Subject : Completion of APARs in “SPARROW”

In the recent times, it is observed that the APARs are not completed by the officers as per the laid down DoPT timelines. APARs in respect of few IDAS officers for the FY 2018-19 have been closed by the system – “Pending with Officer Reported upon for self appraisal” stage. This has been viewed seriously by the competent authority.

2. In this regard it is stated that the PAR managers are responsible to send alert message to the officer reported upon (preferably a week before the prescribed timeline for submitting self appraisal). On failure of an officer to submit self-appraisal as per DoPT timelines to the Reporting Officer, the PAR Manager shall “Force Forward” the same to the Reporting Officer without self appraisal.

3. The Reporting officers should also keep a watch on the movement of APARs of officers working under them and ensure that the APARs are written timely. In case, the self appraisal is not submitted timely, then the force forwarded APAR without self appraisal shall be written by the Reporting officer.

4. The Reporting/ Reviewing/ Accepting officers are also requested to complete the APARs as per DoPT timelines in future. The online recording of APARs on SPARROW system close on 31st December after which it will not be possible to take any action on the APARs.

5. APARs of officers posted on deputation to various Ministries /Departments (other than those posted in Ministry of Defence , UPSC and OFB) are generated centrally in this HQrs office. These officers are request ed to provide the details as mentioned in the table below latest by first week of the next financial year so that the APARs could be initiated timely. Officers posted in Ministry of Defence, UPSC and OFB may forward the details to concerned PAR Managers of MoD, UPSC and PCA (Fys) Kolkata respectively.

6. Officers posted on deputation/ IPA/ Ordinance factories setup, where officers of other services/ Ministers/ Executive authorities are involved are requested to track the movement of their APARs using the tracking activity on SPARROW and if necessary request their Reporting/ Reviewing/ Accepting officers for timely completion of their APARs.

Attention is drawn towards this Department’s OM No. 39020/18/2016- Estt.(B) dated 19th December, 2016 regarding timely and advance action in filling up the Direct Recruitment (DR) vacancies. It was, inter-alia, requested therein that advance action may be taken by the Ministries/ Departments and their Attached and Subordinate Offices for reporting vacancy position with respect to Direct Recruitment (DR) posts to the concerned recruitment agency i.e. Union Public Service Commission (UPSC) and Staff Selection Commission (SSC) etc, for filling up of such Direct Recruitment vacancies in a timely manner.

The Cabinet Committee on Investment and Growth in the meeting held on 23.12.2019, has directed to take time bound action to fill the existing vacancies in various Ministries / Departments.

Accordingly, all the Ministries/ Departments are requested to fill up the existing vacancies in the concerned Ministries/ Departments, their Attached and Subordinate Offices, in a time bound manner. It is also requested that a report with regard to action taken to fill up the existing vacancies, may be sent to this Department, as per format given overleaf, by 5th day of every month. The first such report should reach this Department latest by 5th February, 2020.

Subject: Procedure to be followed in cases of disagreement on Recruitment Rules – regarding.

The undersigned is directed to state that as per extant instructions, the process of framing / amending of Recruitment Rules for a post involves consultation with DoPT, UPSC and thereafter vetting by the Legislative Department. As per established procedure, the Administrative Ministries / Departments frame service rules/recruitment rules or propose amendments thereof, based mainly on the model RRs or instructions issued by DoPT from time to time and refer them to DoP&T for concurrence. After the receipt of concurrence from DoPT, the Ministries/Departments refer proposals to UPSC for advice. After receipt of concurrence of UPSC. with the approval of Competent Authority, RRs are finally notified, after vetting by the legislative Department.

UPSC brought certain instances to the notice of this Department, where post the advice of Commission, RRs have been notified incorporating substantial changes in the recruitment rules / service rules (RRs/SRs). without obtaining the concurrence of the Commission, which is not in order. On consideration of the matter, it has been decided that if substantial changes are effected in the RRs after the receipt of advice of UPSC. the same shall be brought to the notice of UPSC by the administrative Ministry for obtaining their advice / concurrence on the same. Non-adherence to this procedure may result in the case being treated as a case of disagreement with the Commission, and therefore administrative Ministries have to take a conscious decision in this regard. Substantial changes referred here are those changes having a bearing on the principles of recruitment, viz., change in the method of recruitment, eligibility criteria etc and does not include vetting changes made by the Legislative Department, spelling or grammatical corrections.

