Raksha Mantri Shri Rajnath Singh said modernisation of the Armed forces is the top priority of the government to enhance the defence capability and preparedness of the country. He visited Bharat Dynamics Limited (BDL) in Hyderabad on August 3, 2019 on the occasion of Golden Jubilee celebrations of the Defence PSU.

Addressing the gathering on the occasion, Shri Rajnath Singh said Indigenization will be encouraged to the maximum possible extent and defence equipment will be imported only when it cannot be manufactured indigenously. He added that the defence sector will play a key role in making the country a 5-trillion economy through FDI and offset investments in manufacturing. He hoped that defence exports will reach to a significant level by 2025.

Shri Rajnath Singh said BDL is an important defence organisation and with organizations like DRDO, ISRO, BDL has enhanced the prestige of the country through its achievements. Shri Rajnath Singh appreciated BDL for manufacturing more than one lakh missiles in the last 50 years.

Shri Rajnath Singh said in the new world many countries have developed counter to missile technology by developing Air Defence Systems and gave a call for the development of Hypersonic Missiles technology to enhance defence capabilities of the Armed Forces. He reiterated that defence policy of the country is for peace and stability at regional, continental and global level.

He unveiled a statue of former President and Bharat Ratna Dr A P J Abdul Kalam to commemorate his legendary vision. The brainchild of Dr Kalam, Integrated Guided Missile Development (IGMD) Programme that was launched during late 80s, gave BDL plenty of opportunities to develop its skilled manpower and invest in high-end technology areas to manufacture the missiles contemplated under this Programme. The Raksha Mantri also visited the state-of-the-art production facilities at Kanchanbagh Unit of the Company. He also released a commemorative stamp on BDL on the occasion.

Raksha Mantri Shri Rajnath Singh handed over Medium Range Surface-to-AirMissile (MR SAM) to Indian Air Force in the function. Vice Chief of Air Staff Air Marshal R K S Bhadauria received MR SAM on behalf of the IAF.

Raksha Mantri felicitated ‘Veer Naris’ from the State of Telangana and Andhra Pradesh as a part of Corporate Social Responsibility initiative of the BDL. Shri Rajnath Singh interacteded with 22 Veer Naris who were invited to BDL on this occasion.

Raksha Mantri also inaugurated the Rain Water Harvesting facility named as ‘Jal Nidhi’ at the upcoming Unit of BDL at Ibrahimpatnam as a part of Jal Shakti Abhiyan of the Government of India. This is expected to help in meeting storage of 24 Lakh litre of water and increasing the level of underground water levels.

A five MW Solar power plant was also inaugurated by Shri Rajnath Singh at BDL, Ibrahimpatnam, which demonstrates commitment of DPSU towards environment protection.

Earlier, Raksha Mantri was given a warm welcome by Chairman-cum-Managing Director of BDL Commodore Siddharth Mishra (Retd) at its premises at Kanchanbagh. Secretary, Department of Defence Research & Development and Chairman, DRDO Dr G Satheesh Reddy was present of the occasion.

Permanent Commission (PC)

(1) Ministry of Defence has taken steps to ensure implementation of permanent commission to women in the Armed Forces. In so far the Indian Air Force is concerned, all branches, including Fighter Pilots, are now open for women officers. In Navy, all non-sea going branches/cadre/specialization have been opened for induction of women officers through Short Service Commission (SSC). Women officer will be granted PC in the Indian Army in all the ten branches where women are inducted for Short Service Commission.

International Cooperation

(2) A delegation led by Deputy Permanent Secretary for Defence, Thailand visited India on 7th March, 2019 to attend the 7th meeting of India-Thailand Defence Dialogue, co-chaired by Additional Secretary (SC).

(3) A delegation led by Defence Secretary visited United Kingdom to attend the 20th India-UK Defence Consultative Group (DCG) meeting from 7th to 9th March, 2019.

(4) A delegation led by loint Secretary (Planning and International Cooperation) visited Argentina and Chile from 11 th to 15th March, 2019 to discuss defence cooperation issues.

(5) A delegation led by Additional Secretary (SC) visited Australia to attend the 6th meeting oflndia-Austra lia Defence Policy Talks (DPT) from 13th to 15th March, 2019.

(6) A delegation led by Defence Secretary visited Uzbekistan from 25th to 29th March, 2019 and discussed issues related to bilateral defence cooperation.

Acquisition

(7) A contract for procurement of 70 mm Rocket and associated equipment for Advanced Light Helicopter (WSI) in respect of IAF and IA has been signed with M/s Thales, Belgium S.A on 28th March, 2019 at negotiated contract price of Euro 148,500,000 @ 1 Euro = Rs. 70.35 as on 22nd July, 2015.

