Subject: Counting of the limitation period for the diverse purposes under CCS (CCA) Rules, 1965, CCS (Pension) Rules, 1972
The undersigned is directed to refer to OM of even number dated 30th
March, 2020 whereby, considering the unprecedented situation of lockdown
w.e.f. 24th March, 2020, the period of lockdown was decided to be
excluded from the time-limits prescribed in various Rules/instructions.
While in the initial periods of lockdown, the Government offices were
directed to work either with skeletal staff or with 1/3rd of its
strength, DoPT’s extant instructions provide for attendance of 100%
officers of the level of DS & above and 50% below DS on all working
days. Ministry of Home Affairs vide its Order dated 30th May, 2020 has
also issued instructions for phase-wise reopening of prohibited
activities outside the containment zone. In view of this, it has now
been decided that the exclusion of lockdown period w.e.f. 24th March,
2020 shall cease to have further effect with the issue of this O.M.
Therefore, after exclusion of lockdown period, action as per time-lines
provided under various Rules/ instructions may be completed within the
period as explained in paras 2 & 3 of O.M. dated 30th March, 2020
referred above.

2. Consequent upon the outbreak of COVID-19,
and considering the unprecedented situation of the Lockdown w.e.f. 24th
March 2020, it may not be feasible to adhere to the timelines
prescribed in the said Rules and to the instructions issued under the
Rules. It has accordingly been decided not to count the period of the
Lockdown for the purposes of adherence to the prescribed timelines,
including those listed above. For example, if the due date for
completing a process/work/event at the start of the Lockdown falls after
20 days, then the due date will get postponed by the number of Lockdown
days and the same number (20) of days will be available to complete the
work after the Lockdown is lifted.
3. However, after the Lockdown is lifted, if the time left to
complete the task is less than 15 days) then the processes may be
allowed to be completed within 15 days.
4. In addition, timelines may have been prescribed for receipt of
applications for direct recruitment, deputation, etc. Where the last
date of receipt of application for direct recruitment, deputation etc.
falls within the period of the Lockdown, the last date shall be extended
by the number of days of the Lockdown. Similarly, the time limits
prescribed in the CCS (Conduct) Rules, 1964, for various purposes shall
also be extended by the number of days of the Lockdown.
5. These instructions are applicable only in such cases where there
is an intervening Lockdown period and it will not be applicable
otherwise.

Subject: Preventive measures to be taken to contain the spread of Novel Coronavirus (COVID-19) – Attendance regarding.
The undersigned is directed to refer to OM of even number dated the
17th March, 2020, 18th May, 2020 and 19th May, 2020 whereby advisory for
well-being of Government employees and attendance in Government offices
with staggered timings were issued by Department of Personnel &
Training (DoPT).
2. Kind attention is also drawn to Ministry of Home Affairs’ Order
dated 30.05.2020 whereby ‘Additional Directives for Work Places’ have
been prescribed. Further, the Ministry of Health & Family Welfare
(MoH&FW) on 4th June, 2020 has issued Standard Operating Procedure
on preventive measures to contain spread of COVID-19 in workplace settings (copy enclosed).
3. It is emphasized that strict adherence to the practices of social
distancing norms and health & hygiene practices, as enunciated in
these guidelines, is of paramount importance and the Government servants
as responsible employees should abide by these practices so that the
Government offices function in the most efficient manner in the given
situation. All the Ministries / Departments/offices as well as the
Central Government employees are, therefore, directed to ensure strict
compliance of instructions issued by DoPT as well as MHA and MoH&FW.

