Subject:- Provision of Invalid Pension to Armed Forces Personnel before completion of 10 years of qualifying service - reg.

Government of India, Ministry of Defence, D(Pension/Policy) vide their letter no. 12(6)/2019/D(Pen/Pol) dated 16.07.2020 has issued order on the above subject. Copy of the same is forwarded herewith for information and further necessary action.

2. The provision of this circular shall apply to those Armed Forces Personnel who were/are in service on or after 04.01.2019. The cases in respect of personnel who were invalided out from service before 04.01.2019 will not be re-opened.

Subject: Implementation of the Government decision on the recommendation of the Seventh Central Pay Commission – in respect of Service Pension to the Havildar granted Honorary Rank of Naib Subedar retiring on or after 01.01.2016.

Reference: Circular No. 584 dated 07.09.2017.

Reference is invited towards this office Circular No. 584 dated 07.09.2017. In this circular orders and procedure of pensionary award of 7th CPC were circulated with LPCs & its filling instructions. But the Circular is silent in respect of service pension of Havildar granted Hony Rank of Naib Subedar. A clarification was sought for regarding applicability of MoD letter dated 12.06.2009 for post 2016 retirees. It has now been clarified by the competent authority that ibid MoD letter is also applicable to post-2016 retirees Havildar granted Honorary rank of Naib Subedar.

2. Now, it has been decided that in all such cases the field SI No. 93 (Field name-Average Pay) of LPC-Cum Data Sheet of Circular No. 584 dt 07.09.2017 is invariably to be filled with Notional Pay of Havildar granted Hony. Naib Subedar fixed in Level-6 for Pension purpose only.

3. All other terms and condition shall be applied as per various paras of this govt. order as well as the existing provisions on the issue.

4 This circular is applicable in respect of service pension to the Havildar granted Honorary Rank of Naib Subedar retiring on or after 01.01.2016.

Sub:- Revision of pension wef 01.01.2006 of Pre-2006 pensioners who retired from the 5th CPC scale of Rs. 6500- 10500/- or equivalent pay scale in the earlier Pay Commission periods.

Ref: -This office Important Circular No.195, dated 04.02.2019.

Attention is invited to this office circular No. C-195 dt. 04.02.2019 under which instruction has been issued to PDA for revision of pension/family pension wef 01.01.2006, consequent on the decision issued by GOI DP&PW vide OM No.38/33/12- P&PW (A) dated 04.01.2019 to consider the Grade Pay Rs. 4600 as the corresponding Grade pay in the case of Pre-2006 pensioners who retired/died in the 5th CPC scale of Rs. 6500-10500/- or equivalent pay scale in the earlier Pay Commission periods.

2. For revision of pension/family pension w.e.f. 01.01.2016 of pre-2016 pensioners by notional fixation of pay in the 7th CPC Department of P&PW has issued concordance tables vide OM F. No. 38/37/2016-P&PW (A) dated 06.07.2017. Tables No. 24 & 25 in these concordance tables indicated the revised pension/family pension based on the corresponding 6th CPC grade pay of Rs. 4200/- in respect of pre-2006 pensioners/family pensioners who retired/died in the 5th CPC scale of Rs 6500-10500/-or equivalent pay scale in the earlier Pay Commission periods. Consequent on the decision to consider the Grade Pay of Rs. 4600/- in above cases, revised tables No. 24 & 25 have been issued vide DP&PW OM No. 38/33/12-P&PW (A) dt.09.07.2019 (copy enclosed).

3. For implementation of above OM dt.09.07.2019, you are requested to issue instructions to sub offices under your administrative control to submit the revised LPC-cum-data sheet in affected cases, as procedure prescribed in this office circular No. C-164 dated 30.05.2018, so that corrigendum PPOs for the same may be issued at the earliest.

Representations are being received from various Pension Disbursing Agencies(PDAs) seeking clarification as to from which date payment of additional quantum of pension to the armed forces service pensioners on attaining age of 80 years and above will be paid in cases where age shown in the PPO varies with the exact date of birth mentioned in the office records (i.e original discharge certificate).
The issue has been examined and it is noticed that in all old cases, there was a practice of mentioning the age of armed forces personnel instead of date of birth (though the date of birth was mentioned in LPC cum data sheet provided by the records offices). It is also noticed in some cases that age mentioned in the PPO differs from the date of birth/age mentioned in the LPC cum data sheet due to late submission of claim by ROs/HOOs and late notification of PPO as well.

