Subject: Stepping up of pay of senior Assistants of CSS drawing less pay on promotion in the Section Officers Grade than their juniors - OM No.18/2/2007 - CS-I dated 20.05.2014 - Follow up action regarding.

Ref: OM No.18/2/2007-CS-1 dated 20.05.2014 & 08.07.2014 and reminders dated 09.09.14,30.04.15,13.07.15,31.07.15,11.09.15 & 01.10.15

The undersigned is directed to refer to this Department's OM of even number dated 11.09.2015 (copy enclosed) on the subject mentioned above. The compliance report, as per the format attached as Annexure-I and information sought in Annexure-II with OM dated 11.09.2015, are still awaited from Ministries/Departments, complete in all respects. The information received in bits and pieces from some Ministries/Departments have been compiled and attached as Annexure-A.

2. As per the information available in this Department, there are Six OAs (OA No.2884/2015, 3870/2015, 293/2016, 2128/2016, 2352/2016 and 3318/2016) pending before CAT, Principal Bench, New Delhi in the matter. The CAT has ordered for maintenance of status quo till the next date of hearing and stayed recovery from the salary of the applicants in some of these OAs. The same has been indicated against the officers, who are applicants in such OAs, in the attached statement (Annexure-A). There may be some more cases, which are not in the knowledge of this Department.

3. The Office of the Director General of Audit (Central Expenditure) which conducted audit of the records and accounts of the Department for the year 2014-15 has also taken a serious view of the delay occurring in recovery of Government dues. A copy of the relevant extracts of the Inspection Report is enclosed. For settling this audit para, compliance reports, complete in all respects, is required from all Ministries/Departments at the earliest.

4. The Ministries/Departments are, therefore, once again requested to furnish the compliance report in the matter, except in those cases where matter of recovery is subjudice/stayed by order of any competent court, in the prescribed format, complete in all respects, along with information sought in Annexure-II vide OM dated 11.09.2015 immediately.

Subject:- Central Civil Services (Conduct) Rules 1961 - Guidelines regarding prevention of sexual harassment of women at the workplace - regarding.

The undersigned is directed to refer to the DoPT OM number No.11013/2/2014-Estt.A-III, dated the 16th July, 2015 etc., vide which need for effective mechanism to ensure that inquiries in the case of allegations of sexual harassment are conducted as per the prescribed procedure and that they are monitored have been issued. Recently, a meeting was held under the Chairmanship of Minister, Women and Child Development wherein concern was expressed that the inquiries in such cases are taking unduly long time. It has, therefore, been decided that the following further steps may be taken to ensure that the inquiries are conducted expeditiously and the aggrieved women are not subjected to victimization:
(1) As already conveyed vide OM dated 2nd February, 2015 all Ministries/Departments shall include in their Annual Reports information related to the number of such cases and their disposal.
(2) As far as practicable, the inquiry in such cases should be completed within 1 month and in no case should it take more than 90 days as per the limit prescribed under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
(3) It should be ensured that the aggrieved women are not victimized in connection with the complaints filed by them. For a period of five years after a decision in a proven case of sexual harassment, a watch should be kept to ensure that she is not subjected to vendetta. She should not be posted under the Respondent, or any other person where there may be a reasonable ground to believe that she may be subjected to harassment on this account. In case of any victimization the complainant may submit a representation to the Secretary in the case of Ministries/Departments and Head of the Organization in other cases. These representations should be dealt with sensitivity, in consultation with the Complaints Committee, Ministries/Departments and Head of the Organization in other cases. These representations should be dealt with sensitivity, in consultation with the Complaints Committee, and a decision taken within 15 days of the submission of the same.
(4) All Ministries/Departments shall furnish a monthly report to the Ministry of Women and Child Development giving details of number of complaints received, disposed of and action taken in the case.

Subject: Launching/Introduction of New Recruitment Rules Formulation, Amendment
Monitoring System (RRFAMS) Portal - reg.


At present, the proposals for framing/amendment of RRs are first processed in the on-line mode through RRFAMS portal. The proposal received on this portal is scrutinized in DOP&T and preliminary observations are conveyed through the system. Thereafter the Ministries/Departments send their proposals along with comments received in the RRFAMS and necessary Annexure, hierarchy chart etc. in the physical file.

2. It has been decided to launch a fully computerized/online system of examination of RRs and to dispense with the requirement of sending physical file to DOP&T. This system would further be extended in future so that a similar on line scrutiny/approval of the proposal of framing/amendment of RRs are undertaken by UPSC and DOLA without the need reference of physical file for finalization of RRs.

3. In this regard the existing RRFAMS system has been upgraded and following new features have been added:

    (i) Uploading of existing RRs/post creation/abolition etc.

