The undersigned is directed to refer to this Department’s Orders relating to ad-hoc promotion in various grades of CSSS Cadre issued recently, as per the details below:

2. The ad-hoc promotion orders had to be made to address the urgent requirement of various cadre units for manpower at various levels. However, it is seen that a number of officers have not joined. It may be appreciated that ad-hoc promotion is resorted to as a special dispensation for ensuring efficiency in Government’s functioning. The non-joining of officers is defeating the very purpose for which these ad-hoc promotions were made.

3. Hence, in partial modification of the Orders mentioned in para-1 above, all the Cadre Units are hereby directed to issue instructions to the promoted officers in all grades, who have not yet assumed the charge of the posts, to assume the charge immediately and not later than 15.01.2021, failing which the promotion orders with respect to non-joinee Officers, shall be liable to be withdrawn, apart from debarment from ad-hoc promotion or other suitable consequences. Further, the vacancies on this account shall be filled up by considering eligible officers next in order of seniority.

4. The cadre units are also requested to submit a report by 15.01.2021 to this Department at email: bhagirathjha.68[at]gov.in

5. All the concerned Ministries/ Departments are hereby requested to forward the list of officers who have not assumed the charge of the post on promotion by 15.01.2021, 03:30 P.M. on the email id mentioned above.

Ref:- ECoR’s letter No.ECoR/ Pers/R/ Clarification/RB/1. dated 06.03.2020 & 08.06.2020.

With reference to the above, it is stated that Para 9 of Annexure to Board’s letter dated 10.06.2009 (RBE No. 101/2009) explicitly mentions that … “Regular service for the purpose of the MACPS shall commence from the date of joining of a post in direct entry grade on a regular basis either on direct recruitment basis or on absorption re-employment basis. Service rendered on ad-hoc contract basis before regular appointment on pre-appointment training shall not be taken into reckoning… “. As such. ad-hoc service is not to be counted for the purpose of MACPS and, therefore. the concerned employee is entitled for 3rd financial upgradation under MACPS wef 11.10.2012 subject to fulfillment of other terms and condition as contained in Board’: letter dated 10-06-09 (RBE No. 101/2009).

Sub: Promotion of Group ’A' and Group 'B’ officers to Senior Scale on ad-hoc basis.

Ref: Board’s letter Nos. E(GP)85/1/48 dated 31.12.85, EV(GP)89/1/8 dated 17.04.90 and 22.08.90.

In terms of Board’s letter No. ElGP)85/1/48 dated 31.12.85, Group ‘A’/Junior Scale officers with more than 3 years of service but less than 4 years, were eligible to be considered for looking after the duties in Senior Scale, on payment of Special pay, as fixed from time to time by the Board, in addition to their pay in Junior Scale, and it was only in the absence of Group ’A’ officers who have completed their probation successfully, that Group 'B’ officers who have rendered not less than 3 years of service in Group ’B’ could be considered for ad-hoc appointment to Senior Scale. This was based on the fact that all Senior Scale posts are in Group ’A’ and, as such Group ‘B’ officers, irrespective of their length of service, can have no claim for promotion to Senior Scale, even on ad-hoc basis. However, while the position as contained in Board’s letter dated 31.12.85 basically remaining unchanged, it was decided by the Board vide Board's letter No. E(GP)89/1/8 dated 17.04.90, as a temporary measure in the overall administrative interest, that in cases where a Group 'A’/Junior Scale officer who was eligible for regular promotion to Senior Scale, having completed 4 years’ service, was not available, Group 'B’ officers, who had rendered not less than 6 years' service in Group 'B’, could be considered for ad-hoc promotion to Senior Scale, and in case, no such Group ‘B’ officer was available, the provisions contained in sub-paras 3.1(ii) and (iii) of Board's letter dated 31.12.85, would continue to be followed.

2. The matter has since been reconsidered by the Board. After careful consideration, it has been decided that the position as was laid down in Board’s letter No. E(GP)85/1/48 dated 31.12.85 which is in consonance with Rule 214(b) of IREC Vol.- I, be restored. Therefore, the order of preference to be followed henceforth, while considering Group ’A’ (Junior Scale/Group ’B' officers for ad-hoc promotion against Senior Scale vacancies, will be sunder:-

i) Vacancies arising in Senior Scale should be filled by Group .‘A’/Junior Scale officers with 4 years of service who are eligible for regular promotion to Senior Scale;


ii) If eligible Group ‘A'/Junior Scale officers are not available but Junior Scale officers with a minimum of 3 years of service in Junior Scale, who have completed the probation successfully, are available, they should be considered for looking after the duties in Senior Scale on payment of charge allowance, as fixed by the Board from time to time, in addition to pay in Junior Scale, subject to the condition that pay plus charge allowance does not exceed the pay admissible on regular promotion to Senior Scale on completion of 4 years of service in Junior Scale;

iii) Failing (i) and (ii) above, by Group ’B’ officers who have rendered not less than 3 years of service in Group 'B’ and have been adjudged suitable by a Committee of HODs for appointment against Senior Scale vacancies.

