Subject : “Raksha Mantri Awards for Excellence” for the year 2019. Please find enclosed a detailed “Motivation Scheme for the Defence Accounts Department” for the Year 2019.

The process of selecting awardees for the year 2019 at the level of Principal Controllers/Controllers etc. may be completed by 28th June, 2019. For “Raksha Mantri Awards for Excellence” to be decided by the CGDA, nominations may be forwarded in the prescribed format, in both soft and hard copy form (3 copies) and mailed on the email Id atcoord.cgda@gov.in latest by 15th July, 2019 (should reach HOrs. Office). Citation/write up of project/work done (not more than 100 words), two passport size photographs, bio data (not more than 100 words) and a write up in bullet form (not more than 50 words) in respect of each nominee/team may also be forwarded.

It is further requested that the time schedule prescribed above may kindly be strictly adhered to; failing which, it may not be possible to consider the nominations received after the closing date.
The detailed guidelines of the scheme may be given wide publicity and placed on websites etc. The scheme has also been placed on the CGDA’s website at www.cgda,nic.in. The expenditure on the scheme would be made from the DAD-Pay and Allowances head.

Sub : Admissibility of Free Sea Passage to Service Personnel

The case regard admissibility of free sea passage to service personnel at A&N islands was referred to MOD for Clarification. The MOD vide ID Note No.10(8)/2014-D(Mov) dt.22.4.2016 and 7.3.2018 has clarified the LTC/Concession entitlement of the service personnel posted at A & N group of Islands as under:

Service Personnel posted in A &N Islands are entitled for the following LTC/concessions as per various orders:
i. Normal LTC under provisions of Rue 177(A/B) and 184 of Travel Regulations.

ii. In addition they are entitled to one additional free passage including sea passage to their SPR/Hometown in terms of GoI MOD letter No.5(30/07/D(Mov) dt.28th April 2010. This has been incorporated under Rule 177© of Travel regulations (2014 edition)

iii. As per GoI MoD letter No.67669/AC/PS 3(a) /1613 /D(Pay/Services) dated 13th March 1973 service personnel and their families are entitled free sea passage appropriate class once a year to Kolkatta/Chennai & back in addition to LTC
LTC/concessions / Sea Passage claims of service personnel posted at A &N group of Islands may be dealt with accordingly.

Subject : Fixation of Pay and grant of increment in revised pay structure clarification - regarding.

The matter regarding fixation of pay under 7th CPC in respect of employees promoted between 1st day of January and the date of notification of CCS(RP)Rules 2016 and methodology to be adopted in such cases has already been furnished by HQrs vide letter bearing No. AN/XIV/14164/7th CPC/Corr/Vol-I dated 8.09.2016. Further, on receipt of Dept of Expenditure OM dated 29.09.2016 , the same was circulated to all controllers for necessary action regarding re fixation of pay in such cases. Also , references on above subject received from Controllers was suitably replied in the light of above orders.

2. Of late, this HQrs has been receiving various references regarding application of the orders issued by AT-II Section of this office vide their letter No. AT/II/2703/Clar dated 28.04.2017 thereby seeking clarification regarding availability of option to switch over to 7th CPC from 07/2016 in cases where the official has been promoted between 1st January 2016 and the date of notification.

3. The matter was referred to MoD(Fin.) DAD Coord for taking up the matter with Ministry of Finance (Dept. of Expenditure) for issuing necessary clarification in this regard.

4. In reply, Ministry of Finance, Department of Expenditure vide their No. 300346981 dated 14.09.2017 received under MoD(Fin) ID No. 1333/C/2017 dated 18.09.2017 have clarified that -“the option to switch over to the revised pay structure either on 01.01.2016 or the date of next increment is applicable under Rule 5 of CCS(RP)Rules 2016 in case of post held on 01.01.2016.

Sub: Instruction regarding overpayment in r/o of TA/DA on account of Temporary Duty/Tour.

During the inspection of one of the controller office by the inspection team of HQrs Office it has come to the notice of inspection team that the Daily Allowance on Tour/Temporary Duty has been admitted and paid , in excess of rates i.e 25% over and above entitled rates when the official opted for old rate as prescribed in GoI, MF OM 10/2/98-IC & 19030/2/97-E.IV Dt.17/04/1998, resulting in Overpayment. In this Context attention is also drawn to this HQrs office letter No.AN/XIV/14162/6th CPC/Corr/Vol-XII dt 24.11.11 under which it was clarified that the enhancement of rates of various allowances by 25% when DA goes up by 50% is applicable to the rates mentioned in 6th CPC letter No:19030/3/2008-E.IV dt. 23.09.2008

2. Non Compliance of orders on the subject has been viewed with concern by the Competent Authority and has directed to review all the TA/DA claims on account of TD/Tour in respect of your as well as subordinate offices under your Organization. Any overpayments detected may be recovered immediately as per extant orders and corrective action for regulating such irregularities may also be taken.

A reference was received from Directorate General of Signals seeking clarification on the following points:-
(a) whether married sister can be considered for compassionate appointment? and,
(b) whether dependents of the deceased Armed Forces personnel who committed suicide can be considered for compassionate appointment?

2.The matter has been examined in this Ministry in consultation with Department of Personnel & Training. It is clarified that
(a) A married sister in the case of unmarried Government servant or member of the Armed Forces can also be considered for compassionate appointment, subject to the conditions that-
(i) she was wholly dependent on the Government servant at the time of his/her death in harness or retirement on medical grounds.
(ii) she must support other dependent members of the family.
(b) The dependent family member of Armed Force personnel who has committed suicide may also be considered for compassionate appointment.

