Cabinet approves Regularization of certain allowances being paid over and above the 50% (pre-revised) ceiling prescribed by DPE to the executives of certain operational category employees of AAI.

The Union Cabinet chaired by Prime Minister Narendra Modi has approved the regularization of certain allowances (Rating allowance, Stress allowance, Proficiency allowance, Flying allowance and Instructor allowance) being paid over and above the 50% (pre-revised) / 25% (revised) ceiling prescribed by Department of Public Enterprises (DPE) to the executives of certain operational category employees viz. Air Traffic Controllers, Communication Officers, and Pilots of Airports Authority of India (AAI) and to keep these allowances outside the purview of 35% (revised) ceiling. Their job entails complex set of tasks requiring very high level of knowledge and expertise, as well as the practical application of specific skills pertaining to cognitive domains (e.g. spatial perception, information processing, logical reasoning, decision-making) communicative aspects and human relations.

The decision has been taken in view of the fact that air-traffic has increased manifold and these technical personnel are keeping the aviation activity over our skies very safe; in order to attract the best talent and to retain the existing trained manpower to provide world-class facilities to air-travellers, these professionals are required to be compensated suitably.

Subject: Payment of DA to the CPA pattern employees of CPSEs on 6th CPC pay scales governed by HPPC recommendations w.e.f. 01.07.2018.

The undersigned is directed to refer to Para No. 2 and Annexure-111 to this Department’s O.M. dated 14.10.2008 wherein the rates of DA payable to the employees of CPSEs who are following CDA pattern pay scales had been indicated.

2. The DA payable to the employees may be enhanced from the existing rate of 142% to 148% with effect from 01.07.2018.

3. The payment of Dearness Allowance involving fractions of 50 paise and above may be rounded off to the next higher rupee and the fractions of less than 50 paise may be ignored.

4. These rates are applicable in the case of CDA employees whose pay have been revised with effect from 01.01.2006 as per DPE O.M. dated 14.10.2008.

5. All administrative Ministries/Departments of Government of India are requested to bring this to the notice of Central Public Sector Enterprises under their administrative control for action at their end.

Subject: Payment of DA to the CPA pattern employees of CPSEs on 5th CPC pay scales governed by HPPC recommendations w.e.f. 01.07.2018-reg.

The undersigned is directed to refer to Para No. 2 and Annexure-III to this Department’s O.M. dated 24.10.1997 wherein the rates of DA payable to the employees of CPSEs following CDA pattern pay scales, who are governed by HPPC recommendations had been indicated.

2. In continuation of this Department’s OM of even number dated 04.04.2018, the rates of Dearness Allowance payable to the employees of CPSEs governed by the recommendations of HPPC, which have not revised their pay scales in terms of DPE O.M. No. 2(54)/2008-DPE(WC) dated 14.10.2008 may be as follows:-
a) In case of CPSEs who have not allowed the benefit of merger of 50% of DA with basic pay as contained in DPE O.M. dated 24.05.2005 to their employees, the DA payable maybe enhanced from existing rate of 324% to 334% w.e.f. 01.072018.

b) In case of CPSEs who have allowed the benefit of merger of 50% of DA with basic pay as contained in DPE O.M. dated 24.05.2005 to their employees.. the DA payable may be enhanced from existing rate of 274% to 284% w.e.f. 01.07.2018.
3. The payment of Dearness Allowance involving fractions of 50 paise and above may be rounded off to the next higher rupee and the fractions of less than 50 paise may be ignored.

4. All administrative Ministries/Department of Government of India are requested to bring the foregoing to the notice of the Central Public Sector Enterprises under their administrative control for action at their end.

GUIDELINES FOR SETTLEMENT OF CLAIMS FOR COMPENSATION ON ACCIDENTS APPLICABLE TO THE DEPARTMENT OF PUBLIC ENTERPRISES.


