Sub: Providing a link of CPAO website in the websites of Ministries/Departments and their attached/ subordinate offices to get the status of 7th CPC pension revision by the central civil pensioners.

Sir/Madam,
As you are aware that 7th CPC pension revision for Pre-2016 pensioners/family pensioners is going on in compliance to the DP&PW 0M dated 12th May, 2017. As on date, more than 5 Lakhs pension revision cases of central civil pensioners/family pensioners have been received in Central pension Accounting Office (CPAO). CPAO is receiving many queries from the pensioners/family pensioners regarding status of their pension revision. CPAO is providing the status of pension revision to the pensioners. The pension revision status can also be checked by the pensioners/family pensioners through CPAO website www.cpao.nic.in by entering their 12 digit PPO numbers. For the wider publicity of this facility among Central Civil Pensioners/family pensioners, it is felt necessary that a link of this facility available on CPAO website may be provided in the official websites of your Ministry/Department and its attached/subordinate offices for the benefits of pensioners.

Sub: Grant of Fixed Medical Allowance to Central Government Civil Pensioners residing in areas not covered under Central Government Health Scheme -reg.

The undersigned is directed to refer to this Department’s OM No.38/99/99-P&PW(C) dated 17-4-2000 on the subject mentioned above and to say that in accordance with the instructions contained therein, Central Government Civil Pensioners, residing in an area not served by any CGHS dispensary or any corresponding Health Schemes administered by other Ministries/Departments, as the case may be, even though their places of residence may fall within the limits of a CGHS covered cities, are required to submit the following documents for claiming Fixed Medical Allowance:

a) An undertaking in the prescribed format.

b) A certificate from the Medical Authorities of CGHS or from authorities of corresponding Health Schemes of the concerned Ministries/Departments, as the case may be, that the area where the pensioner is residing is not served by any dispensary under CGHS or the corresponding Health Scheme administered by the Ministry/Department.

2. Keeping in view the difficulties being faced by the pensioners in obtaining the required certificate from the concerned Medical Authorities, the matter has been reconsidered in consultation with the Ministry of Health and Family Welfare. It has now been decided that the pensioners, residing in areas not covered by CGHS or any corresponding Health Schemes administered by other Ministries/Departments, as the case may be, would no longer be required to submit a certificate referred to in para 1 (b) above.

However, such pensioners would continue to submit an undertaking in the following format:
I , a retired employee of ____ (Office Address) declare that I am residing at (Residential Address indicated in PPO) , which area is not covered under CGHS or any corresponding Health Scheme administered by the Ministry/Department of , (as the case may be). I have also not obtained and do not wish to obtain a CGHS Card for availing out-door facilities under CGHS/Corresponding Health Scheme of other Ministries/Departments from any dispensary situated in an adjoining area.

3. A Central Government Civil Pensioner is also required to fill the enclosed Form along with above mentioned undertaking.

4. All the pension disbursing authorities are required to obtain the above undertaking along with the Form, as mentioned in Para 3 above, from such pensioners before sanctioning Fixed Medical Allowance. An entry to this effect should also be made in their PPOs.

Subject: Special benefit in cases of death and disability in service – Revision of Disability Pension/Family pension of Pre-2006 disability pensioners/ Family Pensioners -regarding.

The undersigned is directed to say that the pension of pensioners/family pensioners who were drawing pension/family pension as on 1.1.2006 under the CCS(EOP) Rules was to be revised in accordance with Department of Pension & Pensioners’ Welfare OM No.38/37/2008-P&P&W(A) dated 1.9.2008. Accordingly, instructions were issued vide this Department OM of even number dated 30th September, 2010 for extension of benefits of modified parity to past pensioners for revision of disability pension/family pension covered under CCS(EOP) Rules.

