Subject:- Engagement of retired Government officers as 'Consultant' on contract basis on DPIIT - inviting applications thereof - reg - For CSS Officers.

The undersigned is directed to circulate the Vacancy Circular No. A- 12023/3/2019-ENG dated 18th December, 2019 (along-with enclosures) received from Department for Promotion of Industry & Industrial Trade inviting applications retired Government officers from the rank of SO/US/ DS or equivalent from Central Government /PSU/ Autonomous Body having considerable experience of functioning of Central Government Ministries/ Departments for engagement of Consultant (15 posts) on contract basis.

The terms and conditions of the contract shall be as under
  • The consultants will be required to examine cases/proposals, policy issues in the light of Central Govt. rules and regulation, prepare briefs/presentations and analyse the proposals assigned to them by their controlling officers. They shall be fully conversant with MS-Word/ PPT/ Excel etc. as per role requirement and print their own notes/ drafts/ OMs as required.
  • A consolidated remuneration of Rs.50,000/- (Rupees fifty thousand only) per month (minus Professional Tax/ TDS as applicable) shall be payable to consultants who have retired at the rank of US or above.
  • A consolidated remuneration of Rs.40,000/- (Rupees forty thousand only) per month (minus Professional Tax/ TDS as applicable) shall be payable to consultants who have retired at the level of SO or equivalent.
  • The consolidated remuneration shall be payable, subject to periodical completion of work certified by the controlling Officer. They will not be eligible for any other allowance or facility in addition to the consolidated pay. They will, however. continue to draw their pension and relief on pension. as per their entitlement.
  • They should not have attained the age of 63 years on the closing date of applications.
  • Working hours shall normally be from 9 AM to 5.30 PM during working days. However, in exigencies of work, they may be required to sit late and may be called on Saturdays/ Sundays and other holidays. They will be eligible for 08 days leave during the period of one year subject to the approval of the controlling Officer.
  • They will be governed by the Official Secrets Act, 1923, as amended from time to time and will not disclose to any unauthorized person(s) any information/data that may come to their notice during the period of their engagement as 'Consultant' in the Department. All such documents will be property of the Government.
  • They will not utilize or publish or disclose or part with, to a third party. any part of the data or statistics or proceedings or information collected for the purpose of their assignments or during the course of, assignment for the Department without the express written consent of the Department.
  • The Intellectual Property Rights (IPR) of the data collected as well as deliverables produced for the Department shall remain with the Department. x) Their attention is drawn to Central Vigilance Commission's circular no. 01/01/17 dated 23.1.2017 and circular no. 08/06/2011 dated 24.6.2011 regarding engagement of consultants. They will be completely accountable for any advice or any service rendered by them during their engagement in this Department in view of norms of ethical business and professionalism.
  • They must act, at all times, in the interest of DPIIT and render any advice! service with professional integrity.
  • They will maintain highest standards of integrity, transparency, competitiveness, economy and efficiency while working as consultant in this Department. If required, they will cooperate fully with any legitimately provided! constituted investigative body, conducting inquiry into processing or execution of the consultancy contract! any other matter related with discharge of contractual obligations by the consultant.
  • The consultants appointed by the Department shall in no case represent or give opinion or advice to others in any mater which is adverse to the interest of the Department nor will they indulge in any activity outside the terms of the contractual assignment.
  • They will complete the assigned task within the stipulated period as per the requirement of their controlling officers. They will not take up any assignment or contract which conflicts with the interest of the Government during the contract period.
  • They shall be bounded to hand-over the entire set of records of assignment to the Department before the expiry of the contract and before the final payment is released by the Department.
  • The engagement as Consultant can be terminated by the Department at any time without assigning any reason thereof by giving them 15 days' notice. However, in case a Consultant wishes to resign, he will have to give 15 days advance notice or remuneration in lieu thereof before resigning from the engagement.
  • The existing consultants in the Department will continue as per their existing entitlements/ remuneration till they complete their sanctioned tenures. Such consultants, who are already engaged, after completion of their tenure. may be considered for the new grades on the request of the consultant and the recommendations of controlling officers about their performance during the tenure of consultancy.

Sub: Introduction of SPARROW for CSS Officers – reg

The undersigned is directed to say that ‘SPARROW’ has been implemented across all the grades of CSS, CSSS & CSCS from the year 2018-19 vide this Department’s Office Memorandum of even number dated 10th April, 2019. Further, keeping in view the practical difficulties faced by various authorities in recording the APARs, the datelines for filing of online APARs have been extended in terms of Department of Personnel and Training’s Office Memorandum No. 21011/02/2015-Estt (A) (Pt. II), dated 18th April, 2019 and reiterated by CS-I Division’s OM of even number dated 28th May, 2019.

