As already informed to you the meeting of the National Council (JCM) was held on 13/04/2019 under the Chairmanship of the Cabinet Secretary. AIDEF was represented by Comrades C. Srikumar, K.Balakrishnan and R.S.Reddy. After the introductory remark by the Cabinet Secretary the Staff Side raised the following issues:

1. The 47th Meeting of the National Council (ICM) is being Called by the Chairman after a period of 9 years. The last i. e. the 46th meeting of the National Council (JCM) was held on 15 May 2010. Under the JCM Scheme the Ordinary meetings of the National Council shall be held as often as necessary, and not less than once in four months. Special meetings can also be called by the Chairman or on a request from the Staff Side. Unfortunately between 1999 and as on date only 7 meetings are held, which means within a period of 20 years only 7 times the National Council has met. This is a clear proof of violation and dilution of the JCM Scheme. Since the National Council of JCM is not functioning, the Departmental Council JCM’s under the Chairmanship of the Secretaries of the Concerned Departments are also not taking place. Therefore I request the Chairman to take a serious note of the situation and a decision may be taken to hold regular meetings of the National Council, its Standing Committee and also the Departmental Council JCM meetings and the decision may be communicated to all Departments.
   
2. When the JCM Scheme came in to effect from 1966 all the Non- Gazetted employees were allowed to participate in the JCM Scheme. However due to upgradation of various Group C Posts to Group B these categories are now exempted from the JCM Scheme. The Staff Side is demanding for review of the same and to permit all Non Gazetted employees irrespective of their pay should be allowed to participate in the JCM Scheme.
   
3. In the past due to repeated discussions in the National Council JCM, the Cabinet Secretary has written a D.O. Letter to all the Secretaries that before implementing any decisions to privatize, Outsource and closures, downsizing, corporatization, rationalization etc the staff side of the Departmental Council JCM should be consulted and their views may be kept in mind while framing such policy decision. However arbitrary decisions are taken especially by Ministry of Railway’s, Defence, Printing and Stationery, Postal and other departments for privatizing the work being done by permanent employees, closure of many units etc. This has resulted in total Labour unrest and series of agitations are being held including strike action. It is therefore requested that all these activities against the interest of employees may be stopped immediately and the entire issue may be discussed in the Departmental Council JCM meetings with the Staff Side.
   
4. After the submission of the 7th CPC recommendations, the Central Government Employees were very much disappointed and there was an all around dissatisfaction since the 7th CPC has not taken into account the proposals of the Staff Side in determining the minimum pay and corresponding fitment factor. The 7th CPC has also rejected our demand to scrap the NPS implemented for employees recruited on or after 1/1/2004. In this backdrop the National Joint Council of Action of the Central Government employees have issued an Indefinite Strike Notice on the Government. A meeting was convened under the Chairman ship of Hon’ble Home Minister Sh. Rajnath Singh in which other three Senior Ministers including the Finance Minister and Railway Minister were also present. The meeting was held on 30th of June 2016 and based on the assurance given by the senior Ministers that the demands of the Central Government employees would be considered by a high Level committee, the strike was deferred. It is unfortunate that the commitment given to the NJCA was never honored and the discontentment amongst the Central Government employees still prevails. It is therefore urged upon the Government that the commitment of the Group of Ministers may be honoured in letter and spirit and Government may come forward to restore the negotiations with the NJCA for reaching an agreement on the following demands. - a. Enhancement of Minimum Pay and Fitment Factor w.e.f. 1.1.2006 - b. Scraping of NPS and restoration of guaranteed Pension under CCS (Pension) Rules 1972. - c. Option No. 1 recommended by 7th CPC for employees who retired prior to 01/01/2016.
   
5. The Staff Side are repeatedly representing to grant one more option to switch over to 7th CPC pay scale from a date subsequent to 25/07/2016. Even though there is no much financial implication, the Department of Expenditure is not extending the benefit. This issue needs to be considered favourably.
   
