Subject: Implementation of the recommendation of 7th CPC – Para 11.12.140 – Grant of Grade Pay of Rs. 5400 (PB 2) i.e. Level 9 of Pay Matrix in case of Assistant Accounts Officer of Defence Accounts Department of Ministry of Defence: Grant of Non-Functional Up-gradation (NFU).

The CGDA, Delhi Cantt office vide their letter no. AN/XIV/14162/7th CPC/ Vol-II dated 13.11.2020 has intimated that the revised pay scale of the post of Assistant Accounts Officer in Defence Accounts Department would be in Level-8 of Pay Matrix and Level-9 (7th CPC) on completion of 04 years in Grade Pay of Rs. 4800/-(PB-2) Level 8. This is a Non-Functional Up-gradation (NFU) which is subject to the following terms and conditions:-

  • (i) The grant of NFU will be admissible on completion of 4 years of regular service in the cadre from the date of joining as AAO. The aforesaid Non-Functional Up-gradation (NFU) to AAQs is effective from 01.01.2016.
  • (ii) The NFU will be subject to vigilance clearance.
  • (iii) Benefits of Pay Fixation as per Rule 13 of CCS (Revised Pay) Rules 2016 shall be available at the time of grant of Non-Functional Up-gradation to AAQs.
  • (iv) After the grant of NFU to AAOs in Pay Level-9 and their Pay Fixation under Rule 13 of CCS (RP) Rules 2016, there will be no further pay fixation on promotion.
  • (v) NFU will be reckoned for financial up-gradation under MACP Scheme. Subsequent financial up-gradation under MACPs, if any, is to be reckoned from the date of grant of NFU.

2. To consider the grant of NFU, it is requested to furnish the details of all eligible AAOs who are completing 04 years in the grade pay of Rs. 4800/- up to 30.06.2021 on the under-mentioned Performa. The requisite details should reach this office through mail ID pedawcan3 .dad@hub.nic.in latest by 01.03.2021. It may also be ensured that no elected official is left out from your office/section.

Of late several references has been received regarding Payment/ Refund of Dress allowance with reference to Hon’ble CAT Chandigarh has passed order in favor of applicants vide order dated 05.06.2020 and stated that the applicants of thirteen similar OAs are held entitled to grant of Dress Allowance and if any recovery has been made, the same may be refunded to the relevant individuals involved in these cases.

The responsibility to implement Hon’ble CAT Chandigarh order is of concerned administrative Ministry /Department /Organization where the Govt. servant/servants is serving or served last, after getting legal opinion of Govt. On the basis of legal opinion obtained from Govt. counsel the concerned administrative Ministry /Department/ Organization will decide that the judgment of Hon’ble Court is to be implemented or to be challenged in higher court.

It is, therefore, requested not to admit any claim on account of Payment /Refund of Dress allowance with reference to Honble CAT Chandigarh order dated 05,06.2020 till receipt of implementation order of competent authority regarding implementation of Hon’ble CAT Chandigarh order dated 05.06.2020

Sub : Preventive Measures to contain the spread of (COVID-19).

As per directions issued by the Govt. of India, Ministry of Home Affairs (MHA), New Delhi Order
No.40-3/2020-DM-l(A) dated 15.04.2020: and Ministry of Defence, Office Order F.No.A-50024/01/2020-D (Estt.I/Gp.1) dated 15.04.2020, the CGDA I- IQrs Office, Delhi has issued guidelines vide their letter No.AN/III/3012/ Circular No.VIII dated 16.04.2020 (available on the CGDA website) for strict implementation of the revised consolidated guidelines during the lockdown period which will continue to be remain in force upto 3rd May 2020.

2. In view of the above, the Office will remain open without any restriction during the lockdown period w.e.f. 20.04.2020 subject to compliance of all instructions contained in the said Order of the MHA. All the Group Officers and Officer in Charge of Sections will ensure that the above instructions are followed scrupulously. In this regard necessary instructions in addition to the above guidelines are enclosed as Annexure-I.

3. While opening the Office w.e.f. 20.04.2020, it may be ensured that working hours for all employees who attend office should be staggered, therefore, suggested that two rosters of employees may be formed and asked to attend office as per the following timings in such a manner that 50% of employees attend office in 1st Shift and 50% in 2nd Shift:- a. 9.00 a.m. to 5.30 p.m. b. 10.30 a.m. to 7.00 p.m.

Necessary precautionary arrangements for disinfection of office premises, availability of sanitizers etc have been made for employees.

NECESSARY INSTRUCTIONS

  1. Large gathering or meeting i.e. more than 3-4 persons even during tea break must be avoided.
  2. Work places shall have a gap of one hour and will stagger the lunch breaks of staff to ensure social distancing.
  3. Pan Masala, Gutkha and Spitting at work place and in office premises is strictly banned and Rs.500/- fine will be imposed if anyone found doing so.
  4. In case any employee is unwell, has dry cough, difficulty in breathing etc, he/ she or his/ her colleagues should immediately bring it to the notice of administration through Welfare Section.
  5. All the Officers and Staff are advised to download the Arogya Setu App.
  6. Sections are advised to ensure seating at least 6 feet away from each other.
  7. It is advised to use staircases in place of lifts.
  8. Norms of social distancing as issued by the Govt. of India may be followed.
  9. All the officers and staff are requested to co-operate with thermal scanning arrangement at entry points of the office of the PCDA(P) and follow social distancing norms during thermal scanning process.

