Sub: Meeting of the NJCA to discuss and decide course of action to fight against privatization / corporatization and anti-labour policies of the Government of India

As you are aware that; danger of privatization/ corporatization/ outsourcing, in Railways, Ordnance Factories and other Departments/ Organizations of the Government of India, is looming large. The government is moving in full-swing in the direction of privatization/ corporatization of the Railway Production Units and Defence Factories as also closure of the Railway Printing Presses in spite of assurance given by the Railway Board(Ministry of Railways) that nothing would be done without consulting the organized labour.

No doubt, all the Unions / Federations are fighting and agitating this issue at the grassroots level, but now, time has come to take a united movement to face the challenge. It has, therefore, become incumbent on us that, we should keep ourselves prepare to halt government’s efforts of privatization / corporatization of the Railways Production Units and Ordnance Factories.

To discuss and decide future course of action to fight against privatization/ corporatization / outsourcing policy of the Government of India, a meeting of the NJCA will be held on 25th July, 2019 in JCM Office, 13-C, Ferozshah Road, New Delhi, from 16:00 hrs.

You are requested to attend the above cited meeting of the NJCA.

Subject: Proposed Nationwide Dharna/Demonstration by National Joint Council of India (NJCA) on 13th March, 2019 against National Pension Scheme (NPS) - Instructions under CCS (Conduct Rules), 1964 - Regarding.



1. It has been brought to the notice of the Government that a forum by the nomenclature of National Joint Council of Action (NJCA) has decided to organize Dharna/Demonstrations in front of Jantar Mantar, New Delhi and all across the country on 13th March, 20 19 in order to protest against New Pension Scheme (NPS).

2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike/protest including mass casual leave, go slow etc. or any action that abet any form of strike/protest in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(1) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike/protest. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgements that going on a strike/performing any sort of protest is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike/protest in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department's O.M. No.33012/ 1/(s)/2008- Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A).

3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed Dharna/demonstration, and ensure that the willing employees are allowed hindrance free entry into the office premises.

4. In case employees go on Dharna/demonstration, all Divisional Heads are requested to forward a report indicating the number and details of employees, who are absent from duty on the day of Dharna/demonstration, i.e., 13.03.2019.

A delegation of the National JCA consisting of Com. M. Raghaviah, Com. Shiva Gopal Mishra, Com. Guman Singh, Com. K.K.N. Kutty, Com. Ashok Singh, Com. L.N. Pathak, and Com. R.N. Parasar met the honourable Home Minister on 8th February, 2019 at 9.30 Am. The delegation conveyed to the honourable Home Minister, the discontent and anger of the central Government employees over the dishonouring the assurance held out by the group of minister headed by him on 30 th June, 2016 in the matter of the upward revision of the minimum wage and fitment formula.
They pointed out the honourable home minister that on all previous occasions, the Government had revised the minimum wage recommended by the respective pay Commission after negotiation with the Staff Side JCM. The growing concern of the Central and state Government employees manifested in large scale mobilisation of the newly recruited employees over the new contributory Pension scheme was also brought to his notice.

The employees and officers who are recruited in Central Government service after 1.01.2004 are extremely agitated over the meagre amount of annuity they are entitled to receive even after paying huge amount of subscription to the scheme devoid of cost indexation. Family pension protection ect. The delegation also brought to the notice of the honourable Minister that the number of employees and officers who are presently covered by the new scheme has crossed over 50% of the total strength and the demand for bringing back the old Pension scheme has gained momentum. It unfortunate
that the Government did not heed even to the modest suggestion made by the Staff Side before the pension committee to the effect to guarantee a minimum amount of annuity to those who are covered under the new scheme. The delegation also stated that they are constrained to belive of a concerted effort on the part of the Government to kill the negotiating forum JCM as repeated pleading made to revive the joint consultative Machinery has not been responded.

They pointed out that the National Council of the JCM met about 9 years back and the meetings of the Standing committee and national Anomaly Committee has been few and far between . Since no meetings are convened at the apex level, the departmental Councils had also become defunct, they added. In other words, they said that there has been virtually no interaction worth the name between the Government and the employees organisation , which has proliferated the litigation and in most of the cases, the Government has lost out in the Courts. They also pointed out that the official side had been taking extremely nugatory attitude and had not been acting upon even on the verdicts of the Supreme Court.

The Honourable Home Minister gave a patient hearing and recalled the interaction he had with the Staff side earlier, when an assurance to revisit the quantum of minimum wage and fitment formula had been held out . He assured the delegation that he would cause a discussion of the matter with the Honourable Prime Minister.

The National JCA met later at the Staff side office when Com. M.S. Raja and Com. Giriraj Singh joined the meeting. The issues were discussed at length, especially taking into account the ensuing general Election in the country. The meeting finally decided to organise the following programme of actions.

