OPTION-I FOR PRE-2016 PENSIONERS REJECTED: In the meeting held on 30-06-2016, with Group of Ministers by JCM staff side, the Finance Minister had also clarified that Government has taken the decision to implement the recommendation of 7th CPC to bring about parity between past and present pensioners. (Vide NJCA Statement issued on 06-07-2016). Finance Minister categorically assured the NJCA leaders on 30-06-2016 that the Government has accepted the recommendation in to and Pension department has only been asked to sort out the difficulties in implementation of Option-I, if any.

NJCA wrote to Finance Minister on 16-07-2016, as follows: "The issue of acceptance of Option-I and II was discussed with your goodself at the residence of Hon’ble Home Minister (Govt. of India) wherein Hon'ble Minister for Railways and Hon'ble MoS Railways were present. You had categorically agreed our demand that no dilution would be made in the options given to the Pensioners by the 7th CPC. It is unfortunate that a rider "subject to feasibility" has been imposed on Option-I. Sir, this is very unfair and we will appreciate, if you kindly get the sentence "subject to feasibility" removed from that order, to keep your promise also".

But, Finance Minister had gone back from his assurance to JCM Staff side leaders and he refused to withdraw the condition “subject to feasibility". In the letter dated 17-10-2016, addressed to Chairman of the “Pension Option-I Committee”, the Secretary, JCM staff side requested as follows:

"The attempt therefore must be to explore the ways and means of implementing the said recommendation which is beneficial to a large number of pensioners, especially those retired prior to 1996. In view of this, the staff side is of the firm view that the Government issue orders for implementation of Option-I as there is no room for stating that the recommendation is impossible to be implemented for those who are benefitted by the said option".

Finally NJCA wrote a letter to Hon'ble Home Minister Shri. Rajnath Singh on 17-01-2017, requesting intervention. The letter reads as follows:

"The Central Government Pensioners numbering presently more than the working employees are aggrieved of the fact that the one and the only recommendation of the 7th CPC which was in their favour ie; Option-I have been recommended to be rejected by the Pension Department to the Government".

Inspite of all these, the proposal is submitted to cabinet to reject Option-I. This underlines the fact that unless NJCA revive its deferred indefinite strike, the Government will not allow Option-I to pensioners, as assured by Finance Minister.

ARREARS ON ALLOWANCES INCLUDING HRA AND TRANSPORT ALLOWANCE IS GOING TO BE REJECTED:

Now it has become clear that the Government has constituted the Allowance Committee headed by Finance Secretary, mainly to delay the implementation of enhanced allowances and finally deny the arrears by implementing the revised allowance either from 01-01-2017 or from 01-04-2017. The four months time fixed for the Allowance Committee is already extended to six months upto 22-02-2017. Reserve Bank Governor, Dr. Urjit Patel had hinted to the media that the burden of payment of arrears during this financial year will not be there, meaning that Government may not give retrospective effect to the revised allowances. The RBI Governor, Dr. Urjit Patel made the following observations, which is published in the RBI website.
"The extension of two months given to the Ministry of Finance to receive the notification on higher allowances under the Pay Commission's award could push its fuller effect into the next financial year rather than this financial year".

Further, the Allowance Committee has not held any negotiation with the JCM Staff Side. It just heard the views of the staff side. The request of the JCM staff side to hold one more meeting with staff side NJCM was not favourably considered by the Finance Secretary, who is the Chairman of the Allowance Committee. No indication is given as to whether the percentage of HRA recommended by 7th CPC will be enhanced to 30%, 20% and 10%. The fate of other allowances are also the same. Unless NJCA take a firm stand and negotiate with the Government by reviving the indefinite strike, the employees will be placed in a desperate and helpless situation, if Government is allowed to unilaterally declare the HRA and other allowances, without retrospective effect from 01-01-2016, and also without much modification, thereby denying crores of rupees as arrears.

