Respected Madam,

Every year Bonus is declared to the Central Government Employees before Durga Puja. Now Durga Puja celebrations will start from 17 October 2020 and Dussehra will be celebrated on 25th October 2020, but the bonus has not been declared yet.

It is therefore requested to kindly cause orders for payment of Bonus to Central Government Employees before Durga Puja so that they may celebrate the Festival happily.

Confederation strongly oppose premature retirement of Central Government Employees, completed 30 years of service and attained age of 50 - 55 years

The Department of Personnel and Training has issued an office memorandum on 28th August, 2020 that allows it to prematurely retire government servants even if they are within the 50 to 55 age groups or have completed 30 years of service.

Confederation of Central Govt. Employees and Workers strongly oppose the move of Government of India to unilaterally and arbitrarily imposition of provisions of rules FR 56 (J) and rule 48 (h) pension rules to retire the Govt Employees prematurely and forcibly vide the OM No. 25013/03/2019-Estt-A IV dated 28. August 2020 issued by Department of Personal and Training, Govt. of India.
The above mentioned OM gives the power to Government to cause premature retirement of any Govt. official who has completed 30 years of service and attained age of 50/55 years on various vague grounds as such “doubtful integrity”, “ineffectiveness” and When petty allegations.
This OM gives infinite power to the authority to pick and choose the targeted employees for such forced premature retirement. The victim employee will not be given any opportunity to explain as natural justice demands. After retirement, he can approach advisory committee appointed by the Govt. of India.
This shows the autocratic attitude of Govt. of India towards the bask rights of employees and unions and in violation of Labour laws.
Confederation of Central Govt. Employees and workers strongly oppose such an authoritarian and arbitrary move of Govt. of India and demand for withdrawal the said OM forthwith.
If this OM is not withdrawn the Central Govt. Employees will be compelled to launch serious agitational programmes.

Sir,
On the recommendations of the V CPC, Transport Allowance was introduced subsuming CCA W.e.f 1st January, 1997. After two revisions at par recommendation of VI and VII CPC, at present, admissibility of Transport Allowance under different conditions viz. Leave, Deputation, Tour and Suspension etc. is regulated under G.O.I, Min. of Finance, Dept. of Expenditure OM No. 21/5/2017E.II (B) dated 07.07.2017, as par Para 3(a) the Allowance will not be admissible for the calendar month(s) wholly covered by leave.

Incidentally it may kindly be noted that Govt. of India, Min. of Finance, Dept. of Expenditure has not yet clarification of “leave” as in the OM dated 17.07.2017 in the context of changed situation. Under normal dispensation Dept. of Expenditure is the competent authority to clarify/ interpret or modify and provision relation to Transport Allowance.

On scrutiny of various OMs issued on different dates by MHA containing Guidelines, Advisories and Standard Operation Procedure as part of measures for containment of COVID-19, it is revealed that Offices of the Govt. of India, its Subordinate Offices other than exempted category are to function with 100% attendance of Deputy Secretary and levels above that. Remaining officers and staff are to attend up to 33%. Moreover, above guideline is subject to strict adherence to restrictions applicable to RED ZONE/ CONTAINMENT ZONE. As per instructions, employees residing in such Zones can attend office only when allowed by the local authorities of concerned State Govt. etc. or restriction is relaxed. As per the above OMs the public transports including suburban train services were under total suspension till first 4 phases of lockdown. Further, as per Standard Operation Procedure of Min. of Health & Family Welfare, the period of work from home shall not be treated as leave.

A good number of employees who commute from considerable distant places could not attend the office during the months making own arrangement, although, they were inclined to attend their duties being physically present in the offices premises. Further, according to the guidelines of Min. of Health & Family Welfare as well as Ministry of Home Affairs is “to stay at home”, “work from home” to the extent possible, so as to curb the spread /outbreak of the COVID-19. During this period the entire surroundings of the National Library was under Containment Zone as per Govt. of West Bengal notification. In the Ministry of Home Affairs Order dated 15.04.2020 it was also clearly stated, “In these containment zones, the activities allowed under these guidelines will not be permitted….. that there is no unchecked inward/outward movement of population from these zones….. The guidelines issued in this regard…… will be strictly implemented….” Therefore some employee, though willing, could not come, even they have tried their best to join their duties.
This being an unprecedented situation, the condition of one-day attendance in a month, for payment of Transport Allowance, needs to be dispensed with and Transport Allowance for the month of April & May 2020 should not be disallowed.

Your immediate intervention in this matter is highly solicited with a request to issue revised direction to the administration of the National Library and Central Reference Library for payment/settlement of Transport Allowance for the month of April 2020, etc.

Central Government’s decision to freeze three instalments of Dearness Allowance (DA) of Central Government Employees and Dearness Relief (DR) of Pensioners from 01.01.2020 to 30.06.2021 is a severe and unexpected blow to the Central Government Employees and Pensioners. Already most of the Central Government employees and Pensioners have contributed one day’s salary and Pension to PM CARES Fund.

Confederation strongly oppose and protest the unilateral decision of the Central Government. We demand the Government to review the decision immediately and withdraw the DA & DR freezing orders.

The Confederation of Central Government Gazetted Officers Organizations has sent a proposal to the Prime Minister of India, Shri Narendra Modi, to consider the possibility of closing Central Government offices in the country by 31.03.2020 or any other date as deemed appropriate to avoid spreading Coronavirus.

Sub: Preventive measures for containment of the spread of Novel Coronavirus (COVID-19) - matter regarding

Kindly refer to the above.

Since the outbreak of Novel Coronavirus in China and subsequently around the world including India, Government of India and the State Governments have issued several advisories, initiated many preventive measures and imposed restrictions, closures invoking certain acts to contain the spread of Novel Coronavirus in India. Personal hygiene including adoption of certain practices, social distancing and quarantine or isolation in suitable cases are appeared to be the key for containment of the spread of the COVID-19 virus. The entire country is fighting this battle unitedly under your able leadership and guidance, when, in your words, the way ahead lies in collaboration, not confusion, and in preparation, not panic, and we will definitely win this battle too.