2. Orders were issued vide this Departments OM No.38/37/2008-P&PW(A) dated 28th January, 2013 for further stepping up of normal pension/family pension to 50%/30% of the sum of minimum pay in the pay band and grade pay corresponding to the pre-revised pay scales from which the pensioner had retired, as arrived at with reference to the fitment table annexed to the Ministry of Finance, Department of Expenditure OM No.1/1/2008-IC dated 30th August 2008. It was decided to extend this benefit to pre-2006 disability pensioner/family pensioner covered under the Central Civil Services (Extraordinary Pension) Rules vide this Departments OM of even number dated 20.11.2014.

3. Orders have been issued vide this Departments OM No.38/37/2008-P&PVV(A) dated 30.7.2015 to revise the pension/family pension of all pre-2006 pensioners/family pensioners in accordance with this Departments OM No.38/37/2008-P&PW(A) dated 28.1.2013 with effect from 1.1.2006 instead of 24.09.2012. Accordingly, it has been decided that the benefit of revision of disability pension/extra-ordinary family pension in terms of this Departments OM of even number dated 20.11.2014 would also be applicable w.e.f. 01.01.2006 instead of 24.09.2012.

4. All other terms and conditions in the O.M. dated 3.2.2000, as amended vide O.M. No.45/3/2008-P&PW (F) dated 18.11. 2008, 30.09.2010 and 20.11.2014 shall remain unchanged.

5. This issues with the concurrence of the Ministry of Finance, Department of Expenditure, vide their I.D Note No.1(5)/EV/2012, dated 23.02.2016.

6. All Ministries/Departments are requested to bring the contents of these orders to the notice of controller of Accounts/Pay and Accounts Officers and Attached and subordinate Offices under them on a top priority basis. All Pension disbursing officers are also advised to prominently display these orders on their notice boards for the benefits of disability pensioners/Family pensioners.

Subject : Issue of Pensioners’ Identity Card to pensioners.

The undersigned is directed to say that the instructions were issued by this Department vide O.M. No.41/21/2000-P&PW(D) dated 16/11/2000 for issue of Identity Cards to Central Government pensioners. These instructions were reiterated/clarified vide this Department’s OMs of even number dated 30.4.2013 and 25.7.2013. It has been observed that various Departments/Offices are either not issuing pensioners Identity Card to the retired employees or the Identity Cards are not in the format prescribed vide this Department’s OM dated 25.7.2013.

2. The matter has been reviewed in this Department. It has been decided that apart from the details already prescribed, the Pensioners Identity Card should include the Aadhaar Number of the pensioner (if available). Accordingly, a revised format for the pensioners Identity Card is enclosed (Annexure-I and Annexure-11).

3. Further, the following specifications are laid down for the pensioners Identity Card to be issued by the Departments/Offices from which the pensioner retired:

(i) The Pensioners Identity card should be in the prescribed format.
(ii) The Identity Card should be of the standard size of 8.5 cm x 5.5 cm.
(iii) The Pensioners Identity Card should be printed (and not hand written) on good quality paper of 125 GSM or equivalent.
(iv) The Identity Card would be got laminated by the Department/Office before handing it over to the pensioner.

4. All Departments in the Government of India are requested to issue suitable instructions to the Offices under their control to invariably issue Identity Card to the pensioners in accordance with the instructions issued by this Department.

Grant of Dearness Relief to CPF beneficiaries in receipt of ex-gratia payment w.e.f 01.01.2015.

Subject: Grant of Dearness Relief to CPF beneficiaries in receipt of ex-gratia payment w.e.f 01.01.2015.
In continuation of this Department’s OM No 42/10/2014-P&PW(G) dated 20th October, 2014, the President is pleased to grant the Dearness Relief at the rate of 5th CPC w.e.f. 1.1.2015 to the following:
(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12.1985 and are in receipt of ex-gratia @ Rs.600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 & revised to Rs.3000, Rs.1000, Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June,2013 vide OM No.1/10/2012-P&PW(E) dtd. 27th June, 2013 are entitled to Dearness Relief @ 223% w.e.f. 1.1.2015.
(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 are entitled to DR @ 215% w.e.f. 1.1.2015.
(a) The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m. & revised to Rs 645 w.e.f 04 June ,2013 vide OM No. 1/10/2012-P&PW(E) dated 27th June,2013.
(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs. 659/-, Rs. 703/- and Rs. 965/-.
2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee. In their application to the Indian Audit and Accounts Department, these orders issue in consultation with the C&AG.

