Sub:- Review of Model constitution and Rule and Regulations for the Residents Welfare Associations recognised by the government of India, Department of Personnel and Training- regarding.

Sir/Madam,
Keeping the following objectives in view, the Government of India, Department of Personnel & Training has been encouraging the formation of Residents' Welfare Associations in Government residential colonies as well as private colonies in which 2 or more Central Government employees are residing in one compact area:-
(a) To foster a spirit of mutual help and goodwill among the inhabitants of the colonyin general, and the members of the Association in particular, thereby, promoting communal harmony and national integration.
(b) To make all possible effort to achieve general amenities. Consumer protection such as interaction with traders on quality and quantity of goods, over charging etc. monitoring of the public distribution system including supply of essential and
consumable items and environmental protection such as steps to curb pollution, ensure cleanliness, plantation of tress, interaction with authorities on any environmental aspects and for this purpose, represent the interest of the residents
before appropriate authorities.
(c) To undertake all such other lawful acts, deeds or thing including Sports Cultural activities as are incidental or conducive to the attainment of any or all of the above objects including the general welfare of the Employees and their families.
(d) To promote such welfare and socio-economic activities as may be approved by the Department of personnel and Training.
2. Welfare Division of the Department of Personnel and Training, with a view to bring about uniformity and to provide guidance to these Association in their organizational matters have formulated a "Model constitution" and "Rules and Regulations" for the Residents Welfare Association. A copy of these documents is enclosed as ready reference.

3. Lately, it has been noticed that the very objective of fostering a spirit of mutual help and goodwill among the inhabitants of the colony has gone on back foot due to growing disputes among the office bearers and members of RWAs and lack of transparency in the functioning of RWAs.

4. In view of the above, a need has been felt to re-visit the Model Constitution and Rules and Regulations for the RWAs. Accordingly, all RWAs and AWOs are requested to suggest modification/amendment in the existing Model Constitution and Rules and Regulations for the RWAs in the following format for comparative analysis and consideration of the suggestion.

Subject: The Lokpal and Lokayuktas Act, 2013- Submission of declaration of assets and liabilities by CSS officers for each year- regarding.

The undersigned is directed to refer to this Department’s O.M. of even number dated 9.4.2015 followed by reminders dated 23.04.2015, 16.7.2015, 25.08.2015, 22.09.2015 and 01.10.2015 and to say that all CSS officers have been requested to file the returns as required under the Lokpal and Lokayuktas Act 2013 as on 1.8.2014 and for the year 2015 (as on 31.3.2015) online at cscms.nic.in The last date for submission of the returns is 15.04.2016. CSS officers who have not yet submitted the returns are requested to submit the
same immediately without waiting for the last date to approach to avoid rush and slowing down of the system at the last moment. All officers of US and above levels of CSS should also take a print out of the return filed online and submit to this Department duly signed.

2. Ministries/Departments are requested to circulate this O.M. among all CSS officers under them. They should also monitor to ensure that the returns are submitted by all CSS officers within the stipulated period without fail through the Web Based Cadre Management System. Court orders against Government of India instructions on service matters-consultation with Ministry of Law and Department of Personnel and Training on question of filing appeals.

OFFICE MEMORANDUM

Subject: Court orders against Government of India instructions on service matters-consultation with Ministry of Law and Department of Personnel and Training on question of filing appeals.

The undersigned is directed to refer to this Department’s 0.M.No.28027/9/99- Estt.(A) dated 1st May, 2000 on the above subject ( copy enclosed) and to say that the Department of Personnel and Training is the nodal Department that formulates policies on service matters and issues instructions from time to time. These instructions are to be followed by the Ministries/Departments of the Central Government scrupulously. All the Court cases filed by employees have to be defended on the basis of the facts available with the Administrative Ministry/Department concerned, keeping in view the instructions issued on the subject by this Department.

2. Reference is also invited to the Cabinet Secretariats D.O letter No. 6/1/1/94- Cab dated 25.02.1994 and the Department of Expenditure’s O.M. No. 7(8)/2012-E-II(A) dated 16.05.2012 inter-alia provide that (i) a common counter reply should be filed before a Court of Law on behalf of the Union of India by the concerned administrative Department/Ministry where the petitioner is serving or has last served; and (ii) a unified stand should be adopted instead of bringing out each Department’s/Ministry’s point of view in the said reply. It further provides that it is primarily the responsibility of the Administrative Ministry to ensure that timely action is taken at each stage a Court case goes through and that a unified stand is adopted on behalf of Government of India at every such stage. In no case should the litigation be allowed to prolong to the extent that it results in contempt proceedings.

