Subject: Protection of pay in cases of deputation under Central Staffing Scheme in terms of Rule 7 of Indian Administrative Service ( Pay) Rules, 2016 (7th CPC) and analogous provisions in IPS (Pay) Rules, and IFS (Pay) Rules - Regarding.

Sir,

I am directed to refer to queries received from various Ministries/Departments regarding method of pay protection in terms of Rule 7 of IAS (Pay) Rules, 2016 which is as under:-

IPS (Pay) Rules, 2016

”If the pay of the officers posted on deputation to the Central Government under Central Staffing Scheme, after fixation of their pay in the revised pay structure, either under these rules or as per the instructions regulating such fixation of pay on the post to which they are appointed on deputation, happens to be lower than the pay they would have been entitled to, had they been in their parent cadre and would have drawn that pay but for the Central deputation, such difference in the pay shall be protected in the form of Personal Pay with effect from the date of notification of Government Resolution in this regard, i.e. 25th July, 2016.

Further, if the member of Service is promoted in the cadre while on central deputation under Central Staffing Scheme, the difference in the pay that the officer would have drawn had he been in the parent cadre and the amount of pay on his deputation to Centre shall be protected in the form of personal pay with effect from the date of issue of Government Resolution.”

2.  Pay protection of officers on deputation under Central Staffing Scheme after implementation of IAS (Pay) Rules 2016 has been considered in consultation with Establishment Division of this Department and Department of Expenditure and is elaborated in subsequent

3. Pay Protection of IAS officers who were already on deputation under Central Staffing Scheme on 01.01.2016 or who joined deputation under Central Staffing Scheme on or after 01.01.2016

(a) Pay of such officers, as on 01.2016 [or a subsequent date from which they have opted to switch over to the IAS ( Pay) Rules, 2016] will be fixed in the Level of the post held by them on deputation under Central Staffing Scheme on the basis of the pay fixed in their parent cadre. The cell corresponding to the basic pay fixed in the parent cadre will be located in the Level in the Pay Matrix of the post in which the officer is serving on deputation under Central Staffing Scheme and pay shall be fixed at same stage/ equivalent cell. If no such cell is available in the applicable Level of the deputation post, the pay shall be fixed at the immediate lower cell in that Level of the deputation post and the difference in pay will be granted as Personal Pay.

Illustration :

If an officer holding the post in Level 15 in parent cadre and drawing pay of Rs.2,05,100/- goes on deputation under Central Staffing Scheme in Level 14 on 04.05.2017, his pay will be fixed as under :-

(a)Existing pay in the parent cadreLevel  15
(b)Existing pay in Level  15 as on 04.05.2017 in the parent cadreRs. 2,05,100 / – (cell 5 of Level 15)
(c)Pay fixed in Level 14 on Deputation under Central Staffing SchemeRs.1,99,600/- (cell  12 of Level 14) plus (Rs.5500/-Personal pay)
(d)On DNI in parent cadre : Pay in Level 15 in the Parent CadreRs. 2,11,300/- (cell 6 of Level 15)
(e)On DNI in paren t cadre: Pay on Central Deputation in Level 14Rs. 2,05,600/- (cell 13 of Level 14)  plus  (Rs.  5700/-  Personal pay)

(b) However, if an officer currently drawing pay up to Level 13 is appointed on deputation to a post in the equivalent or lower level on deputation  under Central Staffing Scheme OR during the continuance of deputation under Central Staffing Scheme gets an upgradation in his parent cadre to a Level higher than pay Level of deputation post up to Level 13 of the Pay Matrix, his pay will be fixed at the same cell and Level in which he is placed in the parent He will also be eligible to draw the CDTA on the pay of Level of the post in parent cadre at the prevailing rates. For the active period of deputation from 1.1.2016 to 30.6.2017 , CDTA will be admissible at the pre-revised rates in pre­ revised pay structure, i.e. as if the ·pay had not been  revised w.e.f. 1.1.2016. Provisions of this Department’s OM No.2 / 10/ 2017-Estt(Pay-II) dated 24th April, 2018 shall stand amended to this  effect. For the active period of deputation from 1st July, 2017 onwards, CDTA will be admissible as per the guidelines in this Department’s OM No. 2 / 10/2017-Estt(Pay II) dated 24th April, 2018.

Illustration :

(I) If an officer holding the post in Level 13 in parent cadre and drawing pay of 1,26,800/- goes on deputation under Central Staffing Scheme in Level 13 on 22.02.2017, his pay will be fixed as under :-

(a)Existing pay in the parent cadreLevel 13
(b) Existing pay in cell 2 of Level 13 as on 22.02.2017 in the parent cadreRs. 1,26,800/- (cell 2 of Level 13)
(c)Pay fixed in Level 13 on Deputation under Central Staffing SchemeRs. 1,26,800/- (cell 2 of Level 13)

4. Protection/ Fixation of pay of IAS officers who were on deputation under Central Staffing Scheme on 01.01 .2016 or who joined deputation under Central Staffing Scheme on or after 01.01.2016 and got Proforma promotion in parent cadre :-

(a) In case the officer was on deputation under CSS on 01.2016 or joined thereafter and his junior is promoted to a higher post in his parent cadre on or after 01.01.2016, but was not granted proforma promotion under the ‘Next Below Rule’, there will be no change in the pay fixation already done as per extant rules.