13th March 2019

A massive demonstration cum dharna will be organised under the auspices of the National JCA to highlight and focus the demand for the withdrawal of the new Pension scheme and restoration of the old Pension scheme for Central Government employees. The National JCA will simultaneously write to all Political parties to make their stand clear on the issue of the New Pension scheme in their respective manifesto. The National JCA will spcarhead a campaign amount the employees for the acceptances of the demand by the political parties. The dharna will be at jantar Mantar and the same will be participated by the employees working in and around Delhi besides the NJCA leaders. On the same day, similar dharna and demonstrations will be held in front of all Central Government offices throughout the country. The employees will also be requested to wear black badges projecting the demand for the withdrawal of the NPS.

28th MARCH 2019

A protest day long dharna will be organised at jantar Mantar on 28.03.2019, in which all the National council members will take part. A huge demonstration will also be organised on the same day in front of the dharna venue in which the employees working in and around Delhi will take part. The dharna will highlight the need to revive the JCM forum and thus constant and continuous inter action between the Government and the employees. It will also focus the intolerable attitude of the official side even in issuing orders, where the supreme Court has given the verdict in favour of the employees. The Cabinet Secretary will be informed of this decision well in advance.

Copy of the letter addressed to the Cabinet Secretary is enclosed. All participating organisations are requested to make the programme a grand success. The NJCA will meet again on 28.03.2019 to discuss of the future course of action to be mounted in the days to come.

Dear Sir,
We invite your kind reference to the representations made by the staff side both in writing and orally during discussions bilaterally and otherwise on innumerable occasions over the need to convene the National Council meeting of the JCM, which met last about 9 years back.

Since there had been no meeting of the National Council the directive issued by the Department of personnel to various Ministries of the Government of India to convene the Departmental Council meeting had also not been dwindled. We regret to write that inspite of our persistent persuasion you have unfortunately no found time for holding the meeting.

There had been no reason whatever for such inordinate delay in convening the meeting. This apart, the periodicity with which the National Standing committee used to meet has also been dwindled. The National Anomaly Committee set up in the wake of the 6th CPC is still to finalise its business.
The Staff Side, which met on 8th February, 2019 at New Delhi, has come to the inescapable conclusion that it must tread the path of struggle to get the negotiating forum revived we are therefore, constrained to take recourse to agitational programmes and have decided that all the Staff Side members of the National Council will sit on dharna on 28th March, 2019 at New Delhi.
We hope you will take note of the growing. discontent in the matter and take corrective steps to revive the JCM and to convene the meetings immediately.

Sub: Resolution No. NJCA/2018 dated 18/08/2018 against Government’s Failure to fulfill its assurances - Reg.

A copy of Resolution dated 18/08/2018 passed by NJCA is enclosed.

As decided by NJCA in its meeting held on 18/08/2018 at New Delhi, the affiliates are directed to hold mass rallies/demonstrations etc., protesting against Government failure to implement its assurances on revision of minimum wage, improvement of fitment formula and abolition of National Pension System (NPS). Other pending issues related to railway employees may also be highlighted during protest actions. Affiliates may take note that “September 2018” should be treated as PROTEST MONTH by organizing different forms of protest actions at all levels i.e. Depots, Establishments, Workshops, Major Stations etc.,

"All India Protest Day" should be observed on 19th September 2018 and on the said date the affiliates should mobilize employees in large number along with those of Central Government Employees Organizations and hold massive rallies / demonstrations. The members of INDWF and FNPO should also be made part of agitation wherever possible.

A report on protest actions conducted by the affiliates may be sent to the Federation promptly.

NJCA DECIDES TO OBSERVE "ALL INDIA DEMANDS DAY" ON 19th SEPTEMBER 2018

Dear Comrades,
NJCA has given a call to observe 19th September 2018, the 50th Anniversary day of 1968 strike of Central Govt. employees, as ALL INDIA DEMANDS DAY protesting against the betrayal of BJP - led NDA Government and demanding immediate settlement of the following three demands. NJCA has also resolved and informed the Cabinet Secretary its decision to revive the deferred indefinite strike of Central Govt employees, in case The Govt refuses to settle the demands.

Demands :-
1) Upward revision of Minimum Wage and Fitment Formula
2) Scrapping the New Contributory Pension Scheme.
3) Allow Option-1 as one of the Pension Fitment Formula.

Confederation National Secretariat calls upon all affiliated Organizations and State / District level C-O-Cs to observe “Demands Day” on 19th September 2018 (if possible, jointly with Railway & Defence Federations) through out the country by holding protest demonstrations and rallies at all centres and also in front of all offices.

The NJCA met today and took note of the inordinate delay in honouring the commitment made by the Government on 30th June, 2016 in respect of Minimum Wage, Fitment Formula, Scrapping the New Contributory Pension Scheme, Option No.1 to Pensioners, Outsourcing, Regularization of Contract/Casual Workers, JCM revival etc.

At the end of the deliberations it was decided to adopt a resolution and forward the same to the Government.

Copies of the Resolution and letter to the Cabinet Secretary are enclosed herewith, which are self-explanatory.

The NJCA will again meet on 18.08.2018 to finalize the future course of action in the matter of Indefinite Strike which was deferred on 06.07.2016.

The NJCA of the organizations, participating in the JCM, met today and adopted the enclosed resolution.