    (ii) Hierarchy chart

    (iii) On line system for examination and approval of RRs for Group ‘C’ posts within the Ministry.

4. Before the launch of the above portal, it has been decided to have a preparatory meeting wherein a trial run of the new system will be made. All the Ministries/Departments are requested to nominate a nodal officer at the level of Under Secretary who may bring the relevant proposal along with all necessary documents to fill-up the proposal on the new RRFAMS portal, as per the schedule given in Annexure.

Updating Bank Details of Public Authorities (PAs) in RTIMIS for transfer of 'RTI Fees' and 'Additional Payment' received through RTI online portal

Subject: Updating Bank Details of Public Authorities (PAs) in RTIMIS for transfer of  'RTI Fees' and 'Additional Payment' received through RTI online portal - reg.

With reference to the subject mentioned above, the undersigned is directed to say that, as per existing procedure, the 'RTI Fees' and 'Additional Payment' received by the Public Authorities (PAs) through RTI online portal, are being deposited into the consolidated account of Government of India. However, of late, demands have been received from several PAs (other than the Central Ministries/Departments) for transfer of 'Additional Payments' & 'RTI Fees', to their respective bank accounts.

2. In the light of suggestions and feedbacks received from various PAs (i.e. attached /subordinate offices, autonomous bodies and PSUs etc) who are currently using RTI online web portal of DoP&T, it has been decided to initiate the process where the amount received from the citizen in form of 'RTI Fees' and 'Additional Payments' (if any) will be credited to the concerned PA's bank account.

3 . Accordingly, all Nodal Officers of attached/subordinate offices, autonomous bodies and PSUs (other than the Central Ministries/ Departments) are requested to update the Bank details of their respective organization on their RTI online portal. NIC has already provided facility to Nodal Office to fill in their bank details online. This data can be used by the bank for transferring the 'fees' to the concerned organization/PAs.

RECORD NOTE OF THE DISCUSSION ON DOPT-SPECIFIC ALLOWANCES, HELD WITH THE STAFF-SIDE, NATIONAL COUNCIL (JCM) AT 3.00 P.M. ON 25.10.2016 UNDER THE CHAIRMANSHIP OF SECRETARY(P).

A discussion on the DoPT-specific allowances with the Staff-Side National Council (JCM) was held at 3.00 p.m. on 25.10.2016 under the Chairmanship of Secretary(Personnel) in Room No. 119, North Block, New Delhi in compliance with the direction contained in the minutes of the 2nd meeting of the Committee on Allowances held on 01.09.2016 that every Ministry/Department should firm up its views/comments on allowances relating to the Ministry/Department after holding discussion with their Staff Associations.
List of participants is at Annexure.

At the outset JS(JCA) welcomed all the members of the Staff side of the National Council of JCM to the discussion on department specific allowances. JS(JCA) informed that in the second meeting of the Committee on Allowances it was decided that all the department specific allowances will be discussed with the JCM. After a brief introduction it was decided to discuss the following department specific allowances on which DOPT has received the comments for Staff-Side.

Children Education Allowance (CEA)

The Staff-Side has stated that the benefit of Children’s Education Allowance should be extended to the Graduate and Post Graduate levels also. They have informed that the private institutions are charging exorbitantly. So, subject to a ceiling on tuition fees and hostel fees, the CEA should be extended to the Graduates and Post Graduates level. Staff-Side has informed that they had also represented to the Pay Commission for simplifying the procedure wherein they had suggested that reimbursement should be based on the bonafide certificates from the schools where the children are studying. This suggestion has been accepted by the Pay Commission and the Staff-Side has requested that it should be implemented.

On the issue of DOPT’s circular on e-receipt, Secretary, DoPT clarified that this circular had been issued before the government accepted the 7th Pay Commission recommendation.

Night Duty Allowance (NDA)

Staff-Side has pointed out that the Night Duty Allowance (NDA) is still being paid at the 4th CPC rate. Even though there is a Board of Arbitration award in favour of employees that from 01.01.1996 it should be given in the 5th CPC pay scale, the government did not accept the arbitration award and even today employees are getting it at the same rate as it was prevalent during the 4th CPC period.

In the Ministry of Defence a lot of litigation had taken place and the matter went up to the Supreme Court. Hon’ble Supreme Court directed that it should be paid on the basis of the actual pay drawn and that NDA should be revised w.e.f. 01.04.2007 at the 6th CPC pay scale which has been implemented by the government. However, the audit authorities came up with an objection that there is a ceiling for it which has been objected to by the Staff-Side.