6. Inspite of the Government orders for grant of entry pay to the employees promoted on or after 1/1/2006 prescribed for direct recruits in the pay band is not yet implemented in many of the Departments for want of certain clarifications from Department of Expenditure. The issue was discussed in the last Standing Committee meeting and it was assured that necessary clarifications would be issued. However the same has not yet been issued.
   
7. Due to non functioning of JCM and non acceptance of genuine demands of the Central Governments employees there is a multiplicity of litigation on service matters including MACP issues like date of implementation of MACP from 1/1/2006, MACP in promotional hierarchy, Annual Increment to employees retired on 30th June and 31st December etc. In majority of the cases the judgements have gone in favour of the employees and as usual the Government drag the employees up to Supreme Court and even after Establishing the Law on service matters by the Supreme Court the benefits are restricted only to the petitioners. A separate meeting with Staff Side may be held so that the demand for implementation of various Court judgements on service matters can be settled and the number of litigations can be reduced.
   
8. The Defence Industry like Ordnance Factories, DRDO, Units under Army and Navy etc. are under serious attack. The entire policy decision needs to be reconsidered and all these Defence Establishments should be strengthened and developed.
   
9. One time relaxation of LTC-80 cases, where employees have purchased Air Tickets from other than authorized Agents is pending for quite some time. The same may be considered favourably.
   
10. Compassionate Appointment to the wards of employees who dies/medically invalidated on accidents while performing Government duty should be given over and above the 5% quota.
    
11. Outsourcing of permanent Jobs which are being performed by erstwhile Group “D” Employees should be stopped and all the vacancies should be filled up

Decision on Agenda Points/ Points Raised in the meeting

• Judgement of Supreme Court on service matters where policies are involved will be made applicable to all the similarly placed Employees.
• GPF to be introduced to willing NPS employees.
• Government seriously and positively considering the demand of allotment of salary budget separately to Ordnance Factories.
• Stepping up of pay will be permitted in MACP.
• Services of Temporary Status Employees of GSF Cossipore will be regularized.
• Government Orders on Risk Allowance and Night Duty Allowance will be issued soon.
• Relaxation of Educational Qualification for Compassionate Appointment to wife of employees medically boarded out from service would be considered.
• Regarding residency period for promotion from one post to another, the Staff Side should forward a detailed proposal.
• Grant of 90% Medical Advance for conventional diseases would be considered by Ministry of Health.
• Proposal for relaxation of LTC-80 is under consideration.
• Revision of pension to employees those who were compulsorily retired would be considered.
• The provision of “Wherever feasible” given in the Government order for grant of HRA without NAC would be considered.
• 13.Regarding implementation of Arbitration Awards separate meeting would be held with staff side.
• The decision on applicability of CCS (RSA) Rules 1993 to the workers of the Defence Ministry would be taken within a month. 15. The Demand for creation of NFSG grade in cadre of UDC / Stenographers in all offices outside Secretariat is under consideration of the Government.
• Reimbursement of Medical expenditure involved for over stay in the Hospital, because of infection / side effects would be considered by the Ministry of Health.

Subject: Intimation of vacancies in Under Secretary Grade of CSS

The undersigned is directed to refer to this Departments' O.M. of even number dated 04.02.2019 whereby transfer order of 143 Under Secretaries (adhoc) who were initially promoted on "as is where is basis" was issued. So far around 23 officers have not reported to their respective Ministries/Departments where they were ordered to be posted.

2. Meanwhile, preparation is under way for the next round of adhoc promotions in Under Secretary grade. For this, this Department is required to assess the vacancies. Few Ministries/Departments have been reporting vacancies taking into account the current vacancies as well as the vacancies against which Under Secretaries have not reported for duty so far as mentioned in para 1 above. It is clarified that this Department has not cancelled the transfer order of any officers who are yet to join their respective Ministries/ Departments. Therefore, the vacancies remaining unfilled in Ministries/ Departments due to non joining of these officers cannot be filled up by a new incumbent. Simultaneously, the Ministries/Departments from where the officers are yet to be relieved may not adjust them against any subsequent vacancies which have now arisen.

