The undersigned is directed to refer to MOD OMs of even number dated 22.03.2018 and 26.02.2019 on the issue of availability of option for fixation of pay on promotion from the date of next increment (DNI) in the lower post and method of pay fixation from DNI, if opted for, in context of Army Pay Rules 2017. Air Force pay Rules 2017 and Navy Pay Regulations 2017 and to say that the aforesaid OMs dated 22.03.2018 and 26.02.2019 will be applicable in the cases of pay fixation on grant of MACP also in respect of ICOs/ORs and equivalent.

This issues with the concurrence of Defence (Finance) vide their I.D. No. dated 29.01.2019.

Sub: Grant of financial upgradation under MACPS to the staff who are in same Grade Pay for more than 20 years-reg.

Ref: (i) NFIR’s PNM Item No.l/2011.

(ii) Action Taken Statement provided to NFIR during its PNM meeting held with the Railway Board 10/11-05-2018

The subject was discussed in a separate meeting held between the NFIR and Railway Board on l6/10/2017. During discussions, the Official Side conveyed that reply from DoP&T has been received and shared with the Federation. The Official Side further stated that the DoP&T has not agreed to the proposal. Responding to the version of Official Side, NFIR insisted that such of the staff who have completed more than two decades from the date of first promotion and stagnated, should be granted 3rd financial upgradation straightaway under MACPS and requested the Railway Board to make another reference to DoP&T for which suitable examples will be made available by the Federation for referring the matter again to DoP&T.

In this connection, Federation furnishes below a few cases of employees as to enable the Railway Board to apprise to the DoP&T, the cases of no promotion for over two decades.

RWF, Yelahanka:

l. Shri M.N. Indrashekar, appointed as Jr. CMA on 26/07/1983 – regularized on 26/07/1984 in GP 4200/-. He was promoted to GP 4600 on 20th May, 1986 (1st promotion) – granted financial upgradation with GP 4800/- on 01/09/2008 instead allowing 3rd financial upgradation with GP 5400 (PB-2) in view of no promotion for over 2 decades.

2. Shri K.S. Dutta Shivrama, appointed as CMA on l8/11/1985 in GP 4200/-, promoted to GP 4600/- on l8-11-1986 – granted financial upgradation in GP 4800/- on 01/09/2008 instead allowing GP 5400, having stagnated for over 2 decades.

3. Shri R.P. Suresh Kumar appointed as CMA on 19/12/1985 in GP 4200, promoted to GP 4600/- on 28-02-1989 granted financial upgradation in GP 4800/- on 0l/09/2008.

South Central Railway:

4. Shri Kamal Kumar Kuley, appointed a CMA in GP 4200/- on 18/12/1983, and got promoted to GP 4600/- on 0l/01/1984, granted financial upgradation in GP 4800/- on 01/09/2008 instead granting GP 5400 due to stagnation for over 2 decades from the date of first promotion.

5. Shri Amulya Kumar Dhali, appointed as CMA on 31/12/1982 in GP 4200/-, promoted to GP 4600/- on 01/01/1984 and got MACP in GP 4800/- on 0l/09/2008 instead GP 5400, for having stagnated for more than 20 years from the date of promotion.

Federation believes that above illustrations are sufficient to justify the demand for grant of MACP benefit to the staff in GP 5400/- as the staff suffered without promotion for over two decades and also to all similarly situated staff who have been in the same Grade Pay for more than two decades. A copy of the reference made to the DoP&T may be made available to the Federation for takine further action.

Sir,
I am directed to refer to Maharashtra Circle's letter no. STA/MACPs/Bench Mark/2017 dated & 12.2.2017 on the subject cited above and to say that 'Promotion' and 'Modified Assured Career Progression Scheme' (MACP) are two different matters. The first involves higher duties & responsibilities while latter don't.

