Subject:- Provision of Invalid Pension to Armed Forces Personnel before completion of 10 years of qualifying service - reg.

Government of India, Ministry of Defence, D(Pension/Policy) vide their letter no. 12(6)/2019/D(Pen/Pol) dated 16.07.2020 has issued order on the above subject. Copy of the same is forwarded herewith for information and further necessary action.

2. The provision of this circular shall apply to those Armed Forces Personnel who were/are in service on or after 04.01.2019. The cases in respect of personnel who were invalided out from service before 04.01.2019 will not be re-opened.

3. This circular has been uploaded on this office website www.pcdapension.nic.in for disseminating across the all concerned.

2. The addressee officers are requested to furnish details of Reporting / Reviewing Officers for the year 2019-2020 for creation of their APAR workflow in SPARROW system. In case an officer is required to submit more than one APAR for the year 2019-20, the details of periods of annexed proforma.

3. The information sought above may please be forwarded within a week to enable this section to ensure timely generation of APARs in r/o the officers concerned and forwarding the same to them.

Subject : Completion of APARs in “SPARROW”

In the recent times, it is observed that the APARs are not completed by the officers as per the laid down DoPT timelines. APARs in respect of few IDAS officers for the FY 2018-19 have been closed by the system – “Pending with Officer Reported upon for self appraisal” stage. This has been viewed seriously by the competent authority.

2. In this regard it is stated that the PAR managers are responsible to send alert message to the officer reported upon (preferably a week before the prescribed timeline for submitting self appraisal). On failure of an officer to submit self-appraisal as per DoPT timelines to the Reporting Officer, the PAR Manager shall “Force Forward” the same to the Reporting Officer without self appraisal.

3. The Reporting officers should also keep a watch on the movement of APARs of officers working under them and ensure that the APARs are written timely. In case, the self appraisal is not submitted timely, then the force forwarded APAR without self appraisal shall be written by the Reporting officer.

4. The Reporting/ Reviewing/ Accepting officers are also requested to complete the APARs as per DoPT timelines in future. The online recording of APARs on SPARROW system close on 31st December after which it will not be possible to take any action on the APARs.

5. APARs of officers posted on deputation to various Ministries /Departments (other than those posted in Ministry of Defence , UPSC and OFB) are generated centrally in this HQrs office. These officers are request ed to provide the details as mentioned in the table below latest by first week of the next financial year so that the APARs could be initiated timely. Officers posted in Ministry of Defence, UPSC and OFB may forward the details to concerned PAR Managers of MoD, UPSC and PCA (Fys) Kolkata respectively.

6. Officers posted on deputation/ IPA/ Ordinance factories setup, where officers of other services/ Ministers/ Executive authorities are involved are requested to track the movement of their APARs using the tracking activity on SPARROW and if necessary request their Reporting/ Reviewing/ Accepting officers for timely completion of their APARs.

Sub: Dispensation of conditions of applying for Government Accommodation and furnishing of ‘No Accommodation Certificate’ for admissibility of House Rent Allowance.

Reference is invited to Govt. of India, Ministry of Finance, Department of Expenditure Office Memorandum No. 2/5/2017-E.IIB dated 05.03.2019 (copy attached) wherein the Ministry has dispensed with the condition of applying for Government Accommodation and furnishing of ‘No Accommodation Certificate’ by Central Government employees to become eligible for HRA, in respect of General Pool Residential Accommodation (GPRA) controlled by Directorate of Estate, Ministry of Housing and Urban Affairs. It has been further stipulated in the ibid Office Memorandum that Ministries/Departments having their separate pool of residential accommodation for their employees other than GPRA, have been suggested to adopt these provision, wherever feasible.

Accordingly, comments from PCDA/ CDA/ Estate Officers were called for and the matter was under consideration at this office. Now, in terms of rules contained in Allotment of DAD Pool Residential Accommodation Rules, 2019, it has been decided with the approval of Competent Authority that the provision of Govt. of India, Ministry of Finance, Department of Expenditure Office Memorandum No. 2/5/2017-E.IIB dated 05.03.2019 shall be applied to DAD Pool Residential Accommodations except Reserved or Appointment accommodation at various stations pan India with retrospective effect ie. w.e.f. 05.03.2019, the date of issue of ibid orders.