An analysis of APARs generated on ‘SPARROW‘ reveals that a sizeable number of officers are yet to be mapped up on the system and their APARs are pending for generation. It is necessary that the data in respect of APARs generated in each Ministry across all the grades of CSS, should be analysed to find out the gaps with reference to total strength of officers in a particular grade. In the above context the Ministries/Departments are requested to provide their inputs pertaining to their Department as per the following proforma.

Subject: Caution to be exercised in respect of the documents submitted by the officers of CSS.

It has been reported by a Cadre Unit of CSS that an officer of CSS cadre has indulged in forgery of documents relating to his family details, LPC claims for medical reimbursement and education qualifications etc. The matter is under investigation.

2. Meanwhile, this has been viewed seriously by the competent authority in this Department and it is hereby requested to exercise caution while examining/ forwarding the document of officers for deputation etc. Due diligence may be adopted for verification of documents furnished by officers in service matters/sanction of claims etc.

3. The forwarding officers / controlling officers are, in particular, requested to verify the details furnished by the officers concerned and also to countersign all pages of the representation of officers before sending the same to DoPT.

Subject: Recording of Annual Performance Appraisal Report (APAR) for the financial year 2017-18 in respect of CSS/CSSS officers - 'Alert' regarding.

Online system for recording of APARs on SPARROW web portal has been introduced in CSS from the financial year 2015-16. Initially, it was implemented for Deputy Secretary and above level officers in CSS and equivalent levels in CSSS w.e.f. the financial year 2015-16. From the financial year 2016-17, SPARROW has been extended from Under Secretary and above levels in CSS and equivalent levels in CSSS. As per Estt. Division's O.M. dated 23.07.2009 time schedule for completion of various activities relating to PARs are as under :

2. Keeping in view the difficulties faced by Nodal Officers in the Ministries/Departments and also the individual officers, it was decided to extend the timelines for completion of APARs online on SPARROW web portal for the financial year 2017-18 as under :-

3 The progress made towards generation and completion of online APARs on SPARROW system for the financial year 2017-18 is being constantly monitored in this Department'. It has been observed that as on date 367 APARs are pending with ORUs, 404 APARs are pending with Reporting Officers and 445 APARs are pending with the Reviewing Officers. Apart from the above, a total number of 503 APARs are pending at different stages for disclosure/closure. It is note-worthy that the timelines including extended timelines for writing of APARs for the financial year 2017-18 have been over on 31 .8.2018. As per the instructions contained in OM of even number dated 24.07.2018, the entire exercise for writing of APARs in respect of CSS/CSSS officers , for the financial year 2017-18 will be closed on 31.12.2018.

4. In the meantime, a new feature for sending 'alerts' in the SPARROW web portal has been developed by the NIC (SPARROW Division) to remind the officers to complete their APAR activities on SPARROW.

5. Keeping in view the overall progress made in completion of APARs on SPARROW, the Ministries/Departments are advised to take the following actions for timely completion of APARs on SPARROW for the financial year 2017-18, before it is finally closed on 31 .12.2018.
(i) All the Ministries/Departments may send 'alerts' to all the officers to complete the APARs lying in their 'inboxes'. The facility for sending 'alerts ' are available in the revised version of 'SPARROW'.

(ii) The PARs in respect of ORUs who have still not submitted their PARs to their Reporting Officers, may be given a final chance to submit their self-appraisal to their respective Reporting Officers within 15 days from the date of issue of this OM. Thereafter, their APARs may be forceforwarded to their next level i. e. the Reporting Officer.

(iii) The Nodal officers are advised to devise a mechanism to monitor progress of completion of APARs for the financial year 2017-18 including disclosure and consideration of representation, if any by the stipulated date i.e. 31/12/2018.

(iv) It may be re-iterated that the end of entire APAR recording process on SPARROW for the financial year 2017 -18 will be on 31 .12.2018.

Reference is invited to this 0.M. No.2/2/2010-CS-I() dated 18.08.2010 on the subject noted above.
2. In respect of deputation by a CSS officer, para 2.2 of this Department's 0.M. dated 18.08.2010 states as under:

"A CSS officer shall eligible for Deputation/Foreign service to any post in Central or State Government, Central/State Government organizations/Government of UTs/Government of UTs organizations/Autonomous bodies/Trusts, Societies, PSUs etc., only after he/she has completed 9 years of Service and is clear from the vigilance angle. The 9 years of service clause, however, will not apply to posting in the personal staff of Ministries.