 

(b) In case an officer on deputation to a post under Central Staffing Scheme gets proforma promotion in his cadre to a post up to Level 13 in the Pay matrix, his pay in the Level of the post will be fixed with reference to the presumptive pay that he would have got had he remained and promoted in the parent cadre of his service in the manner as provided in para 3(b) .

(c) In case an officer on deputation under Central Staffing Scheme gets promoted in his cadre to a higher post in Level l 3A or above in the Pay matrix, his pay in the Level of the post held on deputation under Central Staffing Scheme will be fixed with reference to the presumptive pay of the officer in the parent cadre of his The Cell corresponding to such basic pay fixed in parent cadre will be located in the Level in the Pay Matrix of the post in which the officer is serving on deputation under Central Staffing Scheme, and pay shall be fixed at same stage/ equivalent cell and if no such cell is available in the applicable Level, the pay shall be fixed at the immediate lower cell in that Level of the post and the difference in pay will be granted as Personal  Pay. Illustrations may be seen below:-

If an officer holding the post in Level 16 in parent cadre drawing pay of Rs.2,24,400/-, who is on deputation under Central Staffing Scheme in Level 15 and drawing pay Rs. 2,24,100/- + Rs.300/- (Personal pay) gets proforma promotion in Level 17, his pay will be fixed as under :-

(a)Pay level in the pay matrix in parent cadre before joining on deputation under  Central Staffing SchemeLevel 16
(b)Pay level in the Central Staffing SchemeLevel 15
(c)Existing pay as on  01.05.2017 on Deputation under Central Staffing Scheme in Level 15Rs.2,24,100/ – (cell  8 of Level 15) plus (Rs.300/- Personal pay) [Corresponding to pay of Rs.2,24,400 /- of Level 16]

7th CPC IPS Pay Rules 2016

5 (a) The officer shall get Dearness Allowance on the said Personal Pay as admissible from time to time. However, no other allowance shall be admissible on this Personal Pay.

(b) The Basic Pay plus Personal  Pay, from time to time,  shall not exceed Rs. 2,25,000.

6. Grant of annual increment to officers on Deputation under Central Staffing Scheme

On grant of annual increment to an officer in parent  cadre (upto Level 16) who is on deputation under Central Staffing Scheme, the pay will be fixed increment.ally moving down one cell in the Level of pay in which the officer is serving on deputation under Central Staffing Scheme. Accordingly,  the Personal Pay, if any, will be re-computed as the difference in the pay (after increment) that h e would have drawn in the parent cadre and the current pay on deputation under Central Staffing Scheme.

7. The aforementioned  instructions  are  applicable  to   All   India   Service officers (i.e. IAS, IPS, IFS) with effect from 01.01.2016.

OFFICE MEMORANDUM

Subject: Special concessions to Central Government employees working in Kashmir Valley in attached/ subordinate offices or PSUs falling under the control of Central Government.

The undersigned is directed to refer to this Department’s O.M. of even number dated 08th January, 2019 on the subject mentioned above and to state that it has been decided by the competent authority to extend the package of concessions / incentives to Central Government employees working in Kashmir Valley for a further period from 01.01.2020 to 31.07.2021. The package for the period from 01.01.2020 to 31.07.202 1 is as per Annexure.

2. The package of incentives is uniformly applicable to all Ministries/ Departments and PSUs under the Government of India and they should ensure strict adherence to the rates prescribed in the The concerned Ministry/ Department may ensure implementation and monitoring of the package in conformity with the approved package, and therefore, all court cases in which verdicts are given contrary to the package would have to be contested by the Ministries/ Departments concerned.

ANNEXURE to DOPT’s 0.M. No.18016/ 3/ 2018-Estt.(L) dated the 14th October, 2020.

DETAILS OF PACKAGE OF CONCESSIONS/ INCENTIVES TO CENTRAL GOVERNMENT EMPLOYEES WORKING IN KASHMIR VALLEY IN ATTACHED/ SUBORDINATE COFFEES OR PSUs FALLING UNDER THE CONTROL OF CENTRAL GOVERNMENT.

[Kashmir Valley comprises of ten districts namely Anantnag, Baramulla, Budgam, Kupwara, Pulwama, Srinagar, Kulgam, Shopian, Ganderbal and Bandipora]

  1. a) Extension of Special concessions/ incentives for a further period from 01.2020 to 31.07.2021 to Central Government employees working in the 10 districts of Kashmir Valley.

I. ADDITIONAL HOUSE RENT ALLOWANCE AND OTHER CONCESSIONS:

(A) EMPLOYEES POSTED IN KASHMIR VALLEY:

(i) The employees shall have an option to move their families to a selected place of their choice in India at Government expenses and the transport allowance for the families are proposed to be allowed as admissible in anent transfer inclusive of the Composite Transfer Grant at the rate of 80 per cent of the last month’s basic pay;

(ii) Departmental arrangements for stay, security and transportation to the place of work for employees;

(iii) Additional house rent allowance at the rate of Class ‘Y’ city (16 per cent of basic pay) for employees who leave their family at their last place of posting, except officials who have retained Government accommodation to accommodate their families and these employees shall be eligible for drawing the normal house rent allowance as well as at their place of posting if the Departmental arrangement is not made for his stay;

(B) EMPLOYEES POSTED TO KASHMIR VALLEY WHO DO NOT WISH TO MOVE THEIR FAMILIES TO A SELECTED PLACE OF

The per diem allowance of Rs. 113/ – per day is paid for each day of attendance to compensate for any additional expense in transportation from to and from office etc. in terms of the Department of Expenditure OM No. 19030/11/ 2017-E.N, dated 13.07.2017.