DoPT Preventive measures to be taken to contain the spread of Novel Coronavirus (COVID-19)

As a guiding measure, DoPT has also issued a detailed advisory for the Central Government offices. In many Central Government Departments, administrations are definitely trying their best to extend all possible support to the employees as per Government guidelines, but several Central Government offices across the country are still lagging in this regard. However, such efforts will only partially address the huge risk posing to the employees.

Being the workers in public office, it is not possible for the Central Government employees to maintain social distancing while in office. Most importantly, more than 98% of the employees have to commute to office using public transport at a time when the Government advisories are suggesting to avoid public transport as far as possible.Despite certain measures being taken in office, our employees thus remain vulnerable to infection due to commuting in public transport to attend office and other unavoidable interaction in office.

Considering this aspect, educational institutions, theatres, malls and several other places have been directed for closure in most of the states till a certain period to minimize commutation in public transport and ensure social distancing. For the same reason, several organizations/ companies have directed their employees to work from home.

As we are probably entering into the most crucial phase (observing the pattern in other affected countries), when there is a chance of exponential increase of infected persons, it is requested to your good self to kindly consider the option of closing Central Government offices (excluding those providing essential services and/or engaged in the country’s present fight against the disease outbreak by any means) across the country till 31.03.2020 or any other date, as deem fit. We believe that it will be an appropriate step in the greater public interest including ensuring safety and well being of the Central Government employees.

Abnormal delay is taking place in declaration of Bonus & DA. Normally, DA is declared in September. Bonus is declared well ahead of Pooja holiday. But this time, till today no orders are issued. To protest against this abnormal delay, Confederation of Central Govt. Employees & Workers CHQ calls upon all affiliates and C-o- Cs to hold protest demonstration in front of all offices from today onwards till Bonus & DA is declared. Higher form of action will be decided by National Secretariat,If Govt refuses to declare DA & Bonus.

Disposal of notice for grant of macp from 01.01.2006 instead of 01.09.2008

In this connection. it is to inform that various Writ Petitions have been filed by Ex-BSF personnel before the Hon’ble High Court of Delhi for grant of MACP benefits w.e.f. 01.01.2006 instead of 01.09.2008. in accordance with the judgment passed on 08.12.2017 by the Hon’ble Supreme Court in U01 V/S Balbir Singh Turn (Civil Appeal No. 3744 of 2016). The Writ Petitions, were listed before the Hon’ble High Court of Delhi and during the hearing, the Hon’ble High Court has directed to withdraw these petitions with liberty to first approach the respondents with proper notice setting out the full particulars of each of the petitioners separately as stated by the Learned Counsel for the respondents

In this regard, various representations dated 15.03.2019 were served by Shri 0 P Agarwal. Advocate, Supreme Court and High Court of Delhi, on behalf of the Ex-BSF personnel for considering their cases for grant of MACP from 01.01.2006 instead of 01.09.2008.

In this regard, it is intimated that, earlier in a similar case, in compliance to the Hon’ble High Court of Delhi vide order dated 21.08.2018 in WP(C) No.3549 of 2018 filed by Sum! Kumar Tyagi V/s U01 & Ors before Hon’ble High Court of Delhi, case was taken up with DoP&T through MHA to consider grant of MACP w.e.f, 01.01.2006 instead of 01 09.2008 in accordance with the decision dated 08.12.2017 of the Hon’ble Supreme Court of India in the case of Balbir Singh Turn & Anr However. after detailed consideration of the case, DoP&T did not accede to the proposal for grant of MACP w.e.f. 01.01.2006.

2019 September 19th is the 51st Anniversary of 1968 September 19th one day strike. All leaders and workers who led and participated in that historic strike have either retired from service or are no more.

The indefinite strike of Central Govt. Employees in1960 was the first major strike of Central Govt. Employees after independence. The five days strike from 1960 July 11 midnight was brutally suppressed by the Central Government declaring it as “Civil Rebellion”. The main demand of the strike was improvement and modifications in the 2nd CPC recommendations. The Need Based Minimum Wage, though adopted by the 15th Indian Labour Conference in 1957, was rejected by the 2nd CPC.

The Joint Consultative Machinery (JCM) was constituted in 1966 by then Home Minister Guljarilal Nanda, as per the decision of the Government. The apprehension of the progressive leadership that this negotiating machinery may not settle any major demands of the Central Govt. employees and may become just a talking shop or a time killing business, ultimately resulting in abnormally delaying the genuine demands, came true within a year of its formation. In the very first meeting of the National Council JCM, the following three demands were notified by the staff side.
  1. Grant of Need Based Minimum Wage as approved by the 1957 Tripartite Labour Conference.
  2. Merger of DA with Pay
  3. Revision of DA formula
After prolonged discussion for about one and a half year, disagreement was recorded. As per JCM Scheme once disagreement is recorded, the item should be referred to compulsory arbitration. But Govt. rejected the demand for arbitration. Protesting against this arbitrary stand of the Govt. the staff side leadership walked out of the JCM and decided to go for one day’s strike. A Joint Action Committee was formed and the date of the strike was decided as 19th September 1968. Even though, the INTUC affiliated organisations were initially a part of the strike decision, later on they decided not to join the strike due to the intervention of the then Congress Government headed by Smt. Indira Gandhi.

The following were the main demands of the strike charter of demands.
  1. Need Based Minimum Wage.
  2. Full neutralisation of rise in prices.
  3. Merger of DA with Basic Pay
  4. Withdrawal of proposal to retire employees with 50 years of age or on completion of 25 years of service.
  5. Vacate victimisation and reinstate victimised workers.
  6. No retrenchment without equivalent alternative jobs.
  7. Abolition of Contract and Casual Labour System.