SOP on preventive measures to contain spread of COVID-19 in offices
1. Background
Offices and other workplaces are relatively close settings, with
shared spaces like work stations, corridors, elevators & stairs,
parking places, cafeteria, meeting rooms and conference halls etc. and
COVID-19 infection can spread relatively fast among officials, staffs
and visitors.
There is a need to prevent spread of infection and to respond in a
timely and effective manner in case suspect case of COVID-19 is detected
in these settings, so as to limit the spread of infection.
2. Scope
This document outlines the preventive and response measures to be
observed to contain the spread of COVID-19 in office settings. The
document is divided into the following sub-sections
(i) Generic preventive measures to be followed at all times
(ii) Measures specific to offices
(iii) Measures to be taken on occurrence
of case(s)
(iv) Disinfection procedures to be implemented in case of occurrence of suspect / confirmed case.
Offices in containment zones shall remain closed except for medical
& essential sevices. Only those outside containment zones will be
allowed to open up.
3. Generic preventive measures
Persons above 65 years of age, persons with comorbidities, pregnant
women are advised to stay at home, except for essential and health
purposes. Office management to facilitate the process.
The generic preventive measures include simple public health measures
that are to be followed to reduce the risk of infection with COVID-19.
These measures need to be observed by all (employees and visitors) at
all times. These include:
i. Individuals must maintain a minimum distance of 6 feet in public places as far as feasible.
ii. Use of face covers/masks to be
mandatory.
iii.
Practice frequent hand washing with soap (for at least 40-60 seconds)
even when hands are not visibly dirty. Use of alcohol-based hand
sanitizers (for at least 20 seconds) can be made wherever feasible.
iv.
Respiratory etiquettes to be strictly followed. This involves strict
practice of covering one’s mouth and nose while coughing/sneezing with a
tissue / handkerchief / flexed elbow and disposing off used tissues
properly.
v. Self-monitoring of health by all and reporting any illness at the earliest to the immediate supervisory officer.
vi.
Spitting shall be strictly prohibited.
vii. Installation & use of Aarogya Setu App by employees.
4. Specific preventive measures for offices:
i. Entrance to have mandatory hand hygiene (sanitizes dispenser) and thermal screening provisions.
ii. Only asymptomatic staff/visitors shall be allowed.
iii.
Any officer and staff residing in containment zone should inform the
same to supervisory officer and not attend the office till containment
zone is denotified. Such staff should be permitted to work from home and
it will not be counted as leave period.
iv. Drivers shall maintain
social distancing and shall follow required dos and don’ts related to
COVID-19. It shall be ensured by the service providers/ officers/ staff
that drivers residing in containment zones shall not be allowed to drive
vehicles.
v. There shall be provision for disinfection of the
interior of the vehicle using 1% sodium hypochlorite solution/ spray. A
proper disinfection of steering, door handles, keys, etc. should be
taken up.
vi. Advise all employees who are at higher risk i.e. older
employees, pregnant employees and employees who have underlying medical
conditions, to take extra precautions. They should preferably not be
exposed to any front-line work requiring direct contact with the public.
Office management to facilitate work from home wherever feasible.
vii.
All officers and staff / visitors to be allowed entry only if using
face cover/masks. The face cover/mask has to be worn at all times inside
the office premises.
viii. Routine issue of visitors/ temporary
passes should be suspended and visitors with proper permission of the
officer who they want to meet, should be allowed after being properly
screened.
ix. Meetings, as far as feasible, should be done through video conferencing.
x. Posters/ standees/ AV media on preventive
measures about COVID-19 to be displayed prominently.
xi. Staggering of office hours, lunch hours/coffee breaks to be done, as far as feasible.
xii. Proper crowd management in the parking lots and outside the premises – duly following social distancing norms be ensured.
xiii.
Valet parking, if available, shall be operational with operating staff
wearing face covers/ masks and gloves as appropriate. A proper
disinfection of steering, door handles, keys, etc. of vehicles should be
taken up.
xiv. Any shops, stalls, cafeteria etc., outside and within
the office premises shall follow social distancing norms at all times.
xv. Specific markings may be made with sufficient distance to manage the queue and ensure social distancing in the premises.
xvi. Preferably separate entry and exit for officers, staff and visitors shall be organised.
xvii.
Proper cleaning and frequent sanitization of the workplace,
particularly of the frequently touched surfaces must be ensured.
xviii. Ensure regular supply of hand sanitisers, soap and running water in the washrooms.
xix. Required precautions while handling supplies, inventories and goods in the office shall be ensured.
xx. Seating arrangement to be made in such a way that adequate social distancing is maintained.
xxi. Number of people in the elevators shall be restricted, duly maintaining social distancing norms.
xxii.