(C) THE PERIOD OF TEMPORARY DUTY EXTENDED TO SIX Months

For period of temporary duty, an incentive known as the Kashmir Valley Special Incentive will be paid at the following rates along with food charges (as per 7th Pay Commission norms), apart from departmental arrangements for stay, security and transportation:

II. MESSING FACILITIES:

  • Messing allowance is paid @ Rs.97.85/- per day.

III. PAYMENT OF MONTHLY PENSION:

The pensioners of Kashmir Valley who are unable to draw their monthly pensions through either Public Sector Banks or Pay and Accounts Office treasuries from which they were receiving their pensions, are given pensions outside the Valley, where they have settled, in relaxation of relevant provisions.

NOTE :-

i. The package of concessions / incentives shall be admissible in Kashmir Valley comprising of ten Districts namely, Anantna Baramulla, Budgam, Kupwara, Pulwama, Srinagar, Kulgam, Shopian, Ganderbal and Bandipora.

ii The Package of concessions / incentives shall be admissible to Temporary Status Casual Laborers working in Kashmir Valley in terms of Para 5(i) of the Casual Laborers (Grant of Temporary Status and Regularization) Scheme of Government of India, 1993.

iii. The benefit of additional house rent allowance admissible under the Kashmir Valley package shall be admissible to all Central Government employees posted in Kashmir Valley irrespective of whether they are natives of Kashmir Valley, if they choose to move their families anywhere in India subject to the conditions governing the grant of these allowances.

The facilities of Messing Allowance and Per Diem Allowances shall also be allowed to natives of Kashmir Valley in terms of the Kashmir Valley package.

Sub: Calculation of monthly contribution towards cost of Pension payable during foreign service – Reg.

The undersigned is directed to invite reference to this Department’s OM No. 2/34/2008-Estt (Pay-II) dated 19th November, 2009 on the above subject and to say that according to this OM w.e.f. 01.01.2006, the pension contribution payable in respect of a Government employee during the active period of his foreign service shall be based on the existing basic pay (Pay in the Pay Band plus Grade Pay) of the post held by the Government servant at the time of proceeding on foreign service, and in case he receives Proforma promotion/ financial up-gradation while on foreign service, on the basic pay (Pay in the Pay Band plus Grade Pay) fixed on such promotion/ financial up-gradation.

2. Consequent upon implementation of the recommendations of the 7th CPC, the matter of issuing revised instructions on the above subject has been engaging the attention of the Government of India. The President is now pleased to decide that pension contribution payable in respect of a Government servant during the active period of his foreign service shall be based on the basic pay in the level (in Pay Matrix) of the post held by him/ her at the time of proceeding on foreign service; and in case of grant of Proforma promotion/financial up-gradation while on foreign service, the same shall be based on basic pay in the Level (in Pay Matrix) fixed on such Proforma promotion / financial up-gradation.

3. In respect of Government employees covered by the NPS, during the active period of foreign service w.e.f. 01.01.2016, it has been decided to fix the monthly Pension contribution @ 24% of basic pay in the level (in Pay Matrix) of the post held by him/her at the time of proceeding on foreign service plus DA admissible on such basic pay (i.e. employee’s contribution @ 10%, employer’s contribution @ 10% and contribution by employer for gratuity @ 4%). However, consequent to revision of Government’s contribution for NPS from 10 % to 14% w.e.f. 01.04.20 19 vide Department of Financial Services Notification dated 31.01.2019, the monthly Pension contribution for Government employees covered by the NPS w.e.f. 01.04.2019 will be 28% of basic pay in the level (in Pay Matrix) plus DA of the post held by him/her, which will include employee’s contribution @ 10%, employer’s contribution @ 14%, and contribution by employer for gratuity @ 4%. In case of grant of Proforma promotion/ financial up-gradation while on foreign service, the same shall be based on basic pay in the Level (in Pay Matrix) fixed on such Proforma promotion /financial up-gradation.

4. In respect of the employees covered under the Old Defined Benefit Pension Scheme, it has been decided to fix their rates of monthly contribution of pension during the active period of foreign service as 14% of basic pay in the level (in Pay Matrix) of the post held by him/her at the time of proceeding on foreign service plus DA admissible on such basic pay during foreign service w.e.f. 01.01.2016. The monthly contribution of pension during the active period of foreign service w.e.f. 01.04.2019 will be 18% of the basic pay in Pay Matrix of the post held by the officer at the time of proceeding on foreign service plus DA admissible on such basic pay.

In case of grant of Proforma promotion/ financial up-gradation while on foreign service, the same shall be based on basic pay in the Level (in Pay Matrix) fixed on such Proforma promotion/ financial up-gradation.

5. It has also been decided that these pension contributions would be in addition to the leave salary contributions for the period of foreign service, in respect of both NPS employees and the employees under Old Defined Benefit Pension Scheme.

6. In case of employees covered under NPS, during the period of active foreign service, the borrowing organisation shall make its part of contribution mandatorily to the NPS Account of the employee.