Accordingly, it has been decided that in all such cases where pensioner is not satisfied or PDA is not sure regarding date of commencement of additional pension, the cases may be referred to this office through ROs/HOOs' concerned for issuing Corr. PPO for making necessary amendment.

1. Refer to Central Organisation ECHS letter No B/ 49701-PR /AG/ ECHS/ 2017 dated 27 Sep 2017 and 8/49701-PR/ AG/ ECHS/ 2017 dt 16 Nov 2017(Not to all).

2. A policy on eligibility criteria for ECHS membership was promulgated vide letters under reference. The following documents are required to be produced by the ESM for all dependants above 18 years of age (except spouse) at the time of collection of their Cards:-

(a) Self attested copy of PAN Card.
(b) Self attested copy of Form 26AS for the last two financial years.

3. In case the documents given at Para 2(a) & (b) can not be produced by the ESM, then he will have to furnish a self attested certificate for dependant above 18 Years of age. Specimen proforma is attached as Appx 'A'.

4. In case of income of dependents above 18 years of age (except spouse) is more than Rs 9000/ - from all sources (excluding DA) per month, then the ECHS Cards for such dependants will not be handed over to the beneficiary/ ESM. Such Cards will be destroyed by a board of officers every month and record be maintained at the Station HQ's. Details of such destruction be forwarded to Regional Centre concerned, Central Organization, ECHS and M/ S Source Dot Com Private Limited. Cases will be intiated in such cases for cancellation of cards permanently.

5. It is further reiterated that the Cards of all dependants will be blocked automatically by the system on completion of one year. The ESM will have to submit an online self declaration certificate by using his login credentials. A specimen ECHS self attested certificate for dependant above 18 years of age is attached as Appx 'B'. The fields marked as 'A' will be auto populated and in the balance fields the beneficiary will have to upload the required certificate/ enter details. This renewal facility will be available one month in advance from completion of one year from the date of issue of Card/ last renewal.

A reference was received from General Manager, East Central Railway seeking approval for hiring of ex-Army personnel as AC coach attendants.

The issue has been deliberated upon and the Board (MS, FC & CRB) has approved the following:
  • The issue is of hiring through contract of ex-Armymen for ACCA. Zonal Railways can do the same by framing the contract conditions accordingly. There is no specific need for approval of Railway Board for this.
  • This can be done where the posts are vacant against sanctioned strength only. This issues with the concurrence of the Associate Finance of the Transformation Cell.

With reference to Gol, MoD letter No 22(1)/01/US(WE)/D(Res) dated 30 Dec 2002 and Gol, MoD letter No. 24(8)/03/US(WE)/D(Res) dated 19 Dec 2003 and in light of M/o Health and Family Welfare order No. Z.15025/ 38/ 2018/ DIR/ CGHS/ EHS dated 22nd May 2018 and No. Z15025/ 51/ 2018/ DIR/ CGHS/ EHS dated 6-6-2018, partial amendments are hereby made to the procedure for payment and reimbursement of medical expenses under ECHS with relaxation of rules for consideration of reimbursement in excess of the approved rates as per the details given under the succeeding paragraphs.

2. The request for full reimbursement which fall under the defined criteria indicated in para 3 below and cases indicated in para 4 below shall be examined by a High Powered Committee whose constitution is indicated in para 5 below. After recommendation of HPC, the concurrence of MoD (Finance/Pension) and approval of Secretary, ESW will be required in all these cases.