Apart from that, the 7th Pay Commission has recommended that it should be worked out with the actual pay of the employee being the criterion. However, in spite of that, except for the Ministries of Defence and Railways, employees working in other Ministries/Departments are getting it at 4th CPC rate. Thus, the absence of uniformity on this allowance across Ministries/Departments is very glaring which, according to the Staff-Side, is a principal source of litigation and will continue to remain so. Therefore, the Staff-Side has suggested that an early revision of the NDA without ceiling, and on the basis of the actual basic pay, and extending it to whoever is asked to do night duty will go a long way in reducing litigations in the future.

Over Time Allowance (OTA)

Staff-Side has pointed out that there are two types of over time duty. One is covered under the Factories Act, 1948, and the other is for the office staff. In the first case, since it is a statutory obligation, the Pay Commission has not recommended anything on it. But for those Central Government employees who are not covered under the statutory provisions of the Factories Act, OTA is paid at a single rate of Rs.15.85/- only and, that too, for the first hour immediately after the scheduled office closing time, it is Nil. In case of OTA there is also an arbitration aw-ld from 01.01.1996 that it should be at par with the 5th CPC pay scale. However, neither it has been implemented nor have the rates been revised.

The Staff-Side has stated that if an employee is asked to work after hours the rate of OTA should be as per 7th CPC pay scale. Staff-Side is of the opinion that overtime means working after office hours, and asking an employee to work beyond office hours automatically entitles him/her to this allowance. The over time rates should also be above the normal level. It was pointed out by them that as per 7th CPC, an MTS is paid @ Rs.75/ hour; whereas overtime allowance is @ Rs. 15.85/- only. Even an outsider employed on casual basis is being paid hourly wages which are more than OTA. The Staff-Side is strongly of the view that if government is deploying a person on overtime work then he has to be paid at least according to the rate of salary which he is getting

Cash Handling Allowance (CHA)

Staff-Side has informed that the 7th CPC recommendation on its abolition is based on the fact that in most of the offices today salary disbursement is not made in cash. It is credited to the individual bank accounts. But cash transactions do take place in certain offices like the Post Offices where cash handouts are made under the Mahatma Gandhi National Rural Employment Guarantee Act. PLI is also another example. Therefore, if it is stopped all of a sudden, no person will show interest in working as cashiers and take the additional responsibility of handling huge amounts of cash. Therefore, the Staff-Side has contended that till all cash transactions are eliminated, CHA should continue.

It was also pointed out by them that this allowance depends on the amount of cash transaction; when the volume of cash transaction comes down, the allowance will also proportionately come down.

Uniform related allowances subsumed in a single Dress allowance (including shoes)
Staff-Side has informed that the 7th Pay Commission has recommended that Persons Below Officers Rank (PBOR) should be given Dress Allowance @ Rs.10,000/- per month. There are 5 Ordnance Factories under Ministry of Defence where persons are exclusively deployed to produce special high altitude dresses for the combat forces of the army. 12000 employees are working in these 5 factories. Therefore, if a uniform rate like this is maintained, it will have an adverse impact on the quality of these high altitude uniforms and will thus jeopardise the safety of the armymen and the nation as a whole. Staff-Side is stated to have already made a request to M /o Defence not to implement this recommendation. Army has also taken a stand that this will result in substandard or sub quality material. So this recommendation on the Dress allowance for PBOR should not be implemented.

As far as Civilian employees are concerned, it has been stated that the 7th CPC has recommended four slabs of Dress Allowances for various categories. One of the categories is called ‘others’. Whereas, in the Department of Posts there are about 75,000 postmen and Multi Tasking Staff wearing uniform. There is no mention about these postmen and multi tasking staff in any of the categories shown by the Pay Commission. If it is presumed that they come under ‘Others’, then they will be getting Rs. 5,000 whereas at present they are getting around Rs. 7,000 plus washing allowance. As such a separate category should be there for postmen and MTS also and the allowance should be Rs.10,000/-

It has also been pointed out that there are many categories like canteen employees, security staff, chowkidars which have not been mentioned and who are eligible for uniform or uniform allowances. It has to be clarified whether these categories will be covered under ‘others’. Staff-Side has stated that whosoever is getting Dress Allowance as on today should continue to get that. Staff-Side has also informed that the recommendations on Dress Allowance have created a lot of discrimination among staff working in similar circumstances.

Staff-Side has also drawn attention to the Dress Allowance with respect to the Nursing Staff. It has been stated that earlier also Nursing Staff were not given normal washing allowance or dress allowance considering the importance or the peculiar conditions prevailing in hospitals. Now they have also been bracketed in the general category. They were getting Rs.750 as Uniform Allowance and Rs. 450 as Washing Allowance per month. Now there is no separate category that has been given to them. For them a different dispensation was made taking into account their special requirements because they work in such an environment where their uniforms require regular washing entailing a substantial expenditure. As these have not been accounted for in the 7th CPC, the nursing staff should have a special dispensation, as is strongly felt by the Staff-Side.