For air-conditioning/ventilation, the guidelines of CPWD shall be
followed which inter alia emphasises that the temperature setting of all
air conditioning devices should be in the range of 24-30°C, relative
humidity should be in the range of 40¬70%, intake of fresh air should be
as much as possible and cross ventilation should be adequate.
xxiii. Large gatherings continue to remain prohibited.
xxiv.
Effective and frequent sanitation within the premises shall be
maintained with particular focus on lavatories, drinking and hand
washing stations/areas.
xxv. Cleaning and regular disinfection (using
1% sodium hypochlorite) of frequently touched surfaces (door knobs,
elevator buttons, hand rails, benches, washroom fixtures, etc.) shall be
done in office premises and in common areas
xxvi. Proper disposal of face covers / masks / gloves left over by visitors and/or employees shall be ensured.
xxvii. In the cafeteria/canteen/dining halls:
a.Adequate crowd and queue management to be ensured to ensure social distancing norms.
b. Staff / waiters to wear mask and hand gloves and take other required precautionary measures.
c.The seating arrangement to ensure a
distance of at least 1 meter between patrons as far as feasible.
d. In the kitchen, the staff to follow social distancing norms.
5. Measures to be taken on occurrence of case(s):
Despite taking the above measures, the occurrence of cases among the
employees working in the office cannot be ruled out. The following
measures will be taken in such circumstances:
i. When one or few person(s) who share a room/close office space
is/are found to be suffering from symptoms suggestive of COVID-19:
Place the ill person in a room or area where they are isolated
from others at the workplace. Provide a mask/face cover till such time
he/she is examined by a doctor.
Immediately inform the nearest medical facility (hospital/clinic) or call the state or district helpline.
A
risk assessment will be undertaken by the designated public health
authority (district RRT/treating physician) and accordingly further
advice shall be made regarding management of case, his/her contacts and
need for disinfection.
The suspect case if reporting very
mild/mild symptoms on assessment by the health authorities would be
placed under home isolation.
Suspect case, if assessed by health
authorities as moderate to severe, will be treated as per health
protocol in appropriate health facility.
The rapid response team of the concerned district shall be requisitioned and will undertake the listing of contacts.
The
necessary actions for contact tracing and disinfection of work place
will start once the report of the patient is received as positive. The
report will be expedited for this purpose.
ii. If there are large numbers of contacts from a pre-symptomatic /
asymptomatic case, there could be a possibility of a cluster emerging in
workplace setting. Due to the close environment in workplace settings
this could even be a large cluster (>15 cases). The essential
principles of risk assessment, isolation, and quarantine of contacts,
case referral and management will remain the same. However, the scale of
arrangements will be higher.
iii. Management of contacts:
The contacts will be categorised into high and low risk contacts by the District RRTas detailed in the Annexure I.
The high-risk exposure contacts shall be quarantined for 14 days.
These persons shall undergo testing as per ICMR protocol.
The low risk exposure contacts shall continue to work and closely monitor their health for next 14 days.
The flowchart for management of contact/ cases is placed at Annexure – II.
6. Closure of workplace
i. If there are one or two cases reported, the disinfection procedure
will be limited to places/areas visited by the patient in past 48 hrs.
There is no need to close the entire office building/halt work in other
areas of the office and work can be resumed after disinfection as per
laid down protocol.
ii. However, if there is a larger outbreak, the
building/block will have to be closed for 48 hours after thorough
disinfection. All the staff will work from home, till the building/block
is adequately disinfected and is declared fit for re-occupation.
7. Disinfection Procedures in Offices
Detailed guidelines on the disinfection as already issued by Ministry
of Health & Family Welfare as available on their website shall be
followed.
Annexure I
Risk profiling of contacts
Contacts are persons who have been exposed to a confirmed case
anytime between 2 days prior to onset of symptoms (in the positive case)
and the date of isolation (or maximum 14 days after the symptom onset
in the case).
High-risk contact
Touched body fluids of the patient (respiratory tract
secretions, blood, vomit, saliva, urine, faeces; e.g. being coughed on,
touching used paper tissues with a bare hand)
Had direct physical contact with the body of the patient including physical examination without PPE
Touched or cleaned the linens, clothes, or dishes of the patient.
Lives in the same household as the patient.
Anyone in close proximity (within 1 meter) of the confirmed case without precautions.
Passengers
in close proximity (within 1 meter) in a conveyance with a symptomatic
person who later tested positive for COVID-19 for more than 6 hours.
Low-risk contact
Shared the same space (worked in same room/similar) but not having a high-risk exposure to confirmed case of COVID-19.
Travelled in same environment (bus/train/flight/any mode of transit) but not having a high-risk exposure.

