This is further to my DO letter No. 7CPC/15/Questionnaire dated 9th April 2014, enclosing a Questionnaire through which the views of your Ministry were sought on the various aspects of the broad issues that the Seventh Pay Commission is mandated to address.

2. While examining the various issues that it is required to look at, apart from the views already sought, the Commission would also need specific data / information on some of the focus areas viz., personnel position, expenditure on salaries and allowances, deployment of contractual staff, training and skill development of personnel, etc. Accordingly, templates for seeking the necessary data have been prepared and are enclosed herewith. Each of the focus areas is covered in a separate Annexure. Data provided by the Ministries / Departments will be crucial in analyzing the key parameters to be studied by the Commission.

3. This composite data template is being shared through the Open Government Data(OGD) platform (data.gov.in). The nodal officers of your Ministries / Department for data collation activity the pre-designed spreadsheets in XLS format and fill them in offline. Once this data collation activity is completed those sheets can be uploaded through the data.gov.in. The Data Controllers of data.gov.in are already familiar with process and methodology of uploading data on to this site. In case your Ministry has not yet nominated the Data Controller, this may kindly be done in accordance with the instructions as contained in the letter of the Cabinet Secretary dated July 18, 2012 in this regard. 4. Instructions may please be issued to the concerned Nodal Officer designated to deal with Pay Commission to furnish replies to the template, complete in all respects. All expenditure related data may kindly be got vetted/ obtained from the Principal CCA/CA of the Ministry / Department in ease of Civil Ministries and by the counterpart officers in the case of Defence, Railways and Posts.

5. I shall be grateful if the data as sought for is furnished to the Commission by 10 June 2014.

In a resolution dated 28th February, 2014, Government of India has appointed the Seventh Central Pay Commission comprising Justice Shri Ashok Kumar Mathur as Chairman, Shri Vivek Rae as full time Member, Dr. Ratin Roy as part time Member and Smt. Meena Agarwal as Secretary. The Commission is headquartered in Delhi and has been given 18 months from date of its constitution to make its recommendations. To this end the Commission will set up its team of Officers, Advisers, Institutional Consultants and Experts and call for required information and documents from Ministries and Departments of Government of India and various Service associations.
 
The dates of appointment and submission of recommendations of the previous six central pay commissions are as under :-

General Conditions:- Leave

• Leave – no claim as a right;
• Can be refused/ revoked;
• Kind of leave applied can not be altered by sanctioning authority;

• Prefix / Suffix – Sundays/holidays;
• MC : Govt servants – from AMA/CGHS Dispensary;
• MC: NGOs – from RMP;
• Period of over-stayal debited as HPL with no pay/allowances;
• Disc. Action on willful absence from duty after expiry of leave.

Casual Leave

• Not a recognised form ;
• Can be combined with special CL / vacation only;
• Sundays/holidays falling during a period of CL not counted;
• Sundays / holidays / restricted holidays can be prefixed/suffixed;
• Can be availed for half a day;
• Total 08 days admissible in a calendar year;
• Normally more than 5 days at a time not allowed;
• Joining in middle of year-proportionately or full – at the discretion.

Earn Leave

• 15 days on 1st January/July in advance;
• Credit reduced @ 1/10th of EOL& Dies non in previous half year;
• Rounding – fraction;
• Accumulation up to 300+15 days;
• Fresh appointment , Retirement /removal / dismissal / death in middle of half year – @ 2½ days per completed month;
• 180 days maximum can be availed at a time, exception
• Unavailed joining time credited in EL account.
• Encashment of E.L. during LTC (10 Days ) / On retirement ( Max 300 days)

Half Pay Leave

• 10 days on 1st January/July in advance;
• Credit reduced @ 1/18th of Dies non;
• Rounding – fraction;
• Accumulation – No limit;
• Fresh appointment – @ 5/3 days p.m.;
• Retirement /removal / dismissal / death in middle of half year
• Temp. Employee – grant subject to his return to duty;
• Can be on MC/without MC;

Commuted Leave

• Not exceeding half of HPL balance on medical certificate;
• up to 90 days during entire service –w/o MC for an approved course of study certified to be in public interest;
• up to 60 days to a female G.S. with less than 02 living children, on adoption of a child less than one year old;
• up to 60 days to a female G.S. w/o MC in continuation of maternity leave;
• Granted only if reasonable prospects of the G.S. returning to duty on its expiry.
• If quits service- period treated as HPL;
• If quits on ill health/death – No recovery.

