CITU DENOUNCES CENTRAL GOVT DECISION TO FREEZE AND CONFISCATE INCREASE IN DEARNESS ALLOWANCE FOR CENTRAL GOVT EMPLOYEES AND PENSIONERS

The Centre of Indian Trade Unions denounces the Central Govt’s decision to freeze, rather confiscate the increase in Dearness Allowance payable to Central Govt employees and pensioners falling due from January 2020 and also future dues, falling due on July 2020 and January 2021 on the plea of financial crisis arising out of COVID 19 vide Finance Ministry Order no 1/1/2020-E-II(B) dated 23rd April 2020.

No doubt, the country has been passing through a financial crisis but why should the workers and employees be made the sacrificial item for the same who themselves suffer most owing to Covid-19 followed by lockdown. Quite a number of employees are deployed and consequently are involved in various governmental activities and services meant to combat the spread of the pandemic Covid-19 especially of those departments declared as emergency services viz, health, postal, defence, railways etc. While taking such decision Govt did not bother to consult the unions and federations of the central govt employees, displaying rabid authoritarianism.

CITU strongly urges that response to financial crisis by the central govt must start with measures to garner resources where it is there aplenty at the disposal of handful of ultra rich class. As Per OXFAM Report, combined wealth amassed by only 63 billionaires in India is more that the total Union Budget in 2018-19 which was at Rs 24, 42, 200 crore. Top 10% of population cornered 77% of national wealth. Wealth of India’s richest 1 per cent is 4 times more than the bottom 70%. Govt must tap this huge accumulation of wealth with barely 5% of ultra-rich, amassed mostly through undue and illegitimate patronization of the economic policy regime, through appropriate direct taxation/wealth tax measures instead of brutally pouncing on the working peoples’ earnings and livelihood. And this right is vested with the Central Govt only

CITU strongly condemns this retrograde decision of the Central Govt to confiscate outright the legitimate dues of the employees and pensioners on account of increase in DA till January 2021, although prices of all essentials will continue to increase to further increase the profit of the big-business / corporate.

CITU demands withdrawal of this DA Confiscation order by the central government also demands that the state governments be extended financial help to enable continuity of variable DA payment to their employees. CITU calls upon the Govt employees’ movement in particular and the trade union movement in general to unitedly oppose this retrograde anti-worker measures.

OFFICE MEMORANDUM

Subject : Freezing of Dearness Allowance to Central Government employees and Dearness Relief to Central Government pensioners at current rates till July 2021.

The undersigned is directed to say that in view of the crisis arising out of COVID-19, it has been decided that the additional installment of Dearness Allowance payable to Central Government employees and Dearness Relief to Central Government pensioners, due from 1st January 2020 shall not be paid. The additional installments of Dearness Allowance and Dearness Relief due from 1st July 2020 and 1st January 2021 shall also not be paid. However, Dearness Allowance and Dearness Relief at current rates will continue to be paid.

2. As and when the decision to release the future installment of Dearness Allowance and Dearness Relief due from 1st July 2021 is taken by the Government, the rates of Dearness Allowance and Dearness Relief as effective from 1st January 2020, 1st July 2020 and 1st January 2021 will be restored prospectively and will be subsumed in the cumulative revised rate effective from 1st July 2021. No arrears for the period from 1st January 2020 till 30th June 2021 shall be paid.

Sub: Preventive measures to contain the spread of COVID19.

In continuation of this Department OM of even no. dated 17th March, 2020 (Copy Enclosed), the following further instructions are issued:

DoPT Preventive measures to be taken to contain the spread of Novel Coronavirus (COVID-19)

(i) Heads of Department (HoDs) may ensure that 50 per cent of Group B and C employees are required to attend office every day, and the remaining 50 per cent staff should be instructed to work from home. All HoDs are advised to draft a weekly roster of duty for Group B and C staff and ask them to attend office on alternate weeks. While deciding the roster for 'the first week, HoDs are advised to include officials who are residing in close proximity to their office or use their own transport to travel to the offices.

(ii) Further, the working hours for all employees who attend office on a particular day should be staggered. It is suggested that three groups of employees may be formed and asked to attend office as per the following timings:-

(a) 9 AM to 5.30 PM
(b) 9.30 AM to 6 PM
(c) 10 AM to 6.30 PM


(iii) The officials who are working from home on a particular day as per the roster drawn up should be available on telephone and electronic means of communication at all times. They should attend office, if called for any exigency of work.
(iv) Similar instructions may be issued to Attached/Subordinate Offices, Autonomous/Statutory Bodies.

Exemption to employees to mark biometric attendance in Aadhar Based Biometric Attendance System (AEBAS) March 6, 2020

(v) The Department of Financial Services (DFS) and Department of Public Enterprises (DPE) may issue similar instructions regarding Financial Institutions and Public Sector Undertakings.

(vi) These instructions shall not apply to the offices and employees engaged in essential / emergency services and those directly engaged in taking measures to control spread of COVID-19.

(vii) These orders shall be applicable with immediate effect and will remain in force till 4th April, 2020.

Confederation National Secretariat Calls upon Entire Central Government Employees
(including Gramin Dak Sevaks and Casual/Contract Workers)

