Sub: Denial of payment of Breakdown Allowance to the staff working in GP 2000/Level 3 of 7th CPC - reg.

(ii) NFIR's letter No.I/5(g)/Part V dated 11-04-2018
(iii) Railway Board's letter No.E(P&A)II-2017/BDA-1 dated 14-09-2018 (RBE No.138/2018)

Pursuant to NFIR's reference vide letter dated 11-04-2018 relating to admissibility of payment of Breakdown Allowance to the staff working in GP 2000/Level-3 of 7th CPC who were left erroneously in Board’s order dated 30th August,2017 (RBE No.106/2017), Railway Board vide letter dated 14-09-2018 (RBE No.138/2018) have issued clarification for grant of Breakdown Allowance to the Technicians Grade-III though drawing pay in higher pay level under MACPS at the rates prescribed for the post held by the employee. Federation however noticed that the said instructions are not in conformity with the Federation’s demand to grant Breakdown Allowance to the Staff working in GP 2000/Level-3 at the pay received in the same Grade Pay/Pay Level.

In this connection, Federation desires to state that the Breakdown Allowance is treated as Compensatory Allowance and is attached to the extra-ordinary duties performed by such staff. The Board's clarification dated 14-09-2018 limiting the payment of Breakdown Allowance to the post held by the staff i.e. substantive pay in GP 1900, is unjustified and needs to be corrected suitably to render justice to the staff of Technical Categories.

NFIR, therefore, urges the Railway Board to consider the above points and issue amendment to the clarification to letter dated 14-09-2018 soon duly endorsing copy to the Federation.

Sub: Clarifications regarding payment of Breakdown Allowance.
Ref:- Board's letter of even number dated 30.08.2017 (RBE No.106/2017)

In context of Board's letter cited above, references have been received in Board's office from some Zonal Railways, seeking clarifications regarding entitlement of Breakdown allowance to Technician Gr.11l drawing pay in higher level i.e. Pay level 3 under MACPS rather than the pay level available for the post. The issue has also been raised by AIRF in PNM Forum as item No.15/2018 and NFIR in their letter dated 11.04.2018.

2. The matter has been examined in Board's office and it has been observed that the MACP Scheme provides for grant of financial upgradation to the employees on personal basis and there occurs no change in the designation, classification or status. The concerned employees continue to discharge the duties and responsibilities of the post held by them. In view of this, it is clarified that the Breakdown Allowance has to be paid at the rate(s) as prescribed against the respective post mentioned in para-1 of Board's letter cit. 30.08.2017. Accordingly, Technician Gr.III though drawing pay in higher pay level under MACPS, are entitled for Breakdown Allowance at the rates prescribed for the post held by them.

3. The other terms and conditions relating to Breakdown Allowance will remain the same.

4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Subject: Revision of the rates of Breakdown Allowance.

Consequent upon the decision taken by the Government on the recommendations of the Seventh Central Pay Commission relating to Breakdown Allowance, the Board have decided that the rates of Breakdown Allowance indicated in this Ministry’s letter No.E(P&A)II-2007/FE-4/3 dated 25-9-2009 and further revised vide Board’s letter No. E(P&A)I-2011/SP-1/Misc.1 dated 13.06.2011 and No. E(P&A)I-2014/SP-1/Genl.2 dated 19.05.2014 may be revised as under :

2. These orders take effect from 1st July, 2017. Other terms and conditions relating to Breakdown Allowance will remain the same.

3. In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President is pleased to direct that Rule 1420 of Indian Railway Establishment Code. Volume-II, 1987 edition (2005 reprint edition) may be amended as in the Advance Correction Slip No.61 enclosed herewith.

4. This has the sanction of the President and issues with the concurrence of the Finance Directorate of the Ministry of Railways.

ADVANCE CORRECTION SLIP NO. 61 - R.II/1987 EDITION ( 2005 REPRINT EDITION)

1. First para of Rule 1420 (1) and table below Rule 1420 (1) (i) in Indian Railway Establishment Code - Vol-II / 1987 edition (2005 reprint edition) may be substituted with the following :-
(1) Non-gazetted Railway servants employed in Running sheds and Carriage and Wagon Depots who are earmarked for attending to breakdown duties and Relief Train Electrical staff, including Supervisory staff, holding posts upto Level 6 (Rs. 4200 GP) and above in the Pay Matrix (except the Supervisors in charge of Carriage & Wagon Depots, Loco Running Shed or the Electrical Relief Train), shall be allowed the following:-

(i) Breakdown Allowance at the following rates :

(c)    The rate of this allowance will be increased by 25% whenever the Dearness Allowance payable on the revised pay structure goes upto by 50%.