In light of the foregoing, all Ministries/ Departments are requested to refer the proposals back to UPSC for concurrence in cases where administrative Ministry / Department, after the receipt of advice of the Commission, want to carry out any change/s in the draft RRs/SRs, which is / are substantial in nature. All Ministries/Departments are requested to adhere to these instructions.

The undersigned is directed to refer to this Department's OM No. 39011/12/2009-Estt(B) dated 10.05.2010 on the subject mentioned above vide which a Proforma/Checklist was forwarded to all Ministries/Departments for referring disciplinary cases to Union Public Service Commission (UPSC) in terms of Article 320(3) (c) of the Constitution of India read with Regulation 5 of the UPSC (Exemption from Consultation) Regulations, 1958 (as amended from time to time).

2. The Proforma/ Checklist has been revised in consultation with UPSC so as to ensure that there are no shortcomings while sending the requisite information/ documents to the Commission. It is also expected that the complete reference is received in the Commission at least three months prior to the retirement of the charged officer in case of minor penalty proceedings and at least six months prior to retirement in case of major penalty proceedings in order to get advice of the Commission and the implementation thereof. Wherever the time is less than three months/ six months from the retirement of the Government servant, cogent reasons justifying late submission of case to UPSC are also required to be indicated.

3. The modified Proforma/Checklist for forwarding disciplinary cases to the  UPSC is enclosed for guidance! compliance by all concerned.

(a) whether the Government has revised the ‘Guidelines for conducting written examination for persons with disabilities’ issued by the Ministry on 26th February 2013;

(b) if so, the details of the revision and the reasons therefor;

(c) whether any restrictions have been imposed on educational qualifications of scribe/reader/lab assistant, if so, the details thereof and the reasons therefor;

(d) whether the new guidelines mandate the production of a certificate from the Chief Medical Officer/Chief Surgeon/ Medical Superintendent of a Government Hospital in addition to the disability certificate; and

(e) if so, the details thereof and the reasons therefor?

(a) & (b) Yes, Sir. The Ministry has issued revised guidelines for conducting written for persons with benchmark disabilities on 29/08/2018 replacing the earlier guidelines issued on 26/02/2013. The revised guidelines were issued on the basis of the recommendations of the Expert Committee constituted on 26/03/2015 to look into the issues raised by UPSC and others relating to implementation of the guidelines for conducting written examination for persons with disabilities

(c) As per Clause VI of the guidelines for conducting written examination for persons with benchmark disabilities issued on 29/08/2018, In case the examining body provides the scribe/reader/lab assistant, it shall be ensured that qualification of the scribe should not be more than the minimum qualification criteria of the examination. However, the qualification of the scribe/reader should always be matriculate or above.

In case the candidate is allowed to bring his own scribe, the qualification of the scribe should be one step below the qualification of the candidate taking examination.

(d) & (e) As per clause IV of the guidelines dated 29/08/2018, the facility of Scribe/Reader/Lab Assistant should be allowed to any person with benchmark disability as defined under section 2(r) of the RPwD Act, 2016 and has limitation in writing including that of speed if so desired by him/her.

In case of persons with benchmark disabilities in the category of blindness, locomotor disability (both arm affected-BA) and cerebral palsy, the facility of scribe/reader/lab assistant shall be given, if so desired by the person.