3. For making ad-hoc promotion to Senior Scale, number of vacancies arising during the period 1st July of any year to 30th June of the following year shall be computed and while empanelling Group ’B’ officers for ad-hoc promotion to Senior Scale against any such vacancies it shall be ensured that there may be no reasonable likelihood of any such Group B’ officers not getting empanelled for regular promotion to Group ’A’/Junior Scale at a later date by the DPC constituted by the UPSC, and also adequate number of Senior Scale vacancies are available for Group 'A’/Junior Scale officers so as to consider them for ad-hoc promotion on completion of 3 years of service, so that there may be no occasion for Group 'B' officers having to be reverted once they have been promoted to Senior Scale on ad-hoc basis.

Subject: Promotion of Grade-I (Under Secretary) officers of CSS to the Selection Grade (Deputy Secretary) on ad-hoc basis along with posting of a Deputy Secretary – Furnishing of personal information thereof.

The undersigned is directed to refer to this Department’s OM of even number dated 18.03.2016 on the subject mentioned above and to say that there is a change in the vacancy position of DS/Director grade of CSS as on 01.04.2016. Accordingly, the revised list of officers to be posted/promoted on ad-hoc basis and the revised vacancy position are at Annex.1 and Annex.11 respectively.

2. The officers may exercise their options as per RTP latest by 21.03.2016 (01 :00 PM) in the format at Annexure-III. If any officer has already exercised options, he/she may submit revised options if so desires. The options should be furnished to Under Secretary, CS-I (D), Department of Personnel and Training through e-mail (uscsoned@gmail.com ). If option is not received from the officers who are in the cadre by 21.03.2016, it will be presumed that the officer concerned has no specific option and posting will be decided by the Placement Committee accordingly. In case the officers who are on deputation do not furnish their options by the stipulated time, it will be presumed that they are not willing to repatriate to the cadre to avail ad-hoc promotion and their names will be considered in future only on receipt of written communication conveying their willingness to repatriate to the cadre to avail promotion.

3. The officers before submission of options should ensure that data in their respect is complete and update in the web based cadre management system (cscms.nic.in). If the data is not complete it should be first got updated before submission of option.

The President hereby appoints the officers of Grade-I (Under Secretary) of the Central Secretariat Service (CSS), whose names appear in para 2 below,to the Selection Grade (Deputy Secretary) in PB-3 (Rs.15600 – 39100) with a grade pay of Rs.7600/-by promotion on ad-hoc basis with immediate effect,initially for a period upto 30.06.2015 or until further orders, whichever is earlier.

2. On promotion on ad-hoc basis,the officers are allocated to the Ministries/Departments as shown against their names:

3. The aforesaid ad-hoc promotion of the officers is Subject to the following conditions:-
(i) The ad-hoc promotion is subject to the final outcome of the pending Writ Petition No. 4097/2011 (Arun Gaur Vs Garima Singh & Ors), W.P. No.4616/2011  (V.S.Pandey & OrsVs. Garima Singh & Ors), W.P. No. 7619/2011 ( UPSC Vs Garima Singh & Ors), W.P.No.2176/2012 (Union of India Vs. Garima Singh & Ors) and other connected Writ Petitions Nos.W.P.(C) 2523/2012 (Union of India Vs. Anant Kishore Saran), W.P.(C) 2524/2012 (Union of India Vs. Shersha and Anr), W.P.(C) 2525/2012 (Union of  India Vs. Syed Eram Rizvi and Anr), W.P.(C) 2526/2012 (Union of India Vs. Sandeep Kumar Gupta), and W.P.(C) 2527/2012 (Union of India Vs. Soumya Chattopadhyay and Anr) in the High Court of Delhi and also any other order by any competent court in any of the connected matters, apart from the above.

(ii) The ad-hoc promotion is further subject to vigilance clearance in terms of this Department’s O.M. No.22011/4/91-Estt.(A) dated 14.9.92,  O.M.No. 22012/1/99- Estt.(D) dated 25.10.2004 and O.M.No. 22034/4/2012-Estt(D) dated 2.11.2012, The Ministry/Department where the officer is working should relieve the officer only after verifying that no disciplinary proceedings are pending or contemplated against the officer. In case of pendency of such proceedings, the matter may be reported to this Department immediately.

(iii) The promotion on ad-hoc basis is effective from the date of assumption of charge by the officer of the post of Deputy Secretary in the Ministry/Department to which he/she has been posted.

(iv) The ad-hoc  promotion to the Selection grade (Deputy Secretary) of CSS shall not bestow on the incumbents any claim for regular promotion to the grade.