3. The request for full reimbursement which fall under the following defined criteria would be considered by the High Powered Committee.
  • Treatment was obtained in non empanelled hospital under emergency condition and the patient was admitted by others when the beneficiary was unconscious or severely incapacitated and was hospitalized for a prolonged period.
  • Treatment was obtained in non empanelled hospital under emergency and was admitted for prolonged period for treatment of head injury, coma, septicaemia, multiorgan failure etc.
  • Treatment was obtained in non empanelled hospital under emergency and was admitted for prolonged period for treatment of head injury, coma, septicaemia, multiorgan failure etc.
  • Treatment was obtained in a non empanelled hospital under emergency for treatment of advanced malignancy.
  • Treatment was taken under emergency in a higher type of accommodation as rooms as per his/her entitlement were not available during that period.
  • Treatment was taken in higher type of accommodation under specific conditions for isolation of patients to avoid contacting infections.
  • Treatment was obtained in a non-empanelled hospital under emergency when there was a strike in Govt. Hospitals.
4. Cases falling in the following categories would also be considered by the High Powered Committee.
  • Settlements of medical claims in relaxation of rules.
  • Approval of air fare with or without attendant on the advice of the treating doctor, for treatment in another city even though he/she is not eligible for air travel/treatment facilities are available in city of residences.
  • Representation from ECHS beneficiaries seeking full reimbursement under special circumstances, which are not covered under para 3 above
5. Composition of the High Powered Committee would be as follows :
  • JS, ESW - Chairman
  • Government Hospital Specialist Doctor (of concerned speciality) - Member
  • Director/DS/US, DoESW - Member
  • Director(Medical), CO, ECHS - Member-Secretary
  • Representative of MoD(Fin/Pen) - Member
6.. The other terms and conditions mentioned in the procedure for payment and reimbursement of medical expenses under ECHS vide Gol, MoD letter No.24(8)/03/US(WE)/D(Res) dated 19 Dec. 2003 shall remain unchanged.

7. This has the concurrence of Ministry of Defence(Finance/Pension) vide their U.O. No32(23)/2018/Fin/Pen dated 3-1-2019.

OROP: 99% pensioners will get benefits by January-end, says Manohar Parrikar

Defence Minster Manohar Parrikar on Tuesday said that around 20 lakh pensioners have been paid the benefits of One Rank One Pension (Orop) so far, and more than 99 percent of cases will be settled by January-end.

New Delhi: Defence Minster Manohar Parrikar on Tuesday said that around 20 lakh pensioners have been paid the benefits of One Rank One Pension (Orop) so far, and more than 99 percent of cases will be settled by January-end.

"So far, we have already paid the benefits to more than 19,70,000 pensioners. Around 68,000 pension cases were in scrutiny in December. The targeted time schedule was end of December and 13,000 cases are sent to pension dispersing authority," Parrikar said at a press conference.

"With that I think almost 99 percent of the eligible cases will be settled probably by January. One percent is not being able to trace them, probably dead," the minister said.

Parrikar said he has "instructed all the agencies to go and find out such cases".

"Rs 6,300 crore has already been dispersed as arrears and the current payments are ongoing for the current period. Total back arrears will be around Rs 10,800 crore of which Rs 6,300 crore has been disbursed," he said.

Orop for retired armed forces personnel was announced on 5 September, 2015.

The scheme took 2013 as the base year to calculate pensions and date of implementation was 1 July, 2014. The period for review was kept at five years.

PIL seeks review of One Rank One Pension (OROP) scheme

A plea filed in the Delhi High Court has asked for the ‘One Rank, One Pension’ scheme to be reviewed and a public hearing to take note of the grievances of ex-servicemen.

Chief Justice G. Rohini and Justice Jayant Nath have now ordered for the PIL to be listed before another Bench on Thursday.

The PIL has also sought extension of the term of the one-man commission of L. Narasimha Reddy, who was former Chief Justice of the Patna High Court. The Commission was instituted to review the ‘One Rank, One Pension’ scheme after several veterans of the Army objected to it.

Filed by ex-serviceman S.P. Singh, the PIL sought directions to the Ministry of Defence (MoD) and the Commission “to give an effective public hearing to those affected or aggrieved by implementation of One Rank One Pension (OROP)”.

According to the petition, a letter from the Ministry of Defence dated April 13, 2016, said: “Defence Forces pensioners/family pensioners, Defence Pensioners’ Associations can submit their representation, suggestions/views on the revised pension as notified, to the MoD, through post or by email within 15 days i.e. by April 29, 2016”.

‘Notice not published’

The petitioner also claimed that the notice was not published in newspapers, as a result of which most people did not know about it. It also said that the time given to submit grievances and suggestions was very little, and that asking those the scheme will affect to forward their grievances to the Ministry was “unfair and in violation of principles of natural justice”.

It also said that the mechanism for consultation only allowed written representations, which violated “the basic concept of effective hearing”.

The petition also said that the Central government did not provide the address and contact information of the Commission despite “repeated requests”, due to which those affected by the scheme would not be able to put their objections before it ahead of the mid-June deadline.

