Subject : Submission of Life Certificate by NPS-AR pensioner through Jeevan Pramaan.

The Central Pension Accounting Office is Pension Disbursing Authority for National Pension system- Additional Relief (NPSAR). The NPS-AR pensioners are required to submit Life Certificate in the month of November every year for continuation of the pension. Life Certificates are sent to CPAO through the Bank Branches of the pensioners, where the pensioners maintain their pension accounts.

2. A new interface (Aadhar based) for submission of Life Certificate has been developed in Jeevan Pramaan for NPS-AR pensioners and this interface is now live for submission of Digital Life Certificate (DLC] through Jeevan Pramaan. Now NPS-AR pensioners can submit their Life Certificate through Jeevan Pramaan. The Jeevan Pramaan User Manual for uploading Digital Life Certificate is attaching herewith.

National Pension System (NPS) was introduced for Central Government employees by a Notification of Ministry of Finance (Department of Economic Affairs) dated 22nd December, 2003. NPS is mandatory for all new recruits to the Central Government service from 1st January, 2004 (except the armed forces). However, in some specific court cases, like WP(C) No. 3834/2013 titled Permanand Yadav Vs. Union of India and WP(C) No. 2810/2016 viz.Rajendra Singh Vs. Union of India, where the selection of candidates had been made before 01.01.2004 but their actual appointment in the Government service could be made on or after 01.01.2004 due to various reasons, on the direction of the Hon’ble High Court of Delhi, the benefit of Old Pension Scheme was allowed to the petitioners.

After considering all the relevant aspects and to extend the benefit to similarly placed Government servants in order to reduce further litigation, the Government has decided, vide an Office Memorandum No. 57/04/2019-P&PW(B) dated 17th February, 2020 of the Department of Pension & Pensioners’ Welfare, that in all cases where the results for recruitment were declared before 01.01.2004 against vacancies occurring on or before 31.12.2003, the candidates declared successful for recruitment shall be eligible for coverage under the Central Civil Services (Pension) Rules, 1972. Accordingly, such Government servants who were declared successful for recruitment in the results declared on or before 31.12.2003 against vacancies occurring before 01.01.2004 and covered under the National Pension System on joining service on or after 01.01.2004, may be given a one – time option to be covered under the Central Civil Services (Pension) Rules, 1972.

The advertisements issued before the introduction of the National Pension System may or may not have contained a clause regarding the pension scheme applicable to the selected candidates. In its order dated 27.03.2019 in W.P.(C) 10306/2016 – Union of India & others versus Dr. Narayan Rao Battu& another, Hon’ble High Court of Delhi observed that since the new pension scheme was in effect and a policy decision had already been taken to make the said scheme applicable to all incumbents joining government service on or after 01.01.2004, the Respondent, who was appointed on 25.02.2005, cannot claim the right to be covered by the old pension scheme, merely because the vacancy against which he was appointed was initially advertised at a time when the old pension scheme was in force. Hon’ble Court also observed that once the new pension scheme unambiguously and specifically provided that since all incoming office bearers, whose date of appointment is on or after 01.01.2004, would be governed by the new pension scheme, no reference can be made to either the date of vacancy, or the date of advertisement.

In view of the specific provisions of the Notification dated 22.12.2003, the date of advertisement for the vacancies or the date of examination for selection against those vacancies is not considered relevant for determining the eligibility for coverage under the Old Pension Scheme or the National Pension System. There is no proposal to revise the orders issued vide aforesaid Office Memorandum dated 17.02.2020.

This information was given by the Union Minister of State (Independent Charge), Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh in a written reply in Rajya Sabha today.

The pension sector regulator Pension Fund Regulatory and Development Authority (PFRDA) has pledged to contribute a part of the employee’s salary to the Prime Minister's Citizen Assistance and Relief in Emergency Situations (PM CARES) Fund, instituted recently under the guidance of Prime Minister Shri Narendra Modi to assist and provide relief measures to the citizens of the country following the global outbreak of novel Coronavirus (COVID-19).

Alike other Government institutions, industry leaders, celebrities, individuals, PFRDA employees have decided to contribute part of their salary and PFRDA is committed to assist the government in its fight against the pandemic in India.

Shri Supratim Bandyopadhyay, Chairman PFRDA said “This is one of the most challenging period that our country is facing today. At this moment what matters most is sharing the responsibility of fight against coronavirus (COVID-19) in every way possible. The PFRDA is perceptive of the implications of this pandemic situation and would like to contribute towards the fight of this crisis”.

About PFRDA

Pension Fund Regulatory and Development Authority (PFRDA) is the statutory Authority established by an enactment of the Parliament, to regulate, promote and ensure orderly growth of the National Pension System (NPS) and pension schemes to which this Act applies. NPS was initially notified for central government employees joining service on or after 1st Jan 2004 and subsequently adopted by almost all State Governments for its employees. NPS was extended to all Indian citizens (resident/non-resident/overseas) on a voluntary basis and to corporates for its employees.

