Enclosed is a copy of DOP&T’s OM No.11013/9/ 2014-Esttt.A-IIT dated 23.04.2020 regarding attendance of Officers / Staff during the lockdown period.

2. Attention in this connection is invited to para 3 of Office Order No. 25 of 2020 and also para 2 of DOP&T’s enclosed OM for following the extant instructions in letter and spirit. While preparing the roster /asking Officials below Deputy Secretary level for reporting to Office, the guiding principle should be that only upto 33% Officials and depending on the requirement be called for working from Office and all others who are not being called at Office or are residing at Containment Zones should work from home and be available at all times on Mobile phones and other Electronic means of Communications. Officials below Deputy Secretary level should not regularly be called to avoid crowding in the Office, except in case of exigencies of work.

3. Further, Officials may be called at staggered timings as stated in para 3 of the enclosed DOPT’s OM.

4. Based on above, if required, separate rosters may be prepared by all controlling Head of the Directorates (PEDs & EDs).

Sub:- Discontinuation of Direct Recruitment to the posts of Senior Section Engineers (SSEs).

Attention is invited to Board's letter No. E(NG)I/2008/PM1/15 dated 03.09.2009 which inter alia lays down that 20% of the vacancies in Group 'C' posts of Senior Section Engineer(SSE) in Civil Engineering, Electrical, Mechanical, Signal & Telecom and Track Machine Organization (TMO) Departments will be filled by direct recruitment.

This provision of direct recruitment in the post of SSEs has since been reviewed by Board. It has been decided to provisionally discontinue direct recruitment in the post of SSEs. This decision will be reviewed after one year. Therefore, all direct recruitment in all technical supervisory categories for the present be only in the post of Junior Engineers (JEs). Vacancies of SSEs may accordingly be added to those of Junior Engineers (JEs) for the purpose of direct recruitment.

Sub: Revision of advance reservation period for running of Suvidha trains and special trains on special charges.

In continuation of above instructions, Ministry of Railways have decided that the currency of above instructions regarding revision of Advance Reservation Period for running of all Suvidha Trains and Special Trains on Special Charges to 120 Days and applicability of normal refund rule even in Suvidha Trains shall be extended for another period of one year i.e. from 15.7.2018 to 14.07.2019.

2. Zonal Railways may review the scheme on held yearly basis to assess the effectiveness of the scheme.

3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Kindly refer to this Ministry’s letter of even number dated 06.01.2016 (RBE No. 1/2016) stipulating extension of the currency of relaxation of age limit of 5 years in favour of the residents of State of Jammu & Kashmir for appointment to Central Civil Services and posts, recruitment to which are made to UPSC/SSC or otherwise by the Central Government up to 31/12/2017.

2. Department of Personnel & Training have issued a further notifications No. 15012/1/2014-Estt(D) dated 09.02.2018 and accordingly age relaxation of 5 years in the upper age limit to all persons who had ordinarily been domiciled in the State of Jammu & Kashmir during the period from the 1st day of January, 1980 to the 31st day of December, 1989 for appointment to Central Civil Services and posts, recruitment to which are made through UPSC or SSC or otherwise by the Central Government, stands extended up to 31/12/2019.

3. Accordingly, the same is also extended beyond 31.12.2017 to 31.12.2019 for recruitment made by Railway Recruiting agencies.

In continuation to Board's letter of even number dated 24.08.2017 regarding implementation of recommendations of the Seventh Central Pay Commission relating to Travelling Allowance entitlements, the admissibility of CTG and Transportation of personal effects on Transfer and Retirement will be regulated as under:

(i) In case, the railway servant has been transferred prior to 01.07.2017 and has assumed charge prior to 01.07.2017, he will be eligible for CTG at ore-revised scale of pay. If the personal effects have been shifted after.01.07.2017, revised rates for transportation of personal effects will be admissible.

(ii) In case, the railway servant has been transferred prior to 01.02.2017 and has assumed charge on/after 01.07.2017, he will be eligible for CTG at revised scale of pay. As the personal effects would be shifted after-01.07.2017, revised rates for transportation of personal effects will be admissible.

(iii) in case of retirement, if a railway servant has retired prior to 01.07.2017, he will be eligible for CTG at pre-revised scale of pay. If the personal effects have been shifted after 01.07.2017, revised rates for transportation of personal effects will be admissible.