Sub:- Submission of pension claim during lock-down in respect of Defence civilian

Government of India has declared lock-down as a precautionary measure in view of COVID-19. Some Head of office have expressed their inability in forwarding of pension claim in hard copy due to lockdown. Matter has been considered by the competent authority and it has been decided that till then lockdown, superannuation/retiring pension claim whose date of retirement is on or before 30.04.2020 and all death cases pension claim may also be forwarded as a soft copy i.e. scanned copy to PCDA (Pension) Allahabad email address cda-albd@nic.in. This arrangement is optional for those HOO who are not in position to forward pension claim in hard copy. Subject of email should be "Pension claim- G1/Civil".

2. In view of the above, you are requested to issue suitable instructions (along with copy of this circular) to all the head of the Offices under your administrative control to ensure the submission of pension claim as stated above.

Subject: Grant of Liberalised family pension to widows who re-married before 01.01.1996- Instructions regarding.

Reference: GoI, MoD letter No. 1(1)/2001/D (Pen-C) dated 24 June 2005

Of late it has been observed that the complaints are being received from widow of Armed force personnel died prior to 01.01.1996 regarding non-payment of Liberalised family pension to the widows who were in receipt of LFP and subsequently LFP was stopped / converted into OFP due to her remarriage before 01.01.1996 with a person other than the real brother of her deceased husband. In terms of Gol, MoD letter no. 200847/Pen-C/71 dated 24.02.1972, the LFP sanctioned to widow was stapped and further converted into OFP after her remarriage with a person other than real brother of the deceased soldier.

In accordance to Gol, MoD letter No. 1(1)/2001/D(Pen-C) dated 24 June 2005, Liberalised family pension of such widows who remarried before 01.01.1996 and whose LFP were stopped and concerted into OFP due to their remarriage are now regulated in terms of para 6.6 of Gol, MoD letter No. 1(2)/97/D(Pen-C) Dated 31.01.2001. The actual benefit arising out of this order will be payable w.e.f 24.06.2005.

In view of the above you are requested to review all the affected cases where LFP was not yet restored to widaw as per Gol, MoD letter No.-1(1)/2001/D(Pen-C) dated 24 June 2005 by issuing afresh PPO. Such cases after review may please be sent to OI/C, G-4 section of this Office enclosing following documents-

i) Corr. LPC- cum datasheet along with the proforma (attached as annexure 'A' duly supported with sheet roll.
ii) Family pension claims for restoration of LFP.
iii) A certificate regarding supporting/non-supporting of child (ren) countersigned by the zila sainik along with family details as per annexure B.
iv) An application from widow for restoration of Liberalised family pension
v) Last payment certificate by PRA, where date upto which Liberalized Family Pension was paid to widow and date of stoppage of Liberalized family pension is clearly mentioned.
vi) Descriptive roll of widow duly affixed recent photographs.

In continuation of this Ministry's letter No. PC 1(2)/97-D (Pen-C), dated the 16th May, 2001 on the subject mentioned above, I am directed to convey the sanction of the President to grant Liberalised Family Pension to a widow whose liberalised family pension was stopped on her remarriage before 01.01.96 with a person other than the real brother of the deceased. Such pension may be regulated in terms of para 6.6 of this Ministry’s letter No. 1(2)/97/D(PEN-C) dt. 31.01.2001.

2. The actual benefit arising out of this order will be payable from the date of issue of this letter.

3. Pension Regulations of the three Services will be amended in due course.

4. This issues with the concurrence of Defence (Finance) vide their UO No. 2907/Fin/ Pen dated 24.6.05.

Representations are being received from various Pension Disbursing Agencies(PDAs) seeking clarification as to from which date payment of additional quantum of pension to the armed forces service pensioners on attaining age of 80 years and above will be paid in cases where age shown in the PPO varies with the exact date of birth mentioned in the office records (i.e original discharge certificate).
The issue has been examined and it is noticed that in all old cases, there was a practice of mentioning the age of armed forces personnel instead of date of birth (though the date of birth was mentioned in LPC cum data sheet provided by the records offices). It is also noticed in some cases that age mentioned in the PPO differs from the date of birth/age mentioned in the LPC cum data sheet due to late submission of claim by ROs/HOOs and late notification of PPO as well.

Accordingly, it has been decided that in all such cases where pensioner is not satisfied or PDA is not sure regarding date of commencement of additional pension, the cases may be referred to this office through ROs/HOOs' concerned for issuing Corr. PPO for making necessary amendment.

1. Please refer to this office letters cited above issued for revision of pension/ family pension in respect of pre-01.01.2016 retired/discharged/invalided out/died Armed Forces officers. Consequent upon issuance of the concordance table vide GoI, MoD letter No. 17(1)/2017(02)/D(Pension/Policy) dated 17.10.2018, revision of pension under notional pay fixation method is to be carried out by the PSAs concerned by issuing Corr. PPO.

2. These concordance tables have been prepared to facilitate fixation of notional pay of Pre‐2016 pensioners/ family pensioners by the PCDA(O) Pune/ NPO, Mumbai / AFCAO New Delhi in case of commissioned officers of Army / Navy /Air Force respectively. Due care has been taken to prepare these concordance tables based on the fitment tables for fixation of pay from 3rd to 4th, 4th to 5th, 5th to 6th and 6th to 7th Pay Commission. In case of any inconsistency in the concordance tables vis‐a-vis the relevant rules / instructions, the notional pay and pension/ family pension of pre‐2016 pensioners / family pensioners may be fixed in accordance with the rules / instructions applicable for fixation of pay in the intervening Pay Commission periods.

