Sub: Participation by Central Government servants In sporting events and tournament of National or International importance.

The undersigned is directed to refer to this Department’s OM No. 6/1/85-Estt (Pay+I) dated 18th May, 2010 which clarifies Inter-alia that sportspersons participating In sporting events (individual/team) of  national/international importance will be treated as having achieved excellence for the purpose of grant of increments if they achieve lst, 2nd or 3rd position in the finals of sporting events, if more than three individuals or teams have participated in the events. If only three or less individuals or teams have participated in the finals of a sporting event, the sportsperson / team achieving first position will be treated as having achieved excellence.

2. The question as regards treating the term ‘finals’ used in OM dated 18.5.2010 and also the distinction sought to be made between athletic / equivalent and non- athletic / equivalent sporting events has been engaging the attention of the Government. In the case of athletic / equivalent sporting events, which are generally decided on the basis of finishing position and which do not involve level-related concept e.g. finals, semi-finals and are held all at one go, there would be no ‘finals’. The three individuals / teams that secure first three positions shall be said to have achieved excellence, if
more than three individuals / teams have participated in the sporting events of national/international importance for the purpose of grant of incentive increments. This benefit, however, is granted to the individual/team, who achieve the first position only, if the number of individuals / teams that participate in the sporting event is three or two.

3. In the case of non-athletic / equivalent sporting events, which are generally single elimination sporting events and which involve level-related concept, the individuals / members of the teams achieving first and second positions respectively In the finals and both the losing semi-finalist individuals / members of the teams achieving third and fourth positions respectively shall be said to have achieved excellence for the purpose of grant of incentive increments, if more than three individuals / teams have
participated in the sporting events of national/international importance for the purpose of grant of incentive increments. This benefit, however, is allowable to only one individual/team, if the number of individuals / teams that participate in a sporting event is less than three.

4. These orders shall be in supersession of the OM No. 6/1/85-Estt(Pay-1) dated 18th May, 2010. The provision as contained in the OM No.6/1/85-Estt(Pay-1) dated 16th July, 1985 shall continue to apply. Past cases may also be decided accordingly.

CIRCULAR
Sub: Sports Facilities of Sports Authority of India and Central Civil Services Cultural Sports Board for Central Government Employees, their families and dependents.

The Central Civil Services Cultural & Sports Board (CCSCSB) is a Society registered under the Societies Registration Act, 1860 and is the Central Agency for promotion of Cultural and Sports Activities amongst the Central Government Employees in the country. It works under the aegis and control Ministry of Personnel, Public Grievances & Pensions Department of Personnel & Training.

2. The CCSCSB organizes various Sports events which includes Inter-Ministry
Tournaments and All India Civil Services Tournaments in 19 disciplines. The details are available at http://www.persmin.nic.in/DOPT_Wings_ATA_Welfare_CCSCSB_Index.asp

3. The CCSCSB has playing facilities at Vinay Marg New Delhi for Athletics, Basketball, Cricket, Football, Hockey and Lawn Tennis. The CCSCSB also maintains Lawn Tennis Courts at Bharti Nagar, R.K. Puram and Brassey Avenue. There is a Volleyball Court and Cricket practice Pitches at Brassy Avenue New Delhi. Facilities are also available for Indoor Games such as Carom & Table Tennis at Nirman Bhawan, New Delhi. Some of the playing facilities are at present free of cost and some are on nominal charges/fees. The details of charges fees for coaching & booking of facilities of CCSCSB is at Annex.

4.The Department of Personnel & Training will provide the following facilities of Sports Authority of India for use by Central Government Employees, their families and dependants at the charges and time mentioned against each w.e.f. 8th June 2016:-

7th Pay Commission News – Wanton Inaction on the part of Govt – Staff Side to proceed with Strike from 11th July 2016 – NJCA instructs all field organisations to serve strike notice on 9th June 2016.

As proposed, the constituent members of NJCA, the joint body of all staff side Associations, met on 3rd June to discuss on the next course of action after Staff Side could not put forth their demands and suggestions before Govt relating to certain anti-employee recommendations of the 7th Pay Commission. NJCA further feels that 7th Pay Commission recommendations should be implemented only after proper negotiations with staff side.

Now, NJCA is of the of the view that there is no possibility for deferring the stike plan as Govt is not willing to talk to Staff Side with regard to 7th Pay Commission report. It has advised on the field organisations to serve the strike notice on 9th June, 2016  to commence the indefinite  strike action on 11th July, 2016.