JS (JCA) has requested Staff-Side to submit a note on the justification or break-up of the amount of Rs.32,400(maximum) as suggested by them and the Staff-Side has agreed to provide the same.
Secretary, DOPT summed up the demands of the Staff-Side by observing that those who were getting Dress Allowances, their allowances should not come down. And the categories of the employees which had special dispensation in the past and have not been mentioned this time or have been clubbed together with other categories need clarification.

Risk Allowance

The Staff-Side has informed that Ministry of Defence is engaged in arms and ammunitions manufacturing etc. In the process of manufacturing them, the staff engaged for this purpose, have to handle hazardous chemicals, acids and so many other poisonous combinations. Cabinet has approved 45 risk operations pertaining to Defence civilian employees. Apart from that, because of the technological developments taking place fast and as the requirement of the armed forces is increasing for getting modern equipments, ammunitions and explosives, new risk operations have also come into existence of which Ministry of Defence is aware and have recommended also accordingly. In spite of this, the existing Risk Allowance has been abolished by the Pay Commission. It has been pointed out by the Staff- Side that it has not been subsumed under the risk and hardship matrix. Rather it comes in the abolition list. In no matrix are the risk operations of Defence civilians are covered. Staff-Side has informed that they have discussed this with Defence Secretary and Defence Ministry is going to recommend in favour of its inclusion in one of the matrix.

In response to the query of Secretary, DOPT as to whether the activities which have been considered to be risky have all been identified, Staff-Side has clarified that it has been identified by a high level committee and approved by the Cabinet. 45 risk operations have been identified and approved. But within a period of 2 decades, lot of new ammunitions and new explosives have come in the arsenal, along with a lot of hazardous chemicals and acids. So, M/o Defence has again appointed a committee and they have identified that all these are additional risk operations over and above the 45 identified, where Defence Civilian employees are actively involved. But the Pay Commission has abolished Risk Allowance. So this has to be incorporated in one of the risk matrix.

Other Items

Staff-Side has pointed out that in the 7th CPC report it has been stated that any allowance not mentioned and hence not reported to the Commission shall cease to exist immediately. They have requested that this recommendation should be rejected. On the contrary, the administrative Ministries should come forward and recommend for their abolition or retention.

Staff-Side has also stated that 7th CPC has abolished all advances completely. Noting that we regularly celebrate a number of festivals like Diwali, Holi, Eid and keeping the general sentiment in mind, they are of the view that advances are very necessary. Moreover, these advances are required to be paid back to the government.

On Family Planning Allowance, the Staff-Side has stated that since the Government has not changed its Family Planning policy, the allowance should be continued. At least in the case of those people who were getting it they should continue to get as they have fulfilled all conditions when the allowance was granted. Otherwise there will be drop in their emoluments.

Subject: Timely and advance action in convening of Departmental Promotion Committee meeting in terms of Model Calendar - regarding.

The undersigned is directed to state that with a view to having the approved select panels for promotion ready in advance in a time-bound manner, this Department has issued a Model Calendar for DPCs vide OM No. 22011/9/98-Estt. (D) dated 8 th September, 1998 as modified vide OM No. 22011/4/2013-Estt.(D) dated 28.01.2015. An indicative pattern has been provided in the Model Calendar for various events involved in the pre/ post DPC related actions. All the Ministries/Departments have been impressed upon from time to time by this Department to adhere to the prescribed time-line so as to ensure that the panel is ready in time and is utilised as and when the vacancies arise during the course of the vacancy year.

2. It has been brought to the notice that many promotion posts are lying vacant due to abnormal delay in convening DPCs. The objective of timely promotions of employees in various Ministries/Departments can be achieved only by holding DPC meetings.

3. In view of above, all Ministries/Departments are again advised to ensure strict compliance of instructions in order to achieve the desired objectives of timely convening of DPCs/preparation of approved select panels within the prescribed time frame.

Applications are invited for filling up the Senior Private Secretary in the Customs, Central Excise & Service Tax, Settlement Commission, Additional Bench, Chennai on deputation basis:

Eligibility Criteria

Central Government employees:-
a) holding analogous post on regular basis; or
b) with three years regular service as Private Secretary in the posts carrying the pay scale of Rs.6500-200 - 10,500/- (pre-revised); or
c) with seven years combined service in the pay scale of Rs.500-9000 (pre revised) or Rs. 6500-10500 (pre-revised) or equivalent in the parent cadre/Department in the Stenographer cadre.
The period of deputation shall be initially for one year extendable up to three years. The pay of the officers/officials selected will be regulated in accordance with DOPT instructions. The maximum age limit for appointment shall not exceed 56 years as on the closing date of receipt of applications.