Strike notice was served and the Joint Action Council (JAC) decided to commence the strike at 06:00 AM on 19th September 1968. Intensive campaign was conducted throughout the country. AIRF, AIDEF and Confederation was the major organisations in the JAC. Govt. invoked Essential Services Maintenance Ordinance (ESMO) to deal with the strike. Govt. also issued detailed instructions to impose heavy penalty including suspension, dismissal, termination, Break-in-service etc. on the striking employees. Para-military force (CRPF) and Police were deployed to deal with the strike. Central Govt. gave orders to all state Governments to suppress the strike at any cost. It was a war-like situation. Arrest of Leaders started on 18th September itself. About 3000 employees and leaders were arrested from Delhi alone. All over India about 12000 Central Government employees and leaders were arrested and jailed.

Inspite of all these brutal repressive measures the strike commenced on 18th after noon itself at many places and was a thundering success all over India and in all departments including Railway, Defence, P&T etc. About 64000 employees were served with termination notices, thousands removed from service and about 40000 employees suspended. Seventeen (17) striking employees had been brutally killed at Pathankot, Bikaner, Delhi Indraprastha Bhavan and in Upper Assam lathi charge, firing by police and military and by running the train over the bodies of employees who picketed the trains.

Though the strike was only for one day on 19th September 1968, the victimisation and repression continued for days together. Struggle against victimisation also continued including work-to-rule agitation, hunger fast of leaders from 10th October 1968. There was unprecedented support to the strike and relief work and also to agitation for reinstatement of the victimized workers, from National Trade Unions, state employees and teachers Unions / Federations etc. A mass rally was organised before the residence of Prime Minister of India Smt. Indira Gandhi on 17th October, 1968.

Kerala was ruled by the Communist Govt. during the strike. Chief Minister Com. E.M.S.

Namboodiripad declared Kerala Govt’s full support to the strike of Central Government employees. The Central Govt. threatened dismissal of the Kerala Govt. for defying the Centre’s directive to suppress the strike.

1968 September 19th strike is written in red letters in the history of Indian Working Class. The demand raised by the Central Govt. employees - Need Based Minimum Wage - was the demand of entire working people of India. Even today, the Central Govt. employees and other section of the working class are on struggle path for realization of the Need Based Minimum Wage. The demand of the Central Govt. employees to modify the recommendations of the 7th Central Pay Commission to ensure Need Based Minimum Wage is not yet conceded by the BJP-led NDA Government. Even the assurance given by three Cabinet Ministers including Home Minister, Finance Minister and Railway Minister regarding increase in Minimum Pay and Fitment formula is not honoured by the Govt. even after a lapse of three years and entire Central Government employees feel cheated.

It is in this background, last year we have celebrated the 50th year of 1968 September 19th strike all over the country in a befitting manner. On the 51st anniversary of the historic strike, let us pledge that we shall continue our struggle for realization of the demands raised by the martyrs of the 1968 strike. Let us pay respectful homage to those valiant fighters who sacrificed their life for the posterity. Let us salute and honour all those who participated in the historic strike, especially those who had been victimized severely for joining the strike.

Sub: Memorandum on the long pending demands of the Central Government employees - Request for kind intervention - regarding.

This Memorandum is submitted with the most fervent hope that the Hon’ble Prime Minister will be condescend to intercede on our behalf to settle the following long pending issues agitating the minds of 32 lakhs Central Government employees and 33 lakhs Central Govt. Pensioners.

1. Scrap New Contributory Pension Scheme (NPS) and restore Defined benefit Old Pension Scheme (OPS). Guarantee 50% of the last pay drawn as Minimum Pension.

Government of India has implemented New Contributory Pension Scheme (NPS) for all Central Govt. employees entering service on or after 01-01-2004. When compared to the Old Defined Benefit Pension Scheme (OPS) there are many adverse factors in the NPS. The monthly pension amount being received under the Insurance Annuity Scheme under NPS is less than Rs.3000/- per month, to those NPS employees who had already retired from service during 2018 and 2019, after completing 14 to 15 years of service, whereas as per the Old Pension Scheme an employee who completes minimum ten years qualifying service will get 50% of the last pay drawn as Minimum Pension which in any case will not be less than Rs.12,000/- for a lowest level employee (Multi Tasking Staff) with ten years service in Central service. Thus the very principle laid down by the Hon’ble Supreme Court of India that “Pension is a social welfare measure rendering socio-economic justice to those, who in the hey day of their life ceaselessly toiled for the employer on an assurance that in their old age, they would not be left in lurch”, stands defeated.

Seventh Central Pay Commission headed by Retired Justice of Supreme Court Shri. Ashok Kumar Mathur, in its report made the following observations about NPS:

Almost a whole lot of Government employees appointed on or after 01-01-2004, were unhappy with the New Pension Scheme. Government should take a call to look into their grievances”.
Govt. appointed a Secretary level committee called “NPS Committee” for streamlining the NPS, but that committee was not empowered to look into the main demand of the NPS employees i.e., scrap NPS, restore OPS and guarantee 50% of the last pay drawn as monthly pension. It is true that as per the recommendations of the NPS Committee, Govt’s contribution to NPS is increased to 14% from 10% and some other cosmetic changes are also made in the NPS Rules. But the basic grievance still remained unattended and unsettled, as a result uncertainty about the social security and Pension looms large over the head of every NPS employee, and the discontentment among the NPS employees (as correctly observed by 7th CPC) is growing day by day. We request the Hon’ble Prime Minister to have a relook into the entire matter, so that NPS will be scrapped and OPS will be restored and at least 50% of the last pay drawn will be guaranteed under Rules as Minimum monthly Pension on retirement.

