Sub: Implementation of Pass Rules and grant of travel facility on privilege pass as per the choice of pass holder - Railway Board's clarification-requested.

NFIR invites attention of the Railway Board to the provisions contained in Advance Correction Slip No. 32 to the Railway Servants (Pass) Rules, 1986 (2nd Edition 1993) where in Rule 3 (vi) which are as under :-

"Privilege pass shall be issued for journey from the starting station to the destination station as desired by the Railway servant, via shortest route, provided that a longer route may be permitted on the Privilege Pass in the following circumstances:-

a) Two alternative routes are available for a destination, for example - Bombay to Calcutta via Nagpur or via Allahabad and Bombay to Delhi by the Central Railway or by the Western Railway - such pass may be permitted by either route irrespective of the distance involved;
or

b) If the distance to destination via a longer route preferred by the Railway servant does not exceed by fifteen percent of the distance via the direct route such pass may be issued even if a double journey over a small portion is involved (for example - ex Chittaranjan to Kancharapara via Howrah or ex-Lucknow to a station on the Southern/ South Central Railway via Bombay VT), provided the distance does not exceed the distance via the shortest route by more than 15% to take advantage of terminal facilities as in Bombay VT - Kalyan or Madras - Arakkonam sections;
or

c) If the longer route to destination is quicker than the direct route irrespective of distance involved."
Federation has received staff representations (also retired staff) that when entitlement and choice is available between (a), (b) & (c) as per ACS No.32, the authorities have been reluctant in issuing the privilege/complimentary passes by wrongly interpreting to the effect that clauses 3(vi) (b) and (c) are independent provisions as they have been separated by the word ‘or’ between them, thereby, the provision in Rule 3(vi) (a) is also independent.

Federation contends that the interpretation as above is not correct in view of the fact that the three provisions are meant to allow staff to avail either 3(vi) (a) or (b) or (c) as per their convenience. The incorrect interpretation by the Railway authorities has resulted deprival of right to employee to take journey on his privilege pass, Similarly, the retired staff are also denied, the privilege of travel as per their choice route on their post retirement complimentary passes.

NFIR, therefore, requests the Railway Board to issue suitable clarification to the Zonal Railways etc., to enable the staff to avail privilege/complimentary passes and take journey as per their choice in terms of provisions contained in ACS No.32. copy of clarificatory instructions may be endorsed to the Federation.

Dear Sir,
Sub: Non-payment of retirement benefits to the Running Staff retired on or after 01/01/2016-reg.
Complaints are being received quite frequently from the Zonal Railways that the Running Staff retired on or after 01/01/2016 have not yet been paid pensionary dues duly adding 55% to their 7th CPC Pay Matrix. It is further learnt that due to IPAS problems, almost on all the Zonal Railways, revised pensionary benefits have not been paid and the Administration has also not taken initiatives to solve the technical problem in co-ordination with the CRIS.

NFIR requests kind intervention in the matter so as to see that the retired Running Staff (from 01/01/2016 onwards) are paid retiral benefits duly reckoning 55% of pay as part of 7th CPC pay. Incidentally, Federation also conveys that all those retired Running Staff are entitled for pension arrears on revision of their present pension with the 55% addition of pay element.

NFIR, therefore, requests the Board (MS & FC) to take immediate action in resolving this issue in co-ordination with CRIS.

Action taken in the matter may kindly be advised to the Federation in due course.

Sub: Amendment to payment of Bonus Act, 1965-Revision of wage calculation limit from Rs. 3500/- p.m. to Rs. 7000/- p.m. with effect from 01/04/2014- payment of P.L. Bonus to Railway employees at revised rate of Rs. 7000/- p.m.-reg.