(8) A contract has been concluded for procurement of 23x3D CID Band Air Surveillance Radar (3D ASRs) amounting to Rs. 1183.53 crore.

(9) A contract for Card Mfg & Personalization & Chip PS Development (RFP-1) for Navy-wide Implementation of RFID based SMART ACCESS Card Project has been signed with Mis BEL Bengaluru on 14th March, 2019 at a total cost of Rs 52.02 crore.

(10) A contract "for Navy-wide Implementation of RFID based SMART ACCESS Card" Project on turnkey basis (RFP-II) was signed with Mis Tech Mahindra Ltd. on 14th March, 2019 at a total cost ofRs. 254.59 crore.

Janaushadhi Diwas

(11) Minister of State for Defence on the occasion of Janaushadhi Diwas inaugurated a Janaushadhi Kendra at Base Hospital in ew Delhi on 7th March, 2019. It will be a pilot Kendra, which is in line with Pradhan Mantri Bharatiya Janaushadhi Pariyojana (PMBJP). Ministry of Defence last year had mandated Janaushadhi Kendras to be empanelled with ECHS as Authorised Local Chemist (ALC) which will benefit the provisioning of medicine at much cheaper rate vis-a-vis market.

Gallantry Awards

(12) President and Supreme Commander of the Indian Armed Forces conferred 05 Kirti Chakras and 30 Shaurya Chakras to Anned Forces Personnel for displaying conspicuous gallantry, indomitable courage and extreme devotion to duty at a solemn ceremony at the Rashtrapati Bhawan on 14th and 19th March, 2019. 04 Kirti Chakras and 03 Shaurya Chakra were given posthumously. The President also conferred 28 Param Vishisht Seva Medals, 03 Uttam Yudh Seva Medals and 51 Ati Vishisht Seva Medals to senior officers of the Armed Forces for distinguished service of an exceptional order.

Miscellaneous

(13) Interceptor Boat (IB) C-444 & C-446 built by Mis L&T were inducted on 18th March, 2019.
(14) On 22nd March, 2019, Indian Coast Guard Ship (ICGS) Rajveer apprehended one Indonesian fishing boat with 03 crew in position 05 nautical mile south Katchall Island. ICGS Rajveer along with apprehended Indonesian fishing boat entered Port Blair on 25th March, 2019 for further formalities.

Media Reports Maligning GoI over NFFU/NFU to Armed Forces

Certain section of media is attempting to generate motivated controversy on the NFFU/NFU for Armed Forces while the case is still subjudice in the Apex Court. The targeting of Govt officials ascribing false statements to them with an intent to pressurise them is highly condemnable. In case of complicated policies with long term and wider consequences, there may be times when agreement is not easy to build not only between two parties but also within a party, such cases are debated for merit in judicial Courts as per the law of the land. This process must not be attempted to be highjacked by publically targeting the reputation of individuals discharging their duties as the authorised representatives of one side, GoI in this case. In the instant case, the recourse to judicial review was taken as per the existing policies and at the decision of the GoI.

Certain facts have been twisted and misrepresented in media with the purpose of misleading uniformed community and the general public. One, the Central Pay Commission has been incorrectly quoted to have recommended NFFU/ NFU for the Armed Forces. Two, there has been no attempt to malign the uniformed community or quote them as staying in ‘palatial houses’ as the hardships faced by military fraternity are well known and deeply respected by everyone including those in the Govt. The counsel of GoI has only read out the recommendations of the 7th CPC as the argument of the case in the Apex Court. Three, the originators of smearing campaign have not spared even a uniformed veteran representing GoI in judicial matters but who has no connection with the instant case. Four, the delay is not at the behest of the Govt but because of the Apex Court asking the Govt to serve the notices to remaining petitioners so that they can also be heard.

MoD requests all to allow the legal procedure in the Apex Court to complete. It is reiterated that Govt stands by its uniformed fraternity and is custodian of its high morale and operational effectiveness.

Subject: Information regarding rent and allied charges in respect of Indian Army Officers

A DO Letter has been revived from shri A.V.Rao, IDAS, PCDA, PCDA (O) Pune regarding timely closing of accounts on retrenchment/release of the Army Officers. It has been intimated that large number of debit balances are being reflected in IRLAs of the Army Officers on account of recovery of rent and allied charges after their date of retirement.

As per provisions of Rule 693 & 694 of RMES, "In the case of pensioners and private individuals, rent is recoverable month;y in advance.Rent bills will be sent through the appropriate MES office direct to them for payment, either into the treasury or to the MES office concerned on or before the 5th of the month" .In such a scenario,there is no need to raise a rent bill in r/o officers after retirement and PCDA (O) Pune is not required to wait for the vacation returns.