To Mobilise and Participate in the 2020 January 8th Nationwide Strike
Organise Mass Dharna and Demonstrations and Rallies at all important centres and State/ District/ Divisional Headquarters on 20th December, 2019.
  • Strike to be organised on 10 points Charter of demands of Confederation (attached herewith) and also the common demands of workers adopted in the National Convention of Workers.
  • First and most important demand to be emphasized is "Scrap NPS and Restore OPS".
  • Each affiliated organisation should independently chalkout intensive campaign programmes to mobilise their entire membership to participate in the strike. Campaign tour programmes of leaders of each affiliate should be chalked out immediately. This is most important and urgent.
  • Campaign tour programmes of National Secretariat Members of Confederation will be published shortly.
  • Draft copy of the pamphlet to be distributed among all the Central Government employees will be published in the Confederation website shortly. C-O-Cs and Affiliates at state/ district level to bring out pamphlets in respective vernacular, with additions/ modifications if necessary.
  • State C-O-Cs should publish Posters with Confederation Charter of demands.
  • Strike notice along with Charter of demands will be served on 12th December, 2019.
    Confederation Central Headquarters will serve strike notice to Cabinet Secretary. All Affiliated organisations should serve strike notice to their respective Departmental heads. Copy of the strike notice should be submitted to all lower level authorities also at State/ District/ Divisional level with mass demonstrations and gate meetings.
  • Affiliated organisations should send copy of the strike notice served by them to their Departmental heads, to all their lower units and also publish the same in their websites.
  • State/ District C-O-Cs should plan their own campaign programmes and mobilisation meetings.
  • Confederation Central Headquarters has already written to the Secretary General of Confederation of Central Government Gazetted Officers Organisation (CCGGOO) requesting to participate in the 8th January 2020 strike.
  • Message of the strike and strike demands should reach each and every Central Govt. employee including Gramin Dak Sevaks and Casual, Part-time contingent, daily-rated and Contract Workers.
  • All Affiliates and C-C-Cs should ensure maximum participation of Central Govt. employees in all the campaign and mobilisation programmes of Joint Action Council of Central Trade Unions and Independent Federations also.
  • As in the past, Government may issue circulars, threatening the employees who participate in the strike. Ignore all such circulars and join the strike with courage and determination. Don’t believe in rumours. All information related to the strike will be published in Confederation website www.confederationhq.blogspot.com
  • Mass dharna at all important centres and also at State/ District/Divisional headquarters may be organised on 20th December 2019, with maximum participation of Central Govt. Employees.
  • Give maximum publicity through local media, social media and websites. Send photos and reports by whatsapp or Email to Confederation Headquarters.
  • Central Government Pensioners Associations may be requested to particpate in all mobilisation programmes and also to organise solidarity programme on 8th January, 2020.
    Remember, all our existing benefits and rights are achieved through struggles and sacrifices only. No strike action will go in vain. No sacrifice will go in vain. We will fight and we will win.

II. National Conference of Confederation of Central Government Employees & Workers:
As already informed to all in the Circular dated 01-08-2019, the next National Conference of Confederation of Central Government Employees & Workers will be held at NAGPUR (Maharashtra) on 07-02-2020 and 08-02-2020 (7th & 8th February 2020; Friday and Saturday). Delegate fee per head is Rs.1,000/- (Rs. One thousand only). In addition to delegates, visitors are also allowed to attend the Conference on payment of Rs.1,000/- (Rs. One thousand only) per head.

All Affiliated organisations and C-O-Cs are requested to ensure maximum participation of delegates and visitors in the National Conference, including maximum Lady delegates and visitors.

Please book the travel tickets of the delegates and visitors well in advance. Last minute, confirmed tickets will not be available.

C-O-C Mumbai, C-O-C Nagpur and nearby states C-O-Cs may ensure participation of more delegates/ visitors/ lady comrades.

Formal notice of the National Conference will be issued shortly.

Number of Delegates and Quota Remittance:

Number of eligible delegates of each Affiliated organisation and C-O-C is decided based on the quota remitted. The National Secretariat meeting of Confederation held at Hyderabad on 19th October 2019, has decided that the subscription/ quota dues list of affiliates will be placed in the Comnfederation website by the Financial Secretary shortly and all will be once again asked to pay out the arrears by 20-12-2019. On the basis of remittances received thereupon, voting rights will be compiled and exhibited in the website.

10 Points Charter of Demands of Confederation

  1. Scrap New Contributory Pension scheme (NPS). Restore Old defined benefit Pension Scheme (OPS) to all employees. Guarantee 50% of the last pay drawn as Minimum Pension.
  2. Honour assurance given by Group of Ministers (GoM) to NJCA leaders on 30-06-2016. Increase Minimum Pay and Fitment formula. Withdraw the proposed move to modify the existing time-tested methodology for calculation of Minimum wage. Grant HRA arrears from 01-01-2016. Withdraw “Very Good” bench mark for MACP, Grant promotional heirarchy and date of effect from 01-01-2006. Grant Option-I parity recommended by 7th CPC to all Central Govt. Pensioners. Settle all anomalies arising out of 7th CPC implementation.
  3. Stop corporatisation / privatisation of Railways, Defence and Postal Departments. Withdraw closure orders of Govt. of India Printing Presses. Stop proposed move to close down Salt Department. Stop closure of Govt. establishments and outsourcing.
  4. Fill up all six lakhs vacant posts in the Central Government Departments in a time bound manner. Reintroduce Regional Recruitment for Group B & C posts.
  5. (a) Regularisation of Gramin Dak Sevaks and grant of Civil servant status. Implement remaining positive recommendations of Kamalesh Chandra Committee report.
    (b) Regularise all casual and contract workers including those joined on or after 01-09-1993.
  6. Ensure equal pay for equal work for all. Remove disparity in pay scales between Central Secretariat staff and similarly placed staff working in field units of various departments.
  7. Implement 7th CPC Wage Revision and Pension revision of remaining Autonomous bodies. Ensure payment of arrears without further delay. Grant Bonus to Autonomous body employees pending from 2016-17 onwards.
  8. Remove 5% condition imposed on compassionate appointments. Grant appointment in all eligible cases.
  9. Grant five time bound promotions to all Group B & C employees. Complete Cadre Review in all departments within a time-frame.
  10. (a) Withdraw the anti-worker wage/labour codes and other anti-worker Labour reforms. Stop attack on trade union rights. Ensure prompt functioning of various negotiating forums under the JCM Scheme at all levels.
    (b) Withdraw the draconian FR 56 (j) and Rule 48 of CCS (Pension Rules 1972

Dear sir,
The above demand was discussed as Item No.15 of the standing committee meeting of the National Council (JCM) held on 7-3- 2019. The extract from the minutes of the above meeting is gives below for your kind ready reference.
Staff side proposed that
  • if the employee has actually traveled in Air India flight, then the LTC-80 fare of the journey day may be paid to him irrespective of the fact that ticket was purchased from authorized agent or not. Any excess amount over and above the LTC- 80 fare can be recovered;
  • No disciplinary action and stoppage of future LTC may be taken;
  • A general instruction in this regard may be issued to all the Departments to regularize all the pending LTC-80 cases as above.
‘Chairman agreed to consider the demand of the staff side’.
Sir, as agreed in the meeting a general instruction as above has not yet been issued by the DOP&T. It is therefore requested that since the employees are subjected to undue hardship, necessary instructions in this regard may please be issued at the earliest.