Ref: Railway Board’s reply vide No. E(P&A)II-2014/PLB-8 dated 16/02/2016 to GS/NFIR.
While thanking the Railway Ministry for its prompt reply to NFIR under reference No. E(P&A)II-2014/PLB-8 dated 16/02/2016, the Federation re-iterates the following facts for taking appropriate steps by the Government.
(i) The chronological developments since decades need to be taken into account for processing the case for payment of PL Bonus to the Railway employees at the revised wage calculation ceiling limit i.e. Rs. 7000/- p.m. w.e.f. 01/04/2014.
(ii) When the Bonus Act was amended, raising the wage calculation ceiling from Rs. 750 to 1600, the Railway employees were paid PL Bonus at the revised wage calculation ceiling limit. Subsequently, when the Bonus Act was amended, revising the wage calculation limit from Rs. 1600/- to Rs. 2500/-, the said rate was adopted by the Railway Ministry and PL Bonus paid to the Railway employees at the revised rates.
(iii) When the wage calculation ceiling was again revised to Rs. 3500/- w.e.f. 1st April 2006, the Federation took up the issue and explained the merits of the case for adopting the rate of Rs. 3500/- w.e.f. 01/04/2006 for ensuring payment of PL Bonus. The Railway Ministry had processed the case and obtained Union Cabinet’s approval and issued orders vide letter No. E(P&A)II-2008/PLB-10 dated 03/10/2008, duly revising the wage calculation ceiling to Rs. 3500/- with retrospective effect i.e, from 01/04/2006, consequently, PLB arrears for the year 2006-07 were paid to the Railway employees in October 2008.
From the above facts, it could be seen that the payment of P.L. Bonus has been ensured commensurating with the revision of wage calculation ceiling limit made through amendments to Bonus Act, 1965 without any deviation. Similarly when the wage calculation ceiling limit has been raised to Rs. 7000/- p.m., the Railway Employees are entitled for payment of P.L. Bonus at revised rates for the year 2014-15.

NFIR, therefore, requests the Hon’ble Railway Minister to kindly arrange to process the case on top priority for obtaining the approval of the Union Cabinet for making payment of PL Bonus arrears pertaining to the year 2014-15 to the Railway employees at the earliest.

Sub: Serious disappointment among Railway Employees on retrograde and perverse recommendations of the 7th CPC – reg.

NFIR brings to the kind notice of Hon’ble MR that the Railway Employees are very much disappointed over the retrograde and perverse recommendation of the 7th Central pay commission.

Federation desires to state that the pay Commission has not considered the duties, responsibilities, remoteness and hard working conditions of Railways Employees of various categories while deciding the Pay Structure (Pay Matix). On perusal of report, it is also noticed that the Railway Ministry has not conveyed to the pay commission, the hard working conditions, nature of jobs being performed by the Railway Employees and the risks involved while their duties are unique, uncommon and complex.

In this connection, Federation brings to your kind notice that the 6th CPC anomalies relating to Railways Employees were discussed with the Railway Board. Consequently, it was agreed to rectify the under noted anomalies:-
(a) Merger of Technician Grade-II (GP 2400/-)with the Technician Grade-I (GP 2800/-)
(b) Replecement of GP 4600/- with GP 4800/-
(c) Placement of Mail/Express Loco Pilots in GP 4600/-
(d) Placement of JA Grade Officials in PB-4
However, the above proposals of Railway Ministry have not been cleared by the Finance Ministry and when the 7th Central Pay Commission was constituted, the Finance Ministry conveniently evaded. Although the above agreements were highlighted to the 7th Central Pay Commission by the NFIR, it is sad to note that the Railway Ministry has never taken initiative to apprise the 7th CPC relating to the above agreed proposals. The failure of the Railways Board in highlighting the facts and the commitments given to the Federation (NFIR) has caused grave justice to the staff. Similarly, on many issues, the Pay Commission has ignored the valid justification placed by the Federation seeking improved pay structure/Pay Matrix and incentives for railway categories. Overall, there is unhappiness and anger among all sections of Railway employees.

Apart from the above negative situation, the Pay Commission has given retrograde recommendations on “Minimum wage” and “Multiplication factor. Several Allowances have been recommended to be abolished.
In view of the above development, the National Joint Council of Action (NJCA) has since conveyed to the Government to take steps for constituting Group of Ministers Committee to initiate discussions for reaching negotiated settlement on the charter of demands by 1st week of February. If the Government fails to work towards negotiated settlement by that date, the Railway Employees as well as Central Government Employees will be driven to go on Indefinite stike from 1st week of March, 2016.

NFIR invites kind attention of Hon’ble MR to the pending issues already discussed with the Railway Board (CRB,MS) more than once by the Federation but unfortunately there has been no satisfactory settlement of the issues.

