Sub: Promotion of Government servants found fit by review DPC after retirement - procedure and guidelines to be followed

The undersigned is directed to invite reference to this Department's OM of even number dated 25.1.2016 which deals with the grant of notional promotion to a Government servant exonerated in a disciplinary proceedings after retirement. However, the cases of Government servants who are found fit by review DPC after their retirement on account of revision of seniority list of the feeder cadre, upgradation of below benchmark APARs etc. are not covered under the said OM. These cases have now been examined and it has been decided to lay down procedure as narrated in subsequent paragraphs for dealing with such cases.
2. A Government servant who is not recommended in the panel by the original / supplementary DPC but later on is recommended in the panel by a review DPC but has since retired may be given the benefit of notional promotion w.e. f. the date of promotion of his immediate junior in the reviewed panel and fixation of notional pay subject to the fulfillment of the following conditions:
(i) That the officer who is immediate junior to the retired Government servant assumed charge of the higher post on or before the date of superannuation of the retired Government servant.
(ii) That the said retired Government servant was clear from vigilance angle on the date of promotion of his immediate junior.
(iii) A retired Government servant who is considered for notional promotion from the date of promotion of his immediate junior on the recommendation of a review DPC would also be entitled to fixation of pension on the basis of such notional pay.
(iv) The notional promotion, notional pay fixation and revision of pension shall be further subject to extant rules on promotion, pay fixation and CCS (Pension) Rules, 1972, Actual increase in pension shall be given only from the date of approval of reviewed panel by the competent authority. No arrears shall be paid.
3. The provisions contained in this Office Memorandum shall become operational from the date of issue of this Office Memorandum. Past cases settled in accordance with the earlier provision shall not be reopened.
4. In so far as persons serving in the Indian Audit & Accounts Department are concerned, these orders issue after consultation with the Comptroller & Auditor General of India.

Central Government paves way for employees timely promotions

New Delhi: All central government departments have been asked to conduct meetings of Departmental Promotion Committee (DPC) in time to check “abnormal delay” in giving career benefits to employees.
The move comes after noticing cases of delay in holding the meeting of DPC - which decides on employees’ promotions.

The Department of Personnel and Training (DoPT) has issued instructions to all the departments asking them to ensure timely promotions to the employees by conducting meetings of DPC in time.

A model calender has also been issued by the DoPT in this regard.

It has been brought to the notice of the government that many promotion posts are lying vacant due to abnormal delay in convening DPCs.

“The objective of timely promotions of employees in various ministries and departments can be achieved only by holding DPC meetings.

“In view of above, all ministries and departments are again advised to ensure strict compliance of instructions in order achieve the desired objectives of timely convening of DPCs/preparation of approved select panels within the prescribed time frame,” the DoPT said in an order.

There are about 50.68 lakh central government employees.

Subject: Timely and advance action in convening of Departmental Promotion Committee meeting in terms of Model Calendar - regarding.

The undersigned is directed to state that with a view to having the approved select panels for promotion ready in advance in a time-bound manner, this Department has issued a Model Calendar for DPCs vide OM No. 22011/9/98-Estt. (D) dated 8 th September, 1998 as modified vide OM No. 22011/4/2013-Estt.(D) dated 28.01.2015. An indicative pattern has been provided in the Model Calendar for various events involved in the pre/ post DPC related actions. All the Ministries/Departments have been impressed upon from time to time by this Department to adhere to the prescribed time-line so as to ensure that the panel is ready in time and is utilised as and when the vacancies arise during the course of the vacancy year.

2. It has been brought to the notice that many promotion posts are lying vacant due to abnormal delay in convening DPCs. The objective of timely promotions of employees in various Ministries/Departments can be achieved only by holding DPC meetings.

3. In view of above, all Ministries/Departments are again advised to ensure strict compliance of instructions in order to achieve the desired objectives of timely convening of DPCs/preparation of approved select panels within the prescribed time frame.

The undersigned is directed to say that pursuant to issue of OM No. 5/4/2005 CS I(S) dated 21.04.2014 by this Department on the subject mentioned above, doubts have been raised by some Ministries/Departments regarding procedure to be followed for grant of NFS to Section Officers of CSS.

2. In this connection, it is reiterated that regular Section Officers of CSS with 4 years of approved service would be considered for grant of NFS subject to vigilance clearance only in terms of this Department's OM No. 21/36/03 CS I dated 13.11.2003 and 5/4/2005-CS.I dated 25.01.2006. The word DPC wherever appearing in OM dated 21.04.2014 may be ignored.