Subject: Recognised Political Parties Participating in 17th Lok Sabha General Election: Request to include demands in Election Manifestos.

It is for your kind information that this federation along with two other recognized federations has decided to submit to all Recognised Political Parities, National/ State Level the demands/ issues of Defence Civilian Employees for inclusion in their manifestos of 17th Lok Sabha General Election.
The issues are as under

1. Self Reliance in Defence Preparedness through State Owned Defence Industries viz Ordnance Factories, DRDO, Army Workshops, Ordnance Depots, Supply Depots, DGQA etc.

As you are well aware with the issue, State Owned Defence Industries are facing serious challenges/ threats these days. It is prime responsibility of Govt to safeguard the existence of these industries in interest of the Nation and take steps so that it may flourish and provide job opportunities to citizen of India. But of late Govt made various decisions regarding these establishments led to total destruction of these industries.

Burning Issues/ Challenges of Industries
  1. Categorization of more than 275 products being manufactured in the Ordnance Factories as “Non-Core”.
  2. Transfer of technology developed by DRDO to Private Sectors depriving
    Ordnance Factories & DPSUs.
  3. Large scale outsourcing of work of more than 1.5 lakh Civilian Posts depriving Young generation with Permanent Job.
  4. Induction of 100% FDI in Defence Sector.
  5. Privatization of Defence Industries by adopting various models like GOCO etc.
  6. Denial of Job to trained Trade Apprentices.
  7. Closure of various defence establishments like Ordnance Depots, Military Farms, Army Postal Establishments etc.
  8. Inclusion of Third Party Inspection at the cost of DGQA/ DGAQA etc.
    Our Proposal that is to be included:
"To achieve self reliance in defence expand, develop and strengthen the state owned Defence Industry and to ensure full capacity utilization of these Industries."

2. National Pension System

Govt introduced a contributory pension system under National pension system for all Central Govt employees recruited on or after 01.01,2004 and deprived them of very elementary benefits of old age social security by denying CCS (Pension) Rules, 1972 to them. The employees have been opposing this pension system since its introduction because it lacks the following essential benefits
  1. No guarantee of any Minimum Pension under this scheme.
  2. No safeguard from Price rise in absence of element of Dearness Allowance.
  3. Absence of additional Pension on attaining the age of 80 Years/ 85 Years/ 90 Years/ 95 Years/ 100 Years.
  4. No safeguard to Missing employees.
  5. Absence of Compulsory Retirement Pension, Compassionate Pension etc.
Both Legislative Body and Executive Body are responsible for well functioning of Administration. Both get their dues from Consolidated Fund of India. It is discriminatory that Executive Body has been deprived of its old age security especially lower rung employees would suffer the most.

Our Proposal to be included:

National Pension System will be scraped and CCS (Pension) Rules, 1972 will be implemented for all Central Govt Employees.

3. Appointment on Compassionate Grounds

The appointment on compassionate ground is an exception to the equality clause under Article 14. If an employee dies while in service then according to rule framed by the Central Government or the State Government, appointment to one of the dependants shall not be considered violation of Articles 14 and 16 of the Constitution because this exception has been provided through various rules only to mitigate the hardships of deceased employee family suffering from scarcity of very trivial things of daily life due to the death of sole bread winner of the family and sudden misery faced by the members of the family of such employee who serves the Central Government or the State Government.

A lot of Employees working under MoD are dealing with hazardous and risky operations. Because they are exposed to various hazardous chemical and other materials, they are developing various illness sometimes led to their deaths.

Proposal to be included:

One time relaxation would be provided to offer appointment on compassionate grounds to all the applicants waiting for years in MoD

5% ceiling would be removed and 100% appointment would be made on compassionate ground.

Employees who die/ incapacitate in accident while performing their official duties, Compassionate appointment would be made straight away without any delay.

However, ex-postfacto sanction of leave encashment on LTC may be considered by the sanctioning authority as an exception in deserving cases within the time limit prescribed for submission of claims for LTC.

Whether encashment of leave with LTC can be availed at the time when the LTC is availed by the Government servant only or can leave be encashed at the time when LTC is availed by family members?
Yes. A Govt. servant can be permitted to encash earned leave upto 10 days either at the time of availing LTC for himself or when his family avails it provided other conditions are satisfied.

Whether leave encashment should be revised on retrospective revision of pay/D.A?
In terms of 38-A of CCS(Leave) Rules, encashment of EL alongwith LTC is to be calculated on pay admissible on the date of availing LTC and DA admissible on that date. If pay or DA admissible has been revised with retrospective effect, going by the rule the Govt. servant would be entitled to encashment of Leave on the revised rates.

Whether encashment of Earned Leave and Half Pay Leave is admissible to industrial employees?
The industrial employees, other than those under the cadre control of the Ministry of Railways, are entitled to encash both Earned Leave and Half Pay Leave, subject to overall limit of 300. The cash equivalent of Half Pay Leave shall be equal to leave salary admissible for Half Pay Leave plus Dearness Allowance admissible on the leave salary without any reduction being made on account of pension and pension equivalent of other retirement benefits payable. But no commutation of Half Pay Leave shall be allowed to make up for the shortfall in Earned Leave and these orders are effective from 07-11-2006.{0M No. 12012/3/2009- Estt.(L) dated 28-12-2012}

Congratulations and big salute to all those leaders and workers who worked tirelessly and organised the most wide-spread and largely participated two days nationwide strike under the banner of Confederation, which is the vanguard of the Central Government employees movement.

Central Government employees had created history again. The two days nationwide strike on 2019 January 8th & 9th was not only widespread but a thundering and magnificent success in all respect, surpassing all the recent past strikes in percentage of participation. Of course, there was weakness in some sections and in some areas, but that didn’t affect the overall success and impact of the strike.
When the dominant leadership of the JCM National Council staffside and National Joint Council of Action (NJCA) ie., Railway Federations, are reluctant to go on strike against the betrayal of the BJP-led NDA Government on Minimum Pay & Fitment formula, NPS, Option-I of Pensioners, HRA arrears etc, inspite of the fact that Confederation and Defence Federation has authorised the Railway Federations leadership to serve strike notice reviving the deferred indefinite strike of 2016 July 11th, it is Confederation, Confederation alone, has shown its commitment to the cause of the 32 lakhs Central Government employees and 33 lakhs Central Govt. Civilian Pensioners, by organising two days historic strike along with the 20 crores workers of Indian working Class.