As on 31st March 2020, the total number of subscribers under NPS and Atal Pension Yojana has crossed 3.45 crores and the Asset under Management (AUM) has grown to Rs 4,17,478 crores. More than 68 lakhs government employees have been enrolled under NPS and 22 lakhs subscribers have subscribed to NPS in the private sector with 7,568 entities registered as corporates. More than 2.11 crores subscribers are presently covered under the GoI guaranteed pension scheme - Atal Pension Yojana.

The Department of Pension and Pensioners ' Welfare released a significant order on 17 February 2020 on extending the benefit to Central government employees whose appointment has been postponed after 31 December 2003.

Under this Order, a single right to be protected under CCS (Pension) Rules (1972) may be given to government officers who have been deemed effective to obtain the results declared before or on 31.12.2003 against vacancies that take place before 01.01.2004 for joints on or after 01.01.2004. The Central government employees in question can exercise this option by 31.05.2020 at the earliest.

Subject: Coverage under Central Civil Services (Pension) Rules, 1972, in place of National Pension System, of those Central Government employees whose selection for appointment was finalized before 01.01.2004 but who joined Government service on or after 01.01.2004.

The undersigned is directed to say that consequent on introduction of National Pension System (NPS) vide Ministry of Finance (Department of Economic Affairs) Notification No. 5/7/2003-ECB & PR dated 22.12.2003, all Government servants appointed on or after 01.01.2004 to the posts in the Central Government service (except armed forces) are mandatorily covered under the said scheme. The Central Civil Services (Pension) Rules, 1972 and other connected rules were also amended vide Notification dated 30.12.2003 and, after the said amendment, those rules are not applicable to the Government servants appointed to Government service after 31.12.2003.

2. Representations have been received in this Department from the Government servants appointed on or after 1.1.2004 requesting for the benefit of the pension scheme under Central Civil Services (Pension) Rules, 1972 on the ground that their appointment was delayed on account of administrative reasons or lapses. Similar references have been received from Ministries/Departments seeking advice of this Department on the question whether the Government servants who were appointed on or after 1.1.2004 could also be extended the benefit of pension scheme under CCS (Pension) Rules, if their appointment was delayed beyond 31.12.2003 on account of administrative reasons and the delay in appointment was beyond the control of the said Government servants.

3. From the representations of the Central Government employees and the references received from Ministries /Departments, it has been observed that in many of the cases referred to this Department, selection process (including written examination, interview and declaration of result) for recruitment had been completed before 01.01.2004 but the employee joined the Government service on or after 01.01.2004. A few illustrations where the selection was finalized before 01.01.2004 but actual joining took place on or after 01.01.2004 are as under:
(i) The result for recruitment was declared before 01.01.2004 but the offer of appointment and actual joining of the Government servant was delayed on account of police verification, medical examination etc.;
(ii) Some of the candidates selected through a common selection process were issued offers of appointments and were also appointed before 01.01.2004 whereas the offers of appointment to other selected candidates were issued on or after 1.1.2004 due to administrative reasons/constraints including pending Court/ CAT cases.
(iii) Candidates selected before 01.01.2004 through a common competitive examination were allocated to different Departments/ organization. While recruitment process was completed by some Department(s) / organizations on or before 31.12.2003 in respect of one or more candidates, the offers of appointment to the candidates allocated to the other Departments / organization were issued on or after 01.01.2004.
(iv) Offers of appointment to selected candidates were made before 01.01.2004 with a direction to join on or after 01.01.2004.
(v) Offers of appointment were issued to selected candidates before 01.01.2004, and many/ most candidates joined service before 01.01.2004. However, some candidate(s) were allowed extension of joining time and they joined service on or after 01.01.2004. However, their seniority was either unaffected or was depressed in the same batch or to a subsequent batch, the result for which subsequent batch was declared before 01.01.2004.
(vi) The result for recruitment was declared before 01.01.2004 but one or more candidates were declared disqualified on the grounds of medical fitness or verification of character and antecedents, caste or income certificates. Subsequently, on review, they were found fit for appointment and were issued offers of appointment on or after 01.01.2004.
In all the above illustrative cases, since the result for recruitment was declared before 01.01.2004, denial of the benefit of pension under CCS (Pension) Rules, 1972 to the affected Government servants is not considered justified.

4. The matter has been examined in consultation with the Department of Personnel & Training, Department of Expenditure and Department of Legal Affairs in the light of the various representations/references and decisions of the Courts in this regard. It has been decided that in all cases where the results for recruitment were declared before 01.01.2004 against vacancies occurring on or before 31.12.2003, the candidates declared successful for recruitment shall be eligible for coverage under the CCS (Pension) Rules, 1972. Accordingly, such Government servants who were declared successful for recruitment in the results declared on or before 31.12.2003 against vacancies occurring before 01.01.2004 and are covered under the National Pension System on joining service on or after 01.01.2004, may be given a one-time option to be covered under the CCS(Pension) Rules, 1972. This option may be exercised by the concerned Government servants latest by 31.05.2020.