No. PC-VI/2 & RBE No. 108/2008) circulating schedules of revised pay structure for running staff effective from 01.01.2006 and letter No. PC-VI/2010/I/RSRP/4 dated 02.11.2010 (Sl. No. PC-VI/234& RBE No. 159/2010) regarding clarification on Additional Allowance. Consequent upon the acceptance of recommendation of 7th Central Pay Commission on Allowances by the Government with certain modifications, the President is pleased to revise the rates of Additional Allowance granted to certain categories of Running Staff viz. Loco Pilot Mail/Express, Loco Pilot Passenger/Motorman, Guard Mail/Express and grant of Additional Allowance to some other categories of Running Staff viz. Loco Pilot Goods and Sr. Passenger Guard at the following rates:-

(i) Rs. 2,250/- per month to Loco Pilot Mail/Express.

(ii) Rs. 1,125/- per month to Loco Pilot Passenger/Motorman.

(iii) Rs. 1,125/- per month to Guard Mail/Express.

(iv) Rs. 750/- per month to Loco Pilot Goods.

(v) Rs. 750/- per month to Sr. Passenger Guard.

2. Dearness Allowance will be payable on this allowance. However, it will not count for pensionary benefits.

3. These orders shall take effect from 1st July, 2017.

These instructions shall apply mutatis mutandis on the Railways also. Rules 38, 49, 50 and 54 of CCS (Pension) Rules, 1972 and CCS (Extraordinary Pension) Rules, mentioned in DOP&PW's O.M. correspond to Rules 55, 69, 70 and 75 of the Railway Services (Pension) Rules, 1993 and Railway Services (Extraordinary Pension) Rules, 1993 respectively. The DOP&PW's O.M. No. 38/41/06/P&PW(A) dated 05.05.2009, referred to in their aforesaid O.M. dated 30.05.2017 has been circulated on the Railways vide this office letter No. 2008/AC-II/2 1/19 dated 29.05.2009.

Attention is invited to instructions issued, vide this Ministry’s letter under RBE No. 129/2013 dated 09.12.2013, laying down qualification for recruitment of staff from open market to posts in Pay Band-1 of Rs. 5200-20200 having Grade Pay- 1800/- (now Level-l of the pay matrix of 7th CPC), through all modes, against direct recruitment quota as 10th pass or ITI or equivalent or National Apprenticeship Certificate (NAC) granted by NCVT.

2. The qualifications have further been reviewed and it has been decided by Board that the minimum educational qualification for recruitment of staff in Level-l of the pay matrix of 7th CPC (earlier Grade Pay Rs 1800/-) in Civil Engineering, Mechanical, Electrical and S& T departments from open market, through all modes, will henceforth be as under:-

10th pass plus National Apprenticeship Certificate (NAC) granted by NCVT
OR
10th pass plus ITI.

3. For all other departments of the Railways, the minimum educational qualification will continue to be the same as mentioned in para-1 above.
4. Cases already under process will continue to be dealt in terms of earlier instructions.

Eastern Railway and South East Central Railway had requested for a clarification whether 30% pay element will be reckoned for pay fixation of a running staff who has been selected to a Group 'B' post through selection/LDCE.

2. The issue has been under consideration in this office and it has been decided to clarify that the provisions regarding fixation of pay of running staff in stationary posts contained in Rule 25 (i)(d) of 'The Rules for the payment of running and other allowances to the Running staff on the Railways 1981' and paragraph 924 (i) (d) of IREM-I would also apply in the case of fixation of pay of running staff posted on promotion to the stationary posts in Group 'B' also.

Subject: Revision of pension of pre-2016 pensioners/family pensioners in implementation of Government’s decision on the recommendations of the 7th Central Pay Commission-Concordance tables-reg.

In pursuance of Government's decision on the recommendations of the 7th Central Pay Commission, the Department of Pension & Pensioners’ Welfare (DOP&PW) vide their O.M. No. 38/ 37 / 2016-P&PW(A) dated 6th July, 2017 has issued instructions alongwith concordance tables for revision of pension of pre-2016 pensioners/family pensioners, which are available on website: doppw.gov.in. These instructions shall apply mutatis mutandis on Railways also.