DoPT issued an office memorandum regarding the functioning of Departmental Councils and it mentioned that the meetings of Departmental Council are essential as they help in resolving differences between Government and the Staff Side.

The undersigned is directed to refer to this Departments D.O. letter of even number dated 23.07.2012 (copy enclosed) regarding holding of meetings of Departmental Councils regularly with a view to make effective use of Joint Consultative Machinery (JCM) Scheme. Secretary, DoPT, had also vide his DO letters of even number dated 03.12.2012, 26.07.2013 and 17.02.2015 requested to promote this interaction more proactively through regular meetings of Departmental/Office Councils under the Ministry/Department.
The JCM Scheme provides for Departmental Councils at the level of individual Ministries/ Departments, including their attached and subordinate offices. The Staff Side of JCM, however, has been remonstrating that regular dialogue with the Staff Side through the mechanism of Departmental Councils at Ministry/Department level is not happening. Meetings of Departmental Council are essential as they help in resolving differences between Government and the Staff Side.

It is requested that suitable instructions may please be issued to hold meetings of Departmental Councils on regular basis.

Raipur: Chhattisgarh government employees will now have to furnish their Annual Information Report (AIR) carrying five year’s description of their immovable assets for seeking departmental promotion.

A decision in this regard was taken in a Cabinet meeting chaired by Chief Minister Raman Singh last evening at his official residence, an official spokesperson said here today.

As per directives issued by General Administration Department (GAD) in 2012, employees had to submit their annual report of immovable property during their departmental promotion but now the cabinet has decided that officials now have to furnish their five year’s description of immovable property to Departmental Promotion Committee (DPC), he said.

The cabinet also took the decision to relax the ceiling of 10 per cent on compassionate appointment in Grade-3 posts for a year, the spokesperson said.

The officials in the meeting informed that a similar decision to exempt ceiling of 10 per on compassionate appointment in Grade-3 posts was taken on June 16, 2013 whose limit expired on June 13, 2014, resulting in pending cases piling up pertaining to compassionate appointment.

Therefore, the same decision has been taken again, he added.

The Cabinet on the occasion also expressed pleasure over the state’s performance in implementing the Pradhan Mantri Mudra Yojana.

Under the scheme, a special drive was conducted from September 25-October 2, during which about 54,109 beneficiaries were sanctioned loan to the tune of Rs 251 crore against the target of 54,000 beneficiaries, he said.

Around 38,000 beneficiaries have been disbursed loan of Rs 168 crore.

Measures taken for the relief of farmers in drought-hit areas of the state were also discussed in the meeting.

O R D E R

The applicant has preferred this Original Application for the following reliefs:
“8(i) Summon the entire relevant record from the possession of respondents for its kind perusal;

8(ii) Upon holding that reducing the basic pay of the applicant as Rs.19960/- is bad in law, command the respondents to calculate all retiral dues and pension of the applicant on the basis of the last basic of Rs. 20,410/-
8(iii) Direct the respondents to revise the pension, DCRG, leave encashment, commuted value of pension and pay arrears of the aforesaid amount with 18% interest p.a.;

8(iv) Direct the respondent to repay the amount of DCRG of Rs.43,790/- to the applicant with 18% interest;

8(v) Any other order/orders, direction/directions may also be passed.

8(vi) Award cost of the litigation to the applicant.

8(vii) Set aside the order dated 30.10.2012 (Annexure A/1), order dated 6.8.2012 (Annexure A/2) and order dated 4.4.2012 (Annexure R/7) with all consequential benefits.”

