(a) whether Government has issued general orders for fixation of pay for officials who were promoted from pre-revised grade pay of Rs. 4,200/- to Rs. 4,600/- between 01/01/2006 to 29/08/2008 to minimum at Rs. 18,460/- as per the orders of Hon’ble Supreme Court in Union of India and others versus Rajkumar Anand dated 14/03/2019 to avoid unnecessary litigation and expenses incurred thereon;
(b) if so, the details thereof along with the date and number of the said orders;
(c) if not, the reasons therefor; and
(d) by when said orders would be issued?

Therefore, no general order/Office Memorandum is required to be issued by this Department.

Sub: Availability of option for fixation of pay on promotion from the Date of Next Increment (DNI) in lower post and method of fixation of pay from DNI, if opted for, in context of RS(RP) Rules,2016.

Ref: NFIR’s letter No.1/2/Part IV dated 13.11.2018.

Please refer to NFIR’s letter quoted above requesting Board to give 90 days’ time for exercise of option for fixation of pay on DNI instead of ‘one month’ period as circulated vide Board’s letter RBE No. 142/2018 dated 20.09.2018 from the date of issue of these orders on the ground that these orders have not been circulated by the Zonal Railways and the Divisions to field units with the result that the staff are unable to exercise option in time.

With respect to above, it is stated that general instructions relating to revised pay structure which are applicable to all central government employees issued by Ministry of Finance (MoF) are adopted in Railways in mutatis mutandis manner. The letter under question was also uploaded on Board’s website on date itself and also circulated amongst all concerned including Zonal Railways/Production Units, Board’s branches, Members of the Staff Council, NFIR, AIRF and other, staff associations. Federation may appreciate that MoF’s circulars/orders already remains in circulation before adopted in Railways, as such Railway employees have even more time to go through such circulars/orders in comparison to other central government employees. Further, no Railway has made any reference bringing on record delayed circulation in this regard.

In view of the above, unilateral deviation from MoF’s stipulation is not feasible.

Points of doubt raised and clarifications thereon

1. Whether one increment of 3% constitute one stage or a difference of 3% among the pay of two officers As explained in this Ministry’s earlier OM dated 3.8.2017, the stages of every pay scale were well defined in the pay structure under 5th CPC regime and the stages were not well defined in the 6th CPC structure. Since there were no defined stages in the 6th CPC structure and as pay in the running Pay Band in the 6th CPC structure could be of any amount in the multiple of Rs. 10, as specific to an employee, it has been very clearly brought out therein, drawing upon the illustration given by the 7th Pay Commission in para 5.1.37 of its Report . that a difference of at least 3%, the rate of annual increment in the 6th CPC structure, was essential for counting of two stages. Therefore, for the purpose of considering bunching, two Pays drawn in a Pay Band with a particular Grade Pay, which are separated by 3% of the lower pay; are to be taken into account, as explained in the illustration given in para 9(i) of this order.
2. Whether the pay at Cell 1 of any Level may be taken as first stage. Bunching is to be considered with reference to the consecutive stages of pay drawn in the pay structure obtaining prior to 1.1.2016, as explained in these orders and as such a reference to Cell 1. which is in the revised pay structure, is not relevant.
3. Whether all .pay stages lower than the entry pay in the 6th CPC pay structure the purpose of bunching. This point has been amply clarified in the aforesaid OM dated 3.8.2017.  As mentioned in para 8(iv) thereof , all pay stages lower than the Entry Pay in the 6th CPC pay structure as indicated in the Pay Matrix contained in 7th CPC Report are not to be taken into account for determining the extent of bunching.
4. Whether benefit of bunching should be given only where previous and current pay stages of the officers (specific to each employee) are getting bunched and placed at the same Level in the 7th CPC matrix without any comparison to any other officer’s pay as per para 5 and 8(iii) of this Department’s OM dated 3.8.2017 which stipulates that a difference of 3% to be reckoned for determination of consecutive pay stages, specific to each employee. The position clarified in these orders covers this poi nt. As explained in the illustration. the pre-revised pay of Rs.46,100 and Rs.47,490 are considered two stages of pay, as these are separated by 3% and these could be drawn by any two officers.
5. Whether benefit of bunching is to be given to a senior officer with reference to the pay of his junior officer who is drawing less pay with the difference of 3% to the senior officer and now his pay got fixed in the same Level as that of the senior officer. The issue of bunching is not a matter of pay drawn by a Senior Officer vis-a-vis a Junior Officer. As explained in these orders, bunching happens as in the illustration given in these orders and as such this is not related to the issue of seniority.
6. Whether the benefit of bunching is also required to be given to a senior officer where his junior’s pay has got fixed in the same Cell as that of the senior due to the benefit of bunching of pay given to the junior
7. Whether the benefit of bunching may be extended on account of bunching of two stages of pre-revised pay of a Government servant alone. It is not clear how two stages drawn by a single Government servant are relevant for pay fixation on 1.1.2016, as only the pay drawn on 31.12.2015 is to be taken into account for pay fixation on 1.1.2016
8. Whether the benefit of bunching may be extended only on direct pay fixation where the pay of two officers in the pre-revised pay with a difference of 3% get fixed at the same stage in the revised pay structure (7th CPC) or also on further bunching with next higher pay stage due to grant of additional increment to an officer for bunching on initial/direct pay fixation. As explained in the illustration contained in para 9(ii) of these orders, no such benefit is admissible in such cas

Madam/Sir,

I am directed to say that the matter related to a clarification on pay fixation under FR 22(1)(a)(I) on re-designation/promotion to a post carrying higher duties and responsibilities but carrying the same pay scale has been examined in the Board in consultation with Department of Expenditure. Department of Expenditure has advised that -

"in case the issue is for pay fixation on movement from the post of Office Superintendent (OS) to Administrative Officer (AO) taking place on dates prior to merger of the posts of OS with AO on 01.01.2006, the pay fixation may be considered in the light of Department of Expenditure OM No.169/2/2000-IC dated 24.11.2000".