3. The pension / family pension of pre-2016 Armed Forces pensioners / family pensioners may be revised using the appropriate concordance table in accordance with the instructions contained in this Ministry's above quoted letter dated 05/09/2017.

4. To enable PSAs to implement the MOD letter dated 05.09.2017 para-18 of the ibid letter clearly specifies that it shall be the responsibility of the PCDA(O) Pune/AFCAO New Delhi/ NPO Mumbai in case of Commissioned Officers of Army / Air Force / Navy to initiate cases for revision of pension/ family pension of Pre-01-01-2016 pensioners/ family pensioners with effect from 01.01.2016 in accordance with these orders for issue of revised Pension Payment Order (PPO) for every pensioner / family pensioner. The Pension Sanctioning Authority would impress upon the PCDA(O) Pune / AFCAO New Delhi/ NPO, Mumbai for fixation of pay on notional basis based on extant orders and will issue revised Pension Payment Order at the earliest.

5. Suo-moto Revision:
This office has carried out an analysis to assess number of cases of Pre-16 pensioners where revision is involved. As per Sanction Database, an estimated 52,000 cases of Commissioned Officers requires revision of pension/family pension. To carry out revision through normal conventional method of calling for LPC-CUM‐Data Sheet with vetting of Pay details by Pay Accounting Office concerned would be time consuming. Therefore, it has been proposed to carry out suo-moto revision subject to the approval of Ministry of Defence, wherever feasible based on PDA details and Pay details (and other info like Rank and QS) wherever available in master data base and based on notional Pay fixation as per Concordance table for 7th CPC issued vide GOI. MOD letter dated 17/10/2018.

6. Initiation for remaining cases where suo moto is not feasible
In remaining cases where Pay Details (and other related fields like Rank and QS) and current PDA details are not available with this office, in such cases this office will not be able to revise the pension and issue the revised PPO on suo‐moto basis. In these cases, claims / inputs will be required from concerned Record keeping and Pay Accounting office viz. PCDA(O) Pune/ NPO, Mumbai / AFCAO New Delhi in case of commissioned officers of Army / Navy /Air Force respectively to authenticate the pensioner details. Similarly, in case of Post-96 retired Majors and equivalent granted Pay of Lt. Col. and equivalent notional pay in concordance table has not been provided. In such type of cases the notional pay will be fixed by concerned Pay accounts office. Therefore, to carryout effective, paperless and speedy revision, an Utility software has been developed by PCDA(P) office to be hosted on CGDA WAN to make available all the data of Pre-2016 Commissioned Officers pensioners/family pensioners for access, modification, initiation (if not found available in database of PCDA(P) on search) and for fixation of 7th CPC pay details by respective Pay Accounting Office in line with MOD letter dated 05/09/2017 (Para 18). Due care has been taken to account for all the cases of live pensioners. However still if any case is missing, the same may be initiated through this utility by PAO and forwarded online through utility.

In case of revision of Pre-01.01.2016 Family Pension /Disability cases or fresh initiation, copy of concerned PPO may also to be uploaded by PAO concerned for ready reference while submitting the revision claim through utility provided

7. Paperless Revision and issue of e-PPO
As the Data can be accessed, initiated, approved and completed through the utility software provided by this office on WAN and controlled through allotted login / password, which is menu based and user friendly. Collection of data will be realized through an interface accessible through CGDA WAN and completed data will be processed by PCDA(P) Allahabad and e‐PPOs will be generated in cases received. The working methodology of utility software and the User Manual is attached for guidance.

8. Issue and Transmission of e-PPO
The revised corrigendum PPO will be issued by PSAs in e-PPO mode with new 12 digit PPO No. and 4 digit suffix code alongwith old PPO number. The e-PPO consisting of .pdf and .xml files will be digitally signed and will be transmitted directly to the PDAs through SFTP connectivity as is already being done for new pensioners (no confirmation from PCDA(O)/AFCAO, New Delhi/NPO Mumbai is required by PDA). E-PPOs will also be uploaded on CGDA WAN for PCDA(O)/ AFCAO, New Delhi /NPO Mumbai to download a copy for record purpose as well as for providing a copy to the pensioner/family pensioner concerned. Any irregularity if noticed may be pointed out to this office for further necessary action.

9. Allotment of login ID and password to Administrator PAO:
To access the utility programme, PAO will be issued login ID and password. Accordingly every PAO has to nominate one Officer of their office as ADMIN (Administrator) to whom login credentials i.e. password will be provided by PCDA(P). The ADMIN of PAO may further allot login user id and password to the required number of users to act as Initiator and Approver in their office at their end through 'User Management' of utility software on WAN. For this purpose a Proforma for allotment of login ID and password to the Admin of PAO concerned is enclosed as per Annexure-A which may be filled and submitted to this office under the signature of PAO In charge concerned on the e‐mail address pcdapedp.dad@nic.in of this office as well as invariably through the hard copy duly signed by OI/C of the PAO concerned to Shri Himanshu Tripathi, IDAS Group Officer, EDP Centre, PCDA(P) Allahabad‐211014 for further necessary action within a month of issue of this letter / Circular.