7. This OM will be effective from 01.01.2016. In respect of persons who are already on foreign service as on 01.01.2016, the pension contribution will be calculated at the above rates on the revised pay as per 7th CPC from the date which they opt to come over to the revised pay structure after implementation of 7th CPC recommendations, in their parent cadres. For the earlier period, the pension contributions will be as per extant orders i.e. the order in force during period prior to 01.01.20 16 from time to time.

8. The modalities! mechanism of payment of pension contribution during the active period of foreign service in respect of NPS subscribers will be issued separately.

9. In their application to the persons belonging to Indian Audit and Accounts Department, these orders are issued under Article 148(5) of the Constitution and after consultation with the Comptroller & Auditor General of India.

1. Refer further to this office letter No.CC-3/85610/47/MACP/D’ Man/6th/CSCC dated 21 April 2017.

2. The undersigned is directed to inform that the approval of grant of 2nd Financial Upgradation after completing 24 yrs of service under ACP scheme of DoPT in respect of Draughtsman & Tech Officers in the pay scale of Rs.15600 – 39100 plus Grade pay of Rs. 6600/- in MES for the intervening period between 01 Jan 2006 to 30 Aug 2008 was granted by MoD after thorough scrutiny of the proposal.

3. Some complaints & grievances were filed against this grant of 2nd Financial Upgradation under ACP scheme by few individuals. In this connection the matter was again sent to MoD for further scrutiny and examinations. The decision of MoD in this regard is reproduced below :-

 “It is stated that the case for grant based on the analogy of Draughtsman Cadre of MES and Assistant (Arch Department) of CPWD provided by E-in-C’s Branch and as per Financial Upgradation to the TOs of Draughtsman Cadre of MES was granted as per the extant rules and guidelines of DoP&T.”

4. In view of the above, it is advised to take further necessary action as per the clarification of the MoD

Subject: Counting of the limitation period for the diverse purposes under CCS (CCA) Rules, 1965, CCS (Pension) Rules, 1972

The undersigned is directed to refer to OM of even number dated 30th March, 2020 whereby, considering the unprecedented situation of lockdown w.e.f. 24th March, 2020, the period of lockdown was decided to be excluded from the time-limits prescribed in various Rules/instructions. While in the initial periods of lockdown, the Government offices were directed to work either with skeletal staff or with 1/3rd of its strength, DoPT’s extant instructions provide for attendance of 100% officers of the level of DS & above and 50% below DS on all working days. Ministry of Home Affairs vide its Order dated 30th May, 2020 has also issued instructions for phase-wise reopening of prohibited activities outside the containment zone. In view of this, it has now been decided that the exclusion of lockdown period w.e.f. 24th March, 2020 shall cease to have further effect with the issue of this O.M. Therefore, after exclusion of lockdown period, action as per time-lines provided under various Rules/ instructions may be completed within the period as explained in paras 2 & 3 of O.M. dated 30th March, 2020 referred above.

The undersigned is directed to refer to Central Civil Services (Classification, Control & Appeal) Rules, 1965 [CCS(CCA) Rules, 1965] and Central Civil Services (Pension) Rules, 1972 [CCS(Pension) Rules, 1972] and the instructions issued under these Rules wherein certain timelines have been prescribed for various activities/ events/ procedures relating to procedures under the said Rules, For instance, in the said Rules/instructions, time limits have been prescribed for the following:
  • Review of order of Suspension before its expiry date [Rule 10(6) of CCS(CCA) Rules, 1965]
  • Submission of written statement of defence on the charge-sheet by the charged officer ISub Rule 4 in Rule 14 of CCS (CCA) Rules, 1965]
  • issuance of charge-sheet once a decision is taken by the Disciplinary Authority to initiate Disciplinary proceedings.{DopTs 0. M. No. 425/04/2012-AVDIV(A) dated 29.11.2012],
  • completion of Inquiry and submission of report by the Inquiring Authority [Sub rule (24) in Rule 14 of CCS (CCA) Rules, 1965]
  • disciplinary proceedings initiated against a Pensioner shall not be in respect of an event which took place four years before such initiation,{Rule 9 of CCS(Pension) Rules, 1972]
  • Acceptance of notice of VRS under Rule 48Aof CCS(Pension) Rules, 1972

2. Consequent upon the outbreak of COVID-19, and considering the unprecedented situation of the Lockdown w.e.f. 24th March 2020, it may not be feasible to adhere to the timelines prescribed in the said Rules and to the instructions issued under the Rules. It has accordingly been decided not to count the period of the Lockdown for the purposes of adherence to the prescribed timelines, including those listed above. For example, if the due date for completing a process/work/event at the start of the Lockdown falls after 20 days, then the due date will get postponed by the number of Lockdown days and the same number (20) of days will be available to complete the work after the Lockdown is lifted.

3. However, after the Lockdown is lifted, if the time left to complete the task is less than 15 days) then the processes may be allowed to be completed within 15 days.

4. In addition, timelines may have been prescribed for receipt of applications for direct recruitment, deputation, etc. Where the last date of receipt of application for direct recruitment, deputation etc. falls within the period of the Lockdown, the last date shall be extended by the number of days of the Lockdown. Similarly, the time limits prescribed in the CCS (Conduct) Rules, 1964, for various purposes shall also be extended by the number of days of the Lockdown.

