OFFICE MEMORANDUM

Subject:- Engagement of retired Government officers as 'Consultant' on contract basis on DPIIT - inviting applications thereof - reg - For CSS Officers.

The undersigned is directed to circulate the Vacancy Circular No. A- 12023/3/2019-ENG dated 18th December, 2019 (along-with enclosures) received from Department for Promotion of Industry & Industrial Trade inviting applications retired Government officers from the rank of SO/US/ DS or equivalent from Central Government /PSU/ Autonomous Body having considerable experience of functioning of Central Government Ministries/ Departments for engagement of Consultant (15 posts) on contract basis.

The terms and conditions of the contract shall be as under
  • The consultants will be required to examine cases/proposals, policy issues in the light of Central Govt. rules and regulation, prepare briefs/presentations and analyse the proposals assigned to them by their controlling officers. They shall be fully conversant with MS-Word/ PPT/ Excel etc. as per role requirement and print their own notes/ drafts/ OMs as required.
  • A consolidated remuneration of Rs.50,000/- (Rupees fifty thousand only) per month (minus Professional Tax/ TDS as applicable) shall be payable to consultants who have retired at the rank of US or above.
  • A consolidated remuneration of Rs.40,000/- (Rupees forty thousand only) per month (minus Professional Tax/ TDS as applicable) shall be payable to consultants who have retired at the level of SO or equivalent.
  • The consolidated remuneration shall be payable, subject to periodical completion of work certified by the controlling Officer. They will not be eligible for any other allowance or facility in addition to the consolidated pay. They will, however. continue to draw their pension and relief on pension. as per their entitlement.
  • They should not have attained the age of 63 years on the closing date of applications.
  • Working hours shall normally be from 9 AM to 5.30 PM during working days. However, in exigencies of work, they may be required to sit late and may be called on Saturdays/ Sundays and other holidays. They will be eligible for 08 days leave during the period of one year subject to the approval of the controlling Officer.
  • They will be governed by the Official Secrets Act, 1923, as amended from time to time and will not disclose to any unauthorized person(s) any information/data that may come to their notice during the period of their engagement as 'Consultant' in the Department. All such documents will be property of the Government.
  • They will not utilize or publish or disclose or part with, to a third party. any part of the data or statistics or proceedings or information collected for the purpose of their assignments or during the course of, assignment for the Department without the express written consent of the Department.
  • The Intellectual Property Rights (IPR) of the data collected as well as deliverables produced for the Department shall remain with the Department. x) Their attention is drawn to Central Vigilance Commission's circular no. 01/01/17 dated 23.1.2017 and circular no. 08/06/2011 dated 24.6.2011 regarding engagement of consultants. They will be completely accountable for any advice or any service rendered by them during their engagement in this Department in view of norms of ethical business and professionalism.
  • They must act, at all times, in the interest of DPIIT and render any advice! service with professional integrity.
  • They will maintain highest standards of integrity, transparency, competitiveness, economy and efficiency while working as consultant in this Department. If required, they will cooperate fully with any legitimately provided! constituted investigative body, conducting inquiry into processing or execution of the consultancy contract! any other matter related with discharge of contractual obligations by the consultant.
  • The consultants appointed by the Department shall in no case represent or give opinion or advice to others in any mater which is adverse to the interest of the Department nor will they indulge in any activity outside the terms of the contractual assignment.
  • They will complete the assigned task within the stipulated period as per the requirement of their controlling officers. They will not take up any assignment or contract which conflicts with the interest of the Government during the contract period.
  • They shall be bounded to hand-over the entire set of records of assignment to the Department before the expiry of the contract and before the final payment is released by the Department.
  • The engagement as Consultant can be terminated by the Department at any time without assigning any reason thereof by giving them 15 days' notice. However, in case a Consultant wishes to resign, he will have to give 15 days advance notice or remuneration in lieu thereof before resigning from the engagement.
  • The existing consultants in the Department will continue as per their existing entitlements/ remuneration till they complete their sanctioned tenures. Such consultants, who are already engaged, after completion of their tenure. may be considered for the new grades on the request of the consultant and the recommendations of controlling officers about their performance during the tenure of consultancy.