Subject: Inclusion of "Third Gender/any Other Category" in the application forms in recruitment to various posts under the Central Government -
reg.
The undersigned is directed to say that "The Transgender Persons (Protection of Rights) Bill, 2019" was passed by both Houses of the Parliament
and received the assent of the President on 05.12.2019. This Act (No. 40 of 2019) has been notified in the Gazette of India on 05.12.2019.
2. The matter regarding Inclusion of "Third Gender/any Other Category" in the application forms in recruitment to various posts under the Central
Government, was under consideration of the Government for quite some time. Based on the provisions of the aforesaid Act and the legal opinion
obtained on the subject, Civil Services Examination Rules, 2020 have been notified on 05.02.2020, providing for inclusion of 'Transgender' as a
separate category of gender for the said exam.
3. All Ministries / Departments of Government of India are requested to modify the relevant examination rules providing for inclusion of
'Transgender' as a separate category of gender, so as to make the said Rules in conformity with the provisions of The Transgender Persons
(Protection of Rights) Bill, 2019.

Relaxation of Central Civil Services (Leave) Rules, 1972, it has now been decided with the approval of
competent authority to grant Commuted Leave without production of medical certificate to those officials who
are above 50 years of age and have underlying conditions
The undersigned is directed to state that the leave sanctioning authorities were advised vide O.M. of even
number dated 17th March, 2020 to sanction leave who wish to self-quarantine, as a preventive measure. In this
regard, in relaxation of Central Civil Services CCS (Leave) Rules, 1972, it has now been decided with the approval of competent
authority to grant Commuted Leave without production of medical certificate to those officials who are above
50 years of age and have underlying conditions i.e. Diabetes, Respiratory problems, Renal diseases and other
life-threatening illness, for a period upto 4th April, 2020, so as to avoid unnecessary burden on the health
care system.
These instructions shall be applicable to Ministries / Departments / attached and subordinate offices of
Central Government. Similar instructions may be issued to Autonomous / Statutory Bodies.

Subject: Exemption to employees to mark biometric attendance in Aadhar Based Biometric Attendance System (AEBAS) – reg.
Though only a small number of novel coronovirus (COVID-19) cases are reported in our country but keeping in view the nature of virus, it is a must to take all possible preventive measures to stop spread of virus.
It is learnt that most common method of transmission of virus seems to be through infected surfaces. Therefore, it is desirable to avoid touching surfaces, which might be infected due to human touch.
In view of the above, all the Ministries / Departments are requested to exempt their employees to mark biometric attendance in Aadhar Based Biometric Attendance System (AEBAS) till 31st March, 2020. However, all the employees are required to mark their attendance in Attendance register, (as done prior to launch of biometric system), during this period.

Subject: Grant of vigilance clearance for obtaining passport.
The undersigned is directed to refer to this Department’s O.M. of even no. dated 28.03.2018 prescribing the
guidelines for grant of vigilance clearance for obtaining passport. The guidelines have been reviewed by this
Department in consultation with Central Vigilance Commission and Ministry of External Affairs (MEA).
2. MEA has also issued the guidelines for issuance of ordinary Passport to the Government servants vide O.M.
No. VI/401/01/05/2014 dated 26.05.2015, wherein procedures to be followed in this regard have been
prescribed.
3. In view of the above, it is mandatory for the administrative Department /Controlling Authority to check as
to whether any provision of the Section 6(2) of the Passport Act, 1967 is attracted in case of employees, who
are working under them, while obtaining Indian Passport. As such, it is required to check the vigilance
clearance of such Government servants.
4. Accordingly, it has been decided that vigilance clearance can be withheld only under the following
circumstances:
The officer is under suspension;
Charge sheet has been filed in a Court by the Investigating Agency in a criminal case or after grant of

