Sub:- Revision of provisional pension sanctioned under Rule of the CCS (Pension) Rules, 1972

The undersigned is directed to say that in pursuance of Government’s decision on the recommendations Of Seventh pay Commission, orders for revision Of pension Of pensioners w.e.f.1.1 .2016 have been issued on 4.8.2016.

2. The following categories of pensioners arc drawing provisional pension under Rule-69 of the CCS (Pension) Rules based 0n their pre-revised pay/pension:-

(i) Retired before 1.1 .2016 and sancüoned provisional pension under Rule-69 of CCS (Pension) Rules on account of departmental/judicial proceedings or suspension.

ii) Suspended before 1.1.20t6 ard sanctioned provisional pension under Rule.69 of the CCS (Pension) Rules on retirement on or after 1.1.2016.

3. The provisional pension sanctioned in the above cases may be revised in the normal course in accordance With the instructions contained in this Department’s NO.38/37/2016- dated 4.8.2016 issued for revision of pension of pre-2016 pensioners.

4. This issues with the approval of Department of Expenditure, Ministry of’ Finance ID No. J(21)/EV/2016 Dated 24.1 1.2016.

Sub:- Issue of Pensioners’ Identity Card to pensioners - reg.

The undersigned is directed to say that instructions for issue of Identity Card to pensioners have been issued from time to time. In this Department’s OM of even numbers dated 25.7.2013, it was inter alia mentioned that it would not be necessary to have the National Emblem on the Identity Card of pensioners.

2. The matter has been reconsidered in consultation with the Ministry of Home Affairs keeping in view the provisions of State Emblem of India (Regulation of Use) Rule, 2007. Ministry of Home Affairs have indicated that they have no objection to the issue of Identity Card to retired Government personnel/pensioners with State emblem. The instructions/clarifications issued by this Department's OM in this regard stand modified to this extent.

3. All Ministries/Departments are requested to keep the above in view while issuing Identity Cards to pensioners who retired from the Central Government Civil Service. This provision will not be applicable in respect of the pensioners retired from the Autonomous Bodies, etc. Such autonomous bodies can, however, use their own logo on the Identity Cards, in accordance with the relevant instructions.

Subject :- Revision of pension in r/o pre-2006 Commissioned Officers/JCOs/ORs pensioners/ Family pensioners.

Reference:- This office Circular No. 547 dated 11.09.2015.

Pension Disbursing Agencies are aware that as per this office Circular No. 547 dt.- 11.09.2015, Service/Family Pension in respect of JCOs/ORs are to be revised w.e.f. 01.01.2006 by the Pension Disbursing Agencies as per tables attached with circular. Specific tables for revision of Special Pension/Invalid Pension/ Service Element of Disability Pension in respect of Pre- 01.01.2006 PBORs retirees discharged with less than 15 years of qualifying service and Service Pension of TA personnel irrespective of their qualifying service have not been prepared as the Pension Disbursing Agencies would not be in a position to revise such cases. Hence, such cases shall be referred to the Pension Sanctioning Authorities by Pension Disbursing Agencies on enclosed Annexure to issue corrigendum PPOs in affected cases.

2. Similarly the DSC personnel who are receiving two pensions, one for regular Army Service and other for DSC Service, their pension for DSC Service shall not be revised. The pension for regular Army service shall be revised under these orders by the Pension Disbursing Agencies. A reference for revision of pension for DSC service will be sent to PCDA (P) on attached Annexure for issue of Corr. PPO. However, Pension of DSC pensioners receiving only one pension for DSC service shall be revised under these orders from attached Table of the Army personnel. DSC pensioners who were on clerical duty and other duty, their pension shall be revised by the attached table for group ‘Y’ and group ‘2’ respectively.

3. Maximum term of engagement for various ranks is mentioned in Appendix ‘X’ of this office important Circular No. 501 dated 17.01.2013. To maintain the uniformity in the tables, the rates have been shown up to the qualifying service of 28 years for each rank. The Service Pension may be revised only up to maximum term of engagement.

4. In Annexure ‘C’ for Navy attached with GOI, MOD letter dated 03.09.2015 circulated vide Circular No. 547, the Column Nos. have been typed erroneously as 2, 3, 5……, same may be treated as re-numbered from ‘1’ upward accordingly. Column No. 21 of Annexure ‘B’ (Air Force) of GOI, MOD letter dated 03.09.2015 circulated vide this office Circular No. 547 has erroneously been typed as ‘2021’, the same may be read as Column No. ‘21’ instead of ‘2021’. Further, in column 9 of Annexure ‘B’, the rate shown for the rank of CPL ‘Z’ against the qualifying service of 25.5 years has erroneously been typed as ‘Rs. 5151’, the same may be read as Rs. 4922 instead of Rs. 5151.