CIRCULAR

It is proposed to engage retired Government employees to work as Retainers against the vacant posts of Section Officer (SO) in the Department of Drinking Water & Sanitation as per the following criteria:
(a) Must have retired from Central Government Ministries / Departments.
(b) Must have retired as SO or above and well acquainted with functioning of Government Ministries.
(c) Should have good communication and interpersonal skills and excellent knowledge of Computer usage.
(d) Work profile and responsibility would be similar to post in the Central Government.

The engagement of retainers shall be subject to the following conditions:

(i) Persons must be below 64 years of age as on the last date of application.
(ii) Engagement shall initially be for a period of six months or until regular incumbents are available, whichever is earlier.
(iii) Extension of engagement, if any, shall be at the sole discretion of competent authority.
(iv) Working hours shall be from 9.00 a.m. to 5.30 p.m. during working days including half an hour lunch break in between. However, in exigencies of work, he/she may be required to sit late and may be called on Saturdays/Sundays and other Gazetted Holidays.
(v) Individual will be required to mark his attendance in Biometric Attendance System (BAS).
(vi) Shall be entitled to 4 days leave in six calendar months. The un-availed leave cannot be carried forward or encashed. (vii) Individual will give one month notice for leaving the services of the Ministry.
(viii) Engagement may be terminated at any time by the Government without assigning any reason \without any notice.
(ix) Ministry of Drinking Water and Sanitation shall not be responsible for any loss, accident, damage or injury suffered by the individual arising out of execution of his/her official duty.
(x) The selected officers will be paid a consolidated fee (TDS as applicable). He/She shall not be entitled for any allowances such as Dearness Allowance, residential, telephone, transport, etc.
(xi) He/She will not be allowed any foreign travel at Government Expenses.
(xii) Individual engaged shall not directly or indirectly communicate or reveal to any person or persons any matter collected for the purpose of his/her assignment or during the course of his/her assignment, without the express written consent of the office.
(xiii) Individual engaged shall not represent or give opinion or advice in any matter which is adverse to the interest of this Office. He/She is not permitted to take up any other assignment during his period of engagement.
(xiv) Preference would be given to those retired in the last one year.

Subject:- Submission of Immovable Property Return (IPR) for the year 2019 (as on 31.12.2019) by the Officers of Central Secretariat Services (CSS) reg.

In terms of Rule 18 of CCS (Conduct) Rules, 1964, the Immovable Property Return is required to be furnished by the CSS Officers in the grade of Under Secretary and above, latest by 31 .01.2020. IPR should be submitted by all the CSS Officers through Web Based Cadre Management System which is hosted at cscms.nic.in. A copy of the print out (IPR submitted online) duly signed, should also be submitted to CS.I (PR/CMS) Section, which is the custodian of Immovable Property Return (IPR) of these Officers. Assistant Section Officers and Section Officers of CSS will also submit the print out (IPR) duly signed, to their respective Admin/ Vigilance Division.

Ministries/ Departments are therefore, requested that the contents of this O.M. may be widely circulated to the notice of all CSS Officers/Officials working under their respective control. They should also ensure that the IPR for the year 2019 (as on 31.12.2019) is submitted within the stipulated time by all the CSS Officers. The officers are also informed that non-submission of IPR within the stipulated date, would invite the denial of vigilance clearance for empanelment, deputation and applying to sensitive posts and assignment to training programme (except mandatory training) as the IPR status needs to be checked for the said purpose(s).

It is, therefore, requested that all the CSS Officers may be directed to file their Immovable Property Return (IPR) for the year 2019 (as on 31.12.2019) well in time, latest by 31.01.2020, through Web Based Cadre Management System only. IPRs received beyond the stipulated date, shall not be regarded as conforming to the extant guidelines. It is also stated that the date of filing of IPR will start from 01st January, 2020 and the "Immovable Property Returns" window shall be opened/provided at cscms.nic.in. automatically from that date only.