(v) The service rendered on ad-hoc basis in the grade would not count for the purpose of seniority in that grade or for promotion to the next higher grade.

(vi) The adhoc promotion shall not confer any right on the incumbents to continue in the grade indefinitely and may be terminated at any point of time without giving any reasons thereof.
4. No request for retention shall be entertained.  Ministry/Department concerned should relieve the officers to enable them to join the allocated Ministries/Departments immediately, latest by 10.06.2015.

5. If any officer declines ad-hoc promotion, he/she would not be considered for ad-hoc promotion for one year from the date of refusal.

6. A copy of the notification implementing the order should be endorsed to this Department.

Subject: Ad-hoc promotion to the grade of Assistants from UDCs grade of CSCS.

The undersigned is directed to refer to the O.M No. dated 12.02.2015 wherein orders were issued for promoting eligible officials out of the list .attached to the O.M No. dated 27.01.2015. Further, to this O.M a copy of the proforma required to be filled by those officials who have been found fit by the DPC could not be adjusted in their own Ministries/Departments due to lack of vacancies is attached herewith.

2. All the Cadre Units are requested to obtain the willingness of such officials concerned in the proforma for their deployment to other Ministries/Departments where there are surplus vacancies available. The preferences may be indicated in the proforma accordingly. The posting however, shall depend upon the vacancy position and administrative requirement and not strictly as per the preference given by the officials.

3. As already stated in our O.M of even number dated 12.2.2015, it is reiterated that the entire process be completed by 18.02.2015 and the details may be furnished to this Department immediately thereafter.

Subject: Promotion of Grade-I (Under Secretary) officers of CSS to the Selection Grade (Deputy Secretary) on ad-hoc basis – Furnishing of personal information thereof.

The undersigned is directed to say that ad-hoc promotions of officers of Grade-I (Under Secretary) of CSS to the Selection Grade (Deputy Secretary) are likely to be made shortly.

2. As Officers are aware, this Department has proposed a revised rotational transfer policy in respect of CSS Officers. It has, therefore, been considered appropriate to decide posting of officers henceforth on transfer and on promotion as per the proposed policy, on the
following parameters:
(i) Ministries /Departments are categorized into Group A and Group B for posting/transfer;
(ii) The proposed RTP provides a tenure of five years for DS in a Ministry Department, including continuous tenure rendered in any other designation in the same Ministry Department;
(iii) In Group A, certain Ministries qualify for a reduced tenure by one year;
(iv) An officer on transfer! promotion shall ordinarily be posted from Group A- Group B and Group B- Group A as the case may be,  if they have completed the prescribed tenure for the promotional post;
(v) Officers who are within two years of superannuation will be retained in the same Ministry/Department if a vacancy in the promotional grade is available; In the absence of a vacancy such officer will be transferred out;
(vi) Officers within six months’ of superannuation will not be posted out on promotion; In the absence of a vacancy of the promotional post, such officer will be adjusted in the same Ministry/Department by personal upgradation of the post;
(vii) For calculation of residency in a Ministry! Department, 2 years/six months for superannuation as the case may be, the last date of the month in which promotion order/posting order is issued will be taken as the cut-off date; accordingly, for posting! promotion in this round, the cutoff date has been taken as 28.2.2015.
(viii) The Placement Committee will decide posting of officers on the basis of seniority, preference, past postings etc.
3. The list of brief details of officers who are likely to be considered for promotion is at Annexure-I. Information relating to vacancies in DS!Director grade of CSS as on 01.03.2015 is at Annexure-II.

4. The officers excluding those who are to be retained as per revised policy are requested to exercise their option for posting in the Ministries/Departments in the other Group latest by 16.2.2015 in the format at Annexure-III to Under Secretary, CS-I (D), Department of Personnel and Training through e-mail (ak.upadhayaya@nic.in) or fax number given below. Hard copies of the same may also be furnished immediately. The officers on deputation may also indicate their willingness to avail the ad-hoc promotion. Maximum three choices within the available vacancies may be exercise. If option is not received by 16.2.2015, it will be presumed that the officer has no specific choice and posting will be decided by the Placement Committee accordingly.

Promotion of UDCs of Central Secretariat Clerical Service (CSCS) to the Assistant’s Grade of Centrai Secretariat (CSS) on Ad-hoc basis

Subject: Promotion of UDCs of Central Secretariat Clerical Service (CSCS) to the Assistant’s Grade of Centrai Secretariat (CSS) on Ad-hoc basis

The undersigned is directed to refer to this Departments O.M. No. No.1211/2011-CS.I( (B) dated 27th January 2015 wherein a list of 1552  officials was circulated. Compliance report was also sought from the  cadre units with regard to their inclusion in the SL 2003(extended) UDC  grade. All the cadre units have given these report to effect that the officials  have been included in SL 2003(extended) and stand promoted.