3. All the Ministries/ Departments are requested to account for only those vacancies which have occurred in Under Secretary Grade after 04.02.2019 due to promotion to next higher grade, deputation, retirement etc. and intimate the same to this Department to enable us to fill them up in the fresh exercise of promotion.

The affiliates are advised that the NFIR leaders (President, General Secretary and Joint General Secretary Shri B.C. Sharma) met Railway Board Chairman Shri V.K. Yadav on 11nd April, 2019 and discussed the subjects listed below:-

(a) LARSGESS: Need for granting appointment to the wards of safety category staff selected/medically found fit prior to 27th October, 2017.

CRB’s response: This matter is being pursued on daily basis for finding solution being legal matter wherein Legal Opinion/AG’s Opinion to be obtained for solving the problem.

NFIR however requested to see that Railway Board accords approval for appointment of wards presently waiting with anxiety.

(b) Quasi Administrative Unit Staff: CRB’s attention was invited to NFIR’s note vide No.II/1B/2018 dated 12/03/2019 and requested to see that Railway Board considers absorption of Quasi Administrative Unit Staff in view of the fact that these staff are being appointed by the management headed by Officer of the rank of not lower than JA Grade.

CRB’s response: CRB said that he will look into the matter again.

(c) Metro Railway, Kolkata - granting Zonal Railway status to RPF Department:
NFIR explained that all Departments of Metro Railway, Kolkata are functioning independently under the overall control of General Manager, Metro Railway while the RPF Department of Metro Railway is continued to be part of Eastern Railway and in this context NFIR conveyed that the General Manager, Metro Railway, Kolkata also wrote to Railway Board to accord independent Zonal Railway status to RPF wing of Metro Railway, Kolkata.

CRB has assured to take necessary action for treating RPF Department as independent Zonal Railway Organization under the command of PCSC, Metro Railway, Kolkata and under the overall control of General Manager, Metro Railway.

(d) Deployment of RPF Ministerial Staff to other Departments on option basis as per their request - implementation of the decision arrived at in the Joint Meeting:

NFIR reminded the CRB of its letter dated 11/02/2019 and back round of the case with request to give approval.

CRB said that the papers are with him and matter is under consideration.

The functionality of online voluntary exit was released in the month of August 2017 by Central Record Keeping Agency (CRA) - NSDL e-Governance Infrastructure Limited to smoothen the process of Voluntary Exit under Atal Pension Yojana (APY). However, it has been observed that some POPs and branches of POPs are sending physical exit forms to PFRDA instead of processing through their APY module. This causes delay in execution of voluntary exit, which in turn increases grievances from the subscribers.

In view of the same, POPs are advised - (i) to process voluntary exit request only through their APY module (ii) to sensitize all their branches which are performing Atal Pension Yojana related activities to process voluntary exit as per the guidelines.

The physical forms are NOT to be submitted to PFRDA.

Permanent Commission (PC)

(1) Ministry of Defence has taken steps to ensure implementation of permanent commission to women in the Armed Forces. In so far the Indian Air Force is concerned, all branches, including Fighter Pilots, are now open for women officers. In Navy, all non-sea going branches/cadre/specialization have been opened for induction of women officers through Short Service Commission (SSC). Women officer will be granted PC in the Indian Army in all the ten branches where women are inducted for Short Service Commission.

International Cooperation

(2) A delegation led by Deputy Permanent Secretary for Defence, Thailand visited India on 7th March, 2019 to attend the 7th meeting of India-Thailand Defence Dialogue, co-chaired by Additional Secretary (SC).

(3) A delegation led by Defence Secretary visited United Kingdom to attend the 20th India-UK Defence Consultative Group (DCG) meeting from 7th to 9th March, 2019.

(4) A delegation led by loint Secretary (Planning and International Cooperation) visited Argentina and Chile from 11 th to 15th March, 2019 to discuss defence cooperation issues.