Subject:- Submission of Immovable Property Return (IPR) for the year 2019 (as on 31.12.2019) by the Officers of Central Secretariat Services (CSS) reg.
In terms of Rule 18 of CCS (Conduct) Rules, 1964, the Immovable Property Return is required to be furnished by the CSS Officers in the grade of Under Secretary and above, latest by 31 .01.2020. IPR should be submitted by all the CSS Officers through Web Based Cadre Management System which is hosted at cscms.nic.in. A copy of the print out (IPR submitted online) duly signed, should also be submitted to CS.I (PR/CMS) Section, which is the custodian of Immovable Property Return (IPR) of these Officers. Assistant Section Officers and Section Officers of CSS will also submit the print out (IPR) duly signed, to their respective Admin/ Vigilance Division.
Ministries/ Departments are therefore, requested that the contents of this O.M. may be widely circulated to the notice of all CSS Officers/Officials working under their respective control. They should also ensure that the IPR for the year 2019 (as on 31.12.2019) is submitted within the stipulated time by all the CSS Officers. The officers are also informed that non-submission of IPR within the stipulated date, would invite the denial of vigilance clearance for empanelment, deputation and applying to sensitive posts and assignment to training programme (except mandatory training) as the IPR status needs to be checked for the said purpose(s).

It is, therefore, requested that all the CSS Officers may be directed to file their Immovable Property Return (IPR) for the year 2019 (as on 31.12.2019) well in time, latest by 31.01.2020, through Web Based Cadre Management System only. It is also stated that the date of filing of IPR will start from 01st January, 2020 and the "Immovable Property Returns" window shall be opened/provided at cscms.nic.in. automatically from that date only.

Benefits for Economically Weaker Sections
In pursuance of insertion of clauses 15(6) and 16(6) in the Constitution, vide the Constitution (One Hundred and Third Amendment) Act, 2019 and in order to enable the EWSs, who are not covered under the existing scheme of reservations for the Scheduled Castes, the Scheduled Tribes and the Socially and Educationally Backward Classes,Department of Personnel and Training has notified that 10% reservation would be provided for EWSs in Central Government posts and services in direct recruitment vacancies to be notified on or after 01.02.2019.

Rule 16(2) of AIS (Conduct) Rules, 1968 provides that every member of the Service shall submit an annual return in such form
as may be prescribed by the Government in this regard, giving full particulars regarding the immovable property inherited by

his family or in the name of any other person. In terms of the instructions vide OM No.8/9/60-AIS(III) dated 16.02.1960 and
OM No.11017/74/93-AIS(III) dated 04.01.1994 issued under this Rule, every member of the service is required to submit annual
immovable property return by 31st January of the next year. Failure on the part of the members of the Service to comply with
the requirements of the aforesaid provisions constitutes good and sufficient reason for institution of disciplinary
proceedings,among other things vide this Department's OM No.104/33/200S-AVD-Idated 29.10.2007and 07.09.2011, against them.
2. In order to further facilitate the filing of IPR's, this Department has vide DO No.6(1)/2014-EO(PR) dated 22.12.2016
introduced online filing of IPR in respect of IAS officers w.eJ. 1st January, 2017 through the Module designed for the
purpose. Through this Module, the officers can submit the IPR either electronically or upload scanned copy of the manually
filled in IPR. This online Module closes automatically after the prescribed timeline of 31st January, 2020 in respect of the
calendar year 2019.
3. I would, therefore, request you to kindly issue necessary instructions to all IAS officers working in your Ministry/
Department and its various organizations,to ensure that they submit their IPRs online in the IPR Module for the year ending
on 31st December,2019, as per the prescribed timeline.