It is therefore, requested that rent bills of Indian Army Officers deployed at the factory and its allied establishments, may be dealt in accordance with the provisions of RMES and forwarded through Project Bhawan, If rent bill is floated at your end. A compliance report in this regard may please be forwarded to this office latest by 28/02/2019 by mail/fax.

Modernisation of the Armed Forces is a continuous process based on threat perception, operational challenges and technological changes to keep the Armed Forces in a state of readiness to meet the entire spectrum of security challenges. Government attaches the highest priority to ensure that the Armed Forces are sufficiently equipped to meet any operational requirement. This is achieved through induction of new equipment and technological upgradation of capabilities. The equipment requirements of the Armed Forces are planned and progressed through a detailed process which includes 15 Year Long Term Integrated Perspective Plan (LTIPP), a five year Service-wise Capability Acquisition Plan, a two year roll-on Annual Acquisition Plan and deliberations by the Defence Acquisition Council chaired by the Raksha Mantri.

During the last three years and in the current year (upto October, 2018), 188 contracts have been signed for capital procurement of defence equipment for Armed Forces such as Radars, Aircraft, Rockets, Artillery Guns, Helicopters, Missiles, Ballistic Helmets, Bullet Proof Jackets, Weapons, Simulators, Electronic Fuzes and Ammunition. Budget Allocation and Expenditure under Capital Budget Head are given below:-

The Final Appropriation has been fully and optimally utilized during the said period. Internal Audit and External Audit of the allocated amount is carried out by CGDA and C&AG respectively.
In May 2001, the Defence Industry sector, which was hitherto reserved for the public sector, was opened up to 100% for Indian private sector participation, with Foreign Direct Investment (FDI) up to 26% both subject to licensing.  Further, Department of Industrial Policy & Promotion, Ministry of Commerce & Industry has notified revised FDI policy under which FDI is allowed under automatic route upto 49% and beyond 49% through Government route wherever it is likely to result in access to modern technology or for other reasons to be recorded.

During the last three years and current year (upto October, 2018) out of total 188 contracts, 121 contracts have been signed with Indian vendors for procurement of defence equipment for Armed Forces such as Helicopters, Survey vessel, Radar, Ballistic Helmets, Artillery Guns, Simulators, Missiles, Bullet Proof Jackets, Electronic Fuzzes and ammunition.

Government is taking measures for modernization of the Armed Forces, through procurement of new equipment and upgrading of existing equipment and systems. The modernization projects are being progressed as per the approved Capital Acquisition Plans and in terms of the extant Defence Procurement Procedure.

Since the launch of  'Make in  India' in September 2014, several measures have been taken by the Government to promote indigenous design, development and manufacture of defence & aerospace equipment in the country under  'Make in India' by harnessing the capabilities of the public and private sector.

Government has also promulgated the policy of Strategic Partnership in the Defence Sector which encourages participation of the private sector in manufacture of major defence platforms and equipment in four selected segments viz. Submarines, Fighter Aircraft, Helicopters and Armoured Fighting vehicles / Tanks.

Taking note of the rigours of military life, the 6th Central Pay Commission (CPC) had recommended an additional, separate element of Pay for the Defence Forces called Military Service Pay (MSP) which the CPC intended would also maintain the edge enjoyed by the Defence Forces over the civilian scales. The Commission was of the view that the rate of MSP as a percentage of the existing pay has to be maintained in case of officers (up to the level of Brigadier / equivalent) as well as PBORs because the difficulties faced in field situations by both these categories are similar.

The 7th Central Pay Commission (CPC) had considered all aspects with regard to applicability of MSP including the rates while making its recommendations. This was done after considering the views of the Services in the matter. The 7th CPC has consciously decided not to create additional categories of personnel for the grant of MSP or to disturb the slab rates for the four categories for which it is being paid up to the level of Brigadiers. The Government after carefully considering the recommendations of the 7th CPC in respect of MSP has accepted and notified the same.

Besides MSP, Service personnel are entitled to several other allowances such as High Altitude Allowance, Field Area / Modified Field Area Allowance, Counter Insurgency Allowance etc which are paid based on risks and hardships involved at a location / in an operation.

Subject: Payment of Dearness Allowance to Armed Forces Officers and Personnel Below Officer Rank including NCs(E) - Revised rates effective from 1st January, 2018.

