OFFICE MEMORANDUM

Subject: Submission of Immovable Property Return (IPR) for the year 2019 (as on 31.12.2019) by the Officers of Central Secretariat Stenographers’ Services (CSSS) & Central Secretariat Clerical Service (CSCS) - regarding.

In terms of Rule 18 of CCS (Conduct) Rules, 1964 and instructions issued by this Department vide OM No,11013/7/2014-Estt,A- III dated 05.01.2016, the Immovable Property Return (IPR) is required to be furnished by all the Government Servants belonging to Group-A, B and C. Accordingly, IPR should be submitted by all the CSCS/ CSSS Officials/ Officers latest by 31.01.2020. CSSS Officers in the grade of Principal Private Secretary (PPS) and above should submit their IPR through Web Based Cadre Management System hosted at cscms.nic.in, A copy of the print out of IPR submitted online should also be signed and submitted to CS.II(A) Section, which is the custodian of Immovable Property Return (IPR) of these Officers. Stenographer Grade-13, Personal Assistants and Private Secretaries of CSSS & Junior Secretariat Assistants and Senior Secretariat Assistants of CSCS will also submit their IPR to their respective Admin./ Vigilance Division.

2. Ministries/ Departments are therefore, requested that the contents of this O.M. may be widely circulated to the notice of all CSCS/ CSSS Officials/ Officers working under their respective control. They should also ensure that the IPR for the year 2019 (as on 31.12.2019) is submitted within the stipulated time by all the CSCS/ CSSS Officials/ Officers. All the officials/officers are informed that non-submission of IPR within the stipulated date, would invite the denial of Vigilance Clearance for Empanelment, Deputation., assignment to training programme (except mandatory training), applying to sensitive posts etc. as the IPR status needs to be checked for the said purpose(s).

3. It is, therefore, requested that all the CSCS/ CSSS Officers may be directed to file their Immovable Property Return (IPR) for the year 2019 (as on 31.12.2.019) well in time, latest by 31.01.2020. IPRs received beyond the stipulated date, shall not be regarded as conforming to the extant guidelines. Filing of IPR has already been started from 01.01.2020 and the “Immovable Property Returns” window has been operative at cscms.nic.in.

4. In case of any doubt/ difficulty about filing the IPR, Shri Sumit Kumar and Shri Batram Yadav, Assistant Section Officer of CS.II Division may be contacted at Telephone No, 2462 0118.

Subject: Early Closure of Central Government Offices in connection with Republic Day Parade and Beating Retreat Ceremony during January, 2020 - regarding

In connection with arrangements for the Republic Day/ At Home Function / Beating Retreat Ceremony, 2020, it has been decided that the Government offices located in tile buildings indicated in Annexure-A would be closed from 1300 hours on 25.01.2020 to 13 00 hours on 26.0 1.2020. These buildings would also be closed at 1830 hours on 22.01.2020 and will reopen at 1300 hours on 23.0 1.2020 for the full dress rehearsal.

2. The buildings indicated in Annexure -B would be closed on 26.0 1.2020 till 1930 hours for 'At Home Function'. The buildings indicated in Annexure-C would be closed at 1200 noon on 29.01.2020 till 1930 hours on 29.01.2020. The buildings indicated in Annexure-D would be closed on 28.01.2020 from 1600 hours till 1930 hours for the full dress rehearsal for Beating Retreat Ceremony.

3. The above arrangements may please be brought to the notice of all cancelled.

The undersigned is directed to refer to this Department's OM of even number dated 08.11.2019 and subsequent reminder dated 03.12.2019 on the subject mentioned above and to say that only 18 cadre units of CSSS as shown in Annexure have provided the inputs in respect of those officers who are covered under the extant provisions of FR 56(J) and Rule 48 of CCS (Pension) Rules, 1972.

2. It may be appreciated that this all important exercise is to be carried out on top priority and on a regular & continuous basis. It is unfortunate that the inputs are not being received promptly from a large number of cadre units delaying the process.

3. All the remaining cadre units are, therefore, once again requested to furnish the information as per the proforma attached immediately and the same may be furnished to this Division by 21.01.2020 positively. Soft copy of the same may also be sent to 'dinesh.d13@nic.in' with a copy to 'sumit.k13@nic.in'.

In pursuance of the decision taken by the Government, the issue was consulted with Department of Expenditure, Ministry of Finance and it has been decided to restore the Special Allowance @ 10% of the Basic Pay to teaching staff of Oak Grove School, Jharipani with effect from 1st July, 2017. This allowance is not admissible to non-teaching staff.

This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

13 lakhs Central Government Employees participated in the nationwide one day strike on 8th January 2020


PRESS STATEMENT

Dated 8th January, 2020

About thirteen (13) lakhs Central Govt. Employees participated in the nationwide one day strike on 8th January 2020 as per the call given by Confederation of Central Government Employees & Workers. The main demand of the strike is “Scrap New Contributory Pension Scheme (NPS) & Restore Old defined Pension Scheme (OPS)”. The strike is also to express the anger and protest of the Central Government employees and Pensioners against the neo-liberal policies being implemented by the Central Government in the Central Government services, as a result of which the job security, wage structure, social security and the trade union rights of the employees are in danger. None of the 10 points Charter of Demands submitted to the Government by Confederation are settled.