Subject: Appointment of Information Commissioner in the Central Information Commission.

Under the Right to Information Act 2005, the Government of India has constituted the Central Information Commission, which is located in New Delhi. The powers and functions of the Information Commissioner in the Central Information Commission are as per the RTI Act, 2005.

Latest DoPT Orders 2019

It is proposed to appoint four Information Commissioners in the Central Information Commission.
The Act provides that the Information Commissioner-
  • shall be a person of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass-media or administration and governance.
  • shall not be a Member of Parliament or Member of the Legislature of any State or Union Territory, as the case may be, or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession. It is clarified that cessation/termination of holding of office of profit, pursuing any profession or carrying any business is a condition precedent to the appointment of a person as Information Commissioner.
4. Persons who have attained the age of 65 years shall not be eligible for appointment.

5. The salary, allowances and other terms and conditions of service of the Information Commissioners shall be as per Right to Information (Term of Office, Salaries, Allowances and Other Terms and Conditions of Service of Chief Information Commissioner, Information Commissioners in the Central Information Commission, State Chief Information Commissioner and State Information Commissioners in the State Information Commission) Rules, 2019.

6. Dear Secretary,
Rule 16(2) of AIS (Conduct) Rules, 1968 provides that every member of the Service shall submit an annual return in such form as may be prescribed by the Government in this regard, giving full particulars regarding the immovable property inherited by him or owned or acquired by him or held by him on lease or mortgage, either in his own name or in the name of any member of his family or in the name of any other person. In terms of the instructions vide OM No.8/9/60-AIS(III) dated 16.02.1960 and OM No.11017/74/93-AIS(III) dated 04.01.1994 issued under this Rule, every member of the service is required to submit annual immovable property return by 31st January of the next year. Failure on the part of the members of the Service to comply with the requirements of the aforesaid provisions constitutes good and sufficient reason for institution of disciplinary proceedings,among other things vide this Department's OM No.104/33/200S-AVD-Idated 29.10.2007and 07.09.2011, against them.

2. In order to further facilitate the filing of IPR's, this Department has vide DO No.6(1)/2014-EO(PR) dated 22.12.2016 introduced online filing of IPR in respect of IAS officers w.eJ. 1st January, 2017 through the Module designed for the purpose. Through this Module, the officers can submit the IPR either electronically or upload scanned copy of the manually filled in IPR. This online Module closes automatically after the prescribed timeline of 31st January, 2020 in respect of the calendar year 2019.

3. I would, therefore, request you to kindly issue necessary instructions to all IAS officers working in your Ministry/ Department and its various organizations,to ensure that they submit their IPRs online in the IPR Module for the year ending on 31st December,2019, as per the prescribed timeline.

Sub: Implementation of suo motu disclosure under Section 4 of Right to Information (RTI) Act, 2005 – Issue of guidelines regarding 

The suo motu disclosure of information to public is mandated under Section 4 (2) of the RTI Act, 2005, so that the public have to resort minimally to the use of this Act to obtain information. Section 4(1)(b) of the Right to Information Act, 2005 lays down the information which should be disclosed by Public Authorities on a suo motu or proactive basis. Section 4(3) prescribes for wide dissemination of every information, in such form and manner which is easily accessible to the public.
The undersigned is directed to refer to this Department’s O.M. of even number dated 15th April, 2013 and to reiterate the guidelines therein (Copy enclosed), duly incorporating a slight revision to Para 4.4 of the above guidelines allowing for third party audit by any Government Training Institute, in cases where no Training Institute exists under the concerned Ministry/Department/Public Authority.

Central Government Ministries/Departments are advised to undertake suo motu disclosure based on these guidelines, in compliance to Sections 4(1)(b) read with Section 4(2), 4(3) and 4(4) of the RTl Act, 2005

The enclosed guidelines may be brought to the notice of all Public Authorities under the Ministry / Department including those in their Attached Offices, Subordinate Offices, Constitutional Bodies, Statutory Bodies, Autonomous Organizations and Public Sector Undertakings.