2. Honour the assurances given by Group of Ministers on 30-06-2016 to National Council (JCM) Standing Committee members regarding increase in Minimum Pay and fitment factor recommended by Seventh Central Pay Commission (CPC) :

All the Federations/Unions/Associations in the Central Govt. Employees sector including Railways, Defence and Confederation had given a call for nationwide indefinite strike from 11th July 2016, demanding increase in Minimum Pay and Fitment formula recommended by Seventh CPC and other 7th CPC related issues. A goup of Cabinet Ministers including Shri. Rajnath Singh, then Home Minister, Shri. Arun Jaitley, then Finance Minister, Shri. Suresh Prabhu, then Railway Minister discussed the demands with the leaders of National Joint Council of Action (NJCA) and assured that Minimum Pay and Fitment formula will be increased and a High Level Committee will be appointed to submit recommendations in this regard. The assurances were reiterated by Shri. Rajnath Singh, then Home Minister on 6th July 2016 in the second round of discussion and Finance Ministry issued a press statement confirming the assurances. Accordingly, the proposed indefinite strike call of the NJCA was deferred, taking in good faith the assurances given by the Group of Ministers. We are sorry to bring it to the notice of the Hon’ble Prime Minister that even after a lapse of three years, neither the promised High Level Committee is constituted by the Govt. nor the Minimum Pay and fitment formula is increased. The entire employees feel betrayed. We request the Hon’ble Prime Minister to take immediate necessary action for implementing the assurances given by the Group of Ministers.

3. Grant “Option-I Parity” recommended by the 7th CPC to all Central Government Pensioners.

7th CPC has recommended a new formula called “Option-1” for refixing the existing pension of Central Government Pensioners retired prior to 01-01-2016. Government accepted the recommendation in principle and constituted a Secretary level committee to examine and recommend regarding the feasibility of implementing ''option-1'' recommended by 7th CPC. The Committee was not, ready to heed the valid and scientific pleadings made by the staff-side in favour of the recommendation mode by 7th CPC which is an ''Expert Body'' headed by retired Justice of Supreme Court, instead viewed the case with a closed mind and gave recommendation to the Government that implementation of Option-I is not feasible. Govt accepted the recommendations of the Secretary Level Committee and rejected ''option-I'' recommended by 7th CPC.

The entire Pension community is very much aggrieved of the decision of the Government. We request the Hon’ble Prime Minister to review the case dispassionately, so that the ''option-I party'' recommended by the 7th CPc will be accepted by the Government.

4. Regularisation of Gramin Dak Sevaks working in Postal Department and casual/contract workers working in all Central Govt Establishments.

(a) About 2.76 lakhs Gramin Dak Sevaks are employed in the Postal Department. Govt. appointed a one man committee headed by retired Postal Board Member Shri Kamalesh Chandra, to examine their wages and service conditions. The final report submitted by the Committee includes certain positive recommendations. As abnormal delay took place in implementing the recommendations of the Report, the entire Gramin Dak Sevaks went on indefinite strike for 16 days in 2018. Finally Govt issued orders, but many recommendations are either modified, diluted or rejected, including payment of arrears from 01-01- 2016 as per the formula recommended by the Committee, Children education Allowance, Promotions, etc, etc., We request the Hon’ble Prime Minister to take a lenient view to rederess the grievances of the low-paid Gramin Dak Sevaks which includes regularisation of their services and also implementation of the pending positive recommendations of the Kamalesh Chandra Committee report.

(b) There are thousands of causal/contract employees and workers engaged in all Central Govt departments and working for years together. They are not paid equal wages and not extended any benefits of regular employees. Even after working for more than ten years continuously, their request for regularisation is not considered favourably. There is no scheme to absorb them in regular service. We request the Hon’ble Prime Minister to consider their case sympathetically so that a scheme will be worked out to regularise all casual/contract workers and extend them all the benefits of regular employees.

5. Stop Corporatisation/ Privatisation of Railways, Defence and Postal Departments. Withdraw the orders for closure/reorganisation of Govt. of India Printing Presses, Geological Survey of India (GSI), Central Public Works Department (CPWD), Salt Department, Stationery Offices etc.

The no holds barred big bang reforms unleashed by the Central Government has given rise to an alarming situation in the Central Government Departments. The proposed move to Corporatize Railway Production Centres and allowing private passenger trains, Corporatisation of Defence Ordinance Factories, Life Insurance and Parcel Sector of Postal department, closure of Govt. of India Printing Presses, proposed reorganisation of Salt Department, Geological Survey of India (GSI), Central Public Works Department (CPWD), Stationary Offices etc. has put in danger the very existence of various Central Govt. Departments and also the job security of lakhs of Central Govt. Employees, Gramin Dak Sevaks and Casual/Contract Workers. The present fate of the Telecom Department which was corporatized in 2000 into different companies is a bitter lesson for all of us. We request the Hon’ble Prime Minister to desist from the proposed move to corporatisation, privatisation, closure and reorganisation of Central Govt. departments.

6. Filling up of seven lakhs vacancies existing in various Central Govt. Departments:
As per the 7th CPC report (Annexure to Chapter-3) there are 7,47,171 vacancies in the Central Govt. Departments as on 01- 01-2014. More retirements has taken place after 01-01-2014 and now the figure may go upto 8 lakhs. During the period from 2001 to 2008, thousands of posts are abolished in all Departments as per the downsizing orders issued by the Government in 2001. Only very few posts are filled up after 2014 and most of the Departments are running with 30 to 40% shortage of manpower. This has resulted in heavy increase in workload on the existing employees and has adversely affected the efficiency of all Central Govt. Departments to a great extent. We request the Hon’ble Prime Minister to take immediate necessary action for filling up all vacant posts in all departments of Central Government.

7. Revision of Wages from 01-01-2016 and payment of arrears of pay and Bonus from 2016 onwards to the employees of Autonomous bodies:
We regret to inform the Hon’ble Prime Minister, that due to the stringent conditions imposed by the Finance Ministry, the pay revision from 01-01-2016 and payment of arrears is still pending in most of the Autonomous bodies under Central Government. Further they are denied Bonus from 2015-16 onwards. We request the Hon’ble Prime Minister to take necessary action to redress the long pending genuine grievances of the Autonomous body employees.