Sir,
I am directed to refer to this Ministry’s letter No.1(2)/2004/D(Pay/Services) dated 3rd October 2017, on the subject cited above and to say that the President is pleased to decide that the Dearness Allowance payable to Armed Forces Officers and Personnel Below Officer Rank, including Non-Combatants (Enrolled), shall be enhanced from the existing rate of 5% to 7% of the basic pay with effect from 1st January, 2018.

2. The term 'basic pay' in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc

3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of Pay rules of Defence Force Personnel.

4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.

5. The payment of arrears of Dearness Allowance shall not be made before the date of disbursement of salary of March, 2018.

6. This letter issues with the concurrence of Finance Division of this Ministry vide their Dy. No.79-PA dated 26.03.18 based on Ministry of Finance (Department of Expenditure) O.M. No.1/1/2018-E.II(B), dated 15th March, 2018.

MoU between Indian Army and HDFC Bank

A Memorandum of Undertaking (MoU) was signed between the Indian Army and HDFC Bank on the Defence Salary Package on 03 Apr 2018. The first MoU between HDFC Bank and the Indian Army was signed in 2011 and was renewed on 13 Mar 2015. The current MoU is tailor made to suit the requirements of serving soldiers, pensioners and families.

The signing in ceremony was chaired by the Director General (MP&PS), Lt Gen S K Saini and was attended by the top dignitaries of HDFC Bank headed by Ms Smita Bhagat, Head Government Business and Branch Banking.

Currently Indian Army has MoUs on Defence Salary Package with 11 public and private sector banks. MoUs are considered for inception and renewal with banks on analyzing their utility and suitability to the requirements of serving soldiers, pensioners and families. Army is hoping that this MoU will benefit a large number of serving and retired Army personnel who are having their accounts with HDFC bank; and also provide them an opportunity to access modern banking facilities.

Under the current MoU apart from other benefits the Army personnel will get free personal accident death cover and free permanent disability cover of Rs 30 lakhs, free educational cover of upto Rs 1 Lakh per year for four years for education of dependent child in case of accidental death of defence personnel and 100% processing fees waived for Car Loans and Personal Loans.

IN THE MINISTRY OF DEFENCE

(a) Yes, Madam.

(b) The combined amount of tuition fee and hostel charges provided to the children of Armed Forces Officers / PBORs missing / disabled / killed in action has been capped at Rs.10,000 p.m. in accordance with the recommendations of the 7th Central Pay Commission (7th CPC) as accepted by the Government.

Keeping in view that both the number of students and the tuition / hostel fee are open-ended, no fixed / uniform amount of savings can be indicated. Out of total reported 2679 students during the year 2017-18, 193 students have been reported to be drawing more than the capped amount of tuition / hostel fee and savings have been reported to be Rs.3.20 crore (Approximately).

(c) Representations have been received for removal of cap of Rs.10,000 p.m. on combined amount of tuition fee / hostel charges from some of the affected beneficiaries.

(d) & (e): The Government has decided to continue the educational concession without the cap of Rs.10,000 p.m.

These provisions regulates pay fixation on promotion, wherein an Officer has an option to get his pay fixed in the higher post either from the date of his promotion or from the date of next increment. Similarly, consequent upon implementation of ih CPC, the pay fixation on promotion from the date of promotion is regulated by Rule 12 of the Army Pay Rules 2017, Air Force Pay Rules 2017 and Navy Pay Regulations 2017 dated 3.5.2017 in respect of Officers and JCOs/OR equivalent. This methodology of fixation of pay on promotion to a post carrying duties and responsibilities of greater importance, of a Defence Services Personnel in case he opts for pay fixation from the Date of Next Increment (DNI) has been considered in this Department.

3. After due consideration in this matter, the following is decided as follows:

(i) A Defence Personnel, who is promoted or upgraded from one rank to another, subject to the fulfilment of the eligibility conditions as prescribed in the relevant Recruitment Rules, to another post carrying duties or responsibilities of greater importance than those attaching to the post held by him/her. Such, Defence Personnel may opt to have his/her pay fixed from the Date of his/her
Next Increment (either 1st July or 1st January, as the case may be) accruing in the Level of the post from which he/she is promoted, except in cases of appointment on deputation basis to an ex-cadre post or on direct recruitment basis or appointment/promotion on ad-hoc basis, as applicable in the Defence Services.

(ii) In case, consequent upon his/her promotion, the Defence Personnel opts to have his/her pay fixed from the date of his/her next increment (either 1st July or 1st January, as the case may be) in the Level of the post from which Defence Personnel is promoted, then, from the date of promotion till his/her  DNI, the Defence Personnel shall be placed at the next higher cell in the level of the post to which he/she is promoted.

