OFFICE MEMORANDUM

Sub:- Payment of TRCA on Sundays /Holidays to the GDS working against Leave vacancies/Vacant posts in Postman/ Mail Guard /MTS Cadre.

In the present set up, Gramin Dak Sevaks are working against the leave vacancy /vacant posts of Postman /Mail Guard /MTS Cadre in departmental Post Offices. As per Directorate order no. 47-19/90-SPB-II dated 23.04.1992 regarding grant of paid National Holidays to GDS employees when appointed against the Postman/ Mail Guard/MTS Cadre against leave vacancy/vacant posts, these GDS are getting salary for Sunday if they continuously works for 6 days. Similarly, GDS are also getting 3 National Holidays if it falls on working day, provided he/she works on both the preceding/succeeding working days to the National Holidays. However, no extra payment on account of National Holidays will be made to persons working substitutes of GDS in view of fact that payment of remuneration to GDS is made on monthly basis.

2. Similarly, GDS substituting in leave vacancy/Vacant posts of Postman / Mail Guard / MTS Cadre are deprived of Productivity Linked Bonus for the period of officiating as Postman/ MTS is on the pretext that they are on Leave Without Allowance.

GDS: Maximum 5 Days Emergency Leave for Gramin Dak Sevaks

3. For substitutes, as per As per Directorate orders vide no.17-07/2019-GDS dated 09.10.2019, substitutes of GDS who have worked in leave vacancies/ Vacant Post in Postman/ Mail Guard /MTS Cadre are also paid on the basis of minimum of revised TRCA level of that post of GDS.
4. In view of above, in supersession of this office memo of even no. dated 23.10.2019, following orders are issued with the approval of the Competent Authority:-

  • Gramin Dak Sevaks when appointed against the leave vacancy/vacant post of regular Postman/MTS, these GDS will get salary for all the Postal Holidays if the Postal Holidays falls on working day, provided he/she works on both the preceding/succeeding working days to the Postal Holidays. However, no extra payment on account of Postal Holidays will be made to persons working substitutes of GDS in view of fact that payment of remuneration to GDS is made on monthly basis.
  • GDS are when appointed against the leave vacancy / vacant post of regular Postman/ MTS, have to apply for leave without allowance as GDS. There is a difference in Leave Without Allowance for personal reasons and Leave Without Allowance for officiating as Postman/MTS. In this case, the GDS is on official duty and is contributing to the productivity. Hence GDS while on LWA for official duty, there is no question of deducting this period for PLB.

In exercise of the powers conferred by sub-section (1) of section 59 of Lokpal and Lokayuktas Act, 2013, the President hereby makes the following rules for Group 'C' Multi Tasking Staff posts in the Lokpal, namely:-

1. Short title and commencement - (1) These rules may be called the Lokpal (Group 'C' PostsMulti Tasking Staff) Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.

2. Power of Lokpal to make Regulations.
The Central Government hereby vests powers in the Lokpal to make Regulations for the recruitment process.
Provided such recruitment shall be made on the recommendation of the Personnel Committee to be constituted by the Chairperson Lokpal and the said Committee shall be chaired by the Secretary, Lokpal or any other Officer of the Lokpal as authorized by him and shall have at least three Members.

3. Number of post, classification, Pay level in the Pay Matrix:-- The number of post, its classification, the pay level or pay scale attached thereto shall be as specified in columns (1) to (4) of the Schedule annexed to these rules.

4. Method of recruitment, age-limit, qualifications, etc. - The method of recruitment to the said post, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification -- No person, --
  • (a) who has entered into or contracted a marriage with a person having a spouse living; or
  • (b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Savings - Nothing in these rules shall affect reservations, relaxations of age limit and other concessions required to be provided for the Schedule Castes, the Scheduled Tribes, other backward classes, ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

I would like to brought this to the kind notice of the Secretary, Department of Posts that after implementation of new TRCA to the GDS vide order dated 25-06-2018, all regularly working GDS have been dawn new TRCA w.e.f 01-07-2018. In case of substitutes working in place of GDS viz., vacant posts. officiating to Departmental posts (Postman/MTS/MG) and on other reasons has not drawn their allowances as per new TRCA slabs w.e.f 01-07-2018.

Further it is requested to issue the instructions to draw the arrears also from 01-01-2016 to 30- 06-2018 to the substitutes working in place of GDS. As it was drawn also at the time of implementation of Natarajamurty Committee recommendations vide Lr.No. No.6-1/2009-PE.II, Dated : 30-05-2012.

Hence it is requesting our Hon’ble Secretary. Department of Posts kindly cause to issue necessary instructions to the concerning authorities on the subject at the earliest in favour of GDS.

DOPT trying best to clear backlog of promotions: Dr Jitendra Singh

The Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr. Jitendra Singh said that the Department of Personnel & Training (DoPT) is trying its best to clear the backlog of promotions which had accumulated for several years. He said, while the Government led by the Prime Minister Shri Narendra Modi follows a policy of zero tolerance towards corrupt and non-performing officers, at the same time it is also supportive towards performing officers of integrity.