10. Allotment of login ID and password to other users of PAO (other than administrator)
The Administrator of PAO will further allot login user ID and password to the required number of users as Initiator and Approver of their office at their end through 'User Management' of utility software on WAN. Facility has been provided in the utility software that all user can change their password after allotment or as and when they requires.

Sub: Transfer of pension account from one Pension Disbursing Authority (PDA) to another PDA.

Provisions for Transfer of pension account from one Pension Disbursing Authority (PDA) to another PDA has been provided in the Defence Pension Payment Instructions (DPPI) as well as Scheme for Payment of Defence Pensions by Public Sector Banks. But, it has been observed that the PDAs are not following laid down procedure in the matter. Hence, the competent authority has decided that following procedure is required to be adopted in the matter.

(i) Pensioner shall submit a simple application (in Part-I of the enclosed formats) along with Pension Certificate (where issued to him) to the PDA from where he is drawing pension at present. A copy of application may be returned to the pensioner duly giving the receipt of the application by the PDA for the records of the pensioner.

(ii) The following documents are required to be forwarded by the existing PDA to the new PDA by registered post.
(a) PPO (including all Corrigendum PPOs) and Payment Authority (if any issued)

(b) Descriptive Roll/Identification Documents with Photographs.

(c) Extract of Payment Register with a certificate thereon indicating the rate of Pension and Dearness relief and date upto and for which last paid. Where the pensioner has been allowed commutation of pension, the PDA should also indicate prominently in the Last Pension Certificate, the date of payment of capitalized value of pension, the date of reduction of pension on account of commutation and the date on which he would complete 15 Years for restoration of his commuted portion of pension.

(d) Nomination to receive arrears of pension

(e) Option 85 undertaking furnished by the pensioner for Medical Allowance

(f) Pension Certificate (where issued)
(iii) In the current scenario, most of the PPOs are issued e-PPO form. Hence, it has been decided that transferor PDA will forward the documents mentioned above as well as copy of e-PPO received through SFTP from this office duly countersigned by him to the new PDA as per existing system.

(iv) Further payments in continuation of the date upto and for which the pensioner is shown as paid on the Extract of Payment Register, will be arranged by the new PDA.

(v) An intimation regarding the transfer of pension papers should invariably be sent both by the transferor/ transferee PDA to the Pr. CDA (Pensions) Allahabad through Form-I/IMP-5(A)/D-II by the transferor PDA (under Part-II of the enclosed format) and Form­II/IMP-5/D-I by the transferee PDA (under Part-III of the enclosed format) as per prevailing procedure by registered post as well as on e-mail ID: dad@hub.nic.in

(2) While forwarding Form-I/IMP-5(A)/D-II to this office by the transferor PDA, following documents are also required to be attached with Form­I/IMP-5(A)/D-II:
(i)  A consent (in Part-IV of the enclosed format) from the new PDA that after receipt of documents from the existing PDA, his/her pension will be paid after taking on the payment strength of the new PDA.

(ii) A leaf of cheque issued by the new PDA duly cancelled in the case of new PDA is Bank.
(3) In the case of change of PDA from Indian Embassy, Nepal to other PDA and vice-versa, existing system for pension file routed through this office and issuance of corrigendum PPO before change of PDA will follow.

Sub: Waiver of requirement of producing two pensioners drawing pension from same PDA to identify the pensioner.

During various Defence Pension Adalats, representations are being received against the requirement of producing two pensioners drawing pension from same PDA to identify pensioner.

The issue has been examined and it is noticed that various checks to be observed by the Pension Disbursing Authorities (PDAs) before making payment for first time on new Pension Payment Orders (PPOs)/transferred PPOs are provided in para 584 of DPPI-2005 & 2013. Similarly, these checks were circulated to the PDAs as Annexure-A to important Circular No.113 dt 27/05/2005. Item No. 7 and No. 15 of DPPI and Annexure-A to above mentioned circular respectively states that two defence pensioners should identify a new pensioners (except officer).

Now a days, requirement of producing two pensioners drawing pension from same PDA to identify the pensioner which is applicable to the pensioners below officer ranks does not seem correct, as PDAs are required to identify the pensioner based on marks of identification furnished in Descriptive Rolls/Descriptive Particulars and photographs provided to them.

Accordingly PDAs are requested to refer this office circular No. 197 dt 10/01/2018, and follow the guidelines issued there under for identification by additional documents produced by defence pensioners in absence of Aadhaar Number as indicated in Notification No. S.0 747(E) dt 03/03/2017 issued by Ministry of Defence, Deptt. of ESW rather than insisting the pensioner to produce two pensioners drawing pension from same PDA to identify him/her.

A Copy of GoI, MoD letter No. 12(1)/2014/D(Pen/Pol)-Pt-II dated 17.10.2018 which is self explanatory, is forwarded herewith for further necessary action and immediate implementation.

2. Consequent upon issuance of GoI, MoD letter dated 17.10.2018, the tables No. 5, 14, 23, 32, 41, 50, 63, 64, 74, 83 and 92 have been modified to the extant mentioned in ibid Govt. letter. Pension of the affected pensioners may be reviewed and revised according to amended tables. However, if pension revised in these cases according to amended tables w.e.f. 1.7.2014 is less than the pension as on 30.06.2014, the same will not be revised of the disadvantage to the pensioners.