PCDA/ CDA/ Estate Officers are therefore requested to apply the ibid Office Memorandum dated 05.03.2019 on DAD Pool Residential Accommodations except Reserved or Appointment accommodation and dispense with the conditions of applying for Government Accommodation and furnishing of ‘No Accommodation Certificate’ for admissibility of House Rent Allowance w.e.f. 05.03.2019.

The government has amended rules putting the maximum age limit of 65 years (retirement age 65) for the Chief of Defence Staff (CDS) to serve in the post.

The changes were made in the Rules of the Army, 1954, according to a defense ministry notification.


In a landmark decision, Tuesday (31st December 2019) Cabinet Committee on Security approved the formation of the CDS, which will serve as the defense minister’s principal military advisor on all tri-service issues.

The service chiefs can serve for a maximum duration of three years or until they reach the age of 62, depending on the early age.

There is no such proposal.  However, vide Ministry of Defence letter dated 17.11.2017, divorced daughter is now eligible for ordinary family pension for life subject to fulfilment of the following conditions:-

When widow / widower of Defence personnel and eligible children below 25 years of age have ceased to be eligible to receive family pension and there is no disabled child to receive family pension.

Divorced daughter was dependent on defence personnel / pensioner or his / her spouse i.e. if decree of divorce had been issued by the competent court during life time of at least one of the parents or even the divorce proceedings had been filed in a competent court during the life time of the personnel / pensioner or his / her spouse but the divorce took place after their death.

She is not earning equal to or more than the sum of minimum family pension and dearness relief thereon.

As and when received, requests from divorced daughters for grant of family pension are replied in accordance with the existing policy.

This information was given by Raksha Rajya Mantri Dr. Subhash Bhamre in a written reply to Shri P. Nagarajanin Lok Sabha today.

(e) Physically disabled service personnel will continue to be paid at double rate, subject to a minimum of Rs 2,250 + DA.

Consequent upon acceptance of the recommendations of the Seventh Central Pay Commission by the Government relating to Dearness Allowance, the undersigned is directed to refer to Ministry of Finance (Department of Expenditure) O.M. No. 1/2/2016-E-II(B) dated 04.11.2016 & 1/3/2017-E- II(B) dated 30.03.2017 on the above subject

The provisions of the said letters will mutatis-mutandis be applicable to Armed Forces Personnel. These letters will be in supersession of letters of even number dated 23.11.2016 and 17.04.2017.

2. These letters issue with the concurrence of Finance Division of this Ministry vide their Dy. No. 229-PA dated 17.08.2017 based on Ministry of Finance (Department of Expenditure) O.M. No. 1/2/2016-E.II(B) dated 04.11.2016 & O.M. No. 1/3/2017-Ell (8) dated 30.03.2017.

Government has sanctioned construction of 1,98,881 Dwelling Units (DUs) for the Married Military officers / soldiers. Apart from construction of DUs, hiring of houses is also undertaken for Defence personnel to meet the deficiency of housing. In addition, Service personnel are authorized to House Rent Allowance (HRA) / Compensation in Lieu of Quarter (CILQ) / Family Accommodation Allowance (FAA).
Married Accommodation Project (MAP) was approved in 2002 for providing 1,98,881 Dwelling Units (DUs) to serving defence personnel. Under this project DUs with improved specifications are being constructed. Besides, under Annual Major Works Programme (AMWP) residential accommodation projects are undertaken as per special needs from time to time.

Phase-I comprising 57875 DUs has been completed. Out of 69904 DUs meant for Phase-II, 38811 DUs have been constructed & balance 31093 DUs are under construction. Balance 71102 DUs are planned for phase- III projects. Provision exists for construction of Field Area Family Accommodation (FAFA) in peace stations for the families of Officers / soldiers serving in field areas. In view of shortfall of FAFA accommodations, Defence Personnel are provided HRA / CILQ / FAA at the rate of selected place of residence of family.