Representation from government servant on service matters.
Attention is invited to the instructions issued by DoPT from time to time on submission of representations by government servant on their service matters. In spite of these instructions, it has been observed that employees of this organisation or their relatives are frequently submitting the representations to Prime Minister/ Minister/Secretary directly for seeking redressal of their grievances. It is clarified that it would include all forms of communication through e-mails or public grievance portal etc. If a government servant wishes to seek redressal of a grievance, the proper course is to address his immediate official superior, or Head of Office, or such other authority at the appropriate level who is competent to deal with the matter in the organisation.
Attention is also invited to the provision of Rule 20 of CCS( Conduct) Rules, 1964 prohibiting Government servants from bringing outside influence in respect of matter pertaining to his service matters. Violation of these instructions may be treated as unbecoming conduct on the part of government servant and may attract the provision of Rule 3(1) (iii) of CCS(Conduct) Rules, 1964.
Therefore, all. Pr.CCAs/CCAs/CAs (with independent charges) are requested that these instructions may be brought to the notice of all government servants working under their administrative control. Violation of the instructions may led to disciplinary action against the government servant under relevant rules.

Federation vide its communications dated 07/09/2018 & 11/02/2019 brought to the notice of Railway Board a specific case of wrong fixation of pay in favour of Shri Satyendra Kumar Lal, Chief Typist, DLW, Varanasi. Along with its communication, Federation also provided a chart highlighting the pay fixation done (Drawn) by the DLW/Varanasi vis-Ã -vis the pay due to be fixed in pursuance of Board’s instructions contained in RBE No. 40/2012 and requested that suitable instructions be issued to the GM/DLW, as also to other Zonal Railways etc., for proper implementation of Board’s orders (RBE No. 40/2012). Federation is disappointed to note that though period of over one year has passed, no action has been taken in the matter, while the employee continues to draw less salary.
NFIR, therefore, once again requests the Railway Board to connect Federation’s letters dated 07/09/2018 and 11/02/2019 and issue suitable clarification to the Zones etc in general and DLW/Varanasi in particular to ensure correct implementation of the instructions contained in RBE No. 40/2012 so as to avoid financial loss to employees on their pay fixation in 7th CPC Pay Matrix.
A copy of the instructions issued may be endorsed to the Federation.

Subject: Sanction for holding an elective office under Rule 15(1)(c) ofCCS(Conduct) Rules, 1964 - reg.
The undersigned is directed to say that as per Rule 15 (1) (c) of the CCS(Conduct) Rules, 1964, no Government servant shall except with the previous sanction of the Government, hold an elective office, or canvass for a candidate or candidates for an elective office, in any body, whether incorporated or not.DoPT's O.M. No. 1l0l3/9/93-Estt.(A) dated 22.04.1994 had also stipulated that no Government servant should be allowed to hold elective office in any sports association/federation for a term of more than 4 years, or for one term whichever is less. Further, according to Department of Personnel & Training OM No. 11013/ ll /2007-Estt (A) dated the 13th November, 2007, the entire time of the Government servant should be available to the Government and that no activities unconnected with his or her official duties should be allowed to interfere with the efficient discharge of such duties. All Ministries were requested to ensure that the participation of the Government servants in the activities of the cooperative societies conform to the above provisions and does not interfere with the discharge of their official duties.
2. Instances have come to notice where Government servants continue to hold elective offices in various capacities for unduly long periods. In some cases,where bye-laws of these bodies place restrictions on the number of consecutive terms a person may hold an office, Government servants are reported to have either got themselves re-elected after a gap or have got a family member/ close relative elected as a surrogate in order to keep control of such bodies. In such cases, Government servants may not be bestowing adequate attention upon their official duties and, as a result, an apprehension may arise that such Government servants also develop vested interests, particularly if the body is involved in commercial activities, directly or indirectly.
3. The policy on fixing an upper limit of the number of years for which Government servants can hold elective office in any body in their entire career has been reviewed and it has been decided that a Government servant may be allowed to hold elective office in any body, whether incorporated or not, for period of two terms or for a period of 4 ]rears. whichever is earlier, for which prior sanction would be required when a Government servant contests an election in such body, as per existing rules.
4. It is, therefore, necessary for the Competent Authority to keep in mind all the relevant factors while granting permission under Rule 15(1)(c) of CCS(Conduct) Rules, L964. It may also be necessary that cases of such sanctions are reviewed from time to time and permissions earlier granted revoked where Government servants have been holding office in any body,whether incorporated or not, for more than four years or in cases there are charges of corruption, adverse audit paras etc. In such cases, the Government servant concerned may be directed to resign from his office in such body immediately. He will cease to discharge any function from the date such direction is conveyed to him, irrespective of the fact whether his resignation from the body is accepted or not. This action may be taken immediately in those cases where information is already available with the Ministries and Departments. In addition, all the Ministries and Departments are also requested to obtain information from their employees in the proforma attached to this Office Memorandum for reviewing the position as well as while considering the request for sanction under Rule 15(1)(c) of CCS(Conduct) Rules, L964 in future.
5. This O.M. issues in supersession of DoPT's ll0l3/9/93-Estt.(A) dated 22.O4.1994.
6. In so far as the employees of Indian Audit and Accounts Departments are concerned, this O.M. issues after consultation with Comptroller & Auditor General of India.