2. It is advised to take necessary action in the matter in terms of provisions contained in Department of Expenditure OM No.169/2/2000-IC dated 24.11.2000. A copy of Department of Expenditure O.M. dated 24.11.2000 is enclosed.

*** If the employee in this illustrations is drawing more pay than that computed due to fixation at Rs.80900, the higher pay of that employee in such circumstances shall be protected as "Personal Pay" till the date it is adjusted by the next increment.

Sub: Fixation of pay/ admissibility of increment under Rule 13 of Revised Pay Rules, 2008 in the situation of placement on non-functional basis in higher Pay Band/ Grade Pay.

Prior to implementation of recommendations of Sixth Central Pay Commission, fixation of pay of Railway employees on appointment from one post to another was governed by Rule 1313 {FR22(1)(a)(1)} and 1313 {FR22(1)(a)(2)} R-II depending upon whether situation involved assumption of duties and responsibilities of greater importance or otherwise. Rule 13 of Railway Services (Revised Pay) Rules, 2008 governing fixation of pay on promotion on or after 1.1.2006, however, envisage grant of one increment equal to 3% of sum of the pay in the pay band and existing grade pay (to be rounded off to next multiple of 10) in the case of promotion from one grade pay to another in the revised pay structure. Further clarification were issued vide Board's letter No. PC-VI/2008/I/RSRP/1 dated 11.02.2009 (RBE No. 28/2009).

2. References have been received from some of the Railways/PUs and both staff Federations regarding admissibility of fixation with extra increment in terms of Rule 13 of RS(RP) Rules, 2008 in the situation of placement of Pharmacist (GP Rs. 2800) in GP Rs. 4200 on completion of two years regular service and placement of Private Secretaries Grade I (GP Rs. 4800) in GP Rs. 5400 (PB 2) on completion of 4 years regular service on non-functional basis. The matter has been examined in consultation with Ministry of Finance and DoP&T and it is clarified that the benefit of fixation of pay in terms of Rule 13 of RS (RP) Rules, 2008 would be admissible in such situations of placement in higher Grade Pay on non-functional basis.

3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sub: Cases of promotion taking place in the pre-revised pay structure between 01.01.2006 and the date of notification of RS(RP)Rules, 2008 and the subsequent merger of the pre-revised pay scales of the promotional and feeder posts in a common grade - Fixation of Pay - Reg.

Ref.: MoF(Deptt. of Exp.)'s OM No.7/14/2010-E.III(A) dated 05.07.2010 and OM No.F-2-1/2015-E.III (A) dated 16.10.2015

Kindly call for my earlier letter of even number dated 18th January, 2018(copy enclosed), through which your kind attention was drawn towards MoF(Deptt. of Exp.)'s OM No.-F-2-1/2015-E.III(A) dated 16.10.2015, whereby it was decided that, in cases where promotion took place in the pre-revised pay structure during the period between 01.01.2006 and the date of notification of CCS(RP) Rule, 2008 and subsequently promotional grade merged with the feeder grade consequent upon promulgation of the CCS(RP) Rules, 2008, the benefit of pay fixation shall be allowed under Rule-13 of CCS(RP) Rules, 2008.

In this connection, it is stated that, some of the government employees, who have got promotion/financial upgradation between 01.01.2006 and date of notification of the CCS(RP) Rules, 2008, exercised their option to switch over to 6th CPC from the date of such promotion/financial upgradation, instead of 01.01.2006 as per option provided vide Deptt. of Expenditure's OM supra dated 05.07.2010, as the same was more beneficial to them at that time. In this connection, it is pertinent to mention here that, initially they opted to switch over to revised pay structure w.e.f 01.01.2006 prior to issuance of OM dated 05.07.2010. As they were not aware with the fact that any such benefit of pay fixation under Rule-13 would be extended in future as has been provided vide Deptt of Expenditure's OM dated 16.10.2015, then they would not have exercised their option to switch over to CCS(RP) Rules, 2008 w.e.f. from their respective dates promotion/ financial upgradation, as per the option provided vide Deptt of Expenditure's OM dated 05.07.2010.
Further, as per instruction of Deptt. of Expenditure's OM dated 16.10.2015, the benefit of pay fixation is being allowed under Rule-13 of CCS(RP) Rules, 2008 in those cases where promotional/financial upgradation took place in the pre-revised pay structure between 01.01.2006 and the date of notification of CCS(RP) Rule, 2008.

