Subject: One-time relaxation to the allottees of General Pool Residential Accommodation (GPRA) in view of Novel Coronavirus (COVID-19) - extension of retention period.

In continuation of the OM of even number dated 25-3-2020 on the above subject, it has been decided by the competent authority that suo-moto extension of retention of quarters granted to the allottees vide OM dated 25.3.2020 for the period from 17.3.2020 to 31.5.2020 shall remain extended upto 30-6-2020.

2. The other terms and condition of the OM dated 25-3-2020 will remain the same.

Sub: One-time relaxation to the allottees of General Pool Residential Accommodation (GPRA) in view of Novel Coronavirus (COVID- 19).

Ministry has been receiving calls from various allottees of Government accommodations, who were / are due to vacate their flats / houses and are not able to do so in the light of the advisories regarding social distancing issued by Ministry of Health and Family Welfare (MoH&FW) under the current global Coronavirus Pandemic (COVID-19). Further, Department of Personnel & Training (DoPT) has issued Guidelines with do’s & don’ts for government personnel vide their O.M. dated 17.03.2020 to contain the spread of this virus. Ministry of Home Affairs (MHA) vide its Order dated 24.03.2020 has issued directions for nation-wide complete lockdown to contain the fast spreading infection.
This extraordinary situation has been considered by the Ministry and it has been decided by the Competent Authority to allow suo-moto retention for the period from 17.03.2020 to 31.05.2020 for all such allottees under the Central Government General Pool Residential Accommodation (CGGPRA) Rules, 2017. This relaxation will be applicable to the following categories:
  • Rule 24(2) - where two allottees, who are in occupation of separate accommodation allotted under these rules marry each other, and are directed to surrender one of the accommodation within one month of their marriage;
  • Rule 40 - which provides for concessional period of retention of GPRA under different cases; and
  • Rule 44 (7 & 8) - which provides for change of accommodation.
2. The suo-moto retention period will be on the payment of licence fees as applicable to the allottee under these rules. No damage will be charged for this period.

3. These relaxations will be given to such allottees also where she/he has become unauthorized occupant of government accommodation before 17.03.2020. However, in such cases, after the retention period of 75 days i.e. upto 31.05.2020, the damage charges at telescopic rates, as was continuing prior to this period, will be resumed.

No, 11011/1/E, II(B)/75 dated 25.02,1977 and to simplify the procedure relating to grant of House Rent Allowance to Central Government employees, the President, in consultation with Ministry of Housing and Urban Affairs and the Staff Side of the National Council (J,C.M,), is pleased to decide that the conditions of applying for Government Accommodation and furnishing of 'No Accommodation Certificate' by Central Government employees to become eligible for House Rent Allowance, are dispensed with for all places, in respect of General Pool Residential Accommodation(GPRA) controlled by Directorate of Estates.

3, Ministries/Departments having their separate pool of residential accommodation for their employees other than GPRA, may adopt these provisions, wherever feasible.

4, These orders shall be effective from the date of issue of the orders.

5, In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller & Auditor General of India.

Subject:- Regularisation of allotment on re-transfer to the last place of posting.

It has come to the notice of this Directorate that some allottees of General Pool Residential Accommodation (GPRA) have retained their accommodation at their last place of posting in contravention of the extant guidelines and instructions on the subject. In this regard, reference is invited to the Rule 54 of Central Government General Pool Residential Accommodation Rules, 2017(CGGPRA Rules, 2017) and it is reiterated that the allottees who have retained General Pool Residential Accommodation (GPRA) at their last place of posting due to their transfer/ posting at non-family stations in violation of the provision of the CGGPRA Rules, 2017 or the extant guidelines, shall not be considered for regularisation of GPRA at their last place of posting.

2. This issues with the approval of the competent authority.

Transformation Cell in Board's office vide their letter No.2018/TransCell/ Process Reforms/Estt dated 05.04.2018 on the subject "Process Reform- Comprehensive Housing Policy" referring to 'Conclave Sampark, Samanvay, Samvad held on December 16, 2017', has directed all GMs/CAOs/DGs that full Board in its meeting held on 4th April, 2018 considered the issue of improvement in housing policy and approved among other items, implementation of telescopic penal charges in case of unauthorized retention of railway quarters in the line of GPRA (MoUD). Accordingly, it has further been advised that GMs/CAOs/DGs may evolve their comprehensive guidelines for uniform implementation at their end.

2. The flat rates of licence fee (Standard Rent) for residential accommodation over the Indian Railways were last revised w.e.f. 01.07.2010, 01.07.2013 and 01.07.2016 vide Board's letter No.F(X)I-2002/11/2 dated 26.12.2017 circulated to all Zonal Railways, Production Units etc .

3. All Zonal Railways and Production Units etc. may take necessary action accordingly.

Subject: Amendment in the provisions for retention/allotment of General Pool Residential Accommodation on re-appointment in an eligible Central Government Office or fresh appointment/re-appointment in Statutory/autonomous/quasi-judicial bodies etc.