Subject: Revision of Pension of pre-2016 pensioners after implementation of seventh Central Pay Commission’s recommendations- anomaly in determining notional pay.
Sir,
I am directed to refer to various communications from State Governments on the above subject and to state that the matter raised in various representations of the pensioners seeking revision of their pension after implementation of 7th CPC recommendations, has been examined in this Department in consultation with Department of Pensions and Pensioner’s Welfare.
2. The basis for the re-fixation of the pension of pre-2016 pensioners are DoPT OM No.14021/4/2016-AIS-Il dated 19th May, 2017 {mutatis-mutandis based on DoP&PW OM dated 38/37/2018-P&PW(A) dated 12th May,2017} and the Concordance Tables issued by DoP&PW vide OM dated 38/37/2018-P&PW(A) dated 6th July,2017.
3. Prior to re-fixation of the pension of pre-2016 pensioners/family pensioners etc., following instructions/pension may be followed:-
(a) Para 4 of the OM dated 12th May, 2017 provides inter alia that the “revised pension/family pension w.e.f 01.01.2016 in respect of all Central Civil pensioners retired prior to 01.01.2016, may be revised by notionally fixing their pay in pay matrix recommended by the 7thCPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired. This will be done by notional pay fixation under each intervening Pay Commission based on the Formula for revision of pay. While fixing pay on notional basis, the pay fixation formulas approved by the Government and other relevant instructions on the subject in force at the relevant time shall be strictly followed. Further, para 7 of the OM provides inter alia that in case of those Government servants who retired or died on or after 01.01.1986 but before 1.1.2016, the actual pay and the pay scale from which they retired or died would be taken into consideration for the purpose of calculation of the notional pay as on 01.01.2016 in accordance with para 4 above. (b) Accordingly, the pay of pre-2016 pensioners was notionally fixed in relevant cell of pay matrix of 7th CPC as per the formula of pay fixation approved by the Government. The pay of the serving IAS officers (including of Selection Grade officers) is also fixed in relevant cell of Pay Matrix of 7th CPC as per the formula of pay revision from 6th CPC to 7th CPC as approved by the Government. Also, the pay of serving officers who had been promoted on 1.1.2016 in JAG or Selection Grade is first fixed in the relevant cell of Pay Matrix of 7th CPC as per the formula of pay revision approved by the Government. Thereafter, they had to be promoted in next scale and their pay fixed in that level as per IAS Pay Rules 2016, granting them two increment in the promotion level. (c) The pay of only those officers who were promoted on or after 1.1.2016 is to be fixed in 3rd cell of level-13. The pay of the officers who were already in selection grade i.e. level-13 as on 1.1.2016 is fixed as per the formula of pay revision from 6th to 7th Central Pay Commission(CPC). The notional pay of the officers who had retired before 01.01.2016 has to be similarly fixed. Therefore, the contention of any pensioner that his/her notional pay cannot be in any case less than the lowest level at which the pay of a serving officer of the Selection Grade of IAS can be fixed, is not tenable. Their pay is to be notionally arrived at by the formula of pay revision from 6th CPC to 7th CPC at par with other serving IAS officers.
4. Pension of pre-2016 pensioners/family pensioner may be revised w.e.f 1.1.2016 in accordance with the instructions contained in D/o P&PW OM dated 12.5.2017.
5. Accordingly, the representations of pre-2016 pensioners may be examined by the State Government and the concerned pensioner(s) may be informed.
6. This issues is with the approval of the competent authority.
The undersigned is directed to say that the Committee, as set-up by Department of Financial Services in terms of their OM
No. 1/3/2016-PR dt. 21.10.2016 under the Chairmanship of Secretary (Pension) and comprising Secretary, Department of
Financial Services and Secretary (Department of Personnel and Training), had submitted its report on 28.2.2018, containing
its recommendations for streamlining implementation of the National Pension System (NPS).
2. One of the recommendations contained in para 8.7.1 of its report relating to grievance redressal is as under:-