However, benefit of pay fixation allowed under Rule-13 of CCS(RP) Rules, 2008, as the provision of Deptt. of Expenditure's OM dated 16.10.2015, is not being extended to those employee who have opted to switched over to the Railway Servant(RP) Rules, 2008, with effect from the date of promotional/financial upgradation instead of 01.01.2006, by exercising the option made available vide Deptt. of Expenditure's OM dated 05.07.2010 (as mentioned in para 2 above), although fulfilling other conditions for getting the benefit of fixation as per the instructions contained in Deptt. of Expenditure's OM dated 16.10.2015.

It has also come to our knowledge that, some of the Railways have made a reference on this issue, seeking clarification regarding extending the benefit of the above-mentioned fixation to these employees after providing opportunity for re-option to switched over to the RS(RP) 2008 (or CCS(RP)Rule, 2008) w.e.f. 01.01.2006 instead of any subsequent date opted earlier. It is also understood that, Railway Board (Ministry of Railways) has referred this clarification to the Deptt. of Expenditure(Ministry of Finance).

Earlier, in similar cases, whenever Deptt. of Expenditure's OM brings about a material change in the basis for exercise of option to come over to revised pay structure/unforeseen developments and change of rule in terms of the CCS(Revised Pay) Rules, opportunity to revise their option to come over to revised pay structure has always been given(as it was given through Deptt. of Expenditure's OM dated 03.11.2013).

Also, it is also is heard that, DoPT is agreed that, re-fixation of pay for merged post under Rule-13 of CCS(RP) Rules-2008, on the basis of Department of Expenditure's OM No.-F-2-1/2015-E.III(A) dated-16.10.2015, were unforeseen developments/change of rule. This brings a material change in the basis for exercise of option to come over to the revised pay structure.

Hence, it is very clear that, Deptt. of Expenditure's OM dated 16.10.2015, brings a material change in the basis for exercise of option to come over to revised pay structure, unforeseen developments and change of rule in terms of the Railway Services(Revised Pay) Rules, 2008. Hence, it is demanded that, opportunity to revise their option to come over to revised pay structure, under the rule of the CCS(RP) Rules, 2008, w.e.f. 01.01.2006, may be given to those employees who are covered under the said letter dated 16.10.2015, as it is more beneficial for them as now.

In view of the above, it is requested that, necessary clarifications in this regard may kindly be communicated to all the Ministries/Departments of the Government of India, so that, aggrieved staff can get an opportunity to re-exercise their option, under Rule-6 of the CCS(RP) Rule, 2008, to switch over to CCS(RP) Rules, 2008, w.e.f. 01.01.2006, and get benefit of pay fixation provided vide Deptt. of Expenditure's OM dated 16.10.2015, so as to avoid financial loss to the affected staff.

Subject: Central Civil Services (Revised Pay) Rules, 2008 - Section II of the Part 'A' of the First Schedule thereto - entry pay for direct recruits appointed on or after 1.1.2006 and pay fixation in the case of persons other than such direct recruits.

The undersigned is directed to invite the attention to the provisions contained in Section-2 of Part 'A' of the First Schedule of the Central Civil Services (Revised Pay) Rules, 2008 which provides for entry pay in the revised pay structure (pay structure effective from 1.1.2006 up to 31.12.2015) for direct recruits appointed on or after 1.1.2006 on a post and to say that pay in respect of persons appointed to the same posts before 1.1.2006 is required to be fixed as on 1.1.2006 under Rule 7 (1)(A)(i) and pay in respect persons appointed on the same post on promotion on or after 1.1.2006 is required to be fixed under Rule 13 thereof.

2. A number of references were received in Ministry of Finance, Department of Expenditure, stating that the pay of seniors of a post was fixed at a stage lower than the entry pay applicable to the persons appointed on direct recruitment basis on that post on or after 1.1.2006. In such cases, stepping of pay was allowed to the senior employee at par with the entry pay of direct recruits of those posts, subject to the conditions, inter-alia, that stepping up of pay of seniors is applicable only in those cases which have an element of direct recruitment and where a directly recruited junior is actually drawing more basic pay than the seniors. Thus, the stepping up of pay of senior employees was admissible from the date a junior direct recruit joined on or after 1.1.2006.

3. The matter was also considered in the meeting of the National Anomaly Committee (NAC) held on 17.7.2012 based on a demand raised by the Staff Side under the JCM. NAC had recommended that in cases where Recruitment Rules provide for direct recruitment, then the stepping up of pay of senior may be considered, even if no actual direct recruitment takes place or no direct recruit has actually joined. However, it was decided that stepping up of the pay of seniors can be claimed only in the case of those cadres which have an element of direct recruitment and in cases where a directly recruited junior is actually drawing more basic pay than the seniors. Thus, stepping up of pay was dependent upon actual joining of a direct recruit.

4. Trained Graduate Teachers (TGTs) of the Government of National Capital Territories of Delhi (GNCTD) filed an OA No. 3217/2014 before the Hon'ble Principal Bench of CAT. The 13 petitioners of the post of Trained Graduate Teachers (TGT) comprised those who were appointed as TGT before 1.1.2006 as also those who were promoted to the post of TGT on or after 1.1.2006. The pay of these 13 employees had been fixed as per the relevant provisions of the CCS(RP) Rules, 2008 and the same happened to be lower than the entry pay as applicable to direct recruits of the post of TGT appointed on or after 1.1.2006. These petitioners prayed for re-fixing their pay as applicable to direct recruits
appointed on or after 1.1.2006.