NFIR hopes that you would take initiative for ensuring negotiated settlement on Railway issues very early.

Sub: Revised entitlement of Passes for Railway employees – hardship caused to certain staff who became entitled for 1st Class Pass as per old norms-remedial action urged.

Ref: NFIR’s PNM Item No. 11/2013.

The subject matter was discussed in the special meeting held on 23/11/2015 in the chamber of ED/IR. During the meeting, the Official Side stated that Federation’s demand is not feasible of acceptance in view of revised entitlement communicated vide Board’s letter dated 6th January 2011. Federation has however did not agree with the view and said that those staff who could have become entitled for 1st Class Pass on the notional pay Rs. 5375 should not be denied the entitlement.

In this connection, NFIR re-iterates that when some of those staff whose notional pay touches Rs. 5375/- (provided they are in a scale the maximum of which is Rs. 70001- or above) are eligible for drawing lst Class Pass as per Board’s instructions dated 01/02/1999, denying the privilege on the plea of revised instructions is illogical. Such staff deserve to be allowed to avail 1st Class pass. The number of such cases may not be large.

NFIR, therefore, requests the Railway Board to kindly review and grant special dispensation for allowing 1st Class Pass in the cases where the notional pay reached Rs. 5375/- on and after 6tn January, 2011. A copy of the instructions issued may be endorsed to the Federation.

Railway Board vide letter dated l2/1O/2015 quoted under reference have issued ACS No.127 relating to Chapter 8 of the Indian Railway Establishment Code Vol.I, 1985 Edition (Second Reprint Edition – 2003). The said amendment to the R-I is based on the instructions issued by the Railway Board vide letter No. E(W)2014/FU-/l dated 30/07/2014.
In this connection, NFIR desires to point out that on making representations by the Federation amendment to these instructions were issued vide RBE No. 136/2014 on 08/12/2014 wherein wards of all non-gazetted Railway employees were made eligible for consideration of Scholarships as was being done prior to issuance of Board’s letter dated 30/07/2014. Now the Federation has noted that while issuing ACS No.127, unfortunately, the amendment dated 08/12/2014 has not been reflected in the ACS resulting confusion on eligibility of scholarships to the wards of employees whose Grade Pay is higher than Gp 4200 (PB-2).
NFIR,therefore,requests the Railway Board to issue modification so as to cover all Group “C”Staff.

(iii) Ministry of Finance, Department of Revenue, CBDT (TPL Division)’s O.M No. 149/21/2013 TPL dated 23/07/2015 addressed to Railway Board.

On perusal of contents of O.M. dated 23/07/2015, (addressed to the Railway Board by Department of Revenue, CBDT TPL Division), copy handed over to the NFIR during the PNM meeting held on 819`” October 2015, Federation felt disappointed that the view of CBDT is unconvincing as the points raised by the Federation in the PNM agenda Item No, 39/2012 have not been taken into consideration. As a matter of fact, the CBDT has generalized the issue ignoring the Federation’s demand seeking revision of tax exemption to the specific category of Running Staff of Railways.

2. Federation however re-iterates below the key points for making proper reference by the Railway Ministry to the MoF/CBDT:-
  • In para 1507 of IREC-Vol II (sixth Edition 1987/2″ Reprint Edition 2005), it has been stipulated that the Running Allowance is granted to the Running Staff for the performance of duty directly connected with charge of moving trains and includes “kilometerage allowance” or “allowance in lieu of kilometerage” and is paid on the kilometerage basis.
  • The argument of CBDT that the exemption limit was raised from Rs. 6000 to 10,000 p.m. which takes care of progressive requirement of employees working in the different transport sector including Railway employees is not relevant as the revision of exemption sought pertains to Running Staff. Federation’s demand is that when the rates of kilometerage allowance of Running Staff on Indian Railways have been enhanced on DA reaching 50% of pay w.e.f. 01/01/2011 and again on reaching 100% as on 01/01/2014, the exemption limit of Income Tax correspondingly needs to be enhanced retrospectively as there is T.A. component in the kilometerage amount. Therefore, the present exempteq. amount of Rs. 10,000/- is grossly insufficient particularly in the context of upward revision of the rates of T.A which are not taxable.
  • The CBDT’s view that moderation of tax rates by way of increase in the basic exemption limits and widening of tax slabs has raised every individual’s exemption limit is not relevant to the issue raised by NFIR seeking revision of exemption limit in the case of Running staff in Railways.
NFIR, therefore, requests the Railway Board to write back to MoF/CBDT duly highlighting that “kilometerage amount paid to Running staff includes T.A. component towards out of pocket expenses” and urging for approval for upward revision of tax exemption limit from the existing Rs. 10,000/- to Rs. 20,000/-