The learned counsel for applicant submitted that at the time of retirement, applicant was holding the post of Deputy Post Master, Khandwa Head Office in the Pay Band of Rs.9300-34800/- + Grade Pay of Rs.4600/- and his basic pay was Rs.20,410/-. However, while paying him retiral dues, the basic pay has been reduced from 20,410/- to 19,960/-. Further, Rs.43,790/- has been deducted from his DCRG, without assigning any reason. The applicant was inducted in the cadre of HSG (II) in the pay scale of Rs.5000-8000 and posted as Deputy Post Master at Itarsi Head Office. Thereafter, vide the order dated 12.1.2005, the applicant was sent on deputation to work as Sub Post Master, Harda in the cadre of HSG (I) and he was given the pay scale of Rs.6500-10500/-. Appointment of applicant in the cadre of HSG (I) was approved by the Departmental Promotion Committee (DPC) and orders were issued on 18.8.2005 (Annexure A-3). Thus, there is no justification for reduction of pay of the applicant for retiral benefits and deduction of Rs.43,790/- from DCRG.
3. The respondents, in their reply, have submitted that the applicant was promoted to HSG (I) grade vide the order dated 18.8.2005, Before that, vide the order dated 12.1.2005, he was posted on HSG (I) grade post of Sub Post Master, Harda Head Post Office by Senior Superintendent of Post Offices, Hoshangabad. Since the applicant was working at that time with the office of Sr. Superintendent Post Offices, Hoshangabad, there was no ground for posting him on deputation basis in one of its offices. Thus, applicant was not entitled to the pay of HSG (I) grade on this posting at Harda as he was still in HSG (II) grade. In any case, applicant was promoted to HSG (II) grade on 29.10.2004 and had qualifying service of only two months as on 1.1.2005 in that grade, he could not have been promoted to HSG (I) grade so early as the qualifying service of three years was required for such promotion. Therefore, when his pension case was prepared, there was objection in regard to his pay fixation on 17.1.2005 in HSG (I) grade when he joined at Harda in compliance of order dated 12.1.2005 of SSPO Hoshangabad. Therefore, applicant’s pay was accordingly refixed and he was grated HSG(I) grade w.e.f. 23.08.2005 when he was actually promoted to that grade. Thus, due to correction of his pay fixation w.e.f 17.1.2005, his basic pay at the time of retirement was changed and applicant has been paid retiral benefits accordingly. Further, excess salary paid to him during this period has been recovered from the DCRG. Thus, the OA, being without any merit, deserves to be dismissed.
4. Heard the learned counsel for the parties and perused the pleadings of the respective parties and documents annexed therewith. I have also gone throught the writtern arguments filled by learned counsel for the respondents.
5. It is undisputed that the applicant was promoted to HSG (I) grade vide the order dated 18.8.2005 (Annexure A-3). Before that, he claims to be posted on deputation basis on a post of HSG (I) grade. However, the order dated 12.1.2005 (Annexure R-1) by which he was posted as Sub Post Master, Harda was issued by Sr. Superintendent of Post Offices, Hoshangabad and since the applicant was already working in his jurisdiction, this posting could not be considered as on deputation. In-fact, this is simply a posting order on vacant post of Sub Post Master, Harda on which the applicant was posted on his own cost for which he may have requested at that time. Thus, applicant was not entitled to get the pay scale of HSG (I) grade w.e.f. 17.1.2005 on the basis of order dated 12.01.2005 (Annexure R-1). Therefore, respondents are not at fault in re-fixing his pay, by treating him promoted to HSG (I) grade w.e.f. 23.08.2005. In view of this correction, basic pay of applicant has been revised and applicant has been paid all the retiral benefits based on this pay. Thus, the respondents cannot be faulted in granting retiral benefits to the applicant based on his revised basic pay of Rs.19,960/- in place of Rs.20,410/-, and no interference with the orders of respondents in this matter, is justified, Therefore, the prayer of the applicant in this regard is rejected.
6. So far as deduction of Rs.43,790/- from the DCRG of the applicant is concerned, this amount has been deducted without issuance of any show-cause notice to the applicant. Relying on the judgment of Hon’ble Supreme Court in the matters of State of Punjab and others etc v. Rafiq Masih (White Washer) etc., Civil Appeal No. 11527 of 2014, learned counsel for the applicant submitted that in view of the law laid down by the Hon’ble Supreme Court in that order, no recovery of excess payment can be made from retired employees or employee who are due to retire within one year of the order of recovery. Since recovery of excess salary has been done after retirement of applicant, such recovery is not in accordance with law. Therefore, the respondents are directed to refund Rs.43,790/- deducted from DCRG of the applicant, within a period of 60 days from the date of communication of this order. However, no interest shall be payable on that amount.

7. Thus, the O.A is partly allowed. No order on costs.

Subject:- Procedure for conduct of supplementary DPC

This Department instructions issued vide OM No. 22011/5/86-Estt (D) dated 10.4.89 [para 6.4.2 (i)] provide that vacancies occurring due to death, voluntary retirement, new creations etc. could not be foreseen at the time of placing facts and material before the DPC, therefore, another meeting of DPC (commonly referred to supplementary DPC) should be held for drawing up a panel for these vacancies.