This information was given by Minister of State for Defence Dr. Subhash Bhamre in a written reply to Shri Kunwar Pushpendra Singh Chandel in Lok Sabha today.

Cabinet approves encashment of accumulated leave to certain Defence Services Personnel who died or were invalidated out while in service between 30 December 1991 to 29 November 1999 with less than 15 years of service

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has approved leave encashment up to 180 days in respect of those Defence personnel who died or were invalidated out of service between 30.12.1991 to 29.11.1999 with less than 15 years of service.

The decision will benefit the families of 9777 Officers and other personnel of Defence Services who died or were invalidated out of service during this period. This period is very significant as a large number of casualities took place during the Kargil conflict ("Operation Vijay") and in counter insurgency operation in J&K and North East during the period.

Subject: Payment of arrears on ad-hoc basis of pay to Defence Forces Personnel pending issuance of Notification accepting 7th Central Pay Commission Award.

Sir,

Government of India have promulgated vide Resolution No.1(6)/2016/D(Pay/Services) dated 05 Sept 2016 and No.1(7)/2016/D (Pay/Services) dated 05th September, 2016 accepting the recommendations of 7th Central Pay Commission in so far as they relate to pay of Service Officers, MNS Officers, JCOs/ORs, NCs(E) including DSC Personnel. Since fixation of pay and consequent calculation of arrears may take some time, I am directed to convey the sanction of the President to the payment of arrears on an ad-hoc basis, @ 10% of existing Basic Pay plus Dearness Allowance @ 125%.

2. Payment of the above ad-hoc amounts will be made only to those personnel who were in service as on 01 Jan. 2016 and continue to be in service thereafter. The pay being drawn as on 01 Jan 16 would be reckoned for calculating the arrears. Pay for this purpose includes Pay in Pay Band, Grade Pay, Gp X Pay, MSP and NPA as applicable along with 125% DA thereon. Over-payment, if any, would be adjusted against the pay and allowances due. The amount so paid will be adjusted against the final computation of arrears on the revised pay scales.

3. Expenditure on account of payment of arrears on ad-hoc basis is debitable to the Major Head 2076 and Minor Head 101.A(C)1 of the Army and corresponding head of account of the Navy and Air Force.
4. This issues with the concurrence of Finance Division of this Ministry vide their Dy.No.400-PA dated 10.10.2016.

7th Pay Commission: No revised pay yet for military personnel - The Hindu

The seventh Pay Commission recommendations will be reflected in this month’s salary for central government employees that would be remitted on Wednesday, but not for the military personnel.

According to military sources, their new salaries are yet to be notified as the notification implementing the Seventh Pay Commission has not yet been issued by the Defence Ministry.

This is because the three service chiefs have written to Prime Minister Narendra Modi and Defence Minister Manohar Parrikar seeking their intervention to fix the anomalies expressed by the military which remain unaddressed despite several representations to the empowered committee and assurances from Mr. Parrikar.
The key demands of the services include Non Functional Upgrade, NFU pay fixation, Military Service Pay (MSP) and common pay matrix for civil and military.

Sir,
I am directed to refer to this Ministry’s Letter No.1(2)/2004/D(Pay/services) dated 6th October 2015, on the subject cited above and to say that the president is pleased to decide that the Dearness Allowance payable to Armed Forces Officers and personnel Below officer Rank, including Non-combatants (Enrolled), shall be enhanced from the existing rate of 119% to 125% with effect from 1st January 2016.

2. The provisions contained in paras 2,4 and 5 of this Ministry’s letter No.1(2)/2004/D (Pay/Services) dated 25th September 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.

3. The additional installment of DA payable under these orders shall be paid in cash to all Armed Forces Officers/PBORs including NCs(E).

4. This letter issues with the concurrence of Finance division of this Ministry vide their Dy.No.132-PA dated 11th April,2016 based on Ministry of Finance (Department of Expenditure) O.M.No.1/1/2016-E-II(B), dated 7th April, 2016.