2.For MACP, DOP&T has issued instruction vide OM No. 35034/3/2015-Estt(D) dated 28.09.2016, accordingly to which the prescribed benchmark would be 'Very Good' for all posts and it will come into effect from 25.07.2016. The communication DOP&T has already been circulated by Estt. Division of the Directorate vide letter no. 7-8/2016-PCC dated 5.10.2016 (Copy enclosed)

3.For promotion, Personnel Division vide letter no. 20-24/2016-SPB-II dated 13.02.2017 has clarified to follow instructions contained DOPT's OM No. 35034/7/97-Estt(D) dated 8.02.2002 until further clarification is issued by DOPT or Department of Posts.

In continuation of Department of Personnel Training’s earlier O.M. of even no. dated 20.01.2016 and dated 01.03.2016 on the above mentioned subject, the undersigned is directed to forward a copy of the decision dated 28.04.2016 of Hon’ble CAT, Calcutta Bench in OA No. 351/00195/2014 filed by Shri S.H.K. Murti & Others Vs. UOI &Ors whereby the demand of the applicant for MACP in promotional hierarchy has been dismissed, for necessary action and compliance. The Hon’ble Tribunal in the aforesaid decision dated 28.04.2016 has held that the MACP benefit would be given in the hierarchy of next higher Grade Pay and not in Grade Pay of promotional hierarchy which will be payable on actual promotion.

2. All Ministries/Departments are requested to upload it on their websites for wider publicity.

Further to above, Federation furnishes below yet another category viz., Shorff cadre (Cash & Pay Department – Receipt side) in which case the ACP Scheme was more advantageous than the MACP Scheme introduced by the Railway Board vide Board’s letter No.PC-V/2009/ACP/2 dated 10-06-2009, w.e.f. 01-09-2008.

Note: * The above comparison clearly establishes the fact that under ACP Scheme the staff got financial up-gradation in Pay Scale Rs.5000-8000/GP 4200/- on completion of 24 years of service whereas under MACP Scheme, the staff gets GP 2800/- (replacement Grade Pay) on completion of three decades and they cannot dream of reaching GP 4200 (PB-2) under MACPS.
 
NFIR, therefore, requests the Railway Board to include the above category of staff in the reference agreed to be made to the DoP&T for seeking guidelines.

With due regards, your attention is invited to the points raised in the JCM meetings by the Staff Side Members of this federation on the subject matter.

You have already clarified that erstwhile ACP Scheme was applicable upto 31.08.2008 and the promotions / upgradations granted prior to 01.01.2006 in the merged grade pay had been ignored for grant of ACP in the promotional hierarchy upto 31.08.2008 and this clarification had already been implemented in favour of supervisory cadre (Chargeman & JWM) of Ord Fys.

On the above analogy, Blue Printer & Record Supplier being a feeder grade for Tracer (upto 20.04.2006) which is a feeder grade for Draughtsman / Chargeman may be granted the 02 financial upgradations under the ACP Scheme by ignoring his movement upto Blue Printer & Record Supplier.

Further, your attention is invited to the order of CAT (Principal Bench) in OA No. 634/2013 (Smt Madhu Malti Tyagi & ors Versus Union of India & others) decided on  22.10.2013 wherein similar case had been dealt with and the relief was granted in favour of petitioners. Respondent No. 3 (General Manager, Ordnance Factory Muradnagar) had published the necessary Factory Order for pay fixation (copy enclosed) in this regard.

In such circumstances, you are requested to take necessary action so that similarly placed all the non-petitioner Record Supplier / Blue Printers may be granted 01st ACP in GP 2400/- and 02nd ACP in GP 4200/- on completion of 12 yrs & 24 yrs regular service between 01.01.2006 to 31.08.2008 & 03rd MACP in GP 4600/- on or after 01.09.2008 on completion of 30 yrs regular service.

Kindly resolve the issue without further delay.

MACP on promotional grade

The employees including Group ‘C’ (which includes erstwhile Group ‘D’) are granted three financial upgradations under Modified Assured Career Progression (MACP) Scheme in the next immediate Grade Pay hierarchy as per CCS(Revised Pay) Rules, 2008 on completion of 10, 20 and 30 years of regular service.

There have been instances where Tribunals and High Courts have directed to grant benefits under Modified Assured Career Progression (MACP) Scheme in the promotional hierarchy. However, in such cases, the order of Court is specific to the applicant only.