(5) A delegation led by Additional Secretary (SC) visited Australia to attend the 6th meeting oflndia-Austra lia Defence Policy Talks (DPT) from 13th to 15th March, 2019.

(6) A delegation led by Defence Secretary visited Uzbekistan from 25th to 29th March, 2019 and discussed issues related to bilateral defence cooperation.

Acquisition

(7) A contract for procurement of 70 mm Rocket and associated equipment for Advanced Light Helicopter (WSI) in respect of IAF and IA has been signed with M/s Thales, Belgium S.A on 28th March, 2019 at negotiated contract price of Euro 148,500,000 @ 1 Euro = Rs. 70.35 as on 22nd July, 2015.

(8) A contract has been concluded for procurement of 23x3D CID Band Air Surveillance Radar (3D ASRs) amounting to Rs. 1183.53 crore.

(9) A contract for Card Mfg & Personalization & Chip PS Development (RFP-1) for Navy-wide Implementation of RFID based SMART ACCESS Card Project has been signed with Mis BEL Bengaluru on 14th March, 2019 at a total cost of Rs 52.02 crore.

(10) A contract "for Navy-wide Implementation of RFID based SMART ACCESS Card" Project on turnkey basis (RFP-II) was signed with Mis Tech Mahindra Ltd. on 14th March, 2019 at a total cost ofRs. 254.59 crore.

Janaushadhi Diwas

(11) Minister of State for Defence on the occasion of Janaushadhi Diwas inaugurated a Janaushadhi Kendra at Base Hospital in ew Delhi on 7th March, 2019. It will be a pilot Kendra, which is in line with Pradhan Mantri Bharatiya Janaushadhi Pariyojana (PMBJP). Ministry of Defence last year had mandated Janaushadhi Kendras to be empanelled with ECHS as Authorised Local Chemist (ALC) which will benefit the provisioning of medicine at much cheaper rate vis-a-vis market.

Gallantry Awards

(12) President and Supreme Commander of the Indian Armed Forces conferred 05 Kirti Chakras and 30 Shaurya Chakras to Anned Forces Personnel for displaying conspicuous gallantry, indomitable courage and extreme devotion to duty at a solemn ceremony at the Rashtrapati Bhawan on 14th and 19th March, 2019. 04 Kirti Chakras and 03 Shaurya Chakra were given posthumously. The President also conferred 28 Param Vishisht Seva Medals, 03 Uttam Yudh Seva Medals and 51 Ati Vishisht Seva Medals to senior officers of the Armed Forces for distinguished service of an exceptional order.

(13) Interceptor Boat (IB) C-444 & C-446 built by Mis L&T were inducted on 18th March, 2019.
(14) On 22nd March, 2019, Indian Coast Guard Ship (ICGS) Rajveer apprehended one Indonesian fishing boat with 03 crew in position 05 nautical mile south Katchall Island. ICGS Rajveer along with apprehended Indonesian fishing boat entered Port Blair on 25th March, 2019 for further formalities.

Kind attention of Railway Board is invited to Federation's PNM Agenda Item No. 15/2017, proposing grant of 3rd financial upgradation under MACP Scheme to the Station Masters entered in GP 2800 which got merged with GP 4200 / Level-6 w.e.f. 01/01/2016 vide Railway Board's instructions dated 02/08/2016 (RBE No. 93/2016), pursuant to acceptance of 7th CPC recommendation. Federation is however disappointed that the Railway Board has not yet considered for granting GP 5400 / Level-9 as financial upgradation to those Station Masters who have completed 30 years of service.

Federation has however learnt that the Railway Board vide letter No. PC-V/2009/ACP/5/CR dated 11/12/2017 has issued a clarification to the General Manager (P), Central Railway stating that the upgradation of ASM in GP 2800 to the post of SM in GP 4200 has to be counted as promotion for the
purpose of MACPS and therefore the GP 4200 (now Pay Level-6) cannot be treated as entry Grade. This clarification of the Railway Board is totally unjustified due to the fact that the said decision violates policy instructions as mentioned below:-

• The Railway Board have cited Item No. 31 of Board's letter No. PC-V/99/I/1/1 dated,19/02/2002 to deny the benefit. The Federation on going through the contents of Item No. 31 of Board's letter dated, 19/02/2002 found following provision.