Preamble

Accidents are unfortunate incidents, occurrences of which cannot be obliterated completely, but can only be minimized by adopting most vigilant practices, safety precautions etc. Sometimes accidents do happen when responsibility and liability cannot be affixed on certain individuals or malfunctioning of certain machinery and the Law recognizes the Principle of 'No faulty Liability' for such unfortunate incidents. In such cases, the loss of life and loss of dependency cost of the dependents of such victims cannot be written off merely on the pretext that negligence on the part of Department or its agencies cannot be substantiated for want of stricter proofs particularly in a welfare state like ours. Therefore, these guidelines have been framed.

1. Title: These guidelines would be called as Guidelines for Settlement of Claims for Compensation.

2. Effective date: The guidelines would be effective from 11.07.2018.

3. Applicability: These guidelines would govern the settlement of compensation claims arising out of accidents resulting into loss of life or permanent disability to a member of general public where the accident happens in any premises where any official activity of the Department is being carried out.

4. Definitions:
  • Accident: Any death or permanent disability resulting solely and directly from any unintended and unforeseen injurious occurrence caused during the maintenance, Operation and provisioning of any public services undertaken by the Department where no negligence can be proved on the part of the Department.
  • Competent Authority: Competent Authority means Secretary to Govt. of India in the Department of Public Enterprises.
  • Department: Means Department of Public Enterprises.
  • Dependent: As defined in the Employee's Compensation Act, 1923.
  • Designated Officer: An Officer designated by the Competent Authority of the level of Under Secretary or equivalent for the purposes of receiving and processing claims for compensation under the present Guidelines.
  • Victim: Any person who suffers permanent disablement or dies in an accident as defined in these Guidelines.
  • Permanent Disablement: A disablement that is classified as a permanent total disablement under the proviso to Section 2 (l) of The Employee's Compensation Act, 1923.
5. Detailed Accident Report: The report prepared by the police within a period of 30 days from the date of incident as per Schedule 1 of these guidelines.
Explanation- For the purposes of the preparation of the detailed accident report. the word "injury" as referred in Schedule -I refers to "permanent disability" as mentioned in clause 4(a) of the Guidelines.

6. Extent of Liability: On the occurrence of any "accident" as defined under these Guidelines, the Department shall whether or not there has been any wrongful act, neglect or default on its part and notwithstanding anything contained in any other law, be liable to pay compensation to such extent as prescribed below:
  • In the event of death or permanent disability resulting from loss of both limbs: upto Rs. 10,00,000 (Rupees Ten Lakh).
  • In the event of other permanent disability : upto Rs. 7,00,000/- (Rupees Seven Lakh).
However, persons claiming compensation under these guidelines will not claim additional compensation from the Department under any other regulation or statute either directly or through a court of law. The claimant shall submit an undertaking to this effect before availing the compensation under these guidelines.

7. Procedure for settlement of claims in respect of compensation
a. The victim or his/her dependent would make an application within a period of 90 days of the accident to the Designated Officer under whose jurisdiction the accident had occurred. The application should be accompanied by the following documents:
  • (i) Proof of age of the victim.
  • (ii) Death certificate of the victim
OR
Permanent disability certificate issued by the Medical Board authorized by the Government.
  • (iii) Certified copy of FIR lodged in respect of the accident.
  • (iv) Proof of applicant's relation with the victim/ Dependency Certificate.
b. The Designated Officer may seek any further documents for settlement of claim to its satisfaction.
Provided that where there are more than one dependent, the Applicant must mention their name, addresses and relations with the victim and the Designated Officer may at its own discretion issue notices to all before releasing the compensation.

c. The Designated Officer on receipt of above application shall take into consideration the Detailed Accident Report submitted by the Police Authority would process the claim of compensation on priority basis but would not normally take more than 30 days for seeking the orders of the competent authority in any case.

d. The Designated Officer, in case where no application is received from the victim/dependents of victims, may on receipt of the detailed accident report proceed suo-moto to initiate the process for consideration for grant of the compensation to the victim/dependents of victim. The payment of compensation whether fully in cash or partly in cash and partly towards reimbursement of medical expenses shall be decided by the sanctioning authority.

e. With effect from the date of the present Guidelines, all contract & agreements to be entered into by the Department with any person or agency for maintenance, operation and provisioning of public service would invariably include a clause whereby any compensation paid under these guidelines shall be recoverable from such person. agency or firm.

f. In no case a claim for appointment of any of the dependents on the compassionate grounds would be entertained by the Department.