This was stated by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Shri Kamlesh Paswan in the Lok Sabha today.

Sub: MACP anomalies meeting held between the Railway Board (Executive Directors) and the Federations-reg.
The position relating to discussions held between the Railway Board (EDS) and the Federations at Rail Bhavan on 12th October 2015 is briefly placed below:-
 
1. Financial up-gradation under MACPS to the directly recruited Gradate Engineers Considering entry Grade Pay as Rs. 4600/- for the purpose of MACP to all the directly recruited Engineering Graduates in Design/Drawing Cadre and other Cadres. (NFIR’s PNM item No. 18/2011)
 
After discussion the Official Side stated that they will collect position relating to Graduate Engineers recruited in Pay Scale of Rs. 5500-9000 who were deprived of MACP benefit while those recruited later on and got Pay Scale of Rs. 6500-10500 through LDCE against 20% DR Quota for further View.
 
2. Third financial up-gradation under MACPS on completion of 20 years of service from the first promotion or 10 years after second promotion or 30 years after regular appointment - Whichever is earlier?
&
7. Grant of financial up-gradation under MACPS to the staff who are in the same Grade Pay for more than 20 years. (NFIR’s PNM Item No. 1/2011).
 
It was agreed to re-consider and discuss with the Federations before making out conclusion on these issues.
 
3. Grant of financial up-gradation under MACP Scheme in the promotional hierarchy (instead of Grade Pay hierarchy) - as per judgment of various Courts.
 
Federation explained that the Grade Pay Rs. 2000 is not existing in the Railways and invited attention of Railway Board to the minutes of the Joint Committee meeting held at the level of DoP&T for review. It was agreed to take action accordingly.
 
4. MACPS benefits to railway employees - cases of employees joining another unit/organization on request.
 
It was agreed to review and re-iterate DoP&T O.M. as it is.
 
5. Provision of all benefits on financial upgrading under MACPS - including entitlements for travel & treatment in hospital etc.
 
Discussed. Official Side stated that the MACP benefits have already been extended as per DoP&T guidelines.
 
6. Non-grant cf benefit of financial up-gradation under MACPS to the staff on North Western Railway.
 
Particulars of individual employees will be obtained from N.W. Railway for considering the case. NFIR invited Board’s attention to its letter dated 13/01/2014.
 
8. Abolition of Pay Scale and Introduction of up-graded Pay Scale with revised designation -Senior Section Engineers (Drawing) - Clarification on entry Grade Pay.
 
Case of Diploma Holder Tracers appointed against DR Quota vacancies as per Board’s orders (pursuant to DC/J CM decision) will be considered positively.
 
9. Non-grant of financial up-gradation under MACP Scheme to the Stock Verifiers working in Zonal Railways/Production Units.
 
Agreed to consider.
 
10. Grant of financial up-gradation under MACP Scheme - Wrongful clarification issued by the Railway Board.
 
NFIR quoted the case of Pharmacists, Guards besides Sr. Clerks joined against Graduate Quota having cleared RRB Examination. It was also contended that the LDCE being part of DR Quota, all such promotions are to be ignored for the purpose of MACP. It was agreed to consider.
 
11. Wrong implementation of MACP Scheme in IT Cadre/Granting of financial benefit under MACP Scheme to EDP Staff.
 
Will be examined.

Modified Assured Career Progression Scheme (MACPS)

MACP clarifications is given with useful illustrations for Defence Civilian Employees. This type of explanations is very useful to know and clarify the doubts of the new scheme. Wittingly to clear in the particular subject, because it is connecting with lifetime promotion of every employee.

This scheme for career upgradations to Central Government employees was introduced with effect from 1-09-2008 with introduction of revised pay rules 2008.

This scheme has replaced earlier scheme of Assured Career Progression Scheme of August 1999.
Under this scheme, an employee would get at least three career upgradations during his entire service on completion of 10,20 and 30 years of service.