3. This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their OM No 1(4)/EV/2004 dated 25.05.2015.

Sub:- Revision of pension of pre-2006 pensioners – reg.

The orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide Department of Pension & Pensioners’ Welfare’s OM dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.

2. The Hon’ble Central Administrative Tribunal, Principal Bench, New Delhi in its common order dated 1.11.2011 in four petitions [OA No.655/2010, 306/2010, 50712010 and 3079/2009] directed that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension with reference to the fitment table applicable for revision of pay of serving employees.

3. A large number of representations from pre-2006 pensioners are being received by the Department of Pension & Pensioners’ Welfare for extension of benefits similar to what had been allowed in case of OA No.655/2010 by CAT, Principal Bench, New Delhi.

4. In this context, it is informed that four Writ Petitions were filed in the High Court of Delhi challenging the order dated 1.11.2011 of Hon’ble CAT in four OAs. These petitions were dismissed on 29.4.2013. Subsequently, four SLPs were filed in the Hon’ble Supreme Court over a period of time against the said order of the Hon’ble High Court. Of the four SLPs, the one pertaining to Central Government SAG (S-29) Pensioners’ Association which was first in the series of said SLPs, has since been dismissed by the Hon’ble Supreme Court on 29.7.2013. As the Review Curative Petition against the said order dated 29.7.2013 also failed, the Government of India decided to comply with the order by extending the requisite benefits to the parties involved in the said SLP. As regards the other three SLPs (Nos.36148-50/2013), Hon’ble Supreme Court in its order dated 19.11.2013 issued notice and made the following observation: .

“Learned Counsel for the respondent submits that during the pendency of these petitions the respondent-writ petitioners shall not precipitate the matter by filing contempt proceedings either before the High Court or before the Tribunal. That statement is recorded. “

5. Thus the issue of revision of pension of pre-2006 pensioners w.e.f. 1.1.2006 as covered under SLP Nos. 36148-50/2013 in the Apex Court which have been tagged with Civil Appeal No.8875-76/2011 filed by Ministry of Defence in a similar matter is subjudice.

Sub: ‘Anubhav’ – showcasing outstanding work done during service – submission of details by a retiring Government employee – to be uploaded on Departmental website – reg.

The Department of Pension & Pensioners’ Welfare is in the process of providing a platform for the retiring Central Government employees to showcase commendable work done during service. It is envisaged that this would provide satisfaction to the retiring employee and also act as a motivator for serving employees. This would also be a wonderful opportunity to garner the resource of retiring employees for voluntary contribution to nation building post retirement. The retiring employee may submit a write-up, not more than 5000 words alongwith appropriate attachments where need be.

2. All Ministries/Departments are requested to inform retiring employees that they may, voluntarily, submit the details in the enclosed Form alongwith Form 5 of CCS (Pension) Rules, 1972.

3. It may be noted that –
(a) Since most successful ventures would have contributions of the entire team, retiring persons may indicate names of other members of the team in the writeup.
(b) Any work that has contributed to the efficiency, economy and effectiveness in government functioning or / and any innovation which led to improved work culture or any other contribution considered significant by the retiring employee may be submitted.
(c) Comments which are religious or political in nature (or gender based or based on caste and creed) will not be permitted. The content should not be such as to disturb communal harmony or be against national interest. There should not be any sensitive or secret information in the write-up.

4.The Head of Office shall check the contents to ensure that the submission is as per format and submit to the administrative head/ authority designated for approval., This exercise would be completed at least one month before retirement and the result uploaded on the concerned departmental website on the facility to be provided by Department of Pension & P.W.