3. Further, in table No. 7, the pension rate of Hony. Nb. Subedar with qualifying service of 13 years has not been protected with reference to the lower rank viz Havildar of same qualifying service i.e. 13 years. As such following amendment may be carried out in tables No. 7.

Reference:- Circular No. 546 dated 10.09.2015.

Reference is invited to para-3 of GoI, MoD letter NO. 3(1)/2015-D(Pen/Pol) dated 25.08.2015 under which it has been decided by the Government that the required undertaking /status of non re-employment /employment after retirement may be obtained by the Record Offices/Head of Offices from the retiring Defence Personnel along with other documents before his retirement.

2. The undertaking regarding recovery of overpayment, non re-employment/ employment certificate alongwith the Descriptive Roll of the retiring JCO/OR or family pensioner in case of death, shall be forwarded to the Pension Disbursing Agencies along with Pension Payment Order by the Record Office concerned following the laid down procedure. In case of pensioner drawing Pension from agencies other than bank viz Defence Pension Disbursing Office/Treasury Office etc. a copy of cancelled cheque obtained from retiring personnel shall also be forwarded by the Record Office along with Pension Payment Order to the Pension Disbursing Agencies to ensure payment of pension into the pensioners’ account.

3. Of late, it has been brought to the notice of competent authority by the banking authorities that required undertaking regarding recovery of overpayment/ non re-employment/employment certificates are not being forwarded to the banks/ PDAs along with Descriptive Roll & PPO for payment of first pension as stated above, resulting in undue delay in first payment of pensionary award.

4. Therefore, it is advised that, to ensure the prompt and timely payment of pension, required undertaking regarding recovery of overpayment and non re­employment/employment certificates after retirement along with Descriptive Roll and PPO may be forwarded to Banks/PDAs for payment of first pension. Specimen copy of undertaking regarding recovery of overpayment & non re-employment/employment certificates are enclosed for reference.

Subject:-Payment of Legal Fee to Central Govt. Counsels - clarification reg.

With reference to the existing provisions relating to payment of Legal Fee to Central Govt. Counsels, certain doubts raised by the office of PCDA have been taken-up with the Ministry of Law & Justice, Department of Legal Affairs (Judicial Section) for clarification/guidelines. Based on the clarifications received, the summary of the points of doubt and clarification are as given below:-

Courts has been notified by Min. of Law & Justice, Dept. of Legal Affairs vide their OM bearing No. 26(1)/2014/Judl. dated 01.10.2015. As per the said OM dated 01.10.2015, payment of legal fee fornon-effective hearings in a case has been restricted to five (05) and payment of legal fee for Conferences in a case has been restricted to four (04).
Point of Doubt
In case, the Govt. Counsel has been changed during the pendency of a case who has already been paid for maximum number of non-effective hearings & conference, whether the newly appointed Govt. Counsel can be paid fee for another five (05) non-effective hearings & (04) conference or not.
The OM No.26(1)/2014-Judl. Dated 01.10.2015 itself restricts the payment to a maximum of five non- effective hearings. Hence, a new counsel appointed during the pendency of a case will not be eligible for payment for non-effective hearings in case the limit of five as stated in above in above- mentioned OM is exhausted.
(ii)In case, a proxy Counsel has appeared on behalf of nominated Govt. Counsel, Whether legal fee {effective or non effective} can be paid to the CGSC for hearings appeared by proxy counsel.When proxy/private counsel has appeared on behalf of the Govt. Counsel in a matter, such nominated counsel is not entitled to payment of fee bill.

2. All the legal fee bills of Govt. Counsels may be regulated accordingly.

Sub: Payment of dearness relief to re-employed pensioners and employed family pensioners: Clarification thereof.
Ref: This office Circular No. 166 dated 07/03/2013, Circular No. 173 dated 07/04/2014 and Circular No. 179 dated 12/05/2015.

Provisions for payment of dearness relief to re-employed pensioners and employed family pensioners is laid down in Ministry of Personnel, Public Grievances & Pensions (Deptt. of Pension & Pensioners Welfare) OM No. 45/73/97-P&PW(G) dated 02/07/1999 issued under this office Important Circular No. 07 dated 13/08/1999. As per the ibid OM, before 18/07/1997, in terms of the existing orders, Dearness Relief to pensioners and family pensioners is to remain suspended during the period a pensioner/family pensioner is re-employed/employed under the Central or State Govt. or in a Statutory Corporation/Company/Body/Bank under them in India or abroad. The above facts are also applicable to the pensioners and family pensioners permanently absorbed in Statutory Corporation/Company/Body/Bank under the Central or State Government.

2. Representations from various agencies as well as pensioners/family pensioners including Pension Disbursing Agencies are being received for clarification on Payment of dearness relief to re-employed pensioners and employed family pensioners. The matter has been examined in this office and following points are clarified.