CIRCULAR

Subject: 2nd Athletic Meet for Wards of Central Government Civilian Employees working in Ministries located at Delhi/New Delhi.

2nd Athletic Meet for wards of Central Government Civilian Employees working in Ministries located at Delhi/new Delhi is proposed to organize at Vi nay Marg Sports Complex, Chankyapuri, New Delhi on 15 December 2019 (Sunday) at 9.00 AM. There is NO ENTRY FEE for this competition. The entry should be sent in the prescribed form along with copies of Parent's office Identity Card and Aadhar Card of the ward to the Board's Office latest by 09 December 2019 (Monday) at Room No. 361, 'B' Wing, Lok Nayak Bhawan, Khan Market, New Delhi or by email at sportsdopt@gmail.com.

3. Wards of the following categories of employees are not eligible for participation in this competition:-
(a) Uniform personnel in Defence Services/Para Military Organisations/ Central Police Organisation/Police/ RPF/ CISF/ BSFIITBP/ NSG etc.
(b) Employees of Autonomous bodies/ Undertakings/ Public Sector Banks/ Corporations even though administratively controlled by the Central Ministries.
(c) Casual/ Daily wages workers.
(d) Employees attached to offices on temporary duty.

4. Decision of the Judges will be final and no appeal against their decision would be entertained.

OFFICE MEMORANDUM

Subject:- Engagement of retired Government Employees as Consultant in the Department of Posts through advertisement.

The undersigned is directed to circulate the office Memorandum No. 31-5/2017-PE-II dated 23.10.2019 (along-with enclosures) received from Ministry of communications (Department of posts) who have invited applications from the Government Servants from the Central /States Govt./ Autonomous Bodies who have retired from the services for engagement as consultant.

General Terms & Conditions

Note 1 – The total monthly remuneration and the pension drawn by the consultant shall not be more than the Last Pay Drawn by him calculated at the current rates of Dearness Allowance.

Note 2 – Enhanced remuneration may be paid to deserving officials on case to case basis with the approval of Secretary, Department of Posts on account of special expertise/ experience in the concerned field.

3.2 Allowances: Consultants shall not be entitled accommodation to any kind of allowance or Accommodation facility e.g. Dearness Allowance, Transport Facility, Residential Personal Staff, CGHS and Medical Reimbursement etc. However, Conveyance Allowance shall be paid at the rates mentioned in the table above [Para 3,1 1.

3.3 TA/DA: No TA/DA shall be admissible for joining completion the assignment or on its completion, Foreign travel of consultants is not permitted at all. However, should they require to travel inside the country in connection with the official work of the competent TA/DA as admissible to a regular employee of the same grade, he/she retired from, will be paid to him/her after obtaining approval of the authority.

3.4 Drawal of pension: A retired Government officer/official appointed as consultant shall continue to draw pension and the dearness relief on pension during the period of his engagement as consultant, His/her engagement as consultant shall not be considered as a case of re-employment.

3.5 Leave: consultants shall be eligible for Eight (08) Days leave in a calendar year on pro rata basis. No remuneration for the period of absence admissible in excess of the leave will be paid to consultants. Also, un-availed leave shall neither be carried forward to next year nor encashed.

3.6 Tax Deduction at source [TDS]: TDS as admissible shall be deducted from the monthly remuneration of consultants. A TDS certificate shall be issued by the concerned DDO on demand.

3.7 Working Hours: Consultants may follow the normal working hours as prescribed [i,e. 09:00 AM to 05:30 PM), However, as per the exigency one has to sit late to complete the time bound work. Attendance would be made through Biometric Attendance System.

4. QUALIFICATION AND EXPERIENCE OF CONSULTANTS

4.1 He/ She should be a Retired Employee of central Government/ state Government / PSU / Autonomous Body having considerable experience of functioning of Central Government Ministries/ Departments.

4.2 He / she should have effective communication and interpersonal skills with a strong flair for in-depth examination relating to Policy Matters/ Administration / Finance / Any other requisite Field.