2. The Railway Board's instructions corresponding to the DOP&PW's instructions referred to in their aforesaid O.M. dated 06.07.2017 are given under:

A copy each of Orders No.(i)1/l3(7)/2017-LS.II, (ii) 1/13/ (6)/2017-LS.II, (iii) 1/13/(5)2017-LS.II, (iv) 1/13/(4)/2017-LS.II (v) 1/13/(3)2017-LS.II and (vi)1/13/(1)/2017-LS-II dated 20.04.2017 revising the rates of variable dearness allowance for contract workers engaged in (i) Loading and unloading in goods sheds, parcel offices of Railways, and other goods-sheds, godowns, warehouses and other similar employments (ii) Watch and Ward (Without arms) (iii) Employment of sweeping and cleaning excluding activities prohibited under the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993 (iv) Stone mines (v) Construction or Maintenance of Roads or runways or in Building Operations including Laying Down Underground electric, wireless, Radio, Television, Telephone, Telegraph and Overseas Communication Cables and Similar other Underground cabling work, Electric lines, Water supply lines and Sewerage Pipe Lines and (vi) Agriculture respectively is sent herewith for information and strict compliance . The rates are applicable w.e.f. 01.04.2017.

2. Railways, being Principal Employer are required to ensure that the contractors are complying with the provisions of the Contract Labour (R&A) Act, 1970 and Minimum wages Act,"1948- strictly and arranging prescribed minimum wages to the contract labourers.

3. This issues with the concurrence of the Finance Directorate of Ministry of Railways.

Subject: Railway Board's order dated 30.1.2017 curbing workers' rights.

In the DC/JCM meeting held on 7.3.2017, during Opening Address, both the Federations have taken a stand that the unconstitutional order dated 30.1.2017 preventing Safety (Supervisory) Staff from becoming Office bearers should be withdrawn by the Railway Board immediately to facilitate negotiations to resume.
The President, General Secretary, Working President etc. have conveyed their strong protest against the Board’s letter dated 30.1.2017.
The General Secretary/NFIR had stated that the Railway Board has betrayed the Federations and the Railway Board has equally failed on several counts on written commitments notably:

a) Replacement of GP 4600 with 4800
b) Upgradation from Gr.C to Gr.B (Gaz.)
c) Allotment of GP 4600 to Loco (Mail)
d) Stepping up of pay of Loco Inspectors inducted prior to 1.1.2006
e) Arbitrary reversal of various decisions given in the past (as a result of agreements with the Federations) and without caring to consult federations.
f) Track Maintainers upgradation (written commitment of Board)

In light of Railway Board's total failure, the Federation (NFIR) conveyed that it is not in a mood to participate in the negotiations of DC/JCM forum and at the same time demanded immediate withdrawal of Board's order dated 30.1.2017, if the Railway Board sincerely feels that industrial relations are required to be preserved.

With the above observations in the DC/JCM meeting, the leaders left the meeting place. Both the Federations have jointly walked away from the meeting.
Please convey to all employees the above development, as the Railway Board's order is a direct attack on the rights of workers, whether they are Supervisors or Non-Supervisors and it is a gross violation of Trade Union Act, ID Act etc.

Also convey the "Walk Out" decision of Federations to GMs, CPOs etc.

Subject : Payment of Productivity Linked Bonus to all eligible non-gazetted Railway employees for the financial year (2015 to 2016).

The President is pleased to sanction Productivity Linked Bonus (PLB) equivalent to 78 (Seventy Eight) days wages without any ceiling on wages for eligibility for the financial year 2015 to 16 to all eligible non-gazetted Railway employees (excluding all RPF/RPSF personnel). Where wages exceed 7000/- per month, Productivity Linked Bonus will be calculated as if  wages are 7000/- p.m.

2. Wages for the purpose of calculating Productivity Linked Bonus shall include Basic pay as defined in the Railway Services (Revised Pay) Rules, 2008 and dearness allowance drawn during the period from 01.04.2015 to 31.12.2015. Wages during the period from 01.01.2016 to 31.03.2016 shall include Basic pay as defined in the Railway Services (Revised Pay) Rules, 2016. Other conditions of eligibility, method of calculation of wages, etc., as prescribed in this Ministry's instructions and clarifications issued from time to time, shall remain unchanged.

3. It has also been decided that in the case of eligible employees mentioned in Para 1 above who were not placed under suspension, or had not quit service/retired/expired during the financial year 2015-16 or were on leave where leave salary admissible is not less than that admissible on leave on average pay, may be paid an amount of 17,951/- towards Productivity Linked Bonus for the financial year 2015 to 16. In the case of employees other than those mentioned above, the amount of Productivity Linked Bonus may he calculated in accordance with the extant instructions on the subject.