“Three-tiered NPS oversight mechanism of the DDO/Head of Office, Joint Secretary (Admin)/Chief Controller of Accounts and
the Financial Advisor set up vide Department of Expenditure’s OM No.1(2)/EV/2008, dated 03.02.209 may be
strengthened/streamlined to monitor grievances as well as timely registration and credit of contributions to subscribes’
accounts. Fresh instructions to this effect and for strict compliance of instructions may be issued by Department of
Expenditure.”
3. In the OM of this Department No. 1(2)/EV/2008 dated 3.2.2009, it was provided, inter-alia, that Ministries/Departments
may constitute a Committee headed by J5 (Admin) and Principal CCA/CCA to monitor registration/regular upload of data and
transfer of NPS contributions in respect of Central Government employees to ensure that no delay therein occurs.
Subsequently, in terms of instructions of this Department vide OM No. 1(5)/EV/2011 dated 10.7.2011 the Committee was
broad-based to include the concerned Financial Advisors and the said instructions dt. 10.7.011 also provided, inter-alia,
that the implementation of NPS, with its various attendant parameters, in each Central Ministry/Department, shall be a “key
performance area” of the Financial Advisors.
4. The Department of Pension and Pensioners’ Welfare, which is the nodal Department in respect of pension related matters
of Central Government employees, is separately in the process of framing statutory rules to regulate the matters of
National Pension System in case of Central Government employees. These Rules would also cover the issue relating to timely
credit of contributions of Central Government employees and the Central Government, as deducted from the salaries of the
concerned Government employee, to NPS architecture.
5. However, since timely credit of deduction made from the salary of Central Government employees towards their
contribution to NP5, as also the applicable contribution of the Central Government, to the NP5 financial architecture is of
paramount importance for availability of due and timely returns thereon towards generation of pension corpus, it has been
decided that a Committee in each Ministry/Department shall be constituted as under to ensure oversight over the NPS
contributions crediting:-
(i) Financial Advisor – Head of the Committee
(ii) Joint Secretary (Administration)
(iii) Principal CCA/CCA
(iv) The concerned Head of the office
(v) The concerned DDO
6. The Committee shall be responsible for the following actions:-
(i) Ensuring that the contribution of employees and the Government are credited without delay to the NPS financial
architecture both in case of existing employees and employees newly recruited from time to time and the existing system and
procedure being followed for the purpose shall be monitored effectively to ensure that no delay in credit of the
contributions takes place.
(ii) Ensuring that in case any grievance by any employee is received in regard to delay in credit of contribution, either
directly from the employee or through PFIZDA, the same has been looked into and disposed of in a manner to the satisfaction
of the concerned employee.
(iii) Any other matter as having a bearing on the issue of crediting/remittance
of NPS contributions.
(iv) The Committee shall devise its own mechanism as also appropriate checks & balances to ensure that NP5
contributions are credited on time in respect of all employees under NPS system.
(v) The Committee shall meet at least once in 3 months to review the progress and in case any slippages are noticed, it
shall take immediate corrective action. However, the concerned Principal CCAI CCA shall keep a watch over the progress on a
regular basis.
7. While the above Committee shall be set-up in each Ministry/Department, appropriate mechanism for keeping a watch in
respect of attached and subordinate offices under that Ministry/Department shall be put in place by the concerned Financial
Advisor, so that the overall oversight in respect of the entire Ministry/Department as a whole is exercised by the
Committee as mentioned in para 5 above.
8. The concerned Financial Advisor shall send a status report every six month to the Department of Pension and Pensioners’
Welfare about the result of the monitoring carried out through the above oversight mechanism with concluding remarks
whether the NPS contributions are being credited on time and in case of any slippages, the details of the action taken.