3. However, it is noticed that the Ministries/Departments are making several references to this Department seeking interpretation of the guidelines without exercising due diligence. The Ministries/Departments are advised not to make any references to this Department unless there are difficulties relating to interpretation/application of these guidelines or any relaxation in Rules/instructions is warranted to mitigate a genuine hardship faced the Government servant.

While seeking advice of this Department, instructions contained in this Department’s O.M. number 43011/9 /2014-Estt (D) dated 28.10.2015 may be followed.

4. The court cases may be further handled in the following manner:-

1. Appointment of Shri Girish Shankar, lAS (SH:1982), Secretary, Department of Official Language, Ministry of Home Affairs as Secretary, Department of Heavy Industry, Ministry of Heavy Industries and Public Enterprises vice Shri Rajan S Katoch, lAS (MP:1979) on his superannuation on 29.02.2016.

2. (i) Creation of a post of Officer on Special Duty (Secretary level) in the Department of Industrial Policy and Promotion by upgrading the vacant post of Additional Secretary in that Department for the period till 29.02.2016.

(ii) Appointment of Shri Ramesh Abhishek, lAS (SH: 1982), Secretary (Performance Management), Cabinet Secretariat as Officer on Special Duty in the Department of Industrial Policy and Promotion with immediate effect in the rank and pay of Secretary.

The Department of Personnel and Training (DoPT) has taken various initiatives during the year 2015. These initiatives aim at working in the direction of larger public interest and to establish accountability and transparency.

In a landmark decision, the Government scrapped Interviews for recruitment to lower posts wherever it could be dispensed with. This was followed by the Minister of State for Personnel, Public Grievances and Pensions Dr. Jitendra Singh writing D.O. letters to Chief Ministers of all States in September to take the lead in carrying forward this initiative with respect to State Government jobs.

The discontinuation of interviews will not only be in larger public interest but would also offer a level playing field and benefit youth hailing from the lower socio-economic strata. Interviews will be dispensed with for all Group C and Group D posts which are now reclassified as Group C posts. Interview would also be discontinued for non-gazetted posts of Group B category. The process of doing away with interview for these posts will be completed by 31.12.2015. In those cases pertaining to non-gazetted Group B posts and Group C & D posts, where Recruitment Rules specify the process of selection which includes conduct of interview, the Ministries/authorities concerned will take necessary steps to carry out the requisite amendment to the Recruitment Rules immediately. Necessary directions have also been issued to the Staff Selection Commission in this regard.

In a big relief to the common people, the DoPT discontinued the practice of submission of affidavit by the family members of deceased Government employees for the appointment on Compassionate grounds. Now they are required to submit self-declaration at the time of applying for compassionate appointment. It will ensure fast process of compassionate appointment and help family members of deceased Government employee immensely.

For the first time in the history of the Indian Administrative Service (IAS), the Officers of 2013 batch of IAS were posted as Assistant Secretary in the Central Secretariat for a period of three months. Exposure to Central Government functioning will provide insight into policy formulation at the Centre to these officers. These officers left for their field posting with a macro picture of such policies which will help them in effective implementation of the schemes keeping citizen at the centre.

In another novel initiative, the DoPT has started Yoga camps for the Central Government employees and their dependents. The Yoga training sessions are conducted in 29 locations (26 Samaj Sadans of Grih Kalyan Kendra and 3 other places) in Delhi and 12 Samaj Sadans of Grih Kalyan Kendra outside Delhi. Approximately 1900 individuals are benefiting from this scheme per day. With this initiative, the employees would be able to de-stress themselves and also take control over various lifestyle diseases like obesity, hypertension, Hyperglycemias etc. The healthy & happy employees would be able to perform more effectively in their office work.

The Department has also started an innovative scheme for the training of the cutting edge level employees of the State Governments. In the first phase, masters trainers are being trained by the ATIs in collaboration with DoPT. These trainers will impart training to the field level employees. Emphasis of the training will be on citizen centricity. Pilot projects had been started in Maharashtra, J&K and Tamil Nadu. It has now been extended in other States. Training will bring an attitudinal change in these employees which in turn will result in increased citizen friendly environment in the field offices.

DOPT also exempted the parents of differently abled children from the mandatory transfers so that they can take proper care of their differently abled child. This move will ease the pain of these parents and ensure care and upbringing of these children.

A weekly one hour in-house training programme for its employees was started. Three modules of the training programme have been completed and the fourth module is currently running. The employees are imparted up-to-date information on various aspects of day to day work in the office. This gives an opportunity to the employees to clear their doubts and the input given in the session is found very useful for them in discharging their duty more accurately, efficiently and effectively. This has speeded up the rate of disposal of work and the ultimate beneficiary of the same are the citizens.