(iii) Subsequently, on DNI in the level of the post to which Defence Personnel is promoted, his/her Pay will be re-fixed and two increments (one accrued on account of annual increment and the second accrued on account of promotion) may be granted in the Level from which the Defence Personnel is promoted and he/she shall be placed, at a Cell equal to the figure so arrived, in the Level of the post to which he/she is promoted; and if no such Cell is available in the Level to which he/she is promoted, he/she shall be placed at the next higher Cell in that Level.

(iv) In such cases where Defence Personnel opts to have his/her pay fixed from the date of his/her next increment in the Level of the post from which he/she is promoted, the next increment as well as Date of Next Increment (DNI) will be regulated accordingly.

4. It is further reiterated that in order to enable the officials to exercise the option within the time limit prescribed, the option clause for pay fixation on promotion with effect from date of promotion/ON I shall invariably be incorporated in the promotion/appointment order, as per applicability, so that there are no cases of delay in exercising the options due to administrative lapse.
5. This issues with the concurrence of Ministry of Finance vide their 1D No. 4-23/2017-IC/E.III (A) dated 22.3.2018.

Cap On educational Concession to Children of Missing/Disabled/Killed Soldiers Removed

Government has decided to continue educational concessions to the children of Armed Forces Officers/Personnel Below Officer Ranks (PBORs)/Missing/Disabled/ Killed in Action without the cap of Rs. 10,000 per month.

Ministry of Defence had persuaded the Finance Ministry twice in this regard, which is agreed upon by the latter.

The above educational concession will be admissible only for undertaking studies in a government/government aided schools/educational institutes, Military/Sainik Schools and other schools or colleges recognised by the Central or State Governments including the autonomous organisations financed entirely by the Central/State Governments.

Subject: Pay and allowances of Retired/Released Armed Forces Officers on re-Employment in the Armed Forces

Sir,
The pay fixation of re-employed officers on re-employment in Armed forces, is being done in accordance with this Department's letter No.1/69/2008/D(Pay/Services) dated 24 July 2009. Officers re-employed in Defence services after retirement have been excluded from the purview of the Army/Navy/Air Force Officers Pay Rules/Regulations, 2017 vide Rule 2 thereof. The question of extension of the benefit of the revised pay rules to these officers and the procedure to be followed for fixing their pay in the revised pay structure has been considered by the Government. The president is pleased to decide that the pay fixation in respect of the Officers who were in/came into re-employment on or after 1st January,2016 will be done in accordance with the provisions contained in this order. This order will cover all re-employed officers on re-employment in Armed Forces.

2. Exercise of Option: Re-employed officers who become eligible to elect revised pay structure in accordance with these orders should exercise their option in the manner laid down in Rule 5 and Rule 6 of the Army/Navy/Air Force Officers Pay Rules/Regulations, 2017,within one hundred and eighty days from the date of issue of these orders or in cases where the existing scales of pay of the posts held by them are revised subsequent to the issue of these within one hundred and eighty days of the date of such order. This facility of option is avilable to the re-employed officers who were re-employed before 1.1.2016 only.

Fixation / drawal of pay of Officers re-employed prior to 01.01.2016 and who were in re-employment as on 01.01.2016:

3. (a) The initial pay of a re-employed officer who elects or is deemed to have elected to be governed by the revised structure from the 1st day of January, 2016 shall be fixed in accordance with the provisions contained in Rule 7 of the Army/Navy/Air Force Officers Pay Rules/ Regulations, 2017. Revised Pension (excluding the ignorable portion of pension,if any), as admissible on relevant date of coming over to the revised pay structure,effective from 1.1.2016 or later, shall be deducted from his/her pay in accordance with the general policy of the Government on fixation and subsequent drawal of pay of re-employed Officers. Revised Military Service Pay and Dearness Allowance thereon shall be payable from 1.1.2016.

(b) In addition to the pay so fixed, the re-employed officer would continue to draw the retirement benefits he / she was permitted to draw in the pre-revised scales, as modified based on the recommendations of the Seventh Central Pay Commission, orders in respect of which have been issued separately by the Department of Ex-Servicemen Welfare.

(c) In the case of persons who were already on re-employment as on 01.01.2016, the pay may be fixed on the basis of these orders, with effect from the date of coming over to the new pay structure, i.e. 01.01.2016 or later, as per the option exercised by them in terms of para 2 above. In such cases, their term would be determined afresh as if they have been re-employed for the first time from such date of coming over to the new Pay Structure.

4. Officers Re-employed on or after 01-01-2016
Officers who are re-employed on or after 1-1-2016 shall be allowed to draw pay only in the revised Pay Structure.