4. Further, in relaxation to the provisions in Rules 905(2), 908 and 909 of State Railway Provident Fund Rules, as contained in Chapter 9 of R-1/1985 edition (2003 Reprint edition), such of the subscribers to the SRPF as are entitled to Productivity Linked Bonus may, if they so desire, deposit the whole or part of the amount admissible under the Scheme in their respective State Railway Provident Fund Accounts.

5. Disbursement of Productivity Linked Bonus for the financial year 2015 to 16 to all eligible non gazetted Railway employees mentioned in Para 1 above should be made on priority in the same mode as payment of salary before the ensuing Puja/Dussehra holidays.

6. This issues with the concurrence of Finance Directorate of the Ministry of Railways.

Sub: Promotion of Group ’A' and Group 'B’ officers to Senior Scale on ad-hoc basis.

Ref: Board’s letter Nos. E(GP)85/1/48 dated 31.12.85, EV(GP)89/1/8 dated 17.04.90 and 22.08.90.

In terms of Board’s letter No. ElGP)85/1/48 dated 31.12.85, Group ‘A’/Junior Scale officers with more than 3 years of service but less than 4 years, were eligible to be considered for looking after the duties in Senior Scale, on payment of Special pay, as fixed from time to time by the Board, in addition to their pay in Junior Scale, and it was only in the absence of Group ’A’ officers who have completed their probation successfully, that Group 'B’ officers who have rendered not less than 3 years of service in Group ’B’ could be considered for ad-hoc appointment to Senior Scale. This was based on the fact that all Senior Scale posts are in Group ’A’ and, as such Group ‘B’ officers, irrespective of their length of service, can have no claim for promotion to Senior Scale, even on ad-hoc basis. However, while the position as contained in Board’s letter dated 31.12.85 basically remaining unchanged, it was decided by the Board vide Board's letter No. E(GP)89/1/8 dated 17.04.90, as a temporary measure in the overall administrative interest, that in cases where a Group 'A’/Junior Scale officer who was eligible for regular promotion to Senior Scale, having completed 4 years’ service, was not available, Group 'B’ officers, who had rendered not less than 6 years' service in Group 'B’, could be considered for ad-hoc promotion to Senior Scale, and in case, no such Group ‘B’ officer was available, the provisions contained in sub-paras 3.1(ii) and (iii) of Board's letter dated 31.12.85, would continue to be followed.

2. The matter has since been reconsidered by the Board. After careful consideration, it has been decided that the position as was laid down in Board’s letter No. E(GP)85/1/48 dated 31.12.85 which is in consonance with Rule 214(b) of IREC Vol.- I, be restored. Therefore, the order of preference to be followed henceforth, while considering Group ’A’ (Junior Scale/Group ’B' officers for ad-hoc promotion against Senior Scale vacancies, will be sunder:-

i) Vacancies arising in Senior Scale should be filled by Group .‘A’/Junior Scale officers with 4 years of service who are eligible for regular promotion to Senior Scale;


ii) If eligible Group ‘A'/Junior Scale officers are not available but Junior Scale officers with a minimum of 3 years of service in Junior Scale, who have completed the probation successfully, are available, they should be considered for looking after the duties in Senior Scale on payment of charge allowance, as fixed by the Board from time to time, in addition to pay in Junior Scale, subject to the condition that pay plus charge allowance does not exceed the pay admissible on regular promotion to Senior Scale on completion of 4 years of service in Junior Scale;

iii) Failing (i) and (ii) above, by Group ’B’ officers who have rendered not less than 3 years of service in Group 'B’ and have been adjudged suitable by a Committee of HODs for appointment against Senior Scale vacancies.

3. For making ad-hoc promotion to Senior Scale, number of vacancies arising during the period 1st July of any year to 30th June of the following year shall be computed and while empanelling Group ’B’ officers for ad-hoc promotion to Senior Scale against any such vacancies it shall be ensured that there may be no reasonable likelihood of any such Group B’ officers not getting empanelled for regular promotion to Group ’A’/Junior Scale at a later date by the DPC constituted by the UPSC, and also adequate number of Senior Scale vacancies are available for Group 'A’/Junior Scale officers so as to consider them for ad-hoc promotion on completion of 3 years of service, so that there may be no occasion for Group 'B' officers having to be reverted once they have been promoted to Senior Scale on ad-hoc basis.