2. As per the O.M. No, 7/4/2013-CS.I (A) dated 23.1.2015 it has been reported that there are about 2500 vacancies in the Assistant grade of CSS. Since, it would take some more time to fill up the DR vacancies of COLE 2013 and 2014, it has been decided to grant ad-hoc promotion to the grade of Assistants to those officials figuring in the list attached to O.M. No. 12/1/2011-CS.II(B) dated 27th January 2015. After excluding from the list of 1552 officials, due to retirement, VRS, resigned, not fit from vigilance angle promoted earher etc. about 1400 officials are ripe for promotion.

3. AH the Cadre Units are requested to consider the cases of UDCs who are figuring in the Select List 2003(extended) (as per list attached to O.M. 12/1/2011-CS. P1(B) dated 27th January 2015) and presently working, for Ad-hoc promotion to Assistant Grade and to issue promotion orders
accordingly subject to their fitness and clearance from vigilance angle. To the extent the vacancies are available In the individual cadre units, Ad-hoc appointees shall continue to work in the same cadre unit. In case there are no vacancies to accommodate the ad-hoc appointees, such of these officials shall be re-deployed by this division to other cadre units where there are surplus vacancies. This ad-hoc promotion would be initially for a period upto 30-06-2015 or until further orders or till regular Assistants become available through the normal mode of recruitment as prescribed under the CSS Rules, whichever is earlier.

4. The above category of officials may be promoted / appointed as Assistants on ad-hoc basis, after assessing their suitability for promotion by screening the records (APARs) of the officials after ensuring that these officials are clear from the vigilance. The ad-hoc promotion/appointment is subject to following conditions:

I) The ad-hoc appointment shall not confer on the appointees any justify to continue in the grade indefinitely or for inclusion in the select list or to claim seniority in the Assistant Grade of CSS;

ii) Ad-hoc appointments may be terminated at any point of time without giving any reason therefore;

iii)The appointment on ad-hoc basis will take effect from the date of taking over charge of the post of Assistant of CSS.

iv) The ad-hoc appointees would attend and qualify the mandatory training as and when nominated by CS.I (Training) Section of this Department, (if not already done), failing which they shall have no claim for inclusion in the regular select list of Assistant.

5. The willingness of the Officials on deputation as to whether they are willing to revert bacic to the Cadre with a view to avail of the promotion will be obtained by the Ministry / Department from where the Official(S) have proceeded on deputation.

6. Procedure rewarding deployment of surplus officials:

A cadre unit consists of sub-cadre units as well. Choices of the UDCs of the sub-cadre who are to be promoted as Assistant may be obtained and deployed In the cadre units/sub-cadre units. For example, if 10 UDCs are covered In the list who are to be promoted as Assistant and only 6 posts are available in the cadre unit and sub-cadre unit put together, the 6 ad-hoc Assistants (Senior most) shall be allotted as per their choices and the details of the remaining 4 officials (Junior most) alongwith their preferences shall be sent to CS.II Division for their onward deployment in those cadre units where there are surplus vacancies. The DPC proceedings and the promotion of the officials as Ad-hoc Assistants in the manner as indicated above shall be completed as quickly as possible and no case later than 18.02.2015. The details of the surplus officials who could not be accommodated in the cadre unit/sub-cadre unit shall be sent to CS II Division before 19.02.2015 positively.

7. All the cadre units are requested to take necessary action and the whole process may be completed on top priority basis within 18.02.2015. A copy of the appointment order may be endorsed to this Department. A report indicating the name and details of the UDCs who have been appointed/promoted to the post of Assistant on ad-hoc basis as well as those who have not been found fit, with reasons therefore, may be sent to this Department by 19th February. 2015 in the prescribed proforma enclosed.

The undersigned is directed to refer to this Department’s O.M of even number dated 3rd July, 2014 on the subject mentioned above, vide which Cadre units were permitted to continue ad-hoc appointments in the grade of UDCs up to 31.12.2014. Further continuance of these appointments has been reviewed in this Department and it has been decided that the period of the ad- hoc appointment of those LDCs of CSCS who are working as UDCs of CSCS on ad-hoc basis may be extended up to 30.06.2015 or till regular UDCs become available, whichever is earlier.

2. Continuance of ad-hoc appointment shall not confer on the appointees any justify to continue in UDC Grade indefinitely or for inclusion in the Select List of UDC of CSCS or to claim seniority in UDC Grade of CSCS.

3. Other terms and conditions mentioned in the relevant OMs will, remain unchanged.

4. Copies of the order along with the details of the officials (date of birth, date of Joining, Rank No., Select List Year, etc) may be endorsed to this Department for record.

Subject :- Promotion of LDC as UDC of Central Secretariat Clerical Service (CSCS) on ad hoc basis-continuance of Ad-hoc appointment regarding.