The NJCA was extremely unhappy to nole that the government did not honour its commitment made to the leaders of the organizations when they metlhe Hon'ble Home Minister and Finance Minister in the presence of the then Railway Ministers on 30.06.2016 on the basis of which the Indefinite Strike which was to commence on 11 .07.2016 was deferred.

The reply 10 a question asked by Shri Neeraj Shekhar in the Upper House of the Parliamcnl(Rajya Sabha) given by Hon'ble Minister of State for Finance, Shri P. Radha Krishnan, on 06.03.201 B Minister, which is reproduced below, has further angered the Central Government employees.
"Question of Shri Neeraj Shekhar(1170)

(a) Whether Government Is actively contemplating to increase minimum pay from Rs.18,000/· to Rs.21,000/· and filment factor from 2.57 to 3, in view of resentment among the Central Government employees over historically lowest increase in pay by 7th Central Pay Commission (CPC);

(b) If so, the details thereof and the date from which it would be implemented; and

(c) If not, the reasons for the callous attitude of Government towards Government Employees?"

ANSWER
MINISTER OF STATE FOR FINANCE (SHRI P RADHAKRISHNAN )

"(a),(b)&(c ) - The minimum Pay of Rs .18,000/- p.m. and filment factor of 2.57 are based on the specific recommendations of the 7th Central Pay Commission in the light of the relevant factors taken into account by it. Therefore, no change therein is at present under consideration".

The NJCA has decided to meet again on 18.08.2018 10 consider the response, if any, from the government to this letter and to the enclosed resolution.

In case of the continuing negative attitude of the government, the NJCA will be left with no other alternative but to revive the decision of Indefinite Strike action, which was deferred on 06.07.2016 on the basis of the assurance given by the Group of Ministers on 30.06.2016.

RESOLUTION

The National JCA, which met today (03.07.20 18) at New Delhi as per the notice issued by the Convenor, after deliberations, came to the painful conclusion that the government had been unfortunately indulging in chicanery for the past two years by not honouring their commitment made to the NJCA leaders on 30.06.2016. The NJCA which was formed to pursue the demands and issues of the Central Government Employees especially those emanating from the recommendations made by the 7th CPC in the matter of Wage Revision, New Pension Scheme etc. had deferred the Indefinite Strike action, which was to commence from 11 .07.2016, on the solemn announcement held out by the Group of Ministers, consisting of the Hon'ble Home Minister, Finance Minister and the then Railway Ministers. The Govt had categorically stated that they should set up a High Power Committee to look into the matters concerning the upward revision of Minimum Wage Fitment Formula etc. with a direction to submit its report within four months. The NJCA had made reasoned submissions as to the fallacy of the computation of Minimum Wage made by the 7th CPC.

The meeting further noted that the report of the committee, set-up by the Government under the Chairmanship of the Secretary, Pension, to look into the grievances of the employees and officers over the newly introduced Contributory Pension Scheme in place of the existing Defined Benefit Pension Scheme, has been kepi pending by the Government without taking any action whatsoever, thereby denying the benefit of Defined Benefit Of Pension to the employees recruited on or after 1.1 .2004.

The meeting also noted that, rejection of Option No.1, recommended by the 7th CPC, to the Pensioners on the specious ground that the said recommendation was not feasible to be implemented, was nothing but denial of legitimate parity between the past and present Pensioners.

The meeting noted with deep concern and anguish that the government has virtually closed down the doors of negotiation by not convening the meeting of the National council JCM for the past 8 years.
The meeting in the above circumstances and given the totally nugatory attitude of the government has decided to revive the Indefinite Strike action, which was deferred on 30.06.2016, immediately and call upon the Central Government employees to prepare themselves for an otherwise inevitable show down. The meeting noted that the government had been dillydallying the issue for the past two years. The meeting desired that the government must immediately address the following issues and bring about negotiated settlement thereof without any further delay.
a) Upward Revision of Minimum Wage and Fitm ent Formula
b) Scrapping the New Contributory Pension Scheme.
c) Allow Option No.1 as one of the Pension Fitment Formula.
The meeting has directed the Convenor to bring to the notice of the Cabinet Secretary and through him the government lhe resentment and discontent of the employees and await their response up to 07.08.2018 and put into operation the deciSion to revive the decision of Indefinite Strike action immediately, thereafter, in case no negotiated settlement is brought about on the various demands included In the Charter of Demands .

Dear Comrade,
As you may be aware the Govt. of India, Ministry of Finance, has given the following written reply in Parliament for a question asked to Minister of Finance, regarding our demand - "Increase in Minimum Pay and Fitment Formula".

Reply given by Minister of state for Finance:
"The minimum pay of Rs.18000/- p.m. and fitment factor of 2.57 are based on the specific recommendations of the 7th Central Pay Commission in the light of the relevant factors taken into account by it. Therefore, no change therein is at present under consideration".
From the above it is crystal clear that Govt. has gone back from the assurance given on 30.06.2016 by Group of Ministers including Sri Rajnath Singh, Home Minister, Shri Arun Jaitley, Finance Minister and Shri Suresh Prabhan, then Railway Minister, that Minimum Pay and Fitment formula will be increased and for that purpose a High Level Committee will be appointed to submit report within four months.