5. The Department of Pension and Pensioners’ Welfare would coordinate and collate the data and information received from various departments.

6. (a) For the employee not belonging to AIS , the write-up would be uploaded on the website of the Department from where he retires and the website of the cadre controlling authority.
b) For employee of AIS, the write-up would, in addition, be uploaded on the website of the cadre controlling authority and the State cadre to which he belongs.

7. While an online system is being designed for this purpose, for which separate set of instructions would be issued, it would be possible for employees to submit hardcopies instead of going online.

8. The Departmental website while displaying the write-up will have a disclaimer that the contents and suggestions are as provided by the retiring employee and the department is not responsible for factual inaccuracies and the veracity of the claims.

Subject :- Revision of pension of pre-2006 pensioners – inclusion of Non-Practicing Allowance (NPA) in revision of pension of retired medical officers

The undersigned is directed to say that in accordance with para 4.2 of this Department’s OM No.38/37/08-P&PW(A) dated 1.9.2008 (as clarified vide OM dated 3.10.2008 and 14.10.2008), the revised pension of pre-2006 pensioners shall, in no case, be lower than fifty per cent of the minimum of the pay in the pay band plus the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired. In the case of HAG and above scales, this will be fifty per cent of the minimum of the revised pay scale. Further, in accordance with OM No.38/37/08-P&PW(A) dated 28.1.2013, the normal pension in respect of pre-2006 pensioners/family pensioners as revised w.e.f. 1.1.2006 in terms of para 4.1 or para 4.2 of the aforesaid OM dated 1.9.2008 would also be further stepped up w.e.f. 24.9.2012 to 50% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale in which the Government servant had retired, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No.1/1/2008-IC dated 30th August, 2008. In the case of HAG and above scales, this will be 50% of the minimum of the pay in the revised pay scale arrived at with reference to the fitment tables annexed to the above OM dated 30.8.2008 of Ministry of Finance (Department of Expenditure).

2. In its judgment dated 27.11.2013 in Civil Appeal No.10640-46/2013 and other connected matters, Hon’ble Supreme Court observed that in accordance with Ministry of Health and Family Welfare’s OM No.45012/11/97-CHS.V dated 7.4.1998, NPA counts as pay for all service benefits including retirement benefits. In implementation of the aforesaid judgement of Hon’ble Supreme Court, orders have been issued vide this Department’s OM No.38/31/11-P&PW(A)(Vol.IV) dated 14.10.2014 read with OM dated 21.10.2014 that in the case of pre-1996 retired medical officers, NPA @ 25% shall be added to the minimum of the revised scale of pay as on 1.1.1996 corresponding to the pre-1996 pay scales from which the pensioner had retired, in cases where consolidated pension/family pension was to be stepped up to 50% / 30% respectively of the minimum of revised pay-scale in terms of OM No.45/10198-P&PW(A) dated 17.12.1998 read with OM No.45/86/97-P&PW(A) (Pt.) dated 11.5.2001.

3. In this Department’s OM of even number dated 14.7.2009, it was clarified that in the case of pre-2006 pensioners, Non-Practicing Allowance is not to be added to the minimum of the revised pay band+Grade Pay/revised pay scale in cases where consolidated pension/family pension as on 1.1.2006 is to be stepped up to 50% / 30% respectively in terms of para 4.2 of Department of Pension & Pensioners’ Welfare OM No.38/37/08-P&PW(A) dated 1.9.2008 (as clarified vide OM dated 3.10.2008 and 14.10.2008).

4. In the OM No. A.45012/2/2008-CHS.V dated 29.9.2008 of Ministry of Health & FW, it is provided that NPA will be treated as pay for the purpose of computing Dearness Allowance, entitlement of Travelling Allowance and other allowances as well as for calculation of retirement benefits. Therefore, the ratio of the said judgement dated 27.11.2013 in CA No.10640-46/2013 would be applicable for revision of pension/family pension of pre-2006 retired civilian medical officers w.e.f. 1.1.2006 also. Accordingly, the OM dated 38/37/08-P&PW(A) dated 14.7.2009 is hereby withdrawn. In the case of pre-2006 retired medical officers, NPA @ 25% would be required to be added to the minimum of the pay in the revised pay band plus grade pay (or minimum of pay in the revised pay scale in the case of HAG and above) as on 1.1.2006 corresponding to the pre-revised pay scale from which they retired, in cases where pension family pension is to be stepped up to 50%130% of the minimum pay respectively.