Leave not due

• To permanent GS with no HPL at credit;
• Only on MC;
• Limited to HPL – G.S. likely to earn in remaining service period;
• Debited in HPL a/c;
• Temp. GS with min. 01 year of service – suffering from TB, Cancer or Mental illness can be granted .
• Not granted as LPR.

Leave not due-Exception

• To female GS w/o MC – in continuation of maternity leave;
• To female GS w/o MC – on adoption of a child less than one year old.
• Max. 360 days during entire service .

Leave Not Due [LND]

• Cancelled if GS does not return to duty – L.S. recovered;
L.S. not to be recovered :
- if resigns due to ill- health incapacitating him for further service,
- if retired prematurely,
- in the event of death.

Extra Ordinary Leave (EOL)

• When no Other leave is admissible; or
• When Other leave admissible, but Govt. servant applies for EOL;
Subject to maximum leave period of 05 years, EOL can be granted to a permanent Govt. servant up to any limit

For temporary officials: -
- Up to 03 months with or w/o MC;
• with a minimum of 01 year’s service- – up to 06 months with MC for common ailments;
- Up to 18 months with MC for cancer, mental illness, pulmonary TB or Pleurisy of Tubercular origine;
• With three or more year’s service
- up to 24 months where the leave is required for studies certified to be in public interest.

Maternity Leave- Female Employees

• Admissible to married/unmarried female G.S.; – Pregnancy: 135 days;
- Miscarriage / abortion: total 45 days in the entire service.
• Leave is not debited to leave account.
• It is granted on full pay.
• It may be combined with leave of any other kind.
• Any kind of leave (i/c 60 days of Comm. Leave/LND w/o MC) up to one year can be sanctioned in continuation of Maternity Leave;
• Not admissible for ‘threatened abortion’

Paternity Leave-Male Govt. Servant

• To male Govt. servant with less than two surviving children.
• It is not debited in leave account.
Leave salary equal to last pay drawn is admissible

 
Study Leave

• Five year’s service (I/c period on probation)
• For higher studies/specialized training in a professional/technical subject capable of widening his mind in a manner likely to improve his ability as a civil servant;
• Study leave can be :
- Granted for maximum 24 months in the entire service and may be granted at a stretch or in different spells;
- not debited to the leave account;
- Requisite Bonds in the prescribed forms are required to be executed
• Finance Ministry’s agreement for release of foreign exchange is necessary for study leave outside India;

• Leave Salary:
- Pay plus DA, HRA, CCA & study allowance admissible outside India;
- No study allowance admissible for course in India.

Special Disability Leave

• When disabled by injury intentionally inflicted or caused in due performance of official duties;
• When disabled by illness incurred in performance of any duty, which has the effect of increasing liability to illness or injury beyond the ordinary risk attached to civil post;
• Period of leave to be certified by AMA;
• Maximum 24 months;
• Not be debited to the leave account;
• First 120 days on full pay , after that on HPL;
• Period counts for pension.

Hospital Leave

• Gr ‘C’ whose duties involve handling of dangerous machinery, explosive material, poisonous drugs or performance of hazardous tasks; and
• Gr ‘D’ while under treatment in a hospital or otherwise for illness or injury directly due to risks incurred in the course of official duties.
• Certificate of AMA necessary;
• Period of leave considered necessary by authority;
• Total period combined with any other kind not exceeding 28 months;
• Not be debited to the leave account;
• First 120 days on full pay , after that on HPL.
• Period counts for pension.

Child Care Leave

Who are entitled for Child Care Leave?
• Child Care Leave can be granted to women employees having minor children below the age of 18 years, for a maximum period of 2 years (i.e. 730 days) during their entire service, for taking care of up to two children whether for rearing or to look after any of their needs like examination, sickness etc. Child Care Leave shall not be admissible if the child is eighteen years of age or older.
• Child Care Leave shall not be debited against the leave account. Child Care Leave may also be allowed for the third year as leave not due (without production of medical certificate)
• No. CCL is not applicable to third Child.
• The Conditions regarding spell of CCL, imposed upon by the Government are that it may not be granted in more than 3 spells in a calendar year and that CCL may not be granted for less than 15 days.
• No. As per the OM of even number dated 7.9.2010, Child Care Leave may not be granted in more than 3 spells. Hence CCL may not be allowed more than 3 times irrespective of the number of days or times Child Care Leave has been availed earlier.