Now that Govt. has gone back from its assurance, I on behalf of Confederation of Central Govt. Employees & Workers, which is a constituent organisation of NJCA, request you revive our deferred agitational programmes immediately and for that purpose, if necessary, an urgent meeting of the NJCA may be convened.

New Delhi: Finance Ministry top official surprised his colleagues by enquiring whether central government employees' minimum pay improved if they got the much-talked-about minimum pay and hike in basic pay.
The official asked the question in a comment that he wrote on a note sent to him by the central government employees through National Joint Council of Action (NJCA).

In its note, the NJCA requested the ministry to hike the minimum pay in the central government employees' pay structure.

The 7th Pay Commission recommended a minimum basic pay for Central government employees of Rs 18,000 with a maximum pay of Rs 2.50 lakh per month.

However, the NJCA is demanding for hike in minimum pay Rs 18,000 to Rs 26,000, which is now under consideration by the National Anomaly Committee.

"The government used to think that minimum pay under the 7th Pay Commission recommendation did not change central government employees' pay structure. Please discuss," the ministry wrote on the NJCA note and forwarded to the National Anomaly Committee.

The note of NJCA, informed the ministry that they their status in the new pay scale was lower than what it was in the previous scale. The note also said that the 7th Pay Commission made the pay gap of lower paid employees and top bureaucrats higher about to 1:14 ratio from 1:12 in the previous pay structure.

In last year, when the new pay scale was given nod by the cabinet, Union Finance Minister Arun Jaitley had assured unions leaders of central government employees in the Union Home Minister Rajnath Singh's house that the pay gap should be minimized.

Finance Ministry's comment on the note came as a shock to many central government employees, particularly because it comes after above one year of the new pay structure had been implemented.
"We are shocked to know that our ministry does not show interest in the hike in minimum pay," a finance ministry official said seeking anonymity.

"If FM also does not show interest in it, then I wonder how, in the first place, he supported to hike in minimum pay," he said.

The notification for the new pay scale was issued on July 25, 2016 and it was implemented for 5.2 million central government employees with retrospective effect from January 1, 2016.

7th CPC related issues - Review of agitational programmes - Demands raised in the charter of demands


7th CPC related issues - Review of agitational programmes organised by Confederation and the present position of the various demands raised in the charter of demands - Future course of action.

The National Secretariat reviewed various agitational programmes independently organised by Confederation viz: Massive Parliament March on 15-12-2016, one day nationwide strike on 16-03-2017, Mass Dharna organised in front of Finance Minister’s Office on 23-05-2017, Human Chain of Central Govt. employees on 22-06-2017 and Burning of the HRA orders on 25-07-2017. It is reported by all National Secretariat members that the employees and pensioners had participated in large number in all the above programmes.

The Government has already implemented Revised Pay Scales, Revised Allowances and Revised Pension based on 5th CPC recommended parity formula for pre-2016 pensioners. The assurances given by Group of Ministers on 30-06-2016 regarding increase in Minimum Pay and Fitment formula still remains unimplemented. Govt. has not considered the demand to restore HRA rate to 30%, 20% and 10% and implement it from 01-01-2016. All revised allowances are implemented prospectively from 01-07-2017 thereby denying arrears from 01-01-2016. The Option-I parity for pensioners recommended by 7th CPC is rejected by the Government, instead 5th CPC recommended parity is extended to all pre-2016 pensioners. The "very good" bench mark condition imposed for grant of MACP is not yet modified. Even though NPS Committee constituted by Govt. for streamlining NPS has submitted its report to Government, its recommendations are still not made public. The demand for withdrawal of Contributory Pension Scheme and guaranteeing minimum pension (50% of the last pay drawn) is still pending. All other demands raised in the confederation and NJCA charter of demands are also remaining unsettled.

Unfortunately, inspite of the totally negative attitude and non-honouring of the assurance given to NJCA by the BJP-led NDA Government, the dominant leadership of NJCA is not in favour of reviving the deferred indefinite strike and no serious agitational programmes was organised after 6th July 2016 (i.e. after deferring the strike) under the united banner of NJCA, which compelled the Confederation to demarcate and organise independent struggle programmes as mentioned above including one day nation-wide strike.

The National Secretariat meeting took note of the above situation and decided to request once again the Railway Federations which are leading the NJCA as Chairman (NFIR) and Convenor (AIRF) to chalk out serious agitational programmes including strike under the banner of NJCA. Confederation National Secretariat strongly felt that to make the Govt. to honour its assurance on Minimum Pay and Fitment formula, to grant enhanced rate of HRA from 01-01-2016, to get Option-I parity implemented for pre-2016 pensioners, to modify the retrograde bench mark condition for MACP, to scrap NPS and ensure guaranteed minimum pension, to settle the justified demands of Gramin Dak Sevaks and Casual, Contract Workers, a united indefinite strike under the banner of NJCA (Railway, Defence & Confederation) is the need of the hour.

In the absence of a united struggle under the banner of NJCA, the Confederation National Secretariat decided to organise the following agitational programmes in a phased manner.

1. Mass dharna at all District headquarters demanding settlement of modified charter of demands of Confederation on 19th September 2017 (Tuesday).