In case of other category of persons with benchmark disabilities, the provision of scribe/reader/lab assistant can be allowed on production of a certificate to the effect that the person concerned has physical limitation to write, and scribe is essential to write examination on his behalf, from the Chief Medical Officer/Civil Surgeon/ Medical Superintendent of a Government health care institution as per the specified proforma

Age Relaxation for Defence Personnel by UPSC

The policy on age relaxation applicable for ex-servicemen for appearing in Civil Services Exam (Group 'A' & 'B' Posts) is governed by 'Ex-servicemen (Re-employment in Central Civil Services and Posts) Rules, 1979' as amended vide DoP&T Notification No. 36034/1/06-Estt.(SCT) dated 4th October, 2012. The following provisions have been made:-

For appointment to any vacancy in Group 'A' and 'B' services or posts filled by direct recruitment otherwise than on the result of an Open All India Competitive Examination, the upper age limit shall be relaxed by the length of military service increased by three years in the case of ex-servicemen and Commissioned Officers including Emergency Commissioned Officers or Short Service Commissioned Officers.

For appointment to any vacancy in Group 'A' and 'B' services or posts filled by direct recruitment on the result of an All India Competitive Examination, the ex-servicemen and Commissioned Officers including Emergency Commissioned Officers or Short Service Commissioned Officers who have rendered at least five years military service and have been released (i) on completion of assignment (including those whose assignment is due to be completed within one year otherwise than by way of dismissal or discharge on account of misconduct or inefficiency; or (ii) on account of physical disability attributable to military service or on invalidment, shall be allowed maximum relaxation of five years in the upper age limit.

The recruitment in armed forces are governed by their respective policies, rules including recruitment rules, orders on the subject.

This information was given by Raksha Rajya Mantri Dr. Subhash Bhamre in a written reply to Shri Prasanna Acharya in Rajya Sabha today.

On the basis of the results of the COMBINED DEFENCE SERVICES EXAMINATION (I), 2018 held by the Union Public Service Commission on 04th February, 2018, 8261 candidates with the following Roll Numbers have qualified for being interviewed by the Service Selection Board of the Ministry of Defence, for admission to (i) Indian Military Academy, Dehradun 146th Course commencing in January, 2019 (ii) Indian Naval Academy, Ezhimala, Kerala, Course commencing in January, 2019 (iii) Air Force Academy, Hyderabad (Pre-Flying) Training Course (205 F(P)) commencing in February, 2019 (iv) Officers Training Academy, Chennai 109th SSC Course (NT)(for Men) commencing in April, 2019 and (v) Officers Training Academy, Chennai, 23rd SSC Women (Non-Technical) Course commencing in April, 2019.

The candidature of all the candidates, whose Roll Numbers are shown in the lists below, is provisional. In accordance with the conditions of the admission to the examination, they are required to submit the original certificates in support of age (Date of Birth), educational qualifications, NCC (C) (Army Wing/Senior Division Air Wing/Naval Wing) etc. claimed by them along with self attested copies thereof, to Army Headquarters, A.G.'s Branch/Rtg./CDSE Entry Section for males and SSC Women Entry Section for women candidates, West Block-III, Ground Floor, Wing 1, R.K. Puram, New Delhi-110066 in case of IMA/SSC as their first choice and to IHQ of MoD (Navy), DMPR (OI & R Section), Room No. 204, 'C'-Wing, Sena Bhawan, New Delhi-110011 in case of Navy as their first choice, and to PO 3 (A) Air Headquarters, ‘J’ Block, Room No. 17, Opp. Vayu Bhawan, Motilal Nehru Marg, New Delhi-110011 in case of Air Force as their first choice. The original Certificates are to be submitted within two weeks of completion of the SSB Interview and not later than 13th November, 2018 for AFA and not later than 01st January, 2019 for IMA and not later than 01st January, 2019 for admission to NA (1st April, 2019 in case of SSC only). The candidates must not send the original Certificates to the Union Public Service Commission.

All the candidates who have successfully qualified in the written exam are required to register themselves online on the Indian Army Recruiting website joinindianarmy.nic.in within two weeks of announcement of written result. The successful candidates would them be allotted Selection Centres and dates, of SSB interview which shall be communicated on the registered e-mail ID. Any candidate who has already registered earlier on the site will not be required to do so. In case of any query/Login problem, e-mail be forwarded to dir-recruiting6-mod@nic.in.

In case, there is any change of address, the candidates are advised to promptly intimate directly to the Army Headquarters/Naval Headquarters/Air Headquarters as the case may be.