A reference was received from MGO Branch through D(O-II) Section seeking clarification regarding inclusion of dependent divorced daughter as ‘Dependent Family Member’ for allocation of points as well as for appointment on compassionate appointment.

2.It is stated that the matter has been examined in this Ministry in consultation with Department of Personnel & Training. It is clarified that a divorced daughter may be considered as a dependent family member of the deceased Government servant for compassionate appointment and also for the purpose of allocation of points, subject to the conditions that-

(i) she was wholly dependent on the Government servant at the time of his/her death in harness or retirement on medical grounds; and
(ii) she must support other dependent members of the family.

Reference: This HQrs letter bearing No. AN/XIII / 13700(435)/2015 dated 02.09.2015.

It has been observed that certain Government servants are representing directly or through their relatives etc. on service matters to the Prime Minister, Minister, Secretary and other higher authorities.

2. As per existing instructions, wherever, in any matter connected with his service rights or conditions, a Government servant wishes to press a claim or to seek redressal of a grievance, the proper course for him is to address his immediate official superior, or Head of his office, or such other authority at the appropriate level who is competent to deal with the matter in the organization. Suitable guidelines in the matter have already been issued vide HQrs Office letter cited under reference. (Copy attached)

3. Therefore, it is reiterated that as per DOP&T OM bearing No.11013 / 08 / 2013-Estt. (A-III) dated 31.08.2015 "Such submission of representations directly to other authorities by-passing the prescribed channel of communication, has to be viewed seriously and appropriate disciplinary action should be taken against those who violate these instructions. This can rightly be treated as an unbecoming conduct attracting the provisions of Rule 3(1) (iii) of the CCS (Conduct) Rules,1964. It is clarified that this would include all forms of communication including through e-mails or public grievances portal etc."

4.In view of above all concerned authorities are requested to bring the existing instructions/rules to the notice of all concerned for compliance.

Subject: Admissibility of HRA in case of residing in Govt. Guest House / Transit Facility
Reference: HQrs Office Important Circulars Xo.AX/XVIII/1/18001/GH dated 21.11.200 and AN/XIV/14153/III/HRA/CCA/Vol.-X dated 18.03.2011

Comprehensive guidelines have been issued on the subject vide HQrs Office Important Circular dated 21.11.2000, to regulate the stay of officials at Guest Houses/transit accommodations. Further, HQrs Office Circular dated 18.03.2011 clearly stipulates that those occupying Government accommodation are not eligible for HRA and that the officers staying in the Inspection Quarters/Bungalow etc. in the Headquarters of their posting will not be entitled to draw HRA for the penod during which they stay in the Inspection Quarters/Bungalow etc.

2. Despite this, HQrs office is in receipt of reference from PCDA/CDA asking for clarification on the subject matter.

3. It is therefore, reiterated that those residing in Government accommodation be it Inspection Quarter or Transit Facility or Guest House shall not be granted HRA as stipulated vide GOI, Ministry of Communications, in consultation with Ministry of Finance, vide their letter No.14-4/85-NB dated 26.11.1985. Action may be taken accordingly.

2. In this regard, I have been directed to request that applications of IDAS Officers for any kind of leave including Ex-India leave/ permission to leave the station, should reach this HQrs office well in advance and the officer(s) should ensure that the leave has been sanctioned before leaving the station/proceeding abroad.

Subject: Payment of Dearness Allowance to Armed Forces Officers and Personnel Below Officer Rank including NCs(E) – Revised rates effective. from 1st July, 2015.

Sir,
I am directed to refer to this Ministry letter No.1(2)/2004/D (Pay/Services) dated 16th April, 2015 on the subject cited above and to say tat the President is pleased to decide that the Dearness Allowance payable to Armed Forces Officers and Personnel Below Officer Rank, including Non-Combatants (Enrolled), shall be enhanced from the existing rate of 113% to 119% with effect from 1st July, 2015

2. Tha provisions contained in paras 2, 4 and 5 of this Ministry’s letter No.1(2)/2004/D (Pay/Services) dated 25th September 2008 shall continue to be applicable while regulation Dearness Allowance under these orders.

3. The additional instalment of DA payable under the orders shall be paid in Cash to all Armed Forces Officers/ PBORs including NCs(E).

4.This letter issues with the concurrence of Finance Division of this Ministry vide their Dy. No.330-PA dated 06.10.2015 based an Ministry of Finance (Department of Expenditure)) O.M. No.1/3/2015-E-II (B), dated 23rd September 2015.

Subject: Payment of Dearness Allowance to Armed Forces Officers and Personnel Below Officer Rank including NCs(E) – Revised rates effective from 1st January, 2015.

Sir,

I am directed to refer to this Ministry’s letter No.1(2)/2004/ D (Pay/Services) dated 24th September 2014, on the subject cited above and to say that the President is pleased to decide that the Dearness Allowance payable to Armed Forces Officers and Personnel Below Officer Rank, including Non-Combatants (Enrolled), shall be enhanced from the existing rate of 107% to 113% with effect from 1st January, 2015.

2. The provisions contained in paras 2, 4 and 5 of this Ministry’s letter No. 1(2)/2004/D (Pay/Services) dated 25th September 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.

3. The additional installment of DA payable under these orders shall be paid in cash to all Armed Forces Officers/ PBORs including NCs(E).

4. This letter issues with the concurrence of Finance Division of this Ministry vide their Dy. No. 145-PA dated 16th April, 2015 based on Ministry of Finance (Department of Expenditure) O.M. No.1/2/ 2015-E-II (B), dated 10th April, 2015.