5. AGE LIMIT

Normally the maximum age limit for all categories of consultants will be 65 years. However, engagement beyond 65 years and upto 70 years may be resorted to in deserving cases with the approval of secretary (posts) keeping view his/ her good in health & level of expertise.

8. PERIOD OF ENGAGEMENT AND EXTENSION OF TENURE

8.1 The initial engagement of a person as consultant shall.be for the period as given in the Terms of Reference (ToR) or one year, whichever is less. After expiry of initial term, engagement may be extended, based on requirement of the Division and performance of consultant(s) concerned, with the concurrence of AS&FA & approval of Secretary (posts) for a maximum period of one year at a time and not more than 3 terms including initial engagement. Relaxation may be given in deserving cases.

8.2 Such extension proposals should not be sent to Establishment Division. The concerned Divisions may directly submit such proposals to AS&FA for concurrence and approval of secretary (Posts) or Minister-in-charge in case of Joint secretary and above. The final outcome of such proposals may be intimated to Establishment Division.

8.3 The appointment of Consultants is of a temporary (non-official) nature against the specific jobs.

8.4 The engagement of consultants can be terminated by the Department at any time without at assigning any reason thereof by giving them 15 Days notice. However, in case a consultant wishes to resign, he will, have to give 15 days advance notice or remuneration in lieu thereof before resigning from the engagement.

10. CONFIDENTIALITY OF DATA AND DOCUMENTS

10.1 The Intellectual Property Rights (IPR) of the data collected as well as deliverables produced for the Department shall remain with the Department.

10.2 No one shall utilize or publish or disclose or part with, to a third party, any-part of the data or statistics or proceedings or information collected purpose for the of his assignment or during the course of, assignment without for the Department the express written consent of the Department.

10.3 The consultant shall be bound to hand-over the entire set of assignment to the Department before the expiry of the contract and before the final payment is released the by the Department.

11 CONFLICT OF INTEREST

11.1 The consultant appointed by the Department shall in no case represent or give opinion or advice to others in any matter which is adverse to the interest of the Department nor will be indulge in any activity outside the terms of the contractual assignment.

11.2 The Consultant will not be entitled for any benefit/compensation / absorption / regurarization of service with this Department.

12. TERMINATION OF ENGAGEMENT

Department may terminate the engagement in following conditions:
i. The consultant is unable to address the assigned work;
ii. Quality of the work is not to the satisfaction of the Department;
iii. The consultant fails in timely achievement of the milestones as finally decided by the Department
iv. The consultant is found racking in honesty and integrity.

Note: The Department reserves the right to terminate the engagement, fifteen (15) days’written by serving notice on the consultant, Termination
on the day right shall be effected after the completion of fifteen (15) days of delivery of such notice.

13. COMPETENT AUTHORITY FOR TERMINATION OF ENGAGEMENT.

The Head of concerned Division, in case of consultant upto level-13.
Secretary (posts), in case of Consultant at Joint Secretary Level or above.

14. REVIEW OF GUIDELINES
These guidelines may be reviewed as and when the circumstances so warrant with the approval of the Secretary (Posts).

15. RIGHTS OF THE DEPARTMENT
The Department has the right to cancel the advertisement, and not go for engagement of Consultant, at any stage. It may accept or reject any or all applications, without giving any reasons therefor, whatsoever.

Subject: Filling up of one (01) post of Director, Level-13, Rs.1,23,100- 2,15,900 (pre-revised PB-4, Rs.37,400 - 67,000 + 8700 in deputation basis in Central Hindi Training Institute, New Delhi, a subordinate office of Department of Official Language, Ministry of Home Affairs.

The undersigned is directed to circulate the Office Memorandum No.14034/17/2019 dated 22nd October, 2019 (along-with enclosures) received from Ministry of Home Affairs who have invited the services of suitable officer urgently for appointment to the post of Director, in Central Hindi Training Institute, a subordinate office of the Department of Official Language Ministry of Home Affairs on deputation basis, in the revised pay scale Pay Matrix Level-13, Rs.1.23.100 - 2.15.900 (Pre-revised PB- Rs.37.400 - 6700 + Grade pay of Rs.8700)