The Union Public Service Commission have a Facilitation Counter near Examination Hall Building in its Campus. Candidates may obtain any information/clarification regarding this examination on working days between 10.00 AM to 5.00 PM, in person or over telephone No.011-23385271, 011-23381125 and 011-23098543 from this Facilitation Counter. Candidates can also obtain information regarding their result by accessing UPSC website http://www.upsc.gov.in

The marks-sheet of candidates who have not qualified, will be put on the Commission’s website within 15 days from the date of publication of the final result of OTA (after conducting SSB Interview) and will remain available on the website for a period of 60 days.

There are four modes of entry for becoming a pilot in the Indian Air Force (IAF) [NDA, CDSE, AFCAT and NCC special entry]. A written test is conducted for NDA/CDSE (by UPSC) and AFCAT (by IAF) entries followed by SSB testing. NCC special entry candidates with valid 'C' certificate (Air Wing) are directly called for SSB testing. The recommended candidates undergo medical tests. The final merit list is prepared based on the candidate's performance and medical fitness. On successful completion of flying training at Flying Training Establishments (FTEs) of the IAF, the cadet is commissioned as a pilot in the IAF.

Pilots are inducted in the Indian Navy as Permanent Commission (PC) or Short Service Commission (SSC).
  • Permanent Commission (PC) : Volunteers from serving Executive branch officers (upto 25 years of age) are selected for pilot training biannually.
  • Short Service Commission (SSC) : Short Service Commissioned officers are inducted biannually through Direct Entry Scheme.
All pilots in Army Aviation are commissioned officers. Options to join Army Aviation are as under:-
  • Volunteers who opt for Army Aviation during pre- commissioning training at IMA and OTA.
  • Volunteer Officers from any Arm of Indian Army on completion of one and half years of service.
Volunteer Officers are required to undergo the following tests:-
  • Pilot Aptitude and Battery Test (PABT)
  • Aviation medical examination
Officers clearing the PABT and medical examination undergo the Basic and Advance flying training, on completion of which they become pilots in the Indian Army.

A study on Restructuring of Army Pilot Cadre was conducted and salient decisions that have been implemented are:
  • There has been an increase in Direct Commissioned Officers (DCO) both from IMA and OTA.
  • For the DCO, the lower service limit of two years of attachment period with fallback arm after commissioning has also been reduced to one and half years.
IAF ensures that the aircrew are fully utilized in a cockpit vacancy for the maximum duration which is well beyond the period required for amortization of the cost of training. It is also ensured that only limited numbers are given release such that the combat potential of IAF is not compromised at any stage
  • Setting up of an Air Force Selection Board (AFSB) at Gandhinagar in 2013.
  • The selection process into the IAF has been simplified with the introduction of the Air Force Common Admission Test (AFCAT) for non-UPSC entries. Under this format, a candidate may apply for selection in any branch for which they meet the QRs, through a single application in a selection cycle.
  • Proactive steps have been taken by the IAF to reduce the shortage of pilots, which include participation in career fairs/exhibitions, advertisements in print and electronic media, motivational lectures in schools, colleges, visuals/signage at strategic locations etc.

Sub: Seventh Central Pay Commission's recommendations - revision of pay scales - amendment of Service Rules/Recruitment Rules.

The undersigned is directed to refer to this Department's OM of even number dated 9th August, 2016 on the subject mentioned above wherein it was requested that as per the CCS (Revised Pay) Rules, 2016 issued by Department of Expenditure vide  Notification  dated 25th July, 2016, consequential amendment in the existing Service Rules/Recruitment Rules shall be made by the Ministries/Departments by substituting the existing Pay Band and Grade Pay by the new pay structure i.e. "LEVEL in the PAY MATRIX" straightaway without making a reference to the Department of Personnel and Training (DOP&T)/Union Public Service Commission (UPSC).