5. These instructions are applicable only in such cases where there is an intervening Lockdown period and it will not be applicable otherwise.

The undersigned is directed to refer to OM of even number dated the 17th March, 2020, 18th May, 2020 and 19th May, 2020 whereby advisory for well-being of Government employees and attendance in Government offices with staggered timings were issued by Department of Personnel & Training (DoPT).

2. Kind attention is also drawn to Ministry of Home Affairs’ Order dated 30.05.2020 whereby ‘Additional Directives for Work Places’ have been prescribed. Further, the Ministry of Health & Family Welfare (MoH&FW) on 4th June, 2020 has issued Standard Operating Procedure on preventive measures to contain spread of COVID-19 in workplace settings (copy enclosed).

3. It is emphasized that strict adherence to the practices of social distancing norms and health & hygiene practices, as enunciated in these guidelines, is of paramount importance and the Government servants as responsible employees should abide by these practices so that the Government offices function in the most efficient manner in the given situation. All the Ministries / Departments/offices as well as the Central Government employees are, therefore, directed to ensure strict compliance of instructions issued by DoPT as well as MHA and MoH&FW.

SOP on preventive measures to contain spread of COVID-19 in offices

1. Background
Offices and other workplaces are relatively close settings, with shared spaces like work stations, corridors, elevators & stairs, parking places, cafeteria, meeting rooms and conference halls etc. and COVID-19 infection can spread relatively fast among officials, staffs and visitors.
There is a need to prevent spread of infection and to respond in a timely and effective manner in case suspect case of COVID-19 is detected in these settings, so as to limit the spread of infection.

2. Scope
This document outlines the preventive and response measures to be observed to contain the spread of COVID-19 in office settings. The document is divided into the following sub-sections
(i) Generic preventive measures to be followed at all times
(ii) Measures specific to offices
(iii) Measures to be taken on occurrence of case(s)
(iv) Disinfection procedures to be implemented in case of occurrence of suspect / confirmed case.

Offices in containment zones shall remain closed except for medical & essential sevices. Only those outside containment zones will be allowed to open up.

3. Generic preventive measures
Persons above 65 years of age, persons with comorbidities, pregnant women are advised to stay at home, except for essential and health purposes. Office management to facilitate the process.
The generic preventive measures include simple public health measures that are to be followed to reduce the risk of infection with COVID-19. These measures need to be observed by all (employees and visitors) at all times. These include:

i. Individuals must maintain a minimum distance of 6 feet in public places as far as feasible.
ii. Use of face covers/masks to be mandatory.
iii. Practice frequent hand washing with soap (for at least 40-60 seconds) even when hands are not visibly dirty. Use of alcohol-based hand sanitizers (for at least 20 seconds) can be made wherever feasible.
iv. Respiratory etiquettes to be strictly followed. This involves strict practice of covering one’s mouth and nose while coughing/sneezing with a tissue / handkerchief / flexed elbow and disposing off used tissues properly.
v. Self-monitoring of health by all and reporting any illness at the earliest to the immediate supervisory officer.
vi. Spitting shall be strictly prohibited.
vii. Installation & use of Aarogya Setu App by employees.

4. Specific preventive measures for offices:

i. Entrance to have mandatory hand hygiene (sanitizes dispenser) and thermal screening provisions.

ii. Only asymptomatic staff/visitors shall be allowed.

iii. Any officer and staff residing in containment zone should inform the same to supervisory officer and not attend the office till containment zone is denotified. Such staff should be permitted to work from home and it will not be counted as leave period.

iv. Drivers shall maintain social distancing and shall follow required dos and don’ts related to COVID-19. It shall be ensured by the service providers/ officers/ staff that drivers residing in containment zones shall not be allowed to drive vehicles.

v. There shall be provision for disinfection of the interior of the vehicle using 1% sodium hypochlorite solution/ spray. A proper disinfection of steering, door handles, keys, etc. should be taken up.

vi. Advise all employees who are at higher risk i.e. older employees, pregnant employees and employees who have underlying medical conditions, to take extra precautions. They should preferably not be exposed to any front-line work requiring direct contact with the public. Office management to facilitate work from home wherever feasible.
vii. All officers and staff / visitors to be allowed entry only if using face cover/masks. The face cover/mask has to be worn at all times inside the office premises.
viii. Routine issue of visitors/ temporary passes should be suspended and visitors with proper permission of the officer who they want to meet, should be allowed after being properly screened.
ix. Meetings, as far as feasible, should be done through video conferencing.
x. Posters/ standees/ AV media on preventive measures about COVID-19 to be displayed prominently.

xi. Staggering of office hours, lunch hours/coffee breaks to be done, as far as feasible.

xii. Proper crowd management in the parking lots and outside the premises – duly following social distancing norms be ensured.
xiii. Valet parking, if available, shall be operational with operating staff wearing face covers/ masks and gloves as appropriate. A proper disinfection of steering, door handles, keys, etc. of vehicles should be taken up.

xiv. Any shops, stalls, cafeteria etc., outside and within the office premises shall follow social distancing norms at all times.

xv. Specific markings may be made with sufficient distance to manage the queue and ensure social distancing in the premises.

xvi. Preferably separate entry and exit for officers, staff and visitors shall be organised.

xvii. Proper cleaning and frequent sanitization of the workplace, particularly of the frequently touched surfaces must be ensured.