The application in the prescribed Proforma (Annexure-I) from eligible officers/officials who can be spared in the event of their selection may be forwarded directly to the Additional Commissioner at the address mentioned below within 30 days from the date of issue Advt. along with (a) up-to-date CR dossiers of the candidate concerned of photocopies of annual confidential reports for the last five years; (b) vigilance clearance report clearly 'indicating that no disciplinary or criminal proceedings vigilance clearance report clearly indicating that no disciplinary or criminal proceedings are either pending or contemplated against the official concerned; (c) statement showing the minor/major penalties imposed, if any, and (d) integrity certificate.

Incomplete applications or applications not received through proper channel or applications received after the specified date shall not be entertained and would be straight-way rejected.

The undersigned is directed to say that a meeting of Committee of Secretaries (CoS) under the chairmanship of Cabinet Secretary was held on 30.10.2012 on the above subject. The CoS , inter-alia, has recommended for compilation of the action taken by Ministries/Departments in compliance with the Olvls/Circulars issued in respect of the recommendations regarding :
  • Compliance to the standard check list while sending cases to UPSC for advice
    (DoP&T's OM No. 39011/12/2010-Estt.(B) dated 14th September, 2010);
  • disposal of all pending cases for sanction of prosecution (DoP&T's OM No. 372/64/2010 -AVD-III dated 23rd December, 2010);
  • deciding all cases where disciplinary inquiry has been under contemplation.
    (DoP&T's OM No. 372/55/2010-AVD-III dated 28th December, 2010); and
  • deciding all pending disciplinary inquiries (DoPT's OM No. 372/55/2010-AVD III dated 28th December; 2010)

Subject : Clarification of the Definition of “Members of Family” in the context of Rule 4 regarding. The undersigned is directed to say that as per rule 4 (1) of CCS (Conduct) Rules, 1964, no Government servant shall use his position or influence directly or indirectly to secure employMent for any member of his family in any company or firm. Further, rule 4(3) reads as follows:
“No Government servant shall in the discharge of his official duties deal with any matter or give or sanction any contract to any company or firm or any other person if any member of his family is employed in that company or firm or under that person or if he or any member of his family is interested in such matter or contract in any other manner and the Government servant shall refer every such matter or contract to his official superior and the matter or contract shall thereafter be disposed of according to the instructions of the authority to whom the reference is made.”
2. As per rule 2 of the CCS (Conduct) Rules, 1964, the definition of “Members of Family” may differ from that given in the rule 2, sub clause (c) in the context of a rule. For removal of doubts it is clarified that in the context of rule 4(1) and 4(3) “Members of family” in relation to a Government servant include the wife or husband, son or daughter, parents, brothers or sisters or any person related to any of them by blood or marriage, whether they are dependent on the Government servant or not. 3. All Ministries/ Departments/ Offices are requested to bring the above guidelines to the notice of all Disciplinary Authorities under their control. 4. Hindi Version follows.

Sub: Change of date of holiday on account of Id-ul-Fitr during 2016 for all Central Government administrative offices located at Delhi / New Delhi.

As per list of holidays circulated vide this Ministry’s 0.M.No.12/7/2015-JCA-2 dated the 11th June, 2015, the holiday on account of Id-ul-Fitr falls on Wednesday the 6th July, 2016. It has been brought to notice of this Ministry that in Delhi Id-ul-Fitr will be celebrated on 7th July, 2016. Accordingly, it has been decided to shift the Id-ul-Fitr holiday to 7th July, 2016 in place of 6th July, 2016 as notified earlier, for all Central Government administrative offices at Delhi / New Delhi.

2. For Offices outside Delhi / New Delhi the Employees Coordination Committee or Head of Offices (Where such committees are not functioning) can decide the date depending upon the decision of the concerned State Government.

Frequent asked questions (FAQs) on the issue of residence/domicile and caste/tribe certificates

Q.1. What is the purpose of issuance of Residence/domicile certificate to the students belonging to SC/ST and other than SC/ST while they are studying in Class V/VIII?
Answer: The residence/domicile certificate is to be issued by the concerned authority of State Government/Union Territory to certify that the person bearing the certificate is a domicile/resident of State/Union Territory to whom the certificate being issued. Such certificate is issued as proof of residence to avail domicile/resident quota in educational institutions and in the State/Central Government services and also in the case of jobs where preference to local candidates is available as per Government of India instructions issued from time to time.

Q.2. Who will be eligible to be issued the Residence/Domicile as well as Caste/Tribe certificates ?
Answer: SC/ST students will be eligible to be issued the Domicil certificate and also Caste/Tribe Certificate, as the case may be. Other students will be eligible to be issued only the Residence/Domicile certificate.