Dr Jitendra Singh was responding to a delegation of Central Secretariat employees who called on him here today and sought his intervention for timely promotion of lower grade staff members. They also submitted a memorandum on behalf the Central Secretariat MTS Association, wherein it was submitted that many of the lowermost working professionals in the Government of India get deprived of even single promotion during their entire service tenure.

Dr Jitendra Singh said, in order to bring in the ease of governance as well as objectivity in empanelments, the government has, in the last three years, improvised upon the procedures so as to ensure that there are no subjective preferences involved in carrying out the promotions. The procedures have been made more hi-tech using sophisticated technology tools to minimize the human interface, he added.

He said that in the past, every government took credit for bringing in a new legislation or rule while this government has done away with nearly 1500 rules which were either obsolete or had become irrelevant with the passage of time. All this is meant not only to ensure effective and timely delivery of outcomes for the public, but also to enable the employees to perform to the best of their ability, he added.

Dr Jitendra Singh said, he himself personally feels disturbed to come across cases where some of the employees working in the lowest rung of administration spend their entire service tenure of 30 to 35 years without securing a single promotion. He said, he has discussed the issue with all the senior officers in the Ministry and several innovative means are being evolved to avoid stagnation at middle and lower rungs of administration.

Dr Jitendra Singh also regretted that in a large number of cases, stagnation in promotions was the result of litigation amongst the employees themselves and even though the DoPT tries its best to put forward its view in the court of law, the delay becomes inevitable.

Sub :- Remuneration to be paid to the Gramin Dak Sevaks engaged as substitutes in short term vacancies of Postmen/Mail Guards and MTS.

1 , Attention is invited to this Directorate OM of even number dated 26.04.2017 vide which rate of remuneration of the Gramin Dak Sevaks engaged as substitutes in short term department vacancies of Postmen, Mail Guards and MTS was issued. In this context, references are being received from Service Unions that the words "In future" and "with effect from 01.01.2016" in the Para 3 of the said OM dated 26.04.2017 give different impression over date of implementation of the instructions and has requested to issue clarification.

2. The matter has, further, been examined in this Directorate in the light of the approval of Department of Expenditure, Ministry of Finance and it is clarified that the orders contained in the ibid OM dated 26.04.2017 (copy attached) are to be implemented w.e.f. 01.01.2016.

Consequent upon the implementation of the Seventh Pay Commission's recommendations, the matter regarding the rates of remuneration payable to Gramin Dak Sevaks engaged as substitutes in short term departmental vacancies of Postmen/Mail Guards and MTS has been reviewed.

2. It has now been decided that the remuneration of the Gramin Dak Sevaks engaged as substitutes in short term departmental vacancies of Postmen, Mail Guards and MTS may be calculated on the basis of the minimum pay of the respective levels of the pay matrix in whiCh the substitute is engaged as defined in the CCS (Revised Pay) Rules 2016 and as mentioned in Table below:

The Prasar Bharati (PB), a statutory autonomous body established under the Prasar Bharati (Broadcasting Corporation of India) Act 1990, comprising of All India Radio & Doordarshan, invites applications from Indian Nationals for Multi-Tasking Staff (MTS) (Non-Technical) under Special Recruitment Drive for Persons with Disabilities (PWD) for Doordarshan Kendras. 1.2. Definition of Disabilities (As per DOPT OM No. 36035/3/2004-Estt. (Res) dated 29th December, 2005).

VH : Visually Handicapped
Blindness: "Blindness" refers to a condition where a person suffers from any of the following conditions, namely:
(i) Total absence of sight; or
(ii) Visual acuity not exceeding 6/60 or 20/200 (Snellen) in the better eye with correcting lenses; or
(iii) Limitation of the field of vision subtending an angle of 20 degree or worse;

Low Vision: "Person with Low Vision" means a person with impairment of visual functioning even after treatment or standard refractive correction but who uses or is potentially capable of using vision for the planning or execution of the tasking with appropriate assistive device.

HH : Hearing Impaired - (Persons suffering from Hearing Impairment). "Hearing Impairment" means loss of sixty decibels or more in the better ear in the conversational range of frequencies.

OH : Orthopedically Handicapped: "Locomotor disability" means disability of the bones, joints or muscles leading to substantial restriction of the movement of the limbs or any form of cerebral palsy.

NOTE: Candidates would produce valid original medical certificate of disability issued on or before 23.01.2017 from Medical Board duly constituted by central or state Government at the time of joining.

While applying candidate has to select only ONE Doordarshan Kendra for which he/she wants his/her candidature to be considered.

Note: Candidate will be eligible for chosen Doordarshan Kendra ONLY and will not be considered for the other Doordarshan Kendra. For example, if a candidate chooses Doordarshan Kendra "Delhi", he/she will not be selected for Doordarshan Kendra Shimla even if he/she is above in merit from the candidate who has chosen Doordarshan Kendra Shimla.

2. SCHEME OF EXAMINATION AND SYLLABUS:

OFFICE MEMORANDUM
Subject: Recruitment to Multi Tasking Staff in Pay Band-1, with Grade Pay of Rs.1800/– Sending of requisition to Staff Selection Commission.