The scheme of interaction of Officers with School Students has been launched in which the Officers of Government of India visit Schools and share their experiences with the School Students. As a pilot, the Senior Officers of DoPT have visited Kendriya Vidyalayas in Delhi and interacted with the students. The interaction of Senior Officers with School Students will have a long lasting impact on their impressionable minds. They will also get a glimpse of the functioning of the Government.

NEW DELHI: All government departments need to complete direct recruitment process within six months of the closing date of receipt of applications mentioned in the advertisements, according to draft guidelines formed by the Centre.

The draft prepared by the Department of Personnel and Training (DOPT) says there was “unduly large” delay in recruitment process undertaken by many central government departments.

“All ministries or departments are, therefore, requested that while initiating the recruitment process to fill vacant posts by the method of direct recruitment in their ministries or departments, they may ensure that the recruitment process i.e., conducting written examination or holding of interviews is completed within six months from the closing date of receipt of applications mentioned in the advertisement,” the Department of Personnel and Training (DoPT) has said in draft instructions.

It has come to notice of DoPT that ministries which undertake direct recruitment for various posts in the Government of India by conducting competitive examinations or interviews, are not adhering to the time frame for that purpose.

“It is seen that in many cases the time gap between the date of advertisement for the vacancy and date of examination or interview is unduly large and defeats the object of early recruitment process.

“Further, delay of recruitment process by more than a year will deny the opportunity to fresh candidates who become eligible during that year,” it said in a note to all central government ministries seeking comments. The DoPT has asked all ministries to send their views on the draft by November 16.

CCS Rules do not recognise unions based on caste, tribe, religion: Government

New Delhi: The central civil service rules do not allow recognition of separate associations and unions on the basis of any caste, tribe or religious dominations, Rajya Sabha was informed today.

In his written reply to a question on the issue, Minister of State for Social Justice and Empowerment Krishan Pal Gurjar said the Department of Personnel and Training formulates policy for recognition of service associations of government employees and this is done by the respective Ministries or Departments in terms of CCS(RSA) Rules, 1993.

“Central Civil Services (Recognition of Service Associations) Rules, 1993 do not allow recognition of separate Associations/Unions on the basis of any caste, tribe or religious denominations,” he said.
Replying to another question, the Minister said as per information received from various ministries and departments till date, the representation of Other Backward Classes as on January 1, 2013 in 71 ministries or departments was 5,24,143 employees in the central government ministries or departments.

DPCs often do not consider such eligible officers who are retiring before the occurrence of the vacancy in the panel year. These undesirable trends negate the very purpose of the above said Office Memorandum No. 22011/4/98-Estt(D) dated October 12, 1998 and it is also against the principle of natural justice.

Subject: – Inclusion of eligible officers who are due to retire before the likely date of vacancies, in the panel for promotion-Regarding


The undersigned is directed to invite reference to the Department of Personnel and Training Office Memorandum No. 22011/4/98-Estt(D) dated October 12, 1998 regarding consideration of retired employees who were within the zone of consideration in the relevant year(s) but are not actually in service when the DPC is being held. The said OM provides as follows:-

“…….There is no specific bar in the aforesaid Office Memorandum dated April 10, 1989 or any other related instructions of the Department of Personnel and Training for consideration of retired employees, while preparing year-wise panel(s), who were within the zone of consideration in the relevant year(s). According to legal opinion also it would not be in order if eligible employees, who were within the zone of consideration for the relevant year(s) but are not actually in service when the DPC is being held, are not considered while preparing year-wise zone of consideration/panel and, consequently, their juniors are considered (in their places), who would not have been in the zone of consideration if the DPC(s) had been held in time. This is considered imperative to identify the correct zone of consideration for relevant Year(s). Names of the retired officials may also be included in the panel(s). Such retired officials would, however, have no justify for actual promotion. The DPC(s) may, if need be, prepare extended panel(s) following the principles prescribed in the Department of Personnel and  Training Office Memorandum No.22011/8/87-Estt.(D) dated April 9, 1996.”
Appointment Committee of Cabinet has observed that DPCs often do not consider such eligible officers who are retiring before the occurrence of the vacancy in the panel year. These undesirable trends negate the very purpose of the above said Office Memorandum No. 22011/4/98-Estt(D) dated October 12, 1998 and it is also against the principle of natural justice.

3. All the Ministries/Departments are therefore advised to ensure strict compliance of the instructions of the Department of Personnel & Training issued vide this Department’s OM No. 22011/4/98-Estt(D) dated October 12, 1998.