Q.3. What is the objective behind issuance of residence domicile certificates and caste/Tribe certificates at School level?
Answer: In order to avoid difficulties faced by the SC/ST students, it has been proposed that “Caste or Tribe Certificate” and also the Domicile certificate may be issued to SC/ST students and only a Residence Certificate may be issued to other than SC/ST students all over the country, while studying in Class V or Class VIII, as an annual exercise. The State Government can choose either Class V or Class VIII to issue this certificate. Once Class V or VIII is chosen, the endeavour should be to issue it to all the students studying in that particular class.

Q.4. Who will assist the students in getting the necessary documents/papers filled as an annual exercise for issue of Residence and also Caste/Tribe certificate?
Answer: The Head Master/Principal of the School in which the students are studying would get the necessary documents/papers filled up from the students studying in Class V/VIII as an annual exercise for issue of Resident and also Caste/Tribe Certificate. The School Head Master/Principal will get the documents collected from all the SC and ST students and also other than SC/ST students and arrange to submit them to the relevant State Government authority/revenue authorities for making the requisite certificate.

Q.5. What would be the proposed time frame set up for completing the exercise for issuance of residence/domicile certificates and caste/tribe certificates to the students studying in VNIII classes?
Answer: A window of two months in September/October or any other time frame decided by the concerned State Government/Union Territory may be allocated /decided for completing this exercise.

Q.6. What is the objective behind the issuance of caste certificates to Scheduled Castes and Scheduled Tribes?
Answer: The main objective of issuance of caste/tribe certificate is to facilitate access of bona-fide candidates belonging to the Scheduled Castes and Scheduled Tribes to the reserved posts and services under the State/Central Government and secure admission in educational institutions and other facilities being provided by the State/Central Government to them.

Q.7. How much time would be taken by the State authorities for issuance of such certificates?
Answer: The concerned Revenue/State Government authorities would scrutinize/verify the documents and issue the relevant certificates preferably within a period of 30 — 60 days.

Q.8. Who would be the custodian of such certificates?
Answer: Once the certificate is made, it may be given to the students in cellophane cover, as far as practicable, though the School authorities and would be kept with the students for safe custody for availing the benefits/concessions and facilities available to the concerned category of students. It can also be uploaded on E-locker facilities, wherever such facilities are available in the States.

Q.9. How can the authenticity of data be verified ?
Answer: The State Government may also try to get the information of students fed into the Meta Data to be made online and may link it to Aaadhar enabled data, if feasible. Sincere efforts be made to issue these certificates alongwith Aaadhar Number.

Q.10. What remedy is available to the students if their application for issuance of residence/domicile and caste/tribe certificate is rejected?
Answer: If the application of any student is rejected for issuance of the relevant certificate, the reasons will be provided and provision for one time appeal may be allowed by the State authorities. The procedure for appeal would be decided by the concerned State Government authorities.

Q.11. Who will be responsible where acceptance for SC/ST domicile certificate is mandatorily done through Citizen Services Centres?
Answer: In states where acceptance for SC/ST domicile certificate is mandatorily done only through Citizen Service Centres, it will be the responsibility of the Headmaster of the School for collection of the documents and ensuring that the application is digitally sent to the concerned authorities from the nearest Citizen Service Centres. If there is already a time limit prescribed by the State authorities through executive order or regulation for issuing such certificates, then such time frame may be adhered to.

Q.12.What is the existing procedure for issuing of Scheduled Caste/Scheduled Tribe certificates? Who is the competent authority to issue the same?
Answer: Caste certificates are issued by the concerned State Government authorized authorities. Each State Government/UT administration has laid down its own procedure for issuance of certificates. Efforts are being made to standardize the format of the certificate as far as possible. Wherever feasible, efforts be made to issue the certificate in bilingual including the language (s) of the State. The Central Government accepts the certificates issued by the following authorities on the prescribed format:-
(1) District Magistrate / Additional District Magistrate/Collector/ Deputy Commissioner/Additional Deputy Commissioner/Deputy Collector/Ist Class stipendiary Magistrate/Sub Divisional Magistrate/Taluka Magistrate/Executive Magistrate/Extra Assistant Commissioner.
(2) Chief Presidency Magistrate/Additional Chief  residency Magistrate/Presidency Magistrate.
(3) Revenue Officer not below the rank of Tehsildar and
(4) Sub-Divisional Officer of the area where the candidate and /or his family normally resides.
Instructions have been issued recently vide 0.M.No.36011/1/2012- Estt.(Res.) dated 8th October 2015 providing that where a candidate belonging to a Scheduled Caste, Scheduled Tribe and Other Backward Classes is unable to produce a certificate from any of the prescribed authorities, he/she may be appointed provisionally on the basis of whatever prima-facie proof he/she is able to produce in support of his/her claim subject to his/her furnishing the prescribed certificate within a reasonable time and if there is genuine difficulty in his/her obtaining a certificate, the appointing authority should itself verify his/her claim through the District Magistrate concerned.

