March to Parliament was held on 28.04.2015 and call of strike has been given by JCA on 23.11.2015 on the demands of central government employees. On the backdrop of the pressure mounted by JCA, DOPT has called a meeting of NC JCM on 29.05.2015 to discuss and consider the issues of central government employees.

2. You will be aware that the meeting of the National Anomaly Committee (NAC) is scheduled to be held on 29.05.2015 and also meeting of the National Council (JCM) is likely to be held shortly. Some of the issues will be discussed and considered during the meetings.

CHARTER OF DEMANDS:

1.    Effect wage revision of the Central Government Employees from 01.01.2014, accepting the memorandum of the Staff Side JCM; ensure 5-year wage revision in future; grant Interim Relief and Merger of 100% of DA. Ensure submission of the 7th CPC report within the stipulated time frame of 18 months; include the Grameen Dak Sewaks within the ambit of the 7th CPC.  Settle all anomalies of the 6th CPC.

2.    No privatisation, PPP or FDI in Railways and Defence Establishments and no corporatisation of postal services.

3.    No Ban on recruitment/creation of post.

4.    Scrap PFRDA Act and re-introduce the defined benefit statutory pension scheme.

5.    No outsourcing; contractorisation, privatisation of governmental  functions; withdraw the proposed move to close down the Printing Presses; the publication, form store and stationery departments and Medical Stores Depots; regularise the existing daily rated/casual and contract workers and absorption of trained apprentices.

6.  Revive the JCM functioning at all levels as an effective negotiating forum for settlement of the demands of the CGEs.

7.    Remove the arbitrary ceiling on compassionate appointments.

8.    No labour reforms which are inimical to the interest of the workers.

9.    Remove the ceiling on payment of Bonus.

10. Ensure five promotions in the service career.

  • 7th Joint Note to be inked on 25th May 2015 at Mumbai Today, the penultimate round on the current wage revision was held at IBA Office, Cuffe Parade, Mumbai at 2.30 p.m. The IBA team was led by Shri Arun Tiwari, CMD, Union Bank, Shri Ashwini Mehra, DMD, SBI, Shri M. V. Tanksale, CEO, IBA, Shri K. Unnikrishnan, Dy. CEO, IBA, Shri K. S. Chauhan, Vice President, HR & IR, IBA besides the support team of IBA.
Preceding the discussions, there was a preliminary round in which Com. Alok Khare, Vice Chairman, besides the undersigned with the other organizational representatives participated in the exercise.

CEO, IBA while welcoming the representatives of the officers organisations expressed his happiness in the matter of reaching the understandings on distribution of the financial benefits to the officers based on the MOU inked on 23rd February 2015. He emphasized the need to protect and promote the public sector banks image in the eyes of the common man of the country. He also expressed the need to take forward the message of building a sense of belonging to the members of the officers community. Shri Arun Tiwari, CMD, UBI was categorical that the work force needs to be satisfied first through whom the image building and the involvement to build the public sector banks would become possible. Representatives of the four officers organisations responded positively to the observations and expressions made by the members of the IBA team. The agreed load was distributed amongst the pay slip components through mutual discussion and the chart of allocation was signed by the both the parties. The details are as under :

Various suggestions have been made by officers organizations to IBA on these matters.

We shall convey the full details of the joint notes once the same is finally inked on 25th May 2015 at Mumbai.

I am directed to say that incentive structure for Banks to mobilize and register subscriber under Atal Pension Yojana has been under the consideration of PFRDA.

2. In consultation with the Department of Financial Services, Ministry of Finance, it has been decided that for mobilizing each account the Banks will be paid an incentive as per the table below:
i. Per capita incentive at Rs 100
ii. Incentive payable for promotion and development of APY:

3. Banks are advised to contact aggregators for shifting of existing eligible Swavalamban subscribers to APY as per the scheme.
 
4. Payment of incentives to banks each year will be made after the completion of the financial year on receipt of funds from the government.

The Federations seriously disappointed over non-finalisation of issues in spite of discussion held at lower level on a number of occasions. Even he agreed issues in the full Board Meeting held on 7th February 2014, have not been implemented (eg stepping up of pay of Loco Inspectors appointed prior to 01/01/2006 and upgradation of Apex level Group ‘C’ posts to Group ‘B’ Gazetted- 3335 posts).