3. However, w.e.f. 18/07/1997, it has been decided by the Govt that: (i) In so far as re-employed pensioners are concerned, the entire pension admissible is to be ignored at present only in the case of those civilian pensioners who held post below Group 'A' and those ex-servicemen who held post below the ranks of Commissioned Officers at the time of their retirement. Their pay, on re-employment, is to be fixed at the minimum of the pay scale of the post in which they are re-employed. Such pensioners will consequently be entitled to Dearness Relief on their pension. (A) For this purpose, the Central Government Departments concerned, including subordinate organizations. State Government, Corporation/Company/Body/Bank etc. employing a Central Government pensioner shall be required to issue of certificate indicating the following:
(a) The re-employed pensioner retired from a civil or military post in the Central Government and was holding a post not included in classified as group 'A' or a post below the rank of commissioned officer in the armed forces;
(b) The entire amount of pension sanctioned by the Central Government was ignored in fixation of the pay on re-employment i.e. no part of the pension was taken into account in such fixation of pay in the pay scale of the post in which the Central government retired/retiree was re-employed/absorbed; and
(c) The pay of the re-employed/absorbee was/is fixed at the minimum of the pay scale of the post in which he had/has been initially re-employed after his retirement from the Central Government.
(d) If the pay fixed at a higher stage because of advance increments and no protection of the last pay drawn is being given.
(B) In the cases where PBOR (below Commissioned Officer) retired before attaining the age of 55 years and re-employed thereafter and their pay fixed at a higher stage because of advance increments and no protection of the last pay drawn were given, the pay should be treated as fixed at a minimum for the purpose of ignoring the entire pension and allowing Dearness Relief on pension. For benefit of advance increments, the policy for the same should exist in the re-employing department and a copy of such policy matter should be enclosed with the required certificate. But, after granting benefit of advance increments, the last pay drawn by the pensioner is protected, the pensioner in such case will not be entitled for dearness relief on pension.

A Copy of Govt. of India, Ministry of Defence, Deptt of ESW letter No. 1(5)/2017/D(Pen/Policy) dated 11.04.2018 on the above subject, which is self explanatory, is forwarded herewith for your information, guidance and necessary action.

2. Consequent upon receipt of Govt. of India, Ministry of Defence, New Delhi letter No. 1(5)/2017/D(Pen/Policy) dated 11.04.2018 ex-gratia adhoc allowance has been sanctioned on compassionate ground @ Rs. 9000/- p.m. w.e.f. 01.01.2016 to the following categories of pensioners/family pensioners:-
(a) Armed forces pensioners/family pensioners migrated from Pakistan.
(b) Burma Army pensioners/ family pensioners who are Indian national and drawing their pension in India.
(c) Burma army pensioners of Nepalese origin who are drawing pension in India and Indian Embassy, Pension Paying Offices in Nepal.
3. The categories of pensioners/family pensioners mentioned in para 2 above will also be eligible to dearness relief on the ex-gratia ad-hoc allowance at the enhanced rate under the Govt. of India, Ministry of Defence, Deptt. of ESW letter No.1(5)/2017/D(Pen/Policy) dated 11.04.2018 at the retes admissible to Central Govt. pensioners from time to time.

4. The ex-gratia ad-hoc allowance on the authority of the Govt. of India, Ministry of Defence, Deptt. of ESW letter No.1(5)/2017/D(Pen/Policy) dated 11.04.2018 will be paid by you to the categories of pensioners mentioned at para 2 above carefylly. No further authorization on this account should be awaited from this office. Further, it is stated that the para 4 of this office Circular No.419 dated 06.10.2009 will be operative. The extra liability on account to Ex-gratia adhoc allowance to Burma defence family pensioners will be borne by the Government of India.

5. The pre-revised Ex-gratia ad-hoc Allowance (including DR etc) already drawn by the above pensioners from 1.1.2016 onward shall be adjusted from the enhanced Ex-gratia Ad-hoc Allowance which shall become payable w.e.f. 1.1.2016 under these orders. Policy and procedure regarding payment of Ex-gratia Ad-hoc Allowance shall continue to be governed by the existing instructions issued in the matter so far. It may be ensured that the payment to pensioners/family pensioners indicated in para 2 above, is made into the Aadhaar linked Bank Accounts.

6. Any overpayment due for recovery may please be adjusted against the arrears now payable.
7. All other terms and conditions shall remain unchanged.

8. All PDAs are requested to identify the effective cases and revise the rate of Ex-gratia Ad-hoc allowance and render report of revision to Shri K.K.Pant, Sr.AO(P), the OI/C, Audit (Tech) Section of this office for onward submission to higher authorities.

Subject : Restoration of pension in respect of Defence Service Personnel who had drawn lump sum payment on absorption in Public Sector Undertakings/ Autonomous Bodies-delinking of qualifying service of 33 years for revised pension with effect from 01.01.2006.

Reference:- This office Circular No. 568 dated 13.10.2016 and Circular No. 592 dated 05.12.2017.

A Copy of Govt. of India, Ministry of Defence, Deptt of ESW letter No. 1(04)/2007/D(Pen/Pol) dated 20.06.2018 on the above subject, which is self explanatory, is forwarded herewith for your information, guidance and necessary action.

2. In terms of GoI, MoD letter No. 1(2)/2016-D(Pen/Pol) dated 30.09.2016, revised consolidated pension and family pension of pre-2006 Armed Forces pensioners w.e.f. 1.1.2006 shall not be lower than 50 % and 30% respectively of the minimum of the pay in the pay band plus grade pay corresponding to the pre-revised scale from which the pensioner had retired/ discharged/ invalided out/ died including Military Service Pay and "X" Group pay, if any, without pro rata reduction of pension even if they had rendered qualifying service of less than 33 years at the time of retirement.