5. The Hon'ble Principal Bench of CAT in their order dated 4.4.2016 in OA No.3217/2014 allowed the application and directed the Government to ensure that none of the applicant's pay is fixed at a stage lower than the pay which could be drawn by a direct recruit appointed on or after 1.1.2006. The order of Hon'ble CAT dated 4.4.2016 was upheld by the Hon'ble Delhi High Court in terms of their order dated 23.3.2017 in WP(C ) No.2634/2017. The Hon'ble Delhi High Court in its order dated 23.3.2017 observed, inter-alia, that the plea of stepping up of pay, as mentioned in para 2 above, means that the direct recruits should have actually joined before any stepping up of pay can be granted and the date of joining would be different as filling up of direct recruit vacancies in the cadre would depend upon vacancy position, selection etc. The Hon'ble Delhi High Court held that this was unacceptable.

6. The matter arising out of the aforesaid order of Hon'ble Delhi High Court dated 23.3.2017 was heard by the Hon'ble Supreme Court as part of the SLP and in its order dated 01.09.2017 (Dy. No. 23663/2017), the Hon'ble Supreme Court has observed that once the question, in principle, has been settled, it is only appropriate on the part of the Government to issue a Circular. The Hon'ble Supreme Court further observed that the present situation is that the stepping up is available only to those who have approached the Court, but since the issue otherwise became final, the Hon'ble Supreme Court directed Government to immediately look into the matter and issue appropriate orders.

7. Accordingly, the matter has been considered in the light of the above background and in the context of the specific orders of Hon'ble Supreme Court dated 01.09.2017 as arising out of the original issue raised by the Trained Graduated Teachers of GNCTD in terms of their OA No. 3217/2014. As mentioned above, the petitioners in that case were those who were appointed as TGT before 1.1.2006 and also promoted as TGT on or after 1.1.2006, and had occasion for grievance because their pay in the pay structure in vogue from 1.1.2006 had been fixed lower than the entry pay as prescribed for direct recruits appointed as TGT on or after 1.1.2006. Therefore, the principle of the benefit of pay fixation, as flowing from the aforesaid orders of Hon'ble CAT, Hon'ble Delhi High Court and the Hon'ble Supreme Court, is that the pay of those who were appointed to the post prior to 1.1.2006 and those who were appointed to the post on promotion in the pay structure effective from 1.1.2006 onwards, and where in respect of such posts entry pay for direct recruits appointed on or after 1.1.2006 has been prescribed giving rise to differential pay, may not be lower than the said entry pay. It is the case of differential pay in respect of employees of a post, as caused by the existence of entry pay applicable for direct recruits on that post appointed on or after 1.1.2006, that has been addressed in the aforesaid case of the post of TGTs. In case entry pay as per Section II of Part A of the First Schedule of the CCS(RP) Rules, 2008 is not applicable in case of a post, the same will not give rise to differential pay for holders of the post and, hence, not covered under the ratio of the case of TGT.

8. Accordingly, the President is pleased to decide that in respect of those posts where entry pay for direct recruits appointed on or after 1.1.2006, as per Section II of Part A of the First Schedule of CCS(RP) Rules, 2008, becomes applicable by virtue of the provision of the element of direct recruitment in the relevant recruitment rules, the pay of Central government employees who were appointed to such posts prior to 1.1.2006 and whose pay, as fixed in the revised pay structure under Rule 7 thereof as on 1.1.2006 turns out to be lower than the prescribed entry pay for direct recruits of that post, shall not be less than such entry pay w.e.f. 1.1.2006. Likewise, the pay of Central Government employees who were appointed to such posts by way of promotion on or after 1.1.2006 and whose pay, as fixed under Rule 13 of CCS(RP) Rules, 2008, happens to be lower than the said entry pay, shall also not be less than such entry pay from the date of their promotion taking place on or after 1.1.2006.

9. In their application to the employees of office of Indian Audits and Accounts Department, these orders issue after consultation with the Comptroller and Auditor General of India.

Subject:- Fixation of pay in respect of employees appointed on or after 01.01.2006 in the Grade of 4280 (PR).

Doubts have been expressed by various quarters regarding fixation of pay of an employee appointed to the post carrying Grade Pay of 4210,4220,4240,4260 and 4280 in PB-3- 9300-34800 (PR), on or after 01.01.2006 in terms of SRO 266 of 2009 dated 31.08.2009 read with SRO 42 of 2011.

The issue has been examined in the Finance Department and it has been observed that consequent to notification of Jammu & Kashmir Civil Services (Revised) Pay Rules, 2009 vide SRO 93 of 2009 dated 15.04.2009, the pre-revised pay scales of 5000-8000, 5150-8300, 5500­9000,5600-9100, 5700-10100 and 6500-10500 were clubbed into single PB-2 - 9300-34800 (PR) with common Grade Pay of 4200. This created practical impediments in making appointments to various posts under these pre-revised pay scales/ Grade Pays, particularly in making promotions both functional or in-situ from one Grade Pay to another within the scales so clubbed. The promotion within these scales would mean nothing except change of designation.

In order to overcome the bottlenecks coming in the way of making appointments or promotions in these pre-revised scales, Grade Pays of 4210,4220,4240,4260 and 4280 were introduced to pave way for promotion from one post to another scale.