5. Similarly, for revision of pension family pension w.e.f. 24.9.2012 in terms of OM dated 28.1.2013, NPA @ 25% would be required to be added to the minimum of the pay in the revised pay band plus grade pay (or minimum of pay in the revised pay scale in the case of HAG and above) corresponding to the pre-revised pay scale from which they retired as arrived at with reference to the fitment table annexed to the Department of Expenditure’s OM dated 30.8.2008 subject to the condition that the basic pay plus NPA does not exceed Rs.85,000/- .

6. This issues with the approval of Ministry of Finance, Department of Expenditure vide their I.D. No. 7211E-V/2014 dated 2.1.2015 and Ministry of Law F.No.213/Advice’A’/2015 dated 29.1.2015.

Subject: Special benefits in cases of death and disability in service – Revision of Disability Pension/Family pension of Pre-2006 disability pensioners/Family Pensioners – regarding.

The undersigned is directed to say that the pension of pensioners/family pensioners who were drawing pension/family pension as on 1.1.2006 under the CCS(EOP) Rules was to be revised in accordance with Department of Pension & Pensioners’ Welfare OM NO.38/37/2008-P&P&W(A) dated 1.9.2008. Accordingly, instructions were issued vide this Department OM of even number dated 30th September 2010 for extension of benefits of modified parity to past pensioners’ for revision of disability pension/family pension covered under CCS(EOP) Rules.

2. Further, orders were issued vide this Department’s OM No.38/37/2008-P&PW(A) dated 28th January, 2013 for further stepping up of normal pension/family pension to 50%/30% of the sum of minimum pay in the pay band and grade pay corresponding to the pre-revised pay scales from which the pensioner had retired, as arrived at with reference to the fitment table annexed to the Ministry of Finance, Department of Expenditure OM NO.1/1/2008-IC dated 30th August 2008. The question of extending this benefit to pre-2006 disability pensioner/family pensioner covered under the Central Civil Services (Extraordinary Pension) Rules has been under the consideration of the Government. It has now been decided that the pension/family pension of pre-2006 disability pensioners/family pensioners covered under CCS(EOP) Rules would be further stepped up as under:-

I. Family Pension for Categories B & C

(a) Where the deceased Government servant was not holding a pensionable post: 40% of minimum of Pay in the Pay Band plus Grade Pay (in the case of below HAG scale)! minimum Basic pay in the revised Scale of Pay (in the case of HAG and above) applicable from 1.1.2006 corresponding to the
scale of pay last held by the employee as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1!2008-IC dated 30th August, 2008 subject to a minimum of Rs.4550!– 2-

(b) Where the deceased Government servant was holding a pensionable post: 60% of minimum of Pay in the Pay Band plus Grade Pay (in the case of below HAG scale )/ minimum Basic Pay in the revised Scale of Pay (in case of HAG and above) applicable from 1.1.2006, corresponding to the scale of pay last held by the employee as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated 30th August, 2008 subject to a minimum of Rs.7.000/-

In case where the widow dies or remarries, the children shall be paid family pension at the rates mentioned at (a) or (b) above, as applicable, and the same rate shall also apply to fatherless/motherless children. In both cases, family pension shall be paid to children for the period during which they would have been eligible for family pension under the CCS (Pension) Rules. Dependent parents/brothers/sisters etc. shall be paid family pension one-half the rate applicable to widows/fatherless or motherless children.