Confederation organised one day strike on 12-12-2012 and two days strike on 2014 February 13th & 14th demanding appointment of 7th Central Pay Commission, One day strike on 16-03-2017 demanding scrapping of NPS and honouring of assurance given by Group of Ministers and one day strikes on 2nd September 2015 and 2016 along with the mainstream of the working class against the neo-liberal economic policies. We decided to go on strike, demanding 10 points charter of demands of which the first and the main demand is "Scrap NPS & Restore OPS" in the mass convention of Central Government employees held at Hyderabad on 10th June 2018. Intensive campaign for the strike started from July 2018 onwards.

The message of the two days strike went to every nook and corner of the country and reached almost all central Govt. Offices and employees including Gramin Dak Sevaks, Casual/Contract Workers and Autonomous body employees and Pensioners. We are proud that we have stood with the workers and peasants of our country as a class-oriented militant trade union and Confederation represents the hope and aspirations of lakhs and lakhs of Central Government Employees and Central Govt. Civilian Pensioners.
NDA GOVERNMENT AND CENTRAL GOVT. EMPLOYEES - OUR EXPERIENCE:
(1) NEW CONTRIBUTORY PENSION SCHEME (NPS):
Everyone of us is aware that it is the previous BJP-led NDA Government which introduced the NPS in 2003 through a Gazette Notification dated 22nd December 2003, to all new entrants recruited on or after 01-01-2004. We are also aware that the Congress-led UPA-II Government passed the PFRDA Bill in Parliament to legalise NPS, with the full support of opposition BJP MPs in 2013 and thereafter PFRDA Act came into effect from 18th September 2013. Only 43 MPs of Left Parties, TMC, JDU, BSP, SP & RJD opposed the bill in Lok Sabha against 125 votes of Congress & BJP. In Rajya Sabha 25 MPs opposed while 115 supported. Confederation along with All India State Govt. Employees Federation (AISGEF) conducted series of agitational programmes against NPS from 2003 onwards including National Convention, Parliament March, signature campaign and strikes.

7th Central Pay Commission headed by Shri. Ashok Kumar Mathur, Retired Justice of Supreme Court of India, in Para 1.24 of its Report made the following observations:

"Almost a whole lot of Central Government employees appointed on or after 01-01-2004 were unhappy with the New Pension Scheme. While National Pension System (NPS) did not form a part of our Terms of Reference; we have recorded the sentiments of the affected employees. The Government should take a call and step into to look into their demands".

In Para 10.03.11, the 7th CPC again made the following comments:

"The larger Federations and Staff Associations advocated scrapping of the NPS on the ground that it discriminate between two sets of Government employees. Individuals covered under NPS have pleaded for reverting to Old Pension Scheme (OPS) on the grounds of uncertainty regarding the actual value of their future pension, on the face of market related risks."

Naturally, in tune with the recommendations of 7th CPC, when the NDA Govt. decided to appoint a High Level Committee called "NPS Committee", the Central Government employees, especially the younger generation, expected that their anxiety and concerns will be taken into account by the Central Government and NPS will be scraped and OPS will be restored. But the final decision of the Government not to scrap NPS but only to increase the percentage of contribution by the Government from 10% to 14% was a great blow to the NPS employees. Their hopes are shattered, "their legitimate aspirations are guillotined" and a situation is created where their "hopes ended in despair".
Their hope faded further when Shri. Arun Jaitley, Finance Minister, in his letter dated 3rd January 2019 addressed to Shri. Nitin Gadkari, another Cabinet Minister in the NDA Government, justified the continuation of NPS as follows:

"NPS is expected to provide old age income security to subscribers besides providing capital for the social and economic development of the economy".

The final blow came when the NDA Government made its stand clear without any ambiguity in a reply dated 25-12-2018 given in Parliament stating that - "Representations have been received which inter-alia also include the demand that Government may revert to Old defined benefit pension system. However, due to the rising and unsustainable pension bill and competing claims on the fiscal, there is no proposal to replace the National Pension System (NPS) with Old Pension System (OPS) in respect of Central Govt. employees recruited on or after 01-01-2004".

During the past 2-3 years many NPS employees, mainly Gramin Dak Sevaks and Casual Labourers promoted to departmental posts after 01-01-2004 (as their previous service is not treated as regular service) and also aged dependents of deceased employees who got compassionate appointment after 01-01-2004 etc, retired from service after completing 10 to 13 years service. Their Annuity Pension under NPS is Rs.700/- to Rs.2700/- maximum per month, thus confirming our apprehension that “NPS is nothing but No Pension System".

Unlike the BJP led NDA Government at the Centre, certain State Governments understood the seriousness of the situation and they have declared that they want to scrap NPS. (Delhi, Andhra Pradesh, Tamilnadu during Jayaalitha’s time, Karnataka and Kerala Governments). Some of them appointed expert Review Committees to work out modalities for coming out of NPS. From the stand taken by the above State Governments it can be seen that it is the political stand of the ruling party that matter. At the centre, it is the political stand of the Political Party ruling the country which is crucial.

2. Minimum Pay and Fitment Formula:

After the continuous struggle by Confederation including strikes from 2011 onwards, the then UPA Government was compelled to announce appointment of 7th Central Pay Commission. Gujarat State Government objected the decision of the UPA Government to appoint 7th CPC. Shri. Narendra Modiji was the Chief Minister of Gujarat at that time. After coming to power at the Centre in 2014, the BJP led NDA Govt. made deliberate attempt and intervention to delay and deny the legitimate demands of the Central Govt. employees and Pensioners including the demands relating to Minimum Pay, Fitment Formula, HRA from 01-01-2016, Option-I for pensioners etc.

When the entire Central Government employees ,under the banner of National Joint Council of Action (NJCA) decided to go on indefinite strike from 11th July, 2016 a Group of Cabinet Ministers including Shri. Rajnath Singh, Home Minister, Shri. Arun Jaitley, Finance Minister and the then Railway Minister Shri. Suresh Prabhu, gave categorical assurance on 30-06-2016 that Minimum Pay and Fitment formula will be increased and for that purpose a High Level Committee will be constituted. Even after a lapse of 2½ years neither High Level Committee was constituted nor Minimum Pay and Fitment Formula is increased.