Accordingly, it is clarified that the newly incorporated Grade Pays viz 4210,4220,4240,4260 and 4280 under SRO 42 of 2011 are applicable to all employees in the revised pay structure, but as far as the applicability of ready reckoner attached to said SRO is concerned, same is relevant for pay revision of employees who have been appointed before 01.01.2006, and were holding these posts on 01.01.2006 to arrive at their revised pay on 01.01.2006 in the revised pay structure in accordance with Rule 7 of J&K Civil Services (Revised) Pay Rules, 2009.

It is also clarified that SRO 42 of 2011 is not an amendment to Rule (8) of Jammu & Kashmir Civil Services (Revised) Pay Rules, 2009, prescribing fixation of pay of direct entrants to Government service on or after 01.01.2006, but is an insertion/ substitution of new Grade Pays in Section-I of first schedule attached to Jammu & Kashmir Civil Services (Revised) Pay Rules, 2009 against S.Nos 11 to 16 of Pay Band-2.

Subject: Grant of benefit of pay fixation at time of promotion to Inspector posts.

Sir/Madam,
I am directed to say that references from various Circles are being received in Directorate seeking clarification on fixation of pay of the Postal Assistants, who have already been granted benefit of financial upgradation under MACP scheme, on their promotion as Inspector posts on the basis of LDCE. Further, consequent upon upgradation of grade pay of Inspector posts to Rs. 4600/- w.e.f. 01.01.2006, disparity in fixation of pay by different Circles has also been noticed by the Directorate while re-fixing pay of Inspector Posts posted in Directorate to the extent that in similar case some Circles have granted promotional increment to the officials who have been granted financial upgradation under MACPs, while others have not allowed, presumably invoking para 4 of Annexure I to MACP guidelines

2. The matter has been examined in consultation with Establishment Division of Directorate and it has been decided to convey that Inspector Posts is not in a regular promotional hierarchy of Postal Assistant and they can become Inspector Posts only on attaining merit in Competitive Examination. As such, 3% fitment benefit should be allowed to officials at the time of fixation of pay on promotion to the post of Inspector (Limited Departmental Competitive Examination) even after availing financial upgradation under MACP.

During NFIR's PNM meeting held with the Railway Board on 13/l4-11-2017, Federation raised the issue of the condition of Railway Quarters outside agenda and stated that the condition of quarters continue to remain deplorable. Federation further said that the deteriorated condition of Railway quarters and the Railway colonies is on account of non-allotment of adequate funds and non-availability of artisan and other support staff under the JEs/SSEs (Works). Federation also stated that the deterioration of conditions has been causing severe hardships to the staff and their families living in the quarters.

Railway Board during NFIR's PNM meeting held on 10/11-5-2018 conveyed following position through Action Taken Statement delivered to the Federation in the meeting:-

"Railway is carrying out repairs and maintenance of quarters along with constructions of new quarters on regular basis and this is ongoing process. Efforts are being made to repair more number of quarters each year with more fund allocation under demand No. 11 (500). For repair and maintenance of residential buildings, Rs. 1790 Cr. (RE) were allotted in year 2017-18 under Demand No. 11 (500). In the year 2018-19, this amount has been increased to Rs. 1899 crores. A Committee was constituted on comprehensive Housing Policy to examine, inter-alia, upkeep and maintenance of colonies as well. The Committee submitted its report on 3110112018. Based on the recommendation of Committee, Board inter-alia has approved the following for implementation in phased
manner:-

(i) For upkeep and maintenance of Railway colonies, setting up of IT based call centres at location of maintenance redressal.

(ii) Setting up of a separate wing for maintenance of infrastructure not related directly with operations. Delhi Division is to undertake this project on pilot basis.

(iii) Fixing of periodicity and scale/schedule of Renovation and maintenance in line with CPWD (CPWD Portal) and practices.

(iv) Specification of Fixtures and Replacement items also need to be in line with CPWD Practice.

(v) Expenditure in PU 32 is to be maximized to 85%. Further PU 32 is to be splitted as under:-

a. PU32A for Type I & II.
b. PU32B for Type III and IV and
c. PU32C for Type V and above houses.

Instructions in this regard have been issued to all Zonal Railways.

Further, as per the full Board's decision taken in the meeting held on 05/10/2017 on maintenance of service buildings and colonies, all Zonal Railways have been asked to adopt user compliance for satisfactory completion of works in service buildings and colonies and to outsource maintenance work for selected colonies.

It may be seen from the above that substantial efforts are being made by Railways to improve the maintenance of Railway colonies and in the years to come the outcome of these steps will be visible".

Above position is conveyed to the affiliates for offering views to the Federation soon,taking into account ground reality and holding discussions with the concerned staff and authorities.

Subject: Implementation of CCS (RP) Rules, 2016 - Exercising of option for fixation of pay

This is regarding exercising of option for fixation of pay in the revised pay structure in terms of following provisions of CCS (RP) Rules, 2016:

Para 5 Save as otherwise provided in these rules, a Governments servant shall draw pay in the Level in the revised pay structure applicable to the post to which he is appointed.

Provisio 1: Provided that a Government servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increments the existing pay structure or until he vacants his post or ceases to draw pay in the existing pay structure.