xviii. Ensure regular supply of hand sanitisers, soap and running water in the washrooms.

xix. Required precautions while handling supplies, inventories and goods in the office shall be ensured.

xx. Seating arrangement to be made in such a way that adequate social distancing is maintained.

xxi. Number of people in the elevators shall be restricted, duly maintaining social distancing norms.

xxii. For air-conditioning/ventilation, the guidelines of CPWD shall be followed which inter alia emphasises that the temperature setting of all air conditioning devices should be in the range of 24-30°C, relative humidity should be in the range of 40¬70%, intake of fresh air should be as much as possible and cross ventilation should be adequate.

xxiii. Large gatherings continue to remain prohibited.

xxiv. Effective and frequent sanitation within the premises shall be maintained with particular focus on lavatories, drinking and hand washing stations/areas.

xxv. Cleaning and regular disinfection (using 1% sodium hypochlorite) of frequently touched surfaces (door knobs, elevator buttons, hand rails, benches, washroom fixtures, etc.) shall be done in office premises and in common areas

xxvi. Proper disposal of face covers / masks / gloves left over by visitors and/or employees shall be ensured.

xxvii. In the cafeteria/canteen/dining halls:
a.Adequate crowd and queue management to be ensured to ensure social distancing norms.
b. Staff / waiters to wear mask and hand gloves and take other required precautionary measures.
c.The seating arrangement to ensure a distance of at least 1 meter between patrons as far as feasible.
d. In the kitchen, the staff to follow social distancing norms.

5. Measures to be taken on occurrence of case(s):
Despite taking the above measures, the occurrence of cases among the employees working in the office cannot be ruled out. The following measures will be taken in such circumstances:

i. When one or few person(s) who share a room/close office space is/are found to be suffering from symptoms suggestive of COVID-19:
  • Place the ill person in a room or area where they are isolated from others at the workplace. Provide a mask/face cover till such time he/she is examined by a doctor.
  • Immediately inform the nearest medical facility (hospital/clinic) or call the state or district helpline.
  • A risk assessment will be undertaken by the designated public health authority (district RRT/treating physician) and accordingly further advice shall be made regarding management of case, his/her contacts and need for disinfection.
  • The suspect case if reporting very mild/mild symptoms on assessment by the health authorities would be placed under home isolation.
  • Suspect case, if assessed by health authorities as moderate to severe, will be treated as per health protocol in appropriate health facility.
  • The rapid response team of the concerned district shall be requisitioned and will undertake the listing of contacts.
  • The necessary actions for contact tracing and disinfection of work place will start once the report of the patient is received as positive. The report will be expedited for this purpose.
ii. If there are large numbers of contacts from a pre-symptomatic / asymptomatic case, there could be a possibility of a cluster emerging in workplace setting. Due to the close environment in workplace settings this could even be a large cluster (>15 cases). The essential principles of risk assessment, isolation, and quarantine of contacts, case referral and management will remain the same. However, the scale of arrangements will be higher.

iii. Management of contacts:
  • The contacts will be categorised into high and low risk contacts by the District RRTas detailed in the Annexure I.
  • The high-risk exposure contacts shall be quarantined for 14 days.
  • These persons shall undergo testing as per ICMR protocol.
  • The low risk exposure contacts shall continue to work and closely monitor their health for next 14 days.
  • The flowchart for management of contact/ cases is placed at Annexure – II.
6. Closure of workplace
i. If there are one or two cases reported, the disinfection procedure will be limited to places/areas visited by the patient in past 48 hrs. There is no need to close the entire office building/halt work in other areas of the office and work can be resumed after disinfection as per laid down protocol.
ii. However, if there is a larger outbreak, the building/block will have to be closed for 48 hours after thorough disinfection. All the staff will work from home, till the building/block is adequately disinfected and is declared fit for re-occupation.

7. Disinfection Procedures in Offices
Detailed guidelines on the disinfection as already issued by Ministry of Health & Family Welfare as available on their website shall be followed.

Annexure I

Risk profiling of contacts
Contacts are persons who have been exposed to a confirmed case anytime between 2 days prior to onset of symptoms (in the positive case) and the date of isolation (or maximum 14 days after the symptom onset in the case).

High-risk contact
  • Touched body fluids of the patient (respiratory tract secretions, blood, vomit, saliva, urine, faeces; e.g. being coughed on, touching used paper tissues with a bare hand)
  • Had direct physical contact with the body of the patient including physical examination without PPE
  • Touched or cleaned the linens, clothes, or dishes of the patient.
  • Lives in the same household as the patient.
  • Anyone in close proximity (within 1 meter) of the confirmed case without precautions.
  • Passengers in close proximity (within 1 meter) in a conveyance with a symptomatic person who later tested positive for COVID-19 for more than 6 hours.
Low-risk contact
  • Shared the same space (worked in same room/similar) but not having a high-risk exposure to confirmed case of COVID-19.
  • Travelled in same environment (bus/train/flight/any mode of transit) but not having a high-risk exposure.

The undersigned is directed to refer to this Department’s OM of even number dated 01.07.2019 wherein instructions, for dealing with stepping up of pay cases consequent to directions of Hon’ble High Court of Delhi vide their interim orders in various Writ Petitions filed in the matter, were issued.