3. Now it has been decided by the Government that while determining the revised pension of above said category of absorbe pensioners/family pensioners with effect from 1.1.2006, the pension/ family pension shall also be revised in accordance with the provisions contained in the GoI, MoD letter No. 1(2)/2016-D(Pen/Pol) dated 30.09.2016 referred above.

4. The pension in terms of this order will be revised by the respective Pension Sanctioning Authorities Suo-moto by issuing Corrigendum PPOs in all affected cases. No application in this regard shall be called for either from the pensioners or from the PDAs concerned. Further, PDAs would also brought into notice of PSAs, such left out cases, if any, for revision of pension.

5. All other terms and conditions shall remain unchanged.

Office of the PCDA(P) Allahabad has started issuing e-PPOs for all categories of pensioners. A new PPO series was also introduced for various types of e-PPOs and subsequently range of modifications took place while adopting the process.

2. Copies of digitally signed e- PPOs are being sent electronically to PDAs and to Record Offices (ROs) concerned in case of JCOs/ORs . The RO, after scrutinising and checking the e-PPO, is required to forward a hard copy of the e-PPO (after printing from the PDF file) along with Descriptive Roll of the pensioners to PDA concerned. Record Offices (ROs) are also required to provide a copy of the e-PPO to the Armed Forces Pensioners/ Family Pensioners for their record either as a hard copy or through an e-mail as deemed fit.

3. After issuance of e-PPOs by this office, the e-PPOs are immediately forwarded to Record Offices concerned through DPCC (Defence Pension Contact Centre) functioning in the office premises of the PCDA (Pensions) Allahabad.

4. However, it has been noticed that the Record Offices (ROs) and the pensioners/family pensioners are not receiving e-PPO on time thereby causing delay in receipt of pension and other pensionary benefits.

5. In view of the above, all Record Offices are requested to instruct their representative/s to contact the DPCC (Defence Pension Contact Centre) functioning in the office premises of the PCDA(Pension) Allahabad for collection of e-PPOs issued by this office in soft copy viz. Compact Disk (CD) or in Pen Drive. Discrepancy observed in the e-PPO, if any, may be immediately brought to the notice of this office for necessary action at this end. For any query regarding collection of e-PPO, please contact Lt. Col. Palani S, Officer I/C, DPCC (E-Mail ID : dplc1pcdap@gmail.com, Phone: 0532- 2423486, Army Line : 6219).

6. Further, Record Offices are requested to ensure that e-PPOs are collected and despatched timely to PDAs alongwith Descriptive Roll so that payment of pensionary benefits are made to the pensioners/family pensioners in time.

Copy of GOI, MOD letter No. 17(01)/2017(01)/D(Pen/Policy) dated 23rd January, 2018 on the above subject, which is self- explanatory, is forwarded herewith for further necessary action at your end.

2. In terms of Para-2 of GOI, MOD letter No. 17(01)/2017 (01)/D(Pension/ Policy) dated 04th September,2017, Disability Element of Disability Pension to Armed Forces Pensioners has to be revised by multiplying the existing rate of Disability Element as had been drawn on 31.12.2015 by factor of 2.57 to arrive at revised rate of Disability Element as on 01.01.2016. Further, in terms of Para-5.2 & 5.3 of GOI, MOD letter No. 17(01)/2017(02)/D(Pension/Policy) dated 05th September' 2017, Disability Pensionary awards has to be revised on notional pay fixation method and benefits of broad banding will be given to discharge cases also as in invalided out cases and these will be done by issuing Corrigendum Pension Payment Order (PPO).

3. Now, consequent upon the issue of GOI, MOD letter dated 23rd January, 2018, the cases where Armed Forces Pensioners who were retired/ discharged voluntary or otherwise with disability and they were in receipt of Disability/ War Injury Element as on 31.12.2015, their extent of disability/ War Injury Element shall be re-computed in the following manner given below, before applying the multiplication factor of 2.57 on existing disability/ war injury element as on 31.12.2015 for getting the revised disability/ war injury element as on 01.01.2016 in accordance to Para-2 of GOI, MOD letter No. 17(01)/2017(01)/D(Pension/ Policy) dated 04th September' 2017.

4. The Note below Para-12 of GOI, MOD letter No. 17 (01)/2016-D(Pen/Pol) dated 29th October, 2016 (circulated vide Circular No. 570 dated 31.10.2016) stands deleted. In other words, quantum of additional pension available to old age pensioners after attaining the age of 80 years and above shall also be admissible on revised disability/ war injury element.

5. It is also stated that PDAs may take utmost care during revision of Disability/War Injury Element as per this order in those cases where the pensioners who are in receipt of 50% of Disability/ War Injury Element of Disability/ War Injury Pension. If the individual has already been given rounding of benefit through PPO (in invalided out cases) then rounding of benefit in such cases should not be given. However, where his disability was assessed as 50% in discharge cases then it will be rounded to 75% as mentioned in Para-3 above. If the PDAs found any problem regarding identification of such cases the same may please be forwarded to Audit Section of this office.

6. All Pension Disbursing Agencies handling disbursement of pension to the Defence Pensioner are hereby authorized to pay benefit of rounding off disability/ war injury and additional pension as per Para 3 & 5 above without any further authorization from the concerned Pension Sanctioning Authorities.

7. Provisions of GOI, MOD letter No. 17(01)/2017(01)/D (Pen/Policy) dated 23rd January, 2018 shall take effect from 01.01.2016.