Reference is invited to the Directorate of Estates O.M No.12035/28/96-Pol.II(Vol.ll) dated 8.12.2016 on the subject cited above. The matter has been reviewed by the competent authority and it has been decided to amend the para 1(g) of the O.M No.12035/28/96-Pol.II(Vol.II) dated 8.12.2016 as follows:-

"The officers re-employed by the ACC to continue in the same post after superannuation for the extended period shall be permitted to continue in the residential accommodation occupied by them till the end of the tenure and they will be further eligible for retention on of the said accommodation as per the provisions of rule 40 of the Central Government General Pool Residential Accommodation Rules, 2017 on completion of tenure. If officers are re-employed by the ACC in any other post, further retention of the said accommodations as per provisions of rule 40 of the Central Government General Pool Residential Accommodation Rules, 2017 will not be allowed. Further retention of three months only will be granted on completion of the tenure of re- appointment."

2. The other terms and conditions of O.M No.12035/28/96-Pol.II(Vol.II) dated 8.12.2016 will remain same.

3. The above mentioned modification will be effective from date of issue.

Mobile App (m-Awas) for allotment of General Pool Residential Accommodation (GPRA) through Automated System of Allotment (ASA) launched

Mobile App (m-Awas) for allotment of General Pool Residential Accommodation (GPRA) through Automated System of Allotment (ASA) launched

Facility will be extended to the applicants of 8 other cities where ASA has been implemented

Sh. Hardeep Puri, Minister of State for Housing and Urban Affairs (I/C) launched a Mobile App (m-Awas) for allotment of Government accommodations in General Pool Residential Accommodation (GPRA) in Delhi under the control of the Directorate of Estates, here today. Secretary, Housing and Urban Affairs, Sh. Durga Shanker Mishra and other senior officers of the ministry were also present on the occasion. The application has been developed by NIC. The dedicated application of online allotment i.e. e-Awas will support this App. A total number of 61,317 residential accommodations of various types are available in Delhi which are allotted to the eligible Central Government employees through Automated System of Allotment (ASA), by using login Id and password. The app will facilitate the applicants of the Central Government accommodation in Delhi as well as those who are in waiting list, to apply for allotment, view waiting list and the allotment lists. The app is user friendly and can be made operative from an android mobile phone. It can be downloaded free of cost from the website of GPRA i.e. https://gpra.nic.in .

The facility will be extended to the applicants of 8 other cities where ASA has been implemented and for the purpose of registration and filling of DE-II form.

Subject: Revision of flat rate of licence fee for General Pool Residential Accommodation (GPRA) throughout the country.

In terms of the provisions of the Rule 74 of the "Central Government General Pool Residential Accommodation Rules. 2017, the Government has decided to revise the flat rates of licence fee recoverable for the residential accommodation available in General Pool and also in Departmental Pools of Ministries/Departments of the Government of India throughout the Country (except in respect of substandard/unclassified accommodation of Ministry of Defence, 'accommodation for service personnel of the Ministry of Defence and accommodation under the control of Ministry of Railways), as shown in the Annexure.

2. The revised rates of licence fee would be effective from 1st July, 2017. All Ministries/Departments are requested to take action to recover the revised licence fee in accordance with these orders in respect of accommodation under their control all over the country.

3. This issues with the concurrence of Integrated Finance Wing of the Ministry of Urban Development vide Note dated 6/7/2017.

Subject: Revision of flat rate of licence fee for General Pool Residential Accommodation (GPRA) throughout the country.

Subject: Grant of eligibility to the Defence civilian employees for the General Pool Residential Accommodation (GPRA) allotted by the Directorate of Estates Representation from BPMS

The undersigned is to refer to Ministry of Urban Development's OM No. 12033/4/67-Pol.II dated 3rd, October, 1969 on the subject - "Eligibility of the staff of Central Government Office for allotment of residential accommodation from the General Pool-Criteria regarding' and to say that a number of defence civilian employees working in many Defence establishments located in Delhi/New Delhi/Delhi Cantt are not able to avail the facility of GPRA for the reason that their offices have not been declared "eligible offices" for allotment of GPRA allotted by Directorate of Estates (DoE). The small quota of 15% of residential accommodation of the Defence/Army Pool is grossly inadequate and therefore it causes extreme hardship to the defence civilian employees who have to make their own arrangement for residential accommodation.

2. It has been noticed that Dte of Estates has already granted eligibility for GPRA to majority of defence establishments in Delhi. The defence civilian employees serving in these defence establishments are already availing the facilities of Residential Accommodation of Dte of Estates. Only a few defence establishments are not covered in the list of eligible offices maintained by the Dte of Estates and a list of 8 such defence establishments in Delhi is at Annexure.