While conveying unhappiness over procrastination of matters, we list below the issues which are needed to be settled at the earliest. Incidentally, it is mentioned that a few issues agreed to during
discussions in the Fast Track Committee Meetings are yet to be complied with:-

Issues:
  • Induction of Course Completed Act Apprentices against erstwhile Group ‘D’ vacancies in Safety and other categories.
  • Exemption of Railways from New Pension Scheme – Hon‘ble Minister for Railways sent proposal to Finance Minister on 29’h March 2014 and thereafter the Railway Board has sent reminder to the MoF,
  • Absorption of Quasi-Administrative Units staff against erstwhile Group ‘D‘ vacancies Railway Board have arbitrarily cancelled the policy decision issued in 1973 and 1977, Since then the Federations have been pressing for restoration of policy. The subject has been dealt with in the DC/NCM meeting also vide item No. 27/2006 & 12/2012. Also the subject was discussed in the meeting held by the Full Board on 7th Feb. 2014. Unfortunately. there has been no satisfactory finalisation of this item.
  • Upgradation of Apex level Group ‘C‘ posts to Group ‘B‘ Gazetted (3335 posts) – implementation of agreement dated 7th Feb 2014 is yet to be ensured.
  • Stepping up of pay of Loco Inspectors appointed prior to 01/01/2006. Although agreed in the Full Board meeting. the decision has not been implemented yet.
  • Though instructions have been issued by the Railway Board for inclusion of a few additional categories of safety categories of staff in GP 1800 under LARSGESS vide Railway Board‘s letter No. E(P&A)I-2010/RT-2 dated 24/03/2014, but unwarranted conditions like “working on tracks” have been shown even though these staff by virtue of working conditions perform Safety job.
  • Federations. therefore. urge upon the Member Staff to kindly fix Joint meeting at the earliest for frank discussions.

Federation desires to invite attention of the Railway Board to the provisions contained in Rule No. 1676 (1) extract of which is reproduced below:-

“A Railway servant suffering from Cancer, Tuberculosis or Polio myelitis who is sent to a hospital referred in Rule 643 RI for treatment on the advice of the authorised Medical Attendant shall be entitled to travelling allowance as for a journey on tour to and from the place of treatment, but no daily allowance shall be admissible for any halts”

As per the above provision Railway employee or a family member of the employee if suffering from Cancer, Tuberculoses or Polio myelitis and sent to Railway Hospital or referred to another Hospital for treatment is entitled for payment of travelling allowance similar to the journey on tour, to and from the place of treatment.
NFIR has noted that the rules, however, do not cover the period of absence during the medical treatment of the Railway employee or member of his/her family. Reports received by the Federation from Zones/Divisions reveal that Railway employees have been facing difficulties in absence of adequate provision as the period spent by the employee is debited against ‘leave due‘ and sometimes leads to ‘Nil’ balance which causes further hardships as the employees are denied salary due to non- availability of adequate amount of leave in the leave account.

NFIR, therefore requests the Railway Board to make suitable provision in the rules for treating such periods as duty, may be, on production of medical certificate from the authorised medical officer and issue instructions accordingly. This will send a right message among the Railway employees as a positive welfare measure. A copy of the instructions issued may be endorsed to the Federation.

Subject: Request for Voluntary retirement from persons suffering from disability — Supreme Court Order in Bhagwan Dass & Anr Vs Punjab State Electricity Board, (2008) 1 SCC 579.

The undersigned is directed say that vide Department of Personnel and Training’s OM No.18017/1/2014-Estt(L) dated the 25 th February, 2015, certain clarifications regarding treatment of leave and absence of disabled Government servants have been issued.

2. Instances have come to notice where Government servants apply for voluntary retirement under various provisions like Rules 38, Rule 48 and 48A of CCS (Pension) Rules, 1972 or Rule 56 of the Fundamental Rule on account of hardships faced by them due to a disability, as they are unaware of the protection provided by the Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of justifys and Full Participation) Act, 1995 (PWD Act). Section 47 of the PwD Act, 1995 is reproduced below for reference:

“Non-discrimination in Government Employment — (1) No establishment shall dispense with, or reduce in rank, an employee who acquires a disability during his service.

Provided that, if an employee, after acquiring disability is not suitable for the post he was holding, could be shifted to some other post with the same pay scale and service benefits;

Provided further that if it is not possible to adjust the employee against any post, he may be kept on a supernumerary post until a suitable post is available or he attains the age of superannuation, whichever is earlier. No promotion shall be denied to a person merely on the ground of his disability;

Provided that the appropriate Government may, having regard to the type of work carried on in any establishment, by notification and subject to such conditions, if any, as may be specified in such notification, exempt any establishment from the provisions of this section”.

3. The issue had come up in Bhagwan Dass & Anr Vs Punjab State Electricity Board (2008) 1 SCC 579, decided by the Hon’ble Supreme Court where the employee who had during his service suffered from blindness, had applied for voluntary retirement. The Hon’ble Supreme court has observed that the Petitioner was not aware of any protection that the law afforded him and apparently believed that the blindness would cause him to lose his job, which was the source of livelihood of his family. In those circumstances, it was the duty of the superior officers to explain to him the correct legal position and to tell him about his legal justifys.