3. It is reiterated that above clause is still in force and all the Ministries/Departments are, therefore, requested to take note of the above clause while forwarding the application of CSS officers for deputation posts.

Subject: Stepping up of pay of senior of CSS promotion in the Officers Grade than juniors - reg.

Representations have been received from some CSS officers in whose case re-fixation and recovery orders have been issued by concerned Ministries/Departments in pursuance to DOPT 0M 20.05.2014, requesting withdrawal of the OMs referred above.

2. It is once again clarified that 0M No.5/16/80-CS.l dated 13.4.1988 was issued on acceptance of award by Board of Arbitration in CA Reference No.7 of 1984 which allowed stepping up of pay at an Assistant of CSS, who is senior by virtue of having been recruited through an earlier examination but is drawing less pay on promotion in the Grade of officer than his junior recruited through a letter examination, up to a level equal to the pay of such junior Sexton Officer in the same cadre i.e. senior DR Assistant to junior DR Assistant of later exam on their promotion as Section Officer, Vide OM No.5/21/192-CS.I dated 23.2.1994 this benefit of stepping up was extended to Section Officers appointed through Limited Departmental Competitive Examination (LDCE) (again applicable to Assistants only). OM NO.5/1/96-CS.l dated 8.10.1996 further extended this benefit in case of promotee Assistants and also to the cases where both junior and senior have been recruited on the basis of the same Select List/Assistants Grade Examination, as the case may be in accordance with OA No.365/90 (Shri K.C.Sehgal Vs UOI and OA No .869/91 (Shri L.K. Chawla VS UOI), which were upheld by the Hon'ble Supreme Court.

3. That there are general guidelines of stepping up of pay issued by the Ministry Of Finance vide 0M No.F.2(78)-E.III(A) dated 04.02.1966 and this Department vide 0M dated 04.11.1993. One Of the conditions of the general guidelines for allowing stepping up of pay to a Senior Govt. servant with reference to a junior in the lower grade also.

Subject: Web-based cadre management System - Upgradation of data of CSS officers/officials in the Grade of ASO/SO/Under Secretary/Deputy Secretary/Director who are likely to be transferred under Rotational Transfer Policy of DoPT or on promotion.

It is brought to the notice of all the officers of the rank of ASO, Section Officer, Under Secretary, Deputy Secretary and Director of CSS Cadre, who are likely to be transferred under Rotational Transfer Policy of DoPT or on promotion that despite the lapse of more than four years since the CSCMS System was operationalized in the year 2013, complete and up-to-date data in respect of various grades of officers of CSS Cadre, is still not available in the system. Since, the prime objective of the web-based system is to ensure accurate real-time data of all the officers to enable this Division to take quicker decisions relating the cadre management functions and hence, unless and until the data is maintained up to date, the purpose of the cadre management system of DoPT is not completed.

2 The instructions in this regard, have already been issued to all cadre units Ministries/Departments from time to time and the same is also available on the website of this Department www.cscms.nic.in under the classification "Web Based Cadre Management", To ensure that up-to-date data of all officers of all grades is available so that transfers/promotions are done in an effective manner, all officers who have not updated their service details in the CSCMS Portal, may kindly get their details updated through their assigned Nodal Officers within three days from the issue of this letter. This practice will help in updating the CSCMS data in respect of various grades of officers of CSS and help CS-I Division in cadre management functions.

Subject: Rotational Transfer Policy applicable to CSS officers - Modification thereof - reg.

The undersigned is directed to refer to this Department's O.M. of even number dated 16.07.2015 vide which revised Rotational Transfer Policy, applicable to Central Secretariat Service officers, was circulated. The competent authority has approved the following additions in the para 12 of the Rotational Transfer Policy:

12.3 In all cases not covered under existing provisions like merger and winding up of Departments / Ministries etc, the posting to Group A and B of the officer would be determined as follows:

(a) If term available is 2 years or more then the officer would be posted to the Group in which the erstwhile Department / Ministry was categorized.

Subject: Introduction of SPARROW for CSS officers - completion of various tasks- reg .

The undersigned is directed to say that 'SPARROW' has been introduced for recording on-line APARs for Deputy Secretary and above level officers in CSS and equivalent levels in CSSS from the financial year 2015-16.

2. The time-limits for performing various activities on the 'SPARROW' system were extended vide this Department's Office memorandum of even number dated 27th May, 2016. The window for 'SPARROW' CSS was closed on 31st December, 2016. A number of Ministries/Departments requested for reopening of this window for completion of various tasks in the system. Therefore, the window for 'SPARROW' (CSS) has been re-opened on the request of these departments to facilitate the nodal officers to take action in the 'SPARROW' system as per the extended date-line.