2. In this connection it is reiterated that the pay of the petitioners and similarly placed non-petitioners is to be restored only if they submit the ‘Affidavit of Undertaking’ as directed by the Hon’ble High Court of Delhi in the format attached with this Department’s OM under reference.

3. As regards the manner in which the pay is to be restored, it is clarified that the pay of the petitioners and non-petitioners, who submit the affidavit of undertaking in the prescribed format, may be restored notionally from the date with effect from which the stepping up of pay was granted earlier and regularly from the date of submission of the affidavit of undertaking as directed by Hon’ble High Court of Delhi subject to the outcome of the Writ Petitions or orders of any competent court in related matters.

4. If an officer, whose pay has been restored in accordance with the above instructions, superannuates or retires voluntarily, his/ her case may be dealt as per the provisions of CCS (Pension) Rules 1972 relating to provisional pension, payment of gratuity etc.

The undersigned is directed to say that MHA vide its Order No. 40-312020-DM-I(A) dated 01.05.2020 has extended the period of lockdown for a further period of two weeks with effect from 04.05.2020 and issued new guidelines on the measures to be taken by Ministries / Department of Government of India, States / UT Governments and State / UT authorities for containment of COVID-19 in the country. These revised guidelines will come into force with effect from 04.05.2020. In the light of the instructions contained in the said orders, the following instructions are issued w.e.f. 04.05.2020 till 17.05.2020 :-

  • Deputy Secretary and above levels shall attend office with 100% attendance during normal office hours i.e. 9.00 AM to 5.30 PM.

  • The personal staff of Deputy Secretary and above levels officers, viz Sr. PPS, PPS, PS, Steno Grade D. Consultant and MTS shall also attend the office during normal office hours i.e. 9.00 AM to 5.30 PM. The concerned reporting officers may rotate duties of their personal staff as per their requirements in the tight of the guidelines.
  • Remaining officers / staff upto thirty three percent (33%) are required to attend office every day from 04.05.2020 till 17.05.2020 during normal office hours i.e.9.00 AM to 5.30 PM.
  • The roster issued vide OM of even number dated 16 April 2020 shall apply for the extended lockdown period of 04 - 17 May 2020,i.e. officials listed to attend office during the week of 20-24 April 2020 shall attend office in the week of 4-8 May 2020 and those who listed to attend office during the week of 27 April to 1 May 2020 shall attend office during the week of 11-17 May 2020.
  • However. concerned Bureau Heads/ Divisional Heads may change the roster as per work exigencies within the 33% limitation as mentioned at point (III) above. Divisional heads will also monitor the attendance and punctuality of their respective officers / staff. The officers residing in containment zones may be exempted.
  • The officials posted in the O/o Hon’ble MoS (IC) (L&E) would seek instructions from PS to Minister.
  • All officers / officials must leave their contact numbers (mobile as well as landline) with their controlling officers and they should be available for being called to office at short notice, as per exigency.
  • All the officers/officials attending office are to follow Govt. guidelines on COVID-19 particularly with regard to maintaining social distance.
  • All Attached /Subordinate / Autonomous offices may issue similar instructions in accordance with the guidelines issued by MHA.
2. Since daily attendance is being sought by DoPT telaphonically, all Divisional Heads/ personal staff of officers are requested to convey attendance in respect of Sections / offices to US/ SO (Admn.I) by 11 am, so that consolidated attendance could be conveyed to DoPT by 12 noon.

2. Attention in this connection is invited to para 3 of Office Order No. 25 of 2020 and also para 2 of DOP&T’s enclosed OM for following the extant instructions in letter and spirit. While preparing the roster /asking Officials below Deputy Secretary level for reporting to Office, the guiding principle should be that only upto 33% Officials and depending on the requirement be called for working from Office and all others who are not being called at Office or are residing at Containment Zones should work from home and be available at all times on Mobile phones and other Electronic means of Communications. Officials below Deputy Secretary level should not regularly be called to avoid crowding in the Office, except in case of exigencies of work.

Subject:- Preventive measures to contain the spread of COVID-19

The undersigned is directed to refer to O.M of even number dated 17th March, 2020 on the above-mentioned subject. The Ministry of Home Affairs (MHA) vide its Order dated 15.4.2020 has now extended the nationwide lockdown till 3rd May, 2020 to contain spread of Coronavirus in the country and has issued the consolidated revised guidelines for strict compliance. Para 18(ii) of these consolidated revised guidelines, inter-alia, provide that all officers of the level of Deputy Secretaries & above are to function with 100% attendance while 33% of the remaining officers/staff are to attend offices as per requirement.

2. The spirit of the guidelines is that crowding in the offices may be avoided and safe social distancing norms may be maintained. It is, however, seen that in some Ministries/ Departments, more than 33% of officials /staff below Deputy Secretary level are being called to offices. This might lead to undesirable crowding in the office jeopardizing the preventive measures in place for containing the spread of COVID-19.

3. It is reiterated that guidelines for attendance for officers/staff at levels below Deputy Secretary, be strictly followed. Heads of Departments (HoDs) may also direct their officers/staff to attend office in staggered timings to further avoid crowding in offices/work spaces. As suggested vide O.M. of even number dated 19th March, 2020, the staggered timings may be as follows :-
(a) 9.00 am. to 5.30 p.m.
(b) 9.30 a.m. to 6.00 p.m.
(c) 10 a.m. to 6.30 p.m.
Suitable Roster May, accordingly, be drawn up by the Heads of Department. Needless to say that officials/ staff working from home on a particular day should be available on telephone and electronic means of communications at all times. They should attend office, if called for any exigencies of work.