2. Mass dharna at all state capitals on 17th October, 2017 (Tuesday).

3. Three days massive relay dharna in front of Parliament from 9th November to 11th November 2017 along with Central Trade Unions.

4. Indefinite strike in 2018 jointly along with Central Trade Unions. (Date will be finalised by the Central Trade Unions and independent Federations including Confederation).
All affiliated organisations and COCs are requested to make the above programmes a grand success. As the NDA Government is aggressively implementing the neo-liberal policies in all sectors, it is our responsibility to join hands with the entire trade unions and unitedly resist the onslaught. If the Govt. is not ready to change its destructive policies, the workers have no option but to embark upon a prolonged struggle jointly with the suffering common people of our country, to change the Government. It is in this background Confederation National Secretariat decided to join with the 3 days mass dharna at New Delhi and indefinite strike. In the meantime, if NJCA meets and take decisions for any agitational programmes, confederation shall implement the programmes of NJCA also. Modified charter of demands of the Confederation is also enclosed herewith.


3. 2017 June 10th National Convention of Central and State Govt. Employees (Confederation and All India State Government Employees Federation) on "NPS & Outsourcing" - Review and implementation of the decisions taken by the National Convention.

The National Secretariat decided to implement the following decisions of the 2017 June 10th National Convention on "NPS & Out sourcing" jointly organised by Confederation and AISGEF. Confederation C-O-Cs should contact the AISGEF leaders of their respective states and chalk out detailed plan for implementing the decisions. Large scale participation of employees on behalf of Confederation should be ensured in all the programmes:

1.State level joint conventions by 31-08-2017 (date may be extended if required).
2.District /Taluk level joint conventions before 31-10-2017.
3.Mass Joint dharna at all important Centres including State Capitals on 21-11-2017 (21st November 2917 Tuesday).
4.Raj Bhavan March (Date will be finalised later).
5.Nationwide campaign Jatthas covering all states. (Dates to be finalised later)
6.Massive Parliament March (date to be finalised later).

4. (a) WFTU-TUI meeting at Kolkata on 2017 October 9th & 10th and (b) Asia Pacific Regional meet and World Secretariat meeting of Trade Union International (TUI) Public Services at Thiruvananthapuram on 2017 September 11th & 12th.
(a) Meeting of a team of WFTU Secretariat led by Com. George Mavrikos, General Secretary and all TUIs (Trade Union Internationals) Presidents/General Secretaries will be held at Kolkatta on 2017 October 9th & 10th .
(b) Asia-Pacific Regional meet and World Secretariat meeting of TUI (Public Services) will be held at Thiruvananthapuram on 2017 September 11th (TUI meet) and September 12th (Secretariat meeting).
The Total expenditure for the above two meet is to be borne by the organisations which are affiliated to WFTU- TUIs from India. Confederation’s share amount is fixed as Rs.300000/- (3 Lakhs). After detailed discussion the National Secretariat decided that each affiliates of the confederation shall donate share amount as shown below.

5. National Convention of workers held on 8th August 2017 at New Delhi-Implementation of decisions.
All the Central Trade Unions and Independent Federations (other than BMS) had Organised a massive National convention of workers on 8th August 2017 at Talkatora Stadium New Delhi against the anti-Labour and anti-people polices of NDA Govt. Confederation being a part of this convention, National Secretariat meeting unanimously decided to implement the following programmes decided by the National convention of workers.
(a) To Work for achieving and accelerating united struggles in all sectors of the economy on respective demands, which has already begun.
(b) To organise Block/District/Industrial Centres/States level massive campaign mobilisation and convention in preperation to Central mobilisation to be followed.
(c) Massive three days dharna at National Capital on 9th, 10th, & 11th November 2017 to be attended by lakhs of workers from all over the country.
(d) To prepare for indefinite countrywide strike action against the anti-people, anti-worker and anti-national policies of the NDA Government.
The following Central Trade Unions have participated in the Convention in addition to independent federations of various sectors including Confederation.

INTUC, AITUC, HMS, CITU, AIUTUC, TUCC, SEWA, AICCTU, UTUC, LPF.
The National Secretariat decided that charter of demands adopted by the National convention of workers will be part-I charter of demands and confederation charter of demands will be part-II charter of demands for campaign and mobilisation of Central Government employees and also for the proposed indefinite strike.

6.All India Women’s Trade Union Workshop-2017
The National Secretariat decided to organise "All India Women’s Trade Union Workshop-2017" in the month of November/December 2017. C-O-C Maharashtra (Mumbai) is requested to discuss and inform their readiness to hold the workshop at Mumbai as there is larger concentration of women employees in Mumbai. In order to reduce the financial burden of the Reception Committee it is decided that delegate fee will be Rs.1000/- (Rs. One thousand only) per head. As the train reservation commences four months before, the decision of the C-O-C Mumbai should be communicated to the CHQ before 21-08-2017. On confirming the place only quota to each organisation and C-O-Cs etc. are to be fixed. The C-O-C Mumbai is requested to communicate their decision immediately.