2. References have been received with regard to the zone of consideration, the eligibility list for the supplementary DPC and whether officers who are included in the panel by the original DPC or in the extended panel but could not be promoted as these anticipated vacancies do not actually become available could be appointed against the additional vacancies later becoming available for the same vacancy year.

3. These issues have been examined in consultation with UPSC and following is decided:-
(i) The zone of consideration, in case of holding supplementary DPC, shall be fixed as per the provisions in this Department OM No. 22011/2/2002-Estt(D) dated 6.1.2006 keeping in view total number of vacancies arising in a particular vacancy year i.e. vacancies accounted in Original DPC + additional vacancies becoming available subsequently during the same year.

(ii) The eligibility list for supplementary DPC shall be prepared by removing the names of all such officers who have already been assessed by earlier DPC as fit, unfit or placed in the sealed cover by the original DPC before placing the same for consideration by the supplementary DPC.

(iii) The officers who have already been empanelled or placed in the extended panel but could not be promoted due to these vacancies not actually becoming available; need not be re-assessed by the supplementary DPC as the assessment matrix remains the same. They may be appointed against the additional vacancies of the same vacancy year as per recommendations of the earlier DPC. In such situation the number of vacancies for supplementary DPC shall be accordingly adjusted.
4. While calculating the regular vacancies for a DPC, it is incumbent upon administrative department to ensure that there is no arbitrariness in calculation of anticipated vacancies.

5. To provide clarity in implementation of these instructions some situation specific illustrations are enclosed as Annexure to this OM.

Situation 1- In the original DPC, first 5 officers are assessed as ‘Fit’ and no officer is assessed for extended panel or assessed as ‘Unfit’ and/or kept in ‘Sealed Cover’
Zone of consideration for Supplementary DPC will now be 13 (Normal Zone of consideration for total number of vacancies for that year — number of officers assessed by earlier DPC i.e 18-5).
As such, in the eligibility list of Supplementary DPC in the above illustration, 13 officers (9 left over officers from the original DPC and 4 additional officers) shall be included.

Situation 2 – In the original DPC, first 5 officers are assessed as ‘Fit’ and next 3 officers are assessed for extended panel and no officer is assessed as ‘Unfit’ and for kept in ‘Sealed Cover’
Zone of consideration for Supplementary DPC will now be 10 (Normal Zone of consideration for total number of vacancies for that year — number of officers assessed by earlier DPC i.e 18-8).
As such, in the eligibility list of Supplementary DPC in the above illustration, 10 officers (6 left over officers from the original DPC and 4 additional officers) shall be included.

Situation 3- In the original DPC, 5 officers are assessed as ‘Fit’, 2 officers are assessed for extended panel and 4 officers are assessed as Unfit’ and/or kept in ‘Sealed Cover’

Zone of consideration for Supplementary DPC will now be 7 (Normal Zone of consideration for total number of vacancies for that year — number of officers assessed by earlier DPC i.e 18-11)
As such, in the eligibility of Supplementary DPC in the above illustration, 7 officers (3 left over officer not assessed in the original DPC and 4 additional officers) shall be included in the normal zone.

Extended Zone in situation 1,2 & 3 above:
Extended zone in the Supplementary DPC, wherever resorted to, may be operated accordingly leaving out the SC/ST officers assessed by the original DPC.

Important- In the Supplementary DPC, (a) Zone of consideration (Normal as well as Extended) shall be decided taking into account total number of vacancies in the relevant vacancy year; and (b) all the officers already assessed in the original DPC are not to be included in the fresh zone of consideration in respect of the S-DPC.

Retired Government Employees Can Now Avail Benefits Of Missed Promotions


Retired government employees who missed out on their promotions due to late meetings of the committees deciding on such departmental elevations will now be able to avail its post-retirement benefits.

“Instructions have been issued to all ministries and departments to give benefit of promotion to those employees who missed it due to late meeting of Departmental Promotion Committee (DPC),” an official in the Department of Personnel and Training (DoPT) said.

It would not be in order if eligible employees, who were within the zone of consideration for the relevant year but are not actually in service when the DPC is being held, are not considered while preparing year-wise zone of consideration or panel, as per the DoPT order.

Consequently, their juniors are considered (in their place) for promotions, who would not have been in the zone of consideration if the DPC had been held in time, it said.

