He hinted in this article that most of the pay commissions have accpeted 70% of the staff side demand. Especially NC JCM Staff Side demands to fix minimum wage at Rs.26000. Minimum Wage and Fitment Formula.
The Staff Side (JCM) has calculated minimum wage as on 1st Jan 2014 as per the Dr. Aykroyd formula as Rs 26,000/- taking into following prices.

Minimum Wage 7th CPC

The 7th CPC also would adopt Dr. Aykroyd formula for the computation of the minimum wage and thereafter the fitment formula is calculated.

Fitment formula = Minimum wage / Rs 7000
The Staff Side (JCM) has calculated the fitment formula of 3.72 that is Rs 26000/ Rs 7000 as on 1st Jan 2014.

The 7th CPC has hinted that the date of effect of the 7th CPC shall be from 1st Jan 2016. In this context the minimum wage and fitment formula, should be as follows.
The increase in prices between 1st Jan 2014 to 1st July 2015 is 18% as the DA as on 1st Jan 2014 was 100% and likely DA as on 1st July 2015 is 118%, In actual terms the retail prices have increased by over 25%. Even considering the 18% hike in prices from 1st Jan 2014 to 1st July 2015 and adding 7 % likely hike in prices for the period 1st July 2015 to Jan 2016 it works out to 25% hike in minimum wage.

Minimum wage calculated by the Staff Side (JCM) using Dr. Aykroyd formula as on 1st Jan 2014 was Rs 26,000/-

Adding 25% hike in prices between 1st Jan 2014 to 1st Jan 2016, the minimum wage should be Rs 32,000/- and accordingly the fitment formula should work out to 4.5 times.

If we calculate the minimum wage as on 1/1/2016 using the Dr. Aykroyd formula taking into account the current retail prices in Bangalore. It works out Rs 27,000/- and fitment formula as 3.85.
Minimum Wage 7th CPC
There are many rumors on the fitment formula and minimum wage, actually the 7th CPC has made only a draft and they will calculate the actual fitment formula and minimum wage only next month taking into the account the prices as on 1st July 2015 and adding weight age for the period 1st July 2015 to Jan 2016 and work out the fitment formula and minimum wage.

If any fitment formula less than 3.85 and minimum wage of Rs 27,000/- it will be denial of right wages for CG employees.

During the 6th CPC the Staff Side (JCM) has calculated minimum wage as on 1st Jan 2006 as per the Dr. Aykroyd formula as Rs 10,000/-, where as the 6th CPC had provide the minimum wage as Rs 7000/- and the 6th CPC had fixed fitment formula of 1.86. Most of the pay commissions have accepted 70% of the staff side demand. We sincerely hope this 7th Central Pay Commission will also calculate the right wages and fitment formula for the Central Government Employees.

“A series of statements and assurances from various ministers and higher officials had increased the expectations and worsened the situation.”

Sources say that the much anticipated and much-delayed One Rank One Pension scheme will come into effect before the end of this year, ahead of the Bihar elections.

For a very long time now, army personnel have been demanding that the OROP scheme be implemented. They have now stepped up their demand now. Relay fast protests were held in 20 cities, including New Delhi, yesterday.

Prime Minister Narendra Modi had assured a number of times before that he is committed to introducing the scheme. But, the ex-servicemen have openly asked why the government is hesitating to implement the scheme and have warned that they would campaign against the BJP in the upcoming state elections in Bihar at the end of the year.

Following the warning, the Government has stepped up its activities implementing the OROP scheme. It has come to our knowledge that the scheme would be implemented as soon as the government lists out the beneficiaries who are going to benefit from the revised pension scale.

Information sources claim that since a mega-coalition has already been formed to counter the BJP in Bihar, the fear of alienating the ex-servicemen has rattled the BJP-government at the centre.

Centre to survey spending patterns of working class

In a bid to understand the spending patterns and living conditions of working class, the Centre has decided to conduct a survey of workers’ family income and expenditure.

The survey, which will be conducted by the National Sample Survey Organisation, a Government of India body, will be used to finalise consumer price index (CPI) numbers for the working class. The CPI is the base for deciding dearness allowances (DA) of the working class.

“The Working Class Family Income and Exemption Survey-2015 will cover workers engaged in seven organised sectors of employment-registered factories, mines, plantations, ports & docks, public motor transport undertakings, electricity generating and distributing establishments, and railways,” an official from NSSO told Deccan Herald.