5. Those Government servants who are eligible to exercise option in accordance with para-4 above, but who do not exercise this option by the stipulated date, shall continue to be covered by the National Pension system (NPS).

6. The option once exercised shall be final.

7. It is clarified, that the above option would be available to only those Government servants who were declared successful for recruitment before 01.01.2004, against vacancies pertaining to the period prior to that date. This option shall, however, not be available to the Government servants appointed on or after 01.01.2004 if they fall in any of the following categories:
(i) Government servants whose names were included in a panel of selected candidates before 01.01.2004 for recruitment against vacancies occurring on or after 01.01.2004 and were, accordingly, recruited on or after 01.01.2004.
(ii) A Government servant whose name was included in a panel of selected candidates prepared before 01.01.2004 for vacancies arising before and after 01.01.2004 but was actually appointed after 31.12.2003 against a vacancy arising on or after 01.01.2004.
(iii) Government servants who were selected against vacancies pertaining to the period prior to 01.01.2004 on the basis of an advertisement / notification issued before 01.01.2004 or a written examination / interview held before 01.01.2004 but results for recruitment were declared on or after 01.01.2004.
(iv) Government servants who joined on or after 01.01.2004 after they were granted extension of joining time on their own request and, in accordance with the instructions issued by the Department of Personnel & Training, their seniority was depressed on account of such extension of joining time to a batch for which the result for recruitment was declared on or after 01.01.2004.
8. The matter regarding coverage under the CCS (Pension) Rules, 1972 based on the option exercised by the Government servant shall be placed before the appointing authority for consideration in accordance with these instructions. In case the Government servant fulfils the conditions for coverage under the CCS (Pension) Rules, 1972, in accordance with these instructions, necessary order in this regard shall be issued latest by 30 September, 2020. The NPS account of such Government servants shall, consequently, be closed w.e.f. 01st November, 2020.

9. The Government servants who exercise option to switch over to the pension scheme under CCS (Pension) Rules, 1972, shall be required to subscribe to the General Provident Fund (GPF). Regarding accountal of the corpus in the NPS account of the Government servant, Controller General of Accounts (CGA) has furnished the following clarification vide letter No. 1(7)(2)/2010/cla./TA III/390 dated 14.11.2019:
i. Adjustment of Employees’ contribution in Accounts: Amount may be credited to individual’s GPF account and the account may be recasted permitting up-to-date interest (Authority-FR-16 &Rule 11 of GPF Rules).
ii. Adjustment of Government contribution under NPS in Accounts: To be accounted for as (-) Dr. to object head 70 – Deduct Recoveries under Major Head 2071 - Pension and other Retirement benefit – Minor Head 911- Deduct Recoveries of overpayment (GAR 35 and para 3.10 of List of Major and Minor Heads of Accounts).
iii. Adjustment of increased value of subscription on account of appreciation of investments - May be accounted for by crediting the amount to Govt. account under M.H. 0071- Contribution towards Pension and Other Retirements Benefits 800- Other Receipts ( Note under the above Head in LMMHA).
10. All Ministries / Departments are requested to give wide publicity to these orders. The cases of those Government servants who fulfil the conditions mentioned in this O.M. and who exercise option to switch over to the pension scheme under CCS (Pension) Rules may be settled by the administrative Ministries / Departments in accordance with these orders.

11. These orders issue with the concurrence of Ministry of Finance, Department of Expenditure, vide their I.D. Note No. 1(7) EV/2019 dated 08.01.2020.

12. In their application to the employees of Indian Audit and Accounts Department, these orders are issued after consultation with Comptroller and Auditor General of India, as mandated under Article 148(5) of the Constitution.

Attention is invited to Board’s letter No. 2008/AC-II/21/19 dated 29.05.2009 vide which instructions were issued providing for additional relief on death/disability of Government servants covered by New Defined Contribution Pension System (NPS). Instructions issued vide letter ibid will be applicable to those Government Servants who joined Government Service on or after 01.01.2004 and will take effect from the same date i.e. 01.01.2004. Further, attention is invited to the letter No. 2016/F(E)III/1(1)/3 dated 27.05.2016 vide which Pension Fund Regulatory and Development Authority (Exits and Withdrawals under NPS) Regulation, 2015 notified vide Gazette notification dated 11.05.2015 was adopted and circulated on Railways. It is prescribed in these regulations that if the subscriber or the family members of the deceased subscriber, upon his death, avails the option of additional relief on seek transfer of the entire accumulated pension wealth of subscriber to itself.

2. References were received in this office seeking clarification whether the rule allowing option for drawl of pension/ family pension, instead of NPS corpus, is also applicable retrospectively for the cases where corpus of NPS has already been paid to the deceased employee’s legal heirs before issue of board’s letter No. 2008/AC-II/21/19 dated 29.05.2009. If the date of application of additional benefit is retrospective, whether it is from the date the employee deceased or from the date of issue of Board’s letter dated 29.05.2009. Also, whether the arrears of pension/family pension is to be paid (upon surrender of NPS Corpus) or not, and the amount is likely to be huge which would impact the Railway Finances. Clarification was, also, sought whether the interest on the corpus is to be charged from the date of payment of corpus amount till the date of is surrender and if so, at what rate.