3. In view of the hardship being experienced by the Civilian employees of these eight defence establishments, it is requested that eligibility code for allotment of General Pool Residential accommodation (GPRA) to the staff of these defence establishments/offices may please be allotted. It is certified that the essential requirements, listed below, for a Central Government offices to be treated as ‘eligible offices' for the purpose of the allotment of Government Residences (General Pool in Delhi) Rules, 1963, are fulfilled by these offices/defence establishments:
(i) These offices/establishments have been situated in Delhi/New Delhi/Delhi Cantt since decades and in most of the cases before independence.
(ii) They are attached/subordinate offices of Ministry of Defence under Government of India.
(iii) The salary of their employees is paid from the Consolidated Fund of India.
(iv) 15% quota of residential accommodation of the Defence/Army Pool is not adequate.
4. This issues with the approval of Defence Secretary.

In partial modification of this Directorate's Office Memorandum of even number, dated 22nd July, 2016 on the subject noted above, the undersigned is directed to state that the matter of charging damages in cases of unauthorised occupation of GPRA quarters has been reviewed by the competent authority and it has been decided to revise the rates of damages for unauthorized occupation of general pool residential accommodation for various cities and other stations in the country as below and the revised rates of damages will be applicable to all unauthorised occupants as on 1.7.2016 and to those who are subsequently declared unauthorized occupant:

2. Damages for unauthorised Occupation: The damages will be charged from the date of cancellation of allotment to the date the GPRA is vacated by the unauthorised allotee and the rate of damages for unauthorised occupation for each type of general pool residential accommodation shall increase in telescopic method from second month onwards i.e. for second month - damages + 10% of rate of damages; for third month - damages + 20% of rate of damages; for fourth month - damages 40% of rate of damages; and so on, limiting to the maximum 5 times of rates of damages charged during the first month of unauthorised occupation.

3. Damages for subletting: Telescopic method will be made applicable for unauthorized occupation in proved subletting cases w.e.f 1.7.2016 on all unauthorized occupants as on 1.7.2016 and who will be declared unauthorized henceforth. The rates of damages will be calculated as two times of damages for first month; two times of damages + 10% two times of damages for second month; two times of damages  + 20% two times of damages for third month; two times of damages + 40% two times of
damages forfourth month and so on, limiting to the maximum 5 times of damages charged in such proved subletting cases during the first month.

4. A ready reckoner for calculation of damages as above is attached.

5. Water charges, Furniture charges etc, if applicable, will be charged apart from the above mentioned damages at the normal rates only.

6. This supersedes this Directorate's GM. of even number dated 4.6.2013 regarding rates of damages for unauthorized occupation of GPRA and OM No.18011/2/2006-Pol.lll dated 22.6.2015 regarding rates of damages for subletting of GPRA throughout the country.

7. This issues with the approval of competent authority.

2. But, it has been observed in many cases that at the time of applying in DE-II Form, a single lady officer apply under single lady category but after marriage of her, do not update her status in DE-II Form and gets accommodation in single lady officer category despite being married. This allotment violates the existing provisions of the Allotment of Government Residences (General Pool in Delhi) Rules, 1963.

3. Therefore, it is to inform that the following instructions should be followed strictly by the applicants applying under Lady Officers Pool and also by the Nodal Officer of the office of the applicant:-
a) The personal information furnished in DE-II Form by a woman employee has to be verified by the office of the applicant as to whether the employee is married or single at the time of submission of the Form as well as at the time of acceptance of allotment of GPRA.
b) A single lady officer should update her records in DE-II Form as soon as she gets married and she will be included in the waiting list of married Lady Officers for the eligible type of accommodation and will get allotment of GPRA from married Lady Officer quota only. In case, a Lady Officer is found to have suppressed information of her marriage and gets an allotment of GPRA from single Lady Officer quota, the allotment shall be cancelled and appropriate action shall be taken as per rules.

Subject: Guidelines on regularization/ allotment of alternate general pool residential accommodation in the name of the eligible spouse / ward of the allottee in the event of death/retirement/transfer of the allottee.

Vide instructions of this Directorate O.M. of even number dated 18.2.2014, guidelines on regularization / allotment of alternate general pool residential accommodation in the name of the eligible spouse / ward of the allottee in the event of death/retirement/transfer of the allottee were issued. On review of the said guidelines, it is found that the issue related to regularization of general pool residential accommodation in the name of eligible spouse/ward of allottee, who owns a house at the place of posting or his / her family owns a house at the place of posting, but his /her policy is covered by allotment of that house has not been inadvertently incorporated in the OM dated 18.2.2014.

2. Therefore, paragraph 2(iv)(f)(i) of the said guidelines is modified and shall be read as below instead of existing entries in the OM dated 18.2.2014:

    “Where the allottee or any member of his / her family owns a house at the place of posting where regularization is being sought. However, either one type below accommodation or same accommodation may be regularized in the name of ward / spouse only in case his / her date of priority was covered on the date of retirement of the retiring allottee or on the date of death of the deceased allottee, irrespective of the fact that they are house-owner at the place of their posting subject to the condition that the licence fee is charged on house owing allottees of general pool residential accommodation as per the guidelines from time to time; and.”