The NFIR desires to bring to the notice of Railway Board that the staff working in TRD wing of Electrical Department are denied Risk Allowance even though these staff face continuous risk while perfoniing duties.
The TRD staff are engaged in the jobs listed vide annexure to Railway Board’s letter No. E(P&A)I-2008/SP-I/AD dated 02/05 /2013.

2. ln this connection, Federation desires to bring to the notice of the Railway Board following facts for appreciation of NFIR’s point of view:-
  • Though the TRD staff while working on the OHE, obtain Block and shut down the power carrying 2500 volt current duly earthing on both ends, but the power of same magnitude and intensity is available in the adjacent up/down line for the purpose of regular flow of rail traffic.
  • The high intensity current on the adjacent line causes severe adverse impact on the health of TRD staff due to inherent infection. This gives rise to various diseases as infection is being caused in the human body.
The seriousness can be assumed from the fact that if the amount of current in the human body crosses 40 mili-ampere, it can cause even deaths.

3. The NFIR therefore contends that the health hazards faced by the TRD Staff of Electrical Department in their day-to-day working are continuous and they are required to be paid Risk Allowance.

NFIR, therefore, requests the Railway Board to consider the case of TRD staff in all grades and accord approval for payment of Risk Allowance.

Federation may be kept advised of the action taken in the matter.

Dear Sir,
Sub: Proposed Delegation of Powers to the Divisional Officers and further at the Field Levels for improving efficiency and speedy decision making.

Ref: Your communication vide letter No.2015/CE-I/CT/20/4 dated 12.10.2015 to GMs of Indian Railways.
There are number of representations besides telephone calls on the draft document sent by you, seeking suggestions / inputs from the General Managers. Cross Section of railway employees are perturbed over certain draft recommendations as they feel, that the said proposals may cause more problems to the system and generate rivalry at field levels.

In this connection, the Federation invites your kind attention to Note (3) under “Establishment Matters” (Annexure- “A”) relating to the Cadre of Station Master. This specific draft recommendation has generated disappointment among the Supervisors of various cadres.

The Federation therefore requests you to kindly have consultations with us before the EDs Committee finalises the draft document.

In continuation of Federation’s letter of even number dated 28/0912015, it is to convey to the Board that protest representations from staff are being received by NFIR against the restrictions clamped by the Board relating to inter-railway transfer requests of Group ‘C’ staff vide tettef No. E(O)III/2014/PL/05 dated 31/08/2015, NFIR strongly feels that the instructions contained under item no. (xi) in Board’s letterdated 3l/08/20l5 need to be deleted.

Complaints have also been received that the mutual transfer requests wherever approved by the competent authorities are not being implemented, lt is further brought to the notice of the Federation that the mutual transfer applications of staff are not being entertained on the plea that 5 years minimum service condition not fulfilled. There are also representations from a few staff that inter railway request transfer applications on’spouse grounds’are not being considered citing “non-fulfilment of 5 years service condition'”.

NFIR, therefore, once again urges upon the Railway Board to review the matter and issue suitable revised instructions for mitigating the staff hardships in the above situations. A copy of the instructions issued may be endorsed to the Federation.

New Delhi: With the government giving in-principle approval to the one rank one pension scheme for defence personnel, Railway employees are now asking for similar pension benefit, arguing that their duties too are “hazardous, risky and complex”.

In a letter to Prime Minister Narendra Modi, National Federation of Indian Railwaymen has demanded uniform pension policy for railway employees.

“On an average, 800 railway employees get killed per year in the course of duty and nearly 3,000 sustain injuries at work,” M Raghavaiah, general secretary of NFIR, said.

Railways, one of the largest employer in the country, has about 13 lakh employees.

He said over 85 per cent of railway employees work in remote locations and extremist-affected areas.