This Department vide OM of even number dated 12.5.2010 and reiterated vide OM dated 21st October, 2013 had issued instructions to all the Ministries/Departments that they have to intimate their requirements for Multi Tasking Staff (Non-Technical) in PB-1 Grade Pay Rs.1800/- to the Staff Selection Commission.

The Ministries/Departments were also advised to take action simultaneously for framing Recruitment Rules for these posts in accordance with the Model RRs already circulated vide OM dated 30.4.2010.

2. It is once again reiterated that the posts of MTS are required to be filled up only through SSC as per the instructions of this Department. All Ministries/Departments may send their requirements as well as the requirements of their attached/subordinate offices also, for MTS ( PB-1 Grade Pay Rs.1800/-) to the Staff Selection Commission so that the Commission could initiate action for recruitment. The Staff Selection Commission is likely to issue advertisement on 1.8.2015.

3. Action pending, if any, may simultaneously be taken for framing of Recruitment Rules for these posts in accordance with the Model Recruitment Rules already circulated.

LDC/UDC ISSUE : Going through the comments of the viewers!

Dear friends,

More than two dozen comments have been posted on the JCM Staff Side memorandum, recommending upgradation of Grade Pay of LDC, published in this web site. Most of the LDCs working in various Departments, posted comments are stated that they are doing duties of higher posts with Rs. 1900 Grade pay. A person who is working in the KVS has written that in his Organization LDCs are doing duties of UDC and LDC both because in maximum offices single LDCs are posted and they are compelled to complete the work by sitting extra time. (Our opinion is that the Staff Associations of the KVS should demand for increased sanction of Administrative Staff in accordance with the work load and also for an immediate cadre restructuring for the Administrative Staff. According to the recommendations of the Central Pay Commissions cadre restructuring should be done in every five years).

It is no doubt that LDC & UDC are the backbone of the Government Offices especially the subordinate offices and they should get a respectable pay scale. Since the 6th Pay Commission has raised the Educational and technical qualification for the post it has become an anomaly and that is why this Association has taken up the issue to the higher authorities and as such the issue gained popularity. Resultantly, Confederation and JCM Staff Side was forced to recommend upgraded grade pay for LDCs in their Memorandum to the 7th Pay Commission. Moreover, Department of Expenditure was compelled to issue a common circular for upgradation of Grade Pay of LDC & UDC at Department level through restructuring. But the said order was not adequate to meet the demand and as such we have filed a case in CAT Jabalpur. Some of our friends proposed to take up the issue to the Prime Minister & Finance Minister again. Several of our friends writing comments have proposed to call a strike on the issue of upgradation of the Grade Pay of LDC & UDC. Both are not the demand of the time, I think. As regards to writing letter to Prime Minister, we had already written a letter to the then Prime Minister and same was forwarded to the DoPT and what action has been taken on it by the DoPT, JCA & Ministry of Finance, all are before us. If we sent another letter to the present Prime Minister it will also go through the routs in which our previous letter was travelled. As regards the calling of strike it is only possible when there is a Federation of Ministerial Staff Association representing the entire Ministerial Staff persists and taking a decision unanimously. You all are aware that I had requested all our friends to come to Delhi in support of the Confederation Dharna on 9th January 2014 so that we may put up the issue effectively before the Confederation. But nobody except some leaders of Delhi State Government Administrative Staff Association has come to attend the Dharna. Thus conducting a strike, even a Department level strike, is not as easy as the comment writers think.

Some of our friends have written that large number of posts of LDC & UDCs are lying vacant in their Department and is not filling up the vacancy by the authorities. This should be tackled at their Department level itself. Staff Associations of the respective Department should take initiative for the same.

As regards the case filed by us in the CAT Jabalpur, we have filed the same with an intention to send a message regarding the seriousness of the issue to the Government, 7th Pay Commission and the JCM Staff Side. As a result JCM Staff Side has discussed the matter and accordingly the recommendation for the upgradation of the Grade Pay of LDC has been sent to the Pay Commission. In order to defend the payment of Rs. 2400 Grade Pay to DEO, DoPT has recently issued a revised model recruitment rule for the DEO. And yet, I am sure, 7th Pay Commission will definitely consider the upgradation of Grade Pay of LDC in its report. The case filed in the CAT Jabalpur will go on for a favorable decision so as to get the upgraded Grade Pay to LDC w.e.f. 1.1.2006.

As regards granting of Rs. 4200 Grade Pay to UDCs, all Associations are requested to send the proposal in their memoranda to the 7th Pay Commission on the ground that UDCs are assigned with the duties of Assistants in most of the subordinate offices as the sanctioned posts of Assistants in these offices is far less than the actual requirement.

Confederation’s Memorandum to 7th CPC:
Confederation has proposed to submit a separate Memorandum to 7th Pay Commission. Even though the LDC & UDC issue, submitted by us have been incorporated in the JCM Staff Side Memorandum, any Association is willing to put up anything new regarding to the upgradation of the LDC/UDC and issues related to other administrative Staff and the cadres of common category including MTS may please send their proposal to the Confederation in the following e-mail id by 14th of this month.