The Finance Ministry in its Lok Sabha reply dated 11-12-2018, categorically stated as follows:

"The fitment factor for the purpose of fixation of pay in the revised pay structure, based on the recommendations of the 7th Central Pay Commission is 2.57 which is uniformly applicable to all categories of employees. As the same is based on the specific and considered recommendations of the 7th CPC, no change ,thereon is envisaged".

Thus the BJP led NDA Government has betrayed 32 lakhs Central Govt. employees and 33 lakhs Central Govt. Civilian Pensioners. The Hon'ble Supreme Court in the case of Bhupendra Nath Hazarika and Another Vs. State of Assam and others (reported in 2013(2)Sec.516) observed as follows, which is quoted by 7th CPC in its preface -

"It should always be borne in mind that legitimate aspirations of the employees are not guillotined and a situation is not created where hopes end in despair. Hope for everyone is gloriously precious and that a model employer should not convert it to be deceitful and treacherous…… A sense of calm sensibility and concerned sincerity should be reflected in every step. An atmosphere of trust has to prevail and when the employees are absolutely sure that their trust shall not be betrayed and they shall be treated with dignified fairness, then only the concept of good governance can be concretized. We say no more".

The NDA Government has "guillotined" our aspirations. NDA Govt. has betrayed the employees and Pensioners and created an atmosphere where "Hopes ended in despair". NDA Govt. converted our hope to be "deceitful and treacherous", "Dignified Fairness", "Calm sensibility" and "Concerned Sincerity" in treating our case is lacking on the part of NDA Government. Hence we have no alternative but to defeat the betrayers in the coming biggest battle of democracy.

The fate of the following other demands raised by the Confederation are also met with the same fate from the NDA Government:

Regularisation of Gramin Dak Sevaks and Casual/Contract Workers. Implementation of the remaining favourable recommendations of Kamalesh Chandra Committee on GDS.
Grant of HRA arrears from 01-01-2016, removal of bench mark for MACP and grant of promotional hierarchy and date of effect of MACP from 01-01-2006.
Fill up of all vacant posts. Reintroduce Regional Recruitment for Group B and C Posts.
Implement Option-I formulation of 7th CPC for Pensioners.
Settle anomalies arising out of 7th CPC.

Parity in Pay scales between Central Secretariat Staff and similarly placed staff working in field units of various departments.
Withdraw closure orders of Govt. of India Printing Presses. Stop closure of Govt. establishments and outsourcing of Govt. functions. Stop proposed move to close down salt department.
Implement 7th CPC Wage Revision and Pension revision in remaining Autonomous bodies. Grant Bonus to Autonomous body employees pending from 2016-17 onwards.
Remove 5% ceiling on compassionate appointment and grant appointments in all deserving cases.
Grant five Assured Career Progression to all Group B and Group C employees.
Stop attack on Trade Union rights. Ensure prompt functioning of all JCM forums. Withdraw the draconian FR 56(j) and Rule 48 of CCS (Pension) Rules 1972.
ELECTION AND CENTRAL GOVERNMENT EMPLOYEES:
In a democratic country like in India, elections to the Legislative bodies are also part of the struggle against the anti-worker and anti-people policies of the ruling class. Com.K.G.Bose, the legendary leader of the Central Govt. Employees movement has observed as follows:

“It is a common say, particularly among the Government employees that the Unions should remain aloof from the politics. All the confusion has arisen because of the fact that the correct definition of the "Politics and Trade Union" has not been understood by most of us. Those two things are not separate from each other rather they are inseparable. Politics do not mean the policies of a particular political party. Each and every demand of the Govt. employees is linked with the politics of the country. It is high time that the age old confusions be removed from the minds of the Govt. employees and their unions. Collective thinking on the problems of life in the context of a nation is a fundamental right of every section of the people and therefore, the Central Govt. employees cannot be deprived of their birth right on the plea of "Political influence".

It is in the above background, we have to take position in the coming General Elections. Our experience during the last five years have proved that BJP-led NDA Government is the most anti-worker and anti-people Government the country had since independence. This Govt. is by the corporates, of the corporates and for the corporates. The working class, including Central Govt. employees, should be made aware of this challenge and prepared to defeat it. It should be kept in mind that defeat of this Government is not the end, but our struggle for reversal of the neo-liberal policies has to continue with increased vigour even after ensuring defeat of the anti-worker government. In any case, continuation of this Government is against the interest of the working class, especially the Central Govt. employees. Change is the need of the hour.

As a class-oriented militant trade union, it is our responsibility to channelize the discontentment and anger of the employees on proper direction with the objective of strengthening united struggles to defeat the neo-liberal policies and ultimately pave the way for taking the struggle towards an exploitation free society. Let us make 2019 that started with the two days historic strike, a year of heightened struggles leading to decisive struggles against the neo-liberal policies. Let us be prepared for a bigger struggle in coming days to “SCRAP NPS & RESTORE OPS” and also for the realisation of our long pending demands.

Let us not forget that the ruling class may use all tricks at their command, all weapons in their armoury to divert the attention of the people and workers, away from their burning day to day livelihood issues, to divide and disrupt their unity to engineer polarisation of the society on caste and communal lines for their electoral gains. We should be prepared to defeat all such machinations and should preserve our unity.

Let us remember the following lines from the famous speech of Late Martin Luther King, Jr -
"Change does not roll in the wheels of inevitability, but comes through continuous struggle, and so, we must straighten our backs and work for our goal."

NATION WIDE TWO DAYS STRIKE ON
8th & 9th JANUARY 2019
STOP THE DISASTROUS NEO-LIBERAL POLICIES.
DEFEAT THE RULING CLASS POLITICS BEHIND IT.

National Secretariat of Confederation unanimously decided to make the two days nation-wide strike on 2019 January 8th & 9th a grand success in the Central Govt. Employees Sector. The decision of the Central Headquarters to postpone the one day strike on 15-11-2018 and to organise two days nationwide strike on 2019 January 8th & 9th is ratified by the National Secretariat. Srike will be organised on 10 points charter of demands of Confederation (reproduced below). First and most important demand of the strike will be “Scrap NPS & Restore OPS”. In connection with the strike, following decisions are taken.