3. The above issue has been examined in consultation with Department of Pension and Pensioners’ Welfare (DOP&PW), the nodal Department of pensioner matters. DOP&PW has clarified that Railway servant/ family member in the case of death of railway servant of his discharge from service on account of invalidation/ disability, is entitled to pension/ family pension under old pension scheme under Railway Services (Pension) Rules, 1993, if the Railway servant/ Family wants to. DOP&PW have, further, clarified that the entire accumulated pension funds under NPS may be recovered from him/family with interest for the period from the date of receipt of entire accumulated pension wealth to the subscriber under NPS to the date of refund to the Government at the rate and manner applicable to GPF deposits from time to time.

4. The aforesaid clarification may be kept in view while dealing with cases covered under National Pension System (NPS).

Subject: Clarification - Enrollment of Overseas Citizen of India (OCI) in NPS.
  1. This is in continuation to the Circular No: PFRDA/2019/19 /PDES/3 dated 29th Oct, 2019 on the above subject whereby the Authority permitted Overseas Citizen of India (OCI) to enroll in National Pension System (NPS) at par with Non-Resident Indians (NRI).
  2. Based on the communication received from Insurance Regulatory and Development Authority of India (IRDAI), it is hereby clarified that Annuity payable by ASPs to NRIs and OCIs will be taxed at source, at rates applicable as per the DTAA (Double Taxation Avoidance Agreements) of the country where the annuitant resides.
  3. Hence the intermediaries including Annuity Service Providers (ASPs) are required to display/ convey to the prospective and existing subscribers that ‘Annuities payable to NRI/ OCI are subject to TDS and ‘repatriation of the corpus, if any, will be subject to applicable laws and regulatory provisions of IRDAI/ PFRDA/ RBI in their relevant marketing materials / website(s) / brochures / communications.

Government of India in February, 2019 launched Pradhan Mantri Shram Yogi Maan-dhan (PM-SYM), a voluntary and contributory pension Scheme, for the benefit of unorganized workers, as per eligibility. The scheme assures minimum monthly pension of Rs. 3000 to the beneficiaries after attaining the age of 60 years. All unorganized workers, in the age group of 18-40 years, whose monthly income is up to Rs. 15,000 and who are not members of Employees’ Provident Fund Organization or Employees’ State Insurance Corporation or National Pension System (Government contributed) and are also not income tax payers, are eligible to enroll under the Scheme. The subscriber is required to pay the prescribed monthly contribution amount and the Central Government provides the equal matching contribution. This Scheme is implemented through Life Insurance Corporation of India. Enrollment under the Scheme can be done through any of the Common Service Centres across the country.

Further, vide notification No. G.S.R. 593 (E) dated 19.08.2014, a minimum pension of Rs. 1000 per month has been fixed with effect from 01.09.2014 for the pensioners under Employees' Pension Scheme (EPS), 1995 framed under the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952, applicable to establishments which belong to industries and classes of establishments listed in Schedule-I and where number of employees is 20 or more. No decision has been taken at present to further enhance the minimum pension under EPS, 1995.

Further, Atal Pension Yojana (APY) was launched in May, 2015, by the Government of India, and Indian Citizens between the age group of 18 to 40 years are eligible to join APY through their savings bank account or post office savings bank account. Depending upon the pension plan selected, each subscriber under APY shall receive a guaranteed minimum pension of Rs. 1000/- per month or Rs. 2000/- per month or Rs. 3000/- per month or Rs. 4000/- per month or Rs. 5000/- per month, after the age of 60 years until his/her death.

This information was given by Shri Santosh Kumar Gangwar Union Minister of State (I/C) for Labour and Employment in written reply to a question in Lok Sabha today.

Conference on Implementation of National Pension System by State Governments

A conference on implementation of National Pension System by State Governments was organized by PFRDA on 10th Sept 2018 at IHC, New Delhi. The prime objective was to provide a forum to all State Governments, where the progress in the implementation of NPS with respect to compliance of timelines in various NPS related activities could be brought to the fore and a way forward could be provided. Higher officials from all State Governments attended the conference.

Dr. Badri Singh Bhandari, Whole Time Member (Economics) in his opening address informed the state government officials about the features and benefits of NPS and various initiatives undertaken by PFRDA. He emphasised the use of online generation of PRAN, dashboard facility for effective monitoring of nodal officers and timely submission of subscriber registration forms and regular remittance of subscriber contribution. He reiterated about the issuance of guidelines by State Governments regarding procedure and timelines to be followed by State Governments for registration of new employees, upload of SCFs and remittance of the NPS contributions. He also touched upon the need of resolving pending grievances and withdrawals on priority by the nodal officers.
Sh. Ajay Narayan Jha, Secretary, Dept of Expenditure, Govt. of India in his address stated that the need of contributory system of pension arose due to the twin objectives to ensure fiscal prudence and secure old age income security in the country. Fiscally strong States are important for progress and development as the pension liabilities of the government has been increasing in terms of proportion of GDP. He advised participating State Governments to monitor the performance of NPS implementation with respect to timely completion of NPS related activities at nodal office level.