The survey will be conducted in 88 centres spreading across 28 states and union territories including Delhi, Karnataka, Andhra Pradesh and Uttar Pradesh. The survey will be conducted in eight places in Karnataka — Bengaluru, Belagavi, Chikkamagaluru, Davangere-Harihar, Hubballi-Dharwad, Kodagu, Mysuru and Mangaluru.

New Delhi: Railways has undertaken an exercise to rationalize the number of employees working in the state transporter and shortlisted four human resource audit companies for the task.

An HR audit company would be identified and entrusted with the task of studying the entire gazetted staff strength, said Railway Board Member (Staff) Pradeep Kumar here today.

Four companies shortlisted for this purpose are Earnst and Young, Deloitte, Price cooper waterhouse and KPMG.

The HR company will examine the Railways’ manpower given the technological development/changes in operational and maintenance practices and determine the optimal level of the staff strength in the coming years, Kumar said.

Currently railways employees 13.36 lakh gazetted and non-gazetted workers.
“We will also hire a reputed consultant to examine the strength in non-gazetted section to study the system and requirement and see if there is any extra flab,” he said.

The Railways will also take into account the international benchmarks before deciding on the issue, the Member (Staff) said.

On the Debroy Committee’s recommendation that railways should not involve in other activities such as running schools, hospitals and RPF, Kumar said “The committee has just given its report and we have to examine it.”

However, he added “there has to be a system to keep railways and its employees in good health. Eventually, to run the Railway system there has to be some agencies to do the job.”
Railways has also taken steps to conduct all examinations online as a fool-proof measures against malpractices.

He said as a major IT initiative, online applications were introduced in two recent exams for the posts of Senior Section Engineers and Junior Engineers (SSEs/JEs) and Para-Medical categories respectively to bring transparency and certainty into recruitment process.

As per the new system, the Railway Recruitment Board (RRB) candidates can keep the question booklets. A pilot project of uploading of answer keys and cut-off marks was initiated in 2014-15, he said.
In the railway recruitment drive during 2014-15, examinations were conducted for 48,822 vacancies in 284 categories.

OFFICE MEMORANDUM

Subject: Revision of time limit for submission of final claims reimbursement of medical expenses under CS(MA) rules, 1944 – regarding.

The undersigned is directed to refer to OM No. F. 29-40/68-MA dated 15.10.1968 in which it was laid down that submission of final claims for reimbursement of medical expenses of Central Government servants in respect of a particular spell of illness should ordinarily be preferred within 3 months from the date of completion of treatment.

2. A representation was received from National Council (Staff Side) to extend the time limit for submission of such medical bills from 3 months to 6 months. The matter was examined in the Ministry and it has been decided that the period of 3 month s for submission of medical claims be revised to 6 months. Henceforth, only the cases in which the bills are submitted after 6 months from the date of completion of medical treatment/discharge of the patient from the hospital are required to be taken up for condonation. The power of condonation of such delays and other terms and conditions would be same as enumerated in the OM No.S.14025/8/99/-MS dated 25.05.1999.

Pay Commission report to be filed by late June

Pay Commission report to be filed by late June

Even as tenure of the State Pay Commission is drawing to a close on June 30, the Commission is keeping itself on its toes to submit the report in time. The date has not been finalised yet in view of the impending by-election in Aruvikkara.

Since the Commission, headed by Justice C.N. Ramachandran Nair, was unable to take decisions on certain crucial issues, the report carries only recommendations on pay scale and pension of the employees.

The members of the commission had earlier sought to extend the deadline to include recommendations covering all the issues. However, the Justice Ramachandran, and other members of the Commission, K.V. Thomas and T.V. George reached a consensus to file the report in time.

Dear Comrade,
As indicated in our last circular letter, the final meeting with the 7th CPC was held on 9.6.2015. Earlier on 8th afternoon, the Staff side had met separately to chalk out the course of negotiations. The National JCA also met on the same day. The National Anomaly Committee met on 9th June, 2015 at 3.00 pm under the Chairmanship of Joint Secretary (E) Department of Personnel at Room No. 72 North Block, New Delhi. We give hereunder a brief synopsis of the discussions at all the meetings.