1. Strike campaign is most important. The message of the strike and the demands raised should reach each and every Central Govt. employee and pensioner. Notices, pamphlets, posters etc. should be printed and circulated among all employees. Maximum campaign through websites, journals of affiliates, print and electronic media and social media should be made by each affiliated Unions/Associations/Federations and C-O-Cs. The campaign should be intensified in the coming days.

2. Each affiliated organization of Confederation should issue separate circulars to their lower units instructing them to participate in the two days strike and also to organise intensive campaign programmes for ensuring 100% participation of employees of each affiliate in the strike. It is noticed that, during previous strikes, some of the affiliates had not issued any separate circulars and no specific instructions to participate in the strike was given to their lower units. This has created problem for other organisations also at the lower level. This time every affiliate should issue their own circulars to lower units.

3. All State/District level C-O-Cs should convene their managing body meetings immediately and work out detailed plan for intensive campaign among the employees under their jurisdiction. C-O-Cs should play an effective and leading role in making the strike a grand success.

4. All affiliated organisations should plan and announce their own separate campaign tour programme of their leaders for organising strike at all centres and all offices. This is most important. Unless the leaders of affiliates make their own campaign tour programmes, the strike cannot be organised in an effective manner in all units.

5. Confederation National Secretariat Members will be visiting only selected important centres in each state for campaign meetings. The tour programme of National Secretariat members will be published shortly. Programme may be finalised by mutual consultation of C-O-C leaders and National Secretariat members concerned. (Campaign by each affiliate and C-O-C is given top most priority as the National Secretariat members are attending limited meetings only.)

6. Strike notice should be served by each affiliate separately to their departmental head on 12-12-2018 (6th anniversary day of 12-12-2012 one day strike). Confederation Central headquarters will serve strike notice to Cabinet Secretary on 12-12-2018. Copy of the strike notice should be served to all lower authorities also organising mass demonstrations of maximum employees. Complaints are received that some of the affiliates never serve separate strike notice to their Departmental head and also never circulate the copy of the strike notice served to lower units. As a result, when C-O-C leaders approach, their lower unit leaders say that they have not received any instructions from their Central headquarters to participate in the strike. This time Central Headquarters of all affiliated organisations should serve strike notice to their departmental heads and should also issue instructions to their lower units to participate in the strike. Affiliation of those organisations which are not serving strike notice or issuing instruction to their lower units to participate in the two days strike will be withdrawn, as their is no meaning in continuing the affiliation of those organisations which do not implement the decision of the National Secretariat of Confederation.

7. If due to unavoidable circumstances, any organistion cannot serve the strike notice on 12-12-2018, they may serve the strike notice on any other day before 23-12-2018.

8. Even though all the leaders of Confederation and its affiliates are well aware of the full details of each demand raised in the 10 point charter of demands including NPS, it is decided to publish detailed note on each demands in the Confederation website in coming days as campaign material and talking points.

9. As almost all Central Govt. employees and pensioners are agitated over the unhelpful and negative attitude of the NDA Government, there is every possibility of making the two days strike a thundering success, provided the leadership of each affiliates and C-O-Cs rise upto the occasion and start mobilisation now onwards with all seriousness.

Our wages and other benefits are under attack.
Our job security is under attack.
Our social security is under attack.
Our trade union rights are under attack.


Let us intensify our struggles from defensive to offensive and defeat the anti-worker policies of the Government. Central Govt. employees can do it under the banner of Confederation. Make the two days strike historic success. Remember, we are not alone, the entire working class of India belonging to Banks, Insurance, BSNL and other public sectors, State Govt. employees and Teachers etc. etc. are all on strike on 2019 January 8th & 9th. Don’t be a spectator, join the strike proudly and be a part of the fighting working class of India. Our slogan is "change the disastrous neo-liberal policies, or else we shall change the Government".

OBSERVE 2018 DECEMBER 12
as "SCRAP NPS & RESTORE OPS" DEMANDS DAY

 National Secretariat of Confederation has decided to observe 12th December 2018 (strike notice serving day) as Demands Day raising the demand - "Scrap NPS & Restore OPS" throughout the country. All affiliates and C-O-Cs are requested to observe the day in a befitting manner by conducting demonstrations in front of all offices, organising gate meetings/general bodies and also wearing badges with the slogan - "Scrap NPS & Restore OPS". The struggle against NPS is getting intensified day by day. Delhi State Govt. has passed a resolution in the State Assembly demanding the Central Govt. to scrap NPS imposed on Delhi State Govt. employees. State Govts. of Kerala, Andhra Pradesh and Tamilnadu has already appointed Expert Review Committees to submit recommendations regarding modalities for scrapping of NPS and restoring OPS. Tamilnadu State Government employees and Teachers (all organisations) have decided to organise indefinite strike demanding scraping of NPS and restoration of OPS. Confederation is in touch with other organisations in Central Sector and is exploring the possibility of organising higher form of trade union action including indefinite strike. After the two days strike on January 8th & 9th, an All India Convention of NPS employees along with other like-minded organisations will be organised. Our ultimate aim is to organise an indefinite strike, no sooner than later, exclusively on one demand ie; "scrap NPS & Restore OPS".

3. All India Trade Union Education Camp of Confederation:
National Secretariat meeting decided to organise an All India Trade Union Camp of Confederation. Venue, date etc. will be finalised in consultation with C-O-Cs shortly and detailed circular will be issued thereafter.

4. All India Women's Trade Union Education Camp - Haridwar - A grand success:
All India Women's Trade Union Camp of Confederation was held at Haridwar (Uttarakhand) on 29th & 30th October, 2018. Com.Subhashini Ali, Ex-MP, inaugurated the camp by taking a class on the subject - "Indian Working Class - Challenges and opportunities". Second class was by Com.Keerthi Singh, Advocate, Supreme Court on the subject - "Women's social status and rights in the Indian Society". Third class was by Com.T.K.Rajalakshmi, Editor, Frontline on the subject - "Media and Politics". Concluding session was on the subject - "Scrap NPS & settle Confederation’s 10 points charter of demands – significance of 2019 January 8th & 9th two day's strike". The Camp was presided by Com: Usha Boneppalli, Chairperson, Women's Sub Committee who delivered a thought provoking presidential address. Com.R.Seethalakshmi, Convenor, Women's Sub Committee made introductory speech. Com.Geetha Bhattacharjee and Com.Manisha Majumdar offered welcome address and vote of thanks on the second day.