Chairman, PFRDA, Sh. Hemant G. Contractor, emphasized on the need for the government officials to be aware of the determinants of pension. NPS, being a contributory and market driven scheme, is different from the earlier pension system in the government, which was a formula based PAYG (Pay As You Go) scheme. In NPS, pension is dependent on various factors, such as the contribution amount, period of contribution, regularity in remittances, returns on investment, withdrawals, deferment options and choice of annuity. He urged the State governments to adopt online PRAN generation Module (OPGM) and to ensure effective implementation and monitoring of NPS. He also urged State Governments to ensure extending choices similar to those available to non-government subscribers and also to frame Rules for the guidance of government staff handling NPS in the States.
Quite a few presentations were made by various stakeholders under NPS for the benefit of the participants. As on 31st August, 2018, 28 States have implemented NPS and there are 32.51 Lakh subscribers with asset under management of Rs 1,16,227.49 Cr.

NPS contribution being deducted from salary without PRAN:

As per information obtained from IPAS, there were 1024 employees without PRAN from whom NPS deductions were made from salary in the month of July, 2019. Of these, 415 cases were in SCR, 404 cases in SWR and 119 cases in CR. This implies that the NPS recoveries in these cases would lie in the suspense and will lead to loss of interest to subscribers, which will have to be borne by the Railways. This position is available to the Railways

Action:
  • PED/A desired that IPAS exception reports should be viewed and acted upon by all Railways
  • All these cases may be reviewed, PRAN generated at the earliest, subscription remitted to the Trustee Bank forthwith.

Number of PRANs without Nomination and Mobile details

There are 35025 PRANs with nomination details and 44553 PRANS without Mobile No. Non-availability of Nomination details will delay settlement in case of Death of a Subscriber.
Action:
  • Mobile number has been made mandatory in CSR Form. For old cases, DDO/ PAO should insist on providing the same with the help of WLI. Subscribers should be educated about importance of having nomination and mobile no. in their PRANs.
  • Nomination and Mobile no. should be collected from every subscriber and updated immediately.
  • As a onetime effort, the Mobile numbers and email ids of these subscribers can be forwarded to NSDL for back end updation.

Subscriber Coverage:

There is substantial gap in no. of registered subscribers and those receiving credits viz. ECR - 83.06%, NR - 87.56% and NER and SCR 89%.
Action:
  • DDOs/ PAOs should ensure all the registered subscribers are receiving regular contribution credits
  • SCFs uploaded should get matched and booked in the CRA system. Cancelled SCFs need to be re-uploaded on time.
  • The regular monthly contributions should be uploaded as “regular” and arrear contributions as “arrear”.

Withdrawal requests pending for purchase of annuity

There are 634 cases where the subscriber has not chosen the Pension plan.
Action:
  • Employees that have exited should be asked to make the option.
    Necessary informatory Youtube videos about the various pension plans are available.
  • Links of these videos are at Annexure -2. Railways/Units may arrange to broadcast these for the benefit of the subscriber/retirees.
  • NSDL offered training session for subscribers as well as Railway officals (Accounts & Personnel), on various aspects of NPS. Request for the same can be sent to NSDL under intimation to Railway Board For any queries/ assistance, PAOs may send an email to npsclaimassist@nsdl.co.in.

STATUS OF PENDING PENSION/FAMILY PENSION under NPS

  • Railway Board had directed Railways to send information on pending cases of pension and family pension in MCDO to FC. The information in not forthcoming from all the Railways. Submission of this information may kindly be ensured.
  • Further, it is noticed that several requests for family pension by family members of deceased NPS subscribers are pending on Railways mainly for want of documents from beneficiaries. This issue is being raised by Union/Federations and also by the beneficiaries in various forums.
  • Complaints are also received regarding non-revision of NPS pension as per recommendation of 7th CPC
  • Railways may review the pending position and ensure clearance thereof in a time bound manner.

Conclusion:

All Railways will ensure necessary action on the deficiencies discussed above and send an action taken report by 15th Oct., 2019 under signature of FA&CAO in charge of NPS.

  • Calculation limit of Bonus should be extended upto 18000 based on recommendation of 7th CPC on Minimum Pay
  • Total abolition of Contract Worker System/ Outsourcing System for job of permanent nature in all Govt Departments

Subject: Introduction of NPS oversight mechanism.

The undersigned is directed to say that the Committee, as set-up by Department of Financial Services in terms of their OM No. 1/3/2016-PR dt. 21.10.2016 under the Chairmanship of Secretary (Pension) and comprising Secretary, Department of Financial Services and Secretary (Department of Personnel and Training), had submitted its report on 28.2.2018, containing its recommendations for streamlining implementation of the National Pension System (NPS).

