Grant of Ten Days Casual Leave to the Industrial and Non-Industrial Employees of all Army DTES at par with other Employees of MOD

2. It has been pointed out by the Staff Side JCM Level III Council that in those Units/Establishments where employees are not getting benefits of 17 closed holidays in a year , may be granted 10 Days Casual leave(CL)
3. In this Connections, it is clarified that as per para 9 of Appendix III of FRSR Part III Leave Rules, all central Government Employees are entitled for Casual Leave as under:-
   

   08 days CL - for those entitled to 17 days gazetted holidays per calendar year
   10 days CL - for those not entitled to 17 days gazetted holidays per calendar year

4. It may be ensured that Casual Leave may be granted as per the above guidelines

7th Pay Commission likely to abolish gazetted holidays

New Delhi: The Seventh Pay Commission is expected to reward the central government by its recommendation on abolishing 18 days gazetted holidays and to provide three days national holidays to central government employees to reform the work culture in central government offices.

Pay commission sources said the number of holidays should come down to improve work culture.
The sources also added, “A survey has revealed that India has the highest number of gazetted holidays per year and close on her heels are her Asian neighbours like Philippines, China, Hong Kong, Malaysia. We need to cut down on holidays to facilitate more work culture.”

The sources argued that the government offices worked only for 196 days in India in a year. Besides, whenever there was election, the government servants were pressed into election work. This affected the routine government business, sources contended.

Earlier, the sixth central pay commission recommended that central government offices should remain closed only on three national holidays (Republic Day, Independence Day and Mahatma Gandhi Jayanti) and all other gazetted holidays should be abolished and the number of restricted holidays (optional) depending on one’s religious persuasion should be increased from two to eight days.

The Seventh Central Pay Commission is also likely to make suggestion for flexible work hours for women and employees with disabilities.

Flexible working gives them greater choice over when and where they work, allowing them to better manage their work-life balance

“As flexi working hours will allow women central government employees to strike a balance between her professional and family responsibility, maintain healthy lifestyles and contribute to parenting well, it is recommended for the same and urge upon the government to work out the modalities in this direction,” the pay panel source said.

“Flexible working can also provide central government employees with disabilities with a ‘bridge’ into retirement. Many of surveys show that often the complete loss of professional work account of disability can leave employees with disabilities feeling depressed and unmotivated, even to the point of affecting mental health. Flexible working time can help employees with disabilities delay retirement without giving up too much of their hard-earned freedom.” said an official.

1. Sundays are Holidays under NI Act. Holidays falling on Sundays are mentioned for the Sunday banking Branches.
2. Muslim festivals which are dependent on the sighting of the moon will be decalred as Holidays by the Competent Authority for date on which the festival would be actually observed in lieu of the date originally notified as Holiday for this festival.
3. ‘W’- Holiday for Woman employees only.
4. List of Holidays may have minor variations as some of the states are yet to finalize the same or may announce changes at the last moment.
5.*** Holiday list for Aruranchal Pradesh and Nagaland are yet to be officially received and thus are subject to change.

* For these States, IBA is yet to issue the circular for holidays under NI Act and thus these will be uploaded as and when the information is available

PS : We have tried to update the details as far as possible from authentic sources. However, there may be changes / discrepancy in the list on account of various issues and thus readers are advised to check with their respective banks for final list of holidays.

Most of the State governments consider the holidays declared for Banks under N I Act to be”Public Holidays”.

IBA has notified that ‘Public Holiday’ declared by Central/State Governments/ Union Territory, includes ‘Sundays’ as indicated under the explanation to Section 25 of the Negotiable Instruments Act. Branches of banks working on Sundays observe their weekly-off on any other day of the week as decided by the Bank and notified to members of staff and public. Therefore, all Sundays will be working days for Sunday working branches, except those Sundays declared as holidays by the Central/ State Government/ Union Territory for a specified festival/occasion in a particular year, under the Negotiable Instruments Act.

Who is Supposed to Declare A Holiday under the Negotiable Instruments Act, 1881?

In terms of Section 25 of the Negotiable Instruments Act, 1881, the expression “public holiday” includes Sunday and any other day declared by the Central Government by notification in the Official Gazette to be a public holiday. However, this power has been delegated by the Central Government to State Governments vide the Government of India, Ministry of Home Affairs’ Notification No. 20-25-56-Pub-I dated 8 June, 1957. While delegating the power to declare public holidays within concerned States under Section 25 of the Negotiable Instruments Act, 1881, the Central Government has stipulated that the delegation is subject to the condition that the Central Government may itself exercise the said function, should it deem fit to do so. This implies that when Central Government itself has notified a day as “public holiday” under Section 25 of the Negotiable Instruments Act, 1881, there is no need for banks to wait for the State Government notification.