Dear Comrades,

We hope you must have gone through our communication  dated 26.5.2016 detailing the brief discussions, we had with the Cabinet Secretary. We had, as you are aware, done everything possible at our  end to  bring  about  a negotiated settlement  on the  charter  of  demands, we submitted  to  the Government immediately after the submission of the report by the 7th Central Pay Commission. i.e. on is” November, 2015.   On 19th  May, 2016,  we have crossed the six months period since the Commission submitted  the  report to the Government.    You are aware that  the Commission had concluded their deliberations  and  prepared  their  report  in  Feb. 2015, itself  but  was delayed  by the  unwarranted intervention  of the present Government.   Even on the first occasion when we met the authorities  after the submission of the report by the 7th Pay Commission we had conveyed the anguish and anxiety of the employees over the delay especially in the background of the denial of the interim relief and merger of DA. We had pointed out that unlike in the past the employees had not been granted any financial help in the  form of interim  relief or DA merger even in the face of the unprecedented erosion of the real value of wage due to the high level of inflation in the economy.  We had then requested the Government the need to take  an expeditious  decision over the  recommendations  of the  7th   CPC, at-least  on the core issues pertaining to wage revision.



In the absence of any formal meetings or fruitful  negotiations which had been the practice at all earlier occasions,  the rumour  mongers who represent none, had a field day.  The NJCA had been in constant touch with the authorities.   You will recall that at the request of the Cabinet Secretary, when we met him on 1st March, 2016,  we deferred our decision to go on strike in April, 2016.  The empowered Committee set up by the government  could have met the JCA leaders during the months of April and May  and could  have discussed  the  various  pros and cons so that  by the  end of May,  certain  views  could have emerged  on all matters.

It was in this  background   that  the  National  JCA met  on 3rd  at the Staff Side office.  The meeting considered the piquant  situation  that  has emerged due to  the  wanton  inaction  on the  part  of the Government,  despite the NJCA agreeing to defer the strike action.  The meeting, therefore, came to the inescapable and inevitable  conclusion unanimously that  in the  face of the  nugatory  attitude  of the Government, we must adhere to our earlier decision to tread the path of struggle and serve the strike notice on 9th June, 2016  to commence the indefinite  strike action on 11th July, 2016.   The meeting also decided to exhort the constituent  organizations to mobilize their  members without  losing any time as the time available for preparation being very short  i.e. hardly a month.  I am also to convey to all of you the following  decision taken at the meeting and appeal to you to create a vibrant situation throughout the country to convey the impression to all concerned that we  stand united with determination.

1.    Every Association/Federation/Union  and all its units will serve the strike notice  on 9.6.2016 by holding massive demonstration  at all work  places.  The strike notice shall have the 11 point charter of demands (copy enclosed) and the respective organizations can include their department-specific  demands as Part B of the  charter of demands.

2.   The Constituents will plan and execute a massive mobilization  campaign to cover each and every employee/worker  in which all the National and State leaders must take part.

3.   The Unions/Federation/Associations  will suspend immediately all ongoing negotiations with their departmental  heads/authorities and concentrate on the mobilization campaign.

4.    On 24th June, 2016,  a massive united demonstration  under the auspices of the NJCAwill be held before the Parliament.  The constituent  organizations will decide upon the quota for each State Unit and communicate the same so that the state units can take necessary steps to ensure that their members reach Delhi on 24th.

5.   The NJCA(CHQ) will write to the leaders of all the Political parties as also the Central Trade Unions seeks their support and solidarity as also explaining as to why the NJCAhad to take the extreme step of organizing the strike action.

6.   All the Constituent organizations and the State Units shall write such letters to the members of Parliament of their  respective States and shall make efforts to meet them  in person  to seek their support.

7.    All the  State  Units  of the  Constituent   organizations   either  jointly   or  independently    organize Press Conferences  to cover the  Print  and Electronic  media.

8.    The  NJCA(CHQ) will  hold  such a Press Conference   at  Delhi  on  23rd  June, 2016 l.e. just one day prior to the mammoth demonstration  planned before the Parliament.

9.   The Constituent  organizations will  get  in touch  with  the  Associations/Federations  of the retired  personnel both at the All India and State levels to  seek out their  support  for  the strike action and enlist their participation  in all demonstrative  programmes organized by the working employees in support of the strike.  The Pensioners organizations may be informed of the Government decision to reject the recommendation  of the ih CPCto provide Option No.1 to the Pensioners as an alternative pension fitment  formula.

10. The constituents  will also seek the  participation  of those organizations in their  respective organizations  who  are not  associated with  the  NJCA being not  participants  in the  JCM Scheme.

We  appeal to  all  constituents  and through  them  each and  every  member  of  the  Central Government  employee’s community  to take all out  efforts  to  make this historic decision an all time memorable event, which must go into the history as the largest participated strike action of the Central Government employees and workers. We must consider this as a really historic moment  provided to us by the harsh turn of events and as an opportunity  to reassert our strength, unity and determination  not only to win laurels today but to function as an effective bargaining entity for years to come.