Consequent upon introduction of Aadhaar Act, 2016, an individual eligible to receive the pension benefits is required to furnish proof of possession of Aadhaar number or undergo Aadhaar authentication.

However, Ministry of Defence, Department of Ex-Servicemen Welfare Notification No. 14(2)/2014/D (P/P)(Part-I)(copy enclosed) published in Gazette of India in 03.03.2017 vide No. S.O.747(e), provides that, till the Aadhaar is assigned to the beneficiary of pension benefits, benefits shall be given to such individuals subject to the production of certain identification documents as indicated in Notification No. S.O. 747(E).

In view of above, all the Pension Disbursing Authorities are advised to check the identification documents, as mentioned in above Notification No. S.O. 747(E), produced by defence pensioners, till Aadhaar is assigned to the pension beneficiaries. Especially as per clause b(i) and (ii) of notification No. S.O. 747(E).

NOTIFICATION

New Delhi, the 3rd March, 2017

S.O. 747(E).—Whereas, the use of Aadhaar as identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner and Aadhaar obviates the need for producing multiple documents to prove one’s identity;

And, whereas, the payment of pension is given to retired Defence Forces pensioners/ Family Pensioners (hereinafter referred to as beneficiaries) by the Department of Ex-Servicemen Welfare, Ministry of Defence in the Government of India under the Pension Regulations for Army, 1961, the Pension Regulations for Air Force, 1961, and the Pension Regulations for Navy 1964 and the pension is disbursed to beneficiaries through Pension Disbursement Agencies;

And, whereas, the aforesaid benefit of pension involves recurring expenditure from the Consolidated

Fund of India;

Now, therefore, in pursuance of the provisions of the section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to the said Act), the Central Government hereby notifies the following, namely: —

(1) An individual eligible to receive the pension benefits is hereby required to furnish proof of possession of Aadhaar number or undergo Aadhaar authentication.

(2)  Any eligible beneficiary entitled to receive pension benefits, who does not possess the Aadhaar Number or, not yet enrolled for Aadhaar, but desirous of availing pension benefits is hereby required to make application for Aadhaar enrolment by 30th June, 2017, provided he or she is entitled to obtain Aadhaar as per section 3 of the said Act and such individuals shall visit any Aadhaar enrolment centre (list available at UIDAI website www.uidai.gov.in) to get enrolled for Aadhaar.

(3)          As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Ministry of Defence through Pension Disbursement Agencies or other means which requires an individual to furnish Aadhaar is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Ministry of Defence through Pension Disbursement Agencies or other means is required to provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of Unique Identification Authority of India or by becoming Unique Identification Authority of India registrar:

Provided that, till the Aadhaar is assigned to the beneficiary of pension benefits, benefits shall be given to such individuals subject to the production of the following identification documents, namely:

(a)          Ex-servicemen Card issued by the concerned authorities; and

(b)  (i) If he or she has enrolled, his or her Aadhaar Enrolment ID slip; or

(ii) a copy of his or her request made for Aadhaar enrolment, as specified in sub-paragraph (2) of paragraph 2 below; and

any of the following documents, namely :-

(i)            Voter ID card issued by the Election Commission of India; or

(ii)           Permanent Account Number Card issued by Income Tax Department; or

(iii)          Passport; or

(iv)         Driving License issued by Licensing authority under the Motor Vehicles Act, 1988 (59 of 1988); or

(v)          Certificate of Identity having photo issued by a Gazetted officer or Tehsildar on an official letter head; or

(vi)         Address card having Name and Photo issued by Department of Posts; or

(vii)        Kisan Photo Passbook; or

(viii)       any other document as specified by the Ministry of Defence:

Provided further that the above documents shall be checked by an officer specifically designated by the Ministry of Defence for that purpose.

2. In order to provide convenient and hassle free pension benefits to the beneficiaries, the Ministry of Defence through Pension Disbursement Agencies or other means shall make all the required arrangements including following; namely:-

(1)  Wide publicity through media and individual notices shall be given to beneficiaries of pension benefits to make them aware of the requirement of Aadhaar under the scheme and they may be advised to get themselves enrolled at the nearest Aadhaar enrolment centres available in their areas by 30th June, 2017 in case they are not already enrolled and the list of locally available enrolment centres shall be made available to them.

(2)          In case, beneficiaries of pension benefits are not able to enrol due to non-availability of enrolment centres in the near vicinity such as in the block or tehsil or taluka, the Ministry through Pension Disbursement Agencies or other means is required to create Aadhaar enrolment facilities at convenient locations and the beneficiaries of pension benefits may register their request for Aadhaar enrolment by giving their name, address, mobile number with Ex-Servicemen Card and other details specified in the proviso to clause (b) sub¬paragraph (3) of paragraph 1 with their Pension Disbursement Agencies or other means or through the web portal provided for the purpose.

3. This notification shall come into effect from the date of its publication in the Official Gazette in all States and Union Territories except the States of Assam, Meghalaya and Jammu and Kashmir. Provided that this notification shall not be applicable for following categories of Pensioners or Family Pensioners, namely:—

(i)            NRI who resides in other or foreign country,

(ii)           Overseas settled Indian who is citizen of other or foreign country,

(iii)    Nepal Domiciled, Burmese and similar categories of defence pensioners.