Provisio 2: Provided further that in cases where a Government servant has been placed in a higher grade pay or scale between 1st day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the Government servant may elect switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.

2. Regarding the aforesaid provision, clarification was sought from Ministry of Finance/Dept. of Expenditure on the issue of exercising of option for fixation of pay by the government servants in 6th CPC Pay Structure till their promotion which falls after the date of notification of CCS (RP) Rules, 2016 (i.e. 25.07.2016).

3. Now, MoF(DoE) have issued clarification dated 19.03.2018 (copy enclosed) wherein it has been clarified that the option for fixation of pay in the revised pay structure after the date of notification of CCS (RP) Rules, 2016 i.e. 25.07.2016 cannot be exercised as Rule 5 of the said Rules provided for option only for promotion taking place upto 25.07.2016 (date of notification of the said Rules)

Sub: Initial pay fixation of re-employed ex-servicemen who held posts below Commissioned Officer Rank in Defence Forces, retired before attaining the age of 55 years and have been appointed on re- employment basis in civilian posts in Railways etc - reg.

Ref: (i) General Secretary/NFIR's letter No. I1/35/Part XIV dated 29/01/2018 addressed to the Hon'ble Prime Minister of India.
(ii) PMO ID No. PMOPG/D/2018/0044515 dated 02/02/2018 addressed to the Secretary, DoP&T and copy to the Federation.

The Federation desires to invite kind attention of the DoP&T to the reference made by the General Secretary, NFIR vide letter No. II/35/Part XIV dated 29/01/2018 (addressed to the Hon'ble Prime Minister) on the subject matter, the same has however, been forwarded by the PMO vide ID No. PMOPG/D/2018/0044515 dated 02/02/2018 for taking further action and conveying the outcome to the Federation.

In this connection, Federation once again brings to the notice of the DoP&T that injustice is being meted out to the former Defence Forces Personnel (PBORs), reemployed in Railways and other Central services on account of the fact that the pay drawn by them at the time of retirement from Defence Forces (prior to attaining 55 years age) has not been protected on their re-employment, while those retired Defence Forces Personnel on re-employment in the Public Sector Undertakings (PSUs) of Central/State Governments have been granted the benefit of pay fixation on the last pay drawn at the time of retirement from Armed Forces. The discrimination has resulted disappointment and frustration among the reemployed retired Armed Forces Personnel in Railways and Central Civil Services.

This subject was dealt by the National Federation of Indian Railwaymen (NFIR), at the level of Railway Ministry in the negotiating fora of PNM, demanding pay re-fixation in favour of re-employed Defence Forces Personnel on the basis of last pay drawn more particularly those who have been re-employed on and after 01/01/2006. On a reference made by Railway Ministry vide O.M. No. E(G)2013/EM 1-5 dated 07/12/2016, the DoP&T had however not agreed for reckoning last pay drawn for pay re-fixation on re-employment in railways. The Federation encloses a copy of Railway Ministry OM dated 07/12/2016 to the DoP&T and reply thereon received from DoP&T vide OM dated 21/02/2017.

Federation also states that DoP&T vide OM dated 18th Oct 2017 called for suggestions for finding single methodology for pay re-fixation of all the ex-servicemen including PBORs, commissioned officers, ex-competent clerks/storemen, NFIR vide letter of even no. dated 21/12/2017 has submitted valid suggestions to the Secretary, Ministry of Defence, Dept of Ex-Servicemen, Welfare, South Block, New Delhi, as follows:-
(a) Considering the crucial role of Defence Forces Personnel in safeguarding the Nation’s borders, they be given pay fixation on the basis of their last pay drawn on re-employment in the Railways and other Central Government Departments.

(b) Their pension needs to be totally ignored as the pension is the social security net provided in recognition to their loyal services to the nation.

(c) The PBORs are not the Personnel of high rankings with higher wages, therefore their case needs to be considered with sympathy and their last pay drawn at the time of retirement from armed forces, to be treated as entry pay on re-employment in Railways and Central Government Departments.

(d) Alternatively, the number of years service rendered by the PBORs in Armed Forces be taken into account for granting pay fixation duly adding the quantum of equal number of increments to the minimum pay of the re-employed post. This may be made applicable to all PBORs who have joined Central Government Departments after 01/01/2006.

(e) In those cases of PBORs retired before attaining the age of 55 years and got re-employment in Government services, their initial pay on re-employment may be fixed at the minimum of the scale of pay prescribed for the post and after fixing the pay, in case the initial pay so fixed, is found to be less than the last pay drawn in the Armed Forces, all such cases may be treated as "cases of undue hardship" and in those cases, their pay may be re-fixed at higher stage duly granting one increment for each year of service rendered in the Armed Forces in order to bring their initial pay at par with the pre-retirement pay, while their pension already drawn be continued un-altered.
NFIR, therefore, requests to kindly see that the above legitimate request of former Defence Forces Personnel is agreed to and orders issued soon. Federation also requests to kindly communicate the action taken in the matter early.

(iii) NFIR's letter No. I/2/Part IV dated 20/02/2018.

(iv) Railway Board's letter No. PC-VIII/2017/R-U/37 dated 07/03/2018 addressed to GS/NFIR.
With reference to reply received from Railway Board vide letter dated 07/03/2018. Federation cites below the specific cases where the running staff promoted during the period July and December, 2016 have not been granted pay re-fixation duly obtaining their option.