Under this scheme an employee would be placed in next higher grade pay on completion of 10 years in previous grade and in case of no promotion has been offered to him.

a. Illustrations of Grant of MACP – Illustration – 1
In case of recruitment of an individual in Grade Pay (GP) of Rs.4200 with no promotion for 10 years,
1st financial upgradation after 10 years with GP-Rs.4600;
2nd financial upgradation after (10+10) 20 years with GP- Rs.4800;
3rd financial upgradation after (10+10+10) 30 years with GP- Rs.5400.

In case of recruitment of an individual in Grade Pay (GP) of Rs.4200 with first promotion after 5 years with GP of Rs. 4600,

The promotion will be considered as 1st financial upgradation;
2nd financial Up gradation after (5+10) 15 years with GP-Rs.4800;
3rd financial up-gradation after (5+10+10) 25 years with GP-Rs.5400.

In case of recruitment of an individual in Grade Pay (GP) of Rs.4200 with 1st promotion in 5 years with GP-Rs.4600 and 2nd promotion after 8 years,(5+8=13 years) with GP of Rs.4800,
He will get only 3rd financial up-gradation after (5+8+10) 23 years with GP-Rs.5400.

b. Norms for grant of MACP
The financial up gradation would be on non-functional basis subject to fitness in the hierarchy of pay band and grade pay.

The only benchmark of “Good” would be applicable till the grade pay of Rs.6600 in PB-3.
The benchmark will be “Very Good” for financial upgradation to the grade pay of Rs.7600 and above.
However, if the financial upgradation under the MACPS also happen to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefits under MACPS as mentioned in Para 17 of the scheme, the benchmark for promotion shall apply to MACP also.

c. Clarifications on MACP

If the promotional hierarchy as per recruitment rules is such that promotions are earned in the same grade pay, then the same shall be counted for the purposes of MACP.

Only the continuous regular service is counted towards qualifying service and the regular service shall commence from the date of joining in direct entry grade on the MACP envisages merely placement in the immediate next higher grade pay as given in Section1, Part A of first schedule of the CCS (Revised Pay) Rules 2008.

Financial upgradation will also be admissible whenever a person has spent 10 years in the same grade pay.
Only regular service rendered in the Central Government Department/Office would be counted for the purposes of grant of MACP.

All tenures spent on deputation, Foreign Service, study leave, all kind of leave, shall be included in the regular service.

d. The benefits of MACP are admissible upto HAG scale of Rs. 67000-79000.
All cases of grant of promotions/ACPs under pre-revised pay scales of Rs. 5000-8000, Rs. 5500-9000, Rs. 6500-10500 and Rs. 7400-11500 and if those merged w.e.f. 1-1-2006 would be ignored for purpose of grant of financial upgradation under the scheme.

MACP scheme was introduced by sixth pay commission and there are lots of anomalies left in this scheme.

MACP on Promotion Hierarchy: Ministerial Staff Association’s appeal contribute for expenditure to fight the case in Supreme Court as per Convener of Steering Committee information that the expenses in the court case are expected to cross over Rs.15 lacs.

All the respected Members of Ministerial Staff Association, Survey of India are hereby informed that Special Leave Petition in the Matter to MACP on Promotion Hierarchy has been filed by the Union of India & Others V/s some of the Government Servants in the Honourable Supreme Court of India.

It is further informed that the undersigned, along with the Vice President (CHQ) MSA has attended the meeting of the Steering Committee on the matter of MACP on Promotion Hierarchy, at New Delhi on 11.12.2014. Convenor of the Steering Committee Com. Pillai had informed the house that the expenses in the subject Court case are expected to cross over Rs. 15 lacs. As such the Central Government Associations/Unions from all over India, have agreed to financial contribution for fighting the case to meet the justice. In the interest of our members, MSA, SOI has also committed to contribute some amount for the purpose.

Therefore, I do hereby appeal to all my respected members of MSA, whether they are affected by the MACP on Promotion Hierarchy or not, to please contribute at least Rs. 100/- per member, with their respective Branch Secretaries and the collected amount with list of members, may be sent to the undersigned latest by 10.02.2015, positively.