2. Subsequently, this Department has held meetings in October/November, 2016 with the administrative Ministries/Departments to review the progress in the  implementation of the OM. An important suggestion made in the meetings was with respect to facilitating the process of consultation with the Legislative Department for drafting notification for amendment of RRs in accordance with OM dated 9thAugust, 2016 and its Hindi translation so as to expedite the issue of notification. In this regard, this Department in consultation with Legislative Department prepared a model notification in English and Hindi for use of the Administrative Ministries/Departments. The same was issued for the use of Ministries/Departments vide this Department's OM dated 18.01.2017.

3. Further, DoP&T vide OM of even number dated 16.02.2017 sought information with regard to implementation of OM dated 09.08.2016. However, no significant inputs on the issue were received from the Ministries/Departments despite repeated requests.

4. In View of the above, a meeting under the Chairmanship of JS (E) with all Ministries/Departments was held on 04.01.2018. The Ministries/Departments were requested to furnish the details on the issue urgently so as to enable this Department to furnish a status report for information of PMO. The detail of the data received from various Ministries/Departments as on 24.01.2018 has been compiled and annexed. All Ministries/Departments are requested to scrutinize the data pertaining to them as per the annexure. In case some additions/corrections are required, the same may be communicated to this Division before 09.02.2018. In case no inputs are received, the data as indicated in the annexure shall be treated as final.

In case of doctors, every year, on the basis of vacancies projected by the Ministry of Health and Family Welfare, Union Public Service Commission (UPSC) conducts Combined Medical Services Examination for recruitment of Medical officers of GDMO sub-cadre of Central Health Services. For filling up of vacant posts belonging to Specialists sub-cadres of Central Health Service, requisitions are also sent to UPSC. Based on the recommendations received from UPSC, candidates are given offer of appointment. Pending recommendations from UPSC, concerned units are permitted to make contractual appointments against the vacant posts, as a stop-gap arrangement, in public interest, till the time regular incumbent joins the post.

The rest of the vacant posts other than the doctors are filled as per the requirement of the respective Hospitals in terms of Recruitment Rules on regular basis, through contractual appointment as a stop-gap arrangement and on outsource basis on the basis of approval received from the Ministry.
The Minister of State (Health and Family Welfare), Sh Ashwini Kumar Choubey stated this in a written reply in the Lok Sabha here today.

Government considering report on age limit for civil service exams

Nearly eight months after its submission, the report of Baswan committee that suggested changes in civil service exam pattern and age limit is under examination, the government has said.
The committee had submitted its report to the Union Public Service Commission (UPSC) on 9 August 2016.

"The Baswan Committee's report along with UPSC's recommendations on it has been received on 20 March 2017 and the same is under examination," the department of personnel and training (DoPT) said in response to an RTI query filed by a PTI correspondent.

Thousands of aspirants appear in the civil service exam conducted annually by the UPSC in three stages - preliminary, mains and interview - to select officers for Indian Administrative Service (IAS), Indian Foreign Service (IFS) and Indian Police Service (IPS), among others.

The UPSC had constituted the expert committee under the chairmanship of former human resource development secretary and retired IAS officer B S Baswan to review the scheme of civil service examination in August 2015.

The committee is understood to have recommended reduction in upper age limit of 32 years to appear in the civil service exam, officials said.

"The recommendations made by the committee including on pattern of civil service examination and age limit are presently under consideration of the UPSC," minister of state for personnel Jitendra Singh had told Rajya Sabha in a written reply in November last year.

In a related development, the UPSC has fixed a seven-day time frame for candidates to report mistakes or discrepancies in questions asked in the various examinations conducted by it.

Sub: Procedure to be observed by the Departmental Promotion Committees (DPCs) - Model Calendar for DPCs - Relevant year up to which APARs are to be considered and Model Calendar for conducting DPCs - regarding.

The undersigned is directed to invite reference to the Department of Personnel and Training OM of even number dated 8th September, 1998 prescribing a 'Model Calendar' for DPCs in order to ensure that DPCs are convened in advance and approved select panels are ready on the date of commencement of the relevant vacancy year and that the last date for sending complete proposal to the UPSC is 15 July (in ACC cases) and 31 July (in non-ACC cases) of the year preceding the vacancy year.