I-Tickets on Defence Travel System can be Collected at any PRS Counter by Defence Personnel

For hassle-free collection of i- tickets by Defence Personnel booked on the Defence Travel System on Indian Railways, the Indian Railways now affords the facility of collection of the booked i-tickets from any Computerized Passenger Reservation System (PRS) counter of Indian Railways. Earlier, the i-tickets could be collected by the Defence Personnel at the journey originating station only. Now it has been liberalized and it can be collected from any PRS counter in the country. However, the i-tickets can be printed only once. This liberalized facility will be a big help to defence personnel.

With a view to phase out the Defence Warrant System, the Indian Railways commenced the Defence Travel System on its e- ticketing portal of IRCTC in 2009. The i-ticket now can be collected from any PRS counter by the defence personnel on showing one of the ten prescribed proofs of identity allowed for undertaking journeys on e-tickets. If some other person collects the tickets on behalf of the defence personnel, then he/she must produce any of the ten prescribed proofs of identity in original along with photocopy of the ticket-holding defence personnel.

The Railways has also issued format of receipt to be given by the Defence Personnel while collecting the i-ticket from the Railway counter which specifies inter alia details such as PNR Number and Transaction ID on Defence Travel System.

The Railway has also mitigated certain other problems encountered in booking of i-tickets for the Defence Personnel through facilities like auto cancellation of fully waitlisted e-tickets, allowing of booking of tickets on defence travel system during first thirty minutes of opening of reservation disallowed for all other ticketing agents.

Armed forces again demand resolution of pay ‘anomalies’ with 7th Pay Commission

NEW DELHI: The armed forces want at least five “core anomalies” in their salary structures to be resolved to establish the “correct baseline” for recommendations of the 7th Central Pay Commission (CPC), whose term has now been extended till December 31 by the government.

While the heat and dust over one rank, one pension (OROP) is yet to settle, with a section of veterans rejecting the “diluted” version announced by the government on September 5, the serving personnel have their own deep-seated grouse over their eroding “status, parity and equivalence” as compared to their civilian counterparts.

The armed forces top brass have made several representations to the government, including the defence and finance ministries, on the core anomalies over the last one year. But have received no assurance till now. With the 7th CPC’s term being extended by four months, they are now making a last-ditch attempt to get the anomalies rectified.

One of the main demands is the grant of NFU (non-functional upgradation) for officers denied promotions due to the lack of vacancies in the steeply-pyramidal structure of the armed forces. “IFS and IPS officers, as also those from organized Group A civil services, now get NFU after the 6th CPC like IAS officers. But the armed forces have been kept out of it,” said a senior officer.

“This adversely impacts the morale of serving military officers. It also creates command, control and functional problems because even organizations that work closely with the military like DRDO, Border Roads Organisation, Military Engineer Service and the like get NFU,” he added.

Another demand is the placement of all Lt-Generals in the HAG+ (higher administrative grade) pay-scale like directors-general of police. “As of now, only 33% of Lt-Gens are in the HAG+ scale. The status of all Lt-Gens with that of DGPs must be restored,” he added.

The other anomalies deal with the grant of “uniform grade pay” and proper “initial pay fixation” of Lt-Colonels, Colonels and Brigadiers. There is also the need for all JCOs (junior commissioned officers) and soldiers to get “common pay scales”, in the backdrop of the ones recruited before January 2006 not getting them.

“Successive CPCs have given a raw deal to the armed forces compared to the bureaucracy. Virtually all IAS and IFS officers, for instance, reach the apex pay scale before their retirement due to NFU. They, therefore, get OROP through the backdoor. It’s high time the historical and traditional parity was restored,” said another officer.

The civilian bureaucracy, however, is not impressed. It feels the armed forces keep on making “more and more demands” when they already get a lot of privileges from free rations to hugely-subsidized canteens. “Military officers and jawans already get ‘military service pay’ for their tougher working conditions. The demand for NFU is unrealistic,” said a senior bureaucrat.