8. Method of Disbursement of compensation.
i. The amount of compensation so awarded shall be deposited in a Nationalized bank or if the branch of a Nationalized Bank is not in existence, it shall be deposited in the branch of a scheduled commercial bank, in the joint or single name of the victim/dependents (5). Out of the amount so deposited, 75% (seventy five percent) of the same shall be put in a fixed deposit for a minimum period of one year and the remaining 25% (twenty five percent) shall be available for utilization and initial expenses by the victim/dependent(s) as the case may be. Provided that in exceptional cases, amounts may be withdrawn before one year for Domestic need/marriage in family/ educational or medical needs of the beneficiary at the discretion of the Department.
ii. In the case of a minor, 75% of the amount of compensation so awarded shall be deposited in the fixed deposit account and shall be drawn only on attainment of the age of majority. but not before one year of the deposit provided that in exceptional cases. amounts may be withdrawn for educational or medical needs of the beneficiary at the discretion of the Department.
iii. The interest on the sum shall be credited directly by the bank in the savings account of the victim/dependent(s) on monthly basis.

Subject: Writing of Annual Performance Appraisal Reports (APARs) of top management incumbents of CPSEs from the year 2017-18 onwards

The undersigned is directed to state that in order to correlate the earlier and the new system of award of MoU scores with the system of awarding APAR rating/grade and to ensure that the overall grades are properly calculated in APARs, it has been decided to change the system of award of grade for APAR attributes and benchmarking of grade as contained in para 6 and 7 of Section III and para 10 of instructions of extant guidelines dated 5.4.2010.

2. The revised para 6 and 7 of Section III (Assessment of the achievements made against the targets) and Assessment of Personal Attributes and Functional Competencies) along with revised table for benchmarking of the Grade is enclosed.

3. All administrative Ministries/Departments are requested to take note of the above decision and bring it to the notice of CPSEs under their respective administrative control for information and compliance for completing the APARs of top management incumbents of CPSEs from the year 2017-18 onwards

No.18(6)/98-CG-GL-72 dated 20th October 2005 (copy enclosed) on the subject mentioned above and to state that the residual service would henceforth be reckoned by Public Enterprises Selection Board with reference to the Date of Superannuation of candidates instead of Superannuation age for the purpose of calculating cut-off age for consideration to Board level posts in CPSEs.

DPE issues guidelines to expedite the process for clousure of CPSEs.

Department of Public Enterprises (DPE), Ministry of Heavy Industries & Public Enterprise has recently issued guidelines to expedite the process for closure of CPSEs so that all administrative Ministries would follow uniform procedure for closure of the CPSEs. Earlier, DPE had issued guidelines for “streamlining the mechanism for revival and restructuring of sick/ incipient sick and weak Central Public Sector Enterprises: General principles and mechanism of restricting”. As per these guidelines, the CPSEs were to be categorized into strategic and non-strategic and revival/restructuring strategy was prescribed. However, there are certain CPSEs in non-strategic sector which have no scope for revival and are to be closed in a time bound manner. Since there are employees working in these CPSEs, Government decided that closure should not cause hardship to them and has now laid down a uniform policy to give workers VRS at 2007 notional pay scale irrespective of the pay scale in which they are working.

The guidelines also prescribe the modalities for disposal of movable assets and immovable assets. The guidelines prescribe that leasehold land would be dealt as per the terms of the lease and freehold land would be offered in following order of priority:-

(i) Central Government Departments.

(ii) Central Government bodies/CPSEs.

(iii) State Government Departments.

(iv) State Government bodies/State PSEs/State authorities.

In case the above categories are not interested in taking the land for six months, then the land would be auctioned through MSTC to any entity so that it can be put to productive use.