Raghavaiah appealed to scrap the New Pension Scheme in railways and grant OROP to employees “as has been agreed to in the case of retired defence personnel”.

The National Federation of Indian Railwaymen while welcoming the Government’s announcement for introduction of “One Rank – One Pension” for ex-servicemen, urges upon the Hon’ble Prime Minister to take steps for granting similar pensionary benefits to the Railway employees also, the duties of Railway employees are hazardous, risky and complex. They work at over 8,000 Railway stations covering the Railway Tracks of over 65,000 kms. Over 85% of Railway employees perform duties at remote places, extremist infested areas and places where no township or medical or drinking water or schooling fbcilities exist. Like Army, Railway employee cannot leave their post till another employee takes over the charge. The Railway tracks are maintained by the employees facing inclement weather conditions and working under open sky akin to that of defence personnel. On an average 800 Railway employees get killed per year in the course of performing duties and nearly 3000 sustain injuries while on duty.

For ensuring uninterrupted services the Railway employees are required to be on high alertness at all times. The Railway employees maintain high degree of discipline and efficiency to ensure that the Rail Transport System functions without interruption. The Chairman of the Railway Safety Review Committee” Justice H.R. Khanna (Retired Supreme Court Judge) had observed in his report that the working of the Railway system is more like armed forces, thus historically the Indian Railways functions differently from other Government Institutions.

The uniqueness in duties being performed by Railway employees is unmatched as these employees are involved in safe and efficient train operations more particularly the statf like Train Controllers, Station Masters, Electric Signal Maintainer. Technical Staff, Loco pilot. Guards.

Technical Supervisors whose duties and responsibilities are similar to that of defence personnel.
Indian Railways plays crucial role not only for the economic development of the country but also for ensuring rapid movement of Army, Military Hardware to the Borders and rises to the occasions when the security of the country is at stake. Railway employees face war like situation in their day-to-day working i.e. breaches, bandhs. civil disobedience movements. accidents etc.. and ensure maintaining the supply line all throughout.
It is unfortunate that the Railway employees have been subjected to injustice by governing them under New Pension Scheme with effect from January, 2004, Railwaymen’s demand for abolition of New Pension Scheme is unresolved even though Railway Minister Mallikarjun Kharge had recommended for exemption of Railways from New Pension Scheme.

I therefore, appeal to the Prime Minister of India to scrap New Pension Scheme in Railways and grant “One Rank – One Pension” Scheme to the Railway employees as has been agreed to in the case of retiring defence personnel.

In this connection, NFIR has following suggestions to be considered for incorporating appropriately in the instructions.
(i) The observations of Ministry of Labour who have been repeatedly bringing to the notice of Railway Board that the number of Apprentices being trained in Railway Establishments is significantly lower than the seats allocated by the Regional Directors of Apprenticeship Training needs to be included in the instructions.

(ii) Depending upon the strength of skilled staff, the joint survey conducted by the Railway Officials and the Ministry of Labour, it is seen that nearly 16,772 Apprentices are to be trained and the seats allotted accordingly vide Board’s letter dated 30/0712012 and modified para 3.3 of Board’s letter dated 22/07/2002. Therefore, the selection of units again as mentioned at’A’of the draft instructions is not acceptable.

(iii) NFIR desires to state that the draft instructions do not contain the provision that Railway should ensure that only those designated trades are included in the survey which have a potential for future recruitment/absorption. This is an important feature needed to be incorporated as the same is also based on Hon’ble Supreme Court’s Judgement in the case of UP State Road Transport Corporation V/s UP Berozgar Samiti and is already existing in para 3.2.1 of Board’s instructions dated 22/07/2002.
(iv) Since the minimum educational qualification prescribed for recruitment in the lowest category i.e. GP 1800/- is l0’n pass or its equivalent in all Government Departments including Indian Railways, the same should be made applicable for Apprentice also. This fulfils the condition mentioned in clause 3 (v) of chapter-ll of the Act. There is thus no need for adding the qualification of ITI or giving any – additional weightage for the same. The bench mark of 50% marks in aggregate taking into account the ITI qualification need not be prescribed. The merit list would however be prepared on the basis of marks obtained in matriculation or 10th pass or equivalent;
(v) The selection for training as apprentices should be from following sources duly following Government of India’s Rules for reservation and age relaxation for various communities/categories as revised by the Railway Board from time to time:-
(a) Nearest employment exchanges,
(b) SC/ST & OBC Organisations,
(c) Recognised Unions/Associations,
(d) Wards of Railway employees
There is no need for centralised notification by the Zonal Railway. The job could be left for the concerned Divisions/Workshops to process and form lists accordins to merit among the eligible candidates.