There are other issues also which is already submitted to the Cabinet Secretary and the Heads of various Ministries/Departments earlier by us. We are enclosing herewith a copy of the Charter of Demands containing the important problems faced by the Central Govt. Employees and Pensioners.
Concludingly, we once again request the Hon’ble Prime Minister to be sympathetic enough to redress the grievances mentioned in this memorandum and enclosed Charter of Demands.

10 Points Charter of Demands of Confederation

  1. Scrap New Contributory Pension scheme (NPS). Restore Old defined benefit Pension Scheme (OPS) to all employees. Guarantee 50% of the last pay drawn as Minimum Pension.
  2. Honour assurance given by Group of Ministers (GoM) to NJCA leaders on 30-06-2016. Increase Minimum Pay and Fitment formula. Withdraw the proposed move to modify the existing time-tested methodology for calculation of Minimum wage. Grant HRA arrears from 01-01-2016. Withdraw “Very Good” bench mark for MACP, Grant promotional hierarchy and date of effect from 01-01-2006. Grant Option-I parity recommended by 7th CPC to all Central Govt. Pensioners. Settle all anomalies arising out of 7th CPC implementation.

  5. (a) Regularisation of Gramin Dak Sevaks and grant of Civil servant status. Implement remaining positive recommendations of Kamalesh Chandra Committee report.
    (b) Regularise all casual and contract workers including those joined on or after 01-09-1993.
  6. Ensure equal pay for equal work for all. Remove disparity in pay scales between Central Secretariat staff and similarly placed staff working in field units of various departments.
  7. Implement 7th CPC Wage Revision and Pension revision of remaining Autonomous bodies. Ensure payment of arrears without further delay. Grant Bonus to Autonomous body employees pending from 2016-17 onwards.
  8. Remove 5% condition imposed on compassionate appointments. Grant appointment in all eligible cases.
  9. Grant five time bound promotions to all Group B & C employees. Complete Cadre Review in all departments within a time-frame.
  10. (a) Withdraw the anti-worker wage/labour codes and other anti-worker Labour reforms. Stop attack on trade union rights. Ensure prompt functioning of various negotiating forums under the JCM Scheme at all levels.
    (b) Withdraw the draconian FR 56 (j) and Rule 48 of CCS (Pension Rules 1972.

Ref: 1) Minutes of National anomaly Committee Meeting held on Tuesday 17th of July 2018, circulated Vide DOP&T OM No. 11/2/2016-JCA-I (Pt.), dated 31st Jan. 2019.

The Staff Side of the National Council (JCM) is repeatedly representing to consider the demand for granting of one more option to switch over to the 7th CPC pay scales on a date which is beneficial to the employees. Vide our letter referred at (2) above, the reference of the Judgment of CAT Bombay Bench in OA No.45/12 pronounced on 29/06/2017 was also referred. In this Judgment the CAT has directed to grant him option to switch over to 6th CPC from a date which is beneficial to the employee, since he has agreed to surrender the arrears already drawn. This Judgment was also implemented by CGDA.

In the meantime, the aggrieved employees of Ordnance Factory Ambajhari under the Department of Defence production, Min. Of Defence approached the CAT Bombay Bench claiming for grant of one more option to switch over to 7th CPC pay scale. After 25/07/2016/ option to switch over to 7th CPC as on date on increment on 01/07/2016. The CAT after hearing the parties have given a direction to the respondents to consider the representation of the applicants keeping in view the aforesaid DOPT OM dated 08/07/2019, through which the minutes of the Standing committee National Council (JCM) was circulated and has directed the DOP&T to take a decision on the subject matter within a period of 6 weeks from the date of receipt of the copy of the Judgement.

Since the matter is getting unduly delayed the affected employees have started approaching to Court of law to get their grievance settled. This defeats the spirit of the JCM scheme. I therefore request you to kindly arrange to issue Govt. orders for revising the option to switch over to 7th CPC pay scale on the following two situations:
1) Option to switch over to 7th CPC to those employees who are promoted/granted MACP after 25/07/2016.
2) Option to switch over to 7th CPC as on date of increment on 01/07/2016.
‘In this regard kindly refer to ‘the illustration given in our letter dated 22nd March 2018. (copy enclosed for ready reference). We request you to kindly arrange to issue necessary instruction in this regard without further delay.

It has come to notice that AILRSA has given a call for Hunger Strike: 24Hrs Hunger Fast' and 'Chakka Jam' on the issues of (i) Revision of KMA rates as per 1980 formula; (ii) Parity in Pension for Running Staff Pensioners; (iii) Implementation of Safety Committee recommendations; (iv) Retention of Railways in Service sector under the Government; (v) Withdrawal of NPS and restoration of OPS; and (vi) Against the 100 days’ Action Plan for Railway Privatisation; (vii) Issues related to Crew Beat and their working hours etc.

In view of aforesaid, there should not be any room for complacency on the part of the Railway administrations and all necessary stringent steps must be taken to ensure discipline and smooth functioning of rail movement. It most he ensured that Railway Servants need to seek necessary permissions from the Competent Authority on their respective Railways/ Production Units to leave their headquarters.

Their particular attention should be drawn to relevant penal provisions i.e. Section 173, 174 and 175 of the Railways Act, 1989 which are attracted in cases of abandoning train without authority, obstructing running of train and endangering the safety of persons by disobeying rules etc.

In case any Railway Servant participates in the aforementioned protests including 'Hunger Strike', 'Chukka Jam' etc, a report indicating the number of Railway Servants who took part in such protests should be conveyed to Board’s office on the evening of 15th , 16th and 17th July, 2019.

Subject: No requirement of an NOC for the renewal/change of address in the Driving Licence

Madam/Sir,
The driving license issued by any licensing authority in any state is valid throughout India and the license-holders is authorized to drive the specified class or classes of vehicles as per the licence in terms of the provisions of the motor vehicles Act, 1988 or the or the Central Motor Vehicles Rules, 1989.