Q.13. What are the points/facts/factors taken into account by the competent authority while issuing residence/ domicile and caste/Tribe certificates?
Answer: The certificate issuing authority should verify and ensure that:
(i) the caste or the tribe to which the candidate claims to belong to is included in the Presidential Orders issued from time to time under Articles 341 and 342 of the Constitution;
(ii) the candidate belongs to the said caste/tribe;
(iii) the candidate ordinarily resides in the concerned State or part of
that State etc. (The term ‘ordinarily resides’ has the same meaning as in section 20 of the Representation of Peoples Act 1950).

Q.14. What is the procedure adopted for verification of antecedents and claims of the applicants before issue of such certificates and how the place of permanent abode of the applicant
is ascertained?
Answer: States/UTs have their own procedure for verification of antecedents and claims of the applicants to belong to a Scheduled Caste/Scheduled Tribe including ascertainment of the permanent residence of the candidates.

Q.15.What are the guidelines that have been issued to the appointing authorities in regard to scrutiny and verification of caste certificates of candidates at the time of their entry into Government
service?
Answer: The Government of India has issued instructions regarding scrutiny and verification of the caste certificates of the candidates at the time of initial appointment and promotion against reserved vacancies. This Department re-iterated the instructions vide O.M. No.36011/3/2005-Estt. (Res.) dated 9th September 2005.  5 .These guidelines would ensure that the benefit of reservation goes to genuine Scheduled Caste/Scheduled Tribe candidates only and reserved vacancies are not occupied by unscrupulous non-SC/ST candidates.

Q.16. Whether the Government contemplates to draw a permanent mechanism to look into the anomalies that have crept into the whole procedure of issuance, verification and cancellation of SC/ST certificates and also for initiating disciplinary and penal action against holders/producers of the false caste certificates?
 Answer: The caste certificates are issued, verified and cancelled by the authorities of the respective State Governments. Each State Government has its own system/procedure in this regard. However, if it is found that a Government servant had produced a false caste certificate in order to secure appointment, action against him/her is required to be taken as per instructions contained in the Department of Personnel & Training’s 0.M.No.11012/7/91-Estt.(A) dated 19-5-93 which provides that wherever it is found that a Government servant, who was not qualified or eligible in terms of the recruitment rules etc. for initial recruitment in service or had furnished false information or produced a false certificate in order to secure appointment, he should not be retained in service. If he/she is a probationer or a temporary Government servant, he should be discharged or his services should be terminated. If he/she has become a permanent Govt. Servant, an inquiry as prescribed in Rule 14 of CCS (CCA) Rules, 1965 may be held and if the charges are proved, the Government servant should be removed or dismissed from service.

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 — Relaxation to travel by private airlines to visit Jammu & Kashmir – Extension reg.

The undersigned is directed to refer to this Ministry’s O.M. No. 31011/3/2014- Estt.(A-1V) dated 26th September, 2014 where Government servants in relaxation to CCS(LTC) Rules, were allowed to travel by air to visit Jammu & Kashmir (J&K), North East Region (NER) and Andaman & Nicobar Islands (A&N) on LTC for a period of two years against conversion of one block of Home Town LTC. The relaxation was given subject to air travel by Air India only.

2. Later vide DoPT’s O.M. of even no. dated 28.11.2014, the Government decided to allow travel by private airlines to visit Jammu & Kashmir under this special dispensation scheme subject to certain conditions. The scheme was valid for a period of one year from the date of issue of the O.M. and expired on 27.11.2015.

3. It has now been decided to extend the scheme for a further period from the date of issue of this O.M., till the date of expiry of the of the special dispensation scheme of travel by air to J&K, NER and A&N, i.e. 25.09.2016. All other terms and conditions prescribed in this Department’s O.M. dated 28.11.2014 shall continue to apply.

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 — Relaxation to travel by private airlines to visit J&K.

The undersigned is directed to refer to this Ministry’s O.M. No. 31011/3/2014- Estt.(A-1V) dated 26th September, 2014. It has been decided that the Government servants while availing Leave Travel Concession (LTC) to Jammu and Kashmir (J&K) under the special dispensation scheme allowed by the aforesaid O.M. may also travel by private airlines subject to the following conditions:-
(i) Officers entitled to travel by air may also travel by private airlines from their headquarters;
(ii) Officers not entitled to travel by air may be permitted to travel by private airlines between Delhi /Amritsar and any place in J&K.
2. Air travel by private airlines is to be performed in Economy Class only an at LTC-80 fare of Air India or less.

