discrimination between the low paid employees and high paid officers. Therefore, this demand should be discussed with the Staff Side by the Official Side so as to settle this major issue which was agreed to be considered by the Group of Ministers.

5. Government may restore various advances withdrawn and should also issue orders for revision of HBA as recommended by 7th CPC and accepted by the Cabinet.

6. While thanking the government for restoring Risk Allowance to the Defence Civilian Employees, the revised rate is very negligible. It should be at least at par with the Risk Matrix given to the Fire fighting Staff.

7. Staff Side, while thanking the government for restoration of some of the allowances, abolished/subsumed by the 7th CPC, asked the Finance Ministry to remove the barrier of coming back to Finance Ministry in case of 12 allowances meant for the Running Staff of the Indian Railways, being bilateral settlement with the Railway Ministry.

The Staff Side informed the Chairman that, considering the discontentment prevailing amongst the Central Government Employees, the Official Side may convey the feelings of the Staff Side to the Government on the above issues, and in case if ther is no positive approach from the Government, then there will be alternative than to plunge into Action Programmes.

The chairman, after a patient hearing, responded as follows :-
1. The views expressed by the Staff Side would be conveyed to the Government.
2. As regards, Minimum Pay and Fitment Factor, the Staff Side may give additional grounds and justification for any revision, so that the Official Side can consider the same.
3. After receipt of the above note from the Staff Side, the next meeting would be convened.

Subject: Revision of pension of pre-2016 pensioners / family pensioners in implementation of Government's decision on the recommendations of the 7th Central Pay Commission Concordance
tables- regarding.

The undersigned is directed to refer to this Department’s OM of even number dated 12.05.2017 on the above subject and to say that instructions were issued for revision of pension / family pension with effect from 01.01.2016 in respect of Central civil pensioners / family pensioners who retired/died prior to 01.01.2016 by notionally fixing their pay in the pay matrix recommended by the 7th Central Pay Commission in the level corresponding to the pay in the pay scale / pay band and grade pay at which they retired I died. It was provided that 50% of such notional pay shall be the revised pension and 30% of the notional pay shall be the revised family pension w.e.f. 01.01.2016.

2. It was also provided that the revision of pension will be done by notional pay fixation under each intervening Pay Commission based on the formula for revision of pay. Based on the fitment tables provided by the Department of Expenditure, concordance tables for fixation of notional pay and pension / family pension of employees who retired/died in various grades during the 4th, 5th and 5th Pay Commission periods have been prepared and the same are enclosed herewith. In the case of those employees who retired/died before 01.01.1986, these concordance tables may be used based on their notional pay as on 01.01.1986, which was fixed in accordance with this Department’s OM No. 45/86/97-P&PW(D)(iii) dated 10.02.1998.

3. Separate tables have been given in respect of pre- 01.01.2016 pensioners who retired in the Group 'D' pay scales corresponding to 5th CPC grade pay of Rs. 1300/-, Rs. 1400/-, Rs. 1600/- and Rs. 1650/- {Table No. 1 to Table No. 4) and for pensioners who retired during 6th CPC period after upgradation to the Grade pay of Rs. 1800/- (Table No. 5 to Table No. 8). The pension/family pension of such pensioners/family pensioners may be revised using the appropriate Table.

4. These concordance tables have been prepared to facilitate revision of  pension of pre-2016 pensioners/family pensioners by the concerned pension sanctioning authorities. Due care has been taken to prepare these concordance tables based on the fitment tables for fixation of pay from 4th to 5th,  and 5th to 6th Pay Commission. In case of any inconsistency in the concordance tables vis-a-vis the relevant rules/instructions, the notional pay and pension/family pension of pre-2016 pensioners/family pensioners may be fixed in accordance with the rules/instructions applicable for fixation of pay in the intervening Pay Commission periods.

5. It is requested that the pension of pre-2016 pensioners / family pensioners may be revised w.e.f. 01.01.2016 in accordance with the instructions contained in this Department’s OM of even no dated 12.05.2017 and using the concordance tables enclosed herewith.

6. This issues with the approval of Ministry of Finance ( Department of Expenditure) vide their Diary No. 1(13)/EV/2017 dated 05.07.2017.

7th CPC Bunching Anomaly : Denial of Bunching Increment due to anomaly in fixing the next stage (Cell) in each pay level with less than 35 increment rate.

Item - 2 - DENIAL OF BUNCHING INCREMENT DUE TO ANOMALY IN FIXING THE NEXT STAGE (CELL) IN EACH PAY LEVEL WITH LESS THAN 3% INCREMENT RATE.

(1) As per the Finance Ministry OM dated 07.09.2016, the grant of bunching increment is subject to the condition that the difference between the lower pay and higher pay should be at least 3%. This condition adversely affects many of the employees. Contrary to the claim of the 7th Pay Commission that increment rate of 3% is maintained, in many pay levels, the difference between lower cell and next higher cell is less than 3% showing that increment rate is less than 3%. Due to this inherent anomaly is granting justified (3%) increment the employees should not be made to suffer in the case of bunching. It is not the fault of the employees but due to faulty increment rate fixed by the commission in each pay level. This anomaly is to be set right by withdrawing the 3% condition from the Finance Ministry orders dated 01.09.2016.

(2) The pay as per the 7th CPC of MTS drawing pay of 7210 and 7430 in the pre- revised pay is bunched and fixed at Rs.19700. As per the bunching orders issued by Finance Ministry, the official drawing Rs.7430 in the pre- revised scale will get additional increment and will be fixed at Rs.20300/- with effect from 01.01.2016. But the MTS officials drawing Rs.7660/- in the pre-revised pay are also getting revised pay fixed at Rs.20300 with effect from 01.01.2016. It is requested that to remove the anomaly, the MTS officials who are drawing Rs.7660/- in the pre-revised scale may also be made eligible to get additional increment