1. Meeting with 7thCPC

The following Staff Side members were present at the Meeting:

Coms. M. Raghavaiah (Leader Staff Side – NFIR), Shiv Gopal Mishra (Secretary, Staff Side-AIRF), Com. Guman Singh, R.P. Bhatnagar and Com.Sharma (all from NFIR), Com. Rakhal Dasgupta, Com. J.R Bhosale (AIRF) Com. KKN Kutty, M.S. Raja and Com. M. Krishnan (from Confederation and NFPE) Com. Srikumar and Com. R.N. Pathak (from AIDEF) Com. Srinivasan and Com. Surjeet Singh ( From INDWF)
(a) Date of effect: The Chairman has made it clear that the Commission would recommend 1.1.2016 as the date of implementation of their recommendations. The Commission would finalise its report by end of August and would submit the same to the Government thereafter. They would adopt Dr. Aykroyd formula for the computation of the Minimum wage. To the specific query made by the Staff Side, the Commission said that they would factor the probable increase in the rate of retail prices of the commodities and would arrive at the minimum wage as on 1.1.2016. There had been no reply to the loss of wages to the employees due to the erosion of the real value of wages as there was no interim relief or benefit accrued from the merger of DA. These demands, therefore, stand rejected.

(b) Increase in the insurance coverage in cases of death in harness: The Staff Side recalled the assurance held out by the Commission earlier to have the actuarial assessed by an expert agency to accede to the demand of the staff side to increase the subscription and the insurance coverage. The Staff Side was of the opinion that their suggestion to share the subscription in the ratio of 3:7 was reasonable but in the absence of an expert study, the Government might not accept the same. The commission said that they would explore the possibility of such an assessment by the LIC before finalization of the report.

(c) Fitment formula. The Commission might accept the suggestion made by the Staff Side in respect of fitment formula with requisite change in the ratio on the basis of the quantum of minimum wage determined.

(d) Open ended pay scales: The Commission would recommend open ended pay scales as suggested by the Staff Side.

(e) In the matters of rate of increment, quantum of allowances etc, the Commission did not come out clearly of their thinking in the matter.

(f) Parity in pension entitlement of the past and present pensioners. The Commission is yet to make up its mind on the suggestion made by the staff side in the matter. They however said that almost all the Pensioners organizations which met the Commission had pleaded for this and the same is linked with the one rank one pension demand of the Armed forces personnel.

(g) MACP scheme: The difficulties and anomalies pointed out by the Staff Side and various other organizations have been taken note of by the Commission. The Commission assured to evolve a methodology to resolve the problem.

(h) Opposition to the induction of casual/daily rated workers and contractorisation. The Commission said that they were opposed to the unfair practice of exploitation of labour. For jobs which are of perennial and permanent character, regular workers must be recruited, the Commission added and that would obviate the need for outsourcing and contractorisation. Since most of the outsourced jobs do not require any academic qualification, the Commission was of the opinion that the revival of Group D cadre would help to address the issue. However, the Commission stated that if only the staff side sends in a communication in writing, the Commission would be able to make any recommendation in the matter. The Staff Side reiterated that they are totally opposed to outsourcing, induction of casual workers and contractorisation and the same has been made explicit in their memorandum.

(i) Parity in the pay scales between the personnel in the Central Sectt and those in the subordinate establishments.
The Commission stated that they have appreciated the stand taken by the Staff Side in the matter.
The Commission was non committal on other issues raised by the Staff Side members.
2. National Anomaly Committee meeting
The meeting was held at Room No. 72 North Block, under the Chairmanship of J.S(E) Department of Personnel and Training. In the initial remarks, the Staff side raised the following issues.
(a) Though the official side had promised to provide an action taken statement on all issues in the National Council, the same has not been supplied;

(b)No date for the National Council is indicated.

(c) No indication of the steps taken to convene the Departmental Councils. The official side had assured of the convening of the Departmental Council of the Ministry of Finance in the last meeting. However, the staff side has not been apprised of any date so far.

(d) Abnormal delay in replying to the references made to the Ministry of Finance, Department of Personnel from the Railways and other Ministries.

(e) The necessity to increase the ceiling limit of the rebate in Incometax for the allowances given to the Loco Pilots.