2. Reference is further invited to the Department of Personnel and Training OM of even number dated 16th June, 2000 wherein it was prescribed/clarified that only such ACRs (now APARs) should be considered which became available during the year immediately preceding the vacancy/panel year irrespective of the date of convening of the DPC. In other words, for the vacancy/panel year 2000-01, it was prescribed that ACRs (now APARs) up to the year 1998-99 (five years preceding T-1st year) are required to be considered. Accordingly, for the vacancy year 2017-18, APARs up to the year 2015-16 are required to be considered.

3. Reference is also invited to the Department of Personnel and Training OM No. 22011/1/2005- Estt(A)-(Pt-II) dated 23rd July, 2009 on the subject 'Preparation and Maintenance of APARs' wherein a time schedule for preparation/completion of APAR has been prescribed. As per this schedule, entire APAR process is to be completed by 30th November of the year following the completion of time period of APAR year.

4. As per the extant instructions, say for vacancy year 2017-18, complete proposal to the UPSC has to be sent by 15 July, 2016 (in ACC cases) and 31 July, 2016 (in non-ACC cases) with APARs up to the year 2015-16. However, the entire process of recording APAR for the year 2015-16 is complete by 30th November, 2016 only. After the issue of guidelines regarding time schedule for completion of APAR, the time lines make it practically impossible to make the last APAR (the APAR of the year immediately preceding T-1th year) available for DPCs, i.e., the APAR for the year 2015-16 does not attain finality and thus may not be available before sending proposal for DPC for vacancy year 2017-18. in this background, the instructions regarding the procedure for convening DPCs have been reviewed in consultation with UPSC.

5. In order to streamline the process of timely convening of DPCs, it has been now decided that henceforth, the following changes may be effected in the DPC procedure in partial modification of this Department OM No. 22011/5/86-Estt.(D) dated 10.4.89, OM No. 22011/9/98-Estt.(D) dated 16.65.2000, OM No. 22011/9/98-Estt.(D) dated 8.9.98 and OM No. 22011/6/2013- Estt.(D) dated 28.5.2014(crucial date of eligibility):
(i) The vacancy year may be shifted to Calendar Year from the year 2018 onwards, wherever the financial year based vacancy year being followed now.

(ii) The crucial date of eligibility will be 1st of January of the Vacancy year w.e.f 2019.

(iii) The APARs for five years preceding T-2nd year may be taken as reckoning APARs, i.e. for the vacancy year 2019 (January 2019 to December, 2019), the reckoning APARs shall be 2016-17, 2015-16, 2014-15, 2013-14 and 2012-13.

(iv) The year of 2018 being the transitional year, the vacancy period shall be from 1st April 2018 to 31st December, 2018. The reckoning APARs for this vacancy year shall be 2015-16, 2014 -15, 2013-14, 2012-13 and 2011-12. The crucial date of eligibility shall be 1st April, 2018 for the transitional year
6. Ministries/Departments are requested to give wide circulation to these instructions for guidance in the matter and also to ensure strict adherence to the time-schedule prescribed as per the 'Model Calendar' for DPCs.

Implementation of creamy layer criteria

In case of recommendation of name of a candidate by Union Public Service Commission (UPSC) for service allocation, the candidate is considered for allocation to one of those services by the Government for which he has indicated his preference subject to fulfilment of other conditions like Medical fitness, eligibility for availing reservation as per Civil Services Examination Rules and extant instructions on the subject. Further, vacancies reserved for Other Backward Classes (OBC) candidates are filled by the candidates eligible for availing OBC (Non Creamy Layer) reservation.

The Supreme Court of India in the Indra Sawhney judgement referred to 'creamy' layer as those sections or identified groups among the backward classes who are excluded from the purview of reservation. Further, the criterion for determining creamy layer amongst OBCs is provided in the Schedule to the OM dated 08.09.1993. For Category VI of the aforesaid Schedule, wherein Income/Wealth Test for determination of creamy layer has been prescribed, the income ceiling is revised from time to time. The current income ceiling for that purpose is Rs 6 Lakh per annum, as stipulated in DoPT OM dated 27.05.2013.