1. The practice of obtaining an NOC from the previous licencing authority was followed primarily with a view to checking the authority of the licence,as to whether it was indeed issued/endorsed by the previous authority and that the licences was not linked with any offence. This practice came to be adapted initially when the Diving Licences were issued in manual mode/regime and also subsequently during the decentralized operations of earlier off-line software versions of SARATHI. Now, with the current version of SARATHI Wherein all Driving Licenses are issued following a IT based application system and the details are verifiable from the database in an on-line mode, there is no need for seeking an NOC for verification of such details as per the provisions of the aforesaid Act or Rules.

2. It has been brought to the notice of this Ministry that many States are still sticking to the practice of obtaining NOC from the parent authority in both cases. i.e renewals and change of address of the driving licence. This not only caused disparity in the implementation process but has a potential of undue harassment to the applicant. In case, when a user moves from one place or State, which does not issue NOC to another place or State, which requires an NOC, the applications are rejected due to the lack of such NOC.

3. The SARATHI database contains the information of the driving licences issued by the states. Accordingly, it is advised that whenever an application for renewal or transfer of address is reserved the concerned competent authority may check the particulars online available in the SARATHI database Further, the details can also be validated using e-challan mobile application. This approach would not require the citizens to visit or approach the original Licencing Authority for getting NOC.

4. It is requested that all the Licensing Authorities be directed to stop forthwith and discontinue any old process of verification in manual mode and follow the online verification of the driving licenses for facilitation of the citizens

AUAB rejects the proposal of the Management for deferring the salary for the month of February 2019 - AUAB also rejects the appeal of the Management to withdraw the strike

A meeting between the AUAB and the BSNL Management was held today at 17.30 hrs. Shri Anupam Srivastava, CMD, BSNL, Ms.Sujatha.T Ray, Director (HR & Finance) and Shri A.M.Gupta GM (SR) were present. From AUAB, Com.P.Abhimanyu, Convener, Com.Chandeswar Singh, Chairman, Com.K.Sebastin, GS, SNEA., Com. Prahlad Rai, GS, AIBSBNLEA, Com.Pathak, AGS, AIGETOA., Com.Suresh Kumar, GS, BSNL MS, Com.H.P.Singh, Dy. GS,BSNLOA and Com.S. Sivakumar, President, AIBSNLEA participated.. The CMD, BSNL explained the serious financial crisis being faced by the BSNL and appealed for the cooperation of the AUAB, for deferring payment of the salary for the month of February 2019. The AUAB representatives firmly rejected the request of the CMD, BSNL. They told in one voice that payment that the payment of salary of employees should not be deferred. Thereafter, the CMD, BSNL said that the 3 days strike called on by the AUAB from 18-02-2019 will be self-defeating and appealed to call off the strike. The representatives of the AUAB rejected the appeal of the CMD, BSNL and reaffirmed that the strike will take place at any cost. They told the Management that the repeated assurances given by the Hon'ble Minister of State for Communications are not implemented by DoT and that the strike will now take place successfully.. The AUAB told the HB Management in categorical term that there is no question of going back from the decision to go on strike.

The BJP led NDA government has once again attempted to throw jumlas on the face of suffering people of India through its vote on accounts (interim budget). The announcements made are with forthcoming elections in mind, just throwing statistics without any basis. On one hand side it is a cruel joke on the marginal farmers who hold land up to 2 hectares which number about 86 % of total farmers in the country offering rupees 17 per family per day. The rural landless poor who work in the fields and related agricultural activities have been offered nothing.

There is nothing in the budget statement to address unemployment which has reached highest in last 45 years. Nothing offered for job creation, no steps announced to fill up the already sanctioned central and state government posts. Hence the youth is once again cheated.

Those who should be covered in EPF in India should be about 10 crore workers which actually are yet not fully registered and hence all of them not been covered for pension. It is those registered only who are already being covered for pension that the pronouncement in this budget to be benefiting with pension of rupees three thousand where as demand of these workers is for pension not less than 7500. There is nothing in the budget for about 35 crore of unorganized sector workers other than the 10 crore workers who are covered under EPF. The working class is also betrayed contrary to the claims being made by the prime minister and the finance minister in regard to providing dignity to the workers. Nothing announced about the demand of Rs 18000 minimum wage to workers about 45 crore of them who were hoping against hope. The false claim of control on price rise is another insult on the people who are finding it too difficult to run their kitchens in the face of steep rise in the prices of every day essential items.

No tax increase on corporates or wealth tax which are very necessary to meet the present crisis ridden economy of the country. The hollowness of the government and its camouflaging ways were on display through this interim budget.

According to the said O.M. Government has decided to discontinue OTA for categories other than Operational Staff and industrial employees.

2. As per para 1 of this OM "Ministries/Departments to prepare a list of those staff coming under the category of "Operational Staff. The following definition shall be used to define Operational Staff.
"All non-ministerial non-gazetted Central Government servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment."

3. In this regard, it is requested to prepare a list of operational staff with full justification based on the above parameters for inclusion of a particular of a particular category of staff in the list of operational staff and submit it to this office latest by 04.02.2019.

The two days nationwide strike on 2019 January 8th & 9th was not only widespread but a thundering and magnificent success in all respect, surpassing all the recent past strikes in percentage of participation. Of course, there was weakness in some sections and in some areas, but that didn’t affect the overall success and impact of the strike.
When the dominant leadership of the JCM National Council staffside and National Joint Council of Action (NJCA) ie., Railway Federations, are reluctant to go on strike against the betrayal of the BJP-led NDA Government on Minimum Pay & Fitment formula, NPS, Option-I of Pensioners, HRA arrears etc, inspite of the fact that Confederation and Defence Federation has authorised the Railway Federations leadership to serve strike notice reviving the deferred indefinite strike of 2016 July 11th, it is Confederation, Confederation alone, has shown its commitment to the cause of the 32 lakhs Central Government employees and 33 lakhs Central Govt. Civilian Pensioners, by organising two days historic strike along with the 20 crores workers of Indian working Class.