(f) Non-adherence to the GOI instructions by the Defence Ministry in certain matters.
The Official side stated that the Action taken Statement was almost ready but for certain comments from Certain departments. The same would be sent to the staff Side and another meeting held to discuss the course of action required on items where no agreement could be reached. The JS (per) stated that some of the references received from the Railways had been sent back to them for clarification before a final decision is taken. Regarding increase in the rebate ceiling under the Income tax Act, the matter would be referred to the revenue department and requested the staff side to appreciate that the same has to be considered in a wider perspective. Thereafter the agenda items, which had not been discussed even once were taken up.

(ii) Anomaly in the Pay Band and Grade Pay assigned to the Group B Officers of the Audit and Accounts, Incometax, , Central Excise and Customs and Postal Departments. (Agenda Item No. 1 and 8 taken together.) Despite agreeing that there existed an anomaly in the matter, the official side expressed their inability to proceed further in the matter as the Group B Gazetted Officers were beyond the ambit of the JCM scheme. However, they agreed that the Govt. would take up the issue specifically with the 7th CPC. Com.Shiv Gopal Mishra said that the Govt. must consider a JCM set up for the promote officers as their cases are not heard or discussed at any other forum. Com. Kutty said that the items were introduced as early as in 2009 and it was not correct on the part of the official sided to state that the same would be referred to the 7th CPC. Normally the Pay Commission would not entertain to consider the anomalies of the earlier Commissions. However, after some discussions, it was agreed that they would discuss the issue of audit & accounts scale (AAOs) separately after receiving a note from Staff Side and in respect of others, a note will be submitted to the 7thCPC.

(iii) Anomaly in the pay and Grade Pay of Data Processing Assistants Grade A.. The official side did not agree with the contention that the assigning of higher grade pay to certain categories of officers (7450-11500 and Grade Pay4600) was arbitrary. The Government, they added, had acted upon the recommendation of the 6th CPC. They also said that only in those cases where the pre-revised pay scales were in 6500-10500 such up-gradation had been made. In the case of DPA Grade A, they were in the pre revised scale of pay of Rs. 5500-9000.

(iv) Item No.3. Grant of Grade pay of Rs. 4200 to Lab Technicians. The official side said that the orders have been issued in the matter.

(v) Item No.4. Up-gradation of Pay Band and Grade pay of LDCs and UDCs.
The Staff Side made the following points in support of the item:

(a) The Grade pay of Rs. 1900 assigned to LDCs by the 6th CPC was without any logic and without appreciating the existing vertical relativity between Group D and LDCs and LDCs and UDCs.

(b) While creating the non functional grade in the grade pay of Rs. 4200 in the Central Secretariat, the Department of Personnel, which is the nodal department for all matters concerning the common categories, did not extend the benefit to the UDCs in the Subordinate offices.

(c) The Staff side also pointed out the Department while restructuring the cadre of stenographers in the Central Sectt. earlier, had extended the benefit to all Stenographers in the subordinate offices.
The official side stated that it was not possible for them to address the issue, whatever may be its justification in the background of the setting up of the 7th CPC. They however, assured to make a reference specifically to the Commission.

(vi) Item No.5. Senior Clerks in DMS to be assigned grade pay of Rs. 4200. The matter was stated to be sub-judice.

(vii) Item No. 6 and 12. – Removal of anomaly in the case of artisans staff of different departments & Master Craftsmen pay scale in MMS in Postal Department. The two agenda items being identical were take up together. The Staff side pointed out the glaring discrimination in the matter. They also stated that the number of employees involved is very small. On behalf of the Postal Department it was stated that the recruitment qualification in the Postal Department was VIII Standard and ITI whereas in other establishment, the academic qualification stipulated was X Standard. The Staff side contested the same pointing out that no person is entitled to be admitted to ITI without having X standard qualification. They pointed out that the merger of Artisan Grade I and Charge hand was the root cause of the problem. The official side took the stand that in any case the anomaly cannot be removed at this stage and have to wait till the 7th CPC recommendations are made.

(viii) Item No. 7. Parity in pay scales between the Central Sectt. and subordinate offices. The official side said that the up-gradation of the pay scale of Central Sectt. Assistants were on well found grounds. The Government had considered the repercussion of the said decision and therefore, the decision is not possible to be either reversed or extended to any other category of employees. They added that perhaps the 7th CPC before whom the matter is already agitated by the employees organizations of the subordinate offices might take a decision in the matter.