Subject: Procedure for dealing with cases of disagreement between Disciplinary Authority and CVC - instructions regarding consultation with UPSC thereof.

The undersigned is directed to refer to the OM No. 372/19/2011 - AVD-III (Pt. I) dated the 26th September, 2011 on the above subject which provided for dispensing with second stage consultation with the CVC in disciplinary matters. However, in those cases where consultation with UPSC is not required as per extant rules/instructions, the second stage consultation with CVC was to continue. Further, CVC issued a circular dated 7/12/2012 stipulating that wherein Disciplinary Authorities (DA) tentatively proposes not to impose any of the statutory penalties at the conclusion of the proceedings, the second stage consultation would continue to be made with the Central Vigilance Commission, involving Group 'A' officers of the Central Government, members of All India Services and such other categories of officers of the Central Government involved in composite cases.

2. Despite clear instructions on the subject some instances have come to the notice where Ministries and Departments are not following the above guidelines leading to delay in disposal of the disciplinary cases.

3. The matter has been considered in consultation with UPSC and CVC and following are being reiterated:

(i) All cases, where the Disciplinary Authority (DA) decides to impose a penalty after conclusion of the proceedings and where UPSC consultation is required as per existing rules/instructions, shall not be referred to the CVC for second stage consultation.

(ii) The CVC circular 8/12/14 of 3rd December, 2014 stipulates that all such cases where the DA proposes to take any action which is at variance with the Commission’s first stage advice would continue to be referred to the Commission for obtaining second stage advice. In this regard it has now been clarified by CVC that the aforementioned circular applies only to the disciplinary cases of non-Presidential appointees including officials of CPSEs, Public Sector Banks, and Autonomous Bodies etc. The above instructions, therefore, do not apply to the cases of the officers of Group A services of the Central government, All India Services (AIS) and such other categories of officers of the Central Government where consultation with UPSC is necessary before imposition of any of the prescribed penalties.


4. In a situation where on conclusion of the departmental proceedings, DA is of the tentative view that no formal penalty needs to be imposed in respect of officers of Group 'A' services of the Central Government, All India Services (AIS) & such other categories of officers of the Central Government and refers the case for second stage consultation with CVC and if CVC advises imposition of a penalty which the DA on consideration decides not to accept, then this becomes a case of disagreement between DA and CVC which as per standing instructions require resolution by DoPT.

5. All Ministries/Departments are, therefore, advised to strictly adhere to these instructions.

After the salary hike, as per the recommendations of the 7th Pay Commission was okayed for Bureau of Indian Standards, it is now the UPSC chairperson's turn to get a massive three-fold hike in salary.

President Pranab Mukherjee on Wednesday cleared the proposal of salary hike of Union Public Service Commission (UPSC) chairperson as per the recommendations of the 7th Pay Commission. After President’s approval, UPSC chairman shall receive a pay of Rs 2,50,000 and each of the other members shall receive a pay of Rs 2,25,000 per mensem under the 7th Pay Commission.

Before the implementation of the 7th Pay Commission, chairman and members of the UPSC, a constitutional body that conducts the prestigious civil services examination, used to get a monthly salary of Rs 90,000.
"The hike in salary was necessitated due to implementation of the 7th Pay Commission (7CPC) recommendation that has resulted in increase of salaries of all Central government employees," a senior government official said. "The salary of UPSC chief will now be that of Cabinet Secretary and members' monthly remuneration will be that drawn by a secretary-level officer," he said.

The 7th Pay Commission had recommended a 14 per cent hike in salary to government officials, which has been accepted by the government. As per the 7th Pay Commission recommendations, the minimum salary of a central government employees has been increased from the current Rs 7,000 per month to Rs 18,000 per month. The salary of cabinet secretaries has been increased up to a minimum of Rs 2.5 lakh per month against the current salary of Rs 90,000. The gratuity ceiling has been increased from Rs 10 lakh to Rs 20 lakh.

The chairperson and members will also be entitled for travel allowance, medical facilities, Leave Travel Concession, conveyance allowance and such other conditions of service as are for the time-being applicable to equivalent pay in the Central government, the norms said.