(a) Officers who Retired from pre-revised scales of pay and were re-employed in the Revised Pay Structure.
The initial pay shall be fixed in the revised pay structure in accordance with Rule 7 of Army/Navy/Air Force Officers Pay Rules/Regulation 2017 read with para 5 below, with reference to the rank held at the time of retirement. Military Service Pay and Dearness Allowance thereon shall be payable from 1-1-2016. However, an amount equivalent to the revised pension (excluding the ignorable portion of pension) effective from 1-1-2016 or after shall be deducted from his pay so fixed in accordance with the general policy of the Govt on fixation of pay of re-employed officers.

(b) Officers who retired and are re-employed in the Revised Scale of pay.

The initial pay in the Level (read with Para 5 below) shall be fixed at the same cell in the Level as the last pay drawn. Military Service Pay and Dearness Allowance thereon shall be payable from 1-1-2016. Having fixed the Pay in the manner indicated, an amount equivalent to the revised pension (excluding the ignorable portion of pension) effective from 1-1-2016 or after shall be deducted from his pay so fixed in accordance with the general policy of the Govt on fixation of pay of re-employed officers.

5. Pay in the Level. In the case of retired Armed Forces Officers (a) who were re-employed before 01.01.2016 (b) who retired from pre-revised pay scales and were re-employed on or after 01.01.2016 in the revised pay structure, and (c) who retired and are re-employed in the revised pay structure, on their re-employment in the Armed Forces, the pay of the officers will be fixed by granting them the pay in the Level of the rank held by them at the time of their retirement or Level of Colonel (Time Scale)'s pay whichever is lower.

Ignorable part of Pension

6. The President is also pleased to enhance the ignorable part of pension from Rs. 4000/- to Rs.15,000/- (Rupees Fifteen Thousand only) in the case of Commissioned Service Officers who retire before attaining the age of 55 years. The existing limits of military pensions to be ignored in fixing the pay of re-employed Officers will therefore, cease to be applicable to cases of such Officers who are re-employed on or after 1-1-2016. As Brigadiers retire at the age of 56 years they will not be eligible for ignorable portion of pension.

Drawal of increments

7. Once the initial pay of the re-employed officer has been fixed in the manner indicated above, he will be allowed to draw normal increments as per the provisions of Rule 9 and 10 of Army/ / Air Force/ Navy Officers Pay Rules/ Regulations, 2017.

8. Further, the existing ceiling of Rs. 80,000/- for drawal of pay plus gross pension on reemployment is enhanced to Rs.2,25,000/-, i.e. the pay plus MSP @Rs.15,500/- plus gross pension should not exceed the ceiling of Rs.2,25,000 pm, the maximum basic pay prescribed for officers in Level 17 under Army/Navy/Air Force Officers Pay Rules/Regulations, 2017.

9. Allowances: The drawal of various allowances and other benefits in the revised structure based on pay shall be regulated with reference to pay that is fixed on re-employment. Pay for these allowances will be the pay fixed before deducting the pension.

10. Gratuity/Death cum Retirement Gratuity - The re-employed officers shall not be eligible for any gratuity/Death cum Retirement Gratuity for the period of re-employment.

11. Some illustrations to cater for pay fixation in various situations arising are given in Appendix 'A' to this letter.

12. These Orders shall take effect from 1.1.2016. These Orders supersede the existing orders on the subject.

13. An undertaking may be obtained from re-employed officers who opt / are deemed to have opted for the revised pay structure to the effect that, they understand and agree that the special dispensation provided through this order is subject to the condition of deduction of pension as admissible to them from time to time, where ever required as per extant instructions and also to recovery in case of over-payment made, if any.

14. This letter issues with the approval of Department of Personnel & Training vide their ID Note No. 1279783/2017-Estt.(Pay-II) dated 12.12.2017 and concurrence of Ministry of Defence (Finance) vide their ID Note No.3(16)/08-AG/389-PA, dated 05-01-2018.

Raksha Mantri Issues Orders on Matter of Equivalence with Respect to Armed Forces and AFHQ CS Officers

Raksha Mantri Smt Nirmala Sitharaman has issued the following orders with immediate effect:-

Ministry of Defence letter dated 18 October 2016 on the issue of equivalence between Armed Forces Officers and Armed Forces Headquarters Civil Services (AFHQ CS)Officers is withdrawn.
The cadre restructuring of AFHQ CS as approved by the Union Cabinet shall be duly implemented. Designations to be created in consequence of the additional posts sanctioned by the Cabinet will be done in consultation with Service HQs. Local designations assigned both Service and Civilian Officers in Service Headquarters/InterService Organisations (ISOs) is hereby withdrawn. Both Service and Civilian Officers will use their respective cadre designations only.