(ix) Item No. 9 and 10. Higher grade pay for Medical Assistants and Store keepers. The Defence Ministry was asked to submit a detailed note to the Ministry of Finance indicating the duties and responsibilities assigned as also the recruitment qualifications stipulated in the RR to enable them to reconsider the issue.

(x) Children Educational Allowance for any two children. The official side stated that the deviation made in identifying the eldest two children was consciously done taking into account the National Population policy and various other factors and is not likely to be changed. Regarding the claim for reimbursement of expenses incurred in the nursery class, as such institutions or classes are not linked to any Educational Boards, the official side said that they would look into the matter with a view to find a solution thereof.

National JCA meeting on 8th June

The National JCA which met at the Staff side office on 8th June, 2015 took note of the fact quite a few States are yet to hold the State level conventions. The meeting also noted that the strike decision taken on 28th April, 2015 has not been percolated down to the rank and file of the workers. The meeting wanted the affiliate to realize that the denial of the demand for wage revision to be effective from 1.1.2014 and the consequent denial of interim relief and the benefit of merger of DA with pay must be viewed very seriously as the said decision will have a far reaching consequence. The Government would not in future will discard the age old practice of grant of I.R. and merger of DA for ever. It has decided to appeal to all the affiliates to chalk out independent programmes of actions in the months to come and to carry out the same in all seriousness so that the employees become fully aware of the possible outcome of the 7thCPC . The Chairman and Convenor of the National JCA will get in touch with those States, where the programme has not been carried out. The meeting decided to convey to the members that the minimum wage computation, in the given situation would be on an imaginary basis. The National JCA was of the opinion that a meeting of all office bearers of the participating organizations must be convened at Delhi somewere in the month of July to chalk out the programmes of action to be pursued by theCGEs togher

It was informed at the house that both Defence and Railways would be taking their strike ballot and would be concluded in the first week of October. The meeting decided to advise the other units to chalk out progammes of action in July so that an ambience of struggle could be created. The NJCA also took note of the painful fact that despite assurances, Government was not convening the Departmental Councils and the JCM has been allowed to become defunct.

The National JCA in conclusion decided to appeal to all affiliates to take concrete steps to invigorate the joint movement of the Central Government employees and meet the challenge that is like to arise on receipt of the recommendations of the 7th CPC.by creating an atmosphere of Unity, and determination to carry out the call of indefinite strike action scheduled to commence on 23rd November, 2015..

MINUTES OF THE MEETING HELD ON 3rd JUNE, 2015 ON AADHAAR BASED AUTHENTICATION OF LIFE CERTIFICATE FOR PENSIONERS

A meeting to review the progress on Aadhaar-based verification of Life Certificate was chaired by Secretary (Pension) on 3rd June, 2015 in Committee Room, 5th Floor, Sardar Patel Bhawan, Sansad Marg.

2. List of participants is annexed.

3. Secretary (Pension) complimented the various agencies for their efforts. He informed that during the last video conference of “Pragati” on 27th May, 2015, the Hon’ble Prime Minister, while discussing problems being faced by Defence pensioners had inter alia stressed the need for using Aadhaar based system solutions. He also stated that e-tracking of pension matter would be a good step towards preventing delays.

4. Department of Financial Services (DFS) informed that all banks have started accepting Digital Life Certificates (DLCs). So far 2,06,024 pensioners have submitted DLCs. Of these, 1,47,629 take pension through banks and 35,135 through Defence Pension Disbursement Offices (DPDOs). A total of 1,52,587 DLCs have been successfully processed by the system of which 1,12,286 are through banks and 29,768 through DPDOs. Secretary, Department of Electronics and Information Technology (DeitY) expressed concern over the very high rate of rejection by the system, as the user tended to loose confidence in the process. It was agreed that for every rejection of the DLC, the system shall indicate the reason for rejection in the form of a speaking order. It was also hoped that during November, 2015, up to 50% pensioners ought to avail benefit from Jeevan Pramaan.

5. Contact numbers of some of the Common Service Centres (CSCs) being circulated were reportedly not correct. DeitY informed that 55,000 records have been cleaned. At present 6,000 CSCs are functional for Jeevan Pramaan. Secretary (DeitY) expressed concern at this. He stated that CSC SPV (Special Purpose Vehicle) should be asked to continuously update their databank and ensure that correct contact details are displayed at all points of time. Secretary (Pension) shared the concern.