In Postal department about four and half lakhs employees participated in the strike all over the country. 1,55,000 Post Offices and about 400 RMS offices remained closed. Gramin Dak Sevaks of rural post offices also went on strike. Delivery work also affected as Postmen joined the strike.

In Income Tax Department the strike is total in all the States. Work of all Income Tax Offices came to a standstill. Employees of Audit & Accounts department, Civil Accounts, Atomic Energy, Geological Survey of India, Customs and Central Excise, Survey of India, Botanical Survey of India, Postal Accounts, Indian Space Research Organisation (ISRO), Printing and Stationery, Indian Bureau of Mines (IBM), AGMARK, Central Government Health Scheme (CGHS), Medical Stores Depots, Film Division of India, Indian Council for Medical Research, Indian Council for Agricultural Research, Central Food Processing Laboratory, Census Department, National Sample Survey Organisation (NSSO), Defence Accounts, Rehabilitation Department, Central Public Works Department (CPWD), Canteen Employees, Institute of Physics, LNCPE, Sree Chitra Tirunal Institute of Medical Sciences, Employees Provident Fund Organisation (EPFO), Passport Department, Zoological survey of India, Patent Office, Central Drug Laboratory, NADMO, National Library, Marketing Inspection, Commercial Intelligence, Homeopathy Department, Archeological Survey of India and various other autonomous and Scientific Research Institutions participated in the nationwide strike.

Strike is near total in Kerala, West Bengal, Tamilnadu, Maharashtra, Karnataka, Odisha, Telangana, Andhra Pradesh, Chattisgarh, Jharkhand, Assam, North Eastern States including Tripura. 70 to 80% participation in Uttar Pradesh, Madhya Pradesh, Punjab, Haryana and Rajasthan. 60 to 70% strike in Uttarakhand, Bihar, Delhi, Himachal Pradesh, Gujrat and J & K.

Solidarity demonstrations and dharnas are conducted by Central Government Pensioners Organizastions in various states.

National Secretariat of the Confederation thanked and congratulated the Central Government employees for their massive participation and for making the one day nationwide strike a resounding success.

Sub: Information regarding over payments made to DAD employees on account of wrong pay fixation granting the benefit of financial up gradation under ACP/ MACP scheme

Recently Hqr office has intimated that it has received a case where a clerk appointed in the DAD on Inter Departmental Transfer basis was granted financial up gradation under ACP scheme of 1999 in the pay scale of Rs.4000-100-6000 in his erstwhile department . Although he was appointed in the DAD as clerk in the pay scale of Rs.3050- 75- 3950- 80-4590 still his pay was erroneously fixed in the pay scale of Rs.4500-125-7000 (granting him financial up gradation in the hierarchy of post in the DAD ie., pay scale applicable to Auditor) instead of granting him pay protection in the pay scale applicable to the post of clerk in the DAD ie 3050- 75-3950- 80-4590 . This pay fixation is not as per rules/
orders.

2. Hqr has already issued a clarification on the issue of MACP to the employees appointed in DAD through Inter Departmental Transfer vide letter no. AN/Xl/11051/ MACP/2010 v.11-1 dated 25.2 .2010 and AN/Xl/ 11051/MACP/ 2011/ID dated 04.06.2012.

3. It is therefore, requested to confirm that no such cases are there in your office where over payments have been made to any employee due to wrong pay fixation or erroneous grant of financial upgradation under ACP/ MACP scheme.

Subject: All India Strike proposed on January 8, 2020 – Instructions under CCS (Conduct Rules), 1964 – Regarding.

It has been brought to the notice of the Government that the Central Trade Union (CTUs), except Bhartiya Mazdoor Sangh and their affiliates in different sectors are mobilizing workers employees for their proposed nationwide general strike on January 8. 2020. The strike is mainly to protest against Union Government’s labour reforms, FDI, disinvestment, corporation and privatization polices and to press for 12 - point common demands of the working class relating to minimum wage and social security, among others.

2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave go slow etc. or any action that abet any form of strike / protest in violation of Rule 7 of the CCS (Conduct) Rules. 1964. Besides in accordance with the proviso to Rule 17(1) of the Fundamental Rules. pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed they cannot be different form the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike /protest. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike in any form would face the consequences which besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department”s O.M. No.33012/1/(s)/2008- Estt.(8) dated 12.9.2008 on the subject for strict compliance (enclosed as Annexure-A).

3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees. if applied for during the period of proposed strike, and ensure that the willing employees are allowed hindrance free entry into the office premises.

4. In case employees go on strike all Divisional Heads are requested to forward a report indicating the number and details of employees. who are absent from duty on the day of strike. i.e. 08 .01.2020.