2. One of the recommendations contained in para 8.7.1 of its report relating to grievance redressal is as under:-

“Three-tiered NPS oversight mechanism of the DDO/Head of Office, Joint Secretary (Admin)/Chief Controller of Accounts and the Financial Advisor set up vide Department of Expenditure’s OM No.1(2)/EV/2008, dated 03.02.209 may be strengthened/streamlined to monitor grievances as well as timely registration and credit of contributions to subscribes’ accounts. Fresh instructions to this effect and for strict compliance of instructions may be issued by Department of Expenditure.”

3. In the OM of this Department No. 1(2)/EV/2008 dated 3.2.2009, it was provided, inter-alia, that Ministries/Departments may constitute a Committee headed by J5 (Admin) and Principal CCA/CCA to monitor registration/regular upload of data and transfer of NPS contributions in respect of Central Government employees to ensure that no delay therein occurs. Subsequently, in terms of instructions of this Department vide OM No. 1(5)/EV/2011 dated 10.7.2011 the Committee was broad-based to include the concerned Financial Advisors and the said instructions dt. 10.7.011 also provided, inter-alia, that the implementation of NPS, with its various attendant parameters, in each Central Ministry/Department, shall be a “key performance area” of the Financial Advisors.

4. The Department of Pension and Pensioners’ Welfare, which is the nodal Department in respect of pension related matters of Central Government employees, is separately in the process of framing statutory rules to regulate the matters of National Pension System in case of Central Government employees. These Rules would also cover the issue relating to timely credit of contributions of Central Government employees and the Central Government, as deducted from the salaries of the concerned Government employee, to NPS architecture.

5. However, since timely credit of deduction made from the salary of Central Government employees towards their contribution to NP5, as also the applicable contribution of the Central Government, to the NP5 financial architecture is of paramount importance for availability of due and timely returns thereon towards generation of pension corpus, it has been decided that a Committee in each Ministry/Department shall be constituted as under to ensure oversight over the NPS contributions crediting:-

(i) Financial Advisor – Head of the Committee
(ii) Joint Secretary (Administration)
(iii) Principal CCA/CCA
(iv) The concerned Head of the office
(v) The concerned DDO

6. The Committee shall be responsible for the following actions:-

(i) Ensuring that the contribution of employees and the Government are credited without delay to the NPS financial architecture both in case of existing employees and employees newly recruited from time to time and the existing system and procedure being followed for the purpose shall be monitored effectively to ensure that no delay in credit of the contributions takes place.

(ii) Ensuring that in case any grievance by any employee is received in regard to delay in credit of contribution, either directly from the employee or through PFIZDA, the same has been looked into and disposed of in a manner to the satisfaction of the concerned employee.

(iii) Any other matter as having a bearing on the issue of crediting/remittance
of NPS contributions.

(iv) The Committee shall devise its own mechanism as also appropriate checks & balances to ensure that NP5 contributions are credited on time in respect of all employees under NPS system.

(v) The Committee shall meet at least once in 3 months to review the progress and in case any slippages are noticed, it shall take immediate corrective action. However, the concerned Principal CCAI CCA shall keep a watch over the progress on a regular basis.

7. While the above Committee shall be set-up in each Ministry/Department, appropriate mechanism for keeping a watch in respect of attached and subordinate offices under that Ministry/Department shall be put in place by the concerned Financial Advisor, so that the overall oversight in respect of the entire Ministry/Department as a whole is exercised by the Committee as mentioned in para 5 above.

8. The concerned Financial Advisor shall send a status report every six month to the Department of Pension and Pensioners’ Welfare about the result of the monitoring carried out through the above oversight mechanism with concluding remarks whether the NPS contributions are being credited on time and in case of any slippages, the details of the action taken.

Subject: Withdrawal of resignation of Central Government servants appointed after 31.12.2003 covered under the National Pension System (NPS) reg.

The undersigned is directed to say that instructions on the procedure to be followed for 'Resignation from service' have been provided vide Ministry of Home Affairs O.M. No.39/6/57-Ests.(A) dated 06.05.1958, Department of Personnel & Training (DoPT) O.M. No.28034/25/87-Estt(A) dated 11 .02.1988, No.28034/4/94 - Estt.(A) dated 31 .05.1994 and No.28035/2/2007-Estt.(A) dated 04.12.2007. Para 5 of DoPT O.M. dated 11 .02.1988 referred to above, provides the procedure for withdrawal of resignation as governed by Rule 26 (4) to (6) of Central Civil Services (Pension) Rules, 1972. References are being received from Ministries/Departments on the request for withdrawal of resignation by Government servants appointed after 31 .12.2003 and for whom CCS (Pension) Rules are not applicable. The matter of withdrawal of resignation of Government servants of Central Civil Services/Posts, appointed after 31 .12.2003 who are covered under the National Pension System (NPS) and for whom CCS (Pension) Rules, 1972 is not applicable has been considered in this Department and with the approval of the competent authority, it has been decided that the following guidelines/ instructions may be followed while considering the request for withdrawal of resignation of the aforesaid Government servants.