List of Allowances & Advances increased by 25% due to DA touched to 100% with effect from 1.1.2014. 
List of all allowances and advances enhanced by 25% from the existing level from 1st January 2014 in order to enter the Dearness allowance into 100%. Already in January 2011, followed the 6th CPC recommendations, all the allowances and advances had been enhanced by 25% due to Dearness allowance crossed 50% mark. This is second time to get the allowances at revised rates.

Subject: Enhancement of Constant Attendance Allowance in respect of Disabled Armed Forces Personnel.
Reference: Circular No. 410, Circular No. 411 & Circular No. 472.
In terms of Para-8 of GOI, MOD letter No. 16(6)/2008(2)/2008/D (Pension/ Policy) dated 05th May’ 2009 and Para-3 of GOI, MOD letter No. 16(6)/2008(1)/2008/D (Pension/ Policy) dated 04th May’ 2009 “Constant Attendance Allowance shall continue to be admissible under the conditions as hitherto fore. However, it shall be admissible at a uniform rate of i 3000/- PM irrespective of the rank. Further, this rate be increased by 25% every time the dearness allowance payable on revised pay band goes up by 50%.” As per GOI, Ministry of Finance, New Delhi letter No. 1/1/2014-E-I1 (B) dated 27th March’ 2014 the rates of Dearness Allowance has been revised @ of 100%.
2. Therefore, the rates of Constant Attendance Allowance will be again increased by 25% wef 01st January’ 2014 and accordingly the CAA will be payable @  4500/- PM wef 01st January’ 2014. 
3. It is therefore requested that the payment of Constant Attendance Allowance (CAA) may please be regulated accordingly.

7th Pay Commission recommend that 20% interim relief be given to all Central and State Government employees

NMC stresses on 20% Interim Relief for State and Central Government Employees – News Report

The National Mazdoor Conference has urged the Chairman of the newly formed 7th Pay Commission recommend that 20% interim relief be given to all Central and State Government employees.
As per Newspapers report that the National Mazdoor Conference has also strongly demanded that these recommendations be submitted to the new government that is likely to form at the Centre.

The NMC President, Subhash Shastri said in a letter to 7th Pay Commission that along with the State and Central Government employees, the interim relief of 20% of basic pay be also extended to pensioners too and that these demands be recommended as soon as the Election Commission’s restrictions (Model Code of conduct Rules) end.

Shastri emphasised that whenever the recommendation of the commission are submitted to the Central government, the Commission should extend these recommendations to the state governments in general and Jammu and Kashmir in particular.

In addition to these, the National Mazdoor Conference has also demanded on its previous demands for raising the retirement age to 62 and of 50% DA merger.

Last week, the Confederation had released its draft reply to the 7th Central Pay Commission questionnaire. The Secretary General said that a final decision in this regard will be made at the Staff Side National Council Meeting.

Leading federations are going to proclaim their replies in the near future. Employees all over the country are eagerly waiting to see these, especially the opinions and queries of federations like AIRF, and NFIR.

Meanwhile, the 7th Pay Commission has sent a circular to all the federations to submit their replies as memorandum on or before June 30. The Commission has sought the cooperation of all the federations since it has to submit a complete report to the Government within 18 months.

The Federations have advised their affiliate unions to hurry with their opinions, demands and their views on the implementation of 7th CPC. Attention is now being channelized to draft suggestions and demands that include all thoughts and views.

The 7th Pay Commission too is particular about gathering opinion and feedback from all Ministers/Departments and the general public for drafting its recommendations.

Subject: Grant of Dearness Relief to CPF beneficiaries in receipt of ex-gratia payment w.e.f. 01.01.2014 in continuation of this Department’s OM No. 42/13/2012-P&PW(G) dated 17th Oct, 2013, the President is pleased to grant the Dearness Relief at the rate of 5th CPC w.e.f.1.1.2014 to the following …
 
(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12.1985 and are in receipt of ex-gratia @ Rs.600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 & revised to Rs.3000, Rs.1000,Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&PW(E) dt. 27th June, 2013 are entitled to Dearness Relief @ 200% w.e.f. 1.1.2014.
 