NPS committee constituted by the Government to streamline the National Pension System has called the JCM Staff Side for second round of discussion on 10.02.2017. As per the notified agenda, the committee is proposing discussion on only cosmetic changes in NPS. Basic issues such as (1) scrapping of NPS (2) Guaranteed Minimum pension to NPS Pensioners ie; 50% of the last pay drawn should be guaranteed by Government as minimum pension even if the returns from annuity insurance scheme amount is less than the 50%. and (3) Exemption of Central Govt. Employees from the purview of NPS, are not included in the agenda of the meeting even though the Cabinet Secretary has assured JCM Staff Side Chairman and Secretary Shri. Raghavayya and Shri Shiv Gopal Misra on 19th January 2017 that  "so far as issue of NPS is concerned he has already directed the Committee to hold meeting with Staff Side". From reading the agenda it can be seen that main demands of the Staff Side are avoided, thus betraying the cause of thousands of younger generation Central Government Employees who joined service after 01.01.2004. Their hopes are shattered and belied. NJCA should revive the deferred strike to protect the interest of younger generations. Let us make the 16th March 2017 Confederation Strike a grand success.

Usually Government approves the dearness allowance during the 1st week of September and release the government order in 3rd or 4th week of September, but this year government not yet approved dearness allowance from 1.7.2016. After 7th Pay Commission Implementation the dearness allowance computation formula & the base year must be changed, the computation formula & base year changed in the earlier pay commission also

During September 1st week JCM Staff side Secretary writes letter to Ministry of Finance with the subject “Future computation of Dearness Allowance and adoption base index figure to Revised Minimum Wage”, in this letter Union demands to grant of 3% dearness allowance with effect from 1.7.2016, even though there is no official announcement from the government. Even all the state government employees are waiting for the announcement from the Central government.
And again last week Union writes letter to the Secretary, Ministry of Finance to grant the dearness allowance at the earliest.

Dear comrade,

This is in connection with LDC/UDC, MACP on Promotional hierarchy and other issues related to Administrative Staff of Subordinate offices. It is surprising to note that the 7th Pay Commission has turned down the genuine issue of LDC & UDC on the ground that the government has stopped direct recruitment for the clerical cadre and gradually phasing out the existing incumbents. If this is true, it is a matter of great concern that the Government has chosen to take a unilateral decision on an important policy matter without consulting the Staff side. The reason given for rejection of the demand is not convincing.
Besides Confederation/Staff Side JCM, several Departments had recommended upgradation of grade pay of LDC & UDC of Administrative Offices especially the LDC & UDCs of subordinate offices of Government of India.
Extracts of the Pay Commission comments on the matter is given below:
By analyzing the demand of SVP, National Police Academy under Para 11.22.100 the Commission has said “This issue has been dealt in Chapter 7.7. Recommendations made there would apply in this case also”
As against the demand of Directorate of Printing under Para 11.52.32 Commission maintained that “posts like LDC, UDC, Accountant are common to a number of ministries/ departments. Recommendations regarding their pay are contained in Chapter 7.7 and Chapter 11.35.”
But, in Chapter 7.7, deals common category, no recommendation for LDC/UDC is given.
However by recording disagreement to increase promotional quota of MTS to LDC under Para 7.7.37 & 11.35.28 Commission has said that “government has already stopped direct recruitment for the clerical cadre and gradually phasing out the existing incumbents, this demand cannot be accepted.”
But the fact is that Staff Selection Commission is frequently conducting recruitment for the post of LDC. Combined higher secondary examination for the selection of LDC also has been conducted recently. Moreover, no alternative recommendation to replace the LDC post is given in the report.  It is to be noted that the normal ratio of LDC and UDC in subordinate offices is 5:2 and thus LDCs have been allocated responsible sections and in many smaller offices LDC alone is handling the work of entire Administration.
On the other hand rejecting Central Secretariat Clerical service demand for parity with DEO, the commission observes “Even though the entry requirements are similar, historically the pay scales of the two posts have been different. Besides, they comprise two distinct cadres with different set of roles and responsibilities. Hence, the demand for parity of pay of LDC with DEOs cannot be acceded to by the Commission.”(Para 11.35.38).
Historically these cadres may be different set of roles but the fact is that functions of LDC are more complex than that of DEO and same was brought before the commission by various Associations/Administrative Authorities. Earlier pay Commissions have fixed Pay Scale to DEO considering their work on computer. But today LDCs are selected on the basis of their expertise in computer operation also.
By concluding the LDC issue, I give hereunder two comments among the dozens of comments/e-mail received us on the subject. This signifies the sufferings of LDCs in subordinate offices.
(1)   I am really disappointed with the decision of 7th CPC, I was hoping that I would get atleast GP 2400 as per their calculation, they don’t even think about lower classMyself Ashutosh, LDC and I am appointed on 2012, 3000 KM far from my house and from last 2 years I am doing the work of cashier along with all the work of Income Tax and budget, apart from me 4 more LDC’s are working here instead of UDC’s and they are the backbone of their branch but as per 7th CPC words we are not having as much responsible work they think LDC’s are recruits only for “dispatch” and “typing” which is not true.
I request to them, sir please come and see how much responsibility we have and what we are getting,
(2)    I am s murugan LDC, handling with pay bills, income tax, TDS and what are related to taxable income such as LTC encashment, final bills, HRA claim and etc…
In 7th Cpc report every where it is stated that this is dealt with chapter 7.7 and 11.35. But, there are no clear instructions for clerical.
The major error is clerical cadre is not included in common categories (chapter 7).
II      Grant of MACP on Promotional Hierarchy:
Even though the Confederation has clarified that the Commission has recommended MACP on promotional hierarchy, the report of the Commission is confusing and contradictory. Para 5.1.44 reads in the new Pay matrix, the employees will move to the immediate next level in the hierarchy. This can be interpreted as fixation in the same principle as that for a regular promotion. But Para 11.52.45 is contradictory.