An ex-servicemen from Hyderabad used the RTI act in order to get his due. As per the state government all ex-servicemen/widows are exempted from paying property tax for any one house owned by them.
An Ex-Serviceman had to struggle for 9 long years with the civic authorities to get exemption from property tax. After repeated failures to get his due, he used the RTI act and woke up the civic authorities from their slumber.
This is the story of an ex-serviceman who had to struggle with the civic authorities for 9 long years to get his due. Mr. PP Sebastian worked in the Indian Air Force and is now settled in Hyderabad. He had to run after the local municipal authorities for 9 long years to get his property tax exemption order.

The Background Story

Most state governments extend a variety of welfare measures for serving personnel and ex-servicemen. The erstwhile Andhra Pradesh Government also extended similar facilities to ex-servicemen. As per the orders of the erstwhile Andhra Pradesh State government, all serving army personnel and ex-servicemen/widows are exempted from paying property tax for any one house owned by them.
18. Exemption from property tax one house/property of Ex-Servicemen/widows/serving personnel when it is occupied by the Widows/Ex-Servicemen and by the family in case of serving personnel for their self dwelling purpose.
Application for exemption filed in 2006

Mr. Sebastian applied for property tax exemption in October 2006 in accordance to the Government Order. He submitted his application to Alwal Municipality, duly submitting all the required certificates. Instead of granting him exemption, the civic authorities kept sending him property tax bills. Moreover, the ex-serviceman received threatening calls to clear his dues
This is to bring to your kind notice that, I am ex-serviceman and had applied for tax exemption on 23rd October, 2006 as per the regulation after paying tax twice. I am yet to receive my tax exemption papers from your end.
Instead I have been receiving property tax bill every year. I had approached 4 to 5 times pertaining to my tax exemption as soon as the receipt of the property tax bill. But I have received no reply from Alwal Municipality so far.
RTI to the Rescue

Meanwhile in 2007, the Alwal Municipality was merged into the Greater Hyderabad Municipal Corporation (GHMC). After repeated trials to know the status of his earlier application, Mr. Sebastian was exhausted and was resigned to his fate.

In early 2013, Mr. Sebastian came to know of Right to Information (RTI) through an awareness workshop. As soon as he realized its power, he filed an application under RTI with the GHMC authorities to know the status of his earlier request for property tax exemption.

After repeated follow-ups and intervention from the State Information Commission, the GHMC finally admitted that they had lost his application that was filed in 2006. They also requested Mr. Sebastian to submit all the documents once again to initiate further action.
With reference to subject cited, it is to inform that the application related to Exemption of Property Tax pertains to——– situated at Temple Alwal was given in erstwhile Alwal Municipality on 23.10.2006. Efforts were made to trace out the application, but the same is not traced out. Therfore, you are requested to kindly submit the required documents for taking further necessary action for exemption of property tax of above said property.
Finally, after submitting the application once again, the GHMC issued the property tax exemption order in December 2015.
ORDER:
In exercise of the powers conferred as per the M.C.H Act 1955 and in accordance with the Government Orders, Vide Ref 2nd cited the following Property (Assessment) is hereby temporarily exempted from the payment of Property tax with effect from 01.04.2007 till further orders, since the under mentioned premises are under the possession of Ex-Serviceman/ Widow of Ex-Serviceman/Serving Army Personnel.

Ref: This office circular No. 540 dated 11/05/2015.

Under the existing orders, claims for service pension in respect of personnel below officer rank are required to be submitted to the pension sanctioning authority concerned, viz. PCDA (P), Allahabad in respect of Army, PCDA (N), Mumbai in respect of Navy and JCDA (AF), New Delhi in respect of Air Force, at least four months in advance of their retirement from service. This arrangement has been made with a view to ensure that the pensionary awards in respect of the personnel are notified in the PPO well before their discharge/retirement and the pension certificates are handed over to them before they are discharged.

It has been observed that above time schedule is not being adhered to by ROs resulting in delay in finalization of pensionary awards in respect of PBORs. Higher authorities have taken a serious view on the matter.

It is, therefore, requested that time frame for submission of pension claims to this office may strictly be followed in order to avoid delay in finalization of pensionary awards to the retiring personnel. This would definitely help in reducing the CAT/Court cases, interest payment etc at a later stage.

Subject: Grant of Fixed Medical Allowance (FMA) to the Armed Forces Pensioners/ Family Pensioners in such cases where date of retirement is prior to 01.04.2003 and who had opted not to avail medical facilities at OPD of Armed Forces Hospitals/ MI Rooms and are not member of ECHS.