Confederation organised one day strike on 12-12-2012 and two days strike on 2014 February 13th & 14th demanding appointment of 7th Central Pay Commission, One day strike on 16-03-2017 demanding scrapping of NPS and honouring of assurance given by Group of Ministers and one day strikes on 2nd September 2015 and 2016 along with the mainstream of the working class against the neo-liberal economic policies. We decided to go on strike, demanding 10 points charter of demands of which the first and the main demand is "Scrap NPS & Restore OPS" in the mass convention of Central Government employees held at Hyderabad on 10th June 2018. Intensive campaign for the strike started from July 2018 onwards.

The message of the two days strike went to every nook and corner of the country and reached almost all central Govt. Offices and employees including Gramin Dak Sevaks, Casual/Contract Workers and Autonomous body employees and Pensioners. We are proud that we have stood with the workers and peasants of our country as a class-oriented militant trade union and Confederation represents the hope and aspirations of lakhs and lakhs of Central Government Employees and Central Govt. Civilian Pensioners.
NDA GOVERNMENT AND CENTRAL GOVT. EMPLOYEES - OUR EXPERIENCE:
(1) NEW CONTRIBUTORY PENSION SCHEME (NPS):
Everyone of us is aware that it is the previous BJP-led NDA Government which introduced the NPS in 2003 through a Gazette Notification dated 22nd December 2003, to all new entrants recruited on or after 01-01-2004. We are also aware that the Congress-led UPA-II Government passed the PFRDA Bill in Parliament to legalise NPS, with the full support of opposition BJP MPs in 2013 and thereafter PFRDA Act came into effect from 18th September 2013. Only 43 MPs of Left Parties, TMC, JDU, BSP, SP & RJD opposed the bill in Lok Sabha against 125 votes of Congress & BJP. In Rajya Sabha 25 MPs opposed while 115 supported. Confederation along with All India State Govt. Employees Federation (AISGEF) conducted series of agitational programmes against NPS from 2003 onwards including National Convention, Parliament March, signature campaign and strikes.

7th Central Pay Commission headed by Shri. Ashok Kumar Mathur, Retired Justice of Supreme Court of India, in Para 1.24 of its Report made the following observations:

"Almost a whole lot of Central Government employees appointed on or after 01-01-2004 were unhappy with the New Pension Scheme. While National Pension System (NPS) did not form a part of our Terms of Reference; we have recorded the sentiments of the affected employees. The Government should take a call and step into to look into their demands".

In Para 10.03.11, the 7th CPC again made the following comments:

"The larger Federations and Staff Associations advocated scrapping of the NPS on the ground that it discriminate between two sets of Government employees. Individuals covered under NPS have pleaded for reverting to Old Pension Scheme (OPS) on the grounds of uncertainty regarding the actual value of their future pension, on the face of market related risks."

Naturally, in tune with the recommendations of 7th CPC, when the NDA Govt. decided to appoint a High Level Committee called "NPS Committee", the Central Government employees, especially the younger generation, expected that their anxiety and concerns will be taken into account by the Central Government and NPS will be scraped and OPS will be restored. But the final decision of the Government not to scrap NPS but only to increase the percentage of contribution by the Government from 10% to 14% was a great blow to the NPS employees. Their hopes are shattered, "their legitimate aspirations are guillotined" and a situation is created where their "hopes ended in despair".
Their hope faded further when Shri. Arun Jaitley, Finance Minister, in his letter dated 3rd January 2019 addressed to Shri. Nitin Gadkari, another Cabinet Minister in the NDA Government, justified the continuation of NPS as follows:

"NPS is expected to provide old age income security to subscribers besides providing capital for the social and economic development of the economy".

The final blow came when the NDA Government made its stand clear without any ambiguity in a reply dated 25-12-2018 given in Parliament stating that - "Representations have been received which inter-alia also include the demand that Government may revert to Old defined benefit pension system. However, due to the rising and unsustainable pension bill and competing claims on the fiscal, there is no proposal to replace the National Pension System (NPS) with Old Pension System (OPS) in respect of Central Govt. employees recruited on or after 01-01-2004".

During the past 2-3 years many NPS employees, mainly Gramin Dak Sevaks and Casual Labourers promoted to departmental posts after 01-01-2004 (as their previous service is not treated as regular service) and also aged dependents of deceased employees who got compassionate appointment after 01-01-2004 etc, retired from service after completing 10 to 13 years service. Their Annuity Pension under NPS is Rs.700/- to Rs.2700/- maximum per month, thus confirming our apprehension that “NPS is nothing but No Pension System".

Unlike the BJP led NDA Government at the Centre, certain State Governments understood the seriousness of the situation and they have declared that they want to scrap NPS. (Delhi, Andhra Pradesh, Tamilnadu during Jayaalitha’s time, Karnataka and Kerala Governments). Some of them appointed expert Review Committees to work out modalities for coming out of NPS. From the stand taken by the above State Governments it can be seen that it is the political stand of the ruling party that matter. At the centre, it is the political stand of the Political Party ruling the country which is crucial.

2. Minimum Pay and Fitment Formula:

After the continuous struggle by Confederation including strikes from 2011 onwards, the then UPA Government was compelled to announce appointment of 7th Central Pay Commission. Gujarat State Government objected the decision of the UPA Government to appoint 7th CPC. Shri. Narendra Modiji was the Chief Minister of Gujarat at that time. After coming to power at the Centre in 2014, the BJP led NDA Govt. made deliberate attempt and intervention to delay and deny the legitimate demands of the Central Govt. employees and Pensioners including the demands relating to Minimum Pay, Fitment Formula, HRA from 01-01-2016, Option-I for pensioners etc.