Com.Virendra Tiwari, Working Chairman of the C-O-C, UP State Committee and Chief Organiser of the camp welcomed the distinguished guests, leaders and delegates during the inaugural session. Com: Anilkumar Chowdhary, Circle President, P4, UP Circle (Shaharanpur Division) presented special shawls to all guests and leaders. The camp concluded at 02.30 PM on 30-10-2018.

2. Settle 7th CPC related issues including increase in Minimum Pay and Fitment formula, HRA arrears from 01-01-2016, MACP Bench Mark, promotional heirarchy and date of effect of MACP from 01-01-2006. Implement Option-1 for pensioners and settle all anomalies arising out of implementation of 7th CPC recommendations.

3. Fill up all vacant posts. Reintroduce Regional Recruitment for Group B & C posts. Withdraw orders for abolishing posts lying vacant for more than five years. Revive all posts abolished during 2001 to 2008 under Annual Direct Recruitment Plan (ADR) as per May 2001 orders of the former NDA Government.

4. (a) Regularisation of Gramin Dak Sevaks and grant of Civil Servant Status. Implement remaining positive recommendations of Kamalesh Chandra Committee report.

(b) Regularise all casual and contract workers including those appointed on or after 01-09-1993.

5. Ensure equal pay for equal work for all. Remove disparity in pay scales between Central Secretariat staff and similary placed staff working in field units of various departments.

6. Stop closure of Government establishments and outsourcing of Government functions. Withdraw closure orders of Govt. of India Printing Presses. Stop proposed move to close down salt department. Stop Foreign Direct Investment (FDI) in Railways and Defence departments.

7. Implement 7th CPC Wage revision and pension revision of Autonomous body employees and pensioners. Grant Bonus to Autonomous body employees pending from 2016-17 onwards.

8. Remove 5% condition imposed on compassionate appointments and grant appointment in all deserving cases. Rejected cases for want of 5% quota vacancies may be reviewed and appointment to dependents may be granted.

9. Grant five time bound promotions to all Group C & B employees on completion of 8,7,6,5 and 4 years of service respectively. Complete Cadre Reviews in all departments within a time frame.

10. (a) Stop attack on trade union rights. Ensure prompt functioning of various negotiating forums under JCM scheme at all levels.

(b) Withdraw the draconian FR 56(j) and Rule 48 of CCS (Pension) Rules, 1972,

(If necessary, affiliates can add their own department – speific demands as PART-II of the Charter of demands).

ALL INDIA WOMEN'S TRADE UNION CAMP - HARIDWAR

All India Women's Trade Union Camp of Confederation of Central Govt Employees & Workers was held at Haridwar (Uttarakhand) on 29th & 30th October 2018.

U.P State Committee of Confederation with Com.R.N.Parashar, Secretary General, NFPE, Com.Virendra Tiwari, General Secretary, AIPSBCOEA , Com.J.P.Singh, ITEF, Com.S.B.Yadav, General Secretary, AIPAEA as Chairman, Working Chairman, General Secretary and Treasurer respectively took the responsibility of organizing the camp. Earlier, four years back, COC, Uttarakhand has organized an All India Trade Union Camp of Confederation at Dehradun.
The camp commenced at 11.00 AM on 29th October with flag hoisting and homage to martyrs. Com.Subhashini Ali, Ex-MP & daughter of great freedom fighter and legendary leader Captain Lakshmi Saigal hoisted the National falg. Com.Giriraj Singh, Vice Chairman, Confederation (CHQ) hoisted the Confederation flag. Com.K.K.N.Kutty, President could not attend the camp as he is unwell and undergoing treatment.

The inaugural session was presided over by Com.Usha Bonepally, Chairperson and she delivered the presidential address. Com.R.Seethalakshmi, Convener, Women's Sub Committee made an introductory speech. Com.Virendra Tiwari, Working Chairman, COC, UP State, and Chief organizer of the camp welcomed the distinguished guests, leaders and delegates.

Com.Subhashini Ali inaugurated the two days camp by taking a class on the subject " Indian Working Class - Challenges and opportunities". In the evening, she again participated in an interaction session for about two hours and answered all the questions, doubts and queries of the women delegates. Presence and participation of Com.Subhashini Ali in the camp, for about 5 hours really inspired the delegates.

Second class was by Com.Keerthi Singh, Advocate, Supreme Court & Adviser, Legal Cell of All India Democratic Women's Association on the subject - "Women's social status and rights in the Indian society".

On 30th morning, Com.T.K.Rajalakshmi, Editor, Front Line took class on the subject - "Media and Politics". Com.Geetha Bhattacharjee and Com.Manisha Mazumdar, Joint Conveners of Women's Sub Committee offered welcome address and vote of thanks respectively.

Final session was on the subject - "Scrap NPS & Confederation's 10 point Charter of Demands - significance of 2019 January 8th & 9th two days All India Strike" Com.M.Krishnan, Secretary General, Confederation, Com.Giriraj Singh, President, NFPE, Com.Vrigu Bhattacharjee, Secretary General, National Federation of Civil Accounts Employees' Associations, Com.S.B.Yadav, General Secretary, All India Postal Accounts Employees Association, Com.Worlikar, National Federation of Atomic Energy Employees, Com.D.B.Mohanty, General Secretary, P4 Union (NFPE) addressed the delegates. Com.Virendra Tiwari made the concluding address and also vote of thanks.

Com.Anilkumar Chaudhary, Circle President, P4, UP Circle (Shaharanpur Division) presented special shawls to all guests and leaders. The camp concluded at 02.30 PM on 30th.

About 100 delegates participated in the camp from different States. The Reception Committee made excellent arrangements for best accommodation, attractive dias, and meeting hall, delicious food, colourful decorations etc., without giving room for any complaints. Confederation National Secretariat conveys its sincere thanks and gratitude to all the leaders and members of Reception Committee for their sincerity, commitment, collective work and dedication which made the camp a grand success.