We are fully aware of the enormous task ahead and equally aware of the possible response, a brutal  Government  might  take  in  the  circumstances.   Without   minimizing  the  impact  of  such as retaliatory  action on the part of the Government (from our experience in the past) we  know that  no power on earth will be able to subdue  our unity and determination  and we shall march forward  well realizing that the ultimate victory in all struggles belong to the working class.

 Charter of  Demands

1.   Settle  the  issues raised  by the  NJCA on the  recommendations    of the  7 CPC sent  to Cabinet  Secretary  vide letter  dated  10th December  2015.

2.   Remove  the   injustice   done   in  the   assignment   of  pay  scales  to  technical/safety categories   etc.  in  Railways &   Defence,   different    categories   in  other   Central   Govt establishments by the 7 CPC.

3.   Scrap the  PFRDA Act and NPS and grant  Pension/family    Pension to  all CG employees under  CCS(Pension)  Rules, 1972 & Railways Pension Rules, 1993.

4.   i) No privatization /outsourcing /contractorisation of governmental   functions.

    ii)  Treat   GDS as Civil  Servants   and  extend   proportional     benefit   on  pension   and allowances  to the GDS.

5.   No FDI in Railways  & Defence;  No corporatization of  Defence  Production   Units  and Postal Department.

6.   Fill up all vacant  posts  in the  government    departments,    lift  the  ban  on creation   of posts; regularize  the casual / contract   workers.

7.   Remove ceiling on compassionate   ground  appointments.

8.   Extend  the   benefit   of  Bonus  Act,1965   amendment    on  enhancement    of  payment ceiling  to  the  adhoc  Bonus / PLB  of  Central  Government   employees  with  effect  from the  Financial year 2014-15.

9.   Ensure Five promotions in the  service career  of an employee.

10. Do not amend    Labour  Laws in the  name of Labour  Reforms  which  will  take  away the existing  benefits  to the workers.

 11. Revive JCM functioning   at all levels.

7th Pay Commission: Central government employees to serve strike notice on June 9 for better pay hike

New Delhi: Central government employees have decided to go on an indefinite strike from July 11, for which they will serve strike notices to their respective departments on June 9 for getting a better pay hike as 7th Pay Commission award.

Chairman of the National Joint Council for Action (NJAC) for all central government employees M Raghavaiah, who is also the General Secretary of the National Federation of Indian Railwaymen (NFIR) – said the government’s response to the charter of demands submitted by the trade unions in December 2015 was disappointing and casual.

“Consequently, the organizations of the central government employees – Railways, Defence, Postal, Income Tax, Central Customs and Central Excise etc – whose number is over 32 lakh, have taken unanimous decision on 3 June 2016 to go on indefinite strike from 11 July 2016,” NFIR said in a statement.

The Central government employees unions have been demanding a minimum salary of Rs 26,000 as against Rs 18,000 recommended by the 7th Pay Commission.

The Finance Ministry sources confirmed that the Empowered Committee of Secretaries, who is processing the recommendations of the 7th Pay Commission, is likely to propose a minimum salary Rs 21,000 per month.

The vice-president of NFIR J G Mahurkar said, “We have asked the government to raise the minimum salary to 26,000. But the government is now willing to increase the minimum salary to Rs 21,000.”
The trade unions’ also demanded to scrap the New Pension Scheme and to restore old pension rules for all central government employees who join since 2004.

The Empowered Committee of Secretaries is going to scrutinise recommendations of the 7th Pay Commission on June 11 finally to make government able to announce the 7th Pay Commission award to implement from July 1, Finance Ministry official said.

“Hence trade unions’ adopted pressure tactics for implementation 7th pay commission soon, so they will serve strike notice on June 9 before the Empowered Committee of Secretaries’ final meeting,” the Finance Ministry official added.

The employees have warned in the notice to go on an indefinite strike from July 11, earlier the strike was to be held on April 11.

Mahurkar also said, “April 11 strike was called off as the railway minister had sought time to work out a compromise.”

Centre to government officials: Don’t use smartphones, foil hackers

Concern over hacking and data thefts and vulnerabilities in communication systems has prompted the centre to instruct officials in all central ministries and departments to use smartphones only as a last resort and in emergency situations to discuss sensitive official work.

Odd as the “restrictions” on use of smartphones may sound in a wireless world, a recent two-day session on cyber security in government offices saw ministry of home affairs (MHA) and central paramilitary brass being asked to stick to face-to-face meetings, RAX (a closed communication network connecting government offices) and landlines.

The officers were sensitised that smartphone is a far less secure device when it comes to dealing with official work due to the risk of embedded malware or spyware that may be downloaded along with certain applications and that these instruments are best avoided when discussing classified information.
The instructions have been reiterated not only for establishment pertaining to the MHA but also defence, external affairs and other sensitive ministries.

“Though it is largely home and defence ministries that routinely handle matters that can directly impinge on national security, the norms for avoiding use of smartphones to process and relay sensitive information will apply to all government departments,” said an officer.