3. However, it is clarified that the dates extended beyond 1 sl January,2017 are for taking necessary action for dealing with representations, disposal of representations and similar actions on the part of the nodal officers. Dates for recording of APARs would be same as contained in the Office Memorandum dated 27th May, 2016.

4. It is also reiterated that as per instructions of this Department, APARs of CSS officers are required to be uploaded on CSCMS. Hard copy of the APARs generated on SPARROW will be kept in CS-I Division/CS-II Division. It would not be practicably possible for these Divisions to download all the APARs from 'SPARROW' and then keep them in the relevant APAR folders including their uploading in the CSCMS system.
5. It is, therefore, requested that Ministries/Departments may ensure following action at their end for efficient management of APARs generated in the 'SPARROW' system :
i) To complete the task required at their end in the SPARROW system before the aforesaid date.
ii) To download the APARs generated online on 'SPARROW' and to upload PDF files in CSCMS.
iii) The PDF files so downloaded from SPARROW may be sent to this Department for custody.
6. In addition the details of hard copies of APARs (other than on-line mode), giving justification for not recording the APAR through 'SPARROW' may be sent to this department.

Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not to exceed three years.

Note 3:
The maximum age limit for appointment by deputation shall not be exceeding fifty six years as on the closing date of receipt of applications.

Note 4:
For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to the 1 st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade payor pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade payor pay scale, and where this benefit will extend only for the post for which that grade payor pay scale is the normal replacement grade without any upgradation.

2 The selected officers will be on deputation for a period of three years initially which can be curtailed or extended further, depending upon the requirement, and with the consent of the officer and approval of the lending department. The usual deputation terms will apply. The DPO/APO can be posted any of the PSK falling under the jurisdiction of respective Passport Offices.

3. All Ministries/Departments of Government of India are requested to circulate the above posts among the officers under the Central Government including officers of All India Services/ State Government, working with them and forward the application (in prescribed pro forma Annexure A) of eligible and interested officers, along with their dossiers and certificate to the effects that they are clear from vigilance angle, to the undersigned by 15th July 2016.

Subject: Rotational transfer of CSS officers of Deputy Secretary grade and above during the year 2016 – regarding

The undersigned is directed to refer to the revised Rotational Transfer Policy (RTP) published in the website of this Department vide OM No. 21/2/2009-CS.I(P) dated 16.07.2015. In terms of the revised RTP, Deputy Secretaries/ Directors/ Joint Secretaries (in-situ) who have completed 5 years or more in the same Ministry/Department are eligible for transfer. The officers serving in certain Ministries/Departments have a reduced tenure by one year prescribed for the grade.

2. Accordingly, a tentative list of Deputy Secretaries/ Directors/ Joint Secretaries (in-situ) who will be completing the prescribed tenure as on 01.07.2016 has been prepared and enclosed herewith (Annexure). The list includes 22 officers. The number of officers due for rotational transfer in Group ‘A’ (considering Cabinet Secretariat in group ‘A’) and group ‘B’ are equal.

3. The list at Annexure does not include officers within two years of superannuation as on 01.07.2016.
4. In terms of provisions contained in DOPT’s OM dated 16.07.2015 which, interalia, provides that officers serving in PMO and Cabinet Secretariat are exempted under RTP. Cabinet Secretariat is, hereby informed that the officers as indicated in the list are matured for transfer. Therefore, a decision on retention of such officers, keeping in view the willingness of the concerned officers, may please be intimated to this Department.

5. The officers concerned should also ensure that their data is complete in all respects in the web based cadre management system at www.cscms.nic.in. If the data is not complete, it may please be first got updated in the system.

6. Ministries/ Departments and officers concerned may check the information in the Annexure and bring to the notice of this Department if there is any discrepancy in the list by 06.06.2016. Ministries/ Departments are also requested to bring to the notice of this Department the names of Deputy Secretary/ Director/ Joint Secretary (in-situ) grade officers, who have completed the prescribed tenure but have been left out in the proposed list of rotational transfer.

7. In case no communication is received by the stipulated date i.e., 06.06.2016, the information as furnished in the list will be considered as final and further steps will be taken accordingly. The officers to be considered for rotational transfer will be finalized after correction of data, if any. Once the list is finalized, options will be sought from the officers concerned before issue of rotational transfer order.

In continuation of this Departments O.M. of even number dated 26.02.2016 on the subject mentioned above and to say that another list of Under Secretaries is enclosed as Annexure in respect of whom the experience details in the web based cadre management system are found to be incomplete or there is some discrepancy therein.