(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&PW{E) dated 16.12.1997 are entitled to DR @ 192 % w.e.f. 1.1.2014.
(a) The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m. & revised to Rs 645 w.e.f 04th June ,2013 vide OM No. 1/10/2012-P&PW(E) dated 27th June,2013.

(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs.654/-, Rs.659/-, Rs.703/- and Rs.965/-.
2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee. In their application to the indian Audit and Accounts Department, these orders issue in consultation with the C&AG.
 
3. This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their OM No. 1(4)/EV/2004 dated 2nd May, 2014.

Dear Sirs,
Dearness Allowance for Workmen and Officer Employees in banks for the months of May June & July 2014 under IX BPS/Joint Note dt. 27.4.10
The confirmed All India Average Consumer Price Index Numbers for Industrial Workers (Base1960=100) for the quarter ended March 2014 are as follows:-

Jan 2014 - 5409.74
Feb 2014 - 5432.56
Mar 2014 - 5455.39

The average CPI of the above is 5432.56. The DA paid for the quarter Feb to Apr 2014 was CPI average of 5500. Hence, there is a reduction in CPI of 67.44 Points (16 slabs).

Consequently, dearness allowance to employees is payable for 650 slabs for the period May, June & July 2014 i.e. a decrease of 16 slabs over the current level.

In terms of clause 7 of the 9th Bipartite Settlement dated 27.04.2010 and clause 3 of the Joint Note dated 27.04.2010, the rate of dearness allowance payable to workmen and officer employees for the months of May, June & July 2014 shall be 97.50% of 'pay'. While arriving at dearness allowance payable, decimals from third place may please be ignored.

We advise banks to pay the difference between the old and revised salary and allowances to officers on an ad hoc basis, pending amendments to Officers' Service Regulations.

Subject: Rates of Dearness Allowance applicable w.e.f. 1.1.2014 to employees of Central Government and Central Autonomous Bodies continuing to draw their pay In the pre-revised scale as per 5th Central Pay Commission.
The undersigned is directed to refer to this Department’s O.M. of even No. dated 7th October, 2013 revising the rates of Dearness Allowance in respect of employees of Central Government and Central Autonomous Bodies who continue to draw their pay and allowances in the pre-revised scales of pay as per 5th Central Pay Commission.
2. The rates of Dearness Allowance admissible to the above categories of employees of Central Government and Central Autonomous bodies shall be enhanced from the existing rate of 183% to 200% w.e.f. 1.1.2014. All other conditions as laid down in the O.M. of even number dated 3rd October, 2008 will continue to apply.


3. The contents of this Office Memorandum may also be brought to the notice of the organizations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.

One of the possible reasons for the dampening interest could be the fact that unlike last time, there is not going to be a DA hike. Although it is very well known that the hike is based on price rise and inflation, it probably feels to them as if something was lost.
This time there is no double-digit increase. It is only going to be a single-digit hike.
At the most, one can expect an increase of 7%. That too is not for sure. All that depends on the soon to be announced AICPIN points for balance months.
After announcing the second additional DA for the year 2014, there are only two instalments left. With the instalments of January 2015 and July 2015, the 6th CPC comes to a close.
The next additional DA will be based on the 7th CPC.

Additional Dearness Allowance formula could be changed in the 7th CPC. They could announce a new Base Year. There could also be a change in the 115.76 yardstick. Nothing can be said for certain this time.
There is already a proposal to change the Labour Bureau Base Year from ‘CPI-IW 2001=100’ to ‘CPI-IW 2015 =100’.  The current series of CPI-IW with base 2001=100 was constructed on the basis of employment data in seven sectors namely, Registered Factories, Mining, Plantations, Ports & Docks, Public Motor Transport, Electricity Generation & Distribution Establishments and Railways sector. The current series comprises of a basket of about 370 items and 289 price collection markets spread across 78 centres of the country.
The new series of CPI-IW will cover 7 sectors and 88 cities in 27 states have been selected for the new recommendation of CPI-IW (2015-100). It is worth mentioning that a special Standing Tripartite Committee (STC) under the chaired by Prof. G.K. Chadda has been created in this regard.