NFIR also desires that the proposal be discussed with the Federations further before formulating policy.

Federation desires to invite attention of the Railway Board to the provisions contained in Rule No. 1676 (1) extract of which is reproduced below:-

“A Railway servant suffering from Cancer, Tuberculosis or Polio myelitis who is sent to a hospital referred in Rule 643 RI for treatment on the advice of the authorised Medical Attendant shall be entitled to travelling allowance as for a journey on tour to and from the place of treatment, but no daily allowance shall be admissible for any halts”

As per the above provision Railway employee or a family member of the employee if suffering from Cancer, Tuberculoses or Polio myelitis and sent to Railway Hospital or referred to another Hospital for treatment is entitled for payment of travelling allowance similar to the journey on tour, to and from the place of treatment.
NFIR has noted that the rules, however, do not cover the period of absence during the medical treatment of the Railway employee or member of his/her family. Reports received by the Federation from Zones/Divisions reveal that Railway employees have been facing difficulties in absence of adequate provision as the period spent by the employee is debited against ‘leave due‘ and sometimes leads to ‘Nil’ balance which causes further hardships as the employees are denied salary due to non- availability of adequate amount of leave in the leave account.

NFIR, therefore requests the Railway Board to make suitable provision in the rules for treating such periods as duty, may be, on production of medical certificate from the authorised medical officer and issue instructions accordingly. This will send a right message among the Railway employees as a positive welfare measure. A copy of the instructions issued may be endorsed to the Federation.

In the Fast Track Committee Meeting held in the Railway Board on 08/05/2015, the above subject was discussed without finality. However, NFIR places below detailed justification warranting restoration of payment of TA/DA to the Staff Car Drivers:-

1. The Committee constituted by the Railway Board appears to have not recommended payment of Daily Allowance to the Staff Car Drivers for performing official journeys during the prescribed duty hours even if they move out beyond a distance of 8 kms. from the Head Quarters without consulting extant codal provision.

2. The Sub Rule (1) of Rule 1614 o.f lndian Railway Establishment Code (Second Reprint Edition) permits drawal of daily allowance by a Railway employee who is not receiving a permanent allowance on any day on which he proceeds on tour beyond a radius of 8 kms.

The position mentioned above shows that the decision taken by the Railway Board is contrary to the instructions/codal provisions, the same requires to be reviewed. It needs to te appreciated that the staff car drivers carry the officials to accident sites, flood affected areas, and different locations in view of administrative requirement. Their working is not comparable with other departments of central Government. Denial of TA/DA is therefore unjustified.

NFIR, therefore, urges the Railway Board to withdraw Board’s letter dated 12/03/2008 and issue instructions to the General Managers of Zones/PUs for restoration of payment of TA/DA to Staff Car Drivers undertaking journeys a beyond a distance of 8 kms. A copy of the instructions issued may be endorsed to the Federation.

MASSIVE DEMONSTRATION BY CENTRAL GOVERNMENT EMPLOYEES AT PARLIAMENT – INDEFINITE STRIKE FROM 23rd NOVEMBER 2015 ANNOUNCED

Over one lakh Central Government employees belonging to Railways, Defence, Postal, Income Tax, Central Excise etc., have conducted massive demonstration in front of Parliament against Central Government’s anti worker policies and non-responsive attitude on the Charter of Demands presented to the Dr. M. Raghavaiah, Chairman of the National Joint Council of Action (NJCA) has presided over the massive meeting near Parliament. He declared that over 34 lakh Central Govemment employees will go on Indefinite Strike from 23rd November 2015 – 6 A.M. onwards if Government fails to reach negotiated settlement on the Charter of Demands out of which main demands are as follows :-
  • Withdrawal of FDI, PPP in Railways, Defence etc., – Stop outsourcing, contractorisation and privatization,
  • Scrap New Pension Scheme,
  • Grant of Interim Relief to Central Government employees,
  • Merger of DA with Pay with retrospective effect and payment of Interim Relief,
  • Implement wage revision w.e.f. 01/01/2014,
  • Calculation of PL Bonus on actual wages,
  • Exemption of Transport Allowance from the purview of Income Tax,
  • Enhancement of contribution of GIS by atleast 10 times,
  • Merger of Technician II with Technician I in GP 2800/- (PB-I) in Railways,
  • Entry grade pay of Station Master as Rs. 4200/- in (PB-2),
  • Allotment of higher grade pay to Loco Pilots and Guards,
  • Upward revision of kilometrage rates of Running Staff w.e.f. 01/011/2006 and settle settlement of Running Staff issues as per agreement dated 07th February 2014 etc.