6. Secretary, DeitY also stressed that Unique Identification Authority ofIndia (UIDAI) should facilitate, promote and encourage wide-spread use of Aadhaar number for delivery of public services. Aadhaar numbers of individual beneficiaries should be made available by UIDAI to Government agencies on demand.

7. It was agreed that State Bank of India (SBI) and UIDAI will organise a camp in Manipur as early as possible to facilitate employees/pensioner in getting enrolled for Aadhaar number and registering them under Jeevan Pramaan software.

8. It was agreed that DFS shall immediately, preferably in 2 nd week of June, 2015, call a meeting with % Controller General of Accounts (CGA) and Banks to sort out the following issues at the earliest possible:
(a) Problem with the PPO numbering systems, which are not uniform. It had been agreed that Central Pension Accounting Office (CPAO) will come up with guidelines to tackle this problem.
(b) For making adequate provisions for self-certification regarding re-marriage, income and reemployment in the software, instructions are to be issued by CPAO/CGA.
(c) Determination of proper procedure and putting in place adequate checks for correlating PPO numbers, bank account number and Aadhaar number while seeding the systems.

9. It was once again pointed out that there were a number of glaring discrepancies in Banks’ data, including the number of pensioners above the age of 100 years and a large number of duplicate records in Banks’ databases. DFS has once again been asked to instruct Banks to get their data cleansed on priority.

10. UIDAI informed that Ministry of Railways, Indian Army and Indian Air Force have been appointed as Registrars for enrolment for Aadhaar number.

11. Secretary (Pension) informed the meeting of the Prime Minister’s directive to put in place an e-tracking system to monitor delays in pension cases. It was agreed that possibilities of the Online Tracking System for Pension Sanction and Payment (Bhavishya) being adopted by Ministry of Railways, Ministry of Defence, Department of Posts and Department of Telecommunications would be explored.

12. Department of Posts informed that Post Offices (POs) disburse pension to 3 lakh pensioners of Departments of Posts and Telecommunications and 2 lakh pensioners of other ministries/departments. The department informed that by so” June, 2015, all POs will start accepting DLCs.

13. NIC informed that the posters and pamphlets for giving wide publicity to ‘Jeevan Pramaan’ are ready for display in bank branches, ATM locations, wellness centres, Railway dispensaries, Defence canteens, etc. Willing agencies can obtain these posters and pamphlets from NIC. For this, name, email id and phone number of the officer concerned were made available: Ms. Nandita Chaudhri, DOG, nandita@nic.in , 24305520.

“Members of the National Council JCM, which represents over 40 lakh Central Government employees all over India, met with the team of higher officials of the 7th Central Pay Commission on 9.6.2015”
It was revealed that the meeting with the 7th CPC was very satisfactory. By the end of August, the committee will submit its recommendations and from Jan 2016, the new pay scale, including all the allowances, will be implemented based on this report.

Elaborate discussions were held on crucial issues like Principles of wage determination and Minimum Wage & Ratio of Minimum and Maximum Pay. Also, popular demands like qualification related pay scales, and grant of increment to those retiring on June 30 and December 31, were also presented.

Issues over the fixing of pension parity between past and future pensioners. And the discrepancies in these methods and retirement benefits including revision of pension were also discussed.

JCM urged that the Need-Based Minimum Wage concept to compute pay at the minimum level may be adopted. Pay Commission should take into account the outside rates to determine the pay package at senior levels of bureaucracy but maintain the ratio between the minimum and maximum at 1 : 8 (MTS to Secretary to Govt. of India).

Staff side demanded open- ended pay scales to ensure that no employee stagnates without increment. We have suggested only 14 Pay scales. Minimum of which is Rs. 26000 and Maximum Rs. 78000 for Group C employees. We suggested that the multiplication factor (26000/7000 = 3.7) may be applied uniformly in all the cases to arrive at the revised pay in the new scales of pay. We also suggested that the benefit on promotion, therefore, should be: two increments in the feeder cadre.

A request was made to rectify the defects in the MACP scheme. NC JCM insists to grant five promotions in the service career. It should be given on their hierarchical basis.

Staff Side requested to remove the ceiling of Rs.3500 and request to recommend to the Central to grant the bonus on the basis of the actual emolument of the employee.

The JCM demanded for Educational Assistance for two children, instead of two eldest children, and also to pay the same for Post Graduate and Professional Courses.