II. Family Pension under Categories D & E

Family pension shall be calculated as the minimum of Pay in the Pay Band plus Grade Pay and minimum Basic Pay in the revised Scale of Pay (in case of HAG and above) applicable from 1.1.2006, corresponding to the scale of pay last held by the employee as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated 30th August, 2008.

(a) If the Government servant is not survived by his widow but is survived by child/children only, all children together shall be eligible for family pension at the rate of 60% of minimum of Pay in the Pay Band plus Grade Pay and minimum Basic Pay in the revised Scale of Pay( in case of HAG and above) applicable from 1.1.2006, corresponding to the scale of pay last held by the employee as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated 30th August, 2008 subject to a minimum of Rs. 7000/-

(b) When the Government servant dies as a bachelor or as a widower without children, dependent pension will be admissible to parent without reference to pecuniary circumstances, at the rate of 75% of minimum of Pay in the Pay Band plus Grade Pay and minimum Basic Pay in the revised scale of pay(in case of HAG and above) applicable from 1.1.2006, corresponding to the scale of pay last held by the employee as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated 30th August, 2008, if both parents are alive, and at the rate of 60% if only one of them is alive.

III. Disability Pension for Categories B & C

(a) Disability pension would comprise of a service element equal to 50% of minimum of Pay in the Pay Band plus Grade Pay (in the case of below HAG scale)/minimum Basic Pay in the revised Scale (in case of HAG and above) applicable from 1-1-2006, corresponding to the scale of pay last held by the employee as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated 30th August, 2008, to be reduced proportionately, if the employee did not have required qualifying service for full pension, plus disability element equal to 30% of the same basic pay, for 100% disability.

(b) For disability less than 100%, disability element shall be reduced proportionately. In cases of disability pension where permanent disability is not less than 60%, the disability pension (i.e. total of service element plus disability element) shall not be less than 60% of the minimum of pay in the Pay
Band plus Grade Pay ( below HAG scale) or the minimum basic pay in the revised Scale of pay (in case of HAG and above) corresponding to the scale of pay last held by the employee as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated so” August, 2008 , subject to a minimum of Rs. 7000/- per
month.

IV. Disability Pension for Category D

(a) Disability pension would comprise of a service element equal to 50% of minimum of Pay in the Pay Band plus Grade Pay ( in the case of below HAG scale)/minimum Basic Pay in the revised Scale of Pay (in case of HAG and above) applicable from 1.1.2006, corresponding to the scale of pay last held by the employee as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated so” August, 2008, subject to proportionate reduction in case his qualifying service up to the deemed date of retirement falls short of full qualifying service and disability element equal to 30% of the same minimum of Pay in the Pay Band plus Grade Pay (in the case of below HAG scale)/minimum Basic Pay in the revised Scale of Pay ( in the case of HAG and above) as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated 30th August, 2008 subject to the condition that the aggregate of service and disability element shall not be less than 80% of the minimum of Pay in the Pay Band plus Grade Pay/minimum Basic Pay, in case of HAG and above, applicable from 1.1.2006, corresponding to the scale of pay last held by the employee as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated so” August, 2008 for 100% disability.

(b) For lower percentage of the disability, proportionate reduction would be made in disability element as provided in OM dated 3.2.2000 as amended vide O.M. No.45/3/2008-P&PW (F) dated 18.11.2008.

V. Disability Pension for Cases under Category E

(a) Disability pension would comprise of a service element equal to 50% of minimum of Pay in the Pay Band plus Grade Pay (in the case of below HAG scale or the minimum Basic pay in the revised Scale of pay (in case of HAG and above) applicable from 1-1-2006, corresponding to the scale of pay last held by the employee as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated 30th August, 2008 subject to proportionate reduction in case his qualifying service upto deemed date of retirement falls short of full qualifying service and disability element equal to the same minimum of pay in the Pay Band plus Grade Pay ( in the cases of below HAG scale) or the minimum Basic Pay in the revised Scale of Pay (in case of HAG and above) corresponding to the scale of pay last held by the employee, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure, OM No. 1/1/2008-IC dated 30th August, 2008 for 100% disability.