Q1 Do I have to pay any penalty for making new Smart Card after I have lost the old Card? 
A1 (a) Penalties on Loss of Smart Cards Yes, In case of loss of Canteen Smart Card (Grocery/Liquor) by an individual following penalties will be levied in addition to costs of Smart Card and penalty amount will be merged with the URC profit :-

Loss/Card Liquor Grocery
First Time Rs. 500/- Rs. 500/-
Second and subsequent Time Rs. 1000/- Rs. 1000/-

Note. Chairman of the URC may wave off the Penalty depending upon the genuineness of the loss, in exceptional cases. 
 
(b) There have been few cases of misuse of lost Smart cards. Therefore, loss of Canteen Smart Card is being dealt with strictly. In addition to person applying afresh for the card and giving wrong details, responsible scrutinizing staff/ countersigning authority will also be held accountable for wrong details in application for fresh Individual Smart Card.

Q2. Why restrictions are laid by some URCs on entry as well as issue of items to authorized persons? 
A2. Misuse of canteen facilities is detrimental to the welfare of the genuine buyers. This needs to be curbed. Sometimes temporary restrictions are also put on place due to short supply of certain items or excess purchase of certain items by customers during particular season. The responsibility to manage the available inventory as also to curb misuse of facility, lies with the Chairman of URCs. In order to streamline and further refine the procedures, following is being implemented:-  
(a) No Bulk Purchases by Individuals. No bulk purchases by an individual are permitted. URCs can lay down restrictions at local level to ensure the same. However, all bulk purchases, if valid reasons necessitate, will be supported by one time use written permission of the Chairman of URC.

(b) Strict check on entry and allowing only authorized persons to avail canteen facilities. Entry into any URC will be purely Smart Card based by personal appearance.

Q3 . What are orders on the issue of liquor? 
A3 Liquor Quota. There is no change in liquor authorization. However, it is limited as per brand/type for better planning and control over quality & quantity. As such, following restrictions are presently enforced:-
  (i) Officers. Scotch whisky permitted up to 50% of total entitlement.
(ii) JCOs & Eqvl. Not more than three Whisky bottles including one Scotch Whisky of the entitlement.
(iii) Others. Not more than two Whisky bottles including one Scotch Whisky of the entitlement.

Note. This restriction will be revised by the DDGCS from time to time as per requirement, availability of funds and stock position.

 
Q4 What is the entitlement for purchase of car?  
A4 Four Wheelers(Car). An entitled person based on his purchasing power will be entitled to purchase first or subsequent car only after years and up to capacity as mentioned below:-
(a) Officers (Incl Retd) - Four years and upto 2500 cc capacity.
(b) JCOs/Eqvl granted Hony Commission (lncl Retd) – Seven years and upto 1500 cc capacity
(c) JCOs/OR & Eqvl (Incl Retd) - Once while in service and once after retirement up to 1400cc capacity.

Q5. Is there a minimum service limit for purchase of car by JCOs/ OR?
A5. Yes, A JCO/ OR should have rendered min 15 years of color service to apply for a car.


Q6. What are restrictions on purchase of a 2-Wheeler?
A6 All categories (Incl Retd) can buy a 2- wheeler after every three years. .


Q7. Is there any restriction on AFD items? 
A7. AFD Items like Refrigerator, TV, Washing Machine etc can be purchased after every three years by all categories.
Note: Control Over AFD Items will be reviewed from time to time as per requirement, availability of stores and budgetary situation of CSD.


Q9. What are the orders for entry into a URC?
 
A9. Entry into any URC will be purely Smart Card based by personal appearance. In case a particular Offr/JCO/OR/Equivalent is unable to present himself personally due to valid reasons like old age or acute medical problem, a permission, signed by the Chairman/ CO/OC of the unit/ establishment running the URC must accompany the Smart Card with photo of the authorized person carrying it. Validity period and genuineness of requirement of such permission will be decided by the Chairman of the URC on case to case basis.