The National Council requested to the 7th CPC to review and recommend the scarping of NPS in the light of the observations made by Hon’ble supreme court that pension is a fundamental justify.

Sub: Brief of the meeting held on 09.06.2015 between NC/JCM(Staff Side) and 7th CPC

A meeting of National Council JCM Staff Side with 7th Pay Commission was held on 09.06.2015 at New Delhi. It was last meeting of 7th Pay Commission with JCM. JCM had already submitted memorandum regarding common issues of Central Government Employees to 7th CPC on 30th June, 2015. JCM submitted memorandum in two parts. Part one deals with Pay, allowances, advances, facilities, benefits et., Part II is concerning retirement benefits, viz Gratuity, Pension, Medical facilities etc.
Today delegation of NC JCM Staff side went for final deliberations regarding issues of central government employees and pensioners with 7th CPC.
 
Detailed discussion was held on the following points:-

1. Principles of Wage Determination: Staff Side insisted that 7th CPC should adopt the need based minimum wage formula at the minimum level;the intrinsic value of the assigned job at the intermediary level; the necessity to keep the relativity both at horizontal and vertical level and the need to provide a reasonable salary for the top bureaucrats, taking into account the perks, privileges, benefits, allowances and concessions that go with the posts. 7th Pay Commission gave positive response on this.

2. Minimum Wage & Ratio of Minimum and Maximum Pay:- JCM urged that the Need-Based Minimum Wage concept to compute pay at the minimum level may be adopted. Pay Commission should take into account the outside rates to determine the pay package at senior levels of bureaucracy but maintain the ratio between the minimum and maximum at 1 : 8 (MTS to Secretary to Govt. of India). Staff Side insisted that minimum pay at lowest level of Group C staff should be Rs. 26000. 7th Pay Commission gave positive assurance on this.

3. Proposed Pay Structure and Rate of Increment:– Staff side demanded open- ended pay scales to ensure that no employee stagnates without increment. We have suggested only 14 Pay scales. Minimum of which is Rs. 26000 and Maximum Rs. 78000 for Group C employees. 4. Career Progression: Grant five promotions in the service career:- The three time bound scheme of MACP instead of improving the situation has been found less beneficial and has therefore not gone to address the inherent problem of demotivation that has crept in due to the high level of stagnation.The discontent amongst the employees in the matter is of high magnitude today. The VII CPC therefore, should recommend that the cadre reviews are undertaken wherever not done to ensure five hierarchical promotions to all employees in their career on the pattern obtaining for Group A Officers. 7th Pay Commission assured to act positively on this.

5. Bonus:-Presently the PLB and adhoc bonus are calculated on the deemed provision that one’s total emoluments is only Rs. 3500/-. This is an absolutely irrational stipulation and must be removed. We request that the Commission to recommend to the Government to remove the said stipulation and grant the bonus on the basis of the actual emolument of the employee. 7th pay commission agreed to recommend our demand with positive note.

6. New Pension Scheme:-We requested VII CPC to review and recommend the scarping of NPS in the light of the observations made by Hon’ble supreme court that pension is a fundamental justify. We also insisted that compulsory imposition of NPS on employees has made it discriminatory and recommendation for scrapping NPS and the PFRDA Act may be made. 7th Pay Commission was very much sympathetic.

7. Pension and other Retirement Benefits:-Staff side demanded that the amount of pension must be enough to enable a pensioner to live free from want with decency, independence, and self-respect and at a standard equivalent at the pre-retirement level. We also urged pay commission to examine the principles which should govern the structure of Pension and other retirement benefits, including revision of pension and granting parity between past and future pensioners. 7th CPC assured positive approach towards pensioners.

8. Parity in pay scales – We demanded that, where recruitment rules, training etc. are same, they should be brought into one singular grade/pay scale. Giving example of parity to Stenographers with the Ministry and Subordinate Offices. Similarly, in other common categories like Rajbhasha, Paramedical Staff etc.

9. Insurance Scheme was discussed(earlier also) in detail. It was told by the Pay Commission that something substantial should be done in this regard; and also to consider the issue of enhanced gratuity, for which 7th CPC was seen willing to consider the same.

10. Educational Assistance – we have demanded for Educational Assistance for two children, instead of two eldest children, and also to pay the same for Post Graduate and Professional Courses. Pay Commission has agreed to consider it up to Graduation level.