5. Similarly, equivalence of ranks across the three services has also been provided in Circular No. 501 dt- 17.01.2013 and Circular No. 512 dt- 26.06.2013. The rank of Chief Mechanician is equivalent to Chief Artificer. Therefore, the pension of Chief Mechanician shall be revised according to Chief Artificer. As per this office ibid circular, the rank of Mechanician IV is equivalent to Artificer IV. Therefore, the pension of Mechanician lV shall be revised equivalent to Artificer- IV.

6. Further, revision under these order may be done on the basis of rank last held and not for the rank for which pensioned as the same has already been clarified in Note below Annexure-Ill of Gol, MoD letter dated 11.11.2008 circulated vide this office Circular No. 397 dated 18.11.2008 (as amended from time to time).

7. All other terms and conditions shall remain unchanged.

Subject: One day training programme for dealing Assistants/Section Officers dealing with Pension related matters.

In continuation of this department’s OM of even number dated 26th August, 2015 on the above mentioned subject, the undersigned is directed to say that no nominations for the training programme, on pension matters to be held between 10.00 AM to 5.00 PM on 21st September, 2015 at Auditorium No.2, Ground Floor, Institute of Secretariat Training & Management, JNU Campus (Old), New Delhi- 110067, have been received in the department.

The training programme will be inaugurated by Hon’ble Minister of State (Personnel & Pension). Ministry of Agriculture etc. are, therefore, requested to ensure nomination of at least two suitable functionaries of appropriate seniority and dealing with Pension Matters to attend the above training course. Absence of records of verification of service – What says CCS (Pension) Rules?

Central Civil Service (Pension) Rules, 1972 on 29.8.2014 that in the absence of records of verification of service, the retiring Government servant may submit a written statement on plain paper stating that he had in fact rendered service for that period, and shall, at the foot of the statement, make and subscribe to a declaration as to the truth of that statement. The Head of Office shall, after taking into consideration the facts in the written statement admit that portion of service as having been rendered for the purpose of calculating the pension of that Government servant”.

Problems of Pensioners

The financial burden on account of pension has shown increasing trend because of, inter-alia, increase in the number of pensioners, periodic release of dearness relief, etc. it is because of pension liability likely to assume unsustainable proportions that the Government had taken decision in December 2003 to switch over form the “defined benefit” based pension to the “defined contribution” based pension scheme in case of Central Government civilian employees (except the Armed Forces) joining on or after 01.01.2004.

As regards lack of proper maintenance of records regarding delay in sanction of pension and other related problems after the employees retirement, a provision has recently been made by amending the Central Civil Service (Pension) Rules, 1972 on 29.8.2014 that in the absence of records of verification of service, the retiring Government servant may submit a written statement on plain paper stating that he had in fact rendered service for that period, and shall, at the foot of the statement, make and subscribe to a declaration as to the truth of that statement. This was stated by Shri Jayant Sinha, Minister of State in the Ministry of Finance in written reply to a question in Rajya Sabha today.

Subject : Clarification on simplification of procedure for payment of pension and other benefits to AIS officers retiring from Govt of India/State Govt : exercise of option regarding.

The undersigned is directed to refer to this Departments Order No.25014/2/2002- AIS-II dated 11th April, 2007 wherein measures for simplification of payment of pension and other retirement benefits to All India Services officers retiring/retired from Government of India/State Government have been revised and the Government of India had taken over the entire pension liability of all the All India Service officers. Besides, all retiring All India Service officers either from the Central Government or State Government uniformly have the option of drawl of their pension through Government of India or through the State Government. However, in the aforesaid order dated 11th April, 2007, the issue of revocation of their earlier option for drawl of pension exercised by the All India Service pensioners was silent.

(2) Accordingly, keeping in view the aging factor and to ease and comfort in a retired life, the issue of exercising option for drawing pension either from Government of India or State Government was revisited in this Department in consultation with the Central Pension Accounting Office, Department of Expenditure and Department of Pension and Pensioners Welfare and has decided that the option exercised by the pensioner for drawl of pension/family pension either from the Government of India or State Government in reference to this Departments Order dated 11th April , 2007 would continue as “Zero option’ (option exercised at the time of retirement would constitute as zero option).

(3) Thereafter, the retired officer can further make two options for which the first option would be permitted without obtaining the permission of Central Government and the second option would require permission of the Central Government. No further option shall be considered after the Second option is permitted by the Central Government. The first option shall be applied by the pensioner to the Drawing Disbursing Authority Of her/his pension in the prescribed format (Annexure-I).

(4) The proposal for revocation of earlier options which required permission of Central Government shall be applied to the concerned Cadre Controlling Authority of All India Services in the prescribed format (Annexure-II) and such proposal shall be processed in consultation with the Chief Controller (Pension), Central Pension Accounting Office (Department of Expenditure), New Delhi for according approval of the Secretary of the concerned Cadre Controlling Authority .

5. It is to state that every time a change in option is made, it shall be notified to the Central Pension Accounts Office (Department of Expenditure) for carrying out necessary updation in its data base.

(6) The revised format for exercising zero option for drawl of pension in respect of retiring/retired members of All India Services is annexed as Annexure-III.