(i) On Raipur Division of South East Central Railway, 53 Guard (Goods) PB-I + GP 2800/- were promoted to Senior Guard (Goods) in PB-2 + GP 4200/- on dated 29/07/2016. A copy of notification issued by the Sr. DPO, Raipur Division on 27/07/2016 is enclosed as Annexure to this letter.

(ii) Similarly, 127 Assistant Loco Pilot in PB-I + GP 2400/- were promoted to Loco Pilot (Goods) PB-2 + GP 4200/- on 08th December, 2016 on Kota Division on West Central Railway.

Federation also visualizes that there might be similar cases of Running and other category staff on the different Divisions/Zones where the re-option opportunity not given, resulting loss of fixation benefit.
In this connection, Federation desires to state that in the above situations, the staff were eligible to be continued in the 6th CPC grade pay on promotion and equally opt for a date from which, they should be switched over to 7th CPC pay. These staff when submitted their options to the respective Administrations, they were denied the pay fixation after promotion date, though permissible under the rules. Cases cited above are sufficient to prove that injustice has been done to those promoted in between July and December, 2016 by denying option for pay fixation in 7th CPC pay level after the date of promotion.

NFIR therefore, once again requests the Railway Board to issue clear; classificatory instructions to the Zones, Production Units etc for allowing pay re-fixation in respect of staff who have been promoted during July-December, 2016 on the basis of their option/re-option.

A copy of instructions issued may be endorsed to the Federation.

PERMISSION TO OPT FOR PAY FIXATION IN THE REVISED PAY STRUCTURE ON A DATE AFTER THE DATE OF ISSUE OF CCS (REVISED PAY) RULES 2016 NOTIFICATION DATED 25.07.2016 DEMAND OF THE JCM NATIONAL COUNCIL STAFF SIDE REJECTED BY GOVERNMENT.

JCM national council, Staff Side, has demanded that under the existing orders the option to come over to revised pay structure from the date of promotion is available only for those employees who are promoted before 25.07.2016. The staff side has demanded that such an option of fixation of pay for coming over to revised pay scale may be given to employees promoted after 25.07.2016 also. The staff side has contended that not giving such an option to an employee who was due for promotion on a date after 25.07.2016 (say on 26.07.2016) will be discriminatory. Government has considered the demand and rejected. The following is the reply of the Finance Ministry, Department of Expenditure.

The position on action taken in respect of item regarding permission to opt for pay fixation in the revised pay structure on a date after the issue of CCS (RP) Rules 2016 (notification on 25.07.2016) in the case of employees whose promotion becomes due after 25.07.2016 is given below:
In the said item the staff side has demanded that under the existing orders the option to come over to revised pay scale from the date of promotion is available only for those employees who are promoted before 25.07.2016, the date of notification of CCS (RP) Rules 2016. The staff side has demanded that such an option of fixation of pay for coming over to revised pay scale may be given to employees promoted after 25.07.2016 also. The staff side has contended that not giving such an option to an employee who was due for promotion on 26.07.2016 (one day after the date of notification) and afterwards will be discriminatory.

The revised Pay rules contained in CCS (RP) Rules 2016 are effective from 01.01.2016. A person holding a particular post as on 01.01.2016 has an option to come over to revised pay scale applicable to that post either straight away on 01.01.2016 or from a date later than that such an option is clearly mentioned in provisio 1 and provisio 2 of Rule 5. A combined reading of provisio 1 and provisio 2 to Rule 5 provided that a Government Servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increment in the existing pay structure or until he vacates his post or ceases to draw pay in the existing pay structure.

But, in cases where a Government servant has been placed in a higher grade pay or scale between 01.01.2016 and the date of notification of CCS (RP) Rules 2016 on account of promotion or upgradation, the Government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation.

Therefore the rules provide while in respect of post held by a Government Servant as on 01.01.2016, the concerned Government Servant may elect to come over to revised pay scale applicable to that post either from 01.01.2016 or from a date later than 01.01.2016, in case he is promoted to a post not held by him on 01.01.2016 on a date later than that, then he can opt to come over to revised pay scale from the date of promotion provided such promotion takes place between 01.01.2016 and the date of notification. Thus the date of notification of the Rules on 25.07.2016 which are effective from 01.01.2016 is the outer limit for option in cases the option is from date of promotion. The similar was the provisions in the Rules pertaining to the 6th CPC in terms of CCs (RP) Rules 2008. This is the fair and time tested rule, as it seeks to allow option in case of promotion during the retrospective effect of the Rules. There has to be outer date and that date is the date of notification of CCS (RP) Rules 2016, which is objective and of fair application. No such objective date beyond 25.07.2016 could be of fair application.

Accordingly it is not possible to agree to the demand of the staff-side.

Sub: Cases of promotion taking place in the pre-revised pay structure between 1.1.2006 and the date of notification of RS(RP)Rules, 2008 and the subsequent merger of the pre-revised pay scales of the promotional and feeder posts in a common grade - Fixation of Pay - Reg.
Ref.: (i) Deptt. of Expenditure, MoF's OM No.7/14/2010-E.III(A) dated 05.07.2010 and OM No.F-2- 1/2015-E.III(A) dated 16.10.2015

Through this missive, your kind attention is drawn towards Department of Expenditure's OM No.-F-2-1/2015-E.III(A) dated 16.10.2015, whereby it was decided that, in cases where promotion took place in the pre-revised pay structure during the period between 01.01.2006 and the date of notification of CCS(RP) Rule, 2008 and subsequently promotional grade merged with the feeder grade consequent upon promulgation of the CCS(RP) Rules, 2008, the benefit of pay fixation shall be allowed under Rule 13 of CCS(RP) Rules, 2008.