2. In this connection, attention is invited to this Department’s O.M. No.21/1/2014-CS.I (PR/CMS) dated 31st December, 2015 (copy enclosed) requesting the nodal officers in the Ministries/ Department for updation of data in the web based cadre management system hosted at cscms.nic.in in respect of all the CSS/CSSS/CSCS officers working under them. Data in respect of two modules viz. experience and promotion details can only be modified by CS.I / CS.II Divisions.

The undersigned is directed to refer to this Department’s O.M. of even number dated 9th and 23rd April, 2015 regarding declaration of assets and liabilities by CSS officers under the Lokpal and Lokayuktas Act, 2013 and to state that vide Notifications dated 27.4.2015 the last date for filing of returns by public servants under the Lokpal and Lokayuktas Act, 2013 as on 1.8.2014 and as on 31.3.2015 has been extended to 15th October, 2015.

2. All CSS Officers are requested to file the returns for the year 2014 (as on 1.8.2014) and for the year 2015 (as on 31.3.2015) on line at cscms.nic.in at the earliest. All officers of US and above levels of CSS should also take a print out of the return filed on line and submit to this Department duly signed.

3. Filing of returns at the last moment by thousands of officers makes the system sluggish and lead to delay in filing of the returns. In view of this, all CSS Officers are requested to file the returns at the earliest without waiting for the last date to approach to avoid rush and slowing down of the system at the last moment.

4. Ministries/Departments are requested that the contents of this O.M. may be widely circulated to the notice of all CSS officers working under their control. They should also monitor and ensure that the returns are submitted by all officers within the stipulated period without fail through Web Based Cadre Management System.

Subject: The Lokpal and Lokayuktas Act, 2013- Submission of declaration of assets and liabilities by CSS officers for each year – regarding.
Ministries/Departments may refer to CS.I Division, DoP&T’s O.M. of even number dated 7.1.2015 on the subject mentioned above.

2. As Ministries/Departments are aware that all Government servants are now required to file information and returns regarding movable and immovable property under the Lokpal and Lokayuktas Act, 2013. In this regard, all Government Servants have been advised that:

(i) The first return under the Lokpal and Lokayuktas Act, 2013 (as on 01.08.2014) should be filed on or before 30.04.2015; and

(ii) The next annual return under the Lokpal and Lokayuktas Act, 2013, for the year ending 31.03.2015, should be filed on or before 31.07.2015.

3. For filing annual return under the Lokpal and Lokayuktas Act, new forms have been developed in the Web Based Cadre Management System which is hosted at cscms.nic.in Returns under Lokpal and Lokayuktas Act should be submitted by all CSS officers through Web Based Cadre Management System. Print out of the returns submitted online in respect of Under Secretary and above level officers of CSS should also be submitted to CS.I Division as it being the custodian of returns of these officers. The procedure for filing return is as under:

(i) Login to the system at cscms.nic.in by using the userid and password. In case of any difficulty in login please contact the nodal officer of the Ministry/Department for assistance. The generic Userid is eight digit date of birth followed by first four letters of name. Userid is also the employee code assigned to individual officers in the web based system. If the password is blocked, nodal officers can reset the password of individual employees by using the ‘reset password’ facility in the Tools Menu on the top of the screen. They can also provide ‘Employee Code’ from the system to individual officers to enable them to login to the system.

(ii) Verify whether personal details are reflected in the system correctly. To verify the details click on the ‘Employee Details’ button. If the details are not correct, first have them rectified through Admin. Division of concerned Department before proceeding further.

(iii) Click ‘IPR’ button on the top and then click on ‘Lokpal Returns’ icon.

(iv) Click ‘create new PR’ button and select property return year then click on create PR.

(v) Read declaration page carefully and click on ‘next’ button.

(vi) Form-I: Add one by one details of Public Servant, his/her spouse and dependent children and save details every time. After adding of details click on ‘next’ button.

(vii) Form-II: Add Movable Properties Owned By Self/ Spouse/ Dependent one by one by clicking ADD Button and save then click on ‘next’ button.

(viii) Form-Ill: Statement of Immovable Property: Add->Select ->IPR year-> Add new property details one by one by clicking ADD Button -> click on ‘next’ button.

(ix) Form-IV: Add Statement of Debts and Other Liabilities one by one by clicking ADD button then click on ‘FINISH’ button.

(x) Click ‘finish’ button. Property Return Details page automatically opens. Users may select the year by click on the particular year and then click on ‘Final submission of IPR’ button.

4. Ministries/Departments are requested that the contents of this O.M. may be widely circulated to the notice of all CSS officers working under their control. They should also ensure that the information and returns regarding movable and immovable property under the Lokpal and Lokayuktas Act is submitted by all officers within the stipulated period cited above without fail.