III     The Grade Pay of  Assistants/Stenographers of Central Secretariat is brought down to Rs. 4200 from the existing Rs. 4600 and NFSG granted to the UDCs of Central Secretariat has been withdrawn thereby the demand for parity with the Grade Pay of Assistant/UDC of Central Secretariat is turned down.
Comrades, Government is bent upon to contractorise all the Administrative posts below the post of Assistants. The demand for merger of Grade Pay of LDC & UDC and upgradation to Rs. 2800, as recommended by the staff side is genuine in accordance with duties assigned. Confederation/JCM (Staff Side) is requested to please help LDC/UDC and other Administrative Staff of subordinate Offices to resolve these genuine issues.

The National Secretariat Meeting of the Confederation held at Hyderabad on 09th October 2015 while endorsing the decision of the National Joint Council of Action (Railway, Defence & Confederation) to organize massive protest dharna at Jantar Mantar, New Delhi on 19th November 2015 and also Nationwide Protest Demonstration in front of all works spot & offices, has decided to further intensify the protest action against the negative attitude of the NDA Government by organizing the following programmes: –

(1) 2015 November 2nd to 6th – Campaign Week.
(2) 2015 November 6th – Nationwide Mass Dharna at all Important centres.

The Campaign and Protest Dharna will be organized mainly on the following three issues: -

(1) Non Settlement of any of the legitimate demands raised by the JCM Staff Side, National Council by the NDA Government.

(2) Causing engineered delay by the Government in the submission of 7th CPC report by granting four months extension upto 31st December 2015, even when the Pay Commission was ready to submit its report within the stipulated time i.e. 28th August 2015.

(3) Unwarranted intervention of the Finance Ministry in the independent functioning of the Pay Commission by issuing a statement asking the 7th CPC to factor into its report the fiscal concern of the government and thereby to pressurize the commission not to recommend wage rise on the basis of a sound and scientific formulation.

All affiliated organizations and C-O-Cs are requested to implement the above campaign and protest programme throughout the country in a most befitting manner.

New Delhi, Government would have to bear burden of Rs. 10000 crore rupees in case deaness allowance of central government employees is merged and till the implementation of seventh pay commission report government will neither give interim relief nor merge dearness allowance in basic pay for central government employees. Central government has flatly refused to give two thousand interim relief to 34 lakhs of its employees. Chairman of seventh pay commission Justice Ashok Kumar Mathur has refused to oblige on this issue. He further reiterated that provision of giving interim or merger of dearness allowance hasn’t been there in the terms of reference for seventh pay commission. Pay commission has asked representatives of employee union to move to dopt or Ministry for Finance for interim or da merger. Representatives of Joint Consultative Machinery then met the oflicials of DOPT and Ministry of Finance on the issue, but both department refused to give any assurance on these issues, rather assured JCM members that pay commission report will be implemented on time.

But employees’ unions are not impressed; JCM says that no pay commission has ever presented its report before two years. Employees’ unions are also raising the demand to resolve the anomalies of sixth pay commission which are still lying pending. JCM members also demanded that interim relief may be taken into account in the report of seventh pay commission; this has also been out rightly rejected by government. JCM had requested to merger dearness allowance with effect from lst January 2014. Total expenditure on interim relief and merger of dear allowance will respectively be Rs. 800 crore and ten thousand crore. On the other hand pay commission is doing its work on the daily routine basis. Pay commission has recently visited Kolkatta and Andaman Nicobar islands on Jan 11 14 respectively. Now the pay commission has decided to have evidence meeting with JCM staff side in February.