In this connection, it is stated that, some of the government employees, who have got promotion/financial upgradation between 01.01.2006 and date of notification of the CCS(RP) Rules, 2008, exercised their option to switch over to 6th CPC from the date of such promotion/financial upgradation instead of 01.01.2006 as per option provided vide Deptt. of Expenditure's OM dated 05.07.2010, as the same was more beneficial to them at that time. In this connection, it is pertinent to mention here that, initially they opted to switch over to revised pay structure w.e.f 01.01.2006 prior to issuance of OM dated 05.07.2010.

Now, as per instruction of the Deptt. of Expenditure's OM dated 16.10.2015, the benefit of pay fixation is being allowed under Rule-13 of CCS(RP) Rules, 2008, in those cases where promotional/financial upgradation took place in the pre-revised pay structure between 01.01.2006 and the date of notification of CCS(RP) Rule, 2008 and who opted 6th CPC w.e.f. 01.01.2006.

However, it has to come to our knowledge that, the benefit of pay fixation allowed under Rule-13 of CCS(RP) Rules, 2008, as per the provision of Deptt. of Expenditure's OM dated 16.10.2015, is not being extended to those employee who have opted to switched over to the Railway Servant (RP) Rules, 2008 with effect from the date of promotional/financial upgradation instead of 01.01.2006 by exercising the option made available vide Deptt. of Expenditure's OM dated 05.07.2010(as mentioned in para 2 above), although fulfilling other conditions for getting the benefit of fixation as per the instructions in Deptt. of Expenditure's OM dated 16.10.2015.

It has also come to our knowledge that, some of the Railways have made a reference on this issue seeking clarification regarding extending the benefit of the above mentioned fixation to these employees after providing opportunity for re-option to switched over to the RS(RP) 2008 (or CCS(RP) Rule, 2008) w.e.f. 01.01.2006 instead of any subsequent date opted earlier. It is also understood that, Railway Board (Ministry of Railways) has referred this issue of revision of option to switch over to the 6th CPC in view of unforeseen events etc. to the Deptt. of Expenditure(Ministry of finance). Despite elapse of more than 12 months, no response has been received in this regard from Deptt. of Expenditure(Ministry of Finance) to resolve the genuine demands of these employees.

In this connection, it is stated that as these are the unforeseen developments or change of rule, the opportunity to revise option for fixation under the Rule of the CCS(RP) Rules, 2008 may be given to these employees in these conditions, as it is more beneficial for them as now. Had they were aware with the fact that any such benefit of pay fixation would be extended in future (as has been provided vide Deptt of Expenditure's OM dated 16.10.2015), they would not have exercised their option to switch over to CCS(RP) Rules, 2008 w.e.f. from their respective dates of promotion/financial upgradation as per the option provided vide Deptt. of Expenditure's OM dated 05.07.2010.

In view of the above, you are requested to issue necessary clarifications in this regard to all the Ministries/Departments of the Government of India, so that, the aggrieved staff should get the opportunity to re-exercise their option under rule-6 of CCS(RP) Rule, 2008 to switch over to CCS(RP) Rules, 2008 w.e.f. 01.01.2006 and get the benefit of pay fixation provided vide Deptt. of Expenditure's OM dated 16.10.2015, so as to avoid financial loss to the affected staff.

ORDER:

In the Government Order first read above, the Government sanctioned an ad-hoc increase in the Consolidated Pay/Fixed Pay/ Honorarium with effect from 01.01.2017 at the rate of Rs.20/- per month in respect of those drawing revised Consolidated Pay / Fixed Pay / Honorarium upto Rs.600/- per month and at the rate of Rs.40/- per month in respect of those drawing revised Consolidated Pay / Fixed Pay / Honorarium of above Rs.600/- per month.

2. In the Government Order second read above, orders were issued enhancing the Dearness Allowance payable to Government employees who are on regular and special time scales of pay with effect from 01.07.2017. Government has therefore, decided to grant ad-hoc increase to those drawing Consolidated Pay / Fixed Pay / Honorarium with effect from 01.07.2017. Accordingly, Government direct that employees drawing Consolidated Pay / Fixed Pay / Honorarium be allowed another ad-hoc increase with effect from 01.07.2017 as detailed below:

For those drawing revised Consolidated Pay / Fixed Pay / Honorarium upto Rs.600/- per month from 01.01.2006Rs.20/- Per month
For those drawing revised Consolidated Pay/Fixed Pay / Honorarium above Rs.600/- per month from 01.01.2006Rs.40/- Per month

3.The Government also direct that the arrears of ad-hoc increase for the months of July to September, 2017 be drawn and disbursed by existing cashless mode of Electronic Clearance System (ECS).

4.This order shall also apply to the employees of Local Bodies, Over Head Tank Operators and Sweepers working in Rural Development and Panchayat Raj Department.