“Appointment Committee of Cabinet has observed that DPCs often do not consider such eligible officers who are retiring before the occurrence of the vacancy in the panel year,” the order said, adding that this “undesirable trend negate the very purpose” of government’s existing instructions for inclusion of such employees.

There have been reports that some of the eligible retired employees are not being given the benefit of promotion which they missed due to late DPCs. In fact the DPCs were being held very late, the official said.
The DoPT has asked all central government ministries and departments under it to ensure “strict compliance” of its instructions to include retiring employees for promotions in case the DPCs are delayed.
Such retired officials would, however, have no justify for actual promotion, the DoPT official said.

Subject: Review of Model Calendar for the Departmental Promotion Committees (DPCs) being conducted by the Ministries / Departments.

Reference is drawn to this Department’s instructions on Model calendar for DPCs vide O.M. No.22011/9/98-Estt (D) dated 8th September, 1998. The Model Calendar envisages initiating action in advance of the commencement of the vacancy year so as to have the approved select panels ready before start of the vacancy year and ensure timely promotions of employees.

2. The Annual Performance Assessment Reports (APAR) schedule separately provide a time schedule for preparation/completion of APARs O.M. No.21011/1/2005-Estt.(A) (Pt.II) dated 23rd July, 2009. The crucial date of eligibility is 1st April of the vacancy year (Financial year based vacancy year) and 1st January (Calendar year based vacancy year) as per O.M. No.22011/6/2013-Estt(D) dated 28th May, 2014.

3. The schedule of Model Calendar for conduct of DPCs in line with the time schedule for completion of APARs so that the panel as approved by the Competent Authority is available before the commencement of the vacancy year has been further examined. It has been decided to reschedule the time frame for the DPCs being conducted by Ministries/Departments themselves as below:-

4. It has been decided to make the aforesaid Model Calendar for DPCs operational with effect from April 1, 2015 in relation to the financial year based vacancy year 2016-17 commencing from April 1, 2016. In the case of calendar year-based vacancy year commencing from January 1, 2016, the Model DPC Calendar will take operational effect from January 1, 2015. These instructions shall, accordingly, be applicable to all such subsequent vacancy years.

5. The success of the Model Calendar depends upon the Ministries/Departments initiating timely action in advance and furnishing the complete proposals to the DPCs with relevant APARs, copy of Service/Recruitment Rules, seniority list, penalty statement and correct vacancy position etc. All Ministries/Departments are, therefore, requested to give these instructions wide circulation and ensure strict compliance so that the desired objectives of convening of DPC meetings/preparation of the approval select panels as per the aforesaid prescribed time frame may be achieved.

6. Model calendar for DPCs conducted by UPSC both for ACC and Non-ACC cases is separately under review. Meanwhile, cadre controlling authorities are advised for timely completion of calculation of vacancy; finalization of Seniority List; collection of information on vigilance clearance status; completion of Penalty statement for last ten years so that the proposal for seeking the date from UPSC for holding DPC may be taken up on completion of APARs including disposal of representations received on entries/grading in ACRs/ APARs. The instructions with regard to JS level officer as designated authority for timely holding of DPCs and requirement of complete proposal as contained in OM No. 22011/1/2011-Estt.(D) dated 25th March,2011 and OM No. 22011/3/2011-Estt.(D) dated 24th March, 2011 are reiterated.

Central Administrative Tribunal suspends promotion of 148 Income Tax inspectors

HYDERABAD: The Hyderabad bench of the Central Administrative Tribunal (CAT) comprising B Venkateshwar Rao, (member judicial) and Minnie Mathew (member administration) on Thursday suspended the promotions given to 148 income tax inspectors by the IT chief commissioner of AP, Hyderabad.

The bench was dealing with a petition by office superintendents and senior tax assistants of the department challenging the action of the chief commissioner in superseding an earlier order of the Centre.

Dr K Lakshmi Narasimha, counsel for the petitioners, said as per the order of the Centre all the posts of office superintendents, senior tax assistants, and stenographers were merged in a single cadre called executive assistants and promotions had to be effected by taking staff from this new category. He alleged that the chief income tax commissioner ignored the rule and effected the promotions.

The bench noted that the petition was filed on June 2 and the IT authorities sought several adjournments and, during the pendency of the petition, the commissioner convened the Departmental Promotion Committee (DPC) meeting and gave promotions.