Till date central government has notified six pay commissions before notifying seventh in February 2014. First central pay commission was notified in 1946, Second CPC in 1957, Third CPC in 1970, Fourth CPC in 1983, Fifth in 1994 and sixth in 2006.
    Government employees to have nice budget this year
Ahead of his first full fledged budget, the Finance Minister Arun Jaitley today said that the NDA government was against raising revenue by imposing higher taxes, instead it would want to leave more money in the hands of consumer to fuel demand and growth. The minister also pledged to make the budgetary process more transparent so as to present the real picture of public finances before the people. “High taxation is not the only route to achieve the target of larger revenue we are not going to take this route,” Jaitley said while speaking at a fianction of private news channel CNBC Awaaz. He was replying to a question whether it was possible to increase the income tax payer base from from 3.5 crore to 15 crore. “We believe that the consumer should have money in hand and by spending that money, production will increase and the country will be benefited,” the minister said. The government raised income tax exemption limit from Rs. 2 lakh to Rs. 2.5 lakh in the last budget, he said.

Sub: Holding of National Convention of the National Council (JCM)(Staff Side)

As you are aware, the Staff Side, JCM National Council had, as desired by the 7th CPC, submitted a separate memorandum on Interim Relief and Merger of DA, copy of which had also been sent to the Finance Ministry. During the Informal Discussions the Staff Side had with the Pay Commission, they had assured us to take up the issue with the Government seeking amendment to the Terms of Reference to enable them to act upon our memorandum.

We have received reply from the Finance Ministry, which is indicative of a refusal of both the demands. The NDA Government has adopted the same plea made by the UPA II Government to reject our demands. The 7th CPC have so far not communicated to us, the decision they have taken on our memorandum.

From the steps so far taken by the BJP Government, it is unambiguous that they would be pursuing the neo-liberal economic policies with much more intensity than even the UPA Government. Having got a clear majority in the Parliament, they would be able to push through necessary legislations to pursue reforms. The outsourcing of Railway functions, privatization of Defence manufacturing Units, increased FDI inflow in various core sectors of economy, dismantling of the administrative price mechanism, de-nationalization efforts in the Banking, Insurance and Coal Sectors and above all the adherence to New Contributory Pension Scheme are some of the bold anti worker steps taken by the new Government.

The matter of fact approach and urgency which was visible in the initial days of the 7th CPC appears to have vanished. It is a matter of pride for all of us that we could submit our final memorandum on common issues to the Commission within the stipulated time frame. We are also happy to note that almost all service organizations of Central Government employees have endorsed our formulations on the wage structure and other service benefits. It is also a fact that all these organizations have submitted their memoranda on department-specific issues before 31st July, 2014. Despite having received such large number of memoranda, the 7thCPC has so far not commenced taking oral evidence giving an indubitable impression that the Commission might not be able to submit its report within the stipulated time of 18 months.

All these issues came up for the consideration of the members of the Staff side when they met a few days back. The unanimous opinion was to pursue the issues through organizational methods. Accordingly, it was decided to hold a National Convention, eliciting the participation of the representatives of all Service organizations participating in the JCM to discuss the emerging situation and decide upon future course of action. Incidentally, we must mention that the JCM conceived as a negotiating forum has been made ineffective by the Government over the years by not convening its meetings periodically.

The National Convention will be held at MPCU Shah Auditorium, Sree Gurjarathi Samaj, Raj Niwas Road, Civil Lines(Opposite Civil Lines Metro Station), Delhi, on 11th December, 2014. The Convention will commence at 12 Noon and will be concluded by 4.00 PM. 740 delegates will participate in the convention, of which 370 shall be Railwaymen(AIRF and NFIR), 150 will be Defence Civilian employees (AIDEF and INDWF) and the rest 220 will be represented by other Central Government employees (Confederation of Central Government employees and workers). The participating organizations will issue separate circular letter indicating the number of delegates of each Branch/Unit, Divisions/Zones, Circles/States, and affiliates may deploy to the Convention.

The Staff side will meet again to finalize the draft declaration to be placed before the Convention for discussion and adoption. The date and venue of the meeting will be intimated in due course.