Reference: This Office Circular NO.451 dated 21.02.2011 and Circular NO. 208 dated 27.07.1998.
A copy of GOI, MOD letter NO. 1(10)/2009-D(Pen/ Policy) dated 5th May 2015 is forwarded herewith for immediate implementation. The same has also been uploaded on this Office website www.pcdapension.nic.in and may please be downloaded at your end without waiting for the hard copy Of the order and action may be taken accordingly.

2. The fixed medical allowance has been enhanced from Rs. 300/- PM to Rs. 500/- PM with effect from 19.11.2014. Ex Servicemen who retired after 01.04.2003 have to become member of ECHS compulsorily and are not eligible to draw Fixed Medical Allowance. However, all Pre 01.04.2003 retirees have the Option of either joining the Scheme or draw Fixed Medical Allowance as per the extant rates.

3. The other conditions for grant of Fixed Medical Allowance as mentioned in this Office Circular No. 208 quoted under reference shall continue to be in force. PDAS are requested to please review the cases and revise the Fixed Medical Allowance in the affected cases accordingly.

PCDA circular: Grant of Family Pension and gratuity

Subject: – Grant of Family Pension and gratuity to the eligible member of the family of an employee/pensioner/family pensioner reported missing-consolidated instructions regarding.

Reference: – This office Circular No. 498 dated 08.08.2013.

A copy of Govt. of India, Ministry of Defence letter No 1(1)/2010-D(Pension/Policy) dated 23.12.2014 is reproduced wherein it has now been decided to issue consolidated instructions in supersession of previous instructions by various Govt. letters as mentioned in Para-1 of ibid Govt. letter regarding grant of family pension to the eligible members of family of the Armed Forces Personnel/Pensioner/Family pensioner reported missing and whose whereabouts are not known.  It includes those kidnapped by insurgents /terrorists but does not include those who disappear after committing frauds Icrime/desertion etc.

2. In the case of a missing Armed Forces Personnel/ Pensioner/Family pensioner, the family can apply for the grant of family pension, amount of salary due, leave encashment due and the amount of DSOP/AFPP fund and gratuity (whatever has not already been received) to the IHQ / Record Office concerned, where the officers and JCOs/ORs in Army and equivalent in Navy and Air Force, had last served, six month after lodging of police report. The family pension and/or retirement gratuity may be sanctioned by the respective Pension Sanctioning Authorities (PSAs) after observing the following formalities:-
(i) The family must lodge a report with the concerned Police station and obtain a report from the police that the Armed Forces Personnel/ Pensioner/ Family pensioner has not been traced despite all efforts made by them. The report may be a First Information Report or any other report such as a Daily Diary/General Diary Entry, filed by the Police authorities concerned, as per the practice prevalent in the state/ UT.

(ii) An Indemnity Bond should be taken from the nominee/dependents of the Armed Forces Personnel/ Pensioner /Family pensioner that all the payments will be adjusted against the payments due to the Armed Forces Personnel/Pensioner /Family pensioner in case she/he appears on the scene and makes any claim.

3. In the case of a missing Armed Forces Personnel, the family pension, at the ordinary or enhanced rate, as applicable, will accrue from the expiry of leave or the date upto which pay and allowances have been paid or the date of the police report, whichever is later. In the case of a missing pensioner/family pensioner, it will accrue from the date of the police report or from the date immediately succeeding the date till which pension/family pension had been paid, whichever is later.

4. The retirement gratuity will be paid to the family within three months of the date of application. In case of any delay, the interest shall be paid at the applicable rates and responsibility for delay shall be fixed. The difference between the death gratuity and retirement gratuity shall be payable after the death of the employee is conclusively established or on the expiry of the period of seven years from the date of the police report.

5- Before sanctioning the payment of gratuity, Service HQrs/ Record Office will assess all Government dues outstanding against the employee/pensioner and affect their recovery in accordance with instruction in force.

6. The amount of salary due, leave encashment due and the amount of DSOP/AFPP fund will be paid to the family in the first instance as per the nominations made by the Armed Forces Personnel/ Pensioner on filing of a Police report and submission of an indemnity bond as indicated above.

7- The benefits to be sanctioned to the family/nominee of the missing Armed Forces Personnel/ Pensioner will be based on and regulated by the emoluments drawn by him/her as on the last date he/she was on duty including authorised periods of leave.

8. Formats of separate Indemnity Bonds to be used in the case of missing Armed Forces Personnel, missing pensioners and missing family pensioners are available at the official website of PCDA (Pensions) Allahabad i.e. www.pcdapensionnic.in.
