The freezing of Dearness Allowance would have a serious effect on Central Govt Employees HRA. Pursuant to recommendations from the 7th CPC and as approved by the Govt.The HRA rates in "X" cities will be revised from 24% to 27% and in "Y" cities from 16% to 18% and in "Z" cities from 8% to 9%.

The constituent organizations of the National Council (JCM) are very much shocked to note the arbitrary decision taken by the Government to freeze the DA to Central Govt.Employees and Dearness Relief to the Central Govt. Pensioners up to 30/06/2021. Before taking such a major policy decision the Govt. has not bothered to consult the staff side of the NC(JCM) and without even hearing the views of the staff side, the decision taken especially on a policy matter which effects the wages of the employees and the pension of the senior citizens is against the spirit of the JCM scheme. The entire 48 lakh Central Govt. Employees (including Armed Forces Personnel) and the 65 lakh Pensioners are very much disappointed against the most drastic decision taken by the Govt. against is own employees.

The Central Govt. and State Govt. employees are the one who are playing their front line role in the fight against COVID-19 Virus, by taking all risk and working in the field exposing themselves without any sufficient Personal Protective Equipment. The Railway employees, Defence Civilian employees, Postal employees and all other Central Govt. employees have already contributed their one day wages to the PM-CARES Fund. The Ordnance Factory Employees have contributed their two days wages, In the Railways , Employees belonging to different categories are deployed for various activities such as PW Tracks, signaling, Electrical and Mechanical assets, cenrunning freight trains, parcels special trains, Transport essential goods etc. Almost all the Central Government Departments are involved in one or other activities during the entire lockdown period. The Ordnance Factory Employees are directly involved in manufacturing of various Protective Equipment required for the Doctors, Nurses & Health Care Workers and for other Civil Authorities. Ignoring all these contribution of the Govt. Employees, the Govt. is targeting them on the plea of  crisis arising out of COVID- 19?.

The Staff side of the National Council (JCM) is of the first view that the 48 Lakh Central Govt. Employees (including Armed Forces Personnel) and 65 lakh Pensioners do not deserve such a treatment from the Government.

A part from that many of all our affiliates of JCM Staff Side have contributed to PM-CARES Fund crores of rupees. As well as they are providing shelter, Food , Transport etc to mitigate the problem of poor employees I workers who have lost their job and everything in this Lockdown.

Moreover the freezing of DA will have a serious impact of the HRA of the Central Govt. employees. In accordance with 7th CPC recommendations and as approved by the Govt. the HRA rates will be revised from 24% to 27% in “X” cities, and from 16% to 18% in “Y” Cities and 8% to 9% in “Z” cities.

The manner in which the price for the essential commodities are rocketing sky high, DA is expected to cross 25% from 01/07/2020 on wards. Since the DA is freezed the employees will loose this hike in the HRA also.

You will appreciate that the Pensioners who are senior citizens are most vulnerable in the fight of the COVID-19 virus and any stoppage of DA in their case at this juncture is not an appreciable decision on the part of the Government.

The decision of the Govt. has subjected the Central Govt. Employees and the Pensioners to unnecessary financial hardship and mental agony when they all are on the field fighting from the front line against the spread of COVID-19 Virus through various official activities.

Therefore we request you to convey our feelings to the Hon’ble Prime Minister and also our request to reconsider the above decision of the Govt. and withdraw the same, so as to motivate the Central Govt. employees to perform their responsibilities, especially in this crisis period.

Ref.: My earlier letter dated 30.06.2017

I have discussed the issues creating mental agony in the minds of the Central Government Employees many a times and once again want to draw your kind attention for resolution of many long pending demands of the Central Government Employees.

National Pension System (NPS) has been raised by the Staff Side (JCM) many a times, the committee set up by the Government of India for reviewing NPS has also submitted its report, but we are not aware about the outcome of the same. Staff Side(JCM) has been of the firm view that there must be "Guaranteed Pension" for the employees recruited on or after 01.01.2004, and in case of their death/permanent disablement, their families should get Pension as per Old Pension Scheme.

All the Central Government Employees are anxiously waiting for recommendations of the Government of India for increasing Minimum Wage and improving Fitment Formula and inordinate delay in this regard is creating lot of frustration amongst them.

It is, therefore, requested that, you may please intervene in the above-mentioned issues and the same should be resolved in an amicable manner to avoid mental agony of the Central Government Employees.