7. Holding of a special convention/meeting of Autonomous body employees organisations and Autonomous body pensioners organistions.
The National Secretariat discussed the situation arising out of abnormal delay in revision of pay of Autonomous body employees and also non-issuing of orders for revision of pension of autonomous body pensioners by the concerned Autonomous bodies/Administrative Ministries. In the case of Autonomous body employees, eventhough the Finance Ministry has issued orders extending the 7th CPC pay scales to autonomous body employees on 13-01-2017, the orders are not implemented in 95% of the autonomous bodies due to the stringent conditions imposed by the Finance Ministry. In the case of Autonomous body pensioners, the stand taken by Finance Ministry and Pension Ministry is that they will not issue any orders for revision of pension or grant of Dearness Relief to Autonomous body pensioners. Earlier during 5th CPC and 6th also they have not issued any separate orders, Once Govt. issues orders for revision of pension and grant of dearness relief to Central Govt. Pensioners, it is upto the autonomous bodies to issue orders based on that orders, in consultation with their Administrative Ministries. But no Administrative Ministry has taken action for revision of pension and grant of dearness relief to Autonomous body pensioners. In short a serious crisis has developed regarding revision of pay scales of Autonomous body employees and Revision of Pension and grant of dearness relief to Autonomous body pensioners.
In the view of the above it is decided to convene a special meeting of all Autonomous body employees organisations and Autonomous body pensioners organisations to discuss and decide future course of action. Date and venue of the meeting will finalised shortly.

8. Problems of affiliated organisations of confederation.
Issues relating to the following departments are discussed and suitable decisions taken.

(2) Printing, Publications & stationary.
(3) Ground water Board.
(4) DAVP
(5) Civil Accounts
(6) Passport

CHARTER OF DEMANDS

1.Honour the assurance given by the Group of Ministers to NJCA on 30th June 2016 and 6th July 2016, especially increase in minimum wage and fitment factor. Grant revised HRA at the rate of 30%, 20% and 10% with effect from 01-01-2016. Settle all anomalies arising out of implementation of 7th CPC recommendations, in a time bound manner.

2.Implement option-I recommended by 7th CPC regarding parity in pension of pre-2016 pensioners.

3. Scrap PFRDA Act and Contributory Pension Scheme and grant pension and Family Pension to all Central Government employees recruited after 01.01.2004, under CCS (Pension) Rules 1972.

4.Treat GraminDakSewaks of Postal department as Civil Servants, and extend all benefits like pay, pension, allowances etc. of departmental employees to GDS.

5.Regularise all casual, contract, part-time, contingent and Daily rated mazdoors and grant equal pay and other benefits.

6.No Downsizing, Privatisation, outsourcing and contractorisation of Government functions.

7.Withdraw the arbitrary decision of the Government to enhance the bench mark for performance appraisal for promotion and financial upgradations under MACP from "GOOD" to VERY GOOD" and also decision to withhold annual increments in the case of those employees who are not able to meet the bench march either for MACP or for regular promotion within the first 20 years of service. Grant MACP pay fixation benefits on promotional hierarchy and not on pay-level hierarchy. Personnel promoted on the basis of examination should be treated as fresh entrants to the cadre for grant of MACP.

8. Withdraw the draconian FR 56 (J) and Rule 48 of CCs (Pension) Rules 1972 which is being misused as a short cut as purity measure to punish and victimize the employees.

9. Fill up all vacant posts including promotional posts in a time bound manner. Lift ban on creation of posts. Undertake cadre Review to assess the requirement of employees and their cadre prospects. Modify recruitment rules of Group-‘C’ cadre and make recruitment on Reginal basis.

10. Remove 5% ceiling on compassionate appointments and grant appointment in all deserving cases.

11. Grant five promotions in the service carreer to all Central Govt. employees.

12.Abolish and upgrade all Lower Division Clerks to Upper Division Clerks.

13.Ensure parity in pay for all stenographers, Assistants, Ministerial Staff in subordinate offices and in all organized Accounts cadres with Central Secretariat staff by upgrading their pay scales. Grant pay scale of Drivers in LokSabha Secretariat to Drivers working in all other Central Government Departments.

14.Reject the stipulation of 7th CPC to reduce the salary to 80% for the second year of Child Care leave and retain the existing provision.

15.Introduce Productivity Linked bonus in all department and continue the existing bi-lateral agreement on PLB wherever it exists.

16.Ensure cashless, hassle free medical treatment to all Central Government employees & Pensioners in all recognized Government and Private hospitals.

17. Revision of Overtime Allowance (OTA) and Night Duty Allowance (NDA) w.e.f 01.01.2016 based on 7th CPC pay scale.

18.Revision of wages of Central Government employees in every five years.

19.Revive JCM functioning at all levels. Grant recognition to the unions/Associations under CCS (RSA) Rules 1993 within a time frame to facilitate effective JCM functioning.

20.Implementation of the Revised Pay structure in respect of employees and pensioners of autonomous bodies consequent on implementation of CCS (Revised Pay) Rules 2016 and Revised Pension Rules in respect of Central Government employees and pensioners.

21.Implementation of the "equal pay for equal work" judgment of the Supreme Court in all departments of the Central Government.