The appointing authority may permit a person to withdraw his resignation in the public interest on the following conditions, namely:

(a) that the resignation was tendered by the Government Servant for some compelling reasons which did not involve any reflection on his integrity, efficiency, or conduct and the request for withdrawal of the resignation has been made as a result of a material change in the circumstances which originally compelled him to tender the resignation ;

(b) that during the period intervening between the date on which the resignation became effective and the date from which the request for withdrawal was made, the conduct of the person concerned was in no way improper;

(c) that the period of absence from duty between the date on which the resignation became effective and the date on which the person is allowed to resume duty as a result of permission to withdraw the resignation is not more than ninety days;

(d) that the post, which was vacated by the Government servant on the acceptance of his resignation or any other comparable post, is available.

3. Request for withdrawal of a resignation shall not be accepted by the appointing authority where a Government servant resigns his service or post with a view to taking up an appointment in or under a private commercial company or in or under a corporation or company wholly or substantially owned or controlled by the Government or in or under a body controlled or financed by the Government.

4. When an order is passed by the appointing authority allowing a person to withdraw his resignation and to resume duty, the order shall be deemed to include the condonation of interruption in service for the purpose.

5. No withdrawal from NPS corpus shall be permissible within a period of 90 days from the date on which the resignation becomes effective i.e. the resignation is accepted by the competent authority and the Government servant is relieved of his duties. However, the aforesaid condition shall not be applicable in case of death of the government servant after the resignation becomes effective.

6. The provision for withdrawal of resignation shall not be applicable for temporary Government Servants.

7. Above guidelines/instructions will be applicable only for the Government servants appointed on Central Civil Service/ Posts after 31.12.2003 who are covered under the National Pension System (NPS) and for whom CCS(Pension) Rules, 1972 is not applicable. Further, these guidelines/ instructions will be applicable till the time the statutory rules regarding withdrawal of resignation for such Government servants are notified.

8. This O.M. shall be prospective and cases already settled shall not be opened.

9. This issues in consultation with the Office of Comptroller and Auditor General of India.

10. It is requested to bring it to the notice of all concerned for strict compliance.

(a) whether the Government proposes to enhance the contribution which is presently at 10 percent to National Pension System (NPS) to make the retirement income scheme more attractive;
b) if so, whether the Government has notified this change;
(c) if so, the details thereof; and
(d) if not, the date proposed for the notification of the new scheme?

(a) to (c) Government has increased the mandatory contribution by Central Government from 10% to 14% of the basic pay+DA for all the Central Government employees covered under National Pension System Tier-I. The employees’ contribution rate would remain at the existing 10% of the basic pay+DA. This has been notified vide Gazette Notification No. 1/3/2016 PR dated 31.01.2019, and has come into force with effect from 01.04.2019.

Subject: Withdrawal of resignation of Central Government Servants Appointed after 31.12.2003 covered under the National Pension System (NPS) - reg.

The undersigned is directed to say that instructions on the procedure to be followed for Resignation from Service have been provided vide Ministry of Home Affairs O.M.No.39/6/57-Ests.(A) dated 06.05.1958, Department of Personnel & Training (DoPT) O.M.No.28034/25/87-Estt (A) dated 11.02.1988, No.28034/4/94-Estt. (A) dated 31.05.1994 and No.28035/2/2007 -Estt.(A) dated 04.02.2007. Para 5 of DoPT O.M. dated 11.02.1988 referred to above, provides the procedure for withdrawal of resignation as governed by Rule 26 (4) to (6) of Central Civil Services (Pension) Rules, 1972. References are being received from Ministries/ Departments on the request for withdrawal of resignation by Government servants appointed after 31.12.2003 and for whom CCS (Pension) Rules are not applicable. The matter of withdrawal of resignation of Government servants of Central Civil Services/Posts, appointed after 31.12.2003 who are covered under the National Pension System (NPS) and for whom CCS (Pension) Rules, 1972 is not applicable has been considered in this Department and with the approval of the competent authority, it has been decided that the following guidelines/instructions may be followed while considering the request for withdrawal of resignation of the aforesaid Government Servants.

2. The appointing authority may permit a person to withdraw his resignation in the public interest on the following conditions, namely:
  • that the resignation was tendered by the Government Servant for some compelling reasons which did not involve any reflection on his integrity. efficiency, or conduct and the request for withdrawal of the resignation has been made as a result of a material change in the circumstances which originally compelled him to tender the resignation.
  • that during the period intervening between the date on which the resignation became effective and the date from which the request for withdrawal was made, the conduct of the person concerned was in no way improper;
  • that the period of absence from duty between the date on which the resignation became effective and the date on which the person is allowed to resume duty as a result of permission to withdraw the resignation is not more than ninety days;
  • that the post, which was vacated by the Government servant on the acceptance of his resignation or any other comparable post, is available.
3. Request for withdrawal of a resignation shall not be accepted by the appointing authority where a Government Servant resigns his service or post with a view to taking up an appointment in or under a private commercial company or in or under a corporation or company wholly or substantially owned or controlled by the Government or in or under a body controlled or financed by the Government.