Today I met the Cabinet Secretary (Government of India) and raised the issues pertaining to National Pension System (NPS), Minimum Wage and Fitment Formula, "Very Good" benchmark for MACPS and non-holding of meetings of the National Council (JCM).

The Cabinet Secretary said that, he is aware of the problems of the Staff Side (JCM) from time to time and particularly to this issue and will definitely try to resolve them.

Particularly on the issue of National Pension System (NPS) he said that, the issue is under active consideration of the Government of India and we are trying to find out some solution to the problems arisen because of the NPS.

"Speculations about the Committee on 7th CPC Allowances have stopped following the assurance from the Cabinet Secretary"

NJCA Secretary Shiva Gopal Mishra's meeting, on March 28, 2017, with the Cabinet Secretary has seemingly put an end to the generation of constant rumours and baseless speculations regarding the Report of Allowance Committee.

Almost every day, the media carried news about the granting of allowances based on the 7th CPC salaries. There is no denying the fact that most of these sensational headlines were based on the meetings in New Delhi or on the statements from the officials involved.

Speculations like "it will be announced today…", "news is expected this week…", "Announcement likely on this date…" were not uncommon. Such news not only generated immense excitement among the Central Government employees, but it also made them contact their respective trade unions for clarifications.

Caught in the midst of their own long list of problems, in addition to planning their future protests, these trade unions were also constantly maintaining pressure on the Central Government by writing letters to them. It was in this scenario that the NJCA Secretary, Shiva Gopal Mishra met the Cabinet Secretary on March 28, 2017.

During the meeting, he had clearly conveyed to the Cabinet Secretary that the long delay have led to the Central Government employees losing interest in this issue. The Cabinet Secretary, on his part, has accepted that decision on the 7th CPC Allowances is taking time, and assured that he would try his best to resolve the issue as quickly as possible. He also said that he will try to obtain the report from the Allowance Committee very soon and forward it to the cabinet for its approval.

Citing the local bodies election in Delhi as the reason for the delay, the Cabinet Secretary has also assured to seek the permission from the Election Commission, if required, to accelerate the process. This assurance has, to some extent, pacified the Central Government employees.

They don't seem to mind the delay, in the desire that arrears for these allowances will be paid.

OFFICE MEMORANDUM

Subject : Grant of Dearness Allowance to Central Government employees - Revised Rates effective from 1.1.2017.

The undersigned is directed to refer to this Ministry's Office Memorandum No. 1/2/2016-E-II (B) dated 4th November, 2016 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 2% to 4% of the basic pay with effect from 1st January, 2017.

2. The term 'basic pay' in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc.

3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of FR 9(21).

4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of Tess than 50 paise may be ignored.
5. The payment of arrears of Dearness Allowance shall not be made before the date of disbursement of salary of March, 2017.

6. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

7. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Minimum Wage of Rs.26000- and Open Ended Pay Scales

JCM DELEGATION PROPOSED BEFORE THE 7th  CENTRAL PAY COMMISSION

During 2 days deliberations on 23rd & 24th March, 2015, the JCM (Staff Side) delegation have pleaded before the 7th Central Pay Commission to recommend minimum wage of Rs. 26,000/- per month on the basis of 15th ILC Norms/ Aykroyd Formula. Some of the important submissions made before the Pay Commission are listed below:

. Wage ratio between the lowest and highest should be 1:8.
. Revised pay scales and allowances should be given effect from 01/01/2014.
. 3.7 multiplication factor should be applied to arrive at the revised pay. Special Pay concept should be restored back.
. HRA should be revised to 60%, 40% and 20% of pay for ‘X’ ‘Y’ and ‘Z’ class localities/ cities respectively.
. Children Education Allowance should be revised and extended to cover higher studies
also.
. Increment rate should be 5% of pay.
. Five promotions during service.
. Special Duty Allowance for North Eastern Region be revised to 37-1/2%.
. House Building Amount should be increased and interest rate should be reduced.
. 6th CPC Anomalies may be got addressed through a special mechanism.
. Flexi timings for women employees besides additional leave facilities etc.,

Pension

. Pay Commission was urged to recommend panty in Pension.
. Minimum Pension should be fixed at 67% of last pay drawn.
. Gratuity amount should be upwardly revised.

All the issues contained in the JCM memorandum were explained to the Commission with cogent logic, merits and Precedents. S/Shri M. Raghavaiah, Leader JCM (Staff Side), Guman Singh. NFIR President, R.P. Bhatnagar, Working President and B.C. Sharma, Joint General Secretary have participated in the deliberations.