New Delhi: The Empowered Committee of Secretaries (E-CoS) will finally take up higher allowance report on June 1, said Shiv Gopal Mishra, secretary of the National Joint Council of Action (NJCA), which is a centralised union of several central government employees unions, who met the Cabinet Secretary P K Sinha.

The 'Committee on Allowances', which examined the 7th pay commission's recommendations on allowances, submitted its report to the finance minister Arun Jaitley on April 27.

The committee on allowances has suggested some modifications in some allowances that are applicable universally to all employees as well as certain other allowances which apply to specific employee categories, the finance ministry said in a statement.

However, the Committee's report on allowances under the 7th Pay Commission hasn't made public.
The committee on allowances report is being currently examined by the Empowered Committee of Secretaries (E-CoS) headed by Cabinet Secretary P K Sinha set up to screen the 7th pay commission recommendations and to firm up the proposal for approval of the Cabinet.

In June 2016, the government approved 14% pay and pension hike for central government employees and pensioners under the 7th Pay Commission recommendations.

The decision on allowances was postponed at that time because the 7th Pay Commission had recommended abolition of 52 allowances and subsuming of another 36 allowances into larger existing ones out of total 196 allowances. Employee unions were opposed.

Accordingly, the government implemented the recommendation of the 7th Pay Commission from January 1, 2016 in respect of basic pay and dearness allowances, other allowances continued to be paid at old rates.
So, the finance minister Jaitley referred allowances to the committee on allowances headed by Finance Secretary Ashok Lavasa in June last year.

The 7th Pay Commission also recommended slashing the House Rent Allowance (HRA) from 30, 20 and 10 per cent to 24, 16 and 8 percent of the Basic Pay for Class X, Y and Z cities respectively.

The National Joint Council of Action (NJCA) demanded the government to implement higher allowances without further delay with effect from January 1, 2016.

The NJCA also demanded HRA at the rate of 30%, 20% and 10% instead of 24, 16 and 8%.

Sub:  Cabinet decision on 3rd May 2017 related 7th CPC - Reg. Another gimmick by the Modi Government

Dear Comrades,
A press communique was issued by Ministry of Finance on 3rd May 2017 with a caption "Cabinet approves modification in the 7th CPC recommendations on pay and pensionary benefits." Copy of the said communique is attached.

But in the said communique nowhere it was mentioned about any modifications in the recommendations on pay. It contains only two subjects, Revision of pensioners of pre - 2016 pensioners and family pensioners and Disability Pension for Defence Pensioners. The communique is left with half information with regards to pre 2016 pensioners as it was not clarified how the pension is going to regulate.

The attempt of the Government is to create confusion among the Central Government Employees in general and the Public at large, as the Confederation of Central Government Employees & Workers has been announced its next course of action to hold dharna in front of the house of Finance Minister Arun Jaitely's New Delhi on 23rd May 2017.

We can also expect statements from the so called NJCA leadership to congratulate the Government and may even claim because of their effort only the Cabinet too decision on pre - 2016 pensioners (or inaction?).
Beware of such leaders and the Government's attitude and ensure grand success of the Dharna on 23rd May 2017 at Delhi and in all units as per the call from Confederation of Central Government Employees & Workers. Be ready for Dharna

The National Joint Council of Action (NJCA), which is leading the negotiation over 7th Pay Commission on behalf of Central Government employees, has not boycotted the issue of minimum salaries. Speaking to India.com, NJCA convenor Shiv Gopal Mishra reiterated that the issue would be raised by National Council (staff side) after the anomalies related to allowances and pensions get settled.

“Minimum salary is an important issue. We will surely negotiate it with the Government. Once the matter pertaining to allowances and pensions gets settled, the NJCA will raise it,” Shiv Gopal Mishra said.

As per the recommendations of 7th Pay Commission, the minimum salaries of Central Government employees was hiked from Rs 7,000 to Rs 18,000. The fitment factor used by Justice AK Mathur-led 7th pay panel was 2.57. The NJCA has demanded the Government to upgrade the fitment factor to at least 3.68, in order to revise the minimum salaries to Rs 26,000.

The Confederation of Central Government employees has also demanded the Government to raise the minimum salaries to Rs 26,000, along with the regularisation of contractual employees.

The issue of minimum salary was one of the key agenda laid before NJCA before the Government in July 2016, when they had threatened a mass strike. Nearly 33 lakh Central Government employees were expected to participate in the indefinite strike which was scheduled to begin from July 11. However, after receiving assurance from Centre, the NJCA was compelled to retract their mass agitation.

No indication has been given from the Government so far regarding the upgradation of minimum salary using a fitment factor of 3.68. According to experts, Centre could adopt a middle road by using a fitment factor of anything between 2.86 to 3.15. The minimum salary, thereby, could be increased between Rs 19,000 to 22,020. However, no official confirmation regarding the same has been received.

The utmost target for NJCA, before the hike in minimum salary, is the implementation of higher allowances. Due to anomalies raised by unions in July, only the basic component of salary was raised for Central Government employees. The hike in allowances was awaited as Centre formed a committee under Finance Secretary Ashok Lavasa to review the demands raised by unions.