(b) For lower percentage of the disability, proportionate reduction would be made in disability element as provided in OM dated 3.2.2000 as amended vide O.M. NO.45/3/2008-P&PW (F) dated 18.11.2008.

3. In the case of Disability pension/Family pension calculated as per para 4.1 of OM NO.38/37/2008-P&PW(A) dated 1.9.2008 is higher than the disability pension/family pension calculated in the manner indicated above, the same (higher consolidated disability pension/family pension) will continue to be treated as basic disability pension/family pension.

4. These orders shall take effect from 24.9.2012. There will be no change in the amount of revision disability pension/family pension paid during the period 1.1.2006 to 23.9.2012, and, therefore, no arrears will be payable on account of these orders for that period.

5. All other terms and conditions in the O.M. dated 3.2. 2000, as amended vide O.M. No.45/3/2008-P&PW (F) dated 18.11. 2008 and 30.09.2010 shall remain unchanged.

6. This issues with the concurrence of the Ministry of Finance, Department of Expenditure, vide their 10 No.481/EV/2014 dated 3.9.20145-

7. In so far as persons belonging to the Indian Audit & Accounts Department, these orders issue after consultation with the Comptroller & Auditor General of India.

8. All Ministries/Departments are requested to bring the contents of these orders to the notice of Controller of Accounts/Pay and Accounts Officers and Attached and subordinate Offices under them on a top priority basis. All pension disbursing officers are also advised to prominently display these orders on their notice boards for the benefits of disability pensioners/family pensioners.

JCM (on Pension matters)

The meeting was held under the chairmanship of the Secretary (Pension) at Lok Nayak Bhawan on 25.9.2014. On behalf of the Staff Side, the following comrades attended.

After the introduction of the members of both official and staff side. the Action taken Statement placed by the official Side of the meeting held on 4.2.2014 was taken up for discussion

1. Abnormal delay in the issue of revised PPO to Pre 2007 pensioners/family pensioners.
It was reported that about 26000 PPO of pre 1990 and 10.000 cases of pre-2006 retirees are still awaiting the issuance of revised PPO. It was reported that the main reason for the delay is the non availability of records in the case of pensioners. The Staff side demanded the supply of Department wise break up of the figures to enable them to take up the issue with the concerned department. This was agreed to. The Staff side further stated that the issue should not be viewed from the statistics angle and the official side must appreciate that in the case of pre 1990 cases. the pension remains unrevised for about 20 to 25 years. It may be that some of the retires/family pensioners might have expired during this period. The staff side also requested the official side to appreciate the agony and difficulties of these pensioners. The lack of availability of records should not be taken as an excuse. After some further discussion, it was agreed that by the end of 2014, all pending cases would be cleared. In the case of Railways, the pendency is about 25000 and in the case of Defence the reported figure was 85,000. It was however noted that serious efforts have been made by both the Ministries to bring down the number of pending cases drastically.

2. Revision of commutation table.
The proposal of the official side was to refer the matter to the 7th CPC. which the start Side objected as unreasonable and bereft of any purpose The Staff Side pointed out that the 6th CPC had devised the new commutation table whereby the commutation benefit had been drastically reduced. When there had been a reduction in the commutation benefit, the tenancy period of commutation ought to have been reduced. The 6th CPC has gone on records to state that the period must remain 15 years as there will have to be sufficient room for cross subsidisation. The Staff Side pointed out that when the commutation time was fixed at 15 years long time back, the mortality rate was much higher than it was today and there, there had been no justification for the recommendations made by the 6th CPC. They also pointed out that the official side in an earlier meeting had agreed to refer the matter to an expert committee and subject their recommendation to discussion with the Staff Side. The 6th CPC was not an expert body on this matter and they had to depend upon a professional agency. The Staff Side for this reason objected to the Official Side proposal. The Chairman, after due consideration wanted the Finance Ministry to appoint an expert committee and refer the issue to that committee to consider the demand in the light of the interest rate, morality rate, life expectancy etc.