RESOLUTION ADOPTED AT THE MASSWE RALLY AT JANTAT MANTAR (PARLIAMENT STREET) ON 28th APRIL 2015

“The massive congregation of the representatives of Central Government Employees who have come from various parts of the country held at Jantar Mantar before the Indian Parliament on 28/04/2015 decided to commence the Indefinite strike action 23rd November 2015 from 6:00 AM having failed to elicit any positive response from the Government in settlement of the 10 Point charter of Demands submitted months back. It was also decided that the Railways and Defence organirations will conduct the strike ballot in July 2015 as per the provision of the Industrial Disputes Act and Recognition Rules before commencing the strike from 23.11.2015.

The massive gathering adopted the resolution unanimously exhorting the Central Government Employees to prepare for the eventual strike action in all earnestness and make it a historic one.

The meeting congratulates the employees for forging exemplary unity and carrying out various programmes chalked out by the National Joint Council of Action (NJCA) after the National Convention on 11th December 2014. Even though the Government was compelled to set up the 7th CPC on account of the sanctions generated through the action programmes, Government has refused to grant Interim Relief and Merger of DA and excluded the Gramin Dak Sewaks of the Postal Department from the ambit of the 7tn CPC.

The meeting noted that the Government has purposely ensured the closure of Joint consultative Machinery, the negotiating forum set up in 1964 for Central Government Employees to discuss and bring about settlement of their demands.

The meeting chaired by Secretary (personnel) on 25th February 2015 did not bring about settlement on any single item of the Charter of Demands.

The meeting unanimously decided to demand the immediately and settle the following Charter of Demands.

CHARTER OF DEMANDS

Effect wage revision of the Central Government Employees from 01/01/2014,regarding the memorandum of the Staff side JCM, ensure 5-year wage revision in future, grant Interim Relief and Merger of 100% of DA.
Ensure submission of the 7th CPC report within the stipulated time frame of 18 months, include the Grameen Dak Sewaks within the ambit of the 7th CPC. Settle all anomalies of the 6th CPC.
  • No Privatization, PPP or FDI in Railways and Defence Establishments and no corporatization of postal services.
  • No Ban on recruitment/creation of post.
  • Scrap PFRDA Act and re-introduce the defined benefit statutory pension scheme.
No outsourcing, contractorisation, privatization of governmental functions, withdraw the proposed move to close down the Printing Presses, the publication form store and stationery departments and Medical Stores Depots, regularize the existing daily rated/casual and contract workers and absorption of trained apprentices.
Revive the JCM function at all levels as an effecting negotiating forum for settlement of the demand of the
  • Remove the arbitrary ceiling on compassionate appointments.
  • No labour reforms which are inimical to the interest of the workers.
  • Remove the Bonus ceiling.
  • Ensure five promotions in the service career.
The meeting authorized the National JCA to take appropriate and necessary steps indefinite strike begining from 23rd November 2015 an unprecedented and grand success’.

Sub: – National Holiday Allowance – revision of rate – urged.

Pursuant to the recommendation of the Jagannadha Das Pay Commission contained in para 45 of Chapter XXXV, the Railway Board with the sanction of the President, had decided to compensate the Railway employees by additional payment, when they are called upon to perform duties on National Holidays every year. Instructions to this effect were issued by the Railway Board vide letter No.PC-60/HL-2/1 dated 10th August 1961, fixing following criteria for payment of additional pay:-

“Basic Pay as defined in Rule 2003 (21) (a) (i&ii) R-II and full Dearness Allowance (inclusive of Dearness Pay), Where the pay plus Dearness Allowance falls in between the two slabs, the rate for the next higher slabs shall apply”.