So far as the Channel of reporting/rendition of Annual Performance Appraisal Report (APAR) is concerned, status quo ante is hereby restored, i.e., the position which existed prior to the issue of MoD letter dated 18 October 2016 shall prevail.

This is for strict compliance by all concerned.

Subject: Revision of rates of Non Practicing Allowance (NPA) to the officers of Armed Forces Medical Services consequent on acceptance of recommendations of 7th Central Pay Commission.

Sir,
I am directed to refer to Department of Expenditure, Ministry of Finance’s Resolution No.11-1/2016-IC dated 6th July, 2017 and OM No 12- 2/2016-EIII.A dated 7th July, 2017 and to convey the sanction of the President of India for the grant of Non Practicing Allowance (NPA) to the officers of Directorate General of Armed Forces Medical Services which shall now be paid at the rate of 20% of the basic pay in the revised pay structure in vogue based on the recommendations of 7th CPC, subject to the condition that the sum of the basic pay, Military Service Pay (MSP) and NPA does not exceed Rs.2,37,500 (Rupees two Lakh thirty seven thousand and five hundred only). The following conditions shall regulate the grant of NPA under these orders:

(i) The term ‘basic pay’ in the revised pay structure shall mean "basic pay" in Army/Navy/Air Force Officers Pay Rules/Regulations, 2017, i.e., "basic pay" in revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix.

(ii) The NPA shall continue to be treated as pay for the purpose of computation of Dearness Allowances, pension and other allowances, except those allowance in respect of which the applicable orders provide otherwise, including calculation of retirement benefits. Dearness Allowance under these orders shall mean dearness allowance as sanctioned by the Central Government from time to time in the 7th Pay Commission - related pay structure.

(iii) As per provision in relevant Rules of Army/Navy/Air Force Officers Pay Rules/Regulation,2017, NPA shall not be calculated on MSP.

(iv) NPA shall continue to be restricted to those medical posts for which medical qualifications recognized under the Indian Medical Council Act, 1956 or under the Dentist Act, 1948 have been prescribed as an essential qualification. The following conditions shall also be fulfilled as hitherto:

(a) The post is a clinical one.
(b) The Post is a whole time post.
(c) There is ample scope for private practice, and
(d) It is necessary to prohibit private practice in public interest.

2. The revised rates of NPA in terms of these orders shall take effect from 1st July,2017.

3. This issues with the concurrence of Ministry of Defence (Finance) vide UO No.3(01)/2017/AG/289-PA dated 19.09.2017.

Message Regarding 7 CPC

1. "GoI, MoD has extended sanction of Operation Rhino for a further period of 3 months with effect from 15/06/2017 to 14/09/2017 or till the termination of Op Rhino whichever is earlier". Units may publish Part II orders accordingly.

2. "Govt orders have been received vide SRO No 17(E) dated 06/07/2017 notified in Gazette of India No 14 dated 07/07/2017 and acted upon in Aug 2017. As per the orders, index of rationalization (IOR) of level 12A & 13 of the Defence Pay Matrix has been enhanced from 2.57 to 2.67 for the entry level Pay but the multiplication factor is retained as 2.57. In some cases pay fixed on 01/01/2016 as per revised Pay matrix would be less than that fixed earlier as per SRO 12(E) dated 03/05/2017, leading to recovery in August 2017 pay account. A few examples are cited at Annexure "A".

Subject: Eligibility of widowed/divorced daughter for grant of Family Pension clarification.

The undersigned is directed to state that the provision for grant of family pension to a widowed/divorced daughter beyond the age of 25 years has been made vide GoI, Ministry of personnel, P.C. & Pensions, Department of Pension & Pensioners Welfare 0M No.1/19/03-(E) dated 2S.08.2004 Circulated vide GoI MOD letter No.878/A/D(Pen/Sers)/04 dated 21.09.2004 applying the same provision to the Armed Force Personnel.

2. It was clarified vide Government of India, Ministry of Personnel, P.G- & Pensions, Department of Pension & Pensioners Welfare OM No.1/13/09-P&PW (E) dated 11.09.2013 circulated vide MOD ID No.1(9)/2013/D(Pen/Pol) dated 16.09.2015, the family pension is payable to the children as they are considered to be dependent on the Government servant/pensioner or his/her spouse. A child who is not earning equal to or more than the sum of minimum family pension and dearness relief thereon is considered to be dependent on his/her parents. Therefore, only those children who are dependent and meet other conditions of eligibility for family pension at the time of death of the Government servant or his/her spouse, whichever is later, are eligible for family pension. If two or more children are eligible for family pension at that time, family pension will be payable to each child on his/her turn provided he/she is still eligible for family pension when the turn come. Accordingly, divorced daughters who fulfil other conditions are eligible for family pension if a decree of divorce had been issued by the competent court during the life time of at least one of the parents.