The Department of Personnel & Training had vide OM No. 21011 /1/2005-Estt (A) (Pt-II) dated 14.05.2009, issued instructions regarding maintenance and preparation of Annual Performance Appraisal Reports. It was inter-alia stated therein that full APAR, including the overall grading and assessment of integrity, shall be communicated to the concerned officer. The new system of communicating entries in the APAR was made applicable prospectively with effect from the reporting period 2008-09.

2. Subsequently, this Department vide O.M. No.21011/1/ 2010-Estt.A dated 13.04.2010 issued instructions regarding disclosure of below benchmark gradings in ACRs of the period prior to 2008-09, providing that if an employee is to be considered for promotion in a future DPC and his ACRs prior to the period 2008-09, which would be reckonable for assessment of his fitness in such future DPCs, contain final grading which are below benchmark. for his next promotion, before such ACRs are placed before the DPC, the concerned employee will be given a copy of the relevant ACR for his representation, if any, within 15 days of such communication. It was clearly stated therein that only below benchmark ACR for the period relevant to promotion need be sent to the officer reported upon and there is no need to send below benchmark ACRs of other years.

3. References are being received in this Department from various Ministries / Departments seeking comments / views on disclosure of below benchmark ACRs of the period prior to 2008-09, which have already been considered by DPC prior to 13.04.2010, for promotion to a post/ grade, for a representation and holding review DPC after due consideration of such representation.

4. The matter has been considered in this Department and it is felt that acceding to the request for disclosure of below benchmark gradings in ACRs for the period prior to 2008-09 will open flood gates and a large number of employees, both serving and retired, may come up with a request for disclosure of their ACRs of old periods, resulting into administrative difficulties and chaos. It is, therefore, reiterated that only such below benchmark ACRs prior to the reporting period 2008-09 need to be disclosed to the officer reported upon for his representation, as are reckonable for assessment of fitness in future DPCs. In other words, below benchmark grading in the ACRs for the period prior to 2008-09 need not be disclosed to the officer reported upon, if the same are not reckonable for future DPCs.

5. This Department may be consulted in case of any deviation from the aforesaid instructions.

Subject: Consolidated Instructions on procedure to be adopted for making appointments on deputation basis - Crucial date for determining the age-limit - reg.

The undersigned is directed to refer to DoPT OM AB-14017/71/89- Estt.RR dated 03.10.1989 prescribing the procedure / guidelines to be followed in cases where appointment is to be made on deputation basis. The relevant para of the aforesaid OM, prescribing crucial data for determination of eligibility, reads as under:
6.1 Where a post is required to be filled by transfer on deputation (including short term contract) / transfer, it is normally laid down in the recruitment rules that officers holding posts in a particular scale of pay who have completed specified years of regular service in the scale are eligible to be considered. The crucial date for determination of eligibility will be as follows:


i) In the case of a vacancy already existing at the time of issue of the communication inviting nominations, the eligibility may be determined with reference to the last date prescribed for receipt of nominations in the Ministry / Departments / Organization responsible for making appointment to the post i.e. originating Ministry etc.

ii) In the case of an anticipated vacancy the crucial date for determining eligibility should be the date on which the vacancy is expected to arise.

2. These instructions were subsequently modified vide DoPT OM No AB.14017/49/92- Estt. (RR) dated 15.06.1993, to provide for the crucial date for determination of eligibility in cases of composite method of recruitment. Clarifications on the subject have also been provided in the replies to Frequently Asked Questions (FAQs), issued from time to time.

3. The Appointments Committee of the Cabinet (ACC), while considering a case of appointment on deputation basis, observed that some Ministries/ Departments were not adhering to the aforesaid instructions on determination of eligibility and the crucial date for appointment on deputation basis.

4. Accordingly, the instructions regarding crucial date for determination of eligibility for appointment on deputation basis and through the composite method (deputation / promotion), as provided in OMs dated 3.10.1989 and 15.6.1993, are hereby reiterated, with further advice to all Ministries / Departments to strictly adhere to these guidelines while making appointments to various posts under their administrative control.

Subject: Inclusion of "Third Gender/any Other Category" in the application forms in recruitment to various posts under the Central Government - reg.

The undersigned is directed to say that "The Transgender Persons (Protection of Rights) Bill, 2019" was passed by both Houses of the Parliament and received the assent of the President on 05.12.2019. This Act (No. 40 of 2019) has been notified in the Gazette of India on 05.12.2019.

2. The matter regarding Inclusion of "Third Gender/any Other Category" in the application forms in recruitment to various posts under the Central Government, was under consideration of the Government for quite some time. Based on the provisions of the aforesaid Act and the legal opinion obtained on the subject, Civil Services Examination Rules, 2020 have been notified on 05.02.2020, providing for inclusion of 'Transgender' as a separate category of gender for the said exam.

3. All Ministries / Departments of Government of India are requested to modify the relevant examination rules providing for inclusion of 'Transgender' as a separate category of gender, so as to make the said Rules in conformity with the provisions of The Transgender Persons (Protection of Rights) Bill, 2019.