When the entire Central Government employees ,under the banner of National Joint Council of Action (NJCA) decided to go on indefinite strike from 11th July, 2016 a Group of Cabinet Ministers including Shri. Rajnath Singh, Home Minister, Shri. Arun Jaitley, Finance Minister and the then Railway Minister Shri. Suresh Prabhu, gave categorical assurance on 30-06-2016 that Minimum Pay and Fitment formula will be increased and for that purpose a High Level Committee will be constituted. Even after a lapse of 2½ years neither High Level Committee was constituted nor Minimum Pay and Fitment Formula is increased.

The Finance Ministry in its Lok Sabha reply dated 11-12-2018, categorically stated as follows:

"The fitment factor for the purpose of fixation of pay in the revised pay structure, based on the recommendations of the 7th Central Pay Commission is 2.57 which is uniformly applicable to all categories of employees. As the same is based on the specific and considered recommendations of the 7th CPC, no change ,thereon is envisaged".

Thus the BJP led NDA Government has betrayed 32 lakhs Central Govt. employees and 33 lakhs Central Govt. Civilian Pensioners. The Hon'ble Supreme Court in the case of Bhupendra Nath Hazarika and Another Vs. State of Assam and others (reported in 2013(2)Sec.516) observed as follows, which is quoted by 7th CPC in its preface -

"It should always be borne in mind that legitimate aspirations of the employees are not guillotined and a situation is not created where hopes end in despair. Hope for everyone is gloriously precious and that a model employer should not convert it to be deceitful and treacherous…… A sense of calm sensibility and concerned sincerity should be reflected in every step. An atmosphere of trust has to prevail and when the employees are absolutely sure that their trust shall not be betrayed and they shall be treated with dignified fairness, then only the concept of good governance can be concretized. We say no more".

The NDA Government has "guillotined" our aspirations. NDA Govt. has betrayed the employees and Pensioners and created an atmosphere where "Hopes ended in despair". NDA Govt. converted our hope to be "deceitful and treacherous", "Dignified Fairness", "Calm sensibility" and "Concerned Sincerity" in treating our case is lacking on the part of NDA Government. Hence we have no alternative but to defeat the betrayers in the coming biggest battle of democracy.

The fate of the following other demands raised by the Confederation are also met with the same fate from the NDA Government:

Regularisation of Gramin Dak Sevaks and Casual/Contract Workers. Implementation of the remaining favourable recommendations of Kamalesh Chandra Committee on GDS.
Grant of HRA arrears from 01-01-2016, removal of bench mark for MACP and grant of promotional hierarchy and date of effect of MACP from 01-01-2006.
Fill up of all vacant posts. Reintroduce Regional Recruitment for Group B and C Posts.
Implement Option-I formulation of 7th CPC for Pensioners.
Settle anomalies arising out of 7th CPC.

Parity in Pay scales between Central Secretariat Staff and similarly placed staff working in field units of various departments.
Withdraw closure orders of Govt. of India Printing Presses. Stop closure of Govt. establishments and outsourcing of Govt. functions. Stop proposed move to close down salt department.
Implement 7th CPC Wage Revision and Pension revision in remaining Autonomous bodies. Grant Bonus to Autonomous body employees pending from 2016-17 onwards.
Remove 5% ceiling on compassionate appointment and grant appointments in all deserving cases.
Grant five Assured Career Progression to all Group B and Group C employees.
Stop attack on Trade Union rights. Ensure prompt functioning of all JCM forums. Withdraw the draconian FR 56(j) and Rule 48 of CCS (Pension) Rules 1972.
ELECTION AND CENTRAL GOVERNMENT EMPLOYEES:
In a democratic country like in India, elections to the Legislative bodies are also part of the struggle against the anti-worker and anti-people policies of the ruling class. Com.K.G.Bose, the legendary leader of the Central Govt. Employees movement has observed as follows:

“It is a common say, particularly among the Government employees that the Unions should remain aloof from the politics. All the confusion has arisen because of the fact that the correct definition of the "Politics and Trade Union" has not been understood by most of us. Those two things are not separate from each other rather they are inseparable. Politics do not mean the policies of a particular political party. Each and every demand of the Govt. employees is linked with the politics of the country. It is high time that the age old confusions be removed from the minds of the Govt. employees and their unions. Collective thinking on the problems of life in the context of a nation is a fundamental right of every section of the people and therefore, the Central Govt. employees cannot be deprived of their birth right on the plea of "Political influence".

It is in the above background, we have to take position in the coming General Elections. Our experience during the last five years have proved that BJP-led NDA Government is the most anti-worker and anti-people Government the country had since independence. This Govt. is by the corporates, of the corporates and for the corporates. The working class, including Central Govt. employees, should be made aware of this challenge and prepared to defeat it. It should be kept in mind that defeat of this Government is not the end, but our struggle for reversal of the neo-liberal policies has to continue with increased vigour even after ensuring defeat of the anti-worker government. In any case, continuation of this Government is against the interest of the working class, especially the Central Govt. employees. Change is the need of the hour.

As a class-oriented militant trade union, it is our responsibility to channelize the discontentment and anger of the employees on proper direction with the objective of strengthening united struggles to defeat the neo-liberal policies and ultimately pave the way for taking the struggle towards an exploitation free society. Let us make 2019 that started with the two days historic strike, a year of heightened struggles leading to decisive struggles against the neo-liberal policies. Let us be prepared for a bigger struggle in coming days to “SCRAP NPS & RESTORE OPS” and also for the realisation of our long pending demands.

Let us not forget that the ruling class may use all tricks at their command, all weapons in their armoury to divert the attention of the people and workers, away from their burning day to day livelihood issues, to divide and disrupt their unity to engineer polarisation of the society on caste and communal lines for their electoral gains. We should be prepared to defeat all such machinations and should preserve our unity.

Let us remember the following lines from the famous speech of Late Martin Luther King, Jr -
"Change does not roll in the wheels of inevitability, but comes through continuous struggle, and so, we must straighten our backs and work for our goal."