3. Air Tickets to be purchased directly from the airlines (Booking counters, website of airlines) or by utilizing the service of Authorized Travel Agents viz. ‘M/s Balmer Lawrie & Company’, ‘M/s Ashok Travels & Tours’ and ‘IRCTC’ (to the extent IRCTC is authorized as per DoPT’s O.M. No. 31011/6/2002-Estt.(A) dated 02.12.2009) while undertaking LTC journey. Booking of tickets through other agencies is not permitted.

4. All other conditions prescribed in this Ministry’s O.M. No. 31011/3/2014-Estt.(AIV) dated 26.09.2014 would continue to apply.

5. The order will remain in force for a period of one year from the date of issue of this order.

Sir,
As you are aware Government of India has launched Swachh Bharat Mission to achieve total sanitation and cleanliness by 2nd October, 2019. It has, therefore, been desired that each Ministry, based on the Ministry’s areas of responsibility, draw out and implement at least a fortnight long action plan every year to bring into focus, its contribution towards Swachh Bharat Mission and also to carry out substantive work related to Swachhta.

2. As a step towards this direction, this Department has prepared an action plan, to involve Pensioners’ Associations identified under Pensioners’ Portal in this mission, with special reference to ‘Swachh Bharat Pakhwada’ being observed during May 16-31, 2016. Under the proposed action plan, Pensioners’ Associations are expected to:-
(i) Organize a mass pledge by members of Pensioners’ Associations (copy enclosed)
(ii) Sensitize their members on cleanliness in their neighborhood.
3. In view of above you are requested to observe the Swachh Bharat Pakhwada during May 16¬31, 2016 by organizing the above activities by involving members of your Pensioners’ Associations.

4. You are also requested to take photographs of activities undertaken by you during the Pakhwada and send the same along with a report on the activities undertaken by your Association, immediately after duration of the Pakhwada, for uploading the same on Pensioners’ Portal website.

Subject: Bye Election to fill the clear vacancies in Lok Sabha and State Legislative Assemblies of Meghalaya, Arunachal Pradesh, Jharkhand, Gujarat, Uttar Pradesh and Telangana – Grant of Paid Holiday -regarding

The undersigned is directed to say that in connection with the Bye Election to Bye Election to fill the clear vacancies in Lok Sabha and State Legislative Assemblies of Meghalaya, Arunachal Pradesh, Jharkhand, Gujarat, Uttar Pradesh and Telangana – Grant of Paid Holiday – to be held on 16th May, 2016, the following guidelines, already issued by DOPT vide OM No. 12/ 14/99-JCA dated 10th October 2001, which would have to be followed for closing of the Central Government Offices including Industrial Establishments in the States of Meghalaya, Arunachal Pradesh, Jharkhand, Gujarat, Uttar Pradesh and Telangana.

(i) The relevant offices / organizations shall remain closed in the notified areas where Bye Election to the State Legislative Assemblies scheduled to be conducted.

(ii) In connection with bye-elections to State Assembly, only such of the employees who are bona-fide voters in the relevant constituency should be granted special casual leave on the day of polling. Special Casual leave may also be granted to an employee who is ordinarily a resident of constituency and registered as a voter but employed in any Central Government Organization/ Industrial Establishment located outside the constituency having a general/ bye-election.

2. The employees detailed on election duty may also be permitted to remain away from their normal duties on polling day(s) as also on the days required for performing journeys which might be undertaken in order to perform such election duty

3. The above instructions may be brought to the notice of all concerned.

Subject: Grant of Dearness Relief to CPF beneficiaries in receipt of ex-gratia payment w.e.f 01.01.2016.

In continuation of this Department’s OM No. 42/10/2014-P&PW(G) dated 28th Oct, 2015, the President is pleased to grant the Dearness Relief at the rate of 5th CPC w.e.f. 1.1.2016 to the following :
The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12.1985 and are in receipt of ex-gratia @ Rs.600/-p.m. w.e.f. 01.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 & revised to Rs.3000, Rs.1000, Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&PW(E) dtd. 27th June, 2013 are entitled to Dearness Relief @ 245% w.e.f. 01.01.2016.

(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 are entitled to DR ©237 % w.e.f. 01.01.2016.
(a) The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m. & revised to Rs 645/-p.m with effect from 04th June ,2013 vide OM No. 1/10/2012-P&PW(E) dated 27th June,2013.

(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs. 659/-, Rs. 703/- and Rs. 965/-.
2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.
In their application to the Indian Audit and Accounts Department, these orders issue in consultation with the C&AG.
3. This issues as per Ministry of Finance, Department of Expenditure vide their OM No 1(4)/EV/2004 dated 25.05.2015 and OM No.1(3)/2008-E.II(B) dated 22.04.2016.