4. when an order is passed by the appointing authority allowing a person to withdraw his resignation and to resume duty, the order shall be deemed to include the con donation of interruption in service for the purpose.

5. No withdrawal from NPS corpus shall be permissible within a period of 90 days from the date on which the resignation becomes effective. i.e the resignation is accepted by the competent authority and the Government servant is relieved of his duties. However, the aforesaid condition shall not be applicable in case of death of the government servant after the resignation becomes effective.

6. The provision for withdrawal of resignation shall not be applicable for temporary Government Servants.

7. Above guidelines/instructions will be applicable only for the Government Servants appointed on central civil service/posts after 31.12.2003 who are covered under the National Pension System (NPS) and for whom CCS (Pension) Rules,1972 is not applicable. Further, these guidelines/instructions will be applicable till the time the statutory rules regarding withdrawal of resignation for such Government Servants are notified.

8. This O.M. shall be prospective and cases already settled shall not be opened.

9. this issues in consultation with the office of comptroller and Auditor general of India.

10. It is requested to bring it to the notice of all concerned for strict compliance.

Function of NPS Nodal Offices in Central Government

Nodal Office means the offices which act as interface between the subscribers and the central record keeping agency and shall include the Principal Accounts Office (PrAO), Pay and Accounts Office (PAO) and Drawing & Disbursing Office (DDO) under the Central Government or analogous offices under Central Government.

Function of NPS Nodal Offices in Central Government Employees

1. Drawing and Disbursing Officer

Functions of DDO:
DDO will collect all the registration forms and forward it CRA for registration of the same. Further, it will also send the change request forms from the Subscribers and forward it to PAO for updation in NPSCAN system. However, DDO shall have various other functions as mentioned below:
Obtain the duly filled Application for allotment of PRAN from the subscribers, fill and certify the employment details.

Consolidate Application for allotment of PRAN and forward it to PAO.

Distribution of PRAN kit, I-Pin, T-Pin to Subscribers.

Forward the Switch requests, New Scheme Preference requests, Change in subscriber details request, Withdrawal Requests received from Subscribers to the PAO.

Providing information to PAO about Subscribers’ pension contribution.

Forward the grievance of the subscriber to the PAO.

DDO shall register itself with CRA before it starts providing various services to the Subscribers. For registering itself in CRA system, DDO shall forward the applications for registration to the concerned PAO.

2. Pay and Accounts Office

Functions of PAO
PAO will be responsible for carrying out the following activities:

Consolidate DDO registration form and forward it to CRA for registration.

Facilitate registration of Subscribers by consolidating the Application for allotment of PRAN received from the concerned DDO and forward it to the CRA - F.C.

Upload Subscriber Contribution File (SCF) to NPSCAN system. SCF will contain subscriber wise details of pension contribution such as PRAN, Pay month and year, Subscriber Contribution amount and Government Contribution amount etc.

PAO will deposit the contribution amount in the Trustee Bank as per the SCF uploaded in NPSCAN. This contribution amount will be invested in various schemes of PFM, based on the Scheme Preference of Subscribers for which SCF has been uploaded.

PAO will update through NPSCAN, the Switch requests, New Scheme Preference requests, Withdrawal Requests, the request for change in subscriber details received from Subscribers
PAO will raise grievance on behalf of DDO and the subscriber.

PAO will resolve the grievance raised against it by any entities in the CRA system.
However, before performing the above-mentioned functions, PAO shall have to register itself with CRA. For registering itself in CRA system, PAO shall forward the applications for registration to the concerned Pr.AO.

3. Principle Accounts Office

A Principal Accounts Office will have several functions in the NPS. However, most of them will be in the nature of monitoring the performances of the Nodal offices under its jurisdiction. CRA will send various alerts to Pr.AO to facilitate it to carry out the role of a supervisory entity.

Functions of Pr.AO:
Pr.AO will be responsible for carrying out the following activities.

Consolidate PAO registration form and forward it to CRA for registration Monitor performance of PAO and DDO in discharging their responsibilities in CRA system.

Monitor the resolution of grievances raised against PAO.

Take necessary action to ensure compliance of PAO and DDO with the operational procedures of CRA system Pr.AO, in its capacity of a Nodal Office shall register itself with CRA. Further, Pr.AO will send the registration applications of the PAOs attached to it to CRA.

Sir,
I am to inform you that Ministry of HRD, vide letter dated 22.04.2019, has directed KVS for stoppage of retirement and death gratuity to the NPS subscribers forthwith. Therefore, death & retirement gratuity and provisional family pension, in terms of CCS (Pension) Rules, 1972, will not be payable to NPS subscriber with effect from 30.04.2019 till further order.

This issues with the approval of the Commissioner, KVS.