4. Keeping in view the provisions of the Section 47 of the PwD Act, 1995 and the above mentioned judgement, it has been decided that whenever a Government servant seeks voluntary retirement citing medical grounds, or when the said notice has been submitted due to a disability, the administrative authorities shall examine as to whether the case is covered under Section 47 of PWD Act, 1995. In case the provisions are applicable, the Government servant shall be advised that he/she has the option of continuing in service with the same pay scale and service benefits.

5. In case a disabled Government servant reconsiders his decision and withdraws the notice for voluntary retirement, his case shall be dealt with under the provisions of the Section 47 read with the Department of Personnel and Training OM dated 25th February, 2015, mentioned above. If however, in spite of being so advised, such Government servant still wishes to take voluntary retirement, the request may be processed as per the applicable rule.

6. All the Ministries and Departments are requested to keep the above in view while processing cases of requests for Voluntary retirement from disabled Government servants.

Along with the decreasing percentage of additional Dearness Allowance, there is also a noticeable fall in interest among employees to know more about ‘Expected DA’…!

“There was tremendous curiosity when initial reports surfaced that ‘Expected DA’ could be as high as 10% in 2013. But, now, when the expectation is fixed at around 5%, readership for the topic has decreased considerably.”

Dearness Allowance for Central Government employees, which is given once every six months, is currently expected to be not more than a very minimal 5%.

Additional Dearness Allowance from July 2015 is based on the fluctuation in price of essential commodities between the months of January and June 2015. With the CPI(IW) data available for only three months as of now, the general prediction is that if the AICPIN falls by 6 points total in three months, the additional DA could be as low as 4% from July 2015.

The chances of a 6% of additional DA increase with effect from July 2015 are very minimal.

Statistics of AICPIN of the next two months will decide if the next additional DA is going to be 5% or 6%.
Why is Dearness Allowance, which is given once every six months in order to help the salaried class manage the increasing prices of essential commodities, so important this time?

New Delhi: Various service associations of All India Services and allied services have represented to the Seventh Pay Commission seeking pay parity with IAS officers and adequate representation in central government’s policy making positions.

Officers associations of Indian Police Service (IPS), Indian Revenue Service (IRS), Indian Audit and Accounts Service (IA&AS) and Indian Forest Service (IFoS) have made detailed presentations to the Pay Commission about their grievances and suggestions for the future.

Though made separately, the associations’ presentations unanimously voiced their demand for ensuring pay parity with IAS officers and a share in Joint Secretary-level posts at the Centre.



The Indian Revenue Service officials demanded that top level posts be increased to accommodate them on par with IAS officers. Asserting that they were involved in the important task of collecting revenue for the government, the IRS officers association said the superiority of IAS and Indian Foreign Services (IFS) officers should go as they did not face any hardships.

Listing out the “disparities”, the associations complained about delay in empanelment of officers of their services as Joint Secretaries at the centre vis-a-vis IAS officers. For example, they said, while a 1997 batch IAS officer is empanelled as Joint Secretary, for empanelment of an IPS officer he has to be of the 1993 batch, 1994 batch for IA&AS and 1989 for IFoS.

These organisations deprecated IAS officers deciding the fate of other All India Services and Allied services officers.

The IRS officers also demanded positions ranging from Superintendents of Police to Joint Directors in the CBI for its officers, claiming they were equipped to deal with economic crimes.

IA&AS memorandum also sought equality in rules governing central deputation and allowances.
In its representation, the IPS Officers Association deplored that its demand for pay parity with IAS and IFS has been ignored by successive Pay Commissions.

“But the same (their demand) has not found favour with the Commission. Unfortunately, the reasons for turning down the request were never based on merit but through direct acceptance of flawed arguments made by the other side on the basis of specious premises,” it said.

The IPS officers also demanded that there be more options for them in central staffing and policy making, especially police-specific jobs like internal security division under the Union Home Ministry.

There are hardly any joint secretary or secretary level officers in the bureaucracy from IPS. The memorandum also said that out of 111 posts of Central Vigilance Officers, only 21 were occupied by IPS officers.

It also spoke about the duty of a police officer which went beyond his ordinary scheduled work hours. “A police officer is subject to restrictions on his private life, one of which is the obligation to obey an order to return to duty,” it said.

The duty hours spanned more than 16 hours a day and, therefore, there was a need to introduce an ‘Overtime Allowance’ for police personnel.

Previous UPA regime had announced the Seventh Pay Commission which was constituted on February 28, 2014. Chaired by Justice Ashok Kumar Mathur, it has Vivek Rae as full-time Member, Ratin-Roy as part time Member and Meena Agarwal as Secretary.

The Commission has been given 18 months to submit its recommendations and its term expires in October this year.