NJCA Secretary Shiva Gopal Mishra's meeting, on March 28, 2017, with the Cabinet Secretary has seemingly put an end to the generation of constant rumours and baseless speculations regarding the Report of Allowance Committee.

Almost every day, the media carried news about the granting of allowances based on the 7th CPC salaries. There is no denying the fact that most of these sensational headlines were based on the meetings in New Delhi or on the statements from the officials involved.

Speculations like "it will be announced today…", "news is expected this week…", "Announcement likely on this date…" were not uncommon. Such news not only generated immense excitement among the Central Government employees, but it also made them contact their respective trade unions for clarifications.

Caught in the midst of their own long list of problems, in addition to planning their future protests, these trade unions were also constantly maintaining pressure on the Central Government by writing letters to them. It was in this scenario that the NJCA Secretary, Shiva Gopal Mishra met the Cabinet Secretary on March 28, 2017.

During the meeting, he had clearly conveyed to the Cabinet Secretary that the long delay have led to the Central Government employees losing interest in this issue. The Cabinet Secretary, on his part, has accepted that decision on the 7th CPC Allowances is taking time, and assured that he would try his best to resolve the issue as quickly as possible. He also said that he will try to obtain the report from the Allowance Committee very soon and forward it to the cabinet for its approval.

Citing the local bodies election in Delhi as the reason for the delay, the Cabinet Secretary has also assured to seek the permission from the Election Commission, if required, to accelerate the process. This assurance has, to some extent, pacified the Central Government employees.

They don't seem to mind the delay, in the desire that arrears for these allowances will be paid.

New Delhi: A finance ministry official, speaking on condition of anonymity, today said that the Central government employees will get the higher allowances under the 7th pay commission recommendations with retrospective effect from January 1, 2016.

Responding to our reporter, the finance ministry official said the central government has to accept to implement the 'Committee on Allowances' recommendations without any hartals by the employees’ unions.
In the past, employees unions had to come on roads and go on strike to push for implementation of pay commission, but this time the government has to order the implementation of higher allowances soon as it is their right, he said.

Employees will get the benefits of the higher allowances with retrospective effect from January 2016, the official said, adding that the government is also working on formulating plan for paying arrears on this account.

The finance ministry will formulate roadmap for payment of arrears, he added.

The government in July last year had formed the 'Committee on Allowances', headed by Finance Secretary Ashok Lavasa, for examination of the recommendations of 7th Pay Commission on allowances other than dearness allowance as the pay commission had recommended abolition of 51 allowances and subsuming 37 others out of 196 allowances.

The committee was initially given four months time to submit the report to Finance Minister Arun Jaitley.
Later, the Finance Minister Arun Jaitley extended the deadline for report submission to February 22, 2017.
The ‘Committee on Allowances is yet to submit its report. The committee is now in the process of finalising its report and the government would take a decision after the report is submitted. It may be taken more time to finalise its report.

Accordingly, the National Joint Council of Action (NJCA), which is a centralised union of several central government employees unions, has told cabinet secretary that the higher allowances must be given as arrears from January 2016.

The central government employees and pensioners got theirs arrears of basic pay and pension arising from implementation of the 7th Pay Commission recommendations in one go in August salaries and pension respectively.

The hike in basic pay and pension has been made effective from January 1, 2016 but the they are still awaiting for the higher allowances.

I have met the Cabinet Secretary on March 28 and have submitted our demands. In which the NJCA have clearly mentioned that whenever there is an implementation of 7th Pay Commission the government has to pay higher allowances effective from January 2016. If the government fails to do so then we will object it in an organised manner, Shiv Gopal Mishra, Convenor, NJCA, said.

With the financial year coming to an end, the central government employees are still waiting for an answer. When will we get higher allowance under the 7th Pay Commission? The committee which was formed by the government on higher allowance has failed to meet its deadline to submit the report.

There are more than 56 lakh employees who will be getting higher allowances under 7th Pay Commission.
Its been more than nine months since the government has formed 7th Pay Commission recommendation committee on higher allowance. In June last year, after the implementation of 7th Pay Commission, Finance Minister Arun Jaitley had announced the formation of Lavasa panel under the chairmanship of Ashok Lavasa, to examine the suggestions on allowance.

According to a India.com report, a Finance Ministry official has said that “Neither Prime Minister Narendra Modi nor Jaitley responsible for the delay in implementation of higher allowance.”

The members of the allowance committee along with National Joint Council of Action (NJCA) leaders will be meeting next week where Lavasa committee is expected to submit the report after discussion with employee representatives, the report said.

NJCA is a joint body of unions representing central government employees.

Earlier, the Lavasa committee was expected to submit the report in October, but since then it got delayed.
The committee is yet to submit the report on House Rent Allowance (HRA) to the government. As reported by Zeebiz earlier, under the 7th Pay Commission, HRA should be paid at the rate of 24%, 16% and 8% of the new Basic Pay, depending on the type of cities while unions demanded HRA at 30, 20 and 10%.
In a reply to a question Lok Sabha, on March 10, Minister of State for Finance Arjun Ram Meghwal, said that the committee has not submitted its report to the government but the deliberations of the committee are in the final stages.