3. Grievances were being received from various quarters that the divorce proceedings are a long drawn procedure which take many years before attaining finality. There are many cases in which the divorce proceedings of a daughter of Government employee/pensioner had been instituted in the competent court during the life of one or both Government employee/pensioner & spouse, but none of them was alive by the time the decree of divorce was granted by the competent authority.

4. The matter has been examined in this department and it has been decided that the clarification “grant family pension to a divorced daughter in such cases where the divorce proceedings had been filed tn a competent court during the life time of the employee/pensioner or his/her spouse but divorce took place after their death-provided the claimant fulfils all other conditions for grant of family pension. In such cases, the family pension will commence from the date of divorce” given by Government of India. Ministry of Personnel, P.G. & Pensions’, Department of Pension & Pensioners Welfare vide 0M No.1/13/09- P&PW (E) dated 19.07.2017 would also apply mutatis mutandis to divorced daughters of Armed Force personnel.

5. This issues with the concurrence ofthe Finance Division of this Ministry vide their ID No.10(09)/2015/Fin/Pen dated 17.10.2017.

The Fest was an amalgamation of varied programmes highlighting the rich culture of different regions of India and stalls of food, entertainment and games for people of all the age groups to rejoice & cherish. The event also encompassed display of various ethnic specialities from across the country.
Students from various schools of Kishtwar district & professional artists from other parts of the country participated in the event to showcase their talent and performed folk dances of Rajasthani, Punjabi & Kashmiri culture. Kalbeliya, Gatka, Bhangra and an electrifying performance by the rock band were the highlights of the day. Stalls manifesting the talent of ITI and paintings, clay models were praiseworthy and the preponderant performance of the local youth of Kishtwar was highly commendable. Over 8000 people from all sections of society witnessed the event.

The event was graced by officials of Army, civil administration, Police, CAPF and other civil dignitaries. The youth & spectators quoted that the fest was an enlightening & enriching experience that has surely changed their perspective towards contributing to a peaceful & harmonious tomorrow.
Speaking on the occasion, the GOC, Delta Force expressed his gratitude to civil administration & local populace for their whole hearted support and enthusiastic participation in making the event a grand success. He emphasized that close coordination between civil administration and Army will take Chenab Valley towards meaningful progressive growth. The overwhelming response of youth in such events will send the message of peace & unity in the region, he added.

Diwali Gift to the Soldiers of the Country

Soldiers and officers of various army and para-military units like CRPF, BSF, BRO, ITBP, etc. are deployed in remote and far flung areas to protect Borders of India. The soldiers and officers are working day and night without bothering about difficult weather conditions and as they are posted away from their homes and headquarters, there is a constant requirement for them to speak to their family and also to their Headquarters. They use only DSPT service provided by BSNL because there is no other means of communications available in those areas.

Briefing the media here, the Minister of Communications Shri Manoj Sinha said that in order to use the facility of DSPT, the soldiers & officers at present are required to pay monthly fee of Rs.500/- and call charges of Rs.5/- per minute. But, looking at the requirement of Soldiers & Officers and also the heavy cost they have to incur for talking to their family members, government has taken an important decision on the auspicious occasion of Diwali. Shri Sinha said, from Diwali day (19th October, 2017), no monthly fee will be taken for using DSPT service, that is, the current monthly fee of Rs.500/- will be ‘Zero’ from tomorrow. And also, the present telephone charges of Rs.5/- per minute is being reduced to Re.1/- per minute.

With this special Diwali Gift from Government of India, Defence personnel can now talk without worrying for more expenses to their home and their Headquarter. The Minister also wished the jawans and officers and their family members A Very Happy Diwali.

Smt. Nirmala Sitharaman took over charge as Defence Minister, here today. On her arrival at the Ministry of Defence in South Block, Smt. Sitharaman was received by outgoing Defence Minister Shri Arun Jaitley, Minister of State for Defence Dr. Subhash Bhamre, Defence Secretary Shri Sanjay Mitra, Defence Secretary (Defence Production) Shri AK Gupta, Chairman DRDO & Secretary Department of Defence R&D Dr. S Christopher and other senior officials. Smt Sitharaman is the first full time Woman Defence Minister of India. Immediately after assuming office, the Defence Minister approved a grant of over Rs 13 crore which will be released for 8685 ex-servicemen, widows and dependants out of the Armed Forces Flag Day Fund. She also approved financial assistance out of Raksha Mantri Ex-Servicemen Fund.