2. The Railway Ministry had also declared some more important days as “National Holidays” later on. In this connection, NFIR wishes to reiterate that initially additional pay was granted, to compensate to those Railway employees who in the exigencies of services are not permitted to avail National Holidays, by additional payment equal to 1 ½ times of the normal rate of pay plus DA thereon. At the same time, NFIR conveys that over the period of time not only the nomenclature but also the basis of National Holiday Allowance has been changed completely by the Railway Board without going into its genesis and has implemented the decision in most negative and unrealistic manner resulting less payment of National Holiday Allowance towards the so called compensation. There is wide variation between the original provision and the amount paid at present as National Holiday Allowance as can be seen from the following illustration:-

3. Incidentally, the Federation desires to mention that the Fifth Central Pay Commission in their recommendations to the Government of India had suggested payment of National Holiday Allowance at the rate of payment of Over Time Allowance.

NFIR, therefore, requests the Chairman, Pay Commission to consider the facts mentioned above and make suitable recommendations to the Government of India for upward revision of the National Holiday Allowance.

NFIR desires to invite kind attention of the Railway Board to the discussions held in the PNM meeting on 1.9th/20th December 2014 relating to allotment of qualification related Grade pay/pay Band to ECG & Holter Technicians working in the Railway Hospitals (appearing under PNM item No. 60/2012) wherein the Federation was apprised that the matter will be referred to the 7th Central Pay Commission with full justification thereof.

2. Further the Federation wishes to state that the issue of revision of designation of ECG & Holter Technician to “Cardiac Technologist” has also been pending in the Railway Board. In this connection, Federation desires to add that majority of Zonal Railways have since suggested for revision of designation of this category to “Cardiac Technologist” as the same is reported to the in vogue in Central and State Government Hospitals. lncidentally NFIR states that this proposal tias NIL financial implications and hence there should be no difficulty to revise the designation.

NFIR, therefore, once again urges upon the Railway Board to send copy,of proposal relating to allotment of qualification based pay structure sent by Railway Board to 7th CPC to the Federation and also issue instructions for revision of designation of ECG & Holter Technician to “Cardiac Technologist” working in the Railway Hospitals at an early date. Federation may please be provided with the copy of the instructions.

Sub: Counting of services paid from contingencies with regular service for retirement benefits of raiiway employees who have put in such service – reg.

(i) NFIR’s PNM Item No.27/2011 & 3/2013.
(ii) Ministry of Railway’s OM No.E(NG)II/2014/CL/14 dated 25/11/2014 to the Secretary, Dop&T, North Block, NewDelhi.
(iii) NFIR’s letter No.II/35/Part.11 dated 07/01/2015.
(iv) Ministry of Personnel, Public Grievances & pensions, Dop&T oM No. Misc- 14017/6/2015 – Estt(RR), Dy. No. 1066914/15/CR dated 26/02/2015 addressed to Secretary, Railway Board, New Delhi & copy endorsed to the General Secretary, NFIR

The Secretary, DoP&T, North Block, New Delhi while enclosing copy of NFIR,s lefter No. II/35/Part. 11 dated 07/01/2015, has addressed letter to the secretary, Railway Board (OM dated 26/02/2015), wherein the Railway Ministry has been advised to send the proposal in accordance with the procedure laid down in Dop&T OM No. 2034/2/2010 – Estt. (D) dated 13th August, 2010.

Federation also desires to state that the issue was discussed in the NFIR’s PNM meeting held with the Railway Board on 19th/20th December, 2014 wherein the official Side while discussing PNM Itern No. 27/2011 & 3/2013 had stated that the subject matter has been referred to the DoP&T vide dated 25/11/2014 whose response was awaited. However the Dop&T’s OM dated 26/02/2015 reveals that the Railway Ministry has not sent proposal in the prescribed format. For ready reference copy of DoP&T OM dated 26/02/2015 is enclosed.

NFIR, therefore, requests the Railway Board to kindly see that proper proposal is sent to the DoPT duly endorsing copy to the Federation. The matter may be treated as important in view of the fact that the PNM item is pending since four years.