Hacking is a major threat to cyber systems and networks used in government offices not only in India but across the world. There have been several cases of Chinese and Pakistani hackers breaking into government of India websites, besides gaining access to official data.

Internationally, many hacking attacks are known to originate from China, Russia, the US, Iran, Israel and even North Korea.

India has faced a consistently high level of cyber threat from Chinese hackers, many being students of technical institutes working with official blessings, whose targets range from government offices, commercial enterprises to admission lists in Army public schools.

he threat of hacking and data-theft is seen as even more serious now, given the Modi regime’s push for ‘Digital India’ that requires most government services and transactions to go online.

As per latest instructions on “prudent use of smartphones” shared with sensitive government departments, employees have been told not to connect their smartphones to office computers, including for charging. Also, there is a thinking that voice-calls meant for official work should be made using only landline phones.

It is announced for general information that during the year 2016-2017, accumulations at the credit of subscribers to the General Provident Fund and other similar funds shall carry interest at the rate of 8.1% (Eight point one per cent) w.e.f. 1st April, 2016 to 30th June, 2016. This rate will be in force w.e.f. 1st April, 2016. The funds concerned are:-

 The emails were allegedly sent to government officials from timesofindiaa.in, a fake news domain registered by the attackers.

Days after Kaspersky claimed Indian government sites were compromised by a cyberespionage group, cybersecurity firm FireEye, Inc has claimed that a fake news website was used to sent spear phishing emails to Indian government officials as part of cyber attacks by a suspected Pakistan-based group.

“On May 18, 2016 the group registered a fake news website and sent spear phishing emails to Indian government officials. The emails referenced the Indian Government’s 7th Central Pay Commission, a topic of interest among officials,”a blog posted by the company claimed.

“There’s no silver bullet to fend off advanced cyber attacks. It’s critical for Indian organisations to bring together the technology, expertise and threat intelligence necessary to quickly detect and respond to these attacks,” said Bryce Boland, Chief Technology Officer for Asia Pacific at FireEye.

The company claimed the emails were sent to government officials from timesofindiaa.in, a fake news domain registered by the attackers. The emails has a malicious Microsoft Word document attached, requesting the recipient to open it.

FireEye said the attachment was designed to create a backdoor called the Breach Remote Administration Tool (BreachRAT)” and said it has not observed this malicious tool being used by these threat actors before. “It allows the attacks to download and run new programs, upload files from the victims’ systems to the attackers’ servers, and a variety of other functions.

The suspected Pakistan-based threat group has been active for several years, conducting suspected intelligence collection operations against South Asian political and military targets, claimed FireEye. “The group is the same that FireEye revealed in March 2016 to have conducted cyber attacks against Indian targets and Pakistani dissidents since 2013. They were observed using malicious documents hosted on websites about the Indian Army, instead of sending these documents directly as an email attachment,”the post claimed, adding that infrastructure used by the group is the same in both attacks.

Sub: VII Central Pay Commission recommendations- Submission to the empowered Committee Secretaries- reg.

1. Bharat Pensioners Samaj (BPS) Federation of pensioners’ associations, a conglomerate of over 628 pensioners’ organizations as an accredited Federation under the Government of India, had appealed to the Secretary, Ministry of personnel, Public Grievances and Pensions, on 16.2.2016 during the meeting on Aadhar seeding to hold a meeting of Pensioners Associations to discuss 7th CPS pension related recommendations, though he had agreed to hold such a meeting but it did not materialize.

2. Now BPS has come to know through NJCA News letter dated 27.5.2016 issued after their meeting with you on 26.5.2016that the Department of Pension is opposed to the first option recommended by the 7th CPC to bring about the parity with the past pensioners, as they consider it to be infeasible and impracticable (due to the non-availability of the requisite records)

3. It is hard to believe, how a department meant for the welfare of pensioners which helped pensioners to get better deal in earlier pay commissions could arrive at such a damaging and misleading decision without even consulting the stake holders.

4. Sir, Service record is a permanent one and if it to be destroyed, proper permission from the Competent Authority is to be obtained. In any case, service record of pensioners can always be reconstructed taking the details from various sources available with the department and the material collected from the Pensioner. This has been done in the past while implementing parity enunciated by fifth CPC and even while implementing modified parity of 6th CPC. It is also being done now implementing OROP. In this regard Your kind attention is also drawn to recent Bombay High court Nagpur judgement dated 09.03.2015 in case of Smt. Saija v. General Manager, Central Railway O.A.No. 2131 of 2011 (Bombay Bench at Nagpur)
Undersigned in the capacity of Secy. Genl ‘Bharat Pensioners Samaj’ request you to takean independent decision in view of submission in Para 4 above to save pensioners/family pensioners from unprecedented permanent damage by a department meant for their welfare.