NJCA DECIDES TO OBSERVE "ALL INDIA DEMANDS DAY" ON 19th SEPTEMBER 2018

Dear Comrades,
NJCA has given a call to observe 19th September 2018, the 50th Anniversary day of 1968 strike of Central Govt. employees, as ALL INDIA DEMANDS DAY protesting against the betrayal of BJP - led NDA Government and demanding immediate settlement of the following three demands. NJCA has also resolved and informed the Cabinet Secretary its decision to revive the deferred indefinite strike of Central Govt employees, in case The Govt refuses to settle the demands.

Demands :-
1) Upward revision of Minimum Wage and Fitment Formula
2) Scrapping the New Contributory Pension Scheme.
3) Allow Option-1 as one of the Pension Fitment Formula.

Confederation National Secretariat calls upon all affiliated Organizations and State / District level C-O-Cs to observe “Demands Day” on 19th September 2018 (if possible, jointly with Railway & Defence Federations) through out the country by holding protest demonstrations and rallies at all centres and also in front of all offices.

What next for Central government employees?

There was a bitter disappointment in store for fifty lakh Central government employees and an equal number of retirees, who have been waiting for a hike in minimum pay and fitment factor beyond the 7th Pay Commission recommendations. There was lot of speculation that PM Narendra Modi may give some good news in his last Independence Day budget in this term as PM. Many believed that looking at good monsoon and positive economic factors, a positive announcement may come months before the general elections.

While PM Modi spoke about how Indian economy will be a powerhouse in next three decades, he didn't have any news to offer for the government employees.

Minister of State for Finance P. Radhakrishnan earlier in Lok Sabha had said that the Prime Minister's Narendra Modi government is not planning to give any hike in minimum basic salary beyond the recommendations of the seventh pay commission. However, the Haryana government approved pay scale recommendations of teaching and non-teachings staff at government universities, government universities and govt-aided colleges with effect from Jan 1,2016.

The Maha government also has announced a salary hike under 7th Pay Commission from January 2019 for 17 lakh state employees. . So obviously the Central government employees are also hoping for some positive news. It may be noted that the government at any time can announce such a decision, and it doesn't need to be on a special day. It may come closer in the heels to the election.
It is to be noted though that in the hopes of minimum pay hike beyond the recommendations of the 7th CPC might get a blow from the Central Bank itself. Earlier this month, RBI decided to increase the policy repo rate by 25 basis points to 6.5%. The reverse repo rate has been hiked to 6.25%, the RBI announced after its three-day Monetary Policy Committee (MPC) meeting.

"RBI's Monetary Policy Committee has decided to increase the policy repo rate under the liquidity adjustment facility (LAF) by 25 basis points to 6.5% Consequently, the reverse repo rate under the LAF stands adjusted to 6.25% and marginal standing facility rate and Bank Rate to 6.75%," the apex bank said in a statement.

RBI in its report mentioned that inflation rates have increased on account of implementation of 7th Pay Commission. The revised HRA structure came into place in July 2017 under the 7th Pay Commission.

Currently, the Central government employees are getting basic pay according to the fitment formula of 2.57 of the basic pay and if this big step is taken, it will come as a massive news for the Central government employees. Fitment factor is a figure used by 7th CPC with which the basic pay in 6th CPC regime (i.e Pay in Pay band + Grade pay) is multiplied in order to fix basic pay in revised pay structure (i.e 7th CPC). Fitment factor formulated by 7th CPC is 2.57.

There were talks about Modi raising the retirement age of central government employees. That also didn't come through

The MACP Scheme promulgated by DoP&T vide OM No. 35034/3/2008-Estt. (D) dated 19.05.2009 was circulated in the Department vide OM No. 4-7/(MACPS)/2009-PCC dated 18.09.2009. Directorate has been receiving numerous references from service unions/ federations and Circles to clarify as to whether the pre-appointment training period will be counted for the purpose of MACPS or not with reference to Para 9 of the Scheme.


2. The matter was taken up with the nodal Department i.e. DoP&T for clarification. The DoP&T has clarified vide Dy. No. 1312914/18/CR dated 5.6.2018 as under :

"as per provisions of MACP Scheme as contained in Para 9 of Annexure -1 of MACP Scheme dated 19th May 2009, pre-appointment training before regular appointment is not counted for the purpose of MACP Scheme. "

Various references have been received in this Department seeking clarification regarding admissibility of Taxes/GST on the prescribed entitlement of Hotel accommodation/Guest House as mentioned in Para 2E(i) of the annexure to this Department's OM No. 19030/1/2017-E.IV dated 13.07.2017.

2. The matter has been considered in this Department and it is clarified that the entitlement prescribed in r/o Hotel accommodation/Guest House as mentioned in Para 2E(i) of above mentioned 0M, is exclusive of all Taxes/GST and these Taxes/GST shall be reimbursed to the Govt. employee over and above the prescribed entitlement. Further, reimbursement of GST shall be calculated on the actual charges paid by the Central Govt. employee within his/her prescribed entitlement,

Sub:  Grant of Tough Location Allowance to Central Govt. Employees of Darjeeling.

This is to bring to your kind notice that Hill Compensatory Allowance (HCA) was being paid till June 2017 to the employees of Darjeeling. Unfortunately HCA has been withdrawan from the month of July 2017 onwards after implementation of 7th CPC Allowance Committee report. However, the neighbouring state, Sikkim is still getting the Special Compensatory Allowance (SCA). It is worth mentioning that Darjeeling and Sikkim share same type of terrain, alongwith climatic conditions. It is further to mention here that the employees of some hill areas viz; Shimla in Himachal Pradesh, comparatively similar to Darjeeling Hills, are enjoying Tough Location Allowance (TLA). But the employees of Darjeeling are deprived of both the Tough Location Allowance (TLA) and Special Compensatory Allowance (SCA).

Darjeeling being the world famous tourist spot and the "Queen of Hills" is one of the expensive place to live in as all the basic commodities are to come from Siliguri, which is a 'Y' category city with 16% HRA. This has led the employees of Darjeeling being economically handicapped with the removal of Hill Compensatory Allowance.

In view of the above, I request you to review the orders withdrawing the Allowance already enjoyed by the employees of Darjeeling, and Consider grant of any kind of Special Duty Allowance/Tough Location Allowance/High Altitude Allowance as a special case, considering the geographical, climatical and economical hardship faced by the employees.