"Where all the posts are placed in a higher scale of pay, with or without a change in the designation; without requirement of any new qualification for holding the post in the higher grade, not specified in the Recruitment Rules for the existing post, and without involving any change in responsibilities and duties, then placement of all the incumbents against such upgraded posts is not be treated as promotion/upgradation".

Since the upgradation of ASMs GP 2800 to GP 4200 as SM has been done as a result of acceptance of 7th CPC recommendation by the Government with slight change in the designation but without change in the qualification and any change in responsibilities and duties, therefore, the placement of all such incumbents against the upgraded posts cannot be treated as promotion / upgradation.

• Federation fur1her desires to clarify that the later part of the conditions mentioned against Item No.31 are not at all relevant to the case of Station Master category.
• Further in Board's letter dated 02/08/2016 (93/2016), it has clearly been mentioned vide Item No. 2.1 of Annexure 'B' that in the case of ASMs GP 2800, their Grade Pay has to be revised to Gp 4200, therefore they are to be fitted in Pay Level-6 of 7th CPC. Note at Item No. 2 clearly states that ASMs in GP 2800 should be upgraded to 4200 and then fitted in the revised pay Matrix and the designation of ASM shall stand abolished and the post of ASMs shall stand merged with the post of Station Master (GP 4200) along with functions. However, the Note further states that the revised AVC, inter-se-seniority, recruitment rules, classification as decided by the Board, will be issued through separate letters. There are no instructions to treat such upgradation as promotion particularly for those ASMs who have been recruited in GP 2800/-.
• Federation also brings to the notice of Railway Board the condition no. 5 mentioned in Annexure to Board's letter dated 10/06/2009 (RBE No. 101/2009) which stipulates as under:-

"Promotions earned/upgradations granted under the ACP Scheme in the past to those grades which now carry the same Grade Pay due to merger of pay scales/upgradations of posts by the 6th Pay Commission shall be ignored for the purpose of granting upgradation under MACPS".

Federation further states that based on the above positions, Railway Board have issued clarification vide letter dated 10/06/2009 (RBE No. 17/2009), that on the analogy of Para 5 of the Annexure to Board's letter dated 10/06/2009, that promotions earned or upgradations granted under ACP Scheme of 01/01/1999 in the past to the four pay scales mentioned above, which now carry the Grade Pay of Rs.1800 shall be ignored for the purpose of MACPS.

Federation requests the Railway Board to kindly review the case denovo, taking into account the points raised above as also the PNM Agenda Item No. 15/2017 and grant 3rd MACP to the Station Masters in GP 5400/ Pay Level-9 on completion of 30 years service. The subject will be discussed in the ensuing PNM meeting with the Railway Board on 25th/26th April. 2019.

2. Period and other terms and conditions of deputation:
The initial period of deputation shall be for three years extendable by a further period of two years, as per Department of Personnel & Training O.M.No 6/8/2009-Estt. (Pay-II) dated 17.06.2010. The terms and conditions of deputation will be governed by the DOP&T's aforementioned O.M. of 17.6.2010 and Government of India's instructions issued from time to time on the subject.

Age Limit
The maximum age limit for appointment on deputation shall not exceed 56 years as on the closing date of receipt of application

Eligibility for Government Accommodation
As per the ongoing arrangement (further continuity of which is subject to approval of Ministry of Urban Development), the officers appointed in the UIDAI will be eligible for General Pool Residential Accommodation at par with Central Government employees.

3. Eligible and willing candidate may apply through proper channel in prescribed format Annexure I Cadre authorities / Head of Departments are requested to forward applications of eligible and willing candidates whose services can be spared on deputation immediately on their selection.