3. Equitable gratuity under Rule 50 of Pension Rules.
The suggestion made by the Staff Side was to change the slab system by introducing a slab upto 11 years and another upto 20 years. Taking into account the fact that the last slab system was introduced on the basis of the recommendations of the 5th CPC. the issue might be referred to the 7th CPC. The Department of Pension has already referred the same to the 7th CPC and the Staff side has been assured to be supplied with a copy thereof.

NEW ITEMS:
 
(A) Increase in Family Pension:
The demand of the Staff Side was agreed to be specifically referred to the 7th CPC.

(B) Cashless and hassle- free treatment in recognised hospital.
The Official side agreed to ensure that the pensioners are not put to any difficulty in the matter by the recognised hospitals. When the stafi’ side pointed out that the Health Ministry had not been paying the dues to the recognised hospital and that has led to the denial of cashless facility, the Health Ministry denied the same. The Staff side wanted the Health Ministry officials to immediately convene a meeting as the last meeting has been held more two years back. The Health Ministry has decided to look into the matter and explore the possibility of convening such a meeting within a month’s time.

(c) Finalisation of family pension cases within a specified period.
The official side pointed out that the procedure has been simplified and liberalised. The Staff Side pointed out that the delay is caused more by the attitude than on any factual deficiency. They. therefore. suggested for the introduction of a provisional family pension scheme as is the case with the pension for those who face inquiry proceedings They suggested the grant of 75% of the family pension immediately on receipt of application and the rest after the scrutiny of the claim. They also asked for a time frame for finalisation of the claim in as much as the applications must be disposed of within three months.

ADVERTISEMENT FOR ENGAGEMENT AS CONSULTANT

Subject: Engagement of Consultant under the Plan Scheme ‘Pensioners Portal’.

This Department has been implementing a Plan Scheme namely ‘Pensioners’ Portal’ – A Mission Mode Project under NeGP, Government of India.

It is proposed to engage one Consultant at Under Secretary level to assist the Department in undertaking various activities under the Pensioners Portal. The consultancy fee payable to the Consultant so selected is likely to be lump-sum monthly remuneration to be fixed based on pay last drawn under the Government minus pension plus DA (fixed). The present approved tenure of the Consultant may be up to 25th February, 2015. The Consultant so appointed may also be required to undertake tours for outstation activities for which he/she will be paid TA/DA as per Rules.

Retired Under Secretaries/equivalent having worked in social welfare schemes of Ministries/ Departments would be desirable. The retired Govt. servants having recently retired from the post equivalent to that of Under Secretary and desirous of being considered may send their bio-data in the enclosed application form so as to reach the undersigned latest by 24th June, 2014 at the email address tripti.ghosh@nic.in. Subject: Grant of Dearness Relief to CPF beneficiaries in receipt of ex-gratia payment w.e.f. 01.01.2014 in continuation of this Department’s OM No. 42/13/2012-P&PW(G) dated 17th Oct, 2013, the President is pleased to grant the Dearness Relief at the rate of 5th CPC w.e.f.1.1.2014 to the following …
 
(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12.1985 and are in receipt of ex-gratia @ Rs.600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 & revised to Rs.3000, Rs.1000,Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&PW(E) dt. 27th June, 2013 are entitled to Dearness Relief @ 200% w.e.f. 1.1.2014.
 
(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&PW{E) dated 16.12.1997 are entitled to DR @ 192 % w.e.f. 1.1.2014.
(a) The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m. & revised to Rs 645 w.e.f 04th June ,2013 vide OM No. 1/10/2012-P&PW(E) dated 27th June,2013.

(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs.654/-, Rs.659/-, Rs.703/- and Rs.965/-.
2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee. In their application to the indian Audit and Accounts Department, these orders issue in consultation with the C&AG.
 
3. This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their OM No. 1(4)/EV/2004 dated 2nd May, 2014.
